Legal and bioethical principles. Separation, connection, integrationThis work is intended to establish relationships between legal and bioethical principles especially when bioethical principles complement and enrich legal ones in order to solve a specific case. Prior author’s contributions on bioethical principles as legal topics and legal bioethics creation in terms of a branch of bioethics which studies legal regulations as well as legal implementation and scope of bioethical problems are referred, making a critical reflection on growing and fruitful relationships between bioethics and law. An Interdisciplinary integration proposed in order to realize cooperation between both fields rejecting a separation or mere connection is suggested: «hetero integration», an integrating system produced by development of common and related principles. The article concludes stating that law structure is a «textual» subject not just involve on the writing of the law but capable to be analyzed from a social sense point of view, conferred to different manifestation of this discipline together with several social practices; a path warning by the need to broad theoretical-practical frameworks in order to move towards the interdisciplinarity taking into account bioethics from its foundations.
El objetivo de este trabajo es examinar la relación que existe entre los principios jurídicos y los principios bioéticos, en particular cuando los principios bioéticos enriquecen y complementan los principios jurídicos en la solución del caso concreto. Se acude a aportes anteriores del autor sobre los principios bioéticos como tópicos jurídicos y la creación de la bioética jurídica como rama de la bioética que estudia la regulación jurídica y las proyecciones y aplicaciones jurídicas de la problemática bioética y permite, como se procura aquí, una reflexión crítica sobre las crecientes y fecundas relaciones entre bioética y derecho. Desechada la separación y aun la mera vinculación, se propone una integración interdisciplinaria tendiente a instrumentar la cooperación entre ambos campos: heterointegración, producida por desarrollo de principios comunes y afines. Se concluye que el derecho constituye una materia textual, susceptible de ser analizada desde una perspectiva que no se agota en la mera escritura de la ley, sino que intenta captar la producción de sentido social que se inviste en las diversas manifestaciones de esta disciplina y que abarca distintas prácticas sociales, senda por la que se advierte la necesidad de ampliar los marcos teórico-prácticos para poder transitar la interdisciplinariedad y en la que no debe faltar la bioética desde sus principios

Esta tesis se centra en los desarrollos recientes de la teoría microscopía de la exoelectricidad y sus aplicaciones prácticas con tal de estudiar la respuesta física en sistemas concretos. La exoelectricidad es la propiedad electromecánica de todos los aislantes de desarrollar una respuesta polar a una perturbación uniforme del gradiente de deformación. Una teoría formal de tal efecto se ha establecido recientemente en el marco de la teoría de perturbación del funcional densidad (DFPT). Aun así, para alcanzar una metodología valiosa para la automatización del cálculo de la respuesta exoeléctrica para un cristal genérico, quedan algunos detalles conceptuales y prácticos. Estos están relacionados con las rotaciones locales de la muestra que pueden seguir una perturbación de gradiente de deformación. En esta tesis nos ocuparemos de tal cuestión; la solución se basa en la introducción de una nueva perturbación del cristal, la perturbación métrica, que se define como un fonón acústico descrito en el sistema de referencia que se mueve conjuntamente con los átomos. Después de presentar su implementación formal en el contexto de DFPT y en la aproximación de pseudopotencial separable, emplearemos esta nueva herramienta para calcular el tensor exoeléctrico para materiales seleccionados. A los logros anteriores les sigue una aplicación práctica de la teoría flexoeléctrica a la ingeniería del diseño de dispositivos " exovoltaicos", es decir dispositivos fotovoltaicos cuyos principios fundamentales de trabajo se basan en el efecto exoeléctrico. En la práctica, gracias a la estrecha conexión entre la teoría de la exoelectricitad y y la teoría de los potenciales absolutos de deformaci ón, mostramos cómo se puede calcular el perfil de bandas electrónicas en nanodispositivos doblados utilizando pocos y bien definidos parámetros. Dichos parámetros dependen de las condiciones de contorno electrostático impuesto. Finalmente centraremos nuestra atención en la respuesta polar mostrada por las paredes del dominio (PdD) ferroeelástico en SrTiO3, recientemente detectado. En general, las PdD se consideran una fuente prometedora de efectos físicos inusuales que pueden ser de interés práctico para aplicaciones de dispositivos electrónicos. Para mejorar la aplicabilidad de tales efectos físicos, es imprescindible entender su origen. Inspirados en la teoría de la exoelectricidad, en este trabajo desarrollamos una metodología original para estudiar el caso de las PdD ferroelásticos en SrTiO3, que se basa en la construcción de un modelo energético efectivo, construido en base a calculos de primeros principios, y eso incluyendo los efectos de los acoplamientos entre diferentes distorsiones inhomogeneas del cristal. Se discuten los efectos de cada contribución a la polarización total en las PdD.
This thesis focus on the recent developments of the microscopic exoelectric theory and its practical applications to study the physical response in concrete systems. Flexoelectricity is the electromechanical property of all insulators of developing a polar response to a uniform strain gradient perturbation. A formal theory of such effect has been recently established in the framework of density functional perturbation theory (DFPT). Still, in order to reach a valu- able methodology to facilitate the calculation of the bulk exoelectric response for a generic crystal, some conceptual and practical subtelties remains. They are related with local rotations of the sample that can follow a strain gradient perturbation. In this thesis we will deal with such issue; The solution is based on the introduction of a novel crystal perturbation, the metric perturbation, which is defined as an acoustic phonon described in the reference frame that is co-moving with the atoms. After presenting its formal implementation in the context of the DFPT within the separable pseudopotential approximation, we will employ such new tool to perform extensive calculations of the exoelectric tensor for selected materials. The previous achievements are followed by a practical application of the exoelectric theory to engineering the design of \ exovoltaic" devices, i.e. photovoltaic devices that base their fundamental working principles on the exoelectric effect. In practice, thanks to the close connection between the exoelectric theory and the theory of absolute deformation potentials, we show how the electron band profile of bended nanodevices can be calculated, in a mesoscopic semiclassical framework, using few and well defined parameters. Such parameters vary with respect to the type of electrostatic boundary conditions imposed. Finally, we will focus our attention on the polar response shown by the fer- roelastic domain walls (DWs) in SrTiO3, recently detected. In general, DWs are considered a promising source of unusual physical effects that can be of prac- tical interest for electronic device applications. For improving the applicability of such physical effects it is essential to understand their origin. Inspired by the theory of exoelectricity we develop an original methodology to study the case of the ferrolastic DWs in SrTiO3, which is based on the construction of an effective energy model, full from first principles, and that includes the effects of gradient mediated couplings between different crystal distortions. The effects of each identified contribution to the total polarization at the DWs is discussed.

This thesis challenges some of the current limits to the grounds for judicial review of legislation accepted by most Canadian jurists. More specifically, it makes a common law-based argument in favour of the priority over legislation of principles which are implied from the Imperial Constitution Acts 1867-1982 and which originally derive from the English constitution – namely implied constitutional principles. The argument faces two main interrelated legal objections: Parliamentary sovereignty and the Framers’ intentions. The first objection is rebutted by arguing that Parliamentary sovereignty possesses an ability to change in a way that can incorporate substantive legal limitations. The most prevalent common law-based theories of change to Parliamentary sovereignty suggest that the courts can authoritatively determine if implied constitutional principles can check legislation. The second objection is rebutted by reference to the notion of progressive interpretation as conceived under Hartian and Dworkinian theories of law and adjudication. Under these theories, progressive interpretation is an aspect of the courts’ best overall interpretation of the constitution, which includes implied constitutional principles. Such progressive interpretation can result in these principles constraining legislative authority. Justification of the progressive interpretation of implied constitutional principles can be based on the rule of law from which derive a number of these principles. One plausible conception of the Canadian rule of law is that it rejects the view that implied constitutional principles can prevail when in conflict with legislation. However, the better conception is that, as an attempt to adapt implied constitutional principles to relevant changes in society and to protect their underlying values, the judiciary should interpret these principles as capable of checking legislation to the extent that they form part of the core content of the rule of law. Such a conception and an operation of implied constitutional principles can properly be explained by Hartian or Dworkinian common law-based progressive interpretation of these principles and by their relationship with legislative authority.

Během studií jsme se učili, jak porozumět pravidlům psaní scénáře a jak je aplikovat na tradiční strukturu dramatu. Krom uspořádání do tří aktů existují také alternativní epizodické způsoby konstruování vyprávění s odlišnými pravidly. Přesto řada úspěšných epizodických filmů stojí na tradiční trojaktové stavbě. Mým cílem bylo popsat principy prolínání struktur a zkoumat, jak jsou uplatňovány v režijním zpracování filmů vysoké umělecké kvality. Ve čtyřech současných revisionistických westernech byly nalezeny čtyři možné principy, které je možné uplatnit také při psaní scénářů pro filmy jiných žánrů. Tyto filmy ukazují, jak je možné se vyhnout scenáristickým klišé a zároveň potvrzují, že aktuální sociální témata mohou být zkoumána v rámci žánrových filmů, o které masové publikum stojí.

La notion de principe directeur est apparue en procédure civile il y a une quarantaine d’années et sert depuis de guide établissant les garanties fondamentales de bonne justice dans le procès civil. Elle s’est, ensuite, implantée en matière administrative et pénale. Un engouement pour cette notion l'a fait apparaître récemment en droit des contrats à un double niveau : au plan interne tout d'abord, depuis 2008, les différents projets de réforme du droit des contrats innovent par la création d’une nouvelle catégorie juridique, les principes directeurs. En fonction des projets, il est proposé d’intégrer dans cette catégorie la liberté contractuelle, la force obligatoire, la bonne foi, la cohérence. Au plan européen ensuite, les autorités bruxelloises s'interrogent, depuis un certain temps, sur l'opportunité de l'élaboration d'un droit européen des contrats commun à tous les États Membres. À cet effet, on retrouve des principes directeurs dans divers textes, codifications savantes et propositions à venir. Dès lors, ce concept a suscité un grand intérêt et les commentateurs ont majoritairement porté un regard très critique sur cette éventuelle introduction. Plus rarement, cette dernière a provoqué une certaine approbation. L’objet de la recherche consiste donc à approfondir le concept de principes directeurs du droit des contrats car après les premières questions liées à la curiosité scientifique doivent venir les recherches portant sur la science des principes directeurs du droit des contrats. Et si la notion est aujourd’hui fréquemment utilisée, son concept demeure énigmatique, aucun consensus ne s’étant opéré sur le sens même à lui donner et sur ses effets. La notion présente donc de nombreuses zones d’ombres qu’il faudra révéler, d’autant plus, qu’après de multiples résistances du Sénat, la loi du 16 février 2015 a habilité le gouvernement à réformer le droit des contrats par la voie de l’ordonnance. Or, les derniers projets reconnaissent des principes directeurs, il est donc temps d'apprécier la notion et ses effets potentiels
The notion of guiding principle appeared in the field of civil procedure forty years ago and has been since then used as a guide establishing fundamental guarantees for fair justice in the civil trial. Later on, it was implemented in the criminal and administrative matters. Enthusiasm for this notion made it emerge recently in the field of contract law at a double layer: firstly in the domestic legal order, the different reform projects for contract law have been innovating since 2008 because guiding principles have been determined as a new legal category in this matter. According to the project, including in this category contractual freedom, binding force, good faith and coherence has been proposed. Secondly, from a European perspective, Brussels authorities have been questioning for quite a long time the opportunity to elaborate a European contract law common to all member States. As a consequence, some guiding principles can be identified in several sources, scientific codifications and proposals to come. Since then, this concept has generated a great interest and commentators have mainly severely criticised a hypothetic introduction. More rarely, it has been significantly supported. Therefore the purpose of the research is to study in depth the concept of guiding principles in contract law since after the first questions relying on scientific curiosity, researches related to the science of guiding principles in contract law must come. Even though the notion is today often used, its concept remains an enigma, no consensus has been found on its sense or effects. The notion carries many shadowy aspects that will have to be enlightened, especially as after several oppositions from the Senate, the Act adopted on the 16th of February in 2015 authorised the Government to reform contract law by executive orders. Nonetheless, the latest projects recognise some guiding principles so it is time to evaluate the relevance of the notion and determine its potential effects

PONTIFÍCIA UNIVERSIDADE CATÓLICA DO RIO DE JANEIRO
A presente dissertação tem por objetivo analisar o fenômeno da constitucionalização do Direito Administrativo e a conseqüente releitura de dois princípios basilares deste ramo do direito: os princípios da legalidade e da legitimidade administrativas. Após algumas considerações introdutórias e a apresentação do tema no capítulo I, o trabalho analisará, no capítulo II, o nascimento e a evolução do Direito Administrativo, com o intuito de demonstrar que a concepção clássica deste ramo do Direito deve passar por uma leitura constitucional, em tempos de constitucionalização do ordenamento jurídico. No capítulo III, o enfoque será o estudo do princípio da legalidade e a sua evolução ao longo dos tempos. A concepção liberal deste princípio, consagrado no Estado Liberal de Direito, entra em crise. A lei deixa de ocupar o papel de protagonista do ordenamento jurídico para dar lugar à Constituição. O desprestígio do Parlamento, bem como a celeridade e complexidade da vida moderna, acabam por gerar a ampliação do poder normativo das entidades administrativas localizadas fora do Poder Legislativo. Com isso, institutos como a deslegalização e a reserva da administração, bem como a figura do regulamento autônomo, ganham destaque no debate jurídico atual. Ao invés do respeito apenas à lei formal, a atuação administrativa deve adequar-se ao ordenamento jurídico como um todo, o que acarreta a consagração do princípio da juridicidade. Em seguida, no capítulo IV, o estudo tecerá considerações sobre as concepções clássicas de legitimidade e demonstrará a necessidade de se reforçar a legitimidade democrática da Administração Pública através de instrumentos efetivos de participação do cidadão na tomada de decisões e elaboração de normas administrativas. O capítulo V, por sua vez, demonstrará que a releitura dos princípios da legalidade e da legitimidade administrativas pode ser verificada, com mais exatidão, na formatação das agências reguladoras. A discussão em relação à constitucionalidade do modelo regulatório adotado pelo ordenamento jurídico pátrio passa necessariamente pela compatibilidade com os princípios em comento. Por fim, no capítulo VI, a titulo de conclusão, o trabalho apontará a importância do princípio da juridicidade no âmbito do estado Democrático de Direito.
The main goal of this dissertation is to analyze the phenomena of constitutionalization in Administrative law and the resulting reconsideration of two basic pilars underpinning this field of Law: the principles of legality and of administrative legitimacy. After some introductory considerations followed by the presentation of the main theme in the first Chapter, the author will review, in the second Chapter, the emergence and evolution of Administrative Law in order to demonstrate that, in view of the current constitutionalization of the legal system, the constitutional perspective should be added to the classic conception of Administrative Law. The third Chapter will focus on the study of the legality principle and how it evolved through times. The liberal view of this principle, the cornerstone of the Liberal Rule of Law, comes to a crisis. The Law becomes less and less the leading agent of the legal order while this role is assigned to the Constitution. The decreasing prestige of Parliament as well as the complexity and the ever-faster pace of modern life end up extending the normative power to administrative entities found outside the realm of the Legislative Branch. Therefore, institutes such as the de-legalization and the administrative reserve, as well as the institute of -autonomous regulation-, gain prominence in the current public debate. Instead of owing respect only to the formal Law, the administrative arena should also adjust itself to the legal order as a whole, which means that the -principle of jurisdicity- becomes paramount. Subsequently, in the fourth Chapter, the study will discuss the classic conceptions of legality and will demonstrate the need to reinforce the democratic legitimacy in Public Administration by means of effective instruments allowing citizens to be part of the decision-making process and of the development of administrative norms. The fifth chapter, in turn, will demonstrate how the re- consideration of the principles of legality and administrative legitimacy can be more accurately verified in the way regulatory agencies were formatted. Any discussion on the constitutionality of the regulatory model adopted by the legal order in Brazil necessarily includes compatibility with the principles under discussion The sixth chapter will conclude the study pointing out the importance of the -principle of jurisdicity- under the Democratic Rule of Law.

This thesis reconciles an interest in decision-making which appears not to be guided by principles with a defence of a philosophical search for action-guiding principles. Chapter 2 defines the relevant sort of philosophical reflection as very general and explicit practical reasoning. Chapter 3 distinguishes different types of principles in which such philosophical reflection might result. Chapter 4 argues that putting the resulting principles into practice does not need to be as impractical as it is often portrayed because an agent can learn to respond in accordance with her principles without having to consciously invoke them all the time. Chapter 5 refutes the claim that we cannot receive much guidance from such principles because the real work in following a principle is done by something other than the principle. Chapters 6 and 7 consider the idea that one needs to use 'judgement' in order to supplement the guidance offered by principles. It is argued that practical philosophizing can guide one's judgement via the defence of methodical principles, i.e. principles which specify a decision- making method. As it is unlikely that any such method can be proven to reliably guide one correctly, it seems sensible to be conservative and carry on with one's current way of making decisions. However, given that one's present method may be flawed, it is also reasonable to try to learn. This can be done by being open and highly attentive while following one's feelings about what would be the right way to respond to the situation. Interestingly this method is reminiscent of the sort of decision-making which particularists and other opponents of principles describe. Yet my arguments only help an opponent of principles who has tried to justify substantive principles and failed. One cannot philosophically defend such methodical principles while refusing to search for justifiable substantive principles.

This licentiate thesis deals with the design of lined rockcaverns used for the storage of gas under high pressures (20-25MPa). This storage technique has been developed in Swedenduring the last 20 years. The concept has been named LRC (LinedRock Cavern).

The goal of the research has been to develop a methodologyfor the design of the cavern wall so that it can fulfil thesafety demands put placed upon it by the society. To achievethis, an extensive knowledge about the properties of the wallmaterials, and how they interact, is required.

The proposed design methodology is based on the cavern wallbuild-up principles that have emerged during the many years ofdevelopment of the LRC concept. The cavern wall consists, inshort, of (from inside outwards): a gastight steel lining, asliding layer of bitumen, a reinforced concrete lining, ashotcrete layer and finally the rock mass.

In the thesis, a step-by-step approach is proposed toanalyse the deformations and strains that the cavern wall issubjected to as the rock caverns expands as a result of thepressurisation. The analysis begins with an assessment of thedeformation properties of the rock mass and proceeds with anestimation of the deformation in the most strained part of therock cavern. The analysis continues with an examination of howthe rock deformation is transmitted through the wall structure,ending in an assessment of the strain in the most strained partof the steel lining. The final step in the methodology is tocompare the calculated steel strain with the acceptable strain,derived from acceptable risk criteria or extracted fromrelevant codes. As an LRC storage is subjected to hundreds ofload cycles (with potentially high strain levels in the steellining) during its lifetime, the dimensioning load case is lowcycle fatigue.

The methodology is based on several assumptions regardingthe properties of the structural parts included in the cavernwall and how they react to the pressure load, both as singleparts and in interaction with adjacent structural parts. Theassumptions regard e.g. the deformation properties of the rockmass, the behaviour of the rock mass during repeatedhigh-pressure loading, the crack distributing effect of thereinforcement and the properties of the sliding layer.

Support for these assumptions has been gathered fromtheories, previous experiences and performed practical tests.The long concept development work has included numeroustechnical studies and tests, which have been used in thecreation of the design methodology. The experiences gained fromthe Pilot tests in Grängesberg have been especiallyvaluable to this end. A series of laboratory tests on themechanical properties of the sliding layer, for the load casein question, have been performed as part of this licentiatework.

The proposed design methodology for the cavern wall is basedon a probabilistic approach. This approach has been chosen forseveral reasons, among others because LRC is a new technologywithout established design practice and because a probabilisticview is a good way to manage the uncertainties, which in thepresent case originates from the stochastic nature of the rockmass. The properties of the rock mass vary within the volumeand are better described by an interval or a distributioninstead of a deterministic value.

The calculation tools used are in themselves rather simple.The basis is an elastoplastic analytical solution for thedeformation of the rock cavern during pressurisation. Thecalculations are performed as Monte Carlo simulations in aspreadsheet model. The choice of calculation tool was done fortwo main reasons, partly to get a lucid method where each stepin the process can be followed, partly because of limitationsin time and budget. However, a large number of FEM calculationshave been used, in addition to the observed behaviour of thePilot Plant, to verify and calibrate the model.

The proposed methodology shows one practicable way ofdesigning an LRC storage. The methodology has already beenapplied in the design of the world’s first large scale LRCstorage (the LRC Demo Plant at Skallen, near Halmstad insouth-western Sweden).

Areas where it is judged possible to improve or supplementthe proposed design methodology are:•A thorough evaluation of the deformationbehaviour of the Demo Plant can be used to check the validityof the assumptions made. Depending on the outcome of such acheck, this might lead to a modification of the designmethodology.•The sliding layer is of great importance for thestress and strain in the steel lining. It is urgent to continuethe development and testing of the sliding layer material andits properties.•It should be examined if, and in which case how,the use of stochastic FEM analysis, asa calculation tool,could improve the handling of uncertainties in the designmethodology.

This doctoral dissertation presents a comprehensive computational approach to describe quantum mechanical systems embedded in complex ionic media, primarily focusing on the first-principles representation of catalytic electrodes under electrochemical conditions. The accurate electrostatic description of electrified metal-solution interfaces represents a persistent challenge for ab-initio simulations and an essential requisite for predicting the electrical response of electrochemical convertors-i.e., the correspondence between the macroscopic voltage and the microscopic interfacial charge distribution. The approach consists of controlling the electrode voltage via its conjugate extensive variable, namely, the charge of the system. As a preliminary to the study of electrified interfaces in ionic media, we analyze charged slabs in vacuum subject to periodic boundary conditions. We show that the corrective potential (defined as the difference between the exact open-boundary potential and the periodic potential obtained from a Fourier transform) varies smoothly over space, allowing for its determination on a coarse mesh using optimized electrostatic solvers. Because this scheme takes into account exact open boundary conditions, its performance is considerably superior to that of conventional corrective methods. Extending this computational scheme, we present an efficient approach to model electrochemical systems under realistic conditions, based on a first-principles description of the interface region and on a continuum representation of the ionic solvent.

We demonstrate that the ionicsolution contribution to the electrostatic potential-the ionic solvent reaction field--can be computed independently at low cost simultaneously using fast Fourier transforms and multigrid techniques, and highlight the importance of adopting adequate electrochemical boundary conditions to correctly predict the electrical response of electrode-electrolyte interfaces. In order to probe and validate the electrochemical model, we study the vibrational Stark effect-i.e., the influence of the applied voltage on the vibrational properties-for carbon monoxide adsorbed on transition metal surfaces, a phenomenon whose description requires an accurate representation of the interfacial electric field. We start out the analysis by examining the vibrational properties of CO adsorbed on clean and ruthenium-covered platinum substrates. The calculated C-O stretching frequencies are found to be in excellent agreement with experimental measurements despite the frequent qualitative failures of local and semilocal exchange-correlation functionals in predicting adsorption energies for CO on transition metals. We then introduce an orbital-resolved force analysis to clarify the electronic origins of the C-O red shifts, and present a sensitivity analysis to assess the influence the HOMO and LUMO hybridizations on the calculated frequencies, thereby establishing the remarkable accuracy of conventional density-functional theory methods in determining the vibrational properties of adsorbed CO. Based on these results, we apply the electrochemical model to provide the first comprehensive ab-initio description of the vibrational Stark effect for CO on transition metal surfaces, finding excellent agreement with spectroscopic measurements.

As related projects, we have implemented a molecular-dynamics algorithm for metallic systems and developed a self-interaction correction method to rectify the tendency of density-functional theory calculations to overestimate binding energies. The present computational electrochemistry toolkit open promising perspectives for the application of first-principles methods to assist the microstructural engineering of electrochemical convertors.

In this work we analyze some selection principles over some classes of hyperspaces. In the first part we consider selective variations of tightness over a class of function spaces whose topologies are determined by bornologies on the space. As results, we extend several well known translations between covering properties and closure properties of the topology of pointwise convergence. In the second part we consider artificial hyperspaces that assist the analysis of productive topological properties. We emphasize the results characterizing productively ccc preorders and the characterization of the Lindelöf property via closed projections.
Neste trabalho analisamos alguns princípios seletivos quando considerados sobre alguns tipos de hiperespaços. Na primeira parte consideramos variações seletivas do tightness sobre diversos tipos de espaços de funções, cujas topologias são determinadas por bornologias no espaço. Como resultados, estendemos diversas traduções conhecidas entre propriedades de recobrimento e propriedades de convergência na topologia da convergência pontual. Na segunda parte consideramos hiperespaços artificiais que auxiliam na análise de propriedades topológicas produtivas. Destacamos os resultados que caracterizam as pré-ordens produtivamente ccc e a caracterização da propriedade de Lindelöf em termos de projeções fechadas.

This thesis aims to provide a comprehensive analysis of the principle of diplomatic inviolability. The principle of diplomatic inviolability is generally regarded by international law scholars as one of the oldest established principles of international law. The concept of inviolability in contemporary international law contains two distinct aspects: in terms of the duty of the receiving State, the first aspect involves the negative duty of not taking any enforcement action against the inviolable diplomatic premises, diplomatic agents or the diplomatic property, while the second aspect requires the positive duty to protect these premises, personnel and property. The contemporary legal regime governing the principle of diplomatic inviolability can be seen through the core provisions stipulated in the Vienna Convention on Diplomatic Relations 1961. Several controversies can be identified when the authorities of the receiving State face dilemmas of deciding whether the principle of diplomatic inviolability or other norms of international law shall prevail. The dilemmas reveal the conflicts between the principle of diplomatic inviolability and other norms of international law, such as the protection of national security, public safety and human life. In the era of fragmentation of international law, it is not easy for either the authorities of the receiving State or international law scholars to settle the controversies with any straightforward solutions, for the reason that the precedence of diplomatic inviolability would inevitably compromise other norms and vice versa. The thesis examines the concept and theoretical basis of the principle of diplomatic inviolability, explores the historical evolution of the principle, analyses the contemporary legal regime of the principle and the controversies involving the conflicts between the principle and other norms of international law. Finally, the thesis critically reviews the various traditional solutions and proposes several alternative solutions to settle the controversies.

La compréhension de l’origine de la supraconductivité haute température est entravée parl’absence de matériaux analogues aux cuprates. Bien que proposée depuis longtemps dans lesoxydes de nickel de formule générale Rn+1NinO2n+2, matériaux isoélectronique aux cuprates, lasupraconductivité n’a été observée qu’en 2019 mais les mécanismes mis en jeu reste à déterminer.Dans cette thèse, nous présentons une étude des oxydes de nickel supraconducteurs à partirde simulations de premiers principes basées sur la théorie fonctionnelle de la densité. Nousrévélons que les composés RNiO2 à couche infinie non dopés présentent une phase métalliqueantiferromagnétique à basse température. Un fort couplage de Hund qui domine le champcristallin explique la coexistence entre l’antiferromagnétisme et le comportement métallique. En étudiant le diagramme de phase en fonction de n, nous identifions un ordre de charge entredes Ni1+ et Ni2+ pour n = 2. Il est la conséquence d’une instabilité électronique du degréd’oxydation 1.5+ des Ni qui préfère dismuter vers les degrés 1+ et 2+ qui sont plus stables,produisant une distorsion Boc des complexes NiO4 pour accomoder les différents charges. Àpartir de ce point, le dopage en électron supprime progressivement l’ordre de charge et il disparaità proximité de la région supraconductrice observée expérimentalent. Nous construisons alorsun modèle supraconducteur basé sur les modes de phonons Boc reproduisant quantitativementle dôme de température critique supraconductrice en fonction du dopage. Nous discutons enoutre de l’importance de la structure cristalline lors de la conception de nouveaux composéssupraconducteurs et de la relation entre ces supraconducteurs à base de nickel et d’autrescomposés supraconducteurs. Enfin, nous étendons le modèle à d’autres composés tels que lesruthénates, expliquant leurs propriétés supraconductrices en tant que matériaux massifs etnanofilms
The understanding of high temperature superconductors based on Cu oxides could beimproved by finding possible oxide analogues with different transition metals. In that regardNi oxide superconductors were proposed to be promising candidates to better understand theorigin of the high temperature superconductivity in the cuprates. In the following manuscript,we present a first-principles study of the physics of the superconducting nickel oxides discoveredin 2019 based on Density Functional Theory. From our study we reveal that the undopedinfinite layer RNiO2 compounds present an antiferromagnetic metallic phase at low temperature.A strong Hund’s coupling that dominates over the crystal field explains the coexistencebetween antiferromagnetism and metallic behavior. Regarding the doping phase diagram, wepropose understanding the normal state of these superconducting compounds, starting froman insulating nickel oxide phase R2NiO4 instead of the metallic RNiO2 phase. This allows usto find a charge-ordering instability in the doping phase diagram when the Ni cations presenta 1.5+ oxidation state. We explore this charge ordering and show that it is a consequence ofan electronic instability that produces a double local environment of Ni+ and Ni2+ cations,which is accompanied by a breathing distortion of the NiO4 complexes Boc. From this point, wefurther study this charge ordering instability revealing that decreasing the Ni oxidation statequenches the instability and it disappears in the vicinity of the reported superconducting region.We then build a superconducting model based on the Boc phonon modes which can reproducequantitatively well the superconducting critical temperature dome accounting for the metallicbut non-superconducting region in the doping phase diagram. Furthermore, we discuss theimportance of the crystal structure when designing new superconducting compounds and howthese nickel-based superconductors relate to other superconducting compounds. Finally, weextend the model to other compounds such as the ruthenates, explaining their superconductingproperties as bulk and nanofilm materials

Leibniz considered that scepticism and confusion engendered by the disputes of different sects or schools of metaphysics were obstacles to the progress of knowledge in philosophy. His solution was to adopt an eclectic method with the aim of uncovering the truth hidden beneath the dispute of schools. Leibniz's project was, having in mind the eclectic method, to synthesise a union between old pre-modern philosophy, based on formal and final causes, and new modern philosophy which gave preference to efficient causes. The result of his efforts is summarised in the Monadology. But the question remains: to what degree was Leibniz successful in this enterprise? An objective of this thesis is to investigate whether philosophical tradition can justify or support some of the arguments that are at the basis of Leibniz's system (for example, monads have no window to the exterior world, a phrase that summarises the structure of Monadology). I shall demonstrate how Leibniz reflects the concerns and the positions of his key predecessors. Thus, the aim of the thesis is to explore key antecedents to Leibniz's central doctrines. The thesis argues that Leibniz carried out a logical development of some principles in the eclectic system of Plotinus, which resulted in the structure of Monadology. Whether Leibniz's project was successful or not will depend on how we view those principles.

This thesis argues that coercive counterinsurgency (COIN) has played a larger role historically than is currently recognized in todays FM 3-24 doctrine, which reflects the popular view of COIN as emphasizing protection of the population. The extent to which the essence of COIN has been misunderstood and misinterpreted, undermining the coercive gold standard is a central concern. While there has been some recognition of the utility of coercive action against insurgents, ethical concerns about proportionality and the indiscriminate use of force have imposed constraints. Where the gold standard represents deliberate, strict coercion against the population, FM 3-24 emphasizes a far more limited coercive approach, one that may be to the detriment of COIN operations as understood in historical perspective.

The subject of this thesis is 'Ethical Principles for Hospital Design'. The mission of this research is to identify the ethical principles for hospital design in the form of a structured framework for ethical discourse about the medical environment. I think this thesis addresses a gap in the current literature, in which, there is not really an already existing structured framework for ethical discourse about the hospital environment. The ethical principles for hospital design can guide designers to identify their ethical duties toward users of the hospital environment (e.g. patients, staff, and visitors). For this sake, I will be engaging with literature that is critical of using the concept of dignity in biomedical contexts, as well as, Nussbaum's capability understanding of dignity. In the introductory chapter, I will explain my reasons for working on this subject and briefly introduce the content of each chapter. In the second chapter, I will discuss the concept of human dignity from the viewpoint of Kant. I will then consider the standpoint of Nussbaum in relation to the meaning and the theory of human dignity. In the third chapter, I will link the idea of human dignity to the notion of human entitlements in the hospital environment. In this regard, I will explain and develop the implications of human dignity in Nussbaum's thought and, accordingly, I will suggest a list of the entitlements of people in hospitals. Such a list of entitlements is the first part of the ethical method in hospital design which I call the dignity approach. The second part is addressed in the fourth chapter, in which I will suggest and elaborate upon three ethical principles; namely, design for vulnerability, design for healing, and design for reverence. These will form my proposed basic ethical principles of hospital design grounded in respect for human dignity and entitlements. Suggesting the dignity approach, I will, also, be critiquing and seeking to supplement in a certain way the influential Evidence-Based Design approach in hospital design. The last chapter will supply a conclusion of the arguments of this thesis and indicate some directions for future research.

An increasing emphasis on energy eciency in aircraft systems has in recent years led to greater interest in integrated design and optimisation within the industry. New tools are needed to understand, compare and manage energy use of an aircraft throughout its design and operation. This thesis describes a new methodology to meet this need: aircraft exergy mapping. The choice of exergy, a 2nd law metric, to describe the energy ows is fundamental to the methodology, providing numerous advantages over energy alone. The basis for time-variant exergy analysis, a necessity when analysing aircraft systems in detail, is established. A set of software tools were developed to enable the creation, storage and analysis of the exergy map data. To study the ecacy of the method for analysing a time-variant system, a hydraulic wave power test rig was used as a case study. The system was equipped with sensors to provide pressure and ow readings at relevant locations. A model of the system was used to supplement the exergy map detail. Since aircraft will experience a range of atmospheric conditions during a ight, the eects of this on exergy calculations must be considered. A turbojet simulation was used to show that a reference state other than the varying, immediately exterior atmospheric conditions leads to unacceptable inaccuracy. To consider the process of exergy mapping a whole aircraft, a case study based on an Airbus A320 was created, including a performance and turbofan model. An air conditioning system model represented a lower energy subsystem. Further analysis of the exergy map included the establishment of a method for assigning mass-induced exergy destruction and the attribution of costs to the aircraft case study. A comparison between two exergy maps of the same aircraft over dierent missions is made.

Cleaning inside automatic dishwashers (ADWs) represents an example of a ‘black box’ problem. The description of the phenomena occurring during a typical wash cycle is not currently well known. This thesis aims to illustrate and expand the in-depth knowledge required to better understand the wash process by analysing the different mechanical and chemical factors involved as well as the interactions between them. Online measurements techniques (Positron Emission Particle Tracking, scanning Fluid Dynamic Gauge or Image Analysis) were combined with statistical and numerical modelling to investigate the evolution over time of the cleaning system.

In this paper we survey some recent variational principies, which have proved to be very useful in the applications to the theory of differential equations, both ordinary and partial. We start with a basic principle due to Ekeland [4}, which provides new proofs to the well known minimax theorems of Ambrosetti - Rabinowitz [2} and Rabinowitz{7}, {8}. For proofs of these results we refer to{8}. We also mention some applications to semilinear elliptic equations.

This thesis develops the principles of nuclear control which are derived from control models initially developed in the 1940s, namely, The Acheson-Lilienthal Report, and the Baruch Plan. Authors of these works aspired to create a grand disarmament scheme establishing an international authority to manage nuclear energy and to prevent states from diverting nuclear energy production to nuclear weapon development. They identified principles, which they believed needed to be incorporated in any nuclear control plan, if the plan was to be effective in promoting international security and stability. The thesis then examines control models that were actually established and explores how they diverged from the suggested principles identified previously. In protecting states' economic and political sovereignty, a series of compromises were made on meeting principles of control. Political realities forced states to settle on a national inspection system (the International Atomic Energy Agency Safeguards System) which sought to detect the diversion of nuclear materials from peaceful uses to nuclear weapons. This type system was initially considered by analysts of the Baruch era but was emphatically rejected as having weaknesses that would undermine the system's effectiveness. Although decision makers were aware of the damage that compromises on the principles could have on the control system's effectiveness, they believed some imperfect control system was better than none at all. The thesis shows that departures of the established model from the earlier model weakened control system effectiveness as predicted by Baruch era analysts. This less rigourous adopted approach achieved broad international acceptability, but could not provide sufficient assurances to all parties. As a consequence, some governments took unilateral action to enhance their security in the face of inadequate controls and/or engaged in efforts to strengthen the system. The mechanisms they created incorporated some of the basic nuclear control principles originally identified a half-century earlier but were rejected on political grounds. The thesis sheds light on the difficulties in implementing control and the relevance of these implementation problems for disarmament. It highlights the struggle between states' desires for more credible systems requiring greater sacrifices on national sovereignty and a need for broad adherence to international control demanding less intrusiveness and wider benefits. The thesis reveals a long-term trend that states appear more willing to accept international control measures as globalisation occurs and concludes that the control system is evolving towards incorporating the principles identified in the 1940s that were not included in the established system.
