For over 65 years, the United Nations has held congresses aimed at strengthening international cooperation against expanding crime. The First Congress on the Prevention of Crime and Treatment of Offenders took place in Geneva in 1955. Sixty-six years later, in 2021, this tradition continued, postponed by the Covid-19 epidemic, as the Fourteenth United Nations Congress on Crime Prevention and Criminal Justice took place in the former capital of Japan — Kyoto. The aim of the paper is to present the most important achievements of all 14 congresses, especially focusing on the development of UN standards and norms in crime prevention and criminal justice. The author also presents the history of the participation and activities of Polish participants of the Congresses (official delegates and individual experts) in the years 1960–2021. The general conclusion is that the institution of the UN Crime Congresses is a major high-level forum to steer the development of the rule of law, to promote global security and good governance, and to improve the response to crime.

El Tribunal Constitucional resuelve suspender la tramitación de una ley debido a la interposición de un recurso de amparo. Este recurso se interpone por afectar una decisión de la Comisión de Justicia del Congreso de los Diputados al ius in officium de los Diputados. La decisión consiste en la aceptación de una enmienda cuyo contenido no se corresponde con el contenido del proyecto de ley en tramitación. Se plantea también la recusación del Presidente y de un miembro del Tribunal Constitucional. Konstituzio Auzitegiak lege baten izapidetzea etetea ebazten du, babes-errekurtsoa jarri delako. The Constitutional Court decided to halt the passage of a bill due to the submission of an application of amparo. This appeal is submitted on the basis that a decision by the Committee of Justice of the Congress of Deputies infringed the ius in officium of the deputies. The decision regards the acceptatance in respect of an amendment whose content does not correspond to the content of the draft legislation in the pipeline. The President and a member of the Constitutional Court are also being challenged.

The main aspects of the World Congress of Ukrainians’ activities aimed at the preservation the Ukrainian Diaspora’s national identity are revealed in the article. Due to the analysis of Ukrainian periodicals in the United States (“Svoboda”, “Mist”, “Chas i Podii”) the vigorous activity of the Ukrainian association in the presentation of Ukrainians among the international community has been identified. The World Congress of Ukrainians has been working efficiently to preserve the religious and cultural heritage, national identity, and it has been also making significant efforts for Ukraine’s entering the Western educational and political space as well. The materials of periodicals suggest a lot of information on the association’s activities in the protection of future generations from the assimilation; on a sustainable cooperation with the USA government officials in order to support Ukraine, defending the right of Ukrainians to establish the historical justice about Holodomor-Genocide, its statehood and unity. Attention is paid to the Congresses of organization, as Chief Executive and heads of committees’ reports show the diversity and importance of the activity of the World Congress of Ukrainians.

Making strategic choices regarding her class and ethnic identiÞcation for the cause of social justice, Luisa Moreno was the most visible Latina labor and civil rights activist in the United States during the Great Depression and World War II. Vice-president of the United Cannery, Agricultural, Packing, and Allied Workers of America (UCAPAWA-CIO), this charismatic Guatemalan immigrant organized farm and cannery workers across the Southwest, achieving particular success among Mexican and Russian Jewish women in southern California plants. In 1939 she was also the driving force behind El Congreso de Pueblos de Hablan Espa–ola (the Congress of Spanish-speaking Peoples), the Þrst national Latino civil rights assembly. A feminist and leftist, she faced government harassment and red-baiting in the late 1940s, especially for her past Communist Party membership.

O artigo analisa os discursos que atravessam os projetos de lei no Congresso Nacional, que propõem regulamentar a união civil/casamento entre pessoas do mesmo sexo buscando identificar as características que esses discursos assumem. Pesquisa documental envolvendo sete projetos de lei que foram propostos entre 1995-2013. As defesas expressaram hegemonicamente a negação da totalidade da vida social, ocultando as determinações sociais, econômicas, políticas e culturais, advindas do modo de produção que afetam as famílias, atribuindo às famílias homoparentais a “culpa” por uma suposta “crise” ou “desestruturação” da família nuclear. Defendem uma concepção de família patriarcal, justificada pelo desejo de procriação, tido como natural e constituído apenas entre homens e mulheres.Palavras-chave: Família. In 1811, William and James Crooks of Niagara built the schooner Lord Nelson. A year later, that vessel was seized by the United States Navy for violating American law, beginning a case unique in the relations between the United States, Great Britain and Canada. Although the seizure was declared illegal by an American court, settlement was delayed by actions taken (or not taken) by the American courts, Congress and the executive, the Canadian provincial and national governments, the British government, wars, rebellions, crime, international disputes and tribunals. It was 1930 before twenty-five descendants of the two brothers finally received any money.

This Article examines how the metaphors in judicial opinions reveal judicial theories of lawmaking and judicial philosophies. It does so through a close reading of Justice Ginsburg’s majority opinion and Justice Gorsuch’s dissenting opinion in Artis v. District of Columbia, 138 S. Ct. 594 (2018). Artis was about what the phrase “shall be tolled” means in the federal supplemental jurisdiction statute, 28 U.S.C. §1367. Does it pause the statute of limitations while a state-law claim is in federal court or keep it running? In holding that Congress used “stop the clock” tolling, an “off-the-shelf” legal device that pauses the statute of limitations, Justice Ginsburg’s majority opinion uses conventional, mechanistic metaphors. Justice Gorsuch’s dissent uses more elaborate, agrarian metaphors to argue that Congress used a stricter “grace period” version of tolling because “[w]hen Congress replants the roots of preexisting law in the federal code, this Court assumes it brings with it the surrounding soil.” This Article shows that Justice Ginsburg’s mechanistic metaphors describe lawmaking like engineering and bespeak a mode of judicial interpretation based on purpose and precedent—while Justice Gorsuch’s agrarian metaphors hark back to a pastoral conception of lawmaking and interpretation “rooted” in a mythical common-law history and tradition. It then compares Justice Ginsburg’s moreunderstated use of conventional metaphors to Justice Gorsuch’s more performative metaphorical technique, arguing that their different rhetorical strategies reflect their different visions of lawmaking and interpretive philosophies. And it closes by showing how close attention to the metaphors theyuse can reveal the flaws in each approach.

Last August of this year, the Universidad Nacional Autónoma de México, through the Law School, by initiative of the College of Professors of Criminal Law, in response to the suspension of academic activities, as a result of the pandemic that afflicts the world arising from the SARS-Cov2 virus, taking advantage of digital platforms available to people at this time as a tool to use to communicate at a distance, organized the First International Virtual Congress of Criminal Law. In this event, more than 130 academics from different Latin American Universities participated as speakers, who presented on topics of the criminal legal reality, both substantive and adjective, in the panels that were organized by themes that addressed different concepts in these specialties. The Congress was embellished by Magisterial Conferences issued by Masters Emeritus and Deans of the Faculty of Law of the UNAM and other law schools of invited countries.The importance of the Congress surprised the Academic Forum, almost twenty thousand people registered and approximately two million of them accessed the event that was transmitted and broadcast on social networks through the Facebook platform “Live streaming”. From the approaches that were most emphasized in the presentations, the concern of the present article is born. Specifically, it highlights concerns about exercise, it highlights the concern about the arbitrary exercise of criminal law due to its punitive nature and the importance of limiting the excess in its application, respecting in general the human rights of individuals and, in particular, those recognized for the parties in the procedural rules, this in equity with the Fundamental Principles of the Prosecution Systems in the accusatory model, already adopted in practically all democratic countries in Latin America. This highlights the need for a new definition of preventive prison, conceived now as a precautionary measure and its intimate relation with the principle of the “Presumption of Innocence”, in whose application there must be absolute communion, a necessary condition in order to have a profound and definitive vision in the protection of Human rights.

[full article is in English]EnglishAt the beginning of the 1980s a new Global Space for the expansion of transnational capital emerged in the US–Mexico Border States. The militarization and securitization of that border were justified by government policies aimed at stopping irregular immigration, drug traffic, and terrorism. In 1991 the US Congress approved the creation of a new Defense Industrial and Technology Base (DITB), which would benefit the Gun Belt linked to the Military-Industrial Complex; and in 1992 the Department of Defense (DoD) proposed to establish a Defense Reserve Industrial Base Program (DRIB), the location for which would be within the existing production-sharing centers along the US–Mexico Border. Both, the DITB and the DRIB, would take advantage of the North American Free Trade Agreement (NAFTA), and transnational arms corporations established or expanded their facilities in the Global Space that has been created along the Mexico–US Border. This article examines this process. La militarización y la securitización de esta frontera ha sido justifi cada por estrategias para detener la inmigración irregular, el narcotráfi co y el terrorismo. En 1991 el Congreso de los Estados Unidos aprobó la creación de una nueva Base de Tecnología y Defensa Industrial (DITB) que benefi ciaría al llamado Cinturón de Armas ligado al Complejo Militar-Industrial; y en 1992 el Departamento de Defensa (DoD) propuso la creación del Programa de Base Industrial de la Reserva de Defensa (DRIB), cuya ubicación estaría dentro de los centros de producción compartida a lo largo de la frontera México–Estados Unidos. In recently-enacted legislation, Congress drew upon the 35-year experience with sentencing reform in the federal civilian criminal courts to reform significant aspects of the sentencing process in the military justice system. The article reviews the sentencing reform provisions contained in the National Defense Authorization Act for FY2022 and the Military Justice Act of 2016, which address many of the core elements of sentencing, including: (1) the principles governing sentencing in courts-martial; (2) the use of sentencing “parameters” and “criteria” in the adjudication of sentences by general and special courts-martial; (3) the role of the military judge in the adjudication of sentences; (4) consideration of plea agreements at the trial level; (5) appellate review of sentences; (6) clemency and related actions on the sentence, and more. After summarizing the history of military and civilian sentencing, the article reviews the newly-enacted military justice sentencing provisions, comparing them to the relevant provisions in the federal civilian sentencing system that were enacted as part of the Sentencing Reform Act of 1984 and subsequent legislation, and implemented by the U.S. Sentencing Commission. Although some of these newly-enacted reforms mirror similar elements of the federal civilian sentencing system, others follow a different approach, reflecting a decision by Congress to adapt rather than simply adopt current civilian practices. As Congress, the Administration, and a new Sentencing Commission focus on criminal justice reform, including possible changes to civilian sentencing law and policy, the recent reforms in military justice sentencing provide an important source of insights worthy of consideration.

The separation-of-powers literature focuses on how the preferences of one branch constrain the behavior of its counterparts. Yet, in much of this work, scholars do not address how responsive behavior varies across particular members. Focusing on Court curbing legislation in Congress, we develop a model of heterogeneous responsiveness. Our theory identifies two distinct mechanisms that underpin responsiveness in judicial behavior, implying that the chief justice and the most moderate (swing) justice are more likely than their colleagues to adjust their behavior in response to external threats from Congress. We find that these two justices are significantly less likely to vote to invalidate legislation than their colleagues during periods of heightened Court curbing and provide evidence that distinct mechanisms shape their behaviors. In addition, we offer justice-specific evidence using a pre–post promotion analysis, demonstrating that Justice Rehnquist became responsive to Court curbing only after becoming chief justice. Our model highlights the micro-level underpinnings of judicial responsiveness to inter-institutional politics and, most broadly, speaks to the need for separation-of-powers models to differentiate the preferences of individual political actors when seeking to understand inter-institutional responsiveness.

In National Federation of Independent Business v. Katherine Sebelius, Secretary of Health and Human Services, Case No. 11393, the Supreme Court of the United States affirmed most of the 2010 Affordable Care Act (ACA). In holding the ACA as valid (constitutional), Chief Justice Roberts reasoned that the taxing power in the U.S. Constitution was the reason that the law was enforceable. Although a strong dissent on such reasoning was written by four other Justices, Roberts also wrote that laws are entrusted to our nations elected leaders, who can be thrown out of office if the people disagree with them. [1]Roberts also wrote that the Commerce Clause in the U.S. Constitution did not give Congress authority to pass the ACA. Moreover, Congress could not impose unfunded mandates on the States to expand Medicaid. In so writing, Roberts disposed of the chief arguments of those in favor of the law and provided a bone to those who opposed it. But, by then holding that Congress taxing power was sufficient to uphold the law, Roberts ignored the Federal Anti-Injunction statute and called into question the ability of the Supreme Court to hold a law passed by Congress entirely unconstitutional. By writing that, in effect, the Court should defer to Acts of Congress, Roberts attempted a finesse first exercised by Chief Justice John Marshall in Marbury v. Madison in 1803. While it may seem as if he intended to demonstrate the same legal adroitness of Marbury, instead he deferred to the wishes of Congress, going through legal gymnastics to uphold a law that many scholars saw as indefensible, and damaged the power of the Supreme Court given to it in Article III immeasurably.

On November 30, 2016, after much uncertainty, the Colombian Congress finally approved a historic peace deal between the Colombian government and the Fuerzas Armadas Revolucionarias de Colombia (FARC), bringing to an end the country's fifty-year conflict. This peace deal was a historical achievement, and had important ramifications for international law, as discussed in a recent AJIL Unbound symposium. But once the spotlights were off, the government was faced with the daunting challenge of implementing the complex, lengthy accord. In particular, the government had to draw up and pass through Congress the legal and constitutional framework for the transitional justice process—a key component of the peace deal. It is there, in the subtle details of domestic criminal law, where the balance between peace and justice must be achieved.

Krause has undertaken a statistical analysis of the relationship between the president and the Congress and the enforcement activities of two regulatory agencies: the Securities and Exchange Commission and the Antitrust Division of the Department of Justice for the years 1949–92. He finds that the president and the Congress often influenced each other, but neither of the political branches succeeded in dominating the bureaucracies. These findings are consistent with the interpretations of presidential-congressional-bureaucratic power of most journalists, sociologists, historians, political scientists, and public administration scholars.

The nominal sovereignty that the indigenous tribes exercise in the US is further constrained by the federal government exercising the powers of trustee and restricting their rights of alienation over lands. The plenary authority of Congress allows the enactment of all laws impacting on Indians that the federal government deems necessary. It is of overriding effect and has led to the emergence of a land law theory that preserves the power of preemption over the tribal nations. This legal framework dates back to the Marshall doctrine and the Indian Trade and Intercourse Act 1790. The issue is: can there be a reversal of the extinguished title for the indigenous peoples and an assertion of their original claim to rightful ownership? This article compares the land theory that prevails in the US with the developments that have taken place in common law countries, such as Canada and Australia, and concludes that there needs to be an affirmation of the principle of a right in land for the Native people rather than them being ‘tenants at will’ of the federal government.

The Act is intended to “restore, reaffirm, and reconcile environmental justice and civil rights.” It does so by restoring an individual’s right to sue in federal court for discrimination based on race, ethnicity, or national origin regardless of intent under the Civil Rights Act of 1964, strengthening the National Environmental Policy Act, and providing economic incentives focused on environmental justice.

Tourists pass by without noticing the building with its small brass plaque reading ‘House of the Mothers’. Every day the Mothers meet here to continue their 20-year struggle, begun during the military dictatorship (1976-1983), to establish exactly what happened to their disappeared sons and daughters and to demand retribution against those who imprisoned, tortured and killed their children. July this year marked their 1,000th meeting. There are also the Grandmothers, women who lost not only a daughter or son, but also their children's children. El problema planteado es ¿Existen factores que interfieren en la Independencia Judicial en la elección de Magistrados de Corte Suprema de Justicia, Corte de Apelaciones y de Tribunales de igual categoría? La hipótesis de trabajo es “Existen factores políticos que limitan e inciden en el ejercicio de la Independencia Judicial en Guatemala en la elección de Magistrados, en virtud que no se privilegia la capacidad, experiencia e idoneidad del operador de justicia en su Carrera Judicial”. Perhaps the most striking aspect of the Supreme Court’s decision in Zivotofsky v. Kerry (Zivotofsky II), was the open disagreement between Justice Kennedy and Chief Justice Roberts. What Justice Kennedy’s majority opinion, holding that the President has exclusive power to recognize states and governments and that Congress cannot constitutionally impinge on that power by requiring the President to list Israel in the passports of U.S. citizens born in Jerusalem, means for future foreign relations law cases is something of a puzzle. Solving it requires understanding the two competing visions at the case’s center and the fluctuating relationship between the two Justices who hold them.

Este artículo trata sobre el Estatuto Provisorio de Justicia que fue promulgado por el Congreso General Extraordinario de 1842, para realizar el análisis se utilizaron fuentes primarias y secundarias aplicando el método histórico y un análisis de las magistraturas establecidas. Se ha encontrado un entramado judicial que se encontraba sometido al gobierno, pese a que se sostuvo que se promulgó el Estatuto para establecer un poder judicial independiente del gobierno. Se concluye que el Estatuto Provisorio de Justicia fue un avance en el proceso de institucionalización republicana en el Paraguay pese a que siguieron vigentes leyes hispanas.

The Prison Litigation Reform Act (PLRA), enacted by Congress in 1996, establishes a separate and unequal system of justice that applies only to prisoners. Under the PLRA, injunctive relief in cases involving prison conditions is both harder to obtain and easier for defendants to terminate than in other cases. The PLRA also imposes strict limits on damages and attorney fees that can be recovered by prisoners whose rights have been violated. Federal courts have largely upheld the PLRA's restrictions, and the reasoning of these decisions is not confined to cases involving prisoners. The PLRA and the court decisions approving it thus stand as a worrisome invitation to Congress to enact similar restrictions on judicial relief for other unpopular and politically powerless minorities.

We are at a notable moment to contemplate federal sentencing. Fifteen years ago, the Supreme Court issued its landmark decision in United States v. Booker. Just over 25 years ago, Congress passed and the President signed the 1994 Crime Bill. By looking backward and learning from history, we may be able to move forward more productively. One remarkable aspect of Booker is that it still controls federal sentencing a decade and a half later. Congress has chosen to largely leave the system as the Court refashioned it. The world is different today than it was in 2005. Yet the Booker framework – established by two essentially dueling 5-4 majorities of the Supreme Court – endures. In some ways, the most remarkable aspect of Booker at 15 is how unremarkable it appears to contemporary eyes. It is the dog that doesn’t bark – at least not much. In order to truly benefit from the lessons of our criminal justice history, we must go beyond guidelines. Just over 25 years ago, Congress spoke forcefully in the 1994 Crime Bill. It was addressing the concerns of that era with tactics that garnered wide support at the time but are not always viewed favorably today. By stopping to explore the context and consequences of two of the most significant judicial and legislative criminal justice events of the last quarter-century, lessons may emerge. That is a good thing. If we are to make mistakes again (and we will), they should be new ones. Only by understanding the past can we effectively illuminate the path forward.

Resumo:
The U.S. Constitution requires the President to submit Supreme Court nominees to the Senate for its advice and consent. The appointment of a Supreme Court Justice is an event of major significance in American politics. Since the early 20th century, Presidents have submitted 62 nominations for the Court, including those for the post of Chief Justice. Of this total, 55 were confirmed (seven declined to serve). The article dissects the crucial constitutional disputes between the executive and legislative branches of government from the Eisenhower administration to the end of the Clinton administration, and examines the day-to-day working relations between the President and Congress, which go beyond the traditional discussions of Supreme Court decisions. The article analyzes the conflicts between the President and Congress in the field of shared power – nomination and confirmation of the Supreme Court Justices in the Senate. The research is based on historical and statistical data on the Supreme Court: its institutional development; decision trends; background, nomination; its relations with public, governmental, and other judicial bodies; and its influence. A special place in the article is given to the analysis of the policies of the Nixon, Reagan and Clinton administrations.
