Texto completo da fonteWe tried answer the question of what should constitute the basis of the degree of openness of an economy where the doestic government anticipates a distorsion to competition from the foreign government. Through the measue of compensation that we offer, we called off anticipated commercial rates, we established the degree of openness of the domestic economy on the domestic government's ability to impose reparations the domestic firm (where the foreign government is shift the equilibrium Cournot-Nash to a Stackelberg equilibrium is unfavorable to the domestic business, but favorable to the foreign firm). The anticipated commercial rate of compensation would puncture a portion of the total income of the foreign firm to the Stackelberg equilibrium when the foreign government distorts (grant awarded to his company) competition. This tapping will highlight the potential production quota (openness) that the domestic government will give the foreign firm if domestic government anticipates a distortion to competition from the foreign government. In addition, it appears that the basis of openness of the domestic economy will also depend on the one hand, subsidy levels implemented by the foreign government and secondly, the relative competitiveness of foreign company in relation to the domestic firm. More on this competitiveness is for the domestic firm, less domestic government will be tempted to open its economy (as the foreign government is obliged to carry high levels of subsidy to make up the domestic business). Conversely, the greater the relative competitiveness is in favor of the foreign firm, the higher thedomestic government will be tempted to open its economy

Texto completo da fonteAs an economic concept, the notion of distortion of competition refers to the effect of State intervention in the economy. Although this notion has been formally transposed into European Union law, it is nevertheless perceived as ill-defined in legal terms. Indeed, what it designates remains unclear, and the multiplicity of meanings that can be construed from this expression makes its conceptualization difficult. However, despite the diversity of potential interpretations, it is possible to conceive the notion of distortion of competition as an operational legal concept. To reach that point, it was necessary to develop a general theory of the notion of distortion of competition. Thus, this doctoral dissertation aims to identify the legal meaning and scope of the notion of distortion of competition as it manifests itself in positive law, in order to suggest a unitary definition of the notion. Once conceptualized, it is then possible to determine the legal regime applicable to the notion of distortion of competition, and to specify the conditions under which it should be banned or, on the contrary, permitted

So there are critical judgements aimed at the way of financing the social security of industry and trade wage-earners (official and collective agreement). But in fact this is employment that is really concerned; the whole tax system (special levies and the taxation system) tends to promote the substitution of labor for capital or to exclude labor from the process of production. On the other hand if we consider competitiveness and competition, we can't speak of distortion. It would be wrong to say that the french firm's competitiveness is penalized for it has support a very high level of national insurance contributions. At the international level, the comparison shault concern the whold wages. The discriminating effect of the basis of insurance contributions depends on what you take as reference. If we compare the whole insurance contributions with the gross income, we can say that firms with a high proportion of labor are favoured. So the criterior of reference to determine the discriminating effect plays an important part. Competitiveness, employment and competition are influenced differently according to the financing of the social security. Meanwhile in the spirit of employers these factors are tightly lirked

Texto completo da fonteThe first part develops a theory of distortions of competition among competing firms, induced by differences in the method and/or stringency of national allocation of greenhouse gas emission permits in an international emissions trading system. By applying neoclassical theory on output optimisation, price setting and other factors such as R&D expenditures, five potentially distorting effects are identified for perfect and imperfect markets. The second part develops economic indicators and a two tier approach, which can be applied empirically, in order to test wether an industry is vulnerable to the potential effects found before. The third part applies the two tier approach empirically to four sectors of the energy intensive in the EU : steel making, cement, oil refining and electricity generation. The steel industry is the most vulnerable industry, followed by oil refining, whereas cement and electricity are not vulnerable. At a permit price of 20€/ton CO2, and with national allocations that differ more tha 40% in terms of allowed emissions per ton product output, this thesis predicts that some steel makers would be forced out of the market

Texto completo da fonteThe growing number of investments made by sovereign wealth funds and the reactions of host countries has raised questions regarding the tax treatment of those public financial entities. Answering these questions implies to analyze the tax legislation on both a national and international level. In this respect this paper compares the direct taxation of sovereign wealth funds investments in France and in the United States. It is then followed by an analysis of some tax treaties signed by France as well as tax treaties signed by countries owning sovereign wealth funds. Questions related to the application of tax treaties to sovereign wealth funds are examined through the presentation of the OECD model tax convention and the United States income model tax convention. We then compare the tax status of sovereign wealth funds and private investors regarding tax competition and portfolio choices. We will see through the lack of tax regulations, guidance and the absence of court decision that this study is mainly based on an interpretation of the facts and the law as a consequence. The solutions provided in this paper aim at clarifying the issues we have identified. Hopefully this will raise further interrogations and will be followed by other studies
