My lady, in composing this little book, I remembered that you bear the name of monseigneur Saint Louis, your ancestor, … and that I once composed a short treatise about him, in order to respond to those who wanted to ruin his good reputation by saying that in his time he destroyed the kingdom of France because of the two expeditions he made overseas, wishing to recover the Holy Land, and that he had been constrained to have leather money made and to impose sales taxes (gabelles) in this kingdom, which is not true, saving their reverence, as will be shown below.

Abstract We consider, in the setting of convex metric spaces, a new class of Kannan type cyclic orbital contractions, and study the existence of its best proximity points. The same problem is then discussed for relatively Kannan nonexpansive mappings, by using the concept of proximal quasi-normal structure. In this way, we extend the main results in Abkar and Gabeleh [A. Abkar and M. Gabeleh, J. Nonlin. Convex Anal. 14 (2013), 653-659].

In this paper, we introduce a semi-cyclic Berinde contraction pair on a metric space which is more general than that of semi-cyclic contraction pair defined by Gabeleh and Abkar [Gabeleh, M. and Abkar, A., Best proximity points for semi-cyclic contractive pairs in Banach spaces, Int. Math. Forum, 6 (2011), 2179–2186] and prove an existence result concerning global monomization of best proximity points of this pair. Our main result can be used to obtain a common fixed point theorem of some contractive mappings related to Berinde’s contractions without commutative assumption. An example supporting our main result is also given.

Weather radar is an active remote sensing instrument for various hydrological and meteorological applications. One advantage of weather radar is its ability to detect rainfall in space and time with high spatial resolution. However, one of the issues that contaminate radar observations is ground clutter. Ground clutter is a signal or echo from non-meteorological objects on the earth’s surface that are stationary in the time domain. Detecting and mitigating clutter effects is crucial to achieve precise weather measurements. This research aims to implement the Gabella and random forest methods to detect ground clutter in Padang weather radar data and determine the optimal method between the two. The implementation of the Gabella method for detecting ground clutter in Padang weather radar data was suboptimal. This was due to the most duplicated data at the same point being only 15.97% of the total data. Meanwhile the random forest method obtained a kappa value of 92.03%. This indicates that the random forest model created using 2000 trees as the parameter performs well. Based on these results, the random forest method identified as the most optimal approach for detecting ground clutter in Padang weather radar data.

Very recently, Abkar and Gabeleh (2013) observed that some best proximity point results under the -property can be obtained from the same results in fixed-point theory. In this paper, motivated by this mentioned work, we show that the most best proximity point results on a metric space endowed with a partial order (under the -property) can be deduced from existing fixed-point theorems in the literature. We present various model examples to illustrate this point of view.

In quasi-pseudometric spaces (not necessarily sequentially complete), we continue the research on the quasi-generalized pseudodistances. We introduce the concepts of semiquasiclosed map and contraction of Nadler type with respect to generalized pseudodistances. Next, inspired by Abkar and Gabeleh we proved new best proximity point theorem in a quasi-pseudometric space. A best proximity point theorem furnishes sufficient conditions that ascertain the existence of an optimal solution to the problem of globally minimizing the errorinf⁡{d(x,y):y∈T(x)}, and hence the existence of a consummate approximate solution to the equationT(X)=x.

We open with the question of subjectivity as it is presented in Hamlet; the focus then moves to the breakdown of subjectivity as experienced in extreme situations and clinical psychosis. Gabel’s idea of continuity from psychosis to ideology (false consciousness) is used to show that William S. Burroughs is in fact a theorist of global ideological pathology. The concept of reification allows us to combine the voices of Gabel and Burroughs. This is not a study of what has been said about Burroughs or Shakespeare, our concern is with the future of the City, not the nature of the finger that points towards it. The cycle of “William & William” refers to the birth and destruction of subjectivity as defined by “conditions such as these”.

The first mentions of the nuns of St. Clare in Kotor date from the fourth decade of the 14th century. Their position in that commune improved in the second half of that century. In December 1364, at the request of the Kotor authorities, Pope Urban V asked the Bishop of Kotor, Dujmo II, to restore the former Benedictine monastery due to the needs of the nuns St. Clare. In the presence of the highest authorities of Kotor, on October 10th, 1365, a document on this legal action was issued. It is preserved in a transcript in the manuscript collection II b 21, held in the manuscript department of the Archives of the Croatian Academy of Sciences and Arts in Zagreb. The document contained the act of assigning the monastery to the Clarisses, prescribing the income which was given on that occasion to the monastery of St. Clare, as well as the appointment of Clare of Foro Julius as its first nun. Part of the transferred revenues consisted of communal revenues from fish market customs duties. The second part of the donation consisted of revenues in the amount of two hundred perpers, half of which came from the butcher's slaughterhouse, and the other half from customs revenue on wine. Customs officers or gabellers, ie persons who leased the mentioned revenues, were obliged to take care of the collection of those revenues. Revenues that the monastery of St. Clare received in October 1365 and are mentioned during the 15th century. Dukal of October 15th, 1447, says that the Venetian authorities after Kotor accepted their rule, recognized the right of the nuns of St. Clare on the said revenues. However, Kotor municipal authorities have occasionally challenged the right to collect assigned revenues, as well as the right to elect procurators themselves. That is why the nuns complained to the Venetian authorities, who ordered the Kotor authorities to allow them to enjoy the allocated income and the right to elect procurators themselves. The problem of paying the income from the fish market to the Clarisses was also present at the end of the 15th century, and Venetian authorities had to intervene.

Abstract Purpose: The economic evaluation reports the incremental cost utility ratio and budget impact of APBI vs standard external beam WBI for the treatment of post-menopausal women with early stage breast cancer. Methods and materials: We compared 488 women in the standard arm (1 fraction per day delivered 5 days per week over 3 or 6/6.5 weeks) to 490 women in the ABPI arm (ten fractions delivered twice per day over one week). We took the perspective of the healthcare system, a 3-year time horizon; the outcomes were quality adjusted life years (QALYs). QALYs were calculated from the EQ5D5L questionnaires at baseline, 3 months, 6 months, 12 months and yearly after irradiation; scores were converted into utilities using the French value set and QALYs computed with the area under the curve approach. Measures of within-trial use of hospital resources were based on routine hospital data via patient-level information. We used the itemized and DRG cost data from each individual patient. Transportation costs were added in a sensitivity analysis. A 2.5% discount rate was applied to costs and QALYs. An incremental analysis with differences in costs and QALYs was performed to calculate the cost utility ratio. Bootstrapping was used to quantify uncertainty on the joint distribution of costs and outcomes, and 1,000 paired estimates of mean differential costs and QALYs were reported on a cost-effectiveness plane. A budget impact analysis based on incidence of breast cancer estimates was added. All analyses followed the intent to treat principle. Results: Cost and utilities were available for the entire population. Costs and QALY results are presented in table 1. The 2 925 € (95% IC, -3 364 €; - 2 452 €) significant difference in total costs favoring ABPI was driven by the difference in radiotherapy costs and partly by lower transportation costs. No significant difference was found in QALYs. Figure 1 shows the uncertainty of the joint distribution of costs and QALYs. The uptake of ABPI for 16% of these women would result in a 16 million€ cost saving. Abstract Mutation-associated neoantigens (MANAs) are exquisitely cancer-specific therapeutic targets. However, MANAs are present at ultra-low densities on the cancer cell surface (as few as 1-2 copies per cell), leading to the challenge of eliciting a sufficiently robust therapeutic effect. We combined components of both T cell receptors (TCRs) and chimeric antigen receptors (CARs) to create a new receptor with improved potency against an ultra-low-density MANA. From CARs, we utilized the antibody-based antigen recognition domain (i.e. the single chain variable fragment, scFv) and the integrated co-stimulation that amplifies T cell activation. From TCRs, we utilized the multi-chain signaling platform that facilitates high antigen sensitivity. This new receptor, termed a TCR Embedded ScFv for Long-term Activation (TESLA), showed promising characteristics when tested with the H2-scFv which targets the p53 R175H mutation presented on HLA-A*02:01 (R175H/A2). Using CRISPR-based homology directed repair in primary human T cells, we tested 15 configurations of appending the H2-scFv to subunits of the TCR complex to identify a design that maximized T cell cytotoxicity and interferon gamma release in co-cultures with cancer cells expressing endogenous levels of the R175H/A2 antigen. In this system, we showed that the optimal TCR-embedded configuration of the H2-scFv produced similar levels of cytotoxicity and interferon gamma secretion as patient-derived TCRs targeting the same R175H/A2 MANA, while conventional H2-CARs were unable to produce any T-cell activation. We then used a multiple stimulation co-culture system to identify a co-stimulation domain combination (MyD88 and CD40) that improved serial cytotoxicity and proliferation of H2-TESLAs when incorporated on the intracellular side of the TCRbeta chain. Finally, we compared the H2-TESLA receptor to patient-derived TCRs modified with the same MyD88 and CD40 co-stimulation domains. In vivo, H2-TESLAs cured all mice in a tumor model, while co-stimulation-modified TCRs produced only temporary tumor control. Moreover, in vivo, H2-TESLAs elicited 100-fold greater T cell expansion than co-stimulation-modified TCRs. In conclusion, we demonstrated that by combining aspects of both CARs and TCRs, the TESLA receptor improved T cell reactivity against an ultra-low-density neoantigen compared to conventional CARs and patient-derived TCRs. The Contract Disputes Act of 1978 (“CDA”) governs disputes “relating to a contract” between federal executive agencies and contractors. It establishes the process for parties to seek administrative remedies for claims under covered contracts. It also limits the right to judicial review of agency decisions to specific “boards of contract appeals” (“BCA”) and the United States Court of Federal Claims (“COFC”). According to the CDA’s sponsors, Congress enacted the law to bring reliability and order to a hodgepodge of conflicting and inconsistent rules for adjudicating contract disputes used by the various executive agencies. The law aimed to simplify the process for resolving agency-contractor disputes in light of the growing complexities and importance of Government procurement programs. In introducing the bill, its primary sponsor underscored the need for an efficient adjudicatory process in which both Government agencies and the contracting industries had confidence: One cannot dispute the almost universal expressions of industry and the practicing bar that the system needs change. A good remedies system is a major element in good procurement, and a good system depends not only on fairness and justice, but also on whether the people who are subject to the system believe it is fair and just. In some respects, the CDA fell short of providing a comprehensive framework for Government contract dispute resolution and its stated aim to “provide to the fullest extent practicable, informal, expeditious, and inexpensive resolution of disputes.” In particular, the Act did not prescribe any period of time for a party to submit an administrative claim for monetary or other relief after occurrence of the breach or other injury. After sixteen years and many complaints from both Government agencies and contractors about dealing with stale claims, Congress finally adopted a CDA limitations period as part of the Federal Acquisition Streamlining Act of 1994 (“FASA”). That statute of limitations, now codified at 41 U.S.C. §7103(a) (4), provides: Each claim by a contractor against the Federal Government relating to a contract and each claim by the Federal Government against a contractor relating to a contract shall be submitted within 6 years after the accrual of the claim. Decisions by BCAs and Federal Circuit courts under the CDA statute of limitations were relatively rare in the several years following the amendment. Since the early 2010s, however, the number of cases has skyrocketed. This spike in limitations disputes undoubtedly is attributable to the massive increase in military procurement following September 11, including unprecedented spending for goods and services in Afghanistan, Iraq, and other conflict zones. The sheer volume of defense contracts and contractual activity often made it difficult for the parties to recognize and submit claims within six years of the occurrence of the underlying facts. In a relatively short period of time, the tribunals with jurisdiction over defense contract litigation had to decide a large number of limitations disputes with little guidance from direct precedent or legislative or regulatory history. These circumstances have led to case law that is not always consistent in analysis or reconcilable in outcome. Part I of this Article provides an overview of the architecture and key features of the CDA. Part II examines the salient legislative and regulatory history surrounding the adoption of the CDA statute of limitations. Part III discusses when a CDA claim “accrues” and triggers the six-year time period for submitting a claim. In Part IV, we review some of the major issues that arise under the statute in significant and recurrent types of contractor-agency disputes. Part V concludes with a brief evaluation of whether the CDA statute measures up to the “long tradition of judicial authority to formulate rules ensuring fair and predictable enforcement of statutes of limitations.” Increasing litigation about limitations periods are challenging CDA tribunals to develop coherent and consistent criteria for parties to determine when the six-year period begins to run on their potential claims. Arguably, the trial judges have made that challenge more difficult by attempting to impose precedent under the Tucker Act’s non- discovery-accrual standard on FAR 31.201’s “discovery” rule language. That challenge has been compounded by a general tendency of the BCAs and COFCs to find that claims do not accrue until the claimant possesses the information on which the claim is based. It is reasonable to conclude that the decisional law has not matured to the ideal, and perhaps, idealistic, state of consisting of “rules ensuring fair and predictable enforcement of statutes of limitations.” It may also be observed that, despite the FAR Council’s express intent and “knew or should have known” definition of “accrual” in FAR 33.201, the decisional law to date has not developed or applied typical discovery rule analysis in examining the facts of the cases or in judgments whether claims are timely or untimely. With rare exception, the decisions have not dismissed as untimely claims based on when a claimant “should have known” or been aware of the relevant facts where the claimant did not have actual knowledge or possess the information showing that it had a claim. As a result, the precedent offers virtually no guidance on issues traditionally fundamental to a “reasonably should have learned” analysis, which include the following: (1) What information is sufficient to put a claimant on “notice”? (2) Does “notice” itself trigger the period (as Gray suggests), or does the statute initiate when a diligent claimant discovers the facts, or reasonably would have discovered the facts? (3) When and under what circumstances does a claimant have an affirmative duty to make a reasonable inquiry aimed towards “discovery” of potential claims? (4) When and under what circumstances may a claimant rely on the other party’s contractual duties to provide information in deter- mining the nature and extent of any “diligence” expected of the claimant? On a more fundamental level, however, the cases have never ad- dressed whether the FAR’s discovery rule definition of “accrual” appropriately serves as controlling over the definition of the otherwise undefined term “accrual” in section 7103(4)(a) of the CDA. The FAR Council undertook to define the word “accrue” in Section 4(a) pursuant to its general authority to promulgate regulations “as may be necessary to implement this Act,” and not in response to any specific delegation. The failure to examine whether the FAR Council’s adoption of its definition of “accrue” is sufficient under the recent Supreme Court decision relating to proper construction of statutory limitations provisions and, separately, deference to federal agencies in implementing regulations, raises questions of whether any “discovery rule” should apply in CDA statute of limitations cases. In several recent cases, the Supreme Court has sent a strong signal that the courts should not “graft” a “discovery rule” on the term “accrues” or the like in a federal statute of limitations absent “textual, historical, or equitable reasons” to do so. In Gabelli v. SEC, the SEC in 2008 filed a civil enforcement action against defendants for securities law violations between 1999 and 2002 and sought civil penalties, which are subject to a statute of limitations that require an action to be brought “within five years from the date when the claim first accrued.” The SEC argued that the statute is subject to a “discovery rule,” delaying accrual until it discovered or “could have been discovered with reasonable diligence.” The Court rejected that argument: “In common parlance a right accrues when it comes into existence . . . .” . . . Thus the “standard rule” is that a claim accrues “when the plaintiff has a complete and present cause of action.” . . . That rule has governed since the 1830’s when the predecessor to §2462 was enacted. . . . And that definition appears in dictionaries from the 19th century up until today. See, e.g., 1 A. Burrill, A Law Dictionary and Glossary 17 (1850) (“an action accrues when the plaintiff has a right to commence it”); Black’s Law Dictionary 23 (9th ed. 2009) (defining “accrue” as “[t]o come into existence as an enforce- able claim or right”). The Court added: “[T]he cases in which ‘a statute of limitation may be suspended by causes not mentioned in the statute itself . . . are very limited in character, and are to be admitted with great caution; other- wise the court would make the law instead of administering it.’” At a minimum, the CDA forums will need to address, if and when any litigant raises the question, whether “accrues” in section 7103(a) (4) (A) means (1) when the claimant “knew or should have known” of the cause, or (2) in light of Gabelli and other recent precedent, when the claimant “has a complete and present cause of action” regardless of the claimant’s state of mind. In this regard, while the FAR Council and the CDA forums have relied significantly on Tucker Act precedent, neither appears to have considered that, as in the CDA, the Tucker Act does not define “accrue,” and since its enactment, the federal courts consistently have construed “accrue” in the Tucker Act to mean the date when “when all the events have occurred which fix the alleged liability of the United States and entitle the claimant to institute an action.” The Supreme Court, moreover, recently clarified that under the Chevron deference analysis, “deference is not due [a regulatory definition of a statutory term] unless a ‘court, employing traditional tools of statutory construction,’ is left with an unresolved ambiguity. . . . Where . . . the canons supply an answer, ‘Chevron leaves the stage.’” Notably, there is no indication in the record that the FAR Council determined that the CDA statute’s use of “accrue” was “ambiguous,” or adopted its “discovery” definition standard to clarify an ambiguity. On the contrary, it noted the “discovery requirement must remain,” notwithstanding little support and much objection among commentators, because “many pricing defect cases have their original events at the beginning of the contract or on contract award, but often cannot be discovered by the Government until years later.” The CDA forum’s “discovery” rule, and the CDA forum’s default use of that definition, may be vulnerable in light of Gabelli, a growing hostility to Chevron deference, and the regulatory record.

Abstract Purpose: The aim of current analyses is to report toxicity and cosmetic outcomes at 3 and up to 9 years of follow-up of post-menopausal patients randomized to receive either standard external beam whole breast radiotherapy (WBI), including hypofractionated options, versus accelerated partial breast irradiation (APBI). Methods and materials: From December 2010 to July 2015, 1006 patients were enrolled in 34 French centers (503 in each arm). Among the whole population, 28 patients who did not meet the final selection criteria or withdrew consent were excluded leading to a modified intention to treat analysis dataset of 978 patients (WBI: n=488; APBI: n=490). Median age (65y) and tumor stage pT1 (99%) rates were similar in both arms. Patients had conservative surgery with clip placement in the tumor bed. Clear margins (> 2mm) were observed in 99% of the patients. In both arms, 96-97% of the patients had negative sentinel lymph node biopsy (SLNB; median number: 4 in WBI arm and 5 in APBI), luminal BC. Ductal histology was observed 82%. Only 2% and 1% of patients had grade III and pN(i+) disease. The median time interval between surgery and radiotherapy was 57d in WBI vs 62d in APBI. WBI schedules consisted of: 50Gy in 25fr + 16Gy boost (n=212) or 40Gy in 15fr (n=156) or 42.5Gy in 16fr (n=120), while APBI arm consisted of 38.5Gy or 40Gy in 10fr. Overall, 94 patients from the APBI arm finally received standard WBI. For statistical considerations, SHARE trial, sponsored by UNICANCER (NCT01247233) is a non-inferiority randomized controlled trial comparing APBI versus WBI in terms of local control as primary objective. Secondary endpoints were severe toxicity (NCI-CTCAE v4 grade ≥ 2), and cosmetic results, evaluated by doctors and by patients, over the entire follow-up. For both outcomes, we estimated the cumulative incidences (CI) using Kalbfleish and Prentice method, considering disease relapse, secondary cancer or death as competing events. Treatment effect (APBI vs WBI) was estimated by cause-specific Hazard Ratios (cs-HR) from Cox models adjusted on stratification factors. Results: Median follow-up was 5.8y (range, 0.13-9.5). The number of deaths was 27, and the number of local relapses was 8. Among the 978 patients, 582 and 396 had finally WBI and APBI, respectively. The rates of post-operative hematoma, edema and infection were low: 8-9%, 2%, 3-2%, respectively. When considering any type of severe toxicity, we observed a significant reduction rate in APBI compared to WBI: cs-HR=0.73 (95% confidence interval: 0.61-0.88); p=0.001, and 3-year cumulative incidence (CI) of severe toxicity at 45% (41-49) in WBI vs 36% (32-40) in APBI arm. The difference was also in favor of APBI when considering breast skin toxicity alone: cs-HR=0.55 (0.44-0.70), p< 0.001 and 3-year CI at 36% (32-40) in WBI vs 21% (18-25) in APBI arm. Conversely, for breast other toxicities, WBI was found less toxic than APBI: cs-HR= 2.10 (1.51-2.91), p< 0.001, and 3-year CI at 8% (5-10) vs 15% (12-19), respectively. When considering cosmetic results according to the investigator, we observed no significant difference between the two arms: cs-HR=1.04 (0.81-1.33), p=0.26 and 3-year probability of remaining with good to excellent cosmetic results at 77% (73-81) in WBI arm and 78% (74-81) in APBI arm. Findings were similar when considering results according to the patient: cs-HR=1.07 (0.85-1.37), p=0.23, and 3-year probability at 74% (70-78) and 75% (70-79), respectively. Conclusions Historically SHARE is the first APBI trial that included hypofractionated schedules in the standard arm. We reported increased risk of severe toxicity and skin breast toxicity in standard arm as compared with APBI arm without any difference in terms of cosmetic results. Longer follow-up is needed. This paper presents that the opto-electrical characteristic of a typical CCD based digital camera is nonlinear. It means that digital electric signal of the camera's CCD detector - is not a linear function of the luminance value on camera's lens. The opto-electrical characteristic feature of a digital camera needs to be transformed into a linear function if this camera is to be used as a luminance distribution measurement device known as Imaging Luminance Measurement Device (ILMD). The article presents the methodology for obtaining the opto-electrical characteristic feature of a typical CCD digital camera and focuses on the non- linearity correction method.
