This thesis examines the relation between subnational autonomies, that is to say regional and local authorities and the norms they create, and European Union law. The existence of local and regional autonomies within the various Member States of the EU is a factual truth. We know that they exist and co-exist with other levels of public authority, themselves generating norms. Yet, on its surface European Union law does not devise any substantive understanding of such autonomies. This stands in stark contrast to the relation between the Member States and the EU, which is governed by a complex catalogue of Treaty rules. As a consequence of European integration, however, subnational autonomies and EU law do interact, so that the latter cannot simply ignore the existence of the former. This thesis sets out to determine the contours of their mutual relation through an analysis of EU procedural and substantive law. It uncovers that the relation between subnational autonomies and EU law is multifarious and diverges depending on whether we look at the surface of EU law, that is to say the Treaties, or whether we look below its surface, at the Court of Justice's rich case law or soft law instruments of the Commission. I map this conclusion through a modelling approach, relying on what I term the 'Insider Model' and the 'Outsider Model' respectively. These models underline that, in some areas of EU law, SNAs are seen to be outsiders to the project of European integration whereas other areas recognise SNAs and especially their norms to be the insiders of that project. The coexistence of both models forces us intellectually to rearrange things. It challenges our 'constitutional imagination'. The key to understanding the coexistence of both models can be found in the evolution of EU law itself. While the Outsider Model remains attached to the public international law origins of the EU Treaties, the Insider Model captures the reality that not only States and citizens, but also SNAs, are integrated into the EU legal order.

Adopting a critical cosmopolitan outlook the thesis identifies a constructive engagement with the European project at a time when the crisis of the Euro-zone is still threatening the very existence of the European Union. The purpose of the study is to determine whether cosmopolitanism is feasible in Europe. I argue that the EU can be conceived as a catalyst of cosmopolitanism without being cosmopolitan per se due its so far limited internal and external contexts of cosmopolitanism. In the case of the EU's limited inner cosmopolitanism, I seek cosmopolitan alternatives for the EU to overcome the crisis on the basis of an institutional and civil society analysis within the conceptual framework of cosmopolitan democracy. Instead of adopting the terminology of governance either for or by the people, my cosmopolitan approach focuses on governance with the people. The case of Greece is of utmost importance for my research as it reveals the causes and gravity of the crisis. It also broadens the empirical basis of cosmopolitan studies by embodying both the dynamics and challenges posed to cosmopolitanism which are exemplified in the paradoxes provoked; on the one hand there is aggravation of (fascist) nationalism and domination of economics on politics perhaps leading to Greece's de- Europeanisation; on the other hand the dynamics of a paradigm shift towards a post-crisis cosmopolitanism are revealed. That kind of cosmopolitanism needs to take under consideration the role of contestation and to redefine its position in the era of global capitalism for the confrontation of the crisis. In the case of the EU's limited external cosmopolitanism, my analysis of Turkey's possible impact on the EU and the reverse aims to demonstrate that Turkey's integration can contribute to the formation of a cosmopolitan, post-Western EU and post-national Turkey. What is of crucial importance for both cosmopolitan and Europeanisation studies is that the endogenous process of change within Turkey which is interlocking with the external dynamics of the EU may potentially lead to a distinctive ‘hybrid' type of cosmopolitanisation neither merely European nor simply Asian. The conclusions drawn from this multiple case study suggest that the current crisis may open new meanings for cosmopolitanism in Europe.

On the basis of case studies of 19th and early 20th century Germany, Sweden and the Netherlands, I address the question of how and when incumbent right elites reformed electoral systems under a rising political threat from the left. Some states adopted proportional representation (PR) earlier than others. Why did different states adopt PR at different times? One important factor was the existing electoral system before the adoption of PR. This has been missed in academic research since most scholars have assumed that the electoral system in place before the adoption of PR in most Western European states was single-member plurality (SMP). I show that the system in place prior to PR in most Western European states was not SMP but a two-round system (TRS). TRS effects are still poorly understood by political scientists. I argue that both PR and TRS were used as safeguards by the parties on the right against an electoral threat from the left, which originated from the expansion of suffrage. PR was used as a last resort after other safeguards had been exhausted. I state that in the presence of a strong left threat, countries with TRS could wait longer to implement PR than countries with SMP in place. Under TRS, the adoption of PR was considerably delayed since electoral coordination between parties could be applied more effectively than under SMP systems. This was largely due to the increase of information and time after the first round of TRS elections, which was used by right parties to coordinate votes around the most promising candidate before the second round. First round results under TRS were used as an "electoral opinion poll". Based on these results, the right could react more effectively than the left in order to improve outcomes in round two.

The purpose of this thesis is to focus on the impact of the influx of refugees on the European Union taking into consideration the challenges, threats and opportunities that arise from this persistent crisis. The examination of the above-mentioned issue presents and analyzed pertinent findings derived from the relevant literature in the field, ranging from diverse case studies, public statistics, data of European Union institutions as well as NGO's, associations and other entities that have addressed issues of human rights and refugee integration in European Union countries. The thesis discloses how this complex matter, referred to as the "current European refugee crisis" gives rise to complex problems and divergent concerns ranging from Islamophobia, terrorist attacks and threats, economic challenges, cultural conflicts, and social clashes. It concludes that there is a need for new perspectives and strategies for better addressing the long and short term causes and challenges of the European refugee crisis.

With the enlargement of the EU to 27 member states in 2007, this thesis considers the transition process of Romania and Bulgaria from the fall of communism in 1989 to accession to the European Union in 2007. The research focuses on the political and economic reforms of Romania and Bulgaria, using a chronological approach, to explore the concept of EU impact on countries in transition. The thesis focuses specifically on the ideas of European conditionality and leverage, in order to answer questions on the importance of the EU’s external influence on these two countries, as well as discussing future implications for candidate countries in transition.

A culture of accommodation and tolerance is a necessary part of establishing and preserving a functional multi-national and multi-ethnic European Union. Civil society organizations and their associated social capital have been shown to foster civic capacity and achievement of public policy goals. However, social capital that is based on group identity can also contribute to a sense of intolerance towards out-groups, undermining the stated tolerance objectives of the social pillar of the European Union. States with a strong presence alongside civil society are expected to be curb the development of the exclusionary bonding form of social capital in favor of bridging social capital which will improve progress toward policy goals. This study tests the link between government capacity, social capital and tolerance using data from the 1990-2009 waves of the World Values Survey and European Values Study. Using path analysis and multi-level models of the relationships between political capacity, social capital and intolerance, the model establishes that government capacity enhances bridging social capital and which increases social tolerance. The study fills a gap in understanding how government capacity and policy can result in improved social capital even with greater diversity. A proposed relationship between political capacity and bonding forms of social capital was not supported.

Resumo: Desde o início da década de 1990, os países-membros da União Européia tem se movido em direção a políticas e leis de imigração cada vez mais repressivas, punitivas e de amplo caráter discriminatório. A intensificação desta política bem como a militarização progressiva de suas fronteiras tem construído o fenômeno político denominado fortaleza Europa, constituído por muros reais e virtuais, pela vigilância constante tanto dos limites territoriais como do próprio espaço público e pelas práticas sancionadas pelos Estados de estigmatização dos imigrantes, refugiados e solicitantes de asilo com base em sua origem cultural, fenótipo e etnia. Neste contexto, o Estado italiano aparece como um caso exemplar desta nova política, pautada pela ótica da emergência, da exclusão de todos os seres considerados indesejáveis e pelo racismo de ordem cultural, que concebe o estrangeiro como incapaz de se adaptar aos valores ocidentais, sobretudo aos valores italianos. Esta dissertação tem como objeto a política italiana para imigração, cujo pilar principal é constituído pela instauração dos Centros de Permanência Temporária, espaço de exceção nos quais são confinados os imigrantes ilegais, refugiados e solicitantes de asilo, e nos quais se efetua a espoliação do estatuto jurídico destes seres, convertendo-os em não-pessoas. Nesse sentido, a análise destes espaços e da política que os criou pode ser capaz de revelar o sentido da reaplicação de esquemas racistas na configuração das relações sociais,bem como o lugar ocupado pelo paradigma da segurança e da exceção, nos quais se pautam diversos Estados europeus e que redefinem a política na atualidade
Abstract: Since the early 1990s, member states of the European Union (EU) have moved toward policies and immigration laws increasingly repressive, punitive and discriminatory. The intensification of these policies and the gradual militarization of EU's borders have built a political phenomenon called Fortress Europe, which consists of real and virtual walls, constant surveillance by both the territorial limits and the very public space and practices sanctioned by the States of stigmatization of immigrants, refugees and asylum seekers based on their cultural background, ethnicity and phenotype. In this context, the Italian State appears as a striking example of this new policy, guided by the optics of emergency, the exclusion of all beings that are considered undesirable, and by cultural racism that sees the foreigner as unable to adapt to Western values, especially Italian values. This thesis aims at Italian immigration policy, which main point is the establishment of Temporary Stay and Assistance Centers. These centers are states of exception in which illegal immigrants, refugees and asylum seekers are confined to, their legal status is spoiled, and thus, they are turned into non-persons. In this sense, the analysis of these states and the politics that created them may reveal the meaning of racist reapplication regimens in the social relations set, and the place occupied by the security and exception paradigm, in which several European States are governed redefining the political scene today

Along with the rapid development of industry and agriculture, growth of population, improvement of urbanization level, China has been confronted with increasingly serious deficiency and pollution of water resource. In order to deal with the challenge as well as reduce waste discharge, it is necessary to strengthen all the possible efforts in controlling water pollution. Therefore, the control and management of water pollution is of vital significance to the development of national economy and social society, which is worth doing research on academically and practically. Water pollution management, in a sense, results from the urbanization and cosmopolitanization process. In this aspect, the European countries have acquired a lot of successful experience in water pollution control, which provides plenty of useful knowledge and reference for China’s ongoing efforts in water pollution control. This thesis, by taking a comparative analysis approach, looks into the European countries’ experience of water pollution control, makes evaluations on their managerial strategies, system and methods. Then it reviews China’s efforts on water pollution control, and analyzes the current situation of China’s water management, especially the water pollution control system of Huaihe River Basin, and as a result puts forward suggestions to improve China’s water pollution control system such as verification of property rights of water resources, enhancement of legal framework, investment and taxation policy preference, technological improvements, public participation and prevention measures.

This study examines economic integration within the European Union (EU) as a factor in conflict transformation and peace-building. European responses to causes of frequent conflicts and wars after the end of WWII focused on the search for peace, economic cooperation and prosperity. This thesis will focus on three elements: economic interdependence, the expansion of the free market, and economic integration. In-depth examination of these factors reveals that economic interdependence or the exchange of goods and services across inter-state and international boundaries only, is not sufficient to bring peace among states. Economic inter-dependence may reduce the impact of war, but cannot maintain sustainable peace. Unfair competition fanned by economic nationalism was a strong obstacle to free trade in Europe in the early 19th century. In the 21st century, the expansion of free trade, with increased understanding has enhanced reduction in interstate conflicts. However, free trade, in and of itself does not constitute a strong factor for a sustainable peace. Free trade may encourage democracy, but the expansion of free trade coupled with interdependence, does not bring sustainable peace. The EU has successfully established sustainable peace through economic integration-the creation of the single market that established freedom of movement, people, goods, services; and a single currency that facilitates easy transactions. The single market also abolished tariffs and custom duties. By and large, economic integration within the EU has been successful in creating a sustainable peace because economic interdependence, and the expansion of the free market have been combined with political integration by building democratic institutions at the intergovernmental and transnational levels.

In 2015, Europe experienced the most significant refugees' outbreak in modern history. Millions of displaced persons crossed the external borders of the European Union. Some of the EU member states represented and handled the outbreak as an opportunity. Some others framed and dealt with the migratory pressures as a security threat. The designation of an issue as an existential threat to a referent object constitutes a security speech act. According to the Copenhagen School of Security Studies, when extraordinary measures and the acceptance of the audience follow a security speech act, then we observe successful securitization. Motivated by the desire to examine the securitization of the refugee crisis in Europe, from a Copenhagen School's perspective, I performed a thorough assessment of the relevant literature which brought into the light a research gap. Despite the persistence of the Copenhagen School's scholars to underline the importance of their analytical framework's 'audience acceptance' component, most of the securitization literature focuses on the other two components of a successful securitization: the security speech act and the emergency action. As a result, the audience acceptance component suffers from under-theorization, underdevelopment, and under-assessment. To enhance the analytical potential of the Copenhagen School's theorem, I develop two methodological novelties -the Triangulation Method of Audience Identification and the Comprehensive Securitization Empirical Framework. The first guarantees the accurate identification of the securitization audience. The second classifies ten different forms of securitization based on the presence or absence of the three securitization components and on the placement of the 'audience acceptance' within the securitization's timeline. To demonstrate the applicability of the novel analytical tools, I test them on the securitization of the European refugee crisis. To support my findings, I perform a comparative case study of five case studies: Greece, Poland, Hungary, Germany, and the EU. To draw my conclusions, I consult thousands of official statements, hundreds of surveys and opinion polls, dozens of relevant books and peer-reviewed articles and several in-person interviews with renowned decision-makers. The outcomes of the research suggest that, in the case of the European refugee crisis, the primary targeted audience was the general public. However, the opinion of the general public about the designation of the existential threat and about the necessity of the extraordinary measures' adoption was rarely considered after the utterance of the security speech acts. In most of the cases, the securitizing actors assessed the feelings of the general public before uttering the speech acts. The findings of this research also indicate that the higher the negativity of the general public towards immigrants and refugees, the most likely the political elites to perform a security speech act and to resort to emergency action. Despite the indisputable impact of the public opinion, the final decision about the securitization of the refugee crisis belongs to the political actors

This thesis explores the bilateral relationship between the European Union (EU) and Japan as interregional partners and as united global actors. The principal aim is to navigate the nature of relations between these two diverse entities asserting that ideology, culture and identity formation contribute significantly to the joint policies undertaken by these two groups. The theoretical assumptions of this thesis are discussed in parallel to observable phenomena relative to the nature of relations between the EU and Japan, 1990-2005. This research analyses EU and Japan interactions from the Joint Declaration 1991 and including the Action Plan 2001 and aims to use the theoretical concepts of Identity. The frameworks of the Four Point Plan and the Analytic Narrative are appropriate to gain insight to the nature of these relations. Both the Four Point Plan and the Analytic Narrative are broad in scope but defined in nature, thus they are most suitable for the purpose of this analysis. This multidisciplinary approach enables the deconstruction of the influence held by 'identity' in domestic and international policy, outlining that policy influences such as preference and 'stories'! affect the relationship between the EU and Japan. This modem research angle serves to emphasise the uniqueness of the EU and Japan as international actors. The United States and rise of China act as intervening variables, and their secondary role highlights the changing global environment over this period.

The humanitarian crisis in Yemen is a man-made famine. The concept of famine crimes has been introduced to problematise and criminalise conduct that leads to the creation of famine. According to an analytical framework proposed by Marcus (2003) there are four categories of famine crimes, which constitute four degrees of conduct through which famines are created, sustained or not prevented. A pivotal role in the creation of the famine in Yemen is played by Saudi Arabia, that relies on the import of military equipment to conduct a military intervention in Yemen. Through Common Position 2008/944/CFSP, the European Member States committed themselves to eight criteria against which arms licence applications are tested. This aims to prevent arms deliveries to questionable receivers, yet various EU Member States export military equipment to Saudi Arabia. In this thesis, the famine crimes framework is applied to foreign actors in a case study of the EU arms trade to Saudi Arabia between 2015 and 2019. The research project answers the question: what insights about the European Union’s role in the creation of famine in Yemen can be gained from the application of the famine crimes framework to the European Union’s arms trade to Saudi Arabia? Since Saudi Arabia violated international humanitarian law in Yemen and used EU-produced arms to do so, the Common Position requires EU Member States to pursue restraint in arms export to Saudi Arabia. Accordingly, the number of licences that were approved by European Member States, as well as their value, declined after 2015. However, there were notable fluctuations and the Member States adopted differing approaches. As such, the EU as a collective body appeared unable to prevent arms exports to Saudi Arabia. In the application of the famine crimes framework, it becomes clear that this inability can be interpreted as a famine crime.Altogether, this exploratory study provides insights into the role of foreign actors in the creation of famine by applying the famine crimes framework. Further research on the extent to which the EU as a collective body could enhance compliance with the Common Position and prevent exports to questionable receivers could be performed to better categorise its conduct within the framework. Further research could also explore the role of other foreign actors and apply the famine crimes framework to other case studies.

In 2009 the sovereign debt crisis started in the European Union. Every member state was involved in the financial turmoil, in particular Portugal, Ireland, Italy, Greece, and Spain. Why were these countries effected more so? Were they still committed to core ideas of the European Union? This paper will review this topic through the perspective of Portugal. Being a former colonial power, once having an authoritative government, and now a full-fledged member of the European Union, Portugal has a unique story to tell about the crisis at hand. This paper will evaluate different European Union principles involving gender equality, tertiary education, politics, and economics while comparing how Portugal ranks in Europeanization to the European Union specifically during the sovereign debt crisis. This paper will conclude by summarizing these topics, analyzing triumphs and setbacks, and hypothesizing Portugal's future in regard to their Europeanization of European Union standards and the current sovereign debt crisis the country faces today.

This thesis seeks to explain the outcomes of trade negotiations between the European Union (EU) and seventy-six of the world’s smallest developing countries in Africa, the Caribbean and Pacific (ACP). Puzzlingly, in spite of its vastly greater economic size, the EU was, for the main, unable to realise its objective of concluding six broad and deep free trade agreements with these countries. Deploying first historical institutional analysis then statistical modelling and finally by scrutinising a wealth of primary documents and transcripts of interviews with negotiators, the thesis reveals three factors that influenced outcomes. First, coercive pressure applied by the EU on countries dependent on EU for trade preferences and aid. Second, tactics within the negotiating process, with some ACP countries and regions manoeuvring more effectively than others. Third, differences in the underlying preferences of ACP governments, with most opposing major aspects of the EU’s proposals, but a minority embracing the EPA approach. Probing the underlying reasons, the thesis finds that, contrary to the prevailing literature, lobbying by domestic economic interest groups only provides part of the answer – the analytical and ideational processes within ACP government institutions also exerted an influence. The analysis shows that structural factors, particularly the depth of economic and political dependence on the larger state, establish the range of likely outcomes from a given negotiation. However the preferences of small states and the way in which they interact strategically with the larger state can definitively shape the final outcome. In particular, small states can exercise a degree of resistance and blocking power that is often underestimated. It also sheds light on the formation of trade preferences in small developing countries and shows that in addition to lobbying by external groups, information and ideas within government bureaucracies appear to play an important role.

This thesis explores the impact of the Syrian refugee crisis on the Common European Asylum System. It evaluates the extent to which the European Union was able to implement a common asylum system, identifies discrepancies between different European countries, primarily Germany and Hungary, and briefly examines the roots of these differences. To this end, the structure of the international refugee protection regime and the German and Hungarian asylum systems are analyzed. Furthermore, the thesis explores how the governments of the two countries perceive the rights of refugees and how their views have affected their handling of the crisis. The case studies of Germany and Hungary have revealed that the treatment of Syrian refugees varies enormously within the EU. Hence, the implementation of the Common European Asylum System has not been achieved, which can be attributed to the deficiencies within the system and the growing ideological rifts within the EU.

Is the application of international law unjust in prominent case law of the Court of Justice of the European Union? In answering this question the thesis explains that Justice comprises both legal certainty, which seeks clear rules to govern future conduct, and [j]ustice, which seeks the correct outcome in an individual case. There is a frequent tension between these aims. Moreover, there is not an accepted model of Justice which resolves how to balance legal certainty and justice. Any loss in one aspect may be justified by a gain in the other. On this basis the analysis of legal certainty and justice is divided in the thesis. Legal certainty can be measured objectively, but the appropriate level of legal certainty which any legal system should achieve is contested. It is argued that legal certainty in internal case law - case law not applying international law - is the appropriate measure of legal certainty in external case law - case law applying international treaty and customary international law. This is implicit in scholarship and has been expressly approved by the Court itself. The thesis will identify that external case law is les certain than internal case law. [j]ustice cannot be measured objectively and is contested in its substantive or 'thick' form. However, formal, or 'thin' justice, which is encapsulated in the obligation to treat like cases alike and unalike cases unalike to the extent of their unalikeness, is widely accepted. Accordingly, the thesis compares internal case law, which reveals strong and consistent conceptions of justice across EU law, to external case law. It identifies differing justice conceptions in external as copared to internal case law. Based on a 'thin' model of justice these justice modifications must be accounted for based on the context of applying international law; the extent of the unalikeness. It will be identified that unalikeness in the context of applying international law cannot account for the justice modifications in external case law and a fortiori the lower levels of legal certainty. Accordingly, this thesis endeavours to show that the application of international law in prominent case law of the Court of Justice of the European Union in unjust.

This thesis provides new insight into the EMU’s impact on the Euro-area firms’ performance, by examining the firms’ accounting rates of return and financial cash flows. The impact is evaluated separately for the EMU formation and the physical Euro adoption, and over different time horizons. The existing literature does not directly examine these issues. This study uses the regression model of the difference-in-differences approach to examine 121 Euro-area and North American firms, covering 14 sectors, over the period from 1992 to 2008. The results indicate a positive impact of the EMU on the firms’ financial cash flows, especially after the Euro adoption, which support the related literature. However, the accounting rates of return suggest a mostly negative impact. The magnitude of the impacts declines over time. The results are robust with respect to GDP as a control variable. The study also reports the EMU’s impact on 4 major industrial sectors.

The study examines the European coverage in four leading Nordic newspapers during two periods in 1993 and in 1996. During the first period, three countries were negotiating for membership in the European Union. During the second period, work on a new European Constitution was ongoing, to be negotiated by the Intergovernmental Conference at the end of the period. Two of the applicant countries, Finland and Sweden, were then members of the union since Jan 1, 1995. Voters in the third country, Norway, opted to stay outside the union. Norway is, however closely linked to the union by the previous EEA agreement. Finally, the fourth country, Denmark, had limited its longstanding membership in four important areas. Results of the main study in 1993 indicate a great difference in the degree of Europeanness of the coverage of European affairs, as indicated by the share of European issues, sources, players, institutions etc. The Danish paper, the Politiken, was on all counts genuinely European in its coverage. This could, to begin with, be understood in terms of a relational context - Denmark was a member of the European Community, the other countries were not. In 1996, as could be expected, the Norwegian paper, the Aftenposten, reduced its coverage of European affairs to about half the previous volume, the Finnish and Swedish papers, the Hufvudstadsbladet and the Dagens Nyheter, increased their volumes to new highs. The Danish paper maintained its previously comparatively high volume of European coverage, and was still distinctly more European in its outlook on transnational politics. This could be understood in terms of a new Maturity proposition - it may take a long time for the national media to come to terms with a new political environment. The study also puts forward the proposition that Danish political culture requires a different coverage of European affairs, and also requires an opportunity to discuss and evaluate European politics. On a theoretical level, the study supports the idea that national experience, historical and relational contexts influence media content. National agendas powerfully determine the orientation of transnational political communication . Three in-depth studies by and large confirm results from the content analysis. A separate exercise inspired by Grounded Theory gives rise to three theoretical concepts that seem to be fundamental dimensions of European political communication: Legitimacy (media coverage contributes to status conferral and encourages deliberation of cooperation as an idea), Participation (media coverage as expressions of intrinsical and instrumental motives for joining and taking responsibility towards European cooperation), and Mondialization/Universalism (media coverage of Europe's efforts in the global arena)

Intellectual Property (IP) law envisions promotion of innovation, creativity and productivity by protecting intellectual achievements and thus, providing incentives for firms and innovators to invest in technologies. But the rationale for IP protection has in some cases, demonstrably failed due to the manner in which it could be abused and misused as the grant of exclusive rights to innovators can simultaneously raise barriers to accessing information and technology, thus slowing down competition and raising costs for consumers. Consequently, IP rights have been caught up in an ideological contest of why, what and how innovation should be pursued within the complex globalised high-tech knowledge-economy. This thesis analyses the promotion of innovation in light of non-use and unreasonable use of IP rights in the United States (US) and European Union (EU) within a dynamic legal, political and economic framework. In unfolding the various dimensions of this issue, the thesis is structured in the form of essays which independently examine target case-studies in the US and EU. It uses an inter-disciplinary approach and multiple methodologies, including empirical and legal textual analysis to covers IP non-use and unreasonable use within the context of research and development policy, trade and liberalisation policy, and competition policy. The thesis explores specific areas where the US and EU are faced with the challenge to deal with non-use and unreasonable use of IP rights. It further analyses whether the steps taken by the US and EU to deal with these challenges would stand the scrutiny of international treaty agreements such as the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS). The thesis finds that both US and EU struggle to deal with challenges posed by abuse of IP rights. Furthermore, both jurisdictions are reluctant to comply with their obligation towards the TRIPS agreement. Overall, the thesis finds that the US and the EU are poor role models to developing countries who look up to the developed economies in their effort to enhance their patent regime.

This study is an attempt to understand strategy-making in the European Union (EU). By targeting the strategy-making process of the European Union Global Strategy (EUGS), the stydy aims to reveal the legal provisions and the in-practice procedures of strategy-making in the area of EU foreign policy. The thesis presents two theories, liberal intergovernmentalism and neofunctionalism, from which it constructs two contrasting ideal types of policy-making. By applying the theoretical ideal types on the targeted case, that is the strategy-making process of the EUGS, the study reflects on the relationships between Member states and the EU, as well as on the inter-institutional dynamics that would come to characterize the progress and development of the EUGS.  Despite difficulties in rejecting any of the theoretical ideal types, the study finds the policy-formulation of the EUGS to be more coherent with the neofunctional ideal type than that of liberal intergovernmentalism. This is due to the central role of the European External Action Service (EEAS) which would come to conduct an innovative policy-formulation phase of the strategy and to the lack of bargaining between the Member States on the textual provisions of the strategy. The neofunctional ideal type does yet fall short in explaining for the EUGS as an initial concept and partly for the implementation of the strategy, favoring a liberal intergovernmental interpretation of how the instruments of the EUGS would come to be initiated. The study also reflects on if the experience of making the EUGS may provide for an argument to review the presumed centrality of Member States being the ultimate drivers of EU foreign policy.

This thesis aims to investigate EU peacebuilding in Bosnia-Herzegovina, focusing on the ways in which EU actors engage with local cultural actors and vice versa. Given that, in the liberal peacebuilding tradition, civil society has been considered a key actor in the public sphere, peacebuilding actors have tended to neglect seemingly more marginal actors and their subtle ways of impacting on the peacebuilding process. However, this thesis contends that processes of interaction are not always direct and visible, but centre on discourse clusters, which I frame as imaginary ‘spaces of agency’. Through the creation of meanings within a space of agency and its translation into other imaginary spaces, actors develop the power to impact upon the peacebuilding process, often in coded ways and therefore invisible in the public sphere, as peacebuilding actors, including the EU, have created it. A typology of the modes of interaction and possible responses between spaces helps understand the complexities and nuances of peacebuilding interaction. The thesis uses this framework to analyse several exemplary spaces of agency of the EU, rooting them in institutional discourses with specific reference to Bosnia-Herzegovina. Based on this, I investigate a number of responses to those spaces on the part of local cultural actors, as well as how the latter contribute to the emergence of alternative localised spaces, where the EU’s spaces fail to connect to the everyday dimensions of peace. I suggest that this represents a way in which local actors try to claim the ownership of peacebuilding back in subtle ways. This also points to the ability of actors that have traditionally been excluded from the peacebuilding project to contextualise abstract and distant processes into what matters locally, as well as their capacity to reject and resist when the EU’s spaces remain irrelevant for local peacebuilding imaginations.

Au niveau international, la conservation du patrimoine a fait l’objet de discussions philosophiques et pratiques considérables au cours des dernières années. La question du lien entre patrimoine et développement est abondamment évoquée, fait l’objet de convictions largement partagées mais les mécanismes qui entrent en action dans ce lien sont très mal identifiés. Etroitement intégrée aux questions environnementales, à l’aménagement rural et aux processus de régénération urbaine, la relation entre patrimoine et développement appartient tant à l’économique qu’au social et au politique. Notre recherche fait entrer les préoccupations patrimoniales dans le champ de la gouvernance locale et régionale elle s’intéresse à leur rôle dans les stratégies d’identité et dans la construction du capital social.

Où se situe le patrimoine dans les politiques de la cohésion européenne? Quels sont les objectifs de la politique de cohésion? Quelles sont les interactions entre développement, cohésion et patrimoine? Les politiques en faveur du patrimoine, actuellement appliquées, sont elles classiques? C’est-à-dire :sont-elles focalisées sur la protection et la restauration du patrimoine ;ou bien sont-elles plus complexe, en ce sens qu’elles impliquent la valorisation et l’insertion du patrimoine parmi les ressources d’un territoire, permettant à la fois d’y greffer des politiques d’emploi, des politiques commerciales et des politiques de cohésion sociale ?Actuellement quelles sont les limites d’une mise en œuvre performante? Au final, le patrimoine a-t-il vraiment la signification et la place qu’on veut lui attribuer? Outre ce qu’ils postulent en matière de développement, les textes produits par l’UE indiquent que le patrimoine et sa valorisation sont d’habitude considérés comme éléments qui contribuent positivement à l’amélioration de la qualité de vie. Mais quelles sont les définitions qui sont actuellement disponibles? Quels sont vraiment les rapports entre toutes ses notions et leur concrétisation sur le terrain? La thèse ambitionne de contribuer à une réponse à ses questions.

Les instruments fournis dans le cadre de la politique européenne, sont extrêmement nombreux et multiformes. Une analyse est tentée afin d’évaluer l’efficacité de divers instruments disponibles de la politique de cohésion, en termes de valorisation du patrimoine et de son intégration, dans un contexte de développement local et régional. L’analyse s’effectue au travers d’études de cas. Les études de cas proposées (deux études de cas dans deux pays européens différents, la ville de Nicosie à Chypre et la ville de Xanthi en Grèce) traitent de l’espace du sud-est méditerranéen de l’U.E. La Grèce et Chypre ont été choisis en tant qu’exemples tout à fait représentatifs d’un point de vue géographique mais également d’un point de vue Européen. (Grèce:U.E 3 et Chypre: UE 12)

Le cas de Xanthi, Grèce, est le plus développé. Notre étude le présente comme un résultat globalement positif du rôle des politiques et des programmes de l’ U.E. Les mécanismes locaux d’utilisation des opportunités offertes par les financements européens sont expliqués. On montre comment l’identification, la réhabilitation, la valorisation d’un patrimoine spécifique à la région et la polarisation des politiques de développement sur ce patrimoine ont entraîné d’importants changements dans le comportement de la population vis-à-vis de son territoire. Outre un réinvestissement massif des groupes sociaux moyens et supérieurs dans le cœur urbain, on a pu constater une forte croissance de toutes les activités tertiaires et l’émergence d’une vie locale extrêmement dynamique. Tant la démographie que le nombre d’emplois montrent une courbe ascendante. Si l’on ne peut pas faire abstraction de phénomènes qui se rapprochent de la gentrification, on doit admettre que l’évolution des prix des immeubles et du foncier, n’a pas eu des conséquences identiques à celles qui sont observées en Europe occidentale. On peut semble–t-il dans ce cas (proche d’autres cas voisins dans les petites villes grecques) parler d’amélioration de la qualité de la vie.

Abstract

This thesis deals with the democratic accountability question within systems of global governance, but focuses on the European Union. The main ambition has been to explore and give an account for the current situation, and lack of accountability as a part of the European Union democratic deficit. It will also stress some of the solutions proposed. In order to fulfil this I have used classic liberal democracy theory and multi level governance theory. The thesis defines the concept of accountability as to be held accountable to a constituency or a superior official and the relationship between them can take many different shapes. Several factors are identified as threats to accountability such as many tiers of governance, no clearly defined responsibilities and the lack of elected politicians on a level of global governance. By establishing the EU as a government of multi level governance and a bearer of democratic values, problems with accountability and hence legitimacy will be presented in relation to the EU:s sui generis features and unique composition. The thesis concludes that even though a union with democratic accountability is highly desired, it is not feasible that it will happen in the nearest future, hence as the situation is today with scattered responsibilities and an invisibility within the non elected institutions, accountability remains a utopia for coming generations to implement.

This thesis examines the difficulties encountered in the process of establishing the CommonEuropean Asylum System, taken from a discursive perspective. The focus of the study isthreefold; why are specific issues highlighted by the European Union Member States, how isthe discursive conflict expressed within the discourse on CEAS, and what definitions ofsolidarity are promoted by the Member States. In purpose of addressing these focuses,discourse theory, issue salience and solidarity through burden sharing are used as theoreticalframework. By applying critical method and discourse analysis, this study has managed toestablish that the security issues are among the most highlighted, whereas the geographicallocation of a Member State seems to be an explanatory factor to a Member State’s specificemphasis. Regarding the discursive conflict, the definitions of the concepts mutual trust, fairdistribution and cooperation are especially contested. Furthermore, the external dimension ofsolidarity is proven to be the precedent definition of solidarity.

This study questions the way sex trafficking is constructed by the EU in their public policy exploring what potential implications exist by the way sex trafficking is problematised. Hence, the objective of this study is to understand how the EU constructs the problem of sex trafficking in their policies, and how this can lead to further policy implications for eradicating sex trafficking. This research analyses the three main policy documents by the EU; Directive 2001/36/EU, its strategy document The EU Strategy towards the Eradication of Trafficking in Human Beings 2012–2016 and Council Directive 2004/81/EC. The discourse analysis called What’s the problem represented to be? will be used as method. It also analyses through the theories of Intersectionality and Governmentality. The results reveal that sex trafficking is a problem of law enforcement, welfare, and illegal immigration. Sex trafficking is constructed as a crime that violates fundamental rights, encourages gender inequality, and threatens the security in the EU. The way the EU constructs victims endorses gender and racial stereotypes. Furthermore, not much efforts are on reducing root causes for trafficking, as main the focus is on the transportation rather than on the exploitation of the victim.

The European Union has been a discussed subject for many years. The conversed areas have been everything from special state interests, refugee crisis, sizes of cucumbers and if the European Union has a sense of community. One of the most debatable fields has been the agricultural policy; control of goods by the union and influence on other markets. This study illustrates what the union controls in form of agricultural production, although mostly aspects around the international agency of the EU, illustrated by the common agricultural policy.   In the liberalised decade of 2010, the rich and powerful European Union still continues to maintain protectionism and customs, and at the same time conduct an aggressive expansion policy. Their current actions in this political area appear abnormal when observed from an analytical perspective. The nations within the EU are all in front line when it comes to everything from technical to democratic perspectives. They are all advocates of freedom, human rights and openness, but are at the same time part of this controlled and restrictive policy regarding their food.   The aim of this essay is not only to illustrate the relationship between the EU and its member states in question of agricultural policies. Also how less fortunate parts of the globe, in particular sub-Saharan African countries, are affected by the contemporary agricultural policies. The presented empirical material will be analysed through three political ideologies, which will represent conservatism, socialism and liberalism within the international political economy. The ideologies combined with the empirical material together with ideology analysis and qualitative text analysis will discuss the question of the essay, which will end up in the final analysis and conclusion.

This research aims to understand the nature and underlying motives of the EU’s relations with the Community of Latin American and Caribbean States (CELAC). The frequently claimed normative role of the EU will be examined in the context of the EU- CELAC summit relations, and the cases should be outlined that cause a switch to Realpolitik behavior. Thereby, the EU’s engagement in regional integration and interregional cooperation will be illustrated and EU-CELAC cooperation areas concerning the fight against poverty and social inequality, the consolidation of good governance and the promotion of peace, and lastly, the regional integration, trade, and economic cooperation are analyzed to reach an understanding of their normative or Realpolitik content. The research illustrates the ways of understanding the EU’s normative behavior and power, and the nature of the cooperation between the EU and the CELAC, whereby it should be shown that the EU acts according to normative consideration and only in few exceptions turns towards Realpolitik behavior.

When the world becomes drowned in multiple global problems and citizens do not see any real progressive solutions from their governments, they take the initiative in their own hands and start changing the world on their own. The Transition Town movement was born this way. It is a social movement which aims at building resilient local communities in response to climate change, peak oil and an unfair ecologically destructive economic system which is probably soon to break down. As a potentially strong actor of future social change, it is worth studying emerging local movements in Europe, and hopefully identifying new potentials for success of these grass-root innovations.The study, thus, aims to investigate the relation between the participants of the Transition Movement Sweden and the supranational/intergovernmental entity EU, which plays one of the key roles in economic, environmental and social aspects of Swedish citizens. By conducting interviews with participants of the movement in several Swedish cities, the nature of this relationship is being explored. Using the theory of Multi-Institutional Politics Approach the case study explains the connection between the movement and the EU.

This study is conducted with the purpose to unfold hidden sides of the EU – Russian energy cooperation and to shed a light on possible reasons for existing problems that have rarely been voiced before. This study provides an alternative view on the role of the Baltic Sea region in the overall EU – Russian energy dialogue and its current situation. In this research the historical observation of the energy interdependence regime development is examined and the crucial turning points in the energy interdependence like the EU enlargement 2004, the gas cut offs 2006 and 2009, and crises 2014 are reconsidered. The energy security policies of the EU and Russia are analyzed by adopting the realist approach and applied to the case of the Baltic Sea region. Furthermore, based on the regional complex security theory and interdependence theory, the way how interstate gas relations in the Baltic Sea region affect the EU – Russian interdependence is discussed.

In Sweden, Small-Medium Enterprises (SMEs) are supported by government programme at the EU and national levels to decrease unemployment. The Skåne-Blekinge programme is an EU programme to increase job opportunities in Region Skåne and Blekinge. While the Simplifying the pathways to jobs and competence programme is a national programme to decrease unemployment rate among new arrival and long-term unemployment. This study aims to assess the nature and function of indicators utilized in the process of implementation of policy programmes using two case studies from Sweden. The understanding of indicator’s functions and characteristics are important to help the actors designing indicators which can measure the goal achievement. This study employed document analysis and interview for data collection, and for analysis, this study used a narrative analysis to describe the programme’s characteristics, indicator’s functions and indicator’s characteristics at programme and projects levels. In summary, the Skåne-Blekinge programme has guidelines which are tools to govern the programme. On the contrary, the Simplifying the pathways to jobs and competence programme utilizes dialogue to create and learn about the projects. Generally, the results-based management is not yet performed. Instead, it starts to be implemented by utilising an indicator that aims to measure the programme’s impact. In term of indicator’s understanding, there is a difficulty to understand it because some people do not notice that an indicator is a measurement tool. At the programme level, indicators are not fully functioned as it should be. In the Skåne-Blekinge programme, indicators should be more reliable, credible, realistic, and accepted. In the Simplifying the pathways to jobs and competence programme, indicators should be more credible, measurable, realistic, reliable, and accepted. At the project level, indicators are more useful for project leaders under the Simplifying the pathways to jobs and competence programme than for project leaders under the Skåne-Blekinge programme. In detail, the characteristics that make indicators are useful for the project leaders are appropriate, relevant, and accepted. These findings contribute to increasing knowledge about indicator’s influence at the programme and project levels both in the Skåne-Blekinge programme and the Simplifying the pathways to jobs and competence programme in practice.

Following the intrinsically linked balance sheets in his Capital Formation Life Cycle, Lukas M. Stahl explains with his Triple A Model of Accounting, Allocation and Accountability the stages of the Capital Formation process from FIAT to EXIT. Based on the theoretical foundations of legal risk laid by the International Bar Association with the help of Roger McCormick and legal scholars such as Joanna Benjamin, Matthew Whalley and Tobias Mahler, and founded on the basis of Wesley Hohfeld’s category theory of jural relations, Stahl develops his mutually exclusive Four Determinants of Legal Risk of Law, Lack of Right, Liability and Limitation. Those Four Determinants of Legal Risk allow us to apply, assess, and precisely describe the respective legal risk at all stages of the Capital Formation Life Cycle as demonstrated in case studies of nine industry verticals of the proposed and currently negotiated Transatlantic Trade and Investment Partnership between the United States of America and the European Union, TTIP, as well as in the case of the often cited financing relation between the United States and the People’s Republic of China. Having established the Four Determinants of Legal Risk and its application to the Capital Formation Life Cycle, Stahl then explores the theoretical foundations of capital formation, their historical basis in classical and neo-classical economics and its forefathers such as The Austrians around Eugen von Boehm-Bawerk, Ludwig von Mises and Friedrich von Hayek and most notably and controversial, Karl Marx, and their impact on today’s exponential expansion of capital formation. Starting off with the first pillar of his Triple A Model, Accounting, Stahl then moves on to explain the Three Factors of Capital Formation, Man, Machines and Money and shows how “value-added” is created with respect to the non-monetary capital factors of human resources and industrial production. Followed by a detailed analysis discussing the roles of the Three Actors of Monetary Capital Formation, Central Banks, Commercial Banks and Citizens Stahl readily dismisses a number of myths regarding the creation of money providing in-depth insight into the workings of monetary policy makers, their institutions and ultimate beneficiaries, the corporate and consumer citizens. In his second pillar, Allocation, Stahl continues his analysis of the balance sheets of the Capital Formation Life Cycle by discussing the role of The Five Key Accounts of Monetary Capital Formation, the Sovereign, Financial, Corporate, Private and International account of Monetary Capital Formation and the associated legal risks in the allocation of capital pursuant to his Four Determinants of Legal Risk. In his third pillar, Accountability, Stahl discusses the ever recurring Crisis-Reaction-Acceleration-Sequence-History, in short: CRASH, since the beginning of the millennium starting with the dot-com crash at the turn of the millennium, followed seven years later by the financial crisis of 2008 and the dislocations in the global economy we are facing another seven years later today in 2015 with several sordid debt restructurings under way and hundred thousands of refugees on the way caused by war and increasing inequality. Together with the regulatory reactions they have caused in the form of so-called landmark legislation such as the Sarbanes-Oxley Act of 2002, the Dodd-Frank Act of 2010, the JOBS Act of 2012 or the introduction of the Basel Accords, Basel II in 2004 and III in 2010, the European Financial Stability Facility of 2010, the European Stability Mechanism of 2012 and the European Banking Union of 2013, Stahl analyses the acceleration in size and scope of crises that appears to find often seemingly helpless bureaucratic responses, the inherent legal risks and the complete lack of accountability on part of those responsible. Stahl argues that the order of the day requires to address the root cause of the problems in the form of two fundamental design defects of our Global Economic Order, namely our monetary and judicial order. Inspired by a 1933 plan of nine University of Chicago economists abolishing the fractional reserve system, he proposes the introduction of Sovereign Money as a prerequisite to void misallocations by way of judicial order in the course of domestic and transnational insolvency proceedings including the restructuring of sovereign debt throughout the entire monetary system back to its origin without causing domino effects of banking collapses and failed financial institutions. In recognizing Austrian-American economist Schumpeter’s Concept of Creative Destruction, as a process of industrial mutation that incessantly revolutionizes the economic structure from within, incessantly destroying the old one, incessantly creating a new one, Stahl responds to Schumpeter’s economic chemotherapy with his Concept of Equitable Default mimicking an immunotherapy that strengthens the corpus economicus own immune system by providing for the judicial authority to terminate precisely those misallocations that have proven malignant causing default perusing the century old common law concept of equity that allows for the equitable reformation, rescission or restitution of contract by way of judicial order. Following a review of the proposed mechanisms of transnational dispute resolution and current court systems with transnational jurisdiction, Stahl advocates as a first step in order to complete the Capital Formation Life Cycle from FIAT, the creation of money by way of credit, to EXIT, the termination of money by way of judicial order, the institution of a Transatlantic Trade and Investment Court constituted by a panel of judges from the U.S. Court of International Trade and the European Court of Justice by following the model of the EFTA Court of the European Free Trade Association. Since the first time his proposal has been made public in June of 2014 after being discussed in academic circles since 2011, his or similar proposals have found numerous public supporters. Most notably, the former Vice President of the European Parliament, David Martin, has tabled an amendment in June 2015 in the course of the negotiations on TTIP calling for an independent judicial body and the Member of the European Commission, Cecilia Malmström, has presented her proposal of an International Investment Court on September 16, 2015. Stahl concludes, that for the first time in the history of our generation it appears that there is a real opportunity for reform of our Global Economic Order by curing the two fundamental design defects of our monetary order and judicial order with the abolition of the fractional reserve system and the introduction of Sovereign Money and the institution of a democratically elected Transatlantic Trade and Investment Court that commensurate with its jurisdiction extending to cases concerning the Transatlantic Trade and Investment Partnership may complete the Capital Formation Life Cycle resolving cases of default with the transnational judicial authority for terminal resolution of misallocations in a New Global Economic Order without the ensuing dangers of systemic collapse from FIAT to EXIT.

La ricerca è stata svolta analizzando l'architettura delle due reti (internet e reti energetiche) e l'evoluzione del bene prodotto e distribuito nella rete energetica, l'energia, esplicitando l'accessibilità da parte della distribuzione mondiale delle risorse petrolifere tradizionali e delle risorse rinnovabili. La struttura metodologica del progetto di ricerca si basa due tipi di analisi teorica: 1) l'analisi della nascita delle società in rete attraverso le teorie di Manuel Castells (concetto di spazio di flussi) e di Saskia Sassen e l'evoluzione delle città (cap.2 e cap.5) 2) le analisi dei flussi dei materiali e delle energie avendo come riferimento metodologico l'approccio ecologico ideato dai ricercatori dell'istituto per il Clima, l'Ambiente e l'Energia di Wuppertal, Germania (cap.3 e cap.4) La contraddizione tra città innovative e città che sono ai livelli di enormi discariche o di baraccopoli è esposta nel cap.6 attraverso casi studio e progetto dei Programmi Europei. Nell'ultimo capitolo (cap.7) si riassumono le ipotesi di partenza e i risultati della ricerca e si espongono le questioni aperte.
Can internet logic scheme be used as a basis to describe public policies evolution on renewable energies production and sharing in urban areas all over the world? The research project analyses the two networks (internet and energetic grids) architectures in actual and future urban areas. This analysis is connected with present and future forecasts energy productions from traditional fuels and from renewable sources. Theoretical analysis is conducted following a double conceptual pathway: - societal networks (Manuel Castells theory) and urban areas evolution (Saskia Sassen and Mike Davis) in order to picture the evolution of cities and towns in modern economies and in developing countries (Chapters 2 and 5); - Material and Energy Flow Analysis (approach by Wuppertal Institute for Climate, Environment and Energy) applied to renewable energy (Chapters 3 and 4) In Chapter 6 case studies are exposed on the deep cleavage between two different worlds: innovative, rich towns on a side and the landfills cities, slums on the other side. In the last part hypothesis and thesis are put together and open questions are explained (Chapter 7).

The objective of this thesis is to examine the role and utility of competition law within the EU’s legislative and regulatory dialogue, using its response to crisis conditions as a test of its aims and abilities. As such, the main conclusion of this thesis is that competition policy acts as a forum for debate as to the direction of the European integration project, while competition law can serve as a tool for aiding in the implementation of broader policy objectives. The analysis in this thesis follows certain themes as they arose in the individual chapters, namely: (i) the role of the general economic context in the application of competition law, (ii) the existence of identifiable baselines applicable in crisis conditions, (iii) the ability and role of National Competition Authorities (NCAs) in applying competition law, and (iv) the ways in which the Commission’s overarching policy goals can influence the application of competition law. The decision to take an empirical approach to this research project stems from a conviction that an investigation into the real world situations faced by firms and consumers should underpin the evaluation of the applicable legal rules. Over the past number of years the European Commission has exerted more and more influence over the development of the regional and global airline industry, and Chapters 4 and 5 reflect the emergence of an apparent overarching aim on the part of the Commission to create a market with a handful of ultra-competitive airlines with international reach serviced by an array of smaller feeder airlines on a regional basis. The study of the Irish beef processing sector in Chapter 6 is interesting because of the high level of government involvement in providing the strategic thinking behind a crisis cartel scheme, and because the economic context appears to have exerted considerably more pressure on the government and the national court than on the competition authorities involved.
