Since the Communists came to power in 1949 Chinese art has seen extraordinary changes. For 30 years, the Party apparatus and its Marxist-Maoist ideology exerted so tight a control over cultural life that it is natural for the art of that period to be viewed primarily as a reflection or expression of political forces. To some degree that is unavoidable, and it is the approach taken by the authors of two important books on post-1949 Chinese art, while Jerome Silbergeld's monograph on the Sichuan eccentric painter Li Huasheng is a fascinating study of the way in which these forces affected the life and work of an individual artist.

Resumo:

Dewasa ini, Pemenuhan hak korban dalam mencari keadilan diabaikan eksistensinya bahkan terdiskriminasi. Walaupun telah diatur dalam Undang-Undang Nomor 39 Tahun 1999 Tentang Hak Asasi Manusia dan Undang-Undang Dasar 1945, yang membahas perihal pemenuhan hak bagi setiap individu yang setara dan harus dipenuhi oleh negara, pemenuhan hak korban masih saja belum terpenuhi secara menyeluruh. Penyebab utamanya adalah sikap Aparat Penegak Hukum yang tidak kooperatif dalam melindungi dan memberikan pemenuhan hak bagi korban. Oleh sebab itu penelitian ini bertujuan untuk menelaah mengenai keadilan dan kemanfaatan yang merupakan tujuan dari adanya hukum, peneliti menganalisis dari teori keadilan John Rawls dan teori utilitarianisme Jeremy Bentham dan ditinjau menurut presfektif viktimologi yang mana berfokus pada pengalaman korban dan respon kebijakan negara terhadap korban. Jenis pepenelitian ini, merupakan penelitian normatif dengan analisis data kualitatif, analisis disajikan secara deskriptif untuk mengungkapkan fakta selengkap-lengkapnya. Hasil analisis pendekatan John Rawls dan Jeremy Bentham menurut presfektif viktimologi jika diterapkan secara benar maka dapat memenuhi keadilan dan melindungi hak korban, namun di Indonesia belum berjalan dengan maksimal karena kurangnya partisipasi aktif aparat penegak hukum dalam menjalankan tugasnya yaitu melindungi serta memberikan pemenuhan hak bagi korban.

The Merchantville Formation of New Jersey, Maryland, and Delaware yields a distinctive assemblage of upper lower Campanian ammonites: Pachydiscus (Pachydiscus) sp., Pseudoschloenbachia cf. P. chispaensis Adkins, 1929, Placenticeras placenta (DeKay, 1828), Texanites (Texanites) sp., Menabites (Delawarella) delawarensis (Morton, 1830c), M. (D.) vanuxemi (Morton, 1830c), Menabites (Bererella) sp., Submortoniceras punctatum Collignon, 1948, S. uddeni Young, 1963, Cryptotexanites paedomorphicus n. gen. and sp., Glyptoxoceras sp., Chesapeakella nodatum n. gen. and sp., Baculites haresi Reeside, 1927, and Scaphites (Scaphites) hippocrepis (DeKay, 1828) III of Cobban, 1969. Elements of the fauna occur in the Gulf Coast and Western Interior regions of the United States, in Western Europe, and in Madagascar and provide a basis for correlation at this level.

Resumo:

Between 1942 and 1945, 5,300 Organisation Todt workers were brought to Jersey to build the defensive fortifications ordered by Hitler. A small number of Russian slave labourers escaped from island camps and were sheltered by Jersey residents until the liberation. The article describes the activities of these helpers and the rudimentary network of safe houses they created, as well as comparing their motives with those of the rescuers of Jews in occupied Europe. It ends by outlining reasons for the neglect of this episode of British wartime history and suggests the adoption of a comparative approach as the best way towards an understanding of the possibilities and limitations of resistance in the Channel Islands.

Abstract Cooperation between the World Bank and India goes back to the foundation of the International Bank for Reconstruction and Development (IBRD) in 1944. As one of 44 countries, India prepared the agenda for the Bretton Woods Conference in June 1944. The Indian delegation led by Sir Jeremy Raisman, Finance Member of the Government of India, proposed the name "International Bank for Reconstruction and Development India managed to lift 133 million people out of poverty between 1994 and 2012. However, India with a population of 1.3 billion shows 5% of its population living in extreme poverty. In June 2018, India ran a current account deficit of USD 15.8 billion, marking the highest deficit in the last five years. India exported USD 261 billion in 2016, making it the 17th largest exporter in the world. However, India's export structure is still not really diversified and focuses primarily on commodities and primary products. Diamonds and jewelry and packaged pharmaceuticals account for about 20% of the export sector

Artykuł zaznajamia z postacią Jana Jerzego Buzka (1874-1940), polskiego lekarza z pogranicza Polski i Czechosłowacji, tzw. Zaolzia. Ukończył studia lekarskie na Uniwersytecie w Krakowie. Pracował jako lekarz górników w Dąbrowie. Był organizatorem szkół średnich dla polskiej młodzieży, a podczas okupacji hitlerowskiej członkiem polskiego ruchu oporu na Zaolziu. W 1940 r. został aresztowany i zesłany do obozu koncentracyjnego w Dachau, gdzie zmarł z głodu i wyczerpania.

This paper compares the modernist musical-narrative separations of The Dark Mirror (Robert Siodmak, 1946), Dead Ringer (Paul Henreid, 1964), and Sisters (Brian De Palma, 1973) with the postmodernist musical-narrative fusions of the Canadian film Dead Ringers (David Cronenberg, 1988). The two earlier films (starring Olivia de Havilland and Bette Davis, respectively) mainly conform to the aesthetic of film noir or "suspense-thriller," whereas the two later films (starring Margot Kidder and Jeremy Irons, respectively) also contain substantial elements of "horror." The musical scores of these four films (by Dimitri Tiomkin, André Previn, Bernard Herrmann, and Howard Shore) feature, in varying degrees, the meaningful placement and development of leitmotifs and titles music, changes in meaning by altering instrumentation and/or mode, gender representations, and issues of cultural hierarchy and class distinctions.

This essay combines an ecological perspective with a mobility justice theoretical framework to reconceptualize the relationship between school transportation and educational access. Authors Sarah Winchell Lenhoff, Jeremy Singer, Kimberly Stokes, James Bear Mahowald, and Sahar Khawaja document the problem of “getting to school” that is at the intersection of students’ family, community, and social contexts and how it goes beyond whether there is a reliable mode of physical transportation. Bringing together a historical analysis of the policy landscape and interview data from parents and students in Detroit, they find that school transportation problems reflect the unequal political, social, and economic context in which families navigate enrollment and attendance. They discuss how policy makers can advance mobility justice in school policy by equitably distributing transportation resources, engaging students and parents as experts in developing and communicating transportation policy, and using institutional power to remedy structural barriers to educational access.

New Jersey played a dominant role in the merger wave at the turn of the century. The state facilitated the rise of large firms by liberalizing its corporation law in exchange for incorporation fees and franchise taxes. This article suggests that chartermongering emerged from the U.S. federal political system and the economic structure of the state. Delaware became the preferred state of incorporation as New Jersey's economic structure changed.

Critics who viewed David French’s three earlier plays about the Mercer family as a “trilogy” will no doubt be expanding it to a “tetralogy” with the appearance of 1949. But this play makes very clear what should have been evident before: the Mercer plays do not constitute a unified saga portraying the fortunes of a single family through time, but are rather a set of variations on a theme, in which French’s family myth is embodied in a series of plays of different styles and involving different characters, although some of these characters share names and a few basic personality traits. The Jacob and Mary of 1949 have some qualities in common with the Jacob and Mary of Leaving Home (which supposedly takes place eight years later), but they are much softer, more insightful people, and they live in a much less harsh environment. Significant details vary considerably from one play to another. Mary’s old beau, Jerome McKenzie, moves from being a prominent St John’s Q.C. to whom Mary constantly alludes in Leaving Home, to a quiet, studious, prematurely-balding schoolteacher who represents security as opposed to sexiness in Salt Water Moon, to a handsome war hero, ladies’ man, and newspaper reporter in 1949, someone whom Mary “hardly ever mentions” (p. 119) because of her awareness of Jacob’s jealousy. These transformations must be attributed, not to time, but to changes in French’s own attitude to his background and his goals as an artist.

The concepts of positivism and utilitarian schools show differences in regulating or interpreting society and individual rights. The purpose of this research is to find the views of the pure law school and the utilitarian law school in reconstructing indigenous peoples. This research uses normative legal research. In its study, this research uses several approaches, namely the statutory approach and the concept approach. The results showed that John Austin's pure legal school places the construction of indigenous peoples in the standard norms contained in Article 18 B paragraph (2) of the 1945 Constitution. This flow limits the interpretation of the construction of indigenous peoples. Meanwhile, according to the utilitarian legal school of Jeremy Bentham, the view of Article 18 B paragraph (2) of the 1945 Constitution as the basis for the construction of indigenous peoples shifts by interpreting the existence of indigenous peoples is not only seen as law an sich, but the legal regulation of legal communities is seen in 3 (three) aspects, namely a) indigenous peoples are seen in the position of legal reality; b) Customary law becomes a translation of the legal provisions referred to in Article 18 B paragraph (2) of the 1945 Constitution; c) Recognition and protection of the law of indigenous peoples are constructed in the aspect of legal reality. Thus, the utilitarian school of law opens a new approach in the construction of indigenous peoples that is not only reviewed from the norms an sich in statutory regulations but the existence of utilitarian schools of law can be used to open more lively legal spaces in constructing recognition and protection of the rights of indigenous peoples as subjects of law.

Then UK Labour Party leader Jeremy Corbyn’s attendance at a Passover Seder organised by the radical leftist group, Jewdas, in April 2018, led to a brief but vitriolic controversy involving Anglo-Jewish umbrella organisations concerning who qualifies to speak as a Jew. This article uses this controversy to engage with Judith Butler’s attempt to address this question, suggesting that in decentring Zionist claims to Jewish subjectivity she fails to take account of how different Jewish subjectivities are formed, and thus ends up proposing a ‘good Jew/bad Jew’ binary that dissolves Jewishness into universal humanism. Drawing on the work of the German-Jewish mystical anarchist Gustav Landauer (1870–1919), the article proposes a different way of understanding subjectivity that retains ontological inherency as a plausible precondition for ethical solidarity. As such, the article’s argument has implications not merely for a reworked understanding of Jewish subjectivity but for the politics of subject formation more broadly.

A conceptual model links agricultural profits, capital gains, interest rates, and property taxes to the sale of agricultural land by profit-maximizing owners. The model motivates an empirical analysis of New Jersey data from 1949 to 1990. Results suggest that nonagricultural considerations may overpower the economic incentives provided by such policies as farmland assessment. Consequently, alternative policies (e.g., purchase of development rights and land use zoning) may be needed to sustain agriculture in rapidly urbanizing areas.

Resumo:

F. Dostoevsky’s Notes from Underground (1864) exerted a considerable influence on American literature since 1940s. The works by outstanding authors beginning with Saul Bellow (Dangling Man, 1944) or Jerome Salinger’s prose and up to Bret Easton Ellis (American Psycho, 1991), Percy Walker, David Foster Wallace, show a persistent fascination of American writers with the novella and are based on re-reading and re-interpreting Dostoevsky’s ideas, motives and imagery.

Resumo:

Objective: The purpose of this study is to analyze the process of registration and consolidation of land for coastal areas and small islands in the perspective of protecting the potential of national resources and strengthening national sovereignty. Method: This type of research is normative legal research, supported by secondary data, which consists of primary, secondary and tertiary legal materials, obtained through library research. The methodology uses a legal research and qualitative approach. The grand theory uses the theory of positive law by John Austin, the middle theory uses the theory of the nation's soul by Friedrich Carl von Savigny and the applied theory uses the theory of the law of happiness (utilitarianism) by Jeremy Bentham. Result: The results show that the State/Government immediately implements the Land Registration and Consolidation, in order to protect the potential of National resources and strengthen national sovereignty. Conclusion: It will accelerate the realization of the national goals mandated in the Fourth Paragraph of the Preamble to the 1945 Constitution of the Republic of Indonesia.

On September 13, 2020 a quarter of a century had elapsed since the Swiss and Italian authorities raid in the Free Port of Geneva, on the warehouses of Giacomo Medici, later convicted of involvement in cases of trafficked antiquities. Since then, many other raids followed on properties of other notorious antiquities traffickers, thousands of antiquities were confiscated from them and their invaluable archives were discovered and seized. The research on these archives resulted in hundreds of notable repatriations so far, but mainly in the enrichment of our knowledge about the criminal way in which the so-called ‘reputable’ members of the international antiquities market have been acting since the 1970 UNESCO Convention, which they completely ignored in practice. Despite the numerous occasions on which these ‘reputable’ members were identified as involved, even today they continue to act in the same way, some without any (or known) legal sanctions. This chapter reviews the illicit associations of one of these ‘prominent’ members of the international antiquities market, the ‘Royal-Athena Galleries’ in New York, a gallery run by the antiquities dealer Jerome Eisenberg, who has repeatedly been found selling looted, smuggled and stolen antiquities. I then present seven antiquities, most of them identified in October 2019, one in March 2020, soon before the retirement of Jerome Eisenberg and the closure of ‘Royal-Athena Galleries’ on October 31, 2020. This piece lays out all the relevant evidence from the confiscated archives and combines everyone involved to illustrate the network that ‘circulated’ these seven objects. This case study also highlights all the problems that are ongoing in this research field, proving that essentially nothing has changed since 1995, or even 1970, and we indeed deserve the (illicit) antiquities market we still have. Resumo:

This study analyzes the concept and implementation of human rights (HAM) within the framework of Pancasila ideology, exploring both theoretical and practical perspectives. It examines the historical and philosophical foundations of human rights, rooted in natural law theory and developed through contributions from figures such as John Locke, Edmund Burke, and Jeremy Bentham, as well as their application in Indonesia’s socio-cultural and legal systems. Employing a descriptive qualitative method, the study utilizes data from academic literature, legal documents, and interpretations of Pancasila, focusing on its principles of Divinity, Humanity, Unity, Democracy, and Justice. The findings reveal that Pancasila integrates universal human rights principles with Indonesia’s socio-cultural realities, guiding the resolution of humanitarian issues and fostering unity in a diverse society. However, challenges such as historical debates over the inclusion of human rights in the 1945 Constitution and contemporary issues like racism and discrimination persist. The study concludes that Pancasila serves as a foundational ideology for upholding human dignity, justice, and equality. To address these challenges, efforts are needed to educate citizens, promote tolerance, and ensure government support for initiatives that strengthen human values and solidarity, highlighting the importance of human rights in achieving national unity, peace, and prosperity.

Resumo:

Jean-Paul sartre is rarely discussed in the philosophy of religion. In 2009, however, Jerome Gellman broke the silence, publishing an article in this journal in which he argued that the source of sartre’s atheism was neither philosophical nor existential, but mystical. Drawing from several of sartre’s works – including Being and Nothingness, Words, and a 1943 review entitled ‘A New mystic’ – I argue that there are strong biographical and philosophical reasons to disagree with Gellman’s conclusion that sartre was a ‘mystical atheist’. moreover, I question the likelihood of drawing any definitive conclusions regarding the sources of sartre’s ambiguous atheism.
