Texto completo da fonteThese last years, the competitive context demonstrated the necessity of reforming the French port policy. This is how the port reform stemming from the law n°2008-660 of July 4th, 2008 created the Major seaports. The model of landlord port was recognized in France. The Major seaport sees its activities refocused on its kingly missions, its missions of operation having been transferred to the port private operators. In front of state property constraints, stemming from the administrative law, the Major seaports had to value their port domain by attracting the private investors and by developing their activities with their «hinterland». The public / private partnership is thus the solution to improve the competitiveness of the Major seaports. If, from the legal point of view, the port authority belongs in «dominant» position by its decision-making role of allocation of port spaces to the various operators, from the economic point of view, the balance of power is inverted for the benefit of the operators. It is thus essential to succeed in balancing these visions in the respect for the free play of competition

In academic research, credit risk laid particular stress on quantitative study of management module tools and Probability of Default . But the measurement tools of Probability of Default are the foundation of credit risk management only. There still harmony with inner practical operation strategies. This study is directed against case company’s credit risk management system from 2007 to 2008 with in-depth interviews with corporate management team. The main purpose is to understand the successful application experience to set up credit risk management system. And the key factors of successes to set up perspectives and affect credit risk management. By building up objective strategy analysis, it could provide to enterprises use for credit risk management establishment and research reference. According to the analysis of research framework and case study, this research completes the conclusions as followings: 1. Credit risk management needs the support and execution from top management level to enter sales daily operation successfully. 2. Enterprises need integrated operation in the perspectives of strategy, organization, processes, and information: All the operations need link together. And the credit risk management should guide into daily sales behavior, to execute and manage credit risk effectively.

In the trend of port privatization, port operations worldwide gradually transition from the service port model to the landlord port model. Accordingly, corporatization has been introduced to the ports in Taiwan to improve their competitiveness and services;since from March 1, 2012, each of the four major port bureaus in Taiwan are divided into a “maritime and port bureau” and a branch of the “Taiwan International Ports Corporation, Ltd.” under the premises of separation of the government from enterprises and organizational reform. Prior to this port authority reform, port operations followed the model of “incorporating government into enterprises,” which enabled port bureaus to invest in port facilities and offer port services on all land within their jurisdiction. The aforementioned reform has changed the management of port operations and the land management of port areas. This study conducted expert interviews and qualitative analysis to determine how separation of the government from enterprises has affected land management at Keelung Port from systemic, management, and operational perspectives. The results revealed that the reform has effectively eliminated the concern of “the player doubling as the referee,” which had been hotly criticized, and has allowed the ports corporation greater autonomy in terms of finance and personnel appointment. However, although the reform has been deemed beneficial to port operations, its impact on land acquisition and port administration requires further investigation.

Since the implementation of Government Procurement Act, the competent authority — Public Construction Commission, Executive Yuan — had set up 40 kinds of sub-laws and more than ten of related operation regulations so as to be the foundation of handling procurement for procuring organs and suppliers. The regulations of government procurement are therefore more complete. While under this circumstance, the dispute of government procurement is increasing day by day. What are the real causes behind the phenomenon? When the two parties had the dispute about procurement, it will incur numerous extra human and substantial costs. If we do not choose corrective approaches to resolve these disputes, not only the two parties waste resources, but also seriously impact the performance of dealing procuring dispute for organs. This situation will be more obvious to the port authority in our study that is located in the key position of sea transportation and transshipment. In this study case, the port authority will deeply suffer the dispute of procurement because it has to provide superior service for shipping company to match the tendency of vessels’ type enlargement. This study explored the ever-happened dispute cases in a port authority and sorted out causes, types, settling ways of procurement dispute and performance of resolving procurement dispute from literatures, and then discussed with main professionals in related business fields to draft adequate questionnaire, going on survey to the members who real did the procurement duty in the port authority. This study got 105 copies of effective surveys, and then preceded factor analysis, correlation analysis, and path analysis to not only verify the hypotheses proposed, but also understand the practices and views of members in the port authority. The conclusions from this study included: 1. Most of procurement dispute happened in the stage of contract implementation. There is huge ratio of concerning cases from representatives. The usual way of resolving procurement dispute is through the appeal to Complaint Review Board of Government Procurement. 2. Different kinds of members got different cognitions in some dimensions. 3. The result of factor analysis shows that there are four significant factors, including perfect regulations, regulations’ acknowledge, training enhancement, and complete documentation. But the primary factors affecting types of procurement dispute are regulations’ acknowledge and training enhancement. Among all four factors, regulations’ acknowledge has the most effect on type of procurement dispute. 4. Type of procurement dispute has positive effect on way of resolving procurement dispute. 5. Way of resolving procurement dispute has positive effect on performance of resolving procurement dispute.

Under the development of global trade, transnational transport is very common in the world, which is the most commonly used way through sea shipment because of the low cost. The Malacca Strait is located in the area of Southeast Asia. There are many ships through this strait. Singapore Port is one of the world''s busiest ports. Singapore have a good performance for economic due to port prosperity to re-export business driven economic take-off. Malaysian port container is far less than the port of Singapore though it is also located in Malacca Strait. This study explores the trend of port shipments between Singapore and Malaysia to understand the difference in the number of containers between Singapore and Malaysia port. Through the case of Hong Kong and Shenzhen, China Special Economic Zone, to understand Malaysia''s current focus on the development of the Iskandar Special Economic Zone, Port Klang third port and Melaka Gateway can copy the success of Shenzhen Special Economic Zone. Finally, the average growth rate of ports in Hong Kong to predict the future of Singapore and Malaysia port container volume and per capita container volume, and Hong Kong and Shenzhen case to assess whether the future of Malaysia due to the growth of port containers to drive its economic growth. The results of this study show that Malaysia''s container shipments account for about 95% of Singapore after the completion of the expansion and construction of Malaysia''s ports in 2025. If China completely relocated its container shipments to Singapore in 2025, Malaysia''s cargo handling capacity was three times that of Singapore, while Malaysia''s per capita container volume would reach 59% of Singapore. Through the case of Hong Kong and Shenzhen, when Shenzhen''s per capita container volume grew from 20% in Hong Kong to 77% in Hong Kong, Shenzhen''s per capita income grew from 16% in Hong Kong to 59% in Hong Kong. Per capita container volume and per capita income partly have positive correlation. As a result, the results of this study suggest that Malaysia''s per capita container volume and per capita income will rise if Malaysia''s future per capita container volume reaches the most favorable scenario in Malaysia, which will have a positive impact on Malaysia.

Under the pressure of the harbor terminal competition, the Port Authorities have to raise the port competitive ability in order to improve the competitiveness. The purpose of this study has to analyze the reform of the department of maritime management from the past till now and conclude the possibility of the organization of the port could be in the future. An organization is made up of employees. When it becomes the different type of organization, the problem about employees is the crucial factors. This study wants to discuss when the different type of the Port Authorities will be in the future, the preference choice of the employees. Therefore, this study established multi-attribute utility models with stated preference data and logit model. The study wants to reveal what kinds of the attributes do employees really care. Finally, according to this results, establishing the policy when the port organization is under changing. It will be used as the reference for the organization reform of government in the future.

The purpose of this research was to explore, from administrative, political, financial, economic, and legal perspectives, the feasibility of reorganizing the Kaohsiung Harbor Bureau (KHB) as an incorporated administration. Concrete proposals were then drawn up, and then refined and strengthened through the use of questionnaires, public hearings, and negotiations aimed at understanding and incorporating the ideas and priorities of shippers, academics, relevant experts, elected representatives, the MOTC, local government, and the administration and staff of the KHB. This research was conducted using documentary and comparative analyses, in-depth interviews, and authentication methodologies. Statistical analysis of questionnaire results sought to identify whether significant differences in opinion were present between staff (Kaohsiung Harbor employee) categories. The following three conclusions are suggested, based on the results of the above-mentioned questionnaire, public hearings, and in-depth interviews.

The purposes of this research were to explore the training development processes of training programs at St. Lucia Air and Sea Port Authority (SLASPA), the training programs offered and the training need of employees at this organization. This study aims to understand and explore the relevant training and development needs issues of training programs at Saint Lucia Air and Sea Port Authority. Every organization undergo training programs for their employees therefore the study seeks to explore what strategies are used to discover the different training needs of employees and whether the training program meet those needs. This research utilized both the Quantitative and Qualitative method of data analysis. The collected data were analyzed using descriptive statistics, One Way Anova and document analysis. The participants for this study were employees from Saint Lucia Air and Sea Port Authority. A convenient sampling technique was adopted for data collection. A questionnaire with 28 items were used which utilized a five point Likert- scale ranging from 1, (highly dissatisfied) to 5 (highly satisfied). Out of the 200 questionnaires dispatched, 159 were retrieved, which represents 80 % response rate. The study unveiled that that employees are fairly satisfied with the training programs offered by Saint Lucia Air and Sea Port Authority. Finally, the findings revealed that the only demographic variable that has any significance to training is education. Employees listed a number of training needs, however, customer service and fire arm training were the two more frequently mentioned.

Abstract There are several models of harbor management and organization. Such as public utility as current, which is one of the government administrative organizations, supervised by government or a private individual corporation to exempt from government’s supervision or a public corporation to assist in governmental administration. To get rid of the inefficiency, inflexibility and dull atmosphere in government organizations, which caused by the limitations in human resources and budgets from Legislation Yuan, a public corporation shows up as the solution. A public corporation provides an alternative model of organization, which combines efficiency and low enforcement. It can help our government to get out of the bottleneck of broking and development. The new public corporation approach satisfies people’s need of efficiency and public interest. In this paper a full survey has been studied, not only the harbor itself but also the Keelung city and the management council of the harbor base on the scheme provided by government’s representative and the legal appointee from the private sector. The purpose of this paper is to discuss and provide proper suggestions in the issue of Keelung Harbor Bureau transforming into a public corporation, through systematically summarize the reference literature, issues research of a public corporation and case study.

Abstract A administrative juridical person is still the first creation in our country. Beside the national Chiang Kai-Shek Cultural center、the research was still in the exploratory stage. 「off-tasking」、implementation of 「public affairs」、and personnel of 「independent」 are the characteristics of this system. They are implemented the 「supervision by country」 by their supervising institution and use the detail legal regulations to control the decentralized management system. 「Emphasize land、lean to air、neglect sea」 are maybe the current transporting policy from the government、this has disappointed many ocean operation people. Indeed、the position of ocean policy that the government was founded by marine is still in uncertain stage. Restructuring the policy of administrative juridical person from our Port Authority institute is like this. The object of this research is referring to the organ regime changing from Governmental agency to administrative juridical person of our Port Authority institute egulation. By referencing German、Japan、England、France、and our public legal chief’s type and implementation examples. we can raise the basis of theory related to the administrative juridical person and summarize the Port Authority from privatization、institute legalized、port and city in one kind to create the administrative (public) juridical person 「the Port Authority setup regulations」 draft、「administrative juridical person bill」 draft、the situation of organizing bills、then after discussing further on the basis bills which stands on the central institute administrative organizations、redevelopment of governmental organizations、revolution of marine port regulations、foreign ports』 public legal chief trend and legal principle structure measurement、combine to develop one set of Port Authority restructure for the researching result of organization design of administrative juridical person、which can set for 「special public legal chief」 organizing regulations and establish the choices of 「whether having the public legal right of port administrative supervision」 on 「marine administrative branch」、「marine port branch」、or 「port business’s administrative juridical person」. Lastly、discuss again on the Port Authority’s power before and after the restructure of their public rights、and safeguarding the authorizations、secure the employee rights and build up strategy so on. The last section of the article is written as conclusion and specific recommendations. The object of this research is to set up an example、expect on 「privatization」 or 「corporatization」 which are not 「consortium」 of the premises、「Port Authority restructure administrative juridical person」 can directly solve 「undivided administration and business」 or 「a player but also a judge」 situation. Maybe this would be beneficial to the revolution of marine port structure. Abstract The continued development of the Transhipment hub in the Asia Pacific region will be vital to the future competitiveness of the region’s economy. This study aims to probe the problems in running freight forwarding operations, through the perspectives of relevant freight forwarders, using the harbors in Singapore, Hong Kong, and Kaohsiung as focal point. These are: 1) Costs and the degree of freedom in Customs. 2) Information and automation management 3) The degree of merchandise control 4) Costs advantage among the ports. 5) The transportation infra-structure of the three ports. 6) The policies governing these multinational consolidation center. Based on the preceding research, this study offers the following recommendations: 1) Port management requires an understanding of the cargo owner's needs. 2) Facilitate speedy flow of goods; 3) Study the management and automated methods used in Singapore and Hong Kong. 4) The cooperation of governmental polices; 5) Build on current existing import/export foundation to promote Transhipment service

The purpose of this study is to investigate whether there are service quality gaps in Kaohsiung Harbor Bureau (KHB), the top international commercial port in Taiwan and an important container port in the world, through analyzing the qualitative data by means of PZB Model and SERVQUAL. Through questionnaires by harbor businessmen and KHB Management staff, researcher learned if there were gaps between harbor businessmen’s expectations and perceptions on service quality; gaps between perceptions of KHB management staff and expectations of harbor businessmen on service quality. In addition, by questionnaires from KHB first-level employees, researcher investigated KHB management staff and explored the gaps from three aspects: the service standard design, employee service, and external communication. In total, researcher received 163 questionnaires from harbor businessmen, 90 from KHB management staff and 193 from basic-level employees. After analyzing the data gained from those questionnaires through SPSS systems, researcher found: 1. There were significant gaps between expectations of harbor businessmen on KHB service quality and perceptions of KHB management staff on expectations of harbor businessmen. (Gap 1) 2. The KHB management staff designed employees’ operation standard and procedures based on harbor companies’ expectations on the service quality. (Gap 2) 3. The KHB employees could provide services to companies according to their operation standards and procedures. (Gap 3) 4. KHB could communicate well with their employees and harbor businessmen. (Gap 4) 5. There were considerable gaps between harbor businessmen’s expectations on KHB service and their perceptions. (Gap 5)

With the rapid expansion of economic globalization and the blooming growth of regional FTA, different countries enhance the international trade by signing FTA. Under the structure of FTA, how to use FTZ effectively as a trading tool becomes a great issue to every country and economic unit. As of now, major countries or economic units in the world mostly have FTZs or similar trade zones, and more, these have become the leading international trade hubs and trade centers. They are also the comprehensive economic zone where commerce trade, manufacturing and R&D combined together. Therefore, FTZ becomes more and more important in the Global Trade today. The objective of this essay is to study the ASEAN-China Free Trade Area, which was established by China and ASEAN. Under this frame, it would analyze the development of FTZ, with Hong Kong, Singapore, and Kaohsiung Harbor as examples, and to explain how Taiwan can prevent from being marginalized under the ASEAN -China Free Trade Area frame. The study for the development of FTZ under ASEAN -China Free Trade Area frame came out with the following conclusion: 1.To face the challenge of ASEAN -China Free Trade Area, Hong Kong is advantageous with its simplified administration processes, operations flexibility, familiarity with China market, as well as its intermediary function of trade. 2.The establishment of ASEAN -China Free Trade Area gave Singapore’s FTZ both preferences from FTA and FTZ. As per macro- economic benefit point of view, the advantage is greater than the drawback. 3.Taiwan can use Kaohsiung FTZ effectively to compensate the discontent raised by the inability of signing FTA with its major business associates, and can prevent from being marginalized under the ASEAN -China Free Trade Area frame.

With the overwhelming trend towards globalization, and regional integration becoming a strongly debatable issue, the relationship between Kinmen and Xiamen has changed from a war front to a convenient commuting route across the Taiwan Strait. Taiwan industry has also been affected with numerous labor-intensive industries moving to mainland China for new opportunities of lower cost of labor, production … etc. This trend is reflected in the phenomenon of increasing trade surplus between Taiwan and China, and the asymmetric development of international trade between the two sides. From the perspective of cross-strait relationship, both Xiamen and Kinmen experience close ties with one another and have location advantages. However, with the new development of cross-strait relationship and the opening of Three-Direct-Links since 2008, Kinmen and Xiamen are fearfully apprehensive about becoming marginalized. Therefore, Xiamen had proposed the development strategy of the “Economic Zone on the West Coast of the Taiwan Straits” which already has received the endorsement of both the Chinese Communist Party and central government. In the mean time, the government of Fujian Province started to promote several important infrastructural constructions such as sea ports in Fuzhou and Xiamen, and high speed railroads and highways linking most of the major cities in this area. In addition, Kinmen had proposed the idea of “Special District” 10 or 20 years ago. These were attempts made by both islands in order to gain the support from central government, boost the local economy, and avoid the possible marginalization and high rate of competition from other economic zones in China. In 2009, shortly after the Lunar Chinese New Year, newly elected president Ma Ying-jeou expressed his concern toward the “Jing-Deng Bridge” and induced many discussions about the bridge in Kinmen. Should the concrete connection be built across-strait between Kinmen and Xiamen, the investments, management and development on the construction and operation of roads and the bridge would definitely need more cross-strait cooperation. Consequently, this research focuses on the cooperation across-strait under the intermediary organization, such as the Port Authority, in order to promote the advantages of Kinmen and Xiamen with the combination of maritime transportation and logistic industries. In the case of the Port Authority of New York and New Jersey (here below shortened as the PANYNJ), more than 90 years have accumulated, thus ripening experiences in the operation and management of port authority. Besides the integration of maritime transportation, the PANYNJ has also developed railroad, mass transportation and bus transportation systems, and earned the right to run three of the main airports and the helicopter pads in the New York metropolitan area. It has become the dominating operator of all types of public transportation systems in the NY metropolitan area. This research starts with the review of the developing history of PANYNJ, analyzing the main reasons for its success. Then, an analysis is taken of the strength and weakness of Kinmen and Xiamen, to suggest that both islands work together to set up the Port Authority according to the example of the PANYNJ. It is the intent of this analysis to provide the foundation for a unique foreign experience for cross-strait cooperation between Xiamen and Kinmen in the future.

Texto completo da fonteEste relatório de estágio representa o trabalho desenvolvido na Autoritat Portuària de Barcelona (APB), mais precisamente no Centro de Documentação da Autoridade Portuária de Barcelona, num período de 150 horas, onde tive a oportunidade de passar pelos diferentes serviços de documentação e realizar as tarefas inerentes a uma Instituição com idêntica tipologia àquela onde presto idêntica atividade em Portugal. Descreve-se a empresa e o trabalho desenvolvido no Centro de Documentação (CENDOC), considerando todas as funções desenvolvidas ao nível da gestão documental, na biblioteca, no arquivo intermédio, histórico e no arquivo fotográfico. O serviço de Arquivo agiliza a gestão de um fundo documental com mais de 3.900 metros lineares de documentos textuais, 500 metros lineares de documentação gráfica e cartográfica e 75.000 fotografias. Também gere o Património Cultural Móvel da APB, tanto o fundo documental do Arquivo Histórico (textual e imagens), como as coleções de objetos artísticos de interesse histórico e cultural (pinturas, esculturas, artes decorativas, cartas náuticas, modelos de navios). Toda a documentação do Arquivo Intermédio foi devidamente tratada, higienizada e organizada num novo espaço de arquivo, com melhores condições de acondicionamento. Aproveitando este trabalho, foi desenvolvido um novo Plano de Classificação em maio de 2012, no mesmo período que desenvolvi o estágio, a fim de melhorar o serviço de Arquivo. O serviço da Biblioteca tem ao alcance dos seus utilizadores um fundo de 1276 publicações periódicas e mais de 2.300 monografias, catalogadas no programa informático CDS/ISIS. A sua classificação é feita com base na Classificação Decimal Universal (CDU), e a partir de um tesauro especifico elaborado pelos técnicos do CENDOC. Enquanto Técnica Superior no Centro de Documentação e Informação na Administração do Porto de Lisboa (APL), o desenvolvimento deste estágio trouxe um importante contributo para o serviço que desempenho no Centro de Documentação e Informação na Administração do Porto de Lisboa. Este Estágio possibilitou, sem dúvida, um melhor conhecimento teórico e prático no âmbito das tarefas inerentes ao mesmo, e a capacitação para o desenvolvimento de projetos relacionados com as funções que desempenho, no Centro de Documentação e Informação da Administração do Porto de Lisboa.
This present trainee-ship report represents the work developed in the Documentation Centre of the Autoritat Portuària de Barcelona (APB), which had an extent of 150 hours and where I had the opportunity to experiment the several documentation services and perform the tasks inherent to an institution so similar to the one I work for in Portugal. The company and the work developed in the Documentation Centre (CENDOC) are here described, having in consideration all the tasks performed at the document management level, the library, the intermediate, historical and photographic archives. The Archive service facilitates the management of a documental fund with more than 3.900 linear meters of textual documents, 500 linear meters of graphic and cartographic documentation and 75.000 photographs. It also manages the APB’s Mobile Cultural Heritage, both the documental fund of the Historical Archive (textual and images) and the artistic objects collections of historical and cultural interest (paintings, sculptures, decorative arts, nautical charts, ship models). The total documentation of the Intermediate Archive was properly treated, sanitized and organized in a new archive space, with excellent storage conditions. Seizing the work done, in May 2012, whilst my trainee-ship took place, a new Classification Plan was developed, in order to improve the Archive service. The Library Service provides to the users a collection of 1.276 periodicals and more than 2.300 monographs, catalogued in the computer program CDS/ISIS and classified according to the Universal Decimal Classification (UDC), based on a specific thesaurus elaborated by the CENDOC technicians. As a technician in the Documentation and Information Centre of the Port of Lisbon Authority (APL, S.A.), this trainee-ship provided an important contribution to the work I perform there. It provided me, undoubtedly, a better theoretical and practical knowledge, and gave me the capacity to develop projects related to my work in the Documentation and Information Centre in the Administration of the Port of Lisbon.

Texto completo da fontePortuguese democracy and rule of law, materialized in the Constitution since its first amendment (1982), sets to the Armed Forces only one mission, external military defense. But this constitutional command is not yet materialized, because the Navy continues to rule the policy of Maritime Authority and the Maritime Police, with the tolerance of the political organs of the State and an acknowledged complexity of the relevant law. In two centuries, occurred just three major changes (since the captaincies were created by law in 1839, one in 1921, and the two biggest, in 1974 and in 1982). This fathered the idea that the Maritime Authority has a good model and that it works well. Furthermore, it offers prestige and material benefits to all those that serve in the captaincies. The union of civil and military functions in the Navy Head and in several officers under his command suggests that the Navy’s rule saves the country resources; but that idea has no theoretical support and no independent research proves it. The detailed and exclusive information that the Navy has about the services of the Maritime Authority, coupled with its old ambition of autonomy, were used to postpone and deplete the reforms of this public policy that would bring about the Navy’s loss of autonomy or size. The political actors that attempted such reforms did not have the resolve or the necessary knowledge, themselves or through their supporting services, nor did they try to obtain them, to achieve the results they aimed at with such reforms. Thence, they curtailed the substantive objectives of the reforms and pleased themselves with changes in shape, wrapped by the rhetoric of the “synergies” and “double use”, yielding to the positions of the Navy. The research was mostly centered on the analysis of documents, the legislation and statements of the relevant actors, supplemented with interviews.
