New management policies cannot be limited to the human cost that they bring about. First, the constraints from new management are, to the workers, a source both of satisfaction and trouble ; the effects are ambivalent indeed. Besides, while such constraints make people dependent in new ways, they also cause them to develop strategies in order to resist. In this respect, by dissociating various areas of experience, one can highlight how the people involved strive to give a positive meaning to their work. Finally, as such strategies lean on the very principles of new management, they should not be mistaken for some "resistance to change"

Texto completo da fonteThe Uniform Act governing cooperative societies marked the beginning of a new adventure for the sector of cooperatives in the Organization for the Harmonization of Business Law in Africa (OHBLA) member’s states. OHBLA according to its founding treaty, are to harmonize business law throughout its members states and to promote arbitration therefore regulate capitalist enterprises. The regulation of cooperative was highly awaited for at least one category of cooperative, the credit union. The former legal framework was characterized by the diversity of legal sources and the growing number of bankruptcies in the microfinance sector. It was thus interesting to analyze the impact of the new Uniform act governing cooperative on the legal framework of credit union within OHBLA space. This reflection has done a review of solutions developed by the OHBLA legislator in order to increase the efficacy of credit union. This new legal framework is characterized by a hybridism which could be justified but also unconvincing segmentation of this legal framework. An hybridism of the legal framework because of the footprint of certain cooperative principles but also because of the presence of capitalistic principles. We also noticed that there was an unconvincing share of legislative prerogative which maintains risk of multiple formal legal sources of law governing credit union. This lead us to reflect on a quest for a unified and coherent legal framework for credit union in the OHBLA

Texto completo da fonteFrom its British beginning in the XIXth century in the public schools, sport was meant for the strategic imperatives of controlling student populations and at a larger scale for training a dominating elite. Pierre de Coubertin has set similar goals when importing sport in France, wanting to reform a society considered in crisis. Sport, characterized by a framed and regulated freedom, faced gymnastics, the established method of population control by body practice, characterized by discipline. Above all, as thought by Coubertin, the sport characteristic is fundamentally ambivalent, being both alienating and emancipating. This ambiguity crystallize itself in the issue of egalitarianism. Sport, fundamentally aristocratic in the sense that it benefits only to physically strong people, paradoxically succeeds to show itself as a pure meritocracy where ranking is solely dependent of the provided efforts, thus producing order and work. This meritocratic representation of sport has built itself throughout the XXth century, gradually replacing its aristocratic characteristic. However, despite the evolutions of speeches, the sporting fact remains aristocratic, both on physiological and psychological sides. Some resistances arise: those of sport itself, which can not reduce itself to the sole merit; those of the sportsmen, who elaborate strategies described as unlawful (cheating, doping, etc.) in order to subvert the sport aristocracy. Useful bodies, hardworking minds, submissive personalities are thus produced by this dialectic of merit. Sport exemplifies the values of merit and try to compel its logic, by constituting itself as an apparatus which gradually extends to all fields of the society

Texto completo da fonteOur research has the ambition to study the impact of identifying operational risk within the framework of the evolution of the Basel II regulations.The absence of a theoretical reference relative to the object of our research, the identification of operational risk, the context of strong asymmetry which characterizes the banking organisation, brings us to use two theoretical routes: the contractual theory and more specifically the theory of the agency which better lets us understand the stakes in the implementation of identification. We will also base ourselves on the relative theories of organisational training in an integrative approach of cognitive and behavioural dimensions. Our methodology is based on a case study within a French finance company that has adopted the AMA approach, the approach that is the most developed in terms of operational risk management. Within this establishment, due to their representativeness, we have selected two professions, the “banquede detail” (retail bank) and investment bank. According to an analytical grid of interviews that are based on the components of the regulatory system of identifying operational risk, we present in the second part our results.These results have been analysed first for each profession and then with a vision of case comparison in order to permit a comparison between the cases and to allow the emergence of the invariables in the process of the training identified. The results of our research highlight the interest of the system of risk identification on the compartmental training in the process of response stimulus. However, it also shows the limits within an environment of constant change where the standardisation of processes stops the pertinent utilisation of specific competencies. On the other hand, the type of cognitive training that generates new methods of reasoning at an individual level, structured by the system and developed within the social interaction framework. The exchanges have come from the necessity to identify the risk and to formalize it, oblige the individual to justify him or herself and favorise the confrontation of points of view. These interactions could lead to developing new thinking tied to the needs of the need for argument and the socialisation of the individual thinking that tends to objectivise itself

Texto completo da fonteThe work of maintaining institutions has been barely studied by neo-institutional analysis. We propose to enrich this notion thanks to the empirical study of credit rating. The credit rating industry is characterized by a paradox that lies in the opposition between the permanence that comes with this phenomenon while it is strongly criticized. Based on the approach of Boltanski and Thévenot’s economies of worth, we carry out an analysis of the institutional work of justification performed by the actors at the time of the public consultations led by the American Securities and Exchange Commission (SEC) during the 2000-2010 crisis of justification. A qualitative analysis of 340 comments was conducted using NVivo software. The analysis indicates that the controversies permitted a reaffirmation of the established legitimacy principles, impeding any actual modification of the status quo. During the considered period, we distinguish between a first work of maintenance, lying on a simple confirmation of what actually is, and a process of maintenance much more complex and dynamic, in which various logics are put together in a way that leads to the reaffirmation of the effective legitimacy principles and to the rejection of any logic not involved in the compromise. The previously enounced paradox of credit rating shall therefore be reconsidered: the contestation of rating is precisely fueling the institutional maintenance in the industry. In its stability, the institution is to be conceived here as inseparable from its contestation

Texto completo da fonteThe written form of hieroglyphic signs which represent workers is studied, and compared with iconographic documents and sculpture, to understand the way in which the writing interprets the notion of work, and the elements that the elite wants to fix in the imagery. A lexicographical approach of work is also done. Historical and sociological documentation is lastly used to obtain a more complete appreciation of the perception of the professional organization in the Old Kingdom. Our analysis has come to define the processes used to transcribe the worker in writing and in whole imagery of the Old Kingdom. The parameters which play a part in the composition of the worker’s image, in his appearance, his relation to action or his connection with technique, are thus defined. The link between lexicography and work is also treated. Whole information is then used to define the ideological perception of work at this time. Work is thus considered like a social act, and the worker, linked to a solid community, appears to be integrated in a complex hierarchic system. Work is also perceived as a hard act, practised by a modest population who is dependent on a ruling authority and who put a lot of effort into carrying out his task. Work finally appears as a productive act, and worker, as technician and producer, constitutes an essential link in the process of transformation of materials, and assures the prosperity of the country and the comfort of the elite

Texto completo da fonteAccording to a law issued on july 12th, 1990, the article l. 122-45 of the labour code states the principle that "no employee can be discharged for health reason, unless he is declared unfit for by occupational medicine". This principle does not apply to discharged based on the company disorganization due to absences of the sick employee, but work agreements often limit that discharging possibility. Problems due to the employee physical unfitness are a little different. The law of december 31st 1992 forces the employer, in case of physical unfitness after a suspension period for illness, to propose to the worker an employment compatible with his physical abilities, if necessary by taking measures such as transfer or transformation of the position. Finally, by the effect of january 7th 1981 law, the employees victim of a professional illness have obtained a specific protection of their employment. The legal ban on breaking the work agreement during the period of suspension, concerns unlimited period agreement and limited period agreement, in accordance with special modes for every kind of agreement. At the end of the suspension period, the employee has to reinstate the firm. If he is declared unfitted for the job he had before, the employer must offer him a job adapted to his abilities. Discharge is only admited if it is not possible for the employer to offer him another job, or if the employee refuses the job offered

Texto completo da fonteApplied to law, the Hegelian theory of the dialectic of the master and the slave allows to acknowledge that parties to a contract are no longer mere contracting parties at the moment when the act is formed. They are either weak or strong. Indeed, the employee, the tenant, the insurance policy holder and the debtor are dependent upon the employer, the landlord, the insurer and the creditor who are able to respond to their needs. Accordingly, if we apply the above mentioned principle to the duration of the contract, it can be observed that the command of such an essential element of the contract lies with the strong party who can use it regardless of the weak party. In order to remedy to such inequality between the parties which comes from the term of agreements, insurance contracts, and consumer credit agreements, the legislator has intervened but, contrary to Hegel's theory, without inverting the inequality between the contracting parties. Henceforth the strong party remains with the control of the temporal element of the contract, but only when teh law does not provide otherwise. Nevertheless, in areas where the legislator has intented to create a balance, the weak party receives formal control, subsequent to the intervention of the legislator, of the term of the contract. Such control, without leading to an inverted inequality, reveals the existence of asymmetry in regard to the choice of the temporal element of the contract. Such asymmetry deprives the strong party of many important prerogatives regarding the initial fixing of the duration of the contract, its termination and extension, to the benefit of the weak party

In spite of the political victory which allowed for the substitution of private capitalists by the state in the control of the basic means of production, socialism was not able to avoid an economic and social debacle. The struggle for the improvement of society against the "traditional" system was carried out through the logic of labour in its abstract form. Hence the necessity to transform the rural population into a free labour force. Socialism stood out for being a social formation inside the capitalist system itself. This system crumbled on its own foundations. It was an exceptional state of the economy that, however, would become the exception that confirms the rule. From being in the periphery of the world system under colonialism, through the failure of the socialist project to put an end to its peripheric condition, mozambique today tends to play a relatively marginal role within the world-system in the third industrial revolution

Originally bearing the "spirit of May", it is concerned with anti-Stalinian Marxist tradition, represents a non-orthodox Brechtism, that is a Brechtism differing from the one advocated by the heirs of decentralization. The journal takes sides with "Young Theater", and supports its daims in front of institutions as well as its strain to give theater a political content and to get the "nonpublic" involved. It makes us hear genuine voices: those of artists, authors and intellectuals of its time. It is always successful at recognizing and making known avant-gardes

Texto completo da fonteThe “Couverture Maladie Universelle” (universal health care), which came into effect on January 1rst, 2000, completes the extension of health care to the whole population. If the CMU means, by nature, the abolition of inequalities, it also operates a significant change in collective solidarity. Disconnected from any work activity, the CMU breaks with the French principle of “Sécurité sociale” (social insurance), namely inter-professional and inter-generational solidarity guaranteed by the contribution. If some perceives this service as a major breakthrough, the agents providing it might have doubts about its legitimacy. Observations carried out within many different payment centers of the Health Insurance Services thus revealed that much of the insurance staff felt strong ressentiment towards the beneficiaries of these health care services not based on any work activity. These ressentiments sometimes lead to informal or even illegal controls that rely on a subjective and moral perception of the population benefitting from these rights. Based on an analysis of the concept of the CMU right, the work of CMU providers, the sociopolitical context and logics of discriminations, this thesis focuses on the ressentiment factors. From suspicion to ordinary racism, ressentiment varies according to the social background of the agents. Therefore it appears as an individual expression of collective fears regarding the meaning of work in our society

Texto completo da fonteThe objective of this thesis is to propose a contribution to the reflexion on the reform of the socio-tax system and, more particularly, to the analysis of the effects of measures such as "Basic Income" and "Negative Income Tax" on unemployment, labour market efficiency and agents well-being. To this purpose, we retain a formalization à la Marimon and Zilibotti (1999) where the differentiation of workers and jobs are made explicit (not like standard matching models). Within this framework, it appears that Earned Income Credit systems can present interesting effects in terms of employment, reduction of inequalities and poverty. However, the efficiency of these systems can depend considerably, on the one hand, on labour market conditions (like, for example, the effectiveness or not of a minimum wage) and, on the other hand, on the variables concerned. Indeed, the fall on participation to the labour market as well as the reduction of job productivity belong to the negative effects that can generate such systems

Texto completo da fonteThis work concentrates on a device that manages and controls working times for the drivers of a private transportation company (Coaches N): the digital tachymeter. To our knowledge, this tool, designed and enforced by the European Union in order to enhance traffic security, has never been investigated so far. A plural theoretical approach of the question of its appropriation, of its factors and of the users’ typologies is adopted. This approach is based on the numerous previous studies on management tools and technology appropriation. Seventy four interviews with employees and managers were conducted during a three year involvement inside the company. An inductive logic was adopted. Our research shows one the one hand that: 1. An effective appropriation of the digital tachymeter from the company and its drivers is evidenced. 2. Several factors impact this appropriation by the drivers: factors related to the device properties (ease of use, complexity, efficiency, compatibility, obligation), individual factors (professional experience, family status, personal efficiency, self-image), and contextual factors (external control authority, internal control processes, colleagues’ attitude). 3. Four attitudes towards the device are shown: rejection, use, adaptation/hijack, displacement. One the other hand, the adoption of a technology that controls working times in a company is nothing but neutral. Step by step, the relationship between managers and drivers, as well as drivers’ conception of their profession, are shaken. The adoption of such a technology not only alters the practices and relations, but the very notion of appropriation appears in an even more complex fashion

The detailed analysis of the respective functions of the various company's governing bodies, shows that in reality the management’s control and the supervision’s control join in a single definition. This definition applies to anyone related with the company’s life and allows to avoid any liability for the control carried out by people who only have a right of information. If control must be conceived as a single operation the question rises of the multitude of liability schemes which applies on the holders of a mission of control. The study of the conditions and the scheme of their liability allow to notice, beyond, the differences of scheme, the conditions of application : the fault, the damage and the causal link , are the same, whatever its ground. It is then allowed to criticize the differences of liability schemes applying on manager and supervisor and to propose to go back to some coherence by a revision, which can be qualified as small, of the liability resulting from the control

The first part -Hegemony of planters- will expose how the planters' ethos imposed itself as a model in a process that postulates the erosion of the white man's labour force on the one hand, and the control of the potential forces of opposition formed by justice and religion on the other hand. The second part -Work and servitude- will try to describe the division of slave work, to determine the capacity of slaves to achieve independant activities. This part of the study will endeavour to understand the master-slave relationship, and, finally, to analyse the place that work held in the debate on the abolition of slave trade and slavery that opened in the 1770s

Texto completo da fonteThe topic of the thesis is the link between power and mobility on the higher levels of the social scale. The sample of the research is formed by more than two hundred of interviewees - among them are top managers in multinational companies, international artists and leading global academics, large proprietors and heirs of great fortunes mainly based in one of the three cities where the empirical analysis took place - Milan, Paris and London. Comparing the mobility plannings and the time schedules of these social groups, we show different forms of international mobility - and correlated structures of personal costs: mobility is a resource and at the same time a constriction weighting today on higher-grade professionals -, strategies for the presence on dislocated social scenes and differences in power on somebody else's rhythm. These results contradict the rhetoric of contemporary managerial literature concerning the rise of an homogeneous elite of citizens of the world and indicate the specific social morphology in post-fordist capitalism

Texto completo da fonteThis thesis investigates the methods of hybridization of companies in Gabon, taking as an example a company established in Libreville since 1969, the Miller and Poultry Company of Gabon (SMAG). Hybridization theories were initially focused on the biological field, particularly on plant biology. It's common knowledge that Mendel's laws stem from the observation of the experimental crossing of several species of beans. It is suitable, therefore, to question the concept of hybridization in its application to the humanities before experimenting it in a corporate anthropology, which is envisaged in this study. With this reading and this analysis, we emphasize the importance of the dual contribution, the dual exchange, that are at stake in a working and production environment. Hacking involves self-directed learning and remove social barriers between hobbyists, professionals and activists. Therefore, it raises the hope to renew the access to knowledge and the role of technologies in society. In line with the bourdieusian thought on reproduction of social inequalities, the study analyses how hacking articulate itself with the classical instances of socialization – family, friends, school system, etc. – and how it influences social mobility. By studying Swiss and French hackers, it shows that self-directed learning varies according to social origins and trajectories: it enables upward trajectories when it is combined with the legitimate scientific culture. In this regards, hackers do not escape the weight of social classes’ relations, although they are are willing to transfer their unusual behaviors and thought process across different areas of activities. Workplace is generally their main focus. Along with careerpath, success or failures to innovate in the professionnal sphere are key to understand the hackers’ involvement in leisure activities, associations, or various forms of activism. The participation in the political sphere is limited because hackers usually do not have the proper ressources. By highlighting the complexity of hacking, the thesis proposes a better understanding of its potential societal impacts

It aims at distinguishing the psychic painfulness of the physical dimension in any sector of activity and understanding its articulation with stress and burnout in order to better understand its issues. Thus, 39 employees of an agro-alimentary industry and 32 employees of a company of service delivery participated in this study. The analyses diagnosed the presence of psychic painfulness in both sectors of activity and the results show that it constitutes one of the predictors of stress and burnout. This painfulness, distinct from the physical painfulness, is characterized at the agro-alimentary company P by indirect factors linked to the activity, such as the weight of the responsibility relating to the position held, the inexperience in a workstation, the fear of making a mistake that can cause heavy consequence for the company and the hyper-alertness imposed by the rhythm of the machine; and to the professional consular chamber A, it is characterized by a high pressure of work related to last-minute work, to the constraints of very short deadlines, to the work in the urgency, to considerable workload linked to the regular addition of files, to a highly directive management style, to an inappropriate work organization and to the lack of recognition of the work of certain socio-professional categories by the hierarchy. In the first section, we describe the social, political and scientific context in which this study is developed. The historical "time" in which of sociological and scientific definition of the youth notion is also dealt with. The first section is articulated around the ideologie, the politics and the managerial instruments set up by the independant state of Algeria. The social father (state) who superceded the begetter father, manages these young generations with a national culture (islamo-arabic) and a youthful model: the adolescence. The educational and training system, employment unemployment and the risks management are as many fields which reveal that the algerian youth is an essential stake for the whole society and that the social "convictship" is a daily reality for the majority of the algerian youth. The cultural disarray felt by the young generations is expressed not only with identity, linguistic and religious references but also with their sociabilities and their leisure pratices. More precisely, it is caused by the advent of a new society where managers are not highly thought of. In the first part of this research, i try to study the historical background of the strong social cohesion constituting. In the second part, i study how this cohesion has been splitting. In the third part, i try to show the causes of the compagnies managers identity crise. I also show that the managers stay in the background of work because of their identity crise. More precisely, i show that staying in the background of the work is a strategy which is taken by the managers in order to get back their identity. It means that refusing to work make the managers get some satisfaction. At the end i give some conclusions about the relation between algerian compagnies and algerian society. In other words, i try to answer the following questions : is the algerian compagny an institution or just an organisation? in other words, can the algerian compagny introduce some changes in algeria?

Texto completo da fonteDigital employment platforms build their business model away from the scope of regulations that would traditionally apply to their line of business (for example, private passenger transport companies), the first of which is labour law. It is argued they serve as mere intermediaries between demand and supply, and as such, the status of employee (and sometimes of a worker altogether) is denied. Instead, preference is given to presumed independence via civil and commercial contracts. As a consequence, individuals working for these platforms are not protected by labour law (ex: termination of employment regulation, collective negotiation rights, maternity leave, unemployment benefits, etc.).Yet, when an organisation develops a commercial and economic activity entailing the use of contracts depending on labour power as its very basis for existence, it is difficult to affirm absence of labour or independence. Employment platforms are not mere intermediation platforms; rather, they are productive entities which draw their dynamics from competitive patterns on the market, far more than traditional firms would.The calling into question of social law they spark is part and parcel of a determinist vision of labour law, which claims that law must necessarily adapt to economy’s requirements. This in no way means that law is helpless in the face of these new models. Quite the contrary, the disrupt they bring forward reflects the history of law’s very construction, for French but also European and international law, and calls for it to reassert its demands and ambitions

While carrying on with the analysis of "the french school of perception", simone weil develops the idea that real perception - the one that enables one to test necessity through impressions - is work. This philosophical prospect - nurtured by descartes and marx, interlocutors both summoned and criticized - is taken up at every stage of the weilian philosophy, in more committed texts or political works, in order to show that, whatever name it is given - democracy, socialism, "civilization founded on the spirituality of work" - work is the core of all conception of a desirable social order. The notion of work makes it possible to connect the different stages of the author's philosophy, for crossing a threshold, in several occasions, implies neither discontinuance nor denial from her. What always matters is to improve the method of reading, in order to get in touch with the different levels of reality, apprehended in their true identity. While exploring in a platonician manner the levels of the being and the degrees of knowledge, simone weil presents work as what enables one to test the real articulation between liberty and necessity, the consent to necessity, the world's unhappiness and beauty. By making good use of these tests, the field of supernatural reality can be attained. Through analogy and symbol, achieved in the crafts, the workman would be in the best position to reach the superior form of intuitive attention and to renew the pact between the mind and the universe, taken as "true metaphor" whose supreme poet would be god
