Karl Kraus called Austria the “testing facility for the apocalypse”, but also noted that “the streets of Vienna are paved with culture; the streets of other cities with asphalt”. Hugo von Hofmannsthal dismissed the idea that there was an Austrian form of literature as fiction. In his opinion, there was only German literature, into which the works of Austrian writers were subsumed. In this respect, Austria is therefore not a completely straightforward subject. What remains indisputable, however, is that Austria became one of the trendsetters in German-speaking literature and culture from the 19th century onwards. The book ‘Topos Österreich’ (Topos Austria) thus contains studies from the field of literary and cultural studies which focus on modern Austrian literature.

In the twenty-year lifespan of the First Republic, there were three contenders for the label of fascist: the Austrian Nazi Party, the Heimwehr, and the Corporate State. In Austria, one is not comparing like with like, however: the Heimwehr and the Austrian Nazis constituted movements that existed from the outset of the new republic, the Nazis with origins reaching back to the turn of the century. The Corporate State, on the other hand, was a short-lived regime that incorporated and reacted to (and against) these movements. One can best compare the opening phases of fascism in the case of the Heimwehr and the Nazis: the Heimwehr only accrued partial power, and was ultimately incorporated into the Corporate State, and the ultimate Nazi victory in 1938 was ambiguous given that it was under German party leadership.

Austria was occupied at the end of World War II by the four Allies, but in contrast to Germany the four powers left in 1955—the condition being its declaration of permanent neutrality, on which the Soviet Union had insisted.In the first half of the 1950s, relations with the new-founded European Coal and Steel Community were being discussed in Austria, because the organization encompassed Austria’s two most important trading partners at that time, West Germany and Italy. But after the uprising in October-November 1956 in neighboring Hungary, Austria started to stress more its neutrality, excluding European Economic Community (EEC) membership. Instead, it joined other European countries to create a less integrated economic entity, the European Free Trade Association (EFTA) in 1960.Not until the mid-1980s did debate about membership in the now European Community (EC) start again. Economic problems and a narrower interpretation of neutrality led to Austria’s application for EC (later European Union) membership in July 1989. After the fall of the Berlin Wall in November 1989 and the application of other EFTA countries, Austria finally acceded to the EU on January 1, 1995 (along with Finland and Sweden). The political system and its economy adjusted relatively smoothly to the challenges of EU membership; the “social partnership,” while losing some of its power, could maintain its influence on Austrian politics. Eastern enlargement of the EU brought further economic advantages for Austria.As one of the smaller EU countries and a non-NATO member, Austria has a somewhat unique position in the EU. Environmental policy and supporting EU membership of the Balkan countries are among the important “niches” for Austrian EU activities. But the country has no close partners in the EU, because it is not participating in the “Visegrad” cooperation of the other Central European EU members. This difficulty clearly showed during the “sanctions” period of the EU-14 against the new Austrian government in 2000.

The interdisciplinary collection contains 16 essays by scholars from literary and cultural studies, by sociologists, historians, musicologists, art historians and media experts. Following the introduction to the key issues in cultural politics and propaganda and a synopsis of the essays, an article surveys the reciprocal perception of Austria and the USA from the 18th century onwards. The following essays analyze various historical phases in the complex relationship between Austria (and Central Europe) and the USA. Several essays survey the strategies used to promote Austrian tourism and contrast them with advertisements for American sights, and document the implementation of aid programs for the impoverished societies in Austria in the aftermath of World War One. There follow articles that discuss the role of exiled Austrians in the dissemination of a positive image of Austria and a favorable view of the USA, while two contributions are devoted to the misrepresentation of significant individuals active in Austria in the interwar years. Special attention is then paid to the role of the Marshall Plan in economic reconstruction in Austria and Western Europe, and to the promotion of liberal democracy in the media during the Cold War. The impact of transatlantic exchange programs for scholars and scientists in the countries of Europe under Soviet influence is also considered. The wide range of essays concludes with critical perspectives on political phenomena, such as the apparently exaggerated role of Austrian resistance fighters in the liberation of the country from the Nazi tyranny in 1945, and on the controversy over Dr. Kurt Waldheim as reflected in popular music in the 1980s. The transfer of new concepts of contemporary art in museums and of contrasted cinematic genres resulting in a merger is illustrated in the final two essays.

This chapter evaluates the merits of Vienna as a venue for international arbitration proceedings. It discusses the history and development of arbitration in Austria; the processes and rules involved as well as the role of courts in the conduct of arbitration proceedings; and rules for arbitral awards. It concludes that Austria is a United Nations Commission on International Trade Law (UNCITRAL) Model Law jurisdiction with a long and stable history of supporting arbitration. A wealth of decisions by the Austrian Supreme Court and a wealth of legal commentaries offer clear guidelines to the arbitration practitioner and only very few surprises. The Vienna Rules are one of the most streamlined of modern institutional arbitration rules that provide substantial flexibility for arbitral proceedings.

Business groups have been limited in number and influence for most of Australia’s modern history. Several entrepreneurs managed a diversified portfolio of interests, and business families often cooperated with one another, but this rarely took the form of a business group. When the Australian economy diversified into manufacturing from its initial narrow resource base, multinational corporations formed a dominant presence. Governments built infrastructure but did not facilitate groups. Maturing capital markets negated the need for in-house treasuries. Business groups temporarily dominated the corporate landscape for several decades towards the end of the twentieth century, but their business model was flawed in relation to the Australian environment and most failed to survive the downturn of the late 1980s and early 1990s.

Given the dualist nature of the Australian legal system, the potential for the Convention on the Rights of Persons with Disabilities (CRPD) to impact on case law is seemingly limited. Nevertheless, a wide range of Australian courts have referenced the Convention in their judgments, and the Convention has certainly been used to bolster or support the reasoning of courts in a number of cases, with at least one court going as far as interpreting Convention provisions and using this interpretation to further the development of domestic law on disability rights. On the other hand, Australian courts have also on occasions explicitly stated that they found the Convention to be inapplicable or irrelevant and have given a variety of reasons for reaching this finding. The Australian cases explored in this chapter therefore represent a wide diversity of judicial responses to the CRPD, and provide the basis for a fruitful discussion and analysis.

This chapter discusses the law of set-off and netting in Australia as well as the key restrictions on the availability of set-off under Australian law. In Australia, set-off and netting arrangements are often used as a means of reducing operational and credit risk. In the context of reducing credit risk involving financial rights and obligations (for example, deposits and loans), set-off and netting arrangements depend on one or more of: contract, section 553C of the Corporations Act 2001, and the Payment Systems and Netting Act 1998 (Netting Act). The chapter first considers set-off between solvent parties and set-off against insolvent parties before explaining set-off under section 553C of the Corporations Act. It also examines issues that may arise in cross-border transactions under Australian law with respect to the availability of set-off in section D of the Corporations Act, with emphasis on the choice of law and set-off in insolvency.

Pastoral Australia tells the story of the expansion of Australia's pastoral industry, how it drove European settlement and involved Aboriginal people in the new settler society. The rural life that once saw Australia 'ride on the sheep's back' is no longer what defines us, yet it is largely our history as a pastoral nation that has endured in heritage places and which is embedded in our self-image as Australians. The challenges of sustaining a pastoral industry in Australia make a compelling story of their own. Developing livestock breeds able to prosper in the Australian environment was an ongoing challenge, as was getting wool and meat to market. Many stock routes, wool stores, abattoirs, wharf facilities, railways, roads, and river and ocean transport systems that were developed to link the pastoral interior with the urban and market infrastructure still survive. Windmills, fences, homesteads, shearing sheds, bores, stock yards, travelling stock routes, bush roads and railheads all changed the look of the country. These features of our landscape form an important part of our heritage. They are symbols of a pastoral Australia, and of the foundations of our national identity, which will endure long into the future.
