On October 31, 1988, in a ceremony at the Beverly Hilton Hotel attended by Congressmen and members of the artistic community. President Reagan signed the 1988 Berne Convention implementation Act. This Act allowed the United States to join the international Berne Convention lor the Protection of Literary and Artistic Works as of March, 1989. Although the Act somewhat expands the availability of U.S. copyright protection to European atilhors, it affects U.S. authors' rights even less, practically speaking. Perhaps that explains why only three major U.S. daily newspapers, The New York Times, The Washington Post, and Los Angeles Times, briefly mentioned this historic moment for the internal ional copyright environment. This article explores why and how the U.S. has joined the Berne Convention after more than 102 years, and the effect that this will have un the availability of U.S. copyright protection to foreign authors. Before considering the technical consequences of the Berne Convention Implementation Act, we give a brief overview of two relevant international copyright treaties and their major differences.

On 30 November 1978 thousands of people from across the United States took part in “Justice for J. P. Stevens' Workers Day.” In seventy-four cities activities such as rallies, marches, press conferences, film premieres, and leafleting were held in support of a union boycott against a giant textile company that had persistently shown its willingness to violate the law rather than recognize its workers' right to organize. In New York City more than 3000 demonstrators marched in front of the company's midtown headquarters as part of the nationwide day of protest that was endorsed by Governor Hugh L. Carey and the City Council. In Los Angeles hundreds of trade unionists and their supporters rallied in front of City Hall, while in Indianapolis protesters gathered at the local Hilton Hotel for a “hard times luncheon” of ham and beans that was designed to express solidarity with the company's low-paid workers. Finding that the hotel's table cloths were made by Stevens, enraged protesters ripped the fabrics from the tables and dumped them in a pile on the floor. Activities were also held in many smaller cities; in Albany, New York, for example, a rally was addressed by Secretary of State and Lieutenant Governor-elect Mario Cuomo, who told consumers “to shun the products of J. P. Stevens as you would shun the fruit of an unholy tree.” Across the country, protesters carried signs urging consumers to steer clear of the company's sheets, a staple part of its textile business.

As COVID-19 spreads, an increasing number of industries have become stagnant, especially the hotel industry. Considering safety hazards, lots of hotel employees tend to make a career change. Therefore, the labor shortage and rising operating costs of human resources have gradually become the major issues for the hotel industry under the pandemic. In this circumstance, it is of great significance for the human resource department to think about how to adjust the hotel business strategy, optimize the management structure and reduce labor costs. Taking the renown Hilton Hotel as an example, this paper describes how the hotel should adopt human resources strategies to effectively cope with the crisis brought by COVID-19 and seize new development opportunities in this context. Hilton Hotels is working hard to ensure guaranteed quality of service during the pandemic, lowering corporate labor costs, and earning higher profits.The specific practice is to improve employee satisfaction, launch new employment mode, use artificial intelligence and so on.

Year after year, the best hotel chains in the world compete. improving their hospitality and service levels to meet the needs and anticipate the desires of consumers. This paper explores the evolution of world famous hotel brands from their inception as well as role brand differentiation in their success. The absolute leaders in the hotel business are Marriott and Hilton, which are fierce competitors. One of the key components that ensured the success of these two companies is the brand and the work of companies to strengthen it. Although Marriott and Hilton faced many challenges due to the COVID-19 pandemic in 2019, in particular a decrease in the number of customers and financial losses, companies are gradually recovering to the previous level. Both Hilton and Marriott are implementing strategies to expand business in different countries, as well as to integrate new technologies into their work. Due to the findings of the study, it is possible to understand how the world's companies deal with weaknesses and threats in business, as well as what strengths and opportunities make it possible to achieve success in the highly competitive area of the hotel business.

The article considers aspects of the tourism activity development. The scientific papers pay significant attention to development of tourism through the formation of tourism clusters and tourist destinations. Formation and development of tourist destinations is impossible without the hospitality sector. Hospitality is one of the important conditions for the formation of a tourist destination. Currently there is a high competition in the hospitality industry. During the 2015-2016 it is planned to open 20 hotels of international hotel chains (Marriott, Ibis, Hilton, Hyatt, Radisson, Novotel) with the average payback period of 5-6 years. The article presents the results of applying the additional services in accommodation facilities, which have been named the best in the competition "The best Russian hotels in 2015 (on guest reviews)" – Lotte Hotel Moscow, Hyatt Regency Yekaterinburg, Hotel « Hermitage», Ramada Kazan City Centre, Four Seasons Hotel Lion Palace, Domina Prestige, Radisson Hotel, Pushka Inn Hotel, Swissotel Krasnye Holmy, Ararat Park Hyatt, Resort «Tsargrad», guest house "Alexander House”, boarding house Assembly, Mercure Moscow Baumanskaya. Additional services in these accommodation facilities have two features: they are not differentiated and are no innovative. According to the research, the authors propose to classify the hotel services by the number of satisfied requirements. The authors also represent two new hotel services and demonstrate the economic feasibility of the application of innovation.

Daily hotel data are employed, along with information on prices, revenue, demand and hotel occupancy, to analyze part of the local economic impact of the annual New York City (NYC) Marathon. As the largest competitive race in the world, the marathon attracts domestic and international competitors and spectators. The cancellation of the 2012 marathon due to Hurricane Sandy was estimated to lead to an increase of 4000 hotel nights as well as a 10% increase in the average daily room rate. Taken together, this is associated with a USD 3 million increase in hotel revenue. The results suggest a significantly lower local economic impact of the race than previously thought.

The Hilton Hotel in Whittier, California is an eight story reinforced hollow unit concrete masonry building. It experienced a peak ground acceleration of approximately sixty percent gravity without visible structural damage. This paper performs an analysis of the building from two perspectives. The first is a structural engineering design perspective using the structural mechanics assumptions consistent with the new strength design criteria for hollow unit shear walls in the 1988 UBC and a response spectra analysis. The second perspective is based on a nonlinear lumped parameter time history model and a step-by-step time history analysis.

The hotel sector of the travel industry is the leader according to the indicator of economic growth, which is observed in both developed and developing countries. Even under the economic instability and global natural disasters, the industry has seen growth in recent years. The franchising model for expanding activities is central to all successful hotel chains.The article deals with the franchising model for the travel business expansion and the economic performance of hotel chains such as Marriott International, Wyndham Hotels, and Hilton. They hold a prominent place in the global hotel business, have a steady tendency to expand their business, hold high positions in the ranking of the best franchises in the world and have been recognized by experts.The main risks for the franchisor and franchisee are determined when making a decision on the expansion of the international travel business, which must be taken into account when developing new markets for hotel chains. The main advantages of the franchising model of expansion, which promote understanding between the parties of the franchise agreement, dynamicize hotel chains expansion and allow for reducing their expenses and increasing incomes.It was found that the growth of net profit and total income in the indicated hotel chains was due to the increase in the number of rooms in franchising and the positive dynamics of franchise income. A more dynamic pace occurred after the crisis growth in revenues from the franchisee compared with the managerial model. A closer relationship between revenues and key financial indicators has been proved when using a franchising model.

In the decades following the war, the spread of international luxury chain hotels was instrumental in shaping the global image of modernity. It was not simply the export of modernist architecture as a style, but rather a process which brought about an overall transformation of the industry and culture surrounding modern domesticity. For Adelaide, well before the arrival of large brand hotel chains like Hilton and Hyatt, this process was initiated by the construction of its first international style hotel in 1960 – Australia Hotel. The proposed paper traces the history of this structure and its impact not only on local design and construction industries but also on domestic culture and lifestyle after the shadow period of recovery after the war. This paper looks at three specific enduring legacies of this structure that went well beyond the modernist aesthetics employed by its original designers, the local firm of Lucas, Parker and Partners. The hotel was one of the first to employ the new technology of lift-slab construction and was recognised by the Head of Architecture at the University of Adelaide, Professor Jensen, as the outstanding building of 1960. It is argued that it was the engagement with such technological and process innovations that has allowed the building to endure through several renovation attempts. In her study of Hilton International hotels, Annabelle Wharton argues how architecture was used for America’s expansion to global economic and political power. Following on from her arguments, this paper explores the implications of the acquisition of the Australia Hotel by the Indian hotel chain Oberoi Hotels in the late 1970s when it became Oberoi Adelaide. The patronage of Indian hotelier Mohan Singh Oberoi came alongside the parallel acquisition of Hotel Windsor in Melbourne, heralding a new era of engagement with Asia. Finally, the paper also highlights the broader impact of this hotel, as a leisure venue for the burgeoning middle class, on the evolving domestic culture of Adelaide.

<p>In 2003, a major collapse occurred during construction of a parking garage at the Tropicana Hotel in Atlantic City, New Jersey. It resulted in four fatalities, dozens of injured workers, and significant delays to the construction project. The legal matter was eventually settled out of court, reportedly for $100 million US dollars.</p><p>The author led the structural investigation into the collapse on behalf of the General Contractor. The investigation included numerous site visits, preservation of structural evidence, review of design drawings and contractor’s shop drawings, structural analyses, and litigation support.</p><p>The concrete parking garage was being constructed with a proprietary structural floor system, which involved “stay‐in‐place” precast concrete forms that became composite with the cast‐in‐place concrete slabs and wide beams.</p><p>The investigation presented significant challenges due to the intertwined design responsibilities for the system, the difficulty of preserving perishable evidence during the demolition of the unstable structure, the high‐profile nature of the collapse, and the diverse interests of the many involved parties.</p><p>The matter settled out of court, so the results of technical investigations and the lessons learned have not been widely disseminated previously.</p><p>This paper will describe the engineering investigation and findings, discuss the roles and responsibilities of the designers and others, and present recommendations to reduce future failures of similarly organized projects.</p>

Rhetorical theorist Sonja Foss introduced a theory of visual rhetoric in 1971 (Foss,2004). Aligning Applied Human Factors Engineering (AHFE) with visual rhetoric can provide the field of UX with a deeper understanding of how a design can impact the effective performance and usability of products. According to Foss, visual objects are not inherently rhetorical, but when they are organized to express symbolic action, allow for human intervention, and target a specific audience, these visual systems gain rhetorical significance (Foss, 2004). All the various user interfaces (UI) that humans interact with day to day include attempts by a user experience (UX) designer to "guide" the user to the proven, most effective, lowest-risk means of accomplishing a specific goal. Aligning user experience (UX) with the principles of rhetorical theory establishes an important facet through which the designer can understand why a UI design fails or succeeds. Aristotle taught that the speaker accomplishes persuasion accomplished by appealing to the three pillars of rhetoric: logos (appealing to logic), pathos (appealing to emotions), and ethos (appealing from authority).Similarly, Don Norman stated (2013), "Cognition provides understanding, and emotion provides value judgement." Norman also discussed (2003) that trust in the UI is damaged when UI doesn't meet these cognitive and emotional expectations. Consider an experience many Americans have in common, staying overnight in a hotel. Every hotel works similarly, understood through the hotel business's well-established practices and expectations built on previous experiences. But imagine what transpires when the experience breaks convention and the unexpected happens. Incorporating rhetorical principles in design considers how users identify and communicate to others in their user group. Appealing to the users through logos, pathos, and ethos helps the designer communicate more effectively, meeting the user's needs. When these pillars work together to communicate with the user more accurately, it improves a user’s discoverability of product features, and system affordances become a pleasant, straightforward experience to enhance the usability of products. Abstract Buildings are one of the major contributors to global greenhouse gas emissions. Decarbonizing building sectors has greatly been emphasized globally. For example, New York state has an aggressive roadmap to decarbonize the building sectors by 2050. To achieve this, electrification of space heating and water heating systems is critical, and it requires energy-efficient and feasible solutions rather than electric coil heating. This study proposes a heat recovery-enabled heat pump technology (i.e., variable refrigerant flow with heat recovery (VRF-HR)) for space heating and domestic water heating and presents a feasibility study of the proposed technology to evaluate decarbonization performance. A computational model is developed to simulate the energy performance of the proposed technology. The model uses a refrigerant circuit box to control refrigerant flows between indoor and heat recovery units for simultaneous space cooling, space heating, and/or hot water generation. A case study for apartment and hotel buildings located in New York City is conducted to demonstrate the feasibility of the proposed technology for decarbonization compared to a conventional system. Building energy simulations are carried out using a whole building energy modeling tool, EnergyPlus. Based on hourly simulation results, the post-process calculation is performed to examine the energy-saving and decarbonization potential by comparing with results from a conventional natural gas-based space and domestic water heating system. Results indicate that the proposed VRF-HR system can effectively achieve building electrification and decarbonization with lowered energy consumption (i.e., about 20% of annual cooling/heating energy savings and 80% of domestic hot water energy savings). Results also show that heat recovery technologies are a remarkable addition to enable electrification and decarbonization effectively.

Los megadesarrollos turísticos de sol y playa han sido impulsados por el Banco Interamericano de Desarrollo (BID) como proyectos de estrategia de desarrollo turístico, en México nacen los Centros Integralmente Planeados (CIP´s) para dar orden urbano, descentralizando grandes inversiones turísticas principalmente de origen extranjeros. Son identificados ante la promoción turística por la inversión de insumos y tecnología. Los emplazamientos turísticos de sol y playa han crecido y destinan espacios para el hospedaje turístico temporal y permanente. Este tipo de emplazamientos destacan por ser representaciones de exclusividad, privacidad y seguridad, manifestando enclavamiento en la serie de conjuntos turísticos construidos para integrar el megadesarrollo turístico, demarcando un acceso que indica el inicio del montaje realidad-ficción, conformando el montaje de ficción, que llevan a construir una realidad a partir del imaginario. Lo sucedido fuera del montaje será considerado como realidad, al establecerse una serie de compaginaciones que fabricarán la nueva realidad, la realidad-ficción, entre representaciones de fantasía visuales, de sonidos y sobretodo de ideas por transmitir, como es lo motivante que resultan para los turistas las guías turísticas. Las representaciones son basadas en imágenes de paisajes, personas, ciudades, entre otros emblemas simbólicos. Cada espacio por destacar será retomado para enfocar el montaje en dibujos, pinturas, danzas, arquitectura, entre otras dinámicas de conquista turística, igual sucede con la reproducción de sonidos relacionados con la exclusividad, privacidad y seguridad para el turista al interior del conjunto. Toda construcción de la realidad se realiza en un espacio y un tiempo definido a partir del imaginario, ya que existe el objetivo de cautivar al visitante, dentro de una serie de montajes continuos donde será eliminada la línea de corte entre montajes, convirtiendo la ficción en realidad para el turista, el montaje correcto y el escenario indicado, señalan el orden constante de los montajes. Del trozo de imágenes fabricadas y rescatadas del ambiente natural o real, se conformara una relación argumental a través de la compaginación con la secuencia adecuada de cada una de las escenas plasmadas por el imaginario, unir y encauzar los montajes para el cumplimiento de la representación en un filme. De los ejemplos más destacados son las creaciones a partir del imaginario en los Emiratos Árabes Unidos, representados en los hoteles como torre hilton baynunah, jumeirah Beach burj al-arab, hotel w, hotel apearon island y hotel eta, los cuales exponen servicios como compras de lujo, centros spa con instalaciones exclusivas para el deporte y el tiempo libre, habitaciones equipadas, climatizadas y con lo último de la tecnología. Se distinguen los colores y las formas por resaltar ante la cultura árabe, pero es importante señalar que cada uno de esos megadesarrollos turísticos marcará su filme con esta serie de montajes, que permitirán compaginar la serie de trozos de imágenes fabricadas ante la fantasía imaginada. Los megadesarrollos turísticos se distinguen por crear escenarios turísticos a partir del imaginario, destacando el enclavamiento a través de la búsqueda del concepto de seguridad, con un marcado interés para conformar comunidades nuevas, asimismo elementos como los acceso se encuentran custodiados por personal de seguridad que indicara la bienvenida al turista, sin conocer que será guiado y vigilado por cámaras de video ocultas en la masa de la edificación, también se distinguen elementos de seguridad para la movilidad y accesibilidad al conjunto, destacando vía aérea, naval ó terrestre, el recorrido al interior marcándose bajo un escalonamiento de cota descendente a nivel de playa, mostrara cada uno de los escenarios turísticos montados para indicar el recorrido al turista al interior del conjunto turístico. They are identified before the tourist promotion by the investment of inputs and technology. The emplacements have grown and destine spaces for the tourist temporary and permanent. This type stand out for being representations of exclusivity, privacy and safety, demonstrating interlock in the series of tourist sets constructed to integrate the tourist megadevelopment, limiting an access that indicates the beginning of the montage reality - fiction, shaping the montage of fiction, that they lead to constructing a reality from the imaginary one. The happened out of the montage will be considered to be a reality, on there having be established a series of page lay-outs that will make the new reality, the reality - fiction, between visual representations of fantasy, of sounds and overcoat of ideas for transmitting, since motivation is that the tourist guides prove for the tourists. The representations are based on images of landscapes, persons, cities and symbolic emblems. The megadevelopments differ for creating tourist scenes from the imaginary one, emphasizing the interlock across the search of the safety concept, with a marked interest to shape new communities, likewise elements like them I access they are guarded by safety personnel that was indicating the welcome to the tourist, Without knowing that it will be guided and monitored by secret video cameras in the mass of the building, also safety elements are distinguished for the mobility and accessibility to the set, emphasizing airway, navally ó terrestrial, the tour to the interior being marked under an stairs of descending level to beach level, there was showing each of the tourist scenes mounted to indicate the tour to the tourist to the interior of the set.

Much of the violence, social, and racial marginalization associated with downtown urban neighborhoods in the last forty years, exacerbated post-Covid, can be traced back to histories of targeted dispossession masked as urban redevelopment during those decades. This paper examines the dynamics of dispossession, disinvestment, and displacement in the context of the Tenderloin, an under-resourced downtown area in San Francisco.It focuses on the intersection of Turk and Taylor Streets in the Tenderloin as the site of a speculative design proposal aiming to reverse the erasure of Tenderloin’s activist past and the cultures of the queer and trans people who consider it home. The intersection was the site of a queer grassroots uprising against police brutality, the Compton’s Cafeteria Riot of 1966. The riot at Compton’s was spearheaded by street youth and gender-nonconforming people and occurred three years before the Stonewall Riot in New York which typically marks the beginning of the modern LGBTQ rights movement. As such, its symbolism extends far beyond the Tenderloin. Today, the three-story building that housed Compton’s Cafeteria at street level and a residential hotel above is operated as a halfway house by GEO Group, a for-profit prison company that also operated broadly criticized children detention spaces on the US-Mexico border.At a time when advances in LGBTQ rights during the last three decades are increasingly facing political and policy obstacles nationwide, Compton’s legacy and the building’s current use demonstrate American society’s enduring perception of specific bodies, especially those of queer, transgender, and non-binary people of color, as urban interlopers. Moreover, these bodies don’t fit mainstream representations of queerness as a predominantly white, middle-class, consumerist culture.
