Thesis (MTh (Old and New Testament))--University of Stellenbosch, 2006.
The aim of this thesis is to explore the trends that are found in commentaries on the book of Exodus and their appropriateness in the African context. The study also seeks to move from a socio-political understanding of Exodus as liberation theology to the cultural understanding of Exodus as African theology. The following three trends are found in modern commentaries on Exodus as explored by this thesis: • Historical-critical approach – dealing with the world behind the text or author centred criticism. Commentaries found under this group include those of M Noth (1962), TE Fretheim (1990), N Sarna (1991), B S Childs (1977) and WHC Propp (1999). • Literary-critical approach – this deals with the text itself or it is text centred. Commentaries found in this category include: W Brueggemann (1994), J G Janzen (1997) and C Houtman (1993). • Theological-critical approach – deals with the world in front of the text. Commentaries of GV Pixley (1987), J Durham (1987) and G Ashby (1998) are good examples of the latter named approach. Exploration into the study of the above listed three trends and their corresponding modern commentaries show that the commentaries are not fully appropriate in the context of Africa (except Ashby). This is so because the above modern commentaries have not directly addressed the ongoing issues of poverty, political, economic, oppression, marginalization, HIV / AIDS, cultural and social issues, famine, racial and sex discrimination, religious crises, and other epidemics and natural disasters prominently found in Africa - particularly among the third world countries. The modern commentaries mentioned above are indirectly relevant for Africa since the topics which they address, resonate with the readers and interpreters of Exodus in Africa. This resonance is possible if readers and interpreters of Exodus in Africa find similarities between modern commentaries and their own current context. The study also shows that the three trends found in modern commentaries on Exodus are dependent on one another to bring forth a meaningful interpretation. Based on this working relationship between the three trends mentioned above, it is suggested that the three trends should be considered in close connection with one another. Biblical interpretation in Africa must do justice to the literary, historical and theological aspects of the Bible to be meaningful and appropriate in Africa.

Given the importance of Paul for Dante's characterization of the pilgrim, and his invocation of the Pauline Epistles throughout the Commedia, this thesis began by asking how important Paul was to Dante's fourteenth-century readers. It examines the use of the Pauline Epistles by the Trecento commentators of Dante's Commedia in order to contribute to our understanding of how both were read in late medieval Italy. Part One examines reading practices in the Middle Ages, and introduces commentary writing as a genre. The fourteenth century commentators are then described, with a focus on personal circumstances that may have influenced their interpretations. Part Two examines the use of Paul in the commentaries, differentiating between different forms of citation, such as when the commentators used Paul because they identified Pauline references or allusions in the poem, or when they included Paul in their interpretations for other reasons. This produced close readings of selected commentaries which reveal how the commentators read Paul and understood Dante. Jacopo della Lana used Paul when copying Aquinas, and his knowledge of the Epistles themselves, it is argued, was often confused and inaccurate. Pietro Alighieri repeatedly used Paul in combination with other sources in order implicitly to link canti. Guido da Pisa viewed the Commedia as a prophetic dream vision, and equated Dante with Biblical figures, including Paul. This comparison allowed Guido to justify his use of Dante as a life model for his dedicatee. The commentators acknowledge the importance of Paul when Dante clearly alludes to the Epistles, but in general, they simply use Paul as an authoritative voice. Finally, this thesis demonstrates their understanding of Dante not just as narrator/character, but also as reader.

Chapter One contains a lengthy discussion of tafsír, outlining its meaning, its need to the present study and the different forms in which it exists, whilst at the same time clarifying its obscurities and commending it as an indispensable science. Chapter Two offers a concise overview of five Qur'ánic commentators selected for this particular study. This assessment is based on the eras from which they emerged which has a definite bearing on their commentaries. Chapter Three is a résumé of my subject's biography adopted primarily from Qur'ánic sources. As a frequently mentioned prophet in the Qur'án the story of Músá [p.b.u.h] is drawn from various chapters highlighting substantial aspects of his life. Chapter Four concentrates on two frequently mentioned events in the life of prophet Músá [ p.b.u.h], namely, his call to prophethood and the proclamation to the pharaoh and his people. Chapter Five concludes this work by presenting an overview of the perspectives of the different commentators.

In this dissertation, I explore the history of research of John 10: 1-18, I attempt to make a contribution to the understanding of this very important chapter in John by using Literary Theory for exegetical purposes, draw some conclusions with regard to the Christology of John and open some avenues of the understanding of the significance of the shepherd metaphor for our own context. In John's own time, this chapter definitely had social, religious as well as political significance. I attempt to determine how these facts interact with Jeremiah 23: 1-8 and Ezekiel 34: 1-6. I also draw some conclusions which may serve as guidelines in our own context and especially our own pastoral needs in the situation of conflict in our society, leaders who lead the flock of God astray and the need of unity among Christians.

Hyung, Jun Kim. "A study of Psalm 90". 1998. http://hdl.handle.net/10500/16985.

Resumo:
The pnmary purpose of this dissertation is to define the function of Psalm 90 and its relationship with regard to adjacent psalms. Keeping this purpose in mind, the dissertation is composed of two main parts. The first part deals with textual notes, structural analysis, the date of the psalm and the possible situation it arose from, and then an attempt is made about the function of the psalm. Concerning the structural analysis, this study reveals that the psalm forms a unity in contrast to the views of Muller and Zenger who have argued for the division of the psalm into two parts. The function that the psalm has within itself is to appeal to Yahweh to intervene in the dilemma the psalmist was facing in the exilic or postexilic situation. However, since the psalm itself does not hint at any clue as to what the actual situation for the appeal was, the study is extended to the examination of the canonical perspective with regard to adjacent Psalms 89 and 91. This consists of the second part, and here Psalm 90 is compared to Psalms 89 and 91 in terms of lexical, thematic, and structural aspects. The study of this part shows that Psalm 90 forms close links with the lament section of Psalm 89 (vv. 39-51) as well as Psalm 91, and the conclusion suggests that Psalm 90 should be interpreted in the light of Psalm 89, thus reflecting the destruction of the Davidic dynasty described in Psalm 89. Concerning the relationship between Psalms 90 and 91, the latter serves as an answer to the former in order to persuade the readers that Yahweh 1s a refuge to those who seek security and protection from him.

Johannes, Benhardt Laurentius. "The interpretation of South African double taxation agreements under international law". Diss., 2014. http://hdl.handle.net/2263/41452.

Texto completo da fonte
Resumo:
This dissertation interrogates which principles should govern the interpretation of South African Double Tax Agreements (‘DTAs’). This field of study is complex because any DTAs have a dual nature. In the first place, it is an international agreement where two states are parties (a bilateral agreement); second, it also becomes part of domestic law. DTAs are governed by principles of customary international law some of which have been codified in the Vienna Convention on the Law of Treaties (‘VCLT’). Though South Africa is not a party to the VCLT, nevertheless, there is judicial support in South Africa for the notion that VCLT reflects general principles of international law [Harksen v President of the Republic of South Africa 1998 (2) SA 1011 (C)]. DTAs are incorporated into South African domestic law by way of statutory enactment in accordance with the dualist approach to international law. The first purpose of the dissertation is to systematise and analyse the structure of an OECD Model Tax Convention (‘OEC D MTC’) and the international methods (principles) of interpretation of DTAs in order to gain a better understanding of how this international methods functions. A number of issues relating to the interpretation of these methods are analysed. Since DTAs are applied by tax authorities, courts and taxpayers in a domestic law context, i.e. within the framework of the legal system of a particular state, the analysis focuses on the application in South Africa of the methods of the interpretation of South African DTAs. The second objective of the dissertation refers to international tax law principles (treaties and customary international law) derived from South Africa public international law and to evaluate a few selected issues related to South African DTAs and their relevance to South Africa domestic tax laws; the interpretation of DTAs and the implications of a DTA overriding or in conflict with South Africa domestic tax laws. It will also interrogate the legal status of a DTA under South African tax law and whether the anti-discrimination article in South Africa DTAs have the force of law in South Africa?

Soza, Joel R. "`Knowing the Lord': moral theology in the book of Jeremiah". Thesis, 2005. http://hdl.handle.net/10500/712.

Texto completo da fonte
Resumo:
This thesis is a moral and theological interpretation of the book of Jeremiah (primarily chapters twenty-one through twenty-nine). The prime focus is on the Hebrew term  and associated vocabulary and terminology which enable an understanding of how the book of Jeremiah sets up knowledge of Yahweh as a primary concern. Such a concern reinforces the rhetorical and ethical nature of the textual witness and elevates the significant and profound challenge that is put forth. For instance, Jeremiah 22:16 is a prime example within the book where an understanding of  of Yahweh should be given adequate attention, although it has not in Old Testament scholarship, to arrive at the kind of moral and theological interpretation that is voiced in this ancient Israelite prophet. Knowledge of Yahweh in the text of Jeremiah is to be distinguished from a purely cognitive knowing that removes from the equation, in any way, living a certain kind of life with Yahweh - a life which is measured only by the highest of moral and religious standards. Indeed, there is a direct relationship between a certain kind of action/way of living and a genuine knowledge of Yahweh. Key texts explored in this thesis then, are those which bring the challenge of a true knowledge of Yahweh to the Judean king, priest, prophet, and people. An overall coherent vision of what it means to know Yahweh, the God of Israel, in the text of Jeremiah, is the aim of this thesis.

Burton, Adrian P. "Temples, texts, and taxes: the Bhagavad-gita and the politico-religious identity of the Caitanya sect". Phd thesis, 2000. http://hdl.handle.net/1885/8755.

Resumo:
The Sarartha-varsini is an orthodox Guariya vaisnava commentary on the Bhagavad-gita. This research project aimed to use the text of the Sarartha-varsini as the starting point for an investigation into the Gauriya sect around the time of its composition. The project began by establishing a scholarly edition of the text with the aid of extant manuscripts and available printed editions. A critical edition and translation of the first three chapters are presented in the appendix. As the project progressed, interesting archival material surfaced, and the relationship of the sect with the state of Amber/Jaipur became the focus. The role of Gauriya religious dignitaries in religious debate in Jaipur was investigated, and the issue of sectarian affiliation emerged as an issue for which the text if the Sarartha-varsini was particularly illuminating. Joseph O’Connell and Klaus Klostermaier had done fine academic research on works by the same author and had even touched on this work. Nevertheless, a large amount of groundwork remained to be done to ascertain basic issues such as names, dates, claims of authorship, and other biographical details. Section One and Two of this dissertation review previous scholarship and tradition on these issues and provide new insights from textual analysis and archival investigation. With regard to the politico-religious milieu in Rajasthan, V.S. Bhatnagar, Monika Horstman and Irfan Habib had already performed significant archival research and published extremely useful findings. My study therefore greatly assisted in this area, and this dissertation was able to build on the very solid foundation established by these fine scholars. This study contains reference to many archival documents already published by them, and it introduces a good deal of previously unpublished archival records. Of particular interest are the new records regarding the influence of Visvanatha Cakravarti, Krnadeva Sarvabhauma Bhattacarya, and Baladeva Vidyabhusana. Section Three combines old and new material to create for the first time a ‘historical’ snapshot of these Gauriya dignitaries and the politico-religious issues of their times. The analysis of the sectarian influences on the text of the Sarartha-varsini (Section 4) brings together the historical issues of the era and the edited text. This section provides clear empirical analysis on the sectarian affiliation of the sect in matters of doctrine. The textual evidence clearly indicates that the Gauriya-Madhva affiliation was merely an ‘official’ stance. Evidence from the text points to a much stronger doctrinal allegiance to Sridhara Swami and the Bhagavata-purana. The Bhagavad-gita commentary has provided an invaluable common platform from which to compare the Gauriya sect with other established sects and important commentators.

Arabic text. Arabic summary and keywords cannot be copied into meta data fields
The importance of this research is evident from the field related to it; namely, that of reports about circumstances for Qur’anic revelations. Without a comprehensive knowledge of it, many of the subtleties and nuances of Qur’anic discourse remain concealed from us. For this purpose, I used al-Suyuti’s "Lubab al-Nuqul fi Asbab al-Nuzul" for the pivotal and comprehensive role it occupies among works dealing with this discipline. Briefly, my methodology was the following: I first presented a summary of the author’s biography. Secondly, I edited the manuscript I had obtained of this book from the King Faisal Library in Riyadh, Saudi Arabia. Thirdly, I made comparisons between this version and numerous printed versions of this book in order to verify the authenticity of textual information I presented in this thesis by categorising Prophetic and other reports at the levels of their soundness and weakness so that the reader may obtain a firm insight into their status levels. Fourthly, I amended reports that al-Suyuti had omitted in relation to verses he had cited. Fifthly, I graded different reports on a topic according to established criteria in this subject; often reconciling them where it was possible. I interpreted verses in their general purport by indicating that the report/s relating to the circumstances for revelation was/were already embodied in their signification. I only deviated from this norm where I found that a body of reliable scholars had given preference to a particular report vis-à-vis a certain verse; in which case I adopted their opinion. Sixthly, I attached brief commentaries to relevant verses to enable the reader to gain a more comprehensive grasp of text within its context. Finally, I defined some peculiar terminology found in this book for the benefit of unfamiliar researchers.

Resumo:
Through a critical-functional, rather than literal, reading of the text of Revelation, this dissertation hypothesises a move beyond the paralysing constant reduction of hermeneutic meaning to two conventional poles when discussing hope – the early Christian movement’s hope through reversal, and contemporary nihilism. In order to do so in a responsible manner, it is necessary to study other research done on the topics of eschatology and hope – especially as seen in the book of Revelation. For this reason, the most popular and representative scholars of the Book of Revelation are studied. This overall look at current scholarships' views regarding the Apocalypse will help detect any possible missing elements in our approach to Revelation. But no study of this topic can be considered near complete if other disciplines are not involved; in this case especially when moving on to a critical-functional reading of Revelation. This thesis thus features an exploratory study of the functioning of ritual and hope within the human psyche; from archaeological to psychological perspectives. This emphasises the importance of, and leads into, the possibilities of a functional reading of the Book of Revelation. All of the above work leads to a re-evaluation of the success of hope as metanarrative for today. The suggestion is that Christian hope is not imaginary, but is irreducibly imaginative. For “reality is never just the world as it exists; it is the world as it is experienced through the lenses of social perception” (Barr 2010:636).
