Texto completo da fonteObjective of the study – The primary goal of this research study was to investigate and document the evolution and historical development of the crime of aggression. Design / methodology / approach – The research study was primarily a desk-top based research by design and methodology. It reviews a range of published books, expert commentaries, and journal articles that provide theoretical and practical research on the evolution and development of crime of aggression through the past centuries to the present day. The discussion is majorly premised around key historical debates and events that shaped, and defined the rubric of the crime of aggression. These include: the philosophers' conceptualisation of the doctrine of "just war" or "unjust war", states' practice before and after the First World War and Second World War, the International Military Tribunals, the birth and role of the United Nations, the 1998 Rome Conference and the 2010 Kampala ICC Review Conference. Findings – This study provides information on each author's perspective on the status of the crime of aggression before and after the First ICC Review Conference. The study generally concedes that although today the crime of aggression is defined under the Rome Statute, and the jurisdiction of the ICC over it spelt out; its status under the treaty regime remains distinctly different from that under international customary law. Significance of the study – The significance of this research study lies in the fact that it is useful with regard to documenting the historical development of the crime of aggression. It also fulfils an identified need to clarify the position of the crime of aggression after the landmark First ICC Review Conference that took place in Kampala during May / June 2010. PROGRAMA DE SUPORTE À PÓS-GRADUAÇÃO DE INSTS. DE ENSINO
O objetivo desse trabalho é melhor compreender a situação atual da formação de intérpretes de conferência de línguas orais-auditivas no Brasil. O primeiro objetivo é mapear o cenário diverso de formação de intérpretes no país e o segundo é comparar o currículo e as práticas desses cursos com as chamadas melhores práticas de formação de intérpretes recomendadas pela Associação Internacional de Intérpretes de Conferência (AIIC). Após a apresentação de algumas propostas para o ensino de interpretação, fundamentadas em textos de Danica Seleskovitch e Marianne Lederer, David Sawyer, Donald Kiraly e Rosemary Arrojo, é traçado um breve panorama da história da formação de intérpretes no Brasil e no mundo e o papel proeminente da AIIC nesse processo. Seguem-se os perfis dos cursos participantes da pesquisa: três de pós-graduação, três de graduação, um sequencial e quatro livres, que serão analisados à luz das melhores práticas da AIIC. O estudo desenvolvido nos permite concluir que, apesar de nenhum curso atender integralmente aos quesitos recomendados pela AIIC, o ensino de intérpretes no Brasil está no caminho para a profissionalização.
The aim of this thesis is to better understand the current scenario of spoken-language conference interpreter training in Brazil. The first aim is to map out the diverse scenario of interpreter training and the second, to compare the curriculum and practices of these different courses with AIIC Conference Interpreter Training best practices. Some proposals for interpreter training were presented, based on the work of Danica Seleskovitch e Marianne Lederer, David Sawyer, Donald Kiraly and Rosemary Arrojo; and an overview of the history of conference interpreter training in Brazil and around the world was made, highlighting AIIC s prominent role in this process. These are the profiles of the courses that took part in the survey: three graduate-level courses, three undergraduate level, one extension course and four commercial courses. Their practices were analyzed according to AIIC s best practices for interpreter training. We concluded that even though no school has fully met all AIIC s recommended criteria, interpreter training in Brazil is on the path to professionalization.

Texto completo da fonteAs the agenda for the United Nations (UN) 2001 Conference on The Illicit Trade in Small Arms and Light Weapons in All Its Aspects takes shape, governments should begin to identify a set of standards, mechanisms and specific agreements that will help consolidate, reinforce and co-ordinate regional and national measures to address the problem of the proliferation and misuse of small arms. An important element of this approach will be to build upon the wealth of regional and national experiences and perspectives that illustrate the different contexts in which efforts to combat the proliferation and misuse of small arms and light weapons have occurred. At the same time, agreements reached at the UN 2001 Conference should be substantial, establishing an agreed comprehensive `international action programme¿ f o r sustained global effort on this complex problem. However there remain issues and concerns that are common to all regions: these should be identified and addressed internationally within the context of the UN 2001 Conference. This briefing, the second in the Biting the Bullet series, reviews some of the current regional e fforts on small arms and light weapons. It identifies common approaches that have been used in different regions to counter the proliferation and misuse of small arms and light weapons, these include: law enforcement and crime control; supplier restraint and transparency; national legislation and regulation of arms; and arms reduction and control. The briefing analyses initiatives using these approaches that are moving forward in West Africa, Eastern and Southern Africa, the European Union (EU), and the development of cooperation between EU Member States and other countries and regional organizations, including Cambodia and the Southern African Development Community. The briefing identifies the impact and priorities of these initiatives, suggesting ways in which the UN 2001 Conference is both relevant to the region and what the region can contribute to the outcomes of the Conference. The briefing concludes with recommendations on the ways in which regional processes can be reinforced and further developed by the international community, focusing especially on the contribution of the UN 2001 Conference. Experience is showing that much of what happens nationally and regionally needs reinforcement and further development with assistance from the international community. The UN 2001 Conference comes at an important time for providing the framework ¿ through the international action programme ¿ to develop, reinforce and c o-ordinate these national and regional processes, through developing appropriate international norms, standards, programmes and mechanisms. Using the illustration of combating illicit arms trafficking, this briefing outlines some of the processes that could be taken forward through the UN 2001 Conference which would build upon and strengthen national and regional eff o r t s . The briefing contains an annex, which provides background information on many current regional and international initiatives, including those in Africa, the Americas, Asia, Europe and inter-regionally, such as the Organisation for Security and Co-operation in Europe and the North Atlantic Treaty Organisation.

Texto completo da fonteThe Overseas regions, countries and territories present various statuses inherited mainly from the major European Powers which placed them in a relationship of a common interest not only with their mother countries but also with the European Union (EU).However, these territories have continuously re-built between them historical and cultural links, and weaved relationship within the entire Overseas to appear as a constituted whole while negotiating with the EU.The outermost regions (OR) apply Community Law while the Overseas Countries and territories (OCT) situated outside the territory of the Community, have Association Arrangements with the EU.Denmark, France, Netherlands, Portugal, Spain and United Kingdom have proceeded to necessary constitutional reforms to allow numerous articles amendments in respect of right to self-determination of peoples.At the light of statutory amendments and of a continuous economic and social development, the Outermost regions (OR) and the Overseas Countries and Territories (OCT), now wish to assert their rights and to defend their interests at European and International level.Globalisation of policies encourages OR and OCT to gather within International bodies. The rule of law of the related countries opens them to well-structured legal systems and to European values. The outermost geopolitical localisation makes them to have access to international relations.The purpose of this thesis is to demonstrate the interdependence between these different legal systems and the impact of European and International Law on the statutory amendments of the Overseas towards more autonomy, but also liabilities and involvement on their own development by using their regional environment, inter-regional and transnational cooperation and taking part at the works of international organisations

Texto completo da fonteI Estland 2007 utbröt vad som kommit att kallas ”Cyberwar I”, vari ett stort antal centrala myndigheters, tillika finansiella institutioners servrar attackerades av massiva så kallade Computer Network Attacks (CNA), utfört av framförallt ryska aktörer. Estland protesterade högljutt, men frågan huruvida CNA är att beteckna som olovligt är allt annat än klar. Prövningen sker mot den folkrättsliga regimen Jus ad Bellum, och huruvida metoden uppfyller vissa centrala begrepp. Men hur skall denna regim appliceras CNA?
De frågeställningar som avses besvaras är: hur kan CNA utgöra våld eller hot om våld i enlighet med FN-stadgans artikel 2(4) samt hur kan CNA utgöra väpnat angrepp i enlighet med FN-stadgans artikel 51? Detta avses göras genom en studie inbegripande flertalet folkrättsliga experters teorier på området CNA och våldsanvändning, samt applicering av desamma på en fallstudie av händelserna i Estland 2007.
Sammanfattningsvis konstateras att flertalet variabler har bärighet i hur CNA kan uppfylla artiklarnas centrala begrepp, vari frågan om association, effekt, aktör och mål tydligast faller ut. I en efterföljande diskussion påvisas dock hur variablerna endast är att betrakta som indicier på hur CNA kan klassas så som olovligt, varvid endast statspraxis kan ge den slutgiltiga bedömningen.

Technical issues and the opposite interests of States, stemming from interlinked services provided by forest, had prevented International community to adopt a convention on forests. Nevertheless, climate regime has recently created a so-called mechanism on « reducing emissions from deforestation and forest degradation in developing countries and the role of conservation and sustainable management of forests and enhancement of forest carbon stocks in developing countries » (REDD+). The normative framework laid down in decisions of the Conference of the parties has stimulated control improvement on forest resources and wide-ranging reform in developing countries. The study will evaluate the specificities of this normative system by going further its apparent normative weakness. It will expose how International law manage to regulate complex phenomenon by producing adaptive legal system. The study will demonstrate that the specific feature of this system lies in its ability to conciliate two opposite needs: flexibility and legal security

Texto completo da fonteThe final thesis analyzes the role of classification societies in ensuring maritime safety, the basis and meaning of their responsibility, as well as legal acts regulating the activity of classification societies. The aim of the thesis is to analyze the functions of classification societies and to prove the existence of their responsibility and the importance of their role in search for maritime safety, to discuss the relationship of such societies with the country the flag of which the ships are flying and with the owners of the ships, to discuss the reliability of ship inspection and safety certification and the possibilities for the reform of the classification system. The aim of the thesis was met by using data collection, analysis of the collected data, description methods and trying to meet the set objectives. A thorough explanation of the reasons for the establishment of classification societies, their legal and classification functions, differences and performed inspections is provided in the analytical part of the thesis. The role of the International Association of Classification Societies and the requirements for authorized accredited organizations are discussed here as well. The importance of the compliance of technical regulations of classification societies with international legal acts and the problem of the class certification quality are dealt with separately. Texto completo da fonteWhile many discovered the existence of Conferences of the Parties (COPs) in December 2015, during the COP 21 held in Paris, these institutions have nevertheless exercised, for almost half a century, essential functions for the development of international law and the effectiveness of international agreements in a wide variety of fields (protection of the environment, culture, health, disarmament,...). At the time of their creation and early development, these institutions were seen as an innovative mode of international governance, designed to arrange a flexible inter-state cooperation while ensuring the monitoring and adaptation of international treaties. Nearly half a century later, COPs have undergone a significant development, both quantitatively and qualitatively. This evolution calls for an analysis of their legal status and functions. The thesis characterizes the existence of an institutional common model and concludes that Conferences of the parties constitute an intermediate form of institutionalization, which is widely accepted by States despite a growing movement of rejection of multilateralism. By reducing the cost of their institutionalization and by preserving the sovereignty of their States parties, COPs appear to successfully balance the relational and institutional aspects of interstate cooperation

Texto completo da fonteResearch has tried to refine the legal phenomena of the liberalization of goods and services, known as first generation, in favor of a regional economic integration policy under the influence of globalization, in order to establish the ASEAN Economic Community. However, the question of the existence of substantive rules of law is underestimated in the eyes of international lawyers and it is relevant. In other words, ASEAN is mainly based on soft law, namely ASEAN Way, which has effectively slowed down the implementation of its economic integration policy. In order to overcome these challenges, this thesis opted for an approach of public international law in order to examine the mechanism of formation of conventional as well as non-conventional rules of this in ASEAN. In addition, international economic law is also a methodological choice for this research work on essential technical questions in the process of creating the ASEAN Single Market. As a result, we have discovered that ASEAN substantive law does exist and continues to develop gradually in the proper sense of international law. Moreover, the administrative as well as jurisdictional institutional mechanisms have been observed, their operation of which is implicated in a pragmatic manner for the implementation of these material rules regarding the free movement of goods and services. Despite the fact that these rules of law are criticized both for their effectiveness and efficiency because of their flexible and non-binding nature, sectoral legal harmonization is complete towards the direction of the construction of ASEAN Community Law. In conclusion, the economic regionalization of ASEAN is effectively established on its own legal framework, based on legal pluralism and is consistent with international law

Texto completo da fonteThe « three sisters », namely the Codex Alimentarius Commission (CAC), the World Organisation for Animal Health (OIE) and the International Plant Protection Convention (IPPC), and SPS measures of ASEAN maintain a mutually close relationship and can interact with one another in complex and multidimensional ways, which can affect flows of import and export activities of agro-food products regulated especially by international economic law. By perceiving law as a process of decisions, and particularly international law as a process of communication among different participants of the « world community », these interactions can be better identified and comprehended at all levels : multilateral, regional, bilateral and national. Considering the intensity and frequency of exchanges and the strong interdependency of today’s world, the « three sisters » and their standards, guidelines and recommendations are likely to play numerous roles in promoting a greater production and wider distribution of fundamental values that all human beings desire to maximize and achieve, as defended by the « New Haven School of International Law ». Not only are these roles related to the promotion of a more efficient process of eliminating trade barriers deriving from SPS protectionist measures, but also those which are insufficiently highlighted, yet becoming more obvious through repeated practices of ASEAN decision-makers. These are notably the roles of the « three sisters » as performance drivers for monitoring mechanisms of SPS measures with a view to ensuring that they are reasonable in each specific context and respectful towards human dignity; as catalysts of open regionalism ; as promoters of the development dimension in regional trade agreements concluded by ASEAN

Texto completo da fonteThe Algerian-European association, signed on 19 December 2001 in Brussels and enforced on 1 September 2005, represents a partnership in terms of human rights. Sett off by the Barcelona Declaration of 27 & 28 November 1995, it nowadays serves as the best model for a genuine implementation of human rights in the field of assocation agreements. Inspired by Euro-Mediterranean policy whose objective is the promotion as well as protection of human rights, as stated in the universal declaration of human rights, it affects the parties, domestic and international policies and represents and essential element in the implementation of the Algerian-European association agreement. Is there a genuine implementation of the Algerian-European association agreement in the perspective of the respect of human rights? And what are the means used for that propose?

Texto completo da fonteThe title of this thesis already conveys the idea that space cybersecurity is addressed in this research taking into consideration two main aspects: first, that space systems are critical infrastructures and thus play an important role in State security and international stability. Second, that space security, space safety and long-term sustainability of outer space activities cannot be disassociated but require a holistic approach. This thesis focuses on the problem of how international space law applies to space cybersecurity, how international law in general may fill the regulatory gaps and how the international community may address future negotiations. The research is motivated on the need to expand the global space governance taking into account current mechanisms in the United Nations on security in the use of information and communication technologies and in space security, space safety and long-term sustainability of outer space activities. On the basis of six research questions, this thesis develops the relevant arguments along its six chapters to conclude with a proposal for a resolution of the General Assembly containing principles governing space cyber activities. The proposed normative solution would be negotiated at the Committee on the Peaceful Uses of Outer Space (COPUOS) and considered jointly by the First and Fourth Committees of the General Assembly. In the course of this research, three main methods were employed: analysis of relevant international law, examination of national positions at relevant multilateral bodies and domestic/intergovernmental legal frameworks; and finally, consideration of teachings of qualified publicists. It is a qualitative study based on a selection of representative State practice and is envisaged as a multidisciplinary approach to the matter, including technological, legal and political aspects. This thesis concludes with the assessment that international space law and international law in general provide a certain legal ground to regulate space cybersecurity; thus, a set of principles adopted by the General Assembly would provide a preliminary element of guidance in the field. That solution is envisaged as an initial step in a task that needs to be progressive. Throughout this work, several issues connected to the research topic are examined but many of them remained inconclusive, either due to the lack of State practice or insufficient state of the art. Consequently, certain areas are identified at the end of this study for further research.

Texto completo da fonteThe Overseas regions, countries and territories present various statuses inherited mainly from the major European Powers which placed them in a relationship of a common interest not only with their mother countries but also with the European Union (EU).However, these territories have continuously re-built between them historical and cultural links, and weaved relationship within the entire Overseas to appear as a constituted whole while negotiating with the EU.The outermost regions (OR) apply Community Law while the Overseas Countries and territories (OCT) situated outside the territory of the Community, have Association Arrangements with the EU.Denmark, France, Netherlands, Portugal, Spain and United Kingdom have proceeded to necessary constitutional reforms to allow numerous articles amendments in respect of right to self-determination of peoples.At the light of statutory amendments and of a continuous economic and social development, the Outermost regions (OR) and the Overseas Countries and Territories (OCT), now wish to assert their rights and to defend their interests at European and International level.Globalisation of policies encourages OR and OCT to gather within International bodies. The rule of law of the related countries opens them to well-structured legal systems and to European values. The outermost geopolitical localisation makes them to have access to international relations.The purpose of this thesis is to demonstrate the interdependence between these different legal systems and the impact of European and International Law on the statutory amendments of the Overseas towards more autonomy, but also liabilities and involvement on their own development by using their regional environment, inter-regional and transnational cooperation and taking part at the works of international organisations
