On May 10, 2011, a jury verdict in the U.S. District Court for the Central District of California made California-based Lindsey Manufacturing Company the first company ever to be criminally convicted of violating the U.S. Foreign Corrupt Practices Act (FCPA).1 In a press statement, the Assistant Attorney General Lanny Breuer of the U.S. Department of Justice's (DOJ's) Criminal Division stated that ''Lindsey Manufacturing is the first company to be tried and convicted on FCPA violations, but it will not be the last.'' Understanding what led to the first ever criminal conviction of a corporation in the history of a law that is over thirty years old may add to attorneys' understanding of the current and evolving risks their clients face under the FCPA and how best to mitigate those risks. Neither has there been any recent change to U.S. law nor have U.S. authorities announced any official changes to enforcement policy. However, enforcement of anti-bribery laws in the United States, as well as in other jurisdictions, has become more aggressive and widespread. Increasingly aggressive enforcement also has intensified doubts about the value to corporations of cooperation with the U.S. and other enforcement authorities during FCPA investigations. This evolution of the enforcement landscape seems likely to have contributed to the Lindsey decision to defend against anti-bribery charges, and the conviction may in turn shift companies' calculation as to the benefits of cooperation. Companies worldwide have been watching the Lindsey trial closely and now await the sentence, as a gauge of what outcome may await other companies that choose to fight the U.S. Government in an FCPA case. However, the Lindsey conviction may not necessarily spur greater cooperation with enforcement authorities if current aggressive enforcement trends continue and the benefits of cooperation are sufficiently dubious. Regardless of the final outcome in Lindsey, now more than ever, clients should appreciate the value and importance of implementing an effective FCPA compliance program, as U.S. authorities have now amply demonstrated that they are willing and able to criminally prosecute uncooperative companies under the FCPA.

Dingo Media examines the development of media events using as a case study one of Australia’s most widely known criminal investigations, the disappearance of Azaria Chamberlain at “Ayers Rock”. Considering the case as a blueprint for the way mass media events develop and evolve in the late capitalist era, this thesis suggests that the event marks a turning point in negotiation of the public sphere and Australian national identity. Using an original model, I trace from the 1980s five phases through which news stories pass in their evolution as modern media events by comparing the Chamberlain saga to contemporary cases involving “controversial” women, Schapelle Corby, Joanne Lees and Pauline Hanson. The first phase examines the emerging practice of news workers focusing on personalities rather than events; the second phase analyses both the formation of counter-publics protesting the conviction, and the development of a dialogic connection between media and publics; the third phase investigates the rise of a modern celebrity industry promoting “ordinary” individuals into subjects of media discourse; the fourth phase considers the process of mythic production surrounding the Chamberlain case as related to processes of nation-building in the late 1980s; finally, the fifth phase critiques the prevalent view that, through continual retelling, the event has suffered a loss of meaning. Axiomatic to this study will be the politics of representation, how the media records, organises and mythologises information, as well as the interaction between texts and audiences.

The decades before the Scottish Reformation Parliament of 1560 witnessed the unprecedented use of a range of different media to disseminate the Protestant message and to shape beliefs and attitudes. By placing these works within their historical context, this thesis explores the ways in which various media – academic discourse, courtly entertainments, printed poetry, public performances, preaching and pedagogical tools – were employed by evangelical and Protestant reformers to persuade and/or educate different audiences within sixteenth-century Scottish society. The thematic approach examines not only how the reformist message was packaged, but how the movement itself and its persuasive agenda developed, revealing the ways in which it appealed to ever broader circles of Scottish society. In their efforts to bring about religious change, the reformers capitalised on a number of traditional media, while using different media to address different audiences. Hoping to initiate reform from within Church institutions, the reformers first addressed their appeals to the kingdom's educated elite. When their attempts at reasoned academic discourse met with resistance, they turned their attention to the monarch, James V, and the royal court. Reformers within the court utilised courtly entertainments intended to amuse the royal circle and to influence the young king to oversee the reformation of religion within his realm. When, following James's untimely death in 1542, the throne passed to his infant daughter, the reformers took advantage of the period of uncertainty that accompanied the minority. Through the relatively new technology of print, David Lindsay's poetry and English propaganda presented the reformist message to audiences beyond the kingdom's elite. Lindsay and other reformers also exploited the oral media of religious theatre in public spaces, while preaching was one of the most theologically significant, though under-researched, means of disseminating the reformist message. In addition to works intended to convert, the reformers also recognised the need for literature to edify the already converted. To this end, they produced pedagogical tools for use in individual and group devotions. Through the examination of these various media of persuasion, this study contributes to our understanding of the means by which reformed ideas were disseminated in Scotland, as well as the development of the reformist movement before 1560.

This chapter reviews the book Ben Shahn’s New Deal Murals: Jewish Identity in the American Scene (2015), by Diana L. Linden. Ben Shahn’s New Deal Murals is about Ben Shahn, whom Linden considers an American Jew rather than a Jewish American. Linden studies a few of Shahn’s murals and a related easel painting, all conceived or completed between 1933 and 1943. She focuses on four large projects (one unrealized) from the vantage point of Shahn’s Jewish identity and leftist politics, contextualizing the art alongside the history of the American Jewish experience. Working first and foremost as an art historian, she explores Shahn’s iconography and the desires of his patrons. According to Linden, Shahn’s art is “neither solely American nor solely Jewish but rather an alchemic combination of the two.”

This is the first volume to chronicle the story of the evolution of the symbiotic relationship between the presidential press secretaries and reporters who covered White House news during the terms of Franklin Delano Roosevelt, Harry S. Truman, Dwight D. Eisenhower, John F. Kennedy, Lyndon B. Johnson, Richard M. Nixon, Gerald R. Ford, Jimmy Carter, Ronald Reagan, George H. W. Bush, Bill Clinton, and George W. Bush. Author Woody Klein has been both a reporter (for theWashington Postand theNew York World-Telegram & Sun) and a press secretary himself to New York City Mayor John V. Lindsay, who ran for president in 1972. The book reveals how the presidential press secretaries' role has evolved from old-fashioned public relations into a smooth-working system of releasing news and responding to reporters' questions at daily briefings by portraying the president in the best possible light. Klein ferrets out fresh, anecdotal information and includes interviews with nationally known personalities—including former White House press secretaries and notable journalists who have covered the White House. He brings to life the personalities and views of every presidential spokesman on how the job has grown in stature as the press secretaries or spinmeisters have become high-profile officials. Klein reveals how the tension between government and the media—normally healthy in any democracy—has resulted in the manipulation of facts and the release of favorable official news. It started subtly in the Roosevelt administration and has been carefully honed with the transformation of the media in the information and technology revolution; he shows how it has been refined to the point where it is now recognized for what it is: slanting or packaging the news in favor of the president to make it acceptable—even desired—by the public. Perception quickly becomes reality, and once the facts of a situation have been accepted by the establishment—politicians and the press alike—it becomes virtually impossible to change people's minds about them. The book documents scores of examples of White House spin by topic rather than chronologically—for example, how different press secretaries managed the news in wartime, in foreign policy, in scandals, and in a host of domestic issues such as education and national disasters. Twenty-three press secretaries are included. The most notable among them are Steve Early (Roosevelt), James Hagerty (Eisenhower), Pierre Salinger (Kennedy), Bill Moyers (Johnson), Ron Ziegler (Nixon), Marlin Fitzwater (Reagan and G. H. W. Bush), Dee Dee Myers (Clinton), Mike McCurry (Clinton), Joe Lockhart (Clinton), Ari Fleischer (Bush), Scott McClellan (Bush), and Tony Snow (Bush).

Abstract Mid-Century Romance chronicles a revival of the historical novel at the intersection of British late modernism and international communist culture. It frames this mid-century renovation of the genre as a response to a national turn in world politics, and this turn as a function of realignment in the imperial and literary world-systems. Confronted with the turbulence of mid-century history, writers embraced the historical novel to float narratives of national becoming and to locate their readers in the pattern of social change. Many were mindful of the genre’s romantic-era history: they saw themselves following in the footsteps of Sir Walter Scott and his heirs in other countries, and they drew on the same rescued remains of primitive poetry and popular antiquities that romanticism first used to construct its versions of national identity, of national culture and tradition. The study shows how the impulse to salvage traces of ancestral culture and to press them to new purpose links the mid-century historical novel to the rise of two of the most important post-war critical and creative projects: history from below and magical realism. It argues for the period-centrality of the mid-century national-historical novel and situates its cast of British writers—the modernists Hope Mirrlees and Virginia Woolf, the communists Sylvia Townsend Warner and Jack Lindsay, the oddball modernist and onetime fellow traveller John Cowper Powys, and many others in less detail—in a comparative, transnational perspective.

The chapter concludes by outlining some of the educational outreach that Women of the Storm members participated in and suggests that models of civic activism and philanthropy were being shared across generations.

Abstract Between 1933 and 1936, the Savoy Ballroom was ground zero for a cross-country cultural wave: swing music and swing dance. Dancers, celebrities, and lookers-on came to the Savoy for its up-to-the-minute music and to dance the Lindy Hop. Chick Webb and His Orchestra were early adapters of the swing beat, which was perfect for the Lindy style and became the Savoy’s soundtrack. At the Savoy, a man named Herbert “Whitey” White organized the top dancers, including France Manning and Norma Miller, into small groups to perform at parties for a few dollars, most of which he would pocket. Later on, some of Whitey’s Lindy Hoppers teams appeared in theater shows, on international tours, and in movies. Webb’s NBC nationwide spots (on WJZ in New York) and the band’s broadcasts from the Savoy kept their music on the air throughout the spring and summer of 1935 and put more of the spotlight on their new vocalist Ella Fitzgerald. On March 31, 1935, Webb and his rhythm section played at the New York Metropolitan Opera’s annual fundraising gala, and Webb received the most press attention ever in Black and white newspapers across the country.

This chapter tells the story of Bill vanden Heuvel's work with the New York City prison system. Following riots in the Tombs detention center and a rash of suicides in late 1970, Mayor John Lindsay asked vanden Heuvel to serve as Chair of the Board of Correction, a post he held for three years. During that time, he made numerous proposals to improve conditions in the New York City prison system, developing novel approaches to health care, education, training and living conditions. His legal training gave him an eye for spotting inequities in bail and sentencing procedures, and he worked closely with advocates both inside and outside the prisons to create a system that could be remedial as well as punitive. The chapter includes his speech at a service of concern after deadly riots broke out at Attica State Prison in September 1971. His ideas for improving media coverage of the prisons are presented in his article "The Press and the Prisons," first published in June 1972.

Abstract The majority of adults in Britain cite the mass media as their main source of information about developments in science and technology. This alone makes it worth studying how the press covered the story of Dolly the cloned sheep. But the media’s reporting of Dolly is interesting for reasons quite apart from its bearing on public information and, potentially, public attitudes toward science. Rather the way in which science and the processes of science stood revealed through the prism of mass media coverage suggested that there may be serious difficulties in the relationship between science and society. Although there were failures of journalistic accuracy and balance, these should not be allowed to obscure such deeper issues. The coverage provided ample vindication of the contention put forward by Dorothy Nelkin and Susan Lindee in their book.

Is there a causal relationship between the remarkable economic success and rapid upward mobility of American Jews and behavioral patterns on their part that promoted health and the prevention of disease? Jacob Jay Lindenthal offers what he terms “a conjectural analysis” (p. xiii) to suggest such a causality, and he supports his argument with an impressive array of medical sources that scholars of American Jewry have rarely utilized. Lindenthal maintains that Jewish “values, beliefs, traditions, attitudes, and behavioral patterns” have all had a crucial effect on Jewish health (p. xv). He highlights such cultural factors among the Jews as awareness of and concern for health; an emphasis on cleanliness as mandated by Jewish law (halakhah); a cohesive family life; the promotion of education; specific childrearing practices (among them, circumcision, breastfeeding, and maintaining longer time intervals between births); a low rate of alcoholism; and communal charitable institutions and solidarity as playing a decisive role in keeping East European Jewish immigrants in America in relative good health.
