Resumo:

The monograph examines topical issues of reforming the organization of public power in our country in connection with the adoption in 2020 of the Law on Amendments to the Constitution of the Russian Federation. The logic of changes in the organization of public power and the directions of concretization of constitutional values, taking into account the laws of the development of the constitutional system of Russia, are revealed. The most significant characteristics of the updated model of interaction of federal public authorities in accordance with the principle of separation of powers are identified, the trends of constitutional transformations in the spheres of federal relations and local self-government, ensuring the fulfillment by public authorities of international obligations of the Russian Federation are investigated. Particular attention is paid to the development of the legal mechanism of interaction between public authorities and civil society. The authors of the book take into account the results of legislative support for the reform of public power in 2020-2021, a forecast assessment of the implementation of the relevant constitutional and legislative novelties is given, including taking into account the existing legal risks. Solutions are proposed to a number of legal issues of legislative regulation of public power, which can increase the efficiency of its functioning. For researchers, teachers, students and postgraduates, deputies of representative authorities, state and municipal employees, as well as anyone interested in constitutional law issues.

Is morality viable without the notions of desert, moral demand, and moral obligation, notions threatened by possible limitations in human abilities? This essay contends that it may well be. Instead of invoking desert, blame can be largely forward-looking, recast as appropriate moral protest, and aiming at protection, moral formation, and reconciliation. Moral demands in relationships can be re-envisioned as commitments deriving from care, and failure to act in accord with one’s commitments can be conceived as wrong in the sense that they are appropriately protested. Moral obligations can be reconfigured as axiological recommendations. Revision of morality poses risks, but it is argued that the changes envisioned are practically viable.

Disorders of consciousness (DoCs) raise difficult and complex questions about the value of life for persons with impaired consciousness, the rights of persons unable to make medical decisions, and our social, medical, and ethical obligations to patients whose personhood has frequently been challenged and neglected. Recent neuroscientific discoveries have led to enhanced understanding of the heterogeneity of these disorders and patients, and focused renewed attention on the disturbingly high rate of misdiagnosis. This book examines the entanglement of epistemic and ethical uncertainty in DoCs and other medical contexts, and how they interact to create both epistemic and ethical risks. Philosopher and bioethicist L. Syd M Johnson pulls together multiple threads—the ontological mysteries of consciousness, medical uncertainty about unconsciousness, ableist bias, withdrawal of treatment in neurointensive care, and the rarely questioned view that consciousness is essential to personhood and moral status. Johnson challenges longstanding bioethical dogmas about DoC patients, and argues for an ethics of uncertainty for contexts where there is a need for decisive action in the presence of unavoidable uncertainty. The ethics of uncertainty refocuses ethical inquiry concerning persons with DoCs, placing less emphasis on their contested personhood, and more on inductive risk and uncertainty, on respect for autonomy, and especially on epistemic justice, and the duties of privileged epistemic agents. It is an approach with applications beyond brain injury, encouraging an expansive and humane approach that enables surrogate decision makers facing fraught, complex, risky choices to fulfill their obligations as moral and epistemic agents.

This chapter focuses on Joint Operating Agreements (JOAs). A JOA is an agreement between two or more companies which defines their respective rights and obligations in the exploration of a hydrocarbon project. The purpose of the JOA is for the participating companies to share risks (costs) and rewards (revenues) in relation to the project, and to define their respective roles. Among other things, the chapter discusses leading model form JOAs, as well as the interpretation and application of clauses typically found in JOAs, such as exculpatory or liability limitation clauses, pre-emption clauses, and clauses dealing with the consequences of a party's default or forfeiture. It also analyzes case law from various jurisdictions regarding implied or statutory obligations, such as duties of ‘good and fair dealing’ and fiduciary duties amongst the partners.

This commentary focuses on Article 5.1.5 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning the determination of the kind of duty involved. Art 5.1.5 provides criteria for determining the nature of contractual obligations. The question of whether an obligation involves a duty to achieve a specific result or a duty of best efforts is a result of the interpretation of the contract. Thus, Art 5.1.5 supplements the rules on contractual interpretation in Chapter 4 of the PICC. In determining the extent to which a party's obligation involves a duty of best efforts in the performance of an activity or a duty to achieve a specific result, regard shall be had to the way in which the obligation is expressed in the contract; the contractual price and other terms of the contract; the degree of risk normally involved in achieving the expected result; and the ability of the other party to influence the performance of the obligation.

This chapter discusses Article 9 of the ATT, which covers the regulation of each state party of the transit and trans-shipment of conventional arms through its territory. The obligation does not extend to ammunition/munitions or parts and components. The inclusion of specific obligations with respect to transit and trans-shipment reflects the need to ensure that all activities that form part of international arms transfers are regulated in order for the object and purpose of the ATT to be achieved in practice. The obligation in Article 9 is heavily qualified in recognition of the practical and legal issues that limit the ability—and capacity—of states to regulate and control goods in transit. State parties also have an obligation to prevent diversion of such arms, to co-operate and exchange information to mitigate any detected risk of diversion, and to take action to address any diversion detected.

Cybersecurity is a central challenge for many companies. This commentary analyses Article 9.2.8 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning the obligee's right to payment or other performance under the contract in respect of the obligation transferred. In the case of the assignment of a right, the assignment does not alter the obligor's situation. Securities can therefore continue to serve their purposes. The situation is different where an obligation is transferred to a new obligor. If the security were to be transferred with the obligation, the risk of breach or insolvency to be covered would be that of another person, unless the original obligor is not discharged. Art 9.2.8 contains special provisions with respect to the transfer of securities. This commentary discusses the transfer of an obligation with respect to securities given by the original obligor, securities given by a third party, and securities given by the new obligor.

This chapter reviews the two main concerns about financial relationships with industry: that they could conflict with research-related obligations leading to biased or flawed research and an incomplete research record, and that they could undermine trust in biomedical research, researchers, and research institutions. We show that these concerns are valid, and that they persist in the U.S., despite a gradual tightening over the past decade of rules and regulations regarding financial conflicts of interest in biomedical research. The threat that financial interests can pose to research integrity should be of special interest to psychiatry for two reasons: they are prevalent in this field, and they pose heightened risks due to the nature of psychiatry itself. Finally, we recommend that psychiatry—and individual research psychiatrists—take more seriously the threat posed by financial relationships with industry, and work together to develop additional strategies for avoiding and managing financial conflicts of interest.

Retail thinking and tactics are beginning to find their way into health care delivery, further impacting the ability to have strong, dyadic doctor-patient relationships. External forces described in Chapter 2 and poor patient experiences provide fertile soil for their growth. The retail rhetoric consists of heavy emphasis on “value,” “transparency,” “branding,” and “consumer activation.” The implementation of retail tactics into health care shifts the emphasis from relational to transactional forms of exchange, the latter emphasizing short-duration exchanges between buyer and seller, standardized obligations, and economic satisfaction. Retail approaches give large health care organizations greater power given their scale and resources to engage in key retail tactics such as data analytics, market segmentation, marketing, and price competition. There are tangible reasons for bringing some aspects of retail thinking into health care. Their application, however, brings risks for patients and their care, and threatens to undermine doctor-patient relationships further.

These medical decisions are interlaced with the ethical components of informed consent and obligations to the child and family. Informed consent in pediatrics includes the concepts of best interest, in which the parents or other surrogate decision-makers choose acceptable treatment for the child, and assent, which enables children to participate in decision-making to the best of their ability. Of equal significance to informed consent, the process of informed refusal requires anesthesiologists to more fully inform children and their guardians about risks and benefits while respecting refusal of assent and avoiding coercion. Pediatric considerations regarding end-of-life therapy are slightly different than adult considerations. To help resolve these ethical dilemmas, ethics committees are available for consultations to assist the medical team, family members, and patients in order to make the best decision for the child.
