Resumo:

The mental health costs of divorce are staggering: no variable has been more consistently associated with the distribution of psychopathology in the population. Although the literature contains many descriptive guides for the treatment of the divorced, few empirical investigations of specific intervention strategies exist. This study sought to evaluate the effectiveness of one such treatment program, Divorce Recovery of Tucson. Three hypotheses were tested in the study. The first predicted that participants in Divorce Recovery would make greater progress in completing the social and psychological tasks of divorce adjustment than would a contrast group of divorced individuals. The second hypothesis posed a similar advantage for Divorce Recovery participants in the area of general psychological health, as measured by a symptom checklist, the SCL-90-R. The last predicted a moderately strong negative correlation between levels of symptomatology and adjustment to divorce, in the hope of aiding in the validation of a new instrument, the Fisher Divorce Adjustment Scale (FDAS). The study's treatment group consisted of 46 participants in Divorce Recovery, while the contrast group of 45 was drawn from separated or divorced volunteers residing primarily in Ventura County, California. Both groups completed the FDAS and SCL-90-R at ten week intervals, treatment group subjects doing so before and after attending a support group. The results provided partial support for the study's first hypothesis. In general, participation in Divorce Recovery facilitated the intrapersonal, rather than the social, tasks posed by divorce. More specifically, results obtained using the analysis of variance indicated a statistically significant advantage for the treatment group in the area of disentanglement from the love relationship, and clinically significant trends favoring the treatment group in the areas of self-esteem and resolution of anger. The second hypothesis found very mild support, with some weak trends present which favored the treatment group. The study's third hypothesis was confirmed, as moderately strong negative correlations were obtained between the FDAS and the SCL-90-R. Implications of the results for both theory and treatment are discussed, issues of internal validity and generalizability are explored, and suggestions for future studies are made.

Además de ser un determinante de la dinámica familiar, las separaciones conyugales son un elemento central de los sistemas de nupcialidad, y una variable clave para entender las tasas de fecundidad de un país. De igual manera, es un evento demográfico que expresa cambios sociales, relacionados principalmente con la mayor participación de las mujeres en el espacio público, el aumento de la cohabitación, y con las transformaciones de los valores asociados con la vida en pareja, la reproducción y los procesos de individualización, tal como ha sido propuesto por la teoría de la Segunda Transición Demográfica o por la perspectiva de la Revolución del Género. Sin embargo, en Latinoamérica, los contextos de profunda desigualdad social y de género complejizan el análisis de la separación conyugal, haciendo que dicho evento tenga múltiples significados sociales. La presente tesis constituye un aporte relevante para el estudio de la separación conyugal, que actualiza las estimaciones disponibles, confirma los hallazgos previos y profundiza el conocimiento de los procesos alrededor de este evento. Se propone contribuir al conocimiento sociodemográfico de la separación conyugal en Colombia a través de medición de la intensidad y el calendario de la disolución de la primera unión, teniendo en cuenta cuatro ejes de análisis: a) el generacional, para cuantificar el cambio temporal; b) el relacionado con las características de la unión en términos del arreglo conyugal (matrimonios vs unión libre) y el sexo de la pareja (uniones de sexo opuesto y del mismo sexo); c) el educativo como proxy de la condición social, y, d) el geográfico, relativo a la zona (urbana vs rural), y la región de residencia a distintas escalas. La tesis combina el análisis de fuentes transversales y longitudinales. Entre las primeras se incluye el procesamiento de los Censos de Población de 1964, 1973, 1985, 1993 y 2005; así como la Encuesta Mundial de Fecundidad de 1976 (EMF), y siete Encuestas de Demografía y Salud (DHS por su sigla en inglés) para el periodo 1986-2015. Entre las fuentes longitudinales se analizaron las dos únicas encuestas que recogen las historias de unión de la población: la EMF de 1976 y la DHS de 2015, que por primera vez incorpora a los hombres en su cuestionario individual, permitiendo así, considerar la perspectiva de los varones. Adicionalmente, como otro elemento innovador, la presente tesis incluye a las parejas del mismo sexo en el estudio de la disolución de las uniones. Los resultados de la tesis indican que Colombia ha presentado un aumento de la separación conyugal en los últimos 50 años, haciendo que en 2015 su tasa de disolución sea de 411 por mil uniones. De esta manera se ubicaría por encima de países como México, Georgia, Italia y España. De igual forma, y similar a la tendencia global, las uniones contemporáneas tienen mayor riesgo de ruptura en comparación con las uniones iniciadas antes de 1991. No obstante, estas diferencias se matizan de forma substantiva cuando se incluye el tipo de unión, pues si bien tanto los matrimonios como las uniones libres duran menos hoy en día, en estas últimas los valores son mucho más elevados. De esta manera, además de confirmar el mayor riesgo de ruptura exhibido por las uniones libres. Otro eje de diferenciación es el sexo de la pareja. En conjunto, las parejas del mismo sexo exhiben un menor riesgo de ruptura que las parejas de sexo diferente. Sin embargo, cuando se considera el tipo de unión se observa que los matrimonios son los que tienen el menor riesgo, seguido de las uniones del mismo sexo tanto de mujeres como de hombres, y finalmente, las uniones libres.
Union dissolution is a central component of nuptiality systems and family dynamics. In the same way, is a demographic event that is connected to wider social changes, mainly the greater participation of women in the public sphere and the rise in cohabitation. It is also linked to the transformations of values associated with living as a couple, reproduction and the processes of individualization, as has been proposed by the theory of the Second Demographic Transition or by the Gender Revolution perspective. However, Latin America is a region of profound social and gender inequality making union dissolution an event with heterogeneous meanings. This thesis constitutes a relevant contribution to the study of union dissolution, which updates the available estimates, confirms previous findings and deepens the knowledge of processes surrounding this event. Its aim of this dissertation is to contribute to the sociodemographic knowledge of the dissolution of first union dissolution in Colombia through estimating its level and variations according to four analysis axes. The generational axis (a), to quantify temporal changes; b) variation according to union characteristics including marital status and sex-composition; c) educational attainment as a proxy for social status, and, d) the geographical axis, relative to the habitat (urban versus rural), and region of residence on different scales. Throughout the study, the analysis combines transversal and longitudinal sources. The first includes Population Censuses of 1964, 1973, 1985, 1993 and 2005; as well as the 1976 World Fertility Survey (WFS) and seven Demographic and Health Surveys (DHS) for the 1986-2015 period. Among the longitudinal sources, the 1976 WFS and the 2015 DHS are the only surveys that collect union-histories at the national level. The latter one incorporates men in their sample, and therefore allows considering their perspective on union dissolution. Main findings indicate that Colombia has presented an increase in union disruption during the last 50 years, causing that in 2015 its dissolution rate is 411 per thousand unions. This is a number above those observed for countries such as Mexico, Georgia, Italy, and Spain. Similarly to the global trend, partnerships of younger cohorts have a greater risk of disruption compared to the unions initiated before 1991. However, these differences are nuanced in an important way when the type of union is included, because although both marriages and cohabitation last less today, in the latter one instability is much higher. Another axis of differentiation is the sex of the partner. Collectively, same-sex couples exhibit a lower risk of break-up than different-sex couples. However, when considering the type of union, it is observed that marriages have the lowest risk, followed by same-sex unions of both women and men, and finally, cohabitation.

This research study was of the making and administration of Divorce Court Supervision Orders. Although established in England and Wales in 1958, there has been no detailed examination of supervision in domestic proceedings. In the 1979 period, when the population was obtained, 6,935 Divorce Court Supervision Orders were made. This figure has reduced to approximately 5,000 in 1985, with a total of 26,50C) ongoing orders. The population consisted of 121 children in 62 family units. Supervision could be undertaken by both probation officers or social workers. A review was undertaken of the original intentions of Divorce Court Supervision Orders as conceived by the Royal Commission on Marriage and Divorce 1951-55, and any subsequent amendments by legislation. Particular emphasis is also given to changing aspects of family law which might affect provision for children the history of social work to children in divorce proceedings was also examined. A detailed analysis was undertaken of descriptive material, on the place of children in divorce proceedings. This included research studies on the effects of divorce on children and any changes in the provision of services to parents and their children at the time of divorce proceedings. A full explanation is given of concepts such as conciliation. The original theoretical framework, placed the study of Divorce Court Supervision orders, in the wider context of the social policy of divorce proceedings. Reference is made to principles of family law and the possible relevance of a Juvenile Justice framework to the Divorce Court. In addition, Weber's concept of legitimacy was applied to the examination of Divorce Court Supervision Orders. The original research design, indicated the specific purposes of the research, which relate directly to the principles of a juvenile justice system. Details were given of the interview procedure, experience survey, identification of the validity and reliability considerations and the tests to be applied. The findings of the research are outlined in two chapters. They concentrate on the history of the families concerned, the nature of the divorce process and the details of Welfare Report recommendations. Due to the absence of any study of the process of supervision, as opposed to limited studies on the content of Divorce Court Welfare Reports, one chapter describes in some depth, the process of supervision. The analysis uses a combination of statistical tests and case examples. The use of case examples can illustrate most effectively the nature of the supervision provided. A section of the final empirical chapter addresses validity questions, by examination of what organisations a supervising officer had contact with during their involvement with a family, and the degree of continued jurisdiction of the Divorce Court over the supervision undertaken. A review of the main findings asks fundamental questions about the benevolence or control provided in domestic supervision. The final chapter places the present study, in the changing context of social work with children and their parents, involved in divorce proceedings. Child protectionism was identified as a fundamental principle, in spite of the last thirty years of reforms in family law. In addition, the final chapter questions the desirability of continued confusion over better services to divorcing parents and their children and child-protectionist based interventions by social work agencies. Parallels are drawn between the present study and other aspects of family law involving social work agencies. Throughout the research study, it was emphasised that the present research is exploratory and where appropriate, future areas of appropriate research were indicated.

This study was designed to assess the difference in litigation between two courts: one mandating For Kids' Sake, a psycho-educational seminar for divorcing parents, and the other not so mandating. The level of difficulty of children's adjustment to divorce has been positively correlated with parental hostility. More hostile parents would have more contested cases, interim motions, and relitigations. This research compared final dispositions, interim motions, and relitigation between parents in two courts in Collin County, Texas. The treatment group was from the 219th District Court which mandated all divorcing parents with minor children to attend the For Kids' Sake Seminar and the control group was from the 199th District Court which did not so mandate. Archival data was collected from a computer generated list for the Total group data to assess final dispositions and directly from District Clerk files for the In-Depth group data to assess interim motions and relitigation. The Total group was comprised of 679 research subjects with 330 cases in the treatment group and 349 cases in the control group. The In-Depth group consisted of 182 cases from both courts with 84 cases in the treatment group and 98 cases in the control group. Chi square analysis of the total group revealed significantly more parents in the treatment group who non suited the divorce suit and remained married (p. < .05), a significantly lower number of cases in the treatment group with interim motions (p. < .10), and a significantly lower amount of relitigation in the treatment group (p. < .05). The results showed that the court that mandated For Kids' Sake evidenced a reduction in subsequent litigation which not only benefits the legal system but also hopefully reflects lower parental hostility and higher parental cooperation, thereby benefiting the children of divorce.

This dissertation consists of two parts: a cultural study of divorce in early medieval China and a literary study of the divorced woman as represented in various early medieval Chinese writings, including literary and historical writings, legal, ritual and medical texts, and tomb epitaphs. A comparison between the rites, norms and regulations prescribed for women in ritual classics, and women’s lived experiences as recounted in historical writings, shows a greater discrepancy between norm and practice in the early medieval period than in later periods. Normative prescriptions were generally not followed by women of this period, and women enjoyed a more relaxed social and familial environment than their late imperial counterparts. The gap between norm and practice was extended into many areas of familial and social life, including marriage and divorce. An examination of actual divorce cases reveals that neither the Seven Conditions (qichu 七出) nor the Three Prohibitions (sanbuqu 三不去) were strictly adhered to when divorce took place. Divorce happened to people from all levels of society, and could be initiated by both men and women for reasons outside of the Seven Conditions and the Three Prohibitions. Divorce was not regarded as a social taboo in early medieval China. The unstable social and political environment that characterizes the early medieval period gave rise to some ritual deviations and anomalies, among which was the two-principal-wives (liangdi 兩嫡) phenomenon. Debates and discussions on this marital predicament anchored on the issue of divorce, that is, how should the martial status of the two wives be defined? A thorny case of a sixth-century liangdi dilemma reveals that during the long divide between north and south, the contestation between wives for the principal wife status mirrored the contention for cultural supremacy and political legitimacy between northern and southern elite. Generally speaking, divorced women were not stigmatized in early medieval China, and remarriage was an acceptable recourse for them. Historians appeared to be indifferent to her plight, and tended to write of the divorced woman only to help tell the story of the man who divorced her. In contrast, in poetic writings, the divorced woman was not viewed only in relation to her ex-husband. She was instead a disconnected, isolated figure, and her emotions took center stage. This comparison reveals that the image of the divorced woman in early medieval China reflects both the mindset of the men who formulate her in writing, as well as the constraints imposed by each writing genre.

Economic literature attempts to explain the effect of divorce law on divorce rates. Mutual consent divorce law was promulgated in the 1970âs. Although this amendment was a reflection of the social change occurring in the United States of America, unilateral divorce was still feared because some expected it to increase divorce rate. Friedberg and Wolfers made big contributions in this field of study. Friedberg believed that divorce rates have increased as a result of the law change while Wolfers agrees that an initial spike is clear but argues that the effect of the new legislations dissipates with time. I adjust the data they use to take into account separation requirements which they have not considered or merely thought of as an extra cost. Some states did require individuals to separate for a certain amount of time before granting them divorce. I use the same regressions as Friedberg and Wolfers for the same period of time but with a different dependant variable: divorce initiation rate. My results then differ when aligning divorces with the period when they got initiated. I conclude that Friedberg overestimated the effect but that the effect did persist and did not disappear like Wolfers claimed.

Further, it will try to determine whether pre-divorce interparental conflict, time spent with the mother, and the mother's adjustment affects the problem behavior reported for children. Esta dissertação de mestrado pretende discutir a parentalidade após o divórcio e suas repercussões na vida dos filhos. A partir das transformações nas configurações da família contemporânea, investigaram-se as consequências psíquicas do fim da conjugalidade no sujeito, em relação ao seu narcisismo e à possibilidade de elaboração da separação. Desenvolveu-se uma pesquisa qualitativa com quatro pais e quatro mães separados, baseada na realização de entrevistas semiestruturadas. Os resultados foram analisados de acordo com o método de análise de conteúdo. Verificou-se que a separação pode ser uma grande ferida no amor próprio dos membros do ex-casal, dificultando a vivência do luto pelo fim do casamento. Nesse contexto, as fronteiras entre a conjugalidade e a parentalidade ficam pouco delimitadas, afetando a relação com os filhos. Evidenciou-se que a forma na qual o divórcio foi vivido, individualmente, impacta as possibilidades de reorganização familiar após a ruptura. Nesse sentido, a coparentalidade se mostrou potencialmente difícil de ser exercida, implicando em grandes transformações na vida dos filhos.
The purpose of this master s thesis is to discuss parenting after divorce and its repercussions in the children s lives. Taking into account the transformations in contemporary family settings, the study investigates the psychic consequences of the end of marital relations upon the subject, regarding his/her narcissism and the possibility of elaborating the separation. The author conducted a qualitative research with four fathers and four mothers, performing semi-structured interviews and studying the results using the content analysis method. Findings indicate that the separation may inflict a major wound in the self-love of former members of the couple, hindering the grieving process caused by the end of marriage. In this context, the boundaries between marital relations and parenting became unclear, affecting parent-child relations. Evidence shows that the way in which subjects experience divorce, individually, has an impact on the possibilities of family reorganization after the breakup. In this sense, co-parenting seemed potentially difficult, involving major transformations in the children s lives.

Il ne fait aucun doute que les enjeux sont clairement définis par la faute, cause de divorce car « les fautes qui font le divorce dessinent en creux les devoirs du mariage », et le divorce constitue la sanction légitime de la violation des obligations conjugales. En effet, que deviendraient alors les devoirs du mariage s’ils n’étaient plus réduits qu’à leurs obligations naturelles, accompagnées d’aucune sanction en cas de violation ? Si cette hypothèse était le droit, force est de constater alors que le mariage ne serait plus appréhendé au travers du prisme d’obligations juridiquement sanctionnables. Madame le professeur Monéger a raison d’affirmer « qu’il est difficile de réformer le divorce sans réformer le mariage ». Dans ces conditions, il semble bien que la conception du divorce façonne celle du mariage. Il semble alors impossible de se départir de la faute cause de divorce sans en affecter le mariage. Elle semble être essentielle. Il n’est donc pas étonnant qu’elle se trouve au carrefour de la morale et du droit, y compris du droit pénal, auquel le divorce pour faute emprunte le vocabulaire de coupable, d’innocent, et se rapproche de sa source et de ses notions. Elle méconnaît particulièrement les règles du mariage et peut se définir selon Lévy comme « la confiance légitime trompée ». Elle se retrouve partout pour couvrir toutes les situations que la morale conjugale réprouve. Cette affirmation vise bien évidemment la violation des devoirs et obligations du mariage. Ce dernier est intimement lié à l’idée de règles. Pour s’en convaincre, il suffit de se référer à l’article 212 du code civil qui énumère justement les devoirs et obligations imposés par le mariage. Le mariage est donc fait de commandements, d’ordres, de prescriptions voire surtout d’interdictions. Les devoirs et obligations du mariage régissent les rapports conjugaux, ils apparaissent donc comme des règles de conduite dont la violation constitue une faute, la sanction qui y est attachée est le prononcé du divorce. Cette sanction est le pouvoir reconnu à une institution mais aussi aux époux qui peuvent demander à l’autre conjoint, en cas d’inobservation des prescriptions du mariage, de répondre de ses actes et de sa responsabilité dans l’échec de l’union conjugale. La situation est donc différente de celle qui existe dans les rapports purement contractuels. Il est donc normal que le divorce pour faute constitue la sanction de l’inobservation des interdits matrimoniaux, il est en quelque sorte l’épée de Damoclès suspendue au dessus de la tête du délinquant conjugal et peut-être a-t-il pour certains un effet prophylactique ? Il correspond à la sanction civile rétributive des comportements anti-conjugaux. La faute, cause de divorce, est particulière car elle est une notion civile qui se rapproche en beaucoup de points des notions pénales. Ce faisant, le divorce pour faute apparaît comme étant indispensable au mariage. Son but est le même que celui du droit pénal, réprimer la violation de valeurs fondamentales régissant la vie sociale. Autrement dit, la transgression des devoirs et obligations du mariage appelle nécessairement une sanction spécifique propre au droit de la famille parce que le mariage « est une institution dont le sens et la finalité dépassent les volontés individuelles, » il « instaure entre les époux un ensemble de devoirs d’ordre personnel dont le régime échappe, pour l’essentiel, au pouvoir des conjoints », donc à toute logique contractuelle. L’analogie entre la faute, cause de divorce et le droit pénal constitue, il faut bien le dire, un trait cardinal qu’il ne faut jamais perdre de vue si on veut appréhender la faute, cause de divorce, dans toute sa dimension. Il appert que de telles affirmations, un tel poids, un tel pouvoir et missions conférés à cette faute sont de nature à accentuer la conviction profonde qu’elle mérite un examen minutieux de sa structure et de son fonctionnement afin d’en retirer la substance. Aussi, cette exploration offrira une meilleure compréhension de sa nature, de son objet, de sa fonction, de son caractère incontournable, bref de son lien indéfectible avec le mariage. Pour la saisir précisément, il faut la surprendre parce qu’elle est aussi protéiforme, c’est sans doute pour cette raison qu’il est nécessaire de l’aborder dans ses nuances, c'est-à-dire de l’analyser au travers de son histoire, de ses vicissitudes qui permettent de mieux comprendre sa « mue » définitive en un concept large et générique (Première partie) capable d’identifier et de sanctionner toute infraction commise contre l’éthique conjugale. (Deuxième partie).
