Resumo:
We get the introduction of the freedoms provided in the Indian Constitution in the preamble itself. Five types of freedoms have been provided in the preamble, freedom of thought, expression, belief, religion and worship. In these also the main part of our study is the freedom of the press. Which is freedom of expression in the constitution i.e. Anu. contained in Part 1 of 19 itself. The press is considered as the fourth pillar of the constitution because the freedom of the press is especially important in the strengthening of democracy. For this reason, the press and its freedom have a history of their own. Various episodes have been published in protest against the ban on the press, from John Milton's Aropagitica to modern writings. Seeing the tarnished image of the media in modern times due to the ban on the Bengal Gazette (the first newspaper) published in India too, it can be easily guessed that how relevant is the protection of the freedom of the press. The paper also aims to study the actual status of press freedom in India. Abstract in Hindi Language: भारतीय संविधान में प्रदत्त की गई स्वतंत्रताओं का परिचय तो हमें प्रस्तावना में ही प्राप्त हो जाता है प्रस्तावना में पांच प्रकार की स्वतंत्रताए प्रदान की गई है विचार, अभिव्यक्ति, विश्वास धर्म और उपासना की स्वतंत्रता। इनमें भी हमारे अध्ययन का प्रमुख भाग है प्रेस की स्वतंत्रता। जो कि संविधान में अभिव्यक्ति को स्वतंत्रता अर्थात अनु. 19 के भाग 1 में ही निहित है। प्रेस को संविधान का चैथा स्तंभ इसीलिए समझा जाता है क्योंकि लोकतंत्र के सुदृढ़ीकरण में प्रेस की स्वतंत्रता का विशेष रूप से महत्व है। इसी कारण प्रेस का एवं इसकी स्वतंत्रता का अपना एक इतिहास रहा है। प्रेस पर लगाए गये प्रतिबंध के विरोध में जाॅन मिल्टन की Aropagitica से लेकर आधुनिक लेख तक विभिन्न प्रकरण प्रकाशित हुए हैं। भारत में भी प्रकाशित बंगाल गजट (प्रथम समाचार पत्र) पर प्रतिबंध से आधुनिक समय में मीडिया की धुमिल होती छवि देखकर सहज ही अनुमान लगाया जा सकता है कि प्रेस की स्वतंत्रता की सुरक्षा कितनी प्रासांगिक है। पेपर का उद्देश्य भी भारत में प्रेस की स्वतंत्रता की वास्तविक स्थिति को अध्ययन करना है। Keywords: प्रेस, संविधान, स्वतंत्रता अभिव्यक्ति, अनुच्छेद 19, विश्लेषण

Abstract The relationship between press freedom and representative democracy has captured the interest of philosophers and constitutional law scholars for centuries. John Charney’s The Illusion of the Free Press argues that the truth-seeking justification for expressive freedoms can alone explain the continuing importance of a free press to contemporary democracies. This review essay examines two rebuttals to this argument. First, adopting a more modern ‘process-relational’ philosophy reveals that Charney’s epistemological ‘illusion’ is itself based on misconceptions. Secondly, the author’s incomplete use of democratic theory precludes a more convincing explanation based on marginalised notions of horizontal accountability and the checking function of the press.

The freedom of the press is one of the basic guarantees of a democratic state and, at the same time, a guarantee of political rights. After 2008, when the great financial crisis occurred, the Member States of the European Union began to significantly limit the rights and freedoms of citizens, including freedom of the press. The introduced restrictions are characteristic of a neo-militant democracy. However, they sometimes become a tool in the hands of antidemocrats. The aim of the article is to check how and why over the years, between successive crises, i.e., financial crisis, the so-called refugee crisis, the coronavirus pandemic, freedom of the press was restricted in Ireland and Great Britain. These are the countries in which initially the political and social effects of the economic crisis were not felt, but later rapid regression was observed. By using content analysis based on reports from the Reporters without Borders and Freedom House organizations, the study uncovers how and why the restrictions of freedom of the press changed. It locates the political structures of Ireland and Great Britain between the ideal types of neo- and quasi-militant democracy, depending on the goal of the restrictions. The research hypothesis is as follows: The restriction of freedom of the press in Ireland and the United Kingdom after 2008 shows that states are using the media system to pursue their particular interests by introducing solutions characteristic of quasi-militant democracies.

The sample for this study comprises of 495 stocks listed in Bursa Malaysia, covering the sampling period from 2003 to 2013. The model applied in this study employed the pooled ordinary least square regression estimation. In addition, the robustness of the model is tested by using firm size as a controlled variable. The findings show that market beta as well as the economic and press freedom indices could explain the cross-sectional stock returns of the Malaysian stock market. By controlling the firm size, it adds marginally to the explanation of the extended CAP model which incorporated economic, political, and press freedom indices

Freedom of speech, press, assembly, and petition have long been celebrated as crucial to democratic government. (I will often refer to these rights collectively as ‘freedom of expression’ or as ‘freedom of speech’.) United States Supreme Court decisions have, quite rightly, justified strong protection of these freedoms because of their crucial role in the functioning of American democracy. (Of course, there are other justifications as well, but I will not discuss them in this paper.)

AbstractCan foreign aid help free the press? Aid may boost press freedom by incentivizing government to reduce media regulations and provide financial support for infrastructure. Alternatively, foreign aid may prevent press freedom by expanding the role of the state and promoting government over private enterprises. We contend that the magnitude of foreign aid's influence is conditional on the existence of democratic checks. Using panel data from 1994 to 2010, we find evidence suggesting that aid significantly increases press freedom in democracies but insignificantly relates to press freedom in autocracies. Collectively, the results suggest that a standard deviation increase in aid to a country at the mean level of democracy increases press freedom by approximately a 1/20th standard deviation. Overall, the findings suggest that donors should be cautious as most aid recipients are not democratic and aid leads to only relatively small marginal improvements in press freedom.

This study gauged how superintendents of six states view student press freedom. This study focused on two sets of superintendents. In one set, the superintendents were in states that had passed student freedom laws. The second set of superintendents were in states that had no freedom laws, meaning school administrators had the right to censor school publications. The data strongly suggests that superintendents in states with freedom laws were less likely to favor censorship. However, both sets of superintendents appeared to favor administrative control.

Servo presses are notably developed and studied nowadays out of their flexible ram motion. In practice, press users can advantageously utilize a single servo press to deal with different stamping operations such as blanking, drawing, coining, embossing, etc. In this paper, a hybrid-driven servo press mechanism is studied. The mechanism for such servo presses is a seven-bar linkage whose degree of freedom (DOF) is “2”. Two input links of the press mechanism are driven by one normal constant-speed motor and one servo variant-speed motor respectively. The dimensional synthesis of the press mechanism that is based on an analytical method is proposed. The motion function of the servomotor that generated a specified ram motion is derived by kinematic analysis. A design example is illustrated, and it shows that one could apply the proposed method to design a hybrid-driven press mechanism capable of carrying out various ram motions. This work contributes to press mechanism designers a method of dimensional synthesis. The ram motion flexibility of the servo press is achieved, and this provides significant benefit to improve the performance of any different kind of stamping operations.

In this paper, the author starts from the thesis that freedom of expression, which is best reflected in freedom of the press, as the central public media of the time, was a clear indicator of the level of development of the newly created Yugoslav society. The press in the Kingdom of Serbs, Croats and Slovenes was a clear example of existing social antagonisms. Although the Vidovdan Constitution paid attention to this fundamental human freedom, classifying it as a political right of citizens, the manner of its regulation and practical application indicated limitations, immaturity and unwillingness of society to face its own weaknesses, ie the weaknesses of the ruling establishment, but also all important political factors. According to the letter of the constitution, freedom of the press is guaranteed, but with restrictions. These restrictions, such as the possibility of introducing censorship in cases provided by law, clearly raised the question of whether the existence of freedom of expression could be discussed at all in this period. The enjoyment of freedom of the press was concretized by a later law which found a foothold in the Constitution. Historical facts most faithfully reflect the situation in this area, but also the importance of the issue, through reflection on everyday political, cultural, educational, economic and social relations. After 100 years, the violation of freedom of the press is referred to as a violation of media freedom, which means that restrictions and violations of the rules have not been eradicated, but only shaped into new terminology, ie a new appearance.

Abstract An experimental verification of a new linearized two-degree of freedom model of a press feed mechanism, which is presented in a companion paper (Xu and Lowen, 1994), is given. An associated parametric study shows insights pertaining to the relationship between the system and component frequencies and allows the formulation of certain design rules regarding the magnitudes of the coupler and clutch windup angle deflections.

Abstract A new linearized two degree of freedom model of an industrial press feed mechanism, containing an RSSR linkage, a bent coupler, an overrunning sprag clutch, a feed strip and a brake, is presented. By introducing a double cantilever model of the coupler with an assumed quarter sine shape function, simplifying certain terms of secondary importance and replacing the non-linear clutch spring by a linear torsional spring with a deflection dependent stiffness, it was possible to develop a set of two linear differential equations for the all important feed stroke, which could be fully solved in an analytic manner for the dynamic responses of the coupler strain and the clutch windup angle.

The article is dedicated to the scope of protection of the right of public figure to its own image in conjunction with the freedom of press. Since the approaches to the matter in hand differ not only between US and Europe, but also amongst the EU countries, there is systemic inconsistency regarding the right of publicity (publicity right) and the right to personality (personality right). Latvia needs to introduce appropriate legal term analogical to publicity right, which describes the right of an individual be protected against unauthorised use of person’s likeness (photo or video) with a commercial or an otherwise public purpose. Despite the fact that public figures have less protection from press, it is very important to establish proper balance between public interests and private interests, since an individual, even if he or she is a public figure, does not forfeit all the privacy or individual protection.

If the law is concerned only with social ties, then there are freedoms that are subject to regulation, those whose effects extend to society, in the sense that its exercise affects the freedom of others or the interests of the group, and these freedoms are those related to the field of private activities and organized professions, such as freedom to work with its professional dimension Because it is not one of the privacy of the individual, but rather goes beyond that to society and to power itself. Freedoms whose effects extend beyond the individual to society and to power cannot be absolute, otherwise they would turn into chaos and carry with it the prostitution and aggression against the state and the freedoms of others. Therefore, it must be organized without leading to its denunciation or derogation from it, provided that the issue of its organization is entrusted to Parliament as a representative of the will of the people, just as the authority of Parliament in this regard cannot be absolute power, but rather is constrained by objective constitutional controls and restrictions that impose on it not to diminish From it and not confiscate it, and it just has to organize it in a way that makes it more effective. The legal regulation of freedom must ensure the balance, as far as possible, between the right of the individual to exercise his freedom and the restrictions that Parliament considers to be imposed, that is, achieving a balance between the freedoms that the individual needs and the authority that is indispensable and to the extent that prosperity is achieved for society and the individual. This balance is necessary for all Freedom, which is more binding on some public freedoms that are closely related to democracy, such as freedom of work and opinion, freedom of the press, and freedom of assembly And from it, how can a balance be achieved between the legislative organization of public freedoms and its practice in the field of private activities and regulated professions.

The subject of the study is the cooperation of S. Efremov with Western Ukrainian periodicals as a page in the history of Ukrainian journalism which covers the relationship of journalists and scientists of Eastern and Western Ukraine at the turn of the XIX-XX centuries. Research methods (biographical, historical, comparative, axiological, statistical, discursive) develop the comprehensive disclosure of the article. As a result of scientific research, the origins of Ukrainocentrism in the personality of S. Efremov were clarified; his person as a public figure, journalist, publisher, literary critic is multifaceted; taking into account the specifics of the memoir genre and with the involvement of the historical context, the turning points in the destiny of the author of memoirs are interpreted, revealing cooperation with Western Ukrainian magazines and newspapers. The publications ‘Zoria’, ‘Narod’, ‘Pravda’, ‘Bukovyna’, ‘Dzvinok’, are secretly got into sub-Russian Ukraine, became for S. Efremov a spiritual basis in understanding the specifics of the national (Ukrainian) mass media, ideas of education in culture of Ukraine at the end of XIX century, its territorial integrity, and state independence. Memoirs of S. Efremov on cooperation with the iconic Galician journals ‘Notes of the Scientific Society after the name Shevchenko’ and ‘Literary-Scientific Bulletin’, testify to an important stage in the formation of the author’s worldview, the expansion of the genre boundaries of his journalism, active development as a literary critic. S. Yefremov collaborated most fruitfully and for a long time with the Literary-Scientific Bulletin, and he was impressed by the democratic position of this publication. The author’s comments reveal a long-running controversy over the publication of a review of the new edition of Kobzar and thematically related discussions around his other literary criticism, in which the talent of the demanding critic was forged. S. Efremov steadfastly defended the main principles of literary criticism: objectivity and freedom of author’s thought. The names of the allies of the Ukrainian idea L. Skochkovskyi, O. Lototskyi, O. Konyskyi, P. Zhytskyi, M. Hrushevskyi in S. Efremov’s memoirs unfold in multifaceted portrait descriptions and function as historical and cultural facts that document the pages of the author’s biography, record his activities in space and time. The results of the study give grounds to characterize S. Efremov as the first professional Ukrainian-speaking journalist.

The article is dedicated to theoretical understanding of the problem of development and protection of the rights of foreign and domestic journalists. The modern reality of journalistic activity, including the full scale russian aggression, was highlighted. The activities of foreign journalists that come to Ukraine to shoot and write materials to inform their audience with the current situation were carefully studied and analyzed. But on the other hand, the presence of different foreign press agencies in Ukraine can cause harm to national security, because information provided by foreign journalists can be used by hostiles in their criminal deeds. The harsh situation with journalists’ rights is proved by reports about targeting press-labelled cars, assassinations and burglarizing of journalists on annexed territory. War in Ukraine became the first precedent when occupational army prevent press associations to shoot and report crimes they commit there. Materials and photos provided by Ukrainian and foreign journalists do not only give emotional and information pictures to readers and the public, but also are used in courts for persecution. Because of systematic violation of journalists’ rights by russian forces, they demand an eager change of European and national law to punish criminals and increase responsibility for their crimes. Today demand on information is high. One can say that the most precious thing and one of the most valuable goods is information. The main priority today is the rights of journalists their safety Problematic issues of journalistic activity in today’s conditions are highlighted as destabilizing factors in the protection of journalists’ rights. Ways to solve the outlined problematic issues are provided. Key words: journalism, journalist, law, ensuring rights, rights and freedoms, war, invasion, journalistic activity.

The purpose of this study, conducted during the Covid-19 pandemic between November 2020 and March 2021 in India and Nigeria, is to explore the direct and indirect effects of Covid-19 on religiously marginalised groups experiencing intersecting vulnerabilities. The findings provide recognition of the impact of Covid-19 on targeting and encroachments faced by these groups in order to inform policy so that it includes their perspectives in building back better and promoting inclusive development. Policymakers need to understand both the direct and indirect impacts of Covid-19 in order to coordinate effective support and avert deepening marginalisation. This research demonstrates how religious inequalities intersect with other inequalities of power – historical, structural, and socially determined characteristics (class, ethnicity, caste, gender, age) – to shape how people experience the Covid-19 pandemic. Both India and Nigeria manifest high levels of authoritarianism, an absence of press freedom, targeting of religiously marginalised groups, and unequal access to public services and the protection of the state by religiously marginalised groups, according to geographic location. The findings of this report reveal the appalling everyday realities as well as the great courage of religious minorities living in poverty during the pandemic. Greater sensitivity to the critical intersection of vulnerabilities is essential for the longer-term recovery of these groups, who otherwise face slipping deeper into intergenerational poverty. Deepening poverty and proliferating ethno-religious injustices are fuelling tensions and conflict, and the risks of neglecting these issues are immense.
