AbstractThis essay begins by situating Spanish scholarship on Islamic law in the wider context of Arabic and Islamic studies in Spain, stressing two salient characteristics of the latter: its concentration on Andalusī subjects and its relative isolation from the rest of Western scholarship. I then review the production of Spanish scholarship in the field of Islamic law, focusing on three historical periods: the first steps in the nineteenth century (Gayangos, Ribera and his pupils); the period of the Spanish Civil War (1936-1939) when the work of López Ortiz, Morata, and Vila was cut short just as Spanish scholarship on Islamic law was coming of age; and the post-war period, when several attempts were made to renew the study of Islamic law. In the conclusion, I assess the current situation and consider future prospects. A basic bibliography of Spanish scholarship on Islamic law follows the article.

The objective of the article is to analyse legal regulations concerning self-employed activity in force in Spain. Spain is the first EU Member State to have adopted a separate law (on 11 July 2007) to comprehensively and systemically regulate the legal status of the self-employed. The Spanish 2007 LETA act aimed to sort out the situation of the self-employed and grant them additional rights. A new category of economically dependent self-employed persons was introduced and accorded special protection. The author discusses the concept and typology of self-employment, including classic, economically dependent, and bogus self-employment. In her view, the Spanish solution of regulating self-employment in a single piece of legislation appears attractive, but the criteria introduced in the law to determine the status of economically dependent self-employed do not adequately fulfil their role in practice. Their restrictive nature, far-reaching casuistry, and the criterion of economic dependence of the self-employed, who must receive at least 75 per cent of their income from a single counterparty, which is difficult to verify objectively and relatively easy to circumvent, result in a negligible number of self-employed persons benefiting from the protective guarantees provided by LETA.

It is very common to encounter commercial law regulations designed towards encouraging shareholders to make long-term investments in different jurisdictions in response to the issue of short-termism. Until a few months ago, EU Shareholder Rights Directive was seen as the most effective step, which was put into effect as of 3 September 2020, as regards the encouragement of long-term shareholder engagement. However, when the latest developments are considered, a new era has just started in Spain with Law No. 5/2021, which entered into force on 3 May 2021, regarding the duties and responsibilities of managers to increase shareholders’ long-term loyalty to listed companies by complying with the modifications envisaged by Directive 2017/828. This study, in light of what has been covered hitherto, examines the amendments (reform) brought by Law No. 5/2021 as well as evaluating its possible effects on the functioning of company law. One of the best-known discussions of the historical foundations of native title law is Felix Cohen's famous paper on the Spanish Origins of Federal Indian Law, published originally in 1942 and since then reprinted many times.This article cites Cohen's paper in its political and historiographical context, paying particular attention to Cohen's role as one of the architects of the Indian Reorganisation Act of 1934, and considering also shifts in American historiography and legal writing relating to the Spanish legacy as exemplified by legal historians such as James Brown Scott and historians such as H E Bolton. This article also considers fully Cohen's analysis of the precise ways in which Spanish law penetrated the legal framework of Federal Indian Law in the United States and concludes that, as a historical discussion, Cohen's work is in need of substantial revision. In particular Cohen's arguments that Spanish law influenced federal Indian law via international law and by means of judicial consideration of old Spanish land claims seem difficult to sustain.

In Spanish Criminal process and Forensic practices, there is a controversial element so-called popular action. This one has given rise to different positions and judgments have been handed down on this matter too. In this context and in order to understand the basis of the case, it is important to know that there are situations that depending on how they are treated, by whom it can be persecuted, or the people affected by them, they were called one way or another, in addition to many other considerations, and due to the very nature of the illicit act, it is possible that people outside it can position themselves as accusers. This article offers an analysis from Law & Economics applied the popular action, with special attention to its development in Spain, its current risk of deinstitutionalization process and its paradox of active legitimacy.

Abstract: The general principle of law is the best interest of the child. This principle is inserted in a general clause in the Spanish Youth Protection Act of 15 January 1996. As a result, the Spanish judge is now able to apply this principle directly rather than subsidiary, which means that Spanish family law is now required to be interpreted from the perspective of the best interest of the child. The best interest of the child is now the central axis and has priority in the Spanish family law. This paper studies the concept of best interest of the child in the Spanish legal system and its application in special cases that are discussed within Spanish law. These cases are: conflicts between the biologic family and the foster family, the open adoption, and the jurisdiction of judgments in matters of parental responsibility.

The Pegasus spyware case, revealed in July 2021, also impacted Spanish politics when a report produced by Citizen Lab denounced that Catalan independentists had been surveilled using this software. The scandal — known as Catalangate — highlighted the need for a thorough audit of these surveillance capacities in the hands of the Spanish intelligence service. Using Catalangate as a case study, this article analyses whether Spanish mechanisms for controlling the surveillance capacities of the National Intelligence Centre (CNI) have followed the procedures established in Spanish legislation. Our conclusion is that the Spanish control system worked effectively. When the Parliamentary committee was unable to fulfill its duties, another actor within the democratic system, the Ombudsman, filled that gap. Secondly, the article analyses if Spanish control mechanism meets the more recent standards of case law from the European Court of Human Rights (ECHR), and the Court of Justice of the European Union (CJEU). This case law emphasises the importance of procedural guarantees for legitimising both bulk and targeted surveillance procedures, showing the need for potential improvements in Spanish regulations.

Liberty, justice, equality, and political pluralism are the highest values of the legal order of the rule of law. Spain is a constitutional monarchy with a parliamentary government. The legislative power rests upon two chambers: the Congress and Senate. The government exercises the executive powers and the regulatory powers. There have been six presidents since 1978 from all parties, socialist, centrist, and conservative. The judicial power rests upon the courts and tribunals established by law.

In the contemporary criminal law, a prison sentence is the basic and most important type of criminal sanctions to be imposed to the perpetrators in order to prevent and combat crime. But, apart from unconditional prison sentence, all criminal legislations also know different modalities of its imposition or execution. These are different forms of substitute or alternative sentences in cases where unconditional detention is not necessary. Thus, we can distinguish full or partial suspension of the prison sentence or some other kind of punishment. In the first case, it is about the suspended sentence. This is a complete exemption from the execution of a court decision handed down prison sentences or determined (and or other types and extent of punishment) for a specified time (checking) and under certain conditions. In case that conditionally convicted person does not meet the set of general and special, mandatory or optional requirements, criminal law provides for mandatory or optional revoke of the suspended sentence. However, in addition to the suspended sentence as a form or modality of execution of imposed prison sentences, some modern criminal laws recognize suspended sentence as a special kind of criminal penalties - as a measure of warning. A prerequisite for the implementation of these measures is the fulfillment of the formal requirements - in terms of type and duration of prison sentence, or material conditions - assessment of the court that the application of penalties in the concrete case, is not necessary because the goals (purpose) of punishment can be achieved without effective enforcement of prison sentences in whole or in part. This paper is about the concept, characteristics, conditions and methods of implementation of these forms of prison sentence suspension in the Spanish criminal law.

AbstractStudies of Spanish cooperatives date their spread from the Law on Agrarian Syndicates of 1906. But the first legislative appearance of cooperatives is an 1869 measure that permitted general incorporation for lending companies. The 1931 general law on cooperatives, the first act permitting the formation of cooperatives in any activity, reflects the gradual disappearance of the cooperative's «business» characteristics. In this paper, we trace the Spanish cooperative's legal roots in business law and its connections to broader questions of the freedom of association, the formation of joint-stock enterprises and the liability of investors in business and cooperative entities. Our account underscores the similarities of the organizational problems approach by cooperatives and business firms, while at the same time respecting the distinctive purposes cooperatives served.

Abstract This article analyzes the struggles of the Catalan government to organize a referendum on secession and the constitutional framework invoked by the Spanish central authorities to prohibit it. The repression of secessionist referenda within the Spanish constitutional framework triggers several problematic questions concerning the role of constitutional supremacy in handling subnational secessionist challenges developed under a pacific and democratic framework. The article offers a comparison between the Spanish-Catalan case and other examples of secessionist referenda within liberal democracies, underscoring that the Spanish solution of repressing such referenda through criminal law is unique in the liberal democratic context. The article also offers a description of the political, historical, and legal circumstances surrounding the Spanish central authorities’ actions that explains the Spanish constitutional response to both the Catalan Consultation held on November 9, 2014, and the referendum on Catalan independence held on October 1, 2017. The article concludes by arguing that the prohibition of the Catalan referendum initiatives on independence and their subsequent prosecution through criminal law may cripple the basic pillars of the Spanish liberal democracy designed under the 1978 Spanish Constitution.

The teaching of Spanish Law in English responds to the dynamics of European integration and to the set of policies carried out in the European Higher Education Area. By offering training in English, universities can enhance the linguistic training of their graduates, improve their understanding of other legal systems, and attract international students. However, this objective is accompanied by several challenges. The first of these is the need for both teachers and students to be proficient in the language. The transition to an English language curriculum requires a high level of linguistic competence on the part of teachers along with continuous language improvement. Similarly, students must possess the language skills necessary to understand complex legal concepts and to participate effectively in debates. Teaching Spanish national law in English poses specific challenges, such as pedagogical adjustments, creating legal materials in English and achieving linguistic clarity while maintaining legal precision. Specific problems arise in the context of criminal law, such as navigating nuanced legal terminology, understanding different legal systems, or explaining legal categories that do not exist in other jurisdictions.

The problem of the Spanish Succession kept the European diplomatic system in suspense from 1659 until 1713. Statesmen and diplomats tackled the question. Their practical vision of the law was a necessary complement to legal doctrine. Louis XIV and Emperor Leopold I used incompatible and absolute claims, which originated in private law and Spanish succession law. At the Peace of Utrecht, these arguments completely dissolved. The War of the Spanish Succession thus not only redesigned the political map of Europe: It altered the norm hierarchy in public law, strengthening international law as the framework of the 'Société des Princes'.

This article analyses the genesis of fiduciary security transactions in ancient Spanish law and their impact on the economic activities of that time. It highlights the influence of German doctrines on fiduciary transactions and the theory of double effect on the Spanish legal system. Furthermore, it describes the evolution of views among Spanish civil law scholars regarding the essence of such security constructs.

The new Spanish nationality law requires a certain level of Spanish language proficiency for the application of Spanish nationality. The law, which is on the Official State Bulletin (BOE-Boletin Oficial del Estado) N. 167, Section I, Page 58, 149 and which was drafted on the 14th of July, 2015, came in effect on the 15th of October, 2015. The new regulation outlined the new requirements for the immigrants to be able to become Spanish citizens. The law was mainly targeted towards the descendants of those Jewish people who were thrown out of Spain in 1492 in an effort of the Spanish government to normalize relations. Nevertheless, all new applicants are somehow affected by it since a minimum knowledge of Spanish language is required, (level DELE A2 according to the Common European Framework of Reference for languages (CEF; Council of Europe, 2001 & Little (2005)) and a certain cultural and constitutional knowledge as well, to be measured by additionally passing the CCSE exam. These exams, according to the law, are to be administered by Instituto Cervantes, the official Institute of Spanish language of the Government of Spain. This paper aims to study the repercussions and new effects the law is having on the Pakistan Instituto Cervantes Examination Center in terms of enrollments as well as the effects on a specific group of immigrants themselves; the immigrants from Pakistan.

Abstract: The Spanish Constitution grants Catalonia, one of the Spanish so-called Autonomous Communities, power to legislate on private law. The power is not unlimited, being the “bases of contractual obligations” one of the main restrictions. Nowadays, the Catalan Department of Justice fosters the enactment of a Civil Code for Catalonia. Until now, the Family Code and the Succession Code, a range of statutes and the First Act of the Catalan Civil Code have been passed. This paper analyses the Catalan codification process within the framework of the European harmonisation of private law. The author stresses the necessity of taking into account the developments of the new ius commune europaneum and points out the possible Catalan contribution to the process of harmonisation.

The purpose of this article is to answer the question of the legal nature of the European clause contained in the Spanish Constitution. The article examines how it has influenced the process of European integration and the constitutional order in that country. This has been done by analysing the provisions of the Spanish Constitution and the jurisprudence of the Constitutional Tribunal using Spanish constitutional law studies. In the author's opinion, the rather general and open European clause, although it required the jurisprudential activity of the Constitutional Tribunal, proved to be quite functional, becoming the basis of the relationship between Spanish law and EU law and remains unchanged to date.

Resumen: La ley española sólo ofrece dos posibles soluciones a los ciudadanos que constituyen una Kafala en un país islámico: el reconocimiento, sin más pretensiones, a través del artículo 34 LAI o la constitución de una nueva adopción en España conforme a la ley española. Ahora bien, el artículo 19.4 LAI impide la adopción cuando la ley nacional del adoptado la prohíba o no la contemple, lo que sucede en la mayor parte de los Estados musulmanes. Corresponde a los Tribunales españoles interpretar el sentido de esta prohibición, atendiendo las circunstancias del caso concreto y en particular, al grado de integración del menor en nuestro país, junto con las posibilidades de que se constituya una adopción claudicante.Palabras clave: adopción, Kafala, Ley de Adopción internacionalAbstract: Spanish law only offers two possible solutions to the citizens which constitute a Kafala on an Islamic country: the recognition, without more pretensions, through article 34 LAI or the creation of a new adoption in Spain in accordance with Spanish law. Now, article 19.4 LAI prevents the adoption when the adopted national law prohibits it or do not regulate it, what happens in most of the Muslim States. It corresponds to the Spanish courts interpret the meaning of this prohibition, taking account of the circumstances of the specific case and in particular to the degree of integration of the child in our country, along with the possibilities of that constitute a claudicator adoption.Keywords: adoption, Kafala, International Adoption Law.

The aim of this paper is to describe the way in which the subject of disclosure in franchise networks is treated in the Spanish legal system. The paper concludes that the Spanish legislator will have an opportunity to modernize the regulation of these contracts soon. This will be a great moment to adapt the Spanish law on disclosure in franchise networks to the modern legal techniques already present in a number of countries. An adequate and updated regulation of the franchise contract would avoid the majority of the problems that Spanish case-law has been attempting to resolve over the last few years, as this paper will try to demonstrate.

Spanish Administrative Law has evolved under foreign influences and, in contrast with those States with a strong tradition of Administrative Law, Spanish Law is in a better position to receive further influences due to its own idiosyncrasy. The implementation of the Aarhus Convention (AC) is clearly a further example of new inputs, but in this case from international/European Law. This Article will focus on the three pillars of the AC making contrast between the pre- and the post-implementation phase, trying to emphasize progresses and paradoxical steps backward. The principles underlying the Spanish legal order concerning the three pillars of the AC have a different depth in the Spanish legal system. Access to information has traditionally been limited to a defensive perspective related to the audit alteram partem principle and progress is evidently related to a top-down influence. Regarding participation, there exists an old tradition not only linked to the right to be heard, but to public participation in and of itself. Finally, with regard to access to justice, the Spanish legal order underwent major development after the Constitution of 1978 was enacted. A broad legal standing had been recognized by case law before the new Administrative Justice of 1998 was passed.

Abstract: In January 2009, the Spanish Commission for Codification presented a wide-ranging reform proposal for the Spanish law of obligations that, because of the particular attention paid to European legal developments, would deserve to be more closely taken into consideration in the ongoing discussion on a future European Sales Law. This article aims to give a general overview of the Spanish reform proposal in the light of European and International Contract Law Principles. Résumé: En janvier 2009, la Commission générale pour la Codification espagnole a présenté un avant-projet de réforme et de modernisation du droit espagnol des obligations. En considération du rôle central que dans ce projet ont joué les projets européens d'harmonisation du droit des obligations, l'avant-projet espagnol mériterait une attention particulière dans la présente discussion pour un futur droit européen de vente. Cet article s'emploie à illustrer les traits caractéristiques de l'avant-projet espagnol à la lumière des projets d'harmonisation européens et internationaux. Zusammenfassung: Im Januar 2009 legte die spanische Kodifikationskommission einen umfassenden Schuldrechtsmodernisierungsentwurf vor, der aufgrund seiner wahrhaft europäischen Ausrichtung auch in der gegenwärtigen internationalen Diskussion für ein künftiges europäisches Kaufrecht mehr Aufmerksamkeit verdient und daher an dieser Stelle im Lichte der europäischen und internationalen Vertragsrechtsregelwerke vorgestellt werden soll. Die fortschreitende Europäisierung des nationalen Schuldrechts durch europäische Rechtsakte sowie die parallel dazu verlaufenden Bestrebungen zur Schaffung eines einheitlichen europäischen Vertragsrechts haben im Laufe des letzten Jahrzehnts in vielen europäischen Rechtsordnungen nationale Reformbestrebungen geweckt. Unter dem Eindruck der deutschen Schuldrechtsmodernisierung wurde im Jahr 2005 ein umfassender französischer Reformvorentwurf vorgelegt, der national und international auf viel Beachtung gestoßen ist und in Frankreich die Ausarbeitung zweier weiterer Entwürfe nach sich gezogen hat. Von diesem durch Europa wehenden Reformgeist wurde auch Spanien erfasst. Die beim spanischen Justizministerium standing eingerichtete Generalkommission für die Kodifikation (Comisión general de Codificación - Sección de derecho civil) hat im Januar 2009 unter dem Vorsitz des renommierten spanischen Zivilrechtlers Luis Díez-Picazo einen umfassenden Entwurf für die Modernisierung des spanischen Schuldrechts vorgelegt, der aufgrund seiner wahrhaft europäischen Ausrichtung auch in der gegenwärtigen internationalen Diskussion zur Vereinheitlichung des Kaufrechts in Europa größere Beachtung verdient und daher an dieser Stelle im Lichte der europäischen und internationalen Vertragsrechtsregelwerke vorgestellt werden soll.

The present paper is about the regulation appliable to childhood and adolescence in the Spanish Law, with special emphasis on the changes derived from the entry into force of the 1978 Spanish Constitution and its influence in the Civil Law area. The article hast two parts. First one begins with the description of origins of the preoccupation for children and teenagers, at the end of the 18th century and the progressive development of politics focused on their protection during de 19th century. Below, there is a brief exposition of the international dimension of scientific and legal treatment, beginning with the celebration of conferences and congresses dedicated to children and continuing with 1924 y 1959 declarations of the rights of the child. Finally, there is another brief description, focused on the 1989 Convention on the Rights of the Child. The second part is centered on the Spanish Law and its rules for the protection of children and teenagers. Firstly, there is a brief historical description, centered over the Spanish perspective in the progressive and growing interest in childhood. Secondly, there is a legal description of Spanish Law rules on the subject, beginning with 1978 Spanish Constitution and continuing with the enumeration of modifications of Civil Law acts, derived from the return of Spain to democracy and the ratification of 1989 Convention.
