Yet, it clearly appears that, due to the increasing importance of information in a wide range of activities, telecommunications are valuable tools that can help build development dynamics. Indeed, information, which circulates by means of telecommunications, has come to be with no doubt a strategic resource. Moreover, telecommunications raise in original terms the issue of connection between local and national economics and world economy. Knowing these facts, the study here presented aimed to show, using theoretical consideration and several practical case studies, how modern telecommunications do contribute or could better contribute to development dynamics in a poor country environment like Côte d'Ivoire

Texto completo da fonteIvorian constitutional justice, in its current form, is the fruit of the democratization movement launched on the continent from the 1990s. But if elsewhere the exercise of constitutional review immediately became an essential instrument in the effectiveness of the Constitution and the advent of the rule of law, in Côte d'Ivoire, the guarantee of the the Constitution’s supremacy has evolved continuously at an oscillatory rhythm. The constitutionality check is first expressed through a strategy of small steps. The constitutional judge's choice of a narrow interpretation of his attributions produces a daring case law geared towards legitimizing the executive power and its governance. Subsequently, with the advent of the second Republic from the year 2000, the constitutional jurisdiction is relatively more active. But despite the extension of the right of referral to citizens through the preliminary question, constitutional justice remains insensitive to the protection of fundamental rights and freedoms. Its dynamism manifests itself especially when the Constitution is confronted to the Political Agreements, mobilized for the resolution of the military political crisis. The office of the constitutional judge is then revealed as the defense of the constitutional order in danger or the regime embodying it. Here again there is the strong irradiation of the executive power in an unbalanced political system converging, like rivers in the river, all the institutions in the sense of the majesty of the constitutional Pontiff. Moreover, the preponderance of electoral disputes and the crises it provokes, annihilates, almost systematically, the progress of the case law that can give credibility to constitutional justice. In this context, the guarantee of the supremacy of the Constitution remains at an embryonic stage, marked by the seal of precariousness imposed by perverted constitutional practices and chronic political instability

For that reasib, which gave no way to neutralism (even some africain leaders like n'krumah, ben bella, nasser - have verbally enjoin the positive neutra- lism), the new african states had then to choose their camp. Under these circumstances, five west African states -Ivory Coast, Dehomey (presently Benin), Niger, Togo, upper volta (became Burkina Faso), which form the "conseil de l'entente", -declare for solidarity with occident against the socialist block. The promoters of this organisation -felix houphouet-boigny, hubert maga, maurice yameogo, diori hamani and their successors -explain their anticommunism by the atheims, the subsersive ways and the rejection of the liberty of that doctrine. It follows that these states opt frankly for the liberalism. But, by the force of circumstances, they will come to pull up to the Eastern countries. However, this overture result in desillu- sions, especially in the matter of economic cooperation, including Benin, became marxist-leninist (1974) and Burkina Faso, placed itself in the socia- list camp (1983). As a consequence, the soviet block will never achieve to disqualify the western countries in the five states where their supremacy remains indisputable

Texto completo da fonteThe resolution of the Ivorian crisis requires the holding of an inclusive presidential election. On the basis of the Pretoria Agreement and in accordance with Security Council Resolution 1765 (2005) establishing the certification mandate, the United Nations throughout the Special Representative of the Secretary-General were involved in the electoral process.The certification of the Ivorian electoral process constitutes an unprecedented electoral activity at the heart of national sovereignty. Indeed, the management of the electoral process by national bodies and an international body built on a hybrid legal framework, including national law and international law, to safe-guard the results of the presidential election. The acceptance of the certification’s mechanism by the national authorities in this stately process modifies substantially the traditional hierarchy of the norms which assigns to the Constitution and the Constitutional Council a privileged place in the internal and external reports.Thus, the implementation of the Special Representative’s mandate deprives all binding force from the Constitutional Council’s decision, which is supposed to have the authority of res judicata. The United Nations certification’ statement grants international legitimacy and credibility to the candidate proclaimed by the Independent Electoral Commission to the detriment of the candidate proclaimed victor by the Constitutional Council. This situation urges the Ivorian Constitutional Council to recant, and recognizes the superiority of certification on its decision

Texto completo da fonteHe failure of the United Nations Restore Hope operation in Somalia under the leadership of the United States of America and the 1994 Rwandan genocide altered the Western world's relationship to internal armed conflict in Africa. From an initial desire to strengthen the capacity of African actors to manage conflicts within African states, the Western world adopted a position of disengagement from internal conflict in Africa. The United States’ Presidential Decision Directive 25 of May 3, 1994 and the recommendation of the Belgian Senate of January 28, 1998 are particularly significant in terms of changing the Western world’s attitude in favor of Africa in conflict. However, and "going against the current," the United Kingdom on the one hand and France on the other hand have decided to shoulder their share of historical responsibility in the fate of their former colonies in Africa. For these two former colonial powers, the internal difficulties facing the post-Cold War African states were real challenges which these states needed assistance in dealing with. This commitment on both sides of the Channel helped to stabilize and restore peace in two African states in the Rwandan post-genocide era, namely Sierra Leone and Ivory Coast. How did the United Kingdom and France manage to stabilize Sierra Leone and Ivory Coast and extricate them from seemingly intractable conflicts, given the depth of the differences between the actors? What strategic adjustments did the United Kingdom and France make in their interventionist policies in the context of the resolution of internal armed conflicts in Sierra Leone and Ivory Coast, and what actions did they take to achieve success in both these countries? Through a review of the literature as well as through interviews of diplomats, politicians, military leaders and other actors, this thesis demonstrates how, through a synergy of well-coordinated actions, the United Kingdom and France brought peace and tranquility to Sierra Leone and Ivory Coast. Having done so, these two middle-ranking powers, permanent members of the United Nations Security Council, gave Africa and the world reason to believe in international interventions

Texto completo da fonteThe research was aimed at understanding by means of which developments in the political and legal thinking the R2P finally reached its present shape. To this end, we analyzed on one side the evolution of the concept of absolute sovereignty and the shift towards an increased involvement of the international community in the internal affairs of the individual states, and, on the other side, the modifications incurred in the concept of intervention for humanitarian purposes and the lessons learned out of the experiences of the 1990s. We have argued that what R2P is, or is not, should be understood in the light of this long development. Having then established what now R2P is about we wanted to measure to which extent R2P was able, in the ten years of its existence, to influence the behavior of the international community, and in particular of the United Nations Security Council. Hence, we selected four cases – Libya, Côte d’Ivoire Sri Lanka and Syria – where R2P was invoked or should have been invoked, with the aim of finding regularities useful for guiding future action. Our research hypothesis was that R2P is influenced by five main independent variables, namely: the dynamic within the Security Council (active involvement of some specific countries/country representatives); reasonable perspective of success/attractive cost-benefit profile; the role of the relevant regional/sub-regional organizations; the activity of the Human Rights Council; and the action of civil society
