Il est souvent question de Roland Barthes dans les essais et les carnets d’André Belleau. C’est le sémiologue, le critique de Tel quel et le penseur du structuralisme que ce dernier évoque. Belleau s’inspire des écrits de Barthes (et de ceux de Jean Marcel) pour développer son « essayistique », mais aussi, sans doute, pour s’accorder une légitimité d’écrivain. Belleau considère que « l’écrivain est […] celui qui travaille le discours social » (« Approches et situation de l’essai québécois », Y a-t-il un intellectuel dans la salle ?), et ce sont d’abord les « signes du réel » qui retiennent son attention, comme celle de Barthes. Tous deux partagent en outre une passion pour les formes courtes (l’essai, la nouvelle, la chanson). Or, au-delà de ces rapprochements, c’est surtout leur rapport au politique qui nous intéressera, celui-ci paraissant indissociable de leur conception même de l’écriture. Pour André Belleau, l’écriture exige une forme de retrait, une mise en perspective et l’expression d’une singularité prenant forme autour de la question suivante : « Comment être manifestement solidaire du groupe dans la distance ? » (« Petite grammaire de la solidarité avec le peuple », Y a-t-il un intellectuel dans la salle ?) C’est une interrogation semblable que l’on retrouve chez Barthes lorsqu’il élabore les notions « d’impersonnel » et de « neutre ». Cet article visera à établir des parallèles entre la politique mise en oeuvre par ces auteurs et l’importance qu’ils accordent au style, à une certaine forme de « plaisir du texte » et de souplesse de la pensée.

Cette recherche a pour but de décrire les éléments intertextuels sous forme: (1) d’allusion, (2) d’adaptation, (3) d’indication, et (4) de citation dans les trois contes de Bruno de la Salle qui font appel à ceux de Charles Perrault. Cette étude a utilisé la théorie d’intertextualité de Julia Kristeva sur le plan du modèle d’analyse micro-intertextuel.Les objets matériels de cette étude sont trois contes de Bruno de la Salle, à savoir Le Prince Tout Bleui, Le Chat Qui Vient d’On Ne Sait Où, Petit Caillou et Brin de Laine qui ont été écrites en 1995 dans l’anthologie Le Conteur Amoureux, et trois autres contes de Charles Perrault intitulés La Barbe Bleue, Le Maître Chat ou Le Chat Botté, Le Petit Poucet paru en 1697 dans l’anthologie Histoires ou Contes du Temps Passé.Cette recherche se sert de la méthode comparative-qualitative. À partir d’une hypothèse métapsychologique, Tact-Pulsion, recentrant la nature de la pulsion sur le contact, cet article propose de distinguer deux modalités indissociables et déterminantes dans les métiers du soin pour inscrire la démarche diagnostique et thérapeutique : la fonction d’accueillir et celle de recevoir. Recevoir est lié à la demande, dans une forme symbolisée ; accueillir rejoue les bases primitives du contact avec l’autre tel qu’elles ont été expérimentées dans l’enfance, la petite enfance et même la vie prénatale, et définissant une approche spécifique de prendre soin. La réflexion s’organisera autour de différentes situations cliniques d’accueil : temps d’accueil, lieu d’accueil, accueil en salle d’attente, temps en salle d’attente ; j’envisagerai également la nature des éprouvés accueillis, ainsi que le mode de passage psychique de l’accueilli à l’accueillant.

L’atrésie de l’œsophage est une malformation congénitale responsable d’une interruption de la continuité œsophagienne avec dans la majorité des cas une fistule oesotrachéale du cul de sac supérieur et ou inférieur. Son étiologie est inconnue, mais elle est probablement multifactorielle combinant des facteurs génétiques et environnementaux. Cette anomalie une urgence chirurgicale néonatale qui doit être recherchée de principe lors de l’examen initial de tout nouveau-né en salle de naissance. Il existe plusieurs formes anatomiques avec des prises en charge et pronostic différents. L’atrésie de l’œsophage avec fistule oesotrachéale inférieure constitue la forme la plus fréquente. Le progrès de la prise en charge néonatale et chirurgicale a nettement amélioré le pronostic. Mots-clés : Atrésie, Oeso-trachéo-bronchique, Nouveau-né.

Cet article vise à souligner l’intérêt pour les sciences sociales à considérer l’institution scolaire, dans son histoire propre, comme le lieu où se nouent des formes de relations sociales déterminées et où se jouent des rapports singuliers au savoir et au pouvoir. Longtemps concentrés sur la question centrale du rapport des classes sociales à l’institution scolaire, les chercheurs ont souvent oublié d’interroger l’école en tant que telle, c’est-à-dire comme sphère relativement autonome d’activités où se déploient des pratiques spécifiques autour de savoirs spécifiques.Il s’agit de rappeler les différentes étapes de l’histoire de cette forme scolaire en France depuis les collèges d’Ancien Régime jusqu’aux écoles propres à un espace scolaire relativement unifié (au XXe siècle), en passant par les petites écoles de Port-Royal (1637-1660), les petites écoles rurales d’Ancien Régime, les petites écoles urbaines (de Charles Démia et Jean-Baptiste de la Salle) et les écoles mutuelles. À travers cette reconstruction historique, l’auteur s’efforce plus particulièrement de saisir la forme scolaire de socialisation dans ses rapports avec la constitution de savoirs écrits explicites et avec l’objectivation écrite des moyens nécessaires à leur apprentissage: codification des savoirs et de la relation sociale.

Avec les besoins croissants en énergie renouvelable, les activités industrielles dans le domaine du photovoltaïque gagnent une place considérable dans le secteur de l’énergie. Afin d’être en adéquation avec ce marché de l’emploi en plein développement, il devient important de former des ingénieurs compétents dans ce domaine. Un TP a été développé au CIME Nanotech pour simuler, élaborer et caractériser des cellules photovoltaïques de première génération. Le travail de simulation (sur SILVACO®) porte sur les procédés de fabrication de la cellule, ainsi que sur sa réponse I-V sous éclairement. La fabrication (effectuée dans la salle blanche du CIME Nanotech) comprend essentiellement les étapes suivantes : (1) texturation de la surface d’un substrat de silicium (2) réalisation d’une jonction pn, (3) dépôt d’une couche anti-reflet et (4) métallisation. Au-delà de la confrontation aux procédés de fabrication en salle blanche, les étudiants appréhendent l’importance d’étapes technologiques comme, par exemple, la texturation ou la couche anti-reflet ainsi que le rôle de la géométrie, telle que le motif de métallisation. Ces cellules sont ensuite testées électriquement par la mesure des caractéristiques I-V sous obscurité et sous simulateur solaire. Les rendements et autres paramètres caractéristiques (facteur de forme, résistance série…) de chaque cellule sont ensuite calculés et comparés.

Nous aborderons avec les étudiants les enjeux de l’électronique imprimée comme fabrication additive ainsi que ses caractéristiques (Encre-Tête-Substrats). A travers les projets tutorés et les travaux pratiques, nous aborderons en salle blanche la technique de dépôt de matériaux par jets d’encres : de la conception à la caractérisation des couches imprimées en passant par la réalisation : traitement pré et post impression, mesure d’épaisseur et de résistivités d’encres conductrices.

Cette thèse aborde le problème inverse de la reconstruction de la géométrie d’une pièce à partir de mesures acoustiques. Plus précisément, nous nous concentrons sur les Réponses Impulsionnelles de Salle. Nous développons deux approches distinctes pour résoudre ce problème. La première approche considère des pièces parallélépipédiques avec des murs réfléchissants et repose sur la méthode dite des Sources Images. Nous proposons un cadre novateur basé sur l’algorithme Frank-Wolfe pour reconstruire les positions 3D des sources images en résolvant un problème d’optimisation convexe dans l’espace des mesures de Radon. La deuxième approche s’étend à des formes de pièce plus générales en formulant le problème inverse comme un problème d’optimisation de forme, où la géométrie de la pièce est optimisée en minimisant les écarts entre des observations dans le domaine fréquentiel et la solution de l’équation de Helmholtz définie sur le domaine de la pièceThis thesis addresses the inverse problem of reconstructing the geometry of a room from acoustic measurements. Specifically, we focus on Room Impulse Responses. We develop two distinct approaches to tackle this problem. The first approach considers cuboid rooms with reflective walls and is based on the so-called Image Source Method. We propose a novel framework, utilizing the Frank-Wolfe algorithm, to reconstruct the 3D positions of image sources in a gridless manner by solving a convex optimization problem in the space of Radon measures. The second approach extends to more general room shapes. The inverse problem is formulated as a shape optimization problem, where the room geometry is refined by minimizing discrepancies between frequency-domain observations and the solution of the Helmholtz equation defined on the room domain

Antipode de la lumière, le noir est pourtant indissociable du cinéma. Qu'est-ce que le noir du cinéma ? Figure de l'ombre ou de l'obscurité à l'image, il y est aussi présent en tant que tel, un noir sans représentation et avec sa réalité physique singulière. Ce noir-là est avant tout une condition technique, que l'on cache, mais qui joue un rôle décisif dans la production des illusions d'optique et la création de la fiction. Il est également omniprésent dans tout le processus de fabrication de l'image cinématographique. Le noir joue avec la lumière, conditionne la visibilité et l'invisibilité et, en ce sens, invente le cinéma. Le noir propose une autre manière de comprendre ce qu'est le cinéma ainsi que son fonctionnement. Cette étude traitera d'abord l'aspect matériel de l'image argentique : le noircissement photochimique et les idées qu'il suggère en tant que processus de la formation et de la dissolution de l'image. On évoquera ensuite, au travers du noir formel, outil rhétorique et mécanique, les effets produits par le noir, lorsqu'il intervient en tant que forme dans l'image, de l'image, et entre les images. Enfin, en tant que dispositif envahisseur de l'écran et de l'espace de projection, le noir révèlera son rôle dans le dispositif du spectacle visuel : la construction d'un accès à l'illusion et à la révélation. Chaque partie se déploiera dans un parcours à la fois historique, technique, et esthétique. On verra notamment dans des tentatives artistiques et expérimentales que la mise en avant du noir permet de révéler les caractéristiques du médium cinématographique, voire de ré-inventer le cinéma. Lo scopo della mia tesi è quello di fare luce inizialmente sulla pratica dei contratti internazionali, individuando i principali contratti nel campo della vendita internazionale, soffermandomi sulle differenze tra Paesi di Civil law e di Common Law e poi approfondendo il problema del diritto applicabile ai contratti. Una questione che si pone sistematicamente poiché la legge che regola il contratto determinerà se esiste effettivamente un contratto valido, come sarà interpretato e i rimedi per la risoluzione a fronte di violazione del contratto da parte del venditore o dell'acquirente. Il principio di autonomia delle parti è quindi centrale ed è qui che si articola la mia riflessione sulla seconda parte della tesi, che verte sulla clausola di forza maggiore nei contratti internazionali. L'imprevedibile mutamento delle circostanze è, infatti, uno dei problemi più consistenti per i contratti internazionali, soprattutto nel periodo di pandemia che stiamo vivendo oggi. A livello internazionale, esistono testi legislativi in cui l'Istituto della forza maggiore è ampiamente delineato. Dopo un'analisi generale di queste clausole, quali ICC, CISG e UCC, mi concentrerò sulla clausola di forza maggiore correlata alla pandemia Covid-19 che stiamo vivendo, esponendo alcuni casi, anche se un corpus giurisprudenziale completo concernente gli effetti del Covid-19 sull'adempimento contrattuale internazionale non è ancora completamente disponibile.

Cette thèse a pour objet de recenser les différentes formes de salles de réception des grandes demeures tardives du bassin méditerranéen occidental entre le IVe et le VIe siècle, afin d'analyser l'évolution perceptible des modes architecturales. L'étude associe maisons de ville et villas. La première partie se fonde sur une étude des textes de l'époque qui illustrent les différents types de réceptions offerts par les classes dirigeantes, afin de mieux comprendre les espaces qui les abritaient (rite de la clientèle, banquets, réceptions en ville et sur les domaines). Les descriptions de salles de réception ont été analysées pour déterminer les critères importants aux yeux des contemporains et tirer des informations complémentaires sur le mobilier et le décor des salles. La seconde partie est centrée sur le problème de l'évolution du mobilier de banquet à l'époque tardive. Nous avons montré que l'usage traditionnel du triclinium en t+u s'était maintenu. Mais la diffusion des lits de table semi-circulaires (stibadium) a influencé les formes architecturales, les lits étant souvent installés dans les absides. Celles-ci caractérisent alors la forme habituelle des triclinia. Elles peuvent être ajoutées à des salles auparavant quadrangulaires. Pour recevoir plusieurs lits, on tend à multiplier les absides pour créer des salles à manger d'apparat : dans quelques cas à deux absides (biconques), le plus souvent à trois absides (triconque), parfois cinq ou sept absides et plus dans les cas des plus grandes résidences. Notre troisième partie s'est attachée à présenter successivement les différentes formes de salle, en montrant leurs caractéristiques : forme quadrangulaire qui perdurent, formes absides (salle a abside, triconque, salles polyabsidees, exèdres semi-circulaires) et plans. .The present doctoral thesis seeks to make an inventory of the various forms of reception rooms of large late residences in the western Mediterranean area, between the IVth and VIth centuries a. C. , in order to analyze the perceptible evolution of architectural modes. This study associates town houses and villas. The first part is based on the study of time related texts which illustrate the various types of reception given by the ruling classes in order to better understand the areas which accommodate them (clients audiences, banquets, receptions in towns and rural estates). Reception rooms descriptions were investigated to establish the criteria that were considered as important by contemporaries and also to extract complementary information on furniture and room decoration. The second part deals with the evolution problem of banquet furniture in late antiquity. It has been shown that traditional use of triclinium in t+u has lasted partly. But the diffusion of semicircular couches (stibadium) influenced the architectural forms. These apses feature the common form of triclinia. These may be added to former quadrangular rooms. To hold several couches, there was a trend to multiply apses in order to create ceremonial dining rooms. In some cases, with two apses (bichonches), more often with three apses (triconches), sometimes with five or more apses, in the cases of larger residences. Our third part successively discusses the various room forms showing their features, lasting quadrangular form, apsidal forms (apse rooms, triconch, polyapsidal rooms, semicircular exedrae) and. .

Si les salles de remise de forme ont déjà livré nombre de leurs secrets à la communauté scientifique, il en est autrement de celles imposant une ségrégation au regard du sexe. Pourtant depuis 2004, elles ne cessent de se développer et de se multiplier sur le territoire français, en revendiquant l’interdiction faite aux hommes - un affichage loin d’être anodin à l’heure où la coexistence des deux sexes dans l’ensemble de l’espace social est prônée - ; en vantant des propositions de services spécifiquement adaptées à leur clientèle : les femmes, toutes les femmes quels que soient leur âge, leur morphologie, leur condition physique, leur rapport au corps et au sport ; en se présentant comme des lieux préservés des regards, des jugements évaluatifs, des situations stigmatisantes. C’est en nous appuyant sur une enquête mêlant observations (non) participantes (350 heures), entretiens semi-directifs avec les gérant.e.s, encadrant.e.s (43) ainsi que leurs clientes (27) et analyse de supports communicationnels (3 235), que nous avons produit quelques savoirs sociologiques. Volontairement inclusifs dans des espaces qui se veulent exclusifs au regard de l’appartenance de sexe, tel est le paradoxe des salles de fitness d’un nouveau genre. Mais cette apparente inclusion ne doit pas masquer les pratiques mises en place par ces institutions qui consistent à évaluer les corps de leurs clientes à l’aune des normes dominantes pour mieux les faire maigrir, pour mieux les raffermir, pour mieux les dégraisser afin qu’ils se rapprochent des canons de beauté faisant la féminitéIf fitness centres have already given up many of their secrets, it is not the same for those who impose discrimination regarding gender. Yet, since 2004, they keep expanding on French territory, putting forward the fact that access is denied to men – a quite peculiar positioning in times of promotion of sexes coexistence in social spaces – ; selling their services offer allegedly specifically designed for their clientele, that is to say women, all women whatever their age, their morphology, their physical shape, their relation to their own body or with sport ; presenting themselves as places free from any stares, evaluative judgements, stigmatising situations. Basing us on an investigation combining (non) participating observations (350 hours), semi-structured interviews with the managers and coaches (43) of these establishments as well as the clients (27), and an analysis of their communication media (3235), we eventually managed to produce some new sociological knowledge. Willingly inclusive in spaces designed to be exclusive on sexes criteria, here is the paradox of these fitness centres of a new kind. However, this outward inclusion must not hide the practices that have been set in these institutions, aiming at evaluating their clients bodies in regards of the dominant norms, in order to make them lose weight, to reduce their fat, to tone up their muscles so that these bodies get closer and closer of the beauty standards that make femininity

Le theme central de notre etude n'est pas les causes de l'expansion de la capitale rabat-sale (maroc), mais une tentative pour mieux comprendre les phenomenes qui en resultent. Cette etude est donc limitee a l'analyse des formes et processus d' d'urbanisation qui affectent en particulier les communes peripheriques de rabatsale. Elle recouvre ainsi les themes "urbanisationperipherique" et "relations ville campagne". Nous avons analyse la formation des petits centres urbains peripheriques, les douars et bidonvilles periurabins, les lotissements legaux et illegaux, les residences secondaires et les etablissements industriels. Nous avons insiste sur l'importance de la propriete cidadine et son role dans l'extension de l'espace bati sur l'espace rural peripherique sans omettre l'influence de la ville sur l'habitat rural. Une grande attention a ete portee a l'evolution socio-professionnelle des habitants des douars ruraux entre 1971 et 1982, a l'attraction des emigres des regions proches ou lointaines vers cette peripherie, a l'installation des citadins ayant quitte, pour diverses raisons, les villes de rabat ou de saleThe central theme of our study is not the causes of expansion of the capital, rabat sale (morroko) but an attempt to better understand the phenomenum that are the result of it. Les intrusions d'eau salée en zone côtière constituent une menace pour la population. Celles-ci sont particulièrement dommageables en contexte carbonaté. Nous avons étudié le récif corallien Miocène du sud-est de Majorque afin de comprendre la relation entre structure géologique et intrusion. Pour cela nous avons utilisé des méthodes multi-scalaires et multi-disciplinaires. Les mesures dans 25 forages sur l'ensemble de la plate-forme corallienne ont permis de préciser la structure stratigraphique et certains éléments de la tectonique régionale. A l'échelle du site expérimental, l'étude de la composition minérale, de la texture et de la diagenèse ont permis de caractériser l'hétérogénéité de la séquence carbonatée. Cette étude contribue à la connaissance du site le mieux documenté au monde pour l'évolution des réservoirs carbonatés récifaux, avec applications pour les intrusions d'eau salée et l'extraction des hydrocarburesThe coastal intrusion of brine threatens populations. This is particularly prejudicial in carbonate environments. We have studied the Miocene coral reef of S-E Majorca for better understanding the relation between geological structure and intrusion. For that purpose, we have used multi-scalar and multi-disciplinary methods. The measurements in 25 boreholes over the whole coral platform have allowed defining the stratigraphic structure and some elements of the regional tectonic. At the experimental site scale, the study of the mineral composition, the texture, and the diagenesis have allowed characterization of the carbonate sequence heterogeneity. This study contributes to the knowledge of the world best documented site for the evolution of carbonate reef reservoirs, with applications for brine intrusion and for hydrocarbon extraction

L’objet de cette thèse est de comprendre quelles sont les dynamiques sociales suscitées par l'art chorégraphique dans notre société à travers le prisme de la notion de socialité telle que la développe Michel Maffesoli. Nous nous attacherons pour cela à l'étude de l'expérience sensible provoquée par le spectacle de danse contemporaine ainsi qu'au lieu où s'enracine cette expérience, la salle de spectacle. Après avoir consacré un premier chapitre à la présentation de notre terrain, nous considérerons les orientations épistémologiques (chapitre 2) et méthodologiques (chapitre 3) de notre recherche. Puis nous questionnerons les fondements chorégraphiques, et en particulier le corps du danseur, l’imaginaire chorégraphique et l’étude du processus spectaculaire “côté scène” (chapitre 4). Nous nous interrogerons ensuite sur la nature de l'expérience sensible produite par le spectacle de danse contemporaine, en abordant le caractère interactionnel du moment artistique, la configuration relationnelle sensible des salles de spectacles et le déroulement du processus spectaculaire, mais “côté salle” cette fois (chapitre 5). Enfin, nous traiterons de l’ouverture de l'espace chorégraphique sur la ville, en abordant la question de la danse in situ, de l’investissement de l’espace urbain, ainsi que la manière dont la danse contemporaine permet une mise en valeur du tissu social local (chapitre 6)The purpose of this thesis is to understand what are the social dynamics generated by the choreographic art in our society through the prism of the concept of sociality such as Michel Maffesoli develops. For that we will devote ourself to the study of sensory experience caused by the contemporary dance show and the places where is rooted this experience, the theater. After a first chapter devoted to the presentation of our field, we will consider the epistemological orientations (Chapter 2) and the methodology (Chapter 3) of our research. Then we will question the choreographic fundaments, especially the dancer's body, imagination and study of the choreographic spectacular process "side stage" (Chapter 4). Then we will approach the nature of sensory experience produced by the contemporary dance show by examining the interactional nature of the artistic moment, the sensitive relational configuration of the theater and the course of the spectacular process , but "side room" that time (Chapter 5). Finally, we will discuss the opening of the choreographic space of the city, in addressing the question of dance in situ, the investment of the urban space, and how can the contemporary dance make possible the development of the local social fabric (Chapter 6)

La décennie 80 a vu se développer dans les grandes agglomérations urbaines de nouveaux espaces pour le corps : les salles de "mise en forme". Leur succès s'explique et se traduit en même temps par le passage d'un modèle de fonctionnement artisanal à un modèle "entrepreneurial", qui bouleverse l'offre classique en se démarquant des anciennes salles de culture physique et des structures associatives. Cette nouveauté s'objective dans la souplesse d'utilisation proposée, dans la concentration, la combinaison, la sophistication technologique et l'ajustement permanent des prestations, ainsi que dans la production de formes originales de sociabilité. Mais ce phénomène doit être également relie à l'évolution des valeurs et des représentations corporelles qui fait du désir de liberté d'action et de valorisation de soi un impératif social. Rien d'étonnant alors si les résultats de l'enquête menée auprès de huit cents pratiquants nous dévoile que les salles de "mise en forme" parisiennes sont fréquentées par un large public compose de femmes mais aussi d'hommes, de pratiquants de tout âge et issus de tous les groupes sociaux. En effet, le souci de s'accomplir par et à travers son corps, de façon indépendante ou assistée, en agissant à la fois sur sa fonctionnalité, sur son apparence et en s'accordant des parenthèses hédonistes, ne concerne plus une minorité de personnes mais apparait comme un idéal social de masse. Il reste que des stratégies différentes associées au sexe, a l’âge et a l'origine sociale des clients, sont poursuivies et segmentent le marché parisien de la "mise en forme"With the eighties a new style of health facility has been springing up all over the communities: the "fitness center". Their success can be attributed to the fact they have passed from a cottage industry to an entrepreneurial model, a shift which differentiates them from the standart gymnasiums. Today's patrons are offered a wide array of new services, round-the-clock workouts of all kinds, adapted to their wishes or needs, they are introduced to a variety of exercice-condit ionning equipment-technology is keeping pace with the trend and different opportunities for socializing. This phenomenon has been fueled by a change in values and new concepts about the body which have turned the urge for self-bettement into a social must. It is thus not surprising that the results of a survey involving 800 persons should show that there are numerous females, males and youngsters of all ages and in all the walks of life among the clients of a Parisian "fitness center". Many centers promote themselves by offering different strategies by sex and age groups in the parisian fitness field. The quest for self-fulfilment through the means of the body and by the body lures more and more participants. The paper presents some new etymological notes on the Khakas names of the squirrel and the sable. Because of a taboo character, Khakas has four different designations for ‘squirrel’. One of them tīn has a stable Turkic etymology, while the other three forms are of unknown origin. The second Khakas word, saxïl ‘squirrel’ is probably a metathetical form of Turkic salïq ‘tax’. The third form tabïrġan ‘flying squirrel’ was possibly borrowed from Mongolic tarbaγan ‘marmot’. The last word sarbax may be connected with the Mongolic verb sirba- ‘to wag the tail’. There is only one form, albïġa, with the meaning ‘sable’ in Khakas, which is also possibly borrowed from the Mongolic alban ‘tax, impost, tribute’. The etymological analysis confirms the peculiarity and diversity of the Khakas language.

Abstract This chapter deals with terms concerning the description, fitness, and quality of the contract goods that are implied by statute into the contract unless the parties have excluded them within the limits permitted by the law. An examination of the general law of contract shows that it is not easy to pin down the nature of implied contractual terms. Expressed as a simple dichotomy, they come in two different versions: first, terms agreed in fact by the parties that take two different forms. There are terms so obvious that they do not need to be stated or that the parties have not troubled to record in writing, and there are terms implied into contracts to give them a minimum of business efficacy. The second form consists of terms implied in law that may once have expressed the actual agreement of parties to contracts of a particular type but that have, under the weight of case law and inherited assumptions, become over time automatic accessories of particular contract types.

In the context of the aforementioned, in practice there are uncertainties regarding the conduct of transactions for the online sale of goods. In this article are examined the problematic accounting aspects of online goods deliveries with payment through different methods provided by the legislation in force.

United Nations Convention on Contracts for the International Sale of Goods (CISG) entered into force on the 1st August 2011 in Turkey. CISG is accepted with the purpose of development and encouragement of international trade and application of uniform rules for resolution of disputes arising from the contracts for the international sale of goods. CISG applies to contracts of sale of goods between parties whose places of business are in different states when the states are contracting states; or when the rules of private international law lead to the application of the law of a contracting state. Neither the nationality of the parties nor the civil or commercial character of the parties or of the contract is to be taken into consideration in determining the application of CISG. In order to apply CISG, there has to be a contract about international sale of goods and the parties shall be from different contracting states or the rules of private international law shall lead to the application of the law of a contracting state. The parties may totally or partially exclude the application of this CISG. CISG does not apply in terms of third party rights and the validity of the contract or of any of its provisions or of any usage.

The outbreak of COVID-19 has had massive negative impact across all industries and fields in the entire world. While the negative health impact is slowly stabilizing, the economic impact is in full effect and the harm is yet to be evaluated. On macroeconomic level, the necessary measures for combating the pandemic which were undertaken by governments have significantly restricted international trade. On microeconomic level, merchants and businesses are faced with inability or extreme obstacles in their daily operations and particularly in performing their international sales contracts. Failure to perform results in contractual breach and unwanted claims for damages. The paper addresses the impact which COVID-19 has on the performance of international commercial contracts for the sale of goods. The paper considers the impediments which may arise due to the pandemic outbreak and evaluates them from a legal perspective under the UN Convention on Contracts for the International Sale of Goods from 1980 (CISG), which is the main legal instrument governing international sales contracts. Particularly, the paper focuses on the question of exemption from liability in a situation where either of the contractual parties fails to perform and breaches an obligation. The evaluation is conducted through interpretation of the concepts of force majeure and hardship, as grounds for non-performance or contract renegotiation in light of the current situation.

The area of Fruška Gora has great potential for the development of rural tourism, which has only been partially utilized. Wine and religious tourism in the area of Fruška Gora can be seen as the special forms of rural tourism, which, together with agrotourism, can form an authentic integrated tourist product of this area. Adequate promotion and sale of this product could contribute to an increase in the income of stakeholders. The aim of the paper is to present the potential integrated tourism product of Fruška Gora, as well as current incentives that can contribute to its economic sustainability. The research uses the methods of analysis, synthesis, desk research, as well as the descriptive method. The authors conclude that the proposed integrated tourism product, with adequate marketing activities, can contribute to the local sustainable economic development in the area of Fruška Gora, as well as to the reduction of the depopulation in these areas.

The collapse of the Soviet Union marked the beginning of the difficult deconstruction of the regime and ideology which controlled the East for the majority of the 20th Century. In the Republic of Georgia, Soviet collapse catalyzed a series of ethnically prompted conflicts and civil war which prevented the unification of the country under a national agenda, thus creating fertile ground for corruption, privatization and sale of public space. The earliest example of the corrupt transfer of property was the sale of the former Palace of Rituals, in Tbilisi, to Georgian oligarch Badri Patarkatsishvili, which is still primarily used as a private residence by his family. After the Rose Revolution in 2003, Georgia faced rapid institutional reforms under President Mikheil Saakashvili, who legitimized his regime by unifying regions that continuously identified as Georgian (excluding territories Abkhazia and S. Abstract Online data repositories provide designers and engineers with a convenient source of data. Over time, the wealth and type of readily-available data within online repositories has greatly expanded. This data increase permits new uses for machine learning approaches which rely on large, high-dimensional datasets. However, a comparison of the efficacies of attribute-based data, which lends itself well to traditional machine learning algorithms, and form-based data, which lends itself to deep machine learning algorithms, has not fully been established. This paper presents one such comparison for an exemplar dataset. As the efficacy of different machine learning approaches may be dependent on the specific application, this method is intended to lay the groundwork for future studies that produce more extensive comparisons. Specifically, this work makes use of a manufactured gear dataset for sale price prediction. Two traditional machine learning algorithms, M5Rules and SMOreg, are selected due to their applicability to the gear attribute-based data. These algorithms are compared to a neural network model that is trained on a voxelized version of the gears’ 3D models, defined in this work as form-based data. Results show that both data types provide comparable predictive accuracy.

The authors outlined the necessary conditions for the implementation of import substitution in the seed sector: the creation of specialized companies for the selection of seed varieties necessary for agribusiness and a special agrarian zone, where a complete production chain will be organized from seed selection to their sale, as well as support and assistance in the form of subsidies from the state.

Substantial attention has been paid in recent years to the risk of maturity mismatch in emerging markets. Although this risk is microeconomic in nature, the evidence advanced thus far has taken the form of macro correlations. This paper empirically evaluates this mechanism at the micro level by using a database of over 3,000 publicly traded firms from fifteen emerging markets. The paper measures the risk of short-term exposure by estimating, at the firm level, the effect on investment of the interaction of short-term exposure and aggregate capital flows. This effect is (statistically) zero, contrary to the prediction of the maturity-mismatch hypothesis. This conclusion is robust to using a variety of different estimators, alternative measures of capital flows, and controls for devaluation effects and access to international capital. The paper finds evidence that short-term-exposed firms pay higher financing costs and liquidate assets at fire sale prices, but the paper does not find that this reduction in net worth translates into a drop in investment.

The article aims to analyze the structural changes and the Ukrainian labor market organization in the condition of military aggression against Ukraine. The Ukrainian economy encounters the devastating destructions and losses of economic entities, enormous capital, and labor under the effect of military aggression. Structural changes include a change in the industrial structure of production, the destruction of large enterprises, and supply chains, the loss of part of the labor force, and fluctuations between skilled and unskilled jobs. Thus, SMEs in the service sector suffer due to the reduction of the population in cities, which causes both a reduction in demand for certain types of services (hotel and restaurant business, beauty salons, providers of extracurricular educational services, etc.) and a reduction in the supply of highly qualified specialists (IT sector, experts in financial, design and consulting services). Small business because of the war feels caught between the minimum possible sale of their products and reduced demand. The basic research questions are identifying and estimating the urgent needs of the labor market and capital. It will be directed to define sectors that can speed up the process of rebuilding the economy. Diversifying the economy, increasing product/service sophistication, using comparative advantages and transfer of resources (both labor and capital) leads to more productive activities and a rise in well-being.

Une série de vignettes illustre et décrit une série d'habitats benthiques dans le golfe du Maine. Les habitats benthiques actuels sont l'héritage de l'histoire géologique de la région de l'ère mésozoïque (il y a 252 à 66 millions d'années) à l'ère cénozoïque (il y a 66 millions d'années à aujourd'hui). La plate-forme de marge continentale peu profonde abritant le golfe du Maine s'est formée lors de l'ouverture de l'océan Atlantique Nord par le rifting des plaques nord-américaine et africaine au niveau d'un centre d'expansion au cours de l'ère mésozoïque. Des roches sédimentaires non marines et marines se sont déposées sur la nouvelle marge continentale. Au cours de l'ère cénozoïque, une série de transgressions et de régressions du niveau de la mer, associées à de multiples avancées et retraits des calottes glaciaires continentales nord-américaines, se sont accompagnées de dépôts et d'érosions de sédiments et de substrat rocheux sous-jacent. Certains de ces événements d’érosion ont été profonds et se reflètent aujourd’hui dans la géomorphologie à grande échelle de la région. Au cours du dernier maximum glaciaire (il y a environ 24 à 20 14 000 ans) de l'époque du Pléistocène (il y a 2,58 millions à 11 700 ans), la marge sud-est de l'inlandsis laurentidien (LIS) occupait le golfe du Maine. La cartographie de la géomorphologie sous-marine fournit la preuve qu'un courant de glace marine à écoulement rapide occupait le golfe. La LIS s'est retirée vers le nord par étapes. Des sédiments superficiels se sont déposés dans le golfe pendant et après la glaciation. La géomorphologie glaciaire en vue en plan est interprétée à partir de la bathymétrie sonar multifaisceaux haute résolution définie dans des données bathymétriques à l'échelle régionale. L'interprétation des profils de sismique réflexion fournit la structure transversale des caractéristiques glaciaires et les modèles de sédimentation dans le golfe du Maine. Les bassins du golfe présentent des dépôts épais (des dizaines de mètres) de sédiments glaciaires et post-glaciaires à grains fins. Les crêtes séparant les bassins sont dominées par des dépôts à grains filants (till) et ces crêtes constituent une série de moraines de récession majeures. Au cours de l'époque de l'Holocène (il y a 11,7 mille ans jusqu'à aujourd'hui), l'interaction de l'élévation du niveau de la mer avec le rebond post-glaciaire de la croûte a entraîné une exposition subaérienne, pendant un certain temps, des bancs Georges et Browns, limitant ainsi le golfe du Maine de l'Atlantique. Océan. L'interprétation de la bathymétrie du sonar multifaisceau met en évidence une érosion fluviale sur les berges durant cette période. Les inondations ultérieures se sont accompagnées du développement de vastes champs de vagues de sable formés sous le régime actuel des courants.

Faced with environmental degradation and strong land pressure, farmers in south-central Niger have intensified their agricultural production systems. Since the 1980s, farmers in the regions of Zinder, Maradi and Tahoua have increased the number of trees and shrubs on their fields, creating new agroforestry parklands over about 5 million hectares. This regreening is not based on tree planting, however, but on farmers protecting and managing natural regeneration of woody species on their crop lands. This has been well documented over the years, but until now, there has not been a thorough review of all of the published peer-referenced as well as grey literature. This report presents the first comprehensive state of knowledge of farmer managed natural regeneration (FMNR) in Niger. Studies show the scale and dynamics of FMNR as well as its multiple impacts. It has increased crop yields (+31 kg/ha to +350 kg/ha), and that supports family food security even in drought years. FMNR has increased the income of all social categories, even the most vulnerable women, men and youth, through the sale of fuelwood and service wood. The pruning of trees in fields has also reduced the distances travelled by women to collect fuelwood. FMNR increased the availability of fodder from trees to farmers and agropastoralists, with households practising FMNR harvesting 30-45 kg of fodder per day. Economists have not calculated all the multiple impacts in monetary terms, but studies on the costs and benefits all indicate that it is economically rational for farmers to invest their labour in FMNR. The costs are modest (no equipment and little labour), and the benefits are substantial, also helping smallholder farmers adapt to climate change, while sequestering millions of tonnes carbon. As a consequence of FMNR, tree cover has been sustained without external incentives (e.g. food or cash-for-work), an outcome that distinguishes this farmer-driven practice from large-scale tree planting projects where farmers’ stewardship ended when the external incentives ended. Agroforestry landscapes are thus being created at scale due to decisions made by hundreds of thousands of individual farmers. It is hoped that information in this report that shows the clear benefits of FMNR in Niger will encourage policy makers in Africa’s drylands to invest in the promotion of FMNR. This foundational practice must form the backbone of landscape wide initiatives if the ambitious targets of the Great Green Wall, AFR100 and similar ambitious restoration initiatives are to be achieved. FMNR is a low cost sustainable land use management practice with a considerable potential for scaling, which can and must be adopted and scaled immediately.

Background: Clear allergen communication in food business operators (FBOs) has been shown to have a positive impact on customers’ perceptions of businesses (Barnett et al., 2013). However, the precise size and nature of this effect is not known: there is a paucity of quantitative evidence in this area, particularly in the form of randomised controlled trials (RCTs). The Food Standards Agency (FSA), in collaboration with Kantar’s Behavioural Practice, conducted a feasibility trial to investigate whether a randomised cluster trial – involving the proactive communication of allergen information at the point of sale in FBOs – is feasible in the United Kingdom (UK). Objectives: The trial sought to establish: ease of recruitments of businesses into trials; customer response rates for in-store outcome surveys; fidelity of intervention delivery by FBO staff; sensitivity of outcome survey measures to change; and appropriateness of the chosen analytical approach. Method: Following a recruitment phase – in which one of fourteen multinational FBOs was successfully recruited – the execution of the feasibility trial involved a quasi-randomised matched-pairs clustered experiment. Each of the FBO’s ten participating branches underwent pair-wise matching, with similarity of branches judged according to four criteria: Food Hygiene Rating Scheme (FHRS) score, average weekly footfall, number of staff and customer satisfaction rating. The allocation ratio for this trial was 1:1: one branch in each pair was assigned to the treatment group by a representative from the FBO, while the other continued to operate in accordance with their standard operating procedure. As a business-based feasibility trial, customers at participating branches throughout the fieldwork period were automatically enrolled in the trial. The trial was single-blind: customers at treatment branches were not aware that they were receiving an intervention. All customers who visited participating branches throughout the fieldwork period were asked to complete a short in-store survey on a tablet affixed in branches. This survey contained four outcome measures which operationalised customers’: perceptions of food safety in the FBO; trust in the FBO; self-reported confidence to ask for allergen information in future visits; and overall satisfaction with their visit. Results: Fieldwork was conducted from the 3 – 20 March 2020, with cessation occurring prematurely due to the closure of outlets following the proliferation of COVID-19. n=177 participants took part in the trial across the ten branches; however, response rates (which ranged between 0.1 - 0.8%) were likely also adversely affected by COVID-19. Intervention fidelity was an issue in this study: while compliance with delivery of the intervention was relatively high in treatment branches (78.9%), erroneous delivery in control branches was also common (46.2%). Survey data were analysed using random-intercept multilevel linear regression models (due to the nesting of customers within branches). Despite the trial’s modest sample size, there was some evidence to suggest that the intervention had a positive effect for those suffering from allergies/intolerances for the ‘trust’ (β = 1.288, p<0.01) and ‘satisfaction’ (β = 0.945, p<0.01) outcome variables. Due to singularity within the fitted linear models, hierarchical Bayes models were used to corroborate the size of these interactions. Conclusions: The results of this trial suggest that a fully powered clustered RCT would likely be feasible in the UK. In this case, the primary challenge in the execution of the trial was the recruitment of FBOs: despite high levels of initial interest from four chains, only one took part. However, it is likely that the proliferation of COVID-19 adversely impacted chain participation – two other FBOs withdrew during branch eligibility assessment and selection, citing COVID-19 as a barrier. COVID-19 also likely lowered the on-site survey response rate: a significant negative Pearson correlation was observed between daily survey completions and COVID-19 cases in the UK, highlighting a likely relationship between the two. Limitations: The trial was quasi-random: selection of branches, pair matching and allocation to treatment/control groups were not systematically conducted. These processes were undertaken by a representative from the FBO’s Safety and Quality Assurance team (with oversight from Kantar representatives on pair matching), as a result of the chain’s internal operational restrictions.

Our rapid evidence assessment aimed to develop an understanding of the international provision of allergen information in the non-prepacked food sector. A mixed-methods approach was used, including a rapid literature and data review, stakeholder interviews, as well as co-production panel review with our advisor (Dr Audrey DunnGalvin) and members of Allergy UK and the FSA. We found legislation on nine of the 18 countries within the scope for this project. These included three EU countries who have also brought in additional national requirements to EU legislation (Lithuania, Republic of Ireland, and Netherlands); two non-EU countries that align to EU legislation and have additional legislation in place (Switzerland, and Norway); three non-European countries (US, Philippines, and Canada) have legislation in place or draft form; and the UK. While legislation was not found in English for the other countries, all 27 EU member states follow the EU legislation as a minimum requirement. The UK follows EU legislation as we were a member state at the time of implementation. The UK has since left the EU; however the legislation has been retained. The UK has additional legislation for food that is prepacked for direct sale (PPDS), but not other types of non-prepacked food. There is considerable variation across countries and regions, in terms of type of allergens and foods covered, the required format of provision of allergen information (e.g., verbal or written) and the food establishments included within the legislation. Across all countries included within the review, the use of precautionary allergen labelling was voluntary. The overall objective of this rapid evidence assessment was to develop recommendations for the FSA to inform future policy and regulation decisions based on evidence of ‘what works’. However, the reviewed literature provided no evidence of whether approaches are associated with improved safety, compliance, unintended consequences, or feasibility. We were also unable to infer effectiveness via data on reported trends in deaths or incidents pre and post implementation of legislation, as these data was not found for any country. Similarly, there was not enough evidence to allow a systematic analysis of incidents associated with different types or categories of food business operators (FBOs) selling non-prepacked foods. We are therefore unable to provide clear recommendations of ‘what works’ from the evidence. We have instead gathered information on the ideas or potential solutions suggested in the literature.
