Die Reduzierung der Unfallzahlen und berufsbedingten Erkrankungen, die Stärkung des Arbeits- und Gesundheitsschutzes genießen in Sachsen einen hohen Stellenwert, da sichere und gesundheitsgerechte Arbeitsbedingungen in den Schulen auch zur nachhaltigen Entwicklung des Freistaates beitragen. Um diesen Anspruch in den sächsischen Schulen dauerhaft zu sichern, entwickelt die Professur Arbeitswissenschaft und Innovationsmanagement der Technischen Universität Chemnitz das Arbeitsschutzmanagementsystem Schule »AManSys«. Einen wichtigen Teil der Systementwicklung bildet dabei das Handbuch zum »AManSys«, eine Handlungsanleitung und zukünftig digitales Hilfsmittel für den Schulleiter, um die Durchführung und Dokumentation der Prozesse in der Organisation im Arbeits- und Gesundheitsschutz regelkonform zu managen und damit seiner Unternehmerverantwortung gerecht zu werden.

Ausgehend von der These, dass das Verhalten „schwieriger“ Kinder eine Folge kulturell-gesellschaftlicher Entwicklungen ist, die sich nachteilig auf den innerpsychischen Prozess der Triangulierung auswirken und auf die eine von zweckrationalen Organisationsstrukturen, von institutionsspezifischen Kommunikations- und Handlungsformen und von einem veränderten professionellen Selbstverständnis einzelner Lehrer dominierte Schule bislang keine befriedigenden Antworten gegeben hat, wird nach dem Potenzial der Psychoanalyse hinsichtlich der Möglichkeit gefragt, Pädagogen und Pädagoginnen bei der Konstituierung von Schule als ‚triadischer Raum’ im Sinne eines dyadisch geprägten und triadisch strukturierten, die kindliche Entwicklung fördernden psychosozialen Erfahrungsraums zu unterstützen. Am psychoanalytischen Theorem der Triangularität orientiert wendet sich die Erörterung zunächst drei von der Psychoanalyse beeinflussten sozialisationstheoretischen Konzepten unterschiedlicher Provenienz zu. Dieses methodische Vorgehen erweist sich jedoch im Kontext der zentralen Zielsetzung, ein umfassendes pädagogisches Konzept zur Stärkung kindlicher triangulärer psychischer Strukturen zu skizzieren, nur bedingt als hilfreich. Die anschließende Diskussion der Problem- und Fragestellung auf der Folie einer ‚kulturtheoretisch orientierten’ Psychoanalyse, die einem eigenständigen wissenschaftstheoretischen Selbstverständnis und Erkenntnisprozess folgend unbewusste individuelle und überindividuelle, kulturspezifische Subjektivitätsmomente wie auch biologische Determinanten seelischen Erlebens und Verhaltens berücksichtigt, führt zur Formulierung dreier Dimensionen des dialektischen Prinzips der Psychoanalyse, die sich im Bemühen um die Gestaltung triangulär organisierter Verständigungsprozesse als hilfreich erweisen können.
Based on the theory that the behavior of „difficult“ children is a result of a socio-cultural evolution that has adversely affected the inner-psychological process of triangulation and, based on the school of thought of purposive-rational organizational structures and that of institution-specific forms of communication and action, along with the altered professional self-understanding of individual teachers – noneof which have yet to offer any satisfactory answers – the question arises in accordance with the potential of psychoanalysis concerning the possibilities for educators in the constitution of a school as a ‚triadic space’, dyadically characterized and triadically structured to support the constructive psycho-social realm of experience in childhood development. Oriented on the psychoanalytical theorem of triangularity, the analysis initially adresses the varied provenience of three concepts influencing the socializationtheoretically and psychoanalytically. In the context of a central target, this methodic approach proves to be only slightly helpful when outlining a comprehensive pedagogical concept to reinforce childhood triangular psychological structures. The subsequent discussion of the problems addressed on the slides of ‚cultural-theorist-oriented’ psychoanalysis, following an independent epistemological self-understanding and cognitive process, taking unconscious individual and supraindividualculture-specific moments of subjectivity as well as biological determinants of emotional experience and behavior into consideration, leads to the formulation of tree dimensions of the dialectic principle of psychoanalysis that might prove to be helpful when attempting to configure triangularly organized processes of understanding.

The topic of this master thesis is the appraisment of the company Fruko-Schulz s.r.o. which specialized in the sector of production and distribution of spiritous liquers and fruit sirups. The company will be appraised with use of revenue method of discounted free cash flow for the owners, in the case that the company is able to follow the going concern principle. To be able to assume that, we will use the strategical and financial analyses. In the strategical analysis we will be assessing the internal and external potential of the company and the outlook of the relevant market. In the end we will be able to made prediction of this market and also the company's share of the market. The financial situation will be assessed in the finanacial analysis afterwards. It is then possible according to these analyses create the value generators and the finacial plan for the following years. The company will be appraised according to these plans and free cash flows to the firm.

The purpose of the diploma thesis is to determine the market value of the Fruko-Schulz s.r.o. company, developed for the needs of its important stakeholder to the date of December 31, 2014. The thesis is divided into two main parts: the theoretical-methodological part defining the terminology, approaches and methods from the field of business valuation study, and the practical part using the theoretical basis for the actual valuation. After the initial introduction of the company, the strategic and financial analysis is performed, i.e. the current state is described and especially the prospects of the company on the market are discovered. The following compilation of the financial plan and value generators eventually results in the target determination of the market value of Fruko-Schulz s.r.o. company performed in particular through the DCF method.

Der mit Verfassungsrang ausgestattete Schuldgrundsatz als Voraussetzung der Bestrafung ist eine der zentralen Systemkategorien des Strafrechts. Anders als ein Erfolgsstrafrecht verlangt das Schuldstrafrecht nach einem "Andershandelnkönnen" des Täters als Vorbedingung der Zuschreibung von Verantwortlichkeit. Die dabei vorausgesetzte Anlage des Menschen zu Selbstbestimmung und ethischer Einsicht gehört elementar zum Menschenbild, das der Rechtsordnung des Grundgesetzes mit seiner Betonung von Wert und Würde des Einzelnen zu Grunde liegt. Als Ausgangspunkt der Betrachtung werden in der vorliegenden Arbeit Befunde über von Jugendlichen und Heranwachsenden begangene Straßenraubdelikte zusammengetragen, wobei diese Perspektive innerhalb eines wissenssoziologischen Bezugsrahmens auf die Lebenssituation junger Menschen in den aktuellen gesellschaftlichen Zusammenhängen, die Deutungen von abweichendem Verhalten, Gewalt und Kriminalität und schließlich die Wirkungsweise des Strafrechts erweitert wird. Vor diesem Hintergrund wird zu den rechtsdogmatischen Schuldkonzepten Stellung bezogen. Dabei wird die Abhängigkeit des Rechts von gesellschaftlichen Werten herausgearbeitet und eine aktive Rolle der Strafrechtswissenschaft im Prozess der gesellschaftlichen Verständigung über Werte eingefordert. In diesem Verständnis von Schuld im Sinne eines "Wertkonzepts" wird auf eine gegenüber Strafzweckerwägungen und kriminalpolitischen Überlegungen eigenständige Fundierung des Schuldprinzips bestanden, und es werden generalisierende Betrachtungen zur Vorwerfbarkeit abgelehnt. Ausgehend von den Überlegungen zum Schuldgrundsatz wird schließlich kritisch auf moderne kriminalpolitische Konzepte eingegangen, die sich zunehmend in den Bereich des Ordnungsrechts verlagern und auf diese Weise die spezifisch strafrechtlichen Verfassungsgewährleistungen umgehen.
The requirement of guilt as a prerequisite for punishment is both a constitutional principle and one of the central categories of penal law. Contrary to criminal law systems that focus on the outcome of a criminal wrongdoing, a criminal law system that requires the personal guilt of the offender before imposing criminal liability considers whether the offender has the capability and possibility to act legally in a certain situation. Based on this premise, the ability to self-determine one's actions and to conform them to ethical standards is a fundamental component of the image of human kind, which constitutes the basis of the German Basic Law that emphasizes the value and dignity of every single human being. The thesis begins with a report on street robberies committed by young offenders. It then expands to an analysis of the living situation of young people in modern society and interpretations of delinquent behavior, specifically violence and crime and the effect of legislative reactions to crime within a theoretical frame of the sociology of knowledge. Proceeding from this, the author next discusses the different dogmatic concepts of guilt. He shows that law depends on social values and contends that criminology plays an active role in the process of forming an understanding of values within society. Understanding guilt as an ethical concept, the author claims a foundation of the principle of guilt independent from the purpose of punishment and criminological policies. He rejects generalized approaches to the concept of guilt. Finally, he analytically discusses modern concepts of criminological policy that are increasingly shifting into regulatory law, thereby circumventing constitutional guarantees that are specifically related to criminal proceedings.

Dyckia Schultes & Schultes f. reúne 164 espécies com ocorrência em todas as regiões do Brasil e em países vizinhos como Argentina, Bolívia, Paraguai e Uruguai. No Brasil, foram registradas 140 espécies, sendo 127 endêmicas do país. O gênero apresenta uniformidade dos caracteres florais e variabilidade interespecífica dos caracteres vegetativos, o que dificulta a delimitação das espécies e sua correta identificação. A hipótese de uma radiação explosiva recente para Dyckia pode explicar a dificuldade de discernir características morfológicas consistentes que sejam taxonomicamente úteis para distinção das espécies do gênero, mesmo com espécimes completos e totalmente documentados em mãos. Neste contexto, o objeto deste estudo, o complexo Dyckia saxatilis Mez, é formado por um grupo de espécies com folhas estreito-triangulares, lepidotas em ambas as faces ou somente na face abaxial, com brácteas superiores do pedúnculo da inflorescência menores ou iguais aos entrenós, inflorescência simples (raro composta), brácteas florais menores ou iguais às flores, e flores laranja, laranja- avermelhadas ou castanhas. Seus componentes apresentam grande variação morfológica, especialmente nas estruturas vegetativas, e suas populações estão distribuídas em Minas Gerais e no Espírito Santo. Atualmente são subordinados a D. saxatilis quatro sinônimos (D. hilaireana Mez, D. oligantha var. oligantha L.B. Sm., D. oligantha var. cristallina Rauh, D. macropoda L.B. Sm,) e existem outros seis táxons morfologicamente muito relacionados, que integram o complexo: D. brachyphylla L.B. Sm., D. consimilis Mez, D. densiflora Schult. f., D. mello-barretoi L.B. Sm., D. rariflora Schult. f. e D. tenebrosa Leme & Luther, totalizando 11 binômios estudados. Paralelamente ao estudo do complexo D. saxatilis, após a constatação da revalidação de D. oligantha var. oligantha também foi realizado o estudo do complexo D. macedoi, onde foram revisados três binômios: D. macedoi, D. nana e D. oligantha var. oligantha. Assim, esta tese teve como objetivos avaliar a variação morfológica existente nas espécies dos dois complexos através do estudo morfométrico de populações naturais; levantar caracteres de uso taxonômico da anatomia foliar; investigar as relações taxonômicas entre as espécies estabelecendo os limites de variação e a validade dostáxons; realizar o tratamento taxonômico das espécies, descrevendo-as morfologicamente, fornecendo chave de identificação, ilustrações e dados sobre sua distribuição geográfica. Para as análises morfométricas foram amostrados 325 indivíduos pertencentes a 17 populações naturais afins de D. saxatilis (N=256) e D. macedoi (N=90), com D. oligantha (N=21) presente nos dois complexos, nas quais foram medidas 30 variáveis. Na anatomia foliar, cortes da porção basal, mediana e apical das folhas de três indivíduos diferentes de cada população foram analisados. O estudo taxonômico foi realizado através da análise de material herborizado, coletas, observações de campo, resultados das análises morfométricas, suporte da anatomia foliar, e consulta a coleções de espécimes cultivados. Os resultados das diferentes análises realizadas apresentam fortes congruências e somados ao estudo das exsicatas e das plantas vivas permitiram o reconhecimento de 12 espécies: D. brachyphylla, D. consimilis, D. densiflora, D. hilaireana, D. oligantha var. oligantha, D. macedoi, D. nana, D. rariflora, D. saxatilis e D. tenebrosa, sendo duas delas novas para a ciência: D. sulcata Guarçoni e Dyckia sp.1. As espécies oriundas desta revisão foram circunscritas considerando uma melhor amostragem dos táxons.
Dyckia Schultes & Schultes f. comprises 164 species occurring throughout Brazil, as well as neighboring countries such as Argentina, Bolivia, Paraguay, and Uruguay. One hundred and forty species have been recorded in Brazil, with 127 being endemic to that country. The genus shows uniform floral traits but interspecific variability in terms of vegetative characters, which makes the delimitation of species and their correct identification more difficult. The hypothesis of a recent explosive radiation of Dyckia could explain the difficulties encountered in identifying consistent morphological characteristics that are taxonomically useful for distinguishing its species even with access to complete and fully-documented specimens. The Dyckia saxatilis Mez complex, which is formed by a group of species with narrow-triangular leaves, lepidotes on both faces or only on the abaxial surface, with the superior peduncle of the inflorescence bracts shorter than or equal to the internodes, inflorescence simple (rarely composite), floral bracts smaller than or equal to the flowers, flowers orange, orange- red or brown. Its component taxa show great variation, especially in terms of their vegetative structures, and their populations are distributed in the states of Minas Gerais and Espirito Santo. Dyckia saxatilis subordinates currently include five synonyms, with six other morphologically related taxa, forming the complex: D. brachyphylla L.B. Smith, D. consimilis Mez, D. densiflora Schultes f., D. hilaireana Mez, D. oligantha var. oligantha L.B. Smith, D. oligantha var. cristallina Rauh, D. macropoda LB Smith, D. mello-barretoi LB Smith, D. rariflora Schultes f., and D. tenebrosa Leme & Luther, totaling 11 binomials. After the revalidation of D. oligantha var. oligantha, the D. macedoi complex was also examined and three binomials were revised: D. macedoi, D. nana and D. oligantha var. oligantha. The present thesis evaluated the existing morphological variations in two species of the complex through morphometric studies of natural populations; by determining leaf anatomy characters of taxonomic use; investigating the taxonomic relationships among species and establishing their limits of variation and the validity of the taxa; performing taxonomic treatments of the species by describing them morphologically; elaborating an identification key; and providingillustrations and data on their geographical distributions. Morphometric analyses (of 30 variables) used 325 individuals from 17 related natural populations of D. saxatilis (N = 256) and D. macedoi (N = 90), with D. oligantha (N = 21) being found in both complexes. Leaf anatomical studies analyzed sections of the basal, median and apical regions of leaves of three different individuals from each population. The taxonomic study used herbarium specimens, collections, field observations, the results of morphometric analyzes with support from leaf anatomy, and examined collections of cultivated specimens. The results of the different analyses show strong congruence and, together with the study of herbarium specimens and live plants, allowed the recognition of 12 species: D. brachyphylla, D. consimilis, D. densiflora, D. hilaireana, D. oligantha var. oligantha, D. macedoi, D. nana, D. rariflora, D. saxatilis, and D. tenebrosa. Two of these species are new to science: D. sulcata and Dyckia sp.1. Species resulting from this review were circumscribed considering more detailed examinations of the taxa.
