An axiology as a theory of values takes an important place not only in general philosophy but in legal philosophy as well. Jurisprudence and law cannot ultimately be axiologically neutralised since the relationship between law and values is of a primary, eternal, necessary and immanent character. The author discusses this phenomenon on the example of Gustav Radbruch’s legal philosophy. In his opinion when one writes about Radbruch as a philosopher of law, one should make five very important reservations: firstly, Radbruch was a representative of Neo-Kantianism; secondly, it was not Neo-Kantianism ‘in general’, but a specific variant called Baden Neo-Kantianism (south-German, Heidelberg-based); thirdly, Radbruch was not a philosopher ‘in general’, as he was interested in Neo-Kantianism transplanted to the philosophy of law; fourthly, we may currently notice a great comeback of the philosophy of Kant (e.g. J. Habermas, J. Rawls, O. Höffe), but this phenomenon should be precisely distinguished from Neo-Kantianism as the temporally and spatially determined philosophical direction of the fin de siècle period; fifthly, if one can even speak of some kind of axiological turning point in the evolution of Radbruch’s philosophical views, it is 1933 rather than 1945.

Immanuel Kant, the eminent Western philosopher, discusses several significant themes in the context of political ideas that are strewn across his various books. In this study, one of the challenges is to organise Kant’s valuable notes on political ideas in a systematic yet critical manner to reflect his philosophy of law. Kant’s theoretical and practical philosophies have influenced the idea of law, which is an a priori concept of the human mind, in several ways. It is also conceivable, by virtue of Kant’s philosophy of law, to identify the inherent connection between moral and political philosophy. This study will illustrate the connection between the moral and political philosophy of Immanuel Kant and the philosophy of law. This work is carried out through the method of context and critical analysis. This work is organised into three sections. The first portion of the introduction will analyse the definition of law and its connection to the philosophy of law; the second part will study the broad notion of law and its different varieties; and the third section will investigate whether Kant’s political philosophy is consistent enough to accommodate the different types of laws. This work submits that Kant’s philosophy is quite consistent with the philosophy of law. In particular, this work submits that there is a theoretical link between Kant’s political philosophy and natural law, moral law, political law, international law, and cosmopolitan law.

The article is devoted to the problems of security philosophy and the peculiarities of its implementation in the conditions of martial law and real challenges to the existence of the Ukrainian state and its citizens. The philosophy of security considers the latter as a phenomenon of an objective order that exists in an uncivilized space, functions independently of a certain historically formed society, but is always ensured by the active participation of a person in security processes. Under martial law, security philosophy is a conceptual approach that combines two important components. On the one hand, it is based on the organization of the state and society, which pays the most attention to economic security issues, because it is in this area that conditions are created for the maximum mobilization of material resources in order to resist hostile actions. But, on the other hand, it keeps in focus the person who is the main value of a democratic state, his life and security. Its financial, social, and information components continue to be important aspects of security philosophy. Special emphasis in the security philosophy is placed on the factor of information warfare imposed by the aggressor state with the aim of value deformation of the consciousness of Ukrainian citizens, undermining the national-patriotic spirit of Ukrainian citizens, depersonalization of individual responsibility before the threat of loss of statehood and national identity. This is precisely why we highlight another aspect of the security philosophy – the valuable one. The problems of the implementation of state security in the conditions of the introduction of martial law are considered in the article as particularly important and vitally necessary, as they concern both the very existence of the state and its citizens, taking into account the actions of the enemy, which carry a kind of genocide of the Ukrainian people.

Background. Philosophy of law is a branch of philosophy that studies the nature of law, especially in its relation to human values, relationships, and practice. The points of views to the nature of law often depend on the philosophical position taken by a particular philosopher or group of philosophers. As a result, legal philosophy becomes the object of heated discussions, the main feature of which is reduced to the question of what is due and being, i.e. can and should positivist law replace the traditional values developed by mankind as regulators of behavior and relationships. Purpose. The purpose of the article is to determine the relationship between the philosophy of law as a “special” or “private” discipline and “general” philosophy. The subject of the study is the philosophical ideas of a rational approach to law as a practice. Methods. The research method is the analysis of scientific literature and philosophical reflection. Conclusions. In the philosophy of law the decisive factor is not so much its attitude to general philosophy, but the relationship between the philosophy of law and the law itself. Results. The effectiveness of the work done lies in the fact that the findings allow us to consider the philosophy of law as a practical philosophy. The results obtained can be used in further practical and theoretical studies of philosophy and theory of law.

Introduction. The contribution of the famous Russian philosopher and legal scholar N. N. Alekseev to the doctrine of the values in law is studied based on his monograph “Fundamentals of the Philosophy of Law”. It is emphasised that, even though the interest (especially in recent years) to the theoretical heritage of N. N. Alekseev has increased, the analysis of the methodology of his approach to understanding the legal axiology in combination with the scientific, metaphysical and religious definitions is still required. N. N. Alekseev's philosophy of law plays a significant role in strengthening the legal values in Russia and affirming the legal culture, legitimacy and legal order. The aim of present research is to analyse N. N. Alekseev's philosophical and legal concepts concerning the values in law, to determine the methodology of his approach to understanding the legal axiology in combination with the scientific, metaphysical and religious views and to prove the prognostic importance of his original concept. Materials and Methods. The research material comprised the results of the analysis of the theoretical provisions of N. N. Alekseev, more specifically the analysis of the chapter of the book “Fundamentals of the Philosophy of Law” dealing with the problems of legal values. The dialectical method of cognition was the main method used for the research, along with the general scientific methods of analysis, synthesis and the legalistic method. By implementing the historical approach to the evaluation of the materials, the authors adhered to the comprehensiveness and objectivity of the analysis. The authors strived to demonstrate both the holistic logic of N. N. Alekseev’s philosophy of law and his understanding of the legal axiology in combination with the scientific, metaphysical and religious definitions. Results. In the present work, the authors have analysed the mindset of the Russian philosopher and legal scholar N. N. Alekseev, whose views concerning the values in law were neglected in the national juridical science during most of the twentieth century. The ethical and legal concepts of N. N. Alekseev and the critical attitudes to this issue presented in the theoretical works of the various scientists have been reflected upon. Special attention has been given to the profound adherence of N. N. Alekseev to the idea of immanent interrelation of the main problems of law with the value aspects. The article defines the prognostic importance of the original concept formulated by the philosopher and legal scholar. Discussion and Conclusion. The analysis of the methodology of N. N. Alekseev's philosophical and legal mindset is important for the Russian juridical science. Many of the ideas contained in his works have already had a strong impact and continue to affect the research of the modern philosophers and legal scholars concerning the topic of the legal axiology. The ahead of his time prescient conclusions of N. N. Alekseev about the role of value factors in the future development of the Russian state are of considerable interest in the context of the further development of Russia as a law-governed state.

Abstract: The Idea of a Pure Theory of Law presents a new jurisprudential theory based on Hans Kelsen's Pure Theory of Law. This article responds to some criticisms of that book, in particular those that question the role that permissions can play in our thinking about he law. The article begins with a brief restatement of the basic ideas behind my theory of permission and then tackles the most salient clusters of criticism. It ends with a discussion of some more general points that have been made about my book.

Prilog ima četiri dela: predkritičko razdoblje, kritičko razdoblje filozofija prava i pravne države i dodatak. U razvoju misli nemačkog filozofa Imanuela Kanta razlikuju ce uglavnom dva perioda: predkritičko (do početka 1770. godine) i kritičko razdoblje. Kritičko razdoblje je određeno njegovim glavnim delima - Kritika čistog uma, Kritika praktičnog uma i Kritika moći suđenja. U predkritičkom razdoblju Kant ce bavio pretežno problematikom prirodnih nauka i filozofijom prirode. U svom kritičkom periodu Kant je polazio od toga da je neophodno da ce kritički istraže saznajne mogućnosti čoveka. Tek na osnovu toga ce mogu izgraditi teorijska filozofija, etika i filozofija prirode. U svom osnovnom etičkom delu Kritika praktičnog uma pripisuje Kant umu kao praktičnom umu, za razliku od teorijskog, zakonodavno a ne samo regulativno značenje. Kant insistira na dostojanstvu, vrednosti i slobodi svakog čoveka. Zakon praktičnog uma može imati samo formu sveopšteg zakonodavca. Osnovni zakon čistog praktičnog uma Kant formuliše na sledeći način: delaj tako da maksima tvoje volje može da važi kao princip sveopšteg zakonodavstva. Država je za Kanta zajednica ljudi podređena pravu i pravnim zakonima. Sloboda počiva u pravu svakog čoveka da ce pokorava samo onim zakonima na koje je dao svoj pristanak.

The article focuses on the links between criminal law and philosophy as well as the foundations of philosophy and criminal law. The author notes that in modern conditions criminal law can develop only relying on philosophy and shows how philosophy affects the understanding of the need to transform criminal law. Modern criminal law needs to be reflected. Life is changing, so the role of law in it is changing, too. Criminal law can no longer perform its functions in the way it used to. If we fail to understand this, we will not be able to move forward in our development. We will have to move a lot and quickly in the near future. Life is getting harder and faster, which cannot but please, since any movement makes our life longer.

В настоящей статье, открывающей цикл учебно-методических публикаций по философии канонического права, рассматриваются философия как способ вопрошания о сущем и применение философской рефлексии к выяснению правовых начал. Philosophy of law is a section of philosophy and legal science that studies the foundations of law, as well as its relationship to other normative systems - including ethics and practical theology. In the latter case, philosophy of law acts as jurisprudence interacting with the legal aspects of ecclesiology in the form of canon law. This article, which opens a series of teaching publications on the philosophy of canon law, examines philosophy as a way of questioning the essence and the application of philosophical reflection to the elucidation of legal principles.

The article discusses the necessity of the presence of legal philosophy in penal sciences, i. a. criminal law, as a necessary basis for the creation and functioning of a system of good criminal law. The author, referring to selected views on the essence of the criminal law, indicates that the philosophy of law is a binder of the entire criminal law system, serving the implementation of its goals and functions, and guaranteeing that criminal law serves the service of the human person. The philosophy of criminal law applies in many respects, especially in justifying the basic principles of criminal law and in connection with the axiology of protection of human rights and the Constitution.

AbstractIs it the task of legal semiotics or the legal philosophers to define legal semiotics? For the philosopher of law, the question recalls the distinction between philosophers’ philosophy of law and legal scholars’ philosophy of law. The thesis that the paper argues is that a semiotic legal perspective can also be sought from the analysis of anthropological knowledge on the origin of the social bond and society, implying a social and institutional theory of the mind. In the first paragraph, the search for a different kind of rationality emerges from a semiotician, Jürgen Trabant, who analyses semiotically the thought of a rhetorician and philosopher of law, Giambattista Vico. In the second paragraph, the anthropological notion of social bond emerges from the debate on the relationship between the idea of the gift and that of exchange. In the third paragraph, the analysis of the legal notion of thirdness recognizes the central role of myth and fiction in the configuration of the civil world and sign, returning to Vico’s critical view of the philosophy of language as an institution of society.

In this paper, author tries to analyze complex character of the relation between law and morality in contemporary law philosophy. There are three approaches to the issue of relation between law and morality: natural law theory (identity thesis), positivist (separation thesis) and Anglo-American analytical jurisprudence (polarity thesis). The identity thesis-law and morality are basically identical, although basic principles of morality are subordinated to the positive legal rules; the separation thesis-law and morality are quite different system of norms: positive legal rules are completely deprived of any moral content; Polarity thesis - law and morality are different systems of norms which complement to each other. The polarity thesis is exemplified in theories of Herbert Hart and Ronald Dworkin's. At the logical level, polarity thesis overcomes and specifically synthesizes abstract character and reductionism of identity and separation thesis. At the socio-historical level, the polarity thesis is result of historical development of legal and political institutions.

Dimitrije Matic (1821-1884) was a philosopher, jurist, professor of public law at the Belgrade Lyceum and politician. He served as Serbia?s Minister of Education and Church Affairs, acting Foreign Minister, Speaker of the Parliament, and member of the State Council. He was president of the Serbian Society of Letters and member of the Serbian Learned Society. Matic belonged to Serbian liberal-minded intellectual circles. He believed that the rule of force was unacceptable and that governments should promote and support popular education. Matic studied philosophy and law in Serbia (Kragujevac, Belgrade), Germany (Berlin, Heidelberg) and France (Paris), and received his doctorial degree in philosophy in Leipzig. In Berlin Matic embraced Hegel?s speculative philosophy and theory of state (philosophy of law). Among his professors were Georg Andreas Gabler (Hegel`s immediate successor), Otto Friedrich Gruppe, Wilhelm Vatke etc. In Halle he listened to another Hegelian, Johann Eduard Erdmann. He had the opportunity to attend Friedrich Schelling?s lectures on the philosophy of mythology. If the Right Hegelians developed Hegel?s philosophy along the lines they considered to be in accordance with Christian theology, and the Left Hegelians laid the emphasis on the anti-Christian tendencies of Hegel?s system and pushed it in the direction of materialism and socialism, Matic would be closer to the first. Actually, he was mostly influenced by his professor Karl Ludwig Michelet, with whom he established a lifelong friendship. Matic?s doctorial thesis (Dissertatio de via qua Fichtii, Schellingii, Hegeliique philosophia e speculativa investigatione Kantiana exculta sit) addressed the question of how the philosophy of Fichte, Schelling and Hegel developed from Kantian speculative thought. The paper deals with the question whether Matic took a shift from Hegelianism to Positivism (Naturalism) in the 1860s, which is a claim that was taken for granted in the Yugoslav (Serbian) Marxist histories of Serbian philosophy after the Second World War and Communist revolution. In fact, it is rooted in Milan Kujundzic-Aberdar?s (1842-1893) periodization of the Serbian philosophical literature. Kujundzic, professor of Philosophy at the Belgrade Great School, classified Matic?s Science of Education into the latest period of natural philosophy. In order to answer the question, the paper looks into the evolution of Matic?s philosophical, legal and political views. Matic followed Hegelian philosophy in his: Short Review (according to Hegel?s ? Psychology in Encyclopaedia of the Philosophical Sciences); Principles of Rational [Vernunftrecht] State Law [Staatslehre] according to Heinrich Zepfel?s book on the philosophy of law (Grunds?tze des allgemeinen und des konstitutionell-monarchischen Staatsrechts and Hegel?s Philosophy of Law) and History of Philosophy (according to Albert Schwegler?s History of Philosophy). There is nothing in Matic?s Science of Education that would corroborate the claim that he shifted from Hegelianism to Positivism. Though he had to attune his views to the changed, anti- Hegelian, intellectual climate and influences on academic life, he remained a Hegelian. The paper deals with the reasons why the Marxist histories of Serbian philosophy insisted on his alleged conversion.

Resumo:
U prvom dijelu članka autor poklanja naročitu pažnju činjenici da je u Kafkinim dnevnicima upadljivo odsustvo njegova profesionalnog života. Da ne znamo da je slavni pisac bio pravni ekspert, na osnovi njegovih osobnih bilježaka to ne bismo mogli zaključiti. U njima nema niti spomena o njegovom studiju prava, profesionalnim ambicijama i problemima proceduralnog interesa vezanog za pravnu praksu, niti o teškoćama ili postignućima na radnom mjestu, u čijoj je složenoj hijerarhiji pisac zauzimao veoma visoku poziciju. Rezultati provedenih analiza pokazuju bitnu, ali teško prepoznatljivu karakteristiku Kafkina književnog djela. Iznad nas svega nastoji upozoriti na to da je feudalni svijet još uvijek živ i zdrav, te da u modernom svijetu prepoznajemo jedino umnožavanje bivših suverena, čija je uloga da drugima nametnu zakone, a da od njih sami budu izuzeti. Djela Rudolpha von Jheringa, jednog od najpoznatijih filozofa prava toga vremena, i Hansa Grossa, slavnog utemeljitelja kriminologije i Kafkina profesora na praškom Karlovom univerzitetu, tematizirana su da bi se odredile dimenzije piščeve dekonstrukcije socijaldarvinističkih teorija krivičnog prava.

As a growing power, China is confronted with many challenges that include the revision of its erstwhile philosophies so as to better adapt itself to globalization and the contemporary international legal order. This article analyzes the close relationship between China’s attitude to international law and Chinese philosophy.
