Texto completo da fonteThe return of sortition to politics is now a global social phenomenon, fueled by numerous academic studies, activist claims and democratic experiments. Deliberative mini-publics bring together randomly selected citizens to hear experts and debate to make public policy recommendations. Why is sortition being promoted by both moderate pro-election elites and activists seeking radical democracy? What political dynamics do contemporary uses of the civic lottery promote, oligarchic or democratic reinforcement? This thesis conducts a comparative analysis based on qualitative fieldwork case studies of: the Irish Citizens’ Assemblies (Ireland), the Citizen Convention for Climate, the Great National Debate, and the CESE’s citizen group (France). Four axes are studied: the genesis of the mini-publics, their operation, their effects and legitimacies, and their institutionalizations. A new spirit of sortition based on “humility-legitimacy” might explain in part the paradoxical support that drawing lots enjoys. Critics of election support sortition because humility-legitimacy can contribute to the non-domination of the represented. However, proponents of representative government see the weak legitimacy of consultative mini-publics as a way to incorporate criticism without threatening the foundations of the elitist system. However, humility-legitimacy is potentially threatened by a klerocratic claim to the sovereignty of the randomly selected assembly

Texto completo da fonteThe aim of this dissertation is to characterize the semantic aspects of three assemblies, of an Andalusian village, Marinaleda, of the Nouveau parti anticapitaliste (New anticapitalist party) and, of Nuit debout, by considering the different interactions as the same type, a type that we name political civic assemblies. Any interaction taking place within this type of assembly constitutes a common work of preparation, behind the scenes, of what will be officially shown in the name of the collective, in the public discourse.The approach is situated within the paradigm of argumentative semantics. We adopt and extend the Semantic Block Theory (Carel, 2011) according to which semantic entities are discursive possibilities, as well as the Semantics of social conflicts (Lescano, 2017) which states that discursive possibilities exist in semantic spaces where different discourses - both convergent and antagonistic - act and thereby form the semantic structure of conflicts.The main hypothesis states that any utterance appearing in a political civic assembly is not an action on the convictions of individuals, but rather an instrument of a struggle for the stabilization of certain elements and the destabilization of others in a semantic space. According to this hypothesis, any description of semantic properties of this type of interaction amounts to the study of different actions that utterances perform on the semantic space of an assembly, that is, the installation of particular semantic entities and the production of relations between these entities.By analyze the three assemblies, we observe a series of characteristic phenomena for their semantic functioning: the act of voting which we consider not as a mode of obstructing the decision-making process, but as the means to (de)stabilize the power of speaking; interventions that might seem more central than others, which we consider as results of a construction of networks of asymmetrical semantic relations; mechanisms whereby opposing discourse is discredited, which we consider as a product of dependencies between antagonistic semantic units.Our study shows that the objective of this type of assembly is not to persuade nor to reach a consensus. This could have been a possible objective. Yet, this dissertation affirms that in this particular type of interaction, the participating discourses are structurally oriented towards the (de)stabilization of discursive forces
Esta tesis trata de caracterizar los aspectos semánticos de asambleas de la aldea andaluza de Marinaleda, del partido político francés "Nouveau Parti Anticapitaliste" (NPA) y del movimiento social francés Nuit debout, postulando que las interacciones orales que tienen lugar en estas asambleas pertenecen a un tipo único que llamamos asambleas ciudadanas políticas. En estas asambleas se efectúa un trabajo de preparación previa de los discursos que serán desplegados oficialmente en nombre del colectivo. Nuestro acercamiento, situado en el paradigma de la semántica argumentativa, reafirma y prolonga los principios de la Teoría de los Bloques Semánticos (Carel, 2011) según los cuales las entidades semánticas son únicamente posibilidades discursivas, así como la semántica de los conflictos sociales (Lescano, 2017), que postula que estas posibilidades discursivas existen en espacios semánticos sobres los cuales actúan diferentes discursos, tanto convergentes como antagonistas. Haremos la hipótesis que los enunciados surgen en las asambleas ciudadanas políticas como herramientas de una lucha por la estabilización de algunos elementos y la desestabilización de otros en un espacio semántico - lo cual se opone a la idea que los discursos surgen para actuar sobre las convicciones de los individuos. Desde entonces, describir las propiedades semánticas de este tipo de interacciones es estudiar los tipos de acciones que los enunciados pueden efectuar sobre el espacio semántico de una asamblea, las entidades semánticas que los discursos pueden instalar y las relaciones que se producen entre estas entidades. A partir de la observación de diferentes asambleas, mostraremos fenómenos que caracterizan su funcionamiento semántico : el voto aparece como un dispositivo de (des)estabilización de potencias de habla, y no como un modo de cierre de la decisión; las intervenciones que pueden parecer más centrales que otras son el resultado de la construcción de redes de relaciones semánticas asimétricas; los mecanismos de descrédito del discurso ajeno son determinados por la creación de dependencias entre unidades semánticas antagónicas. Finalmente, nuestro estudio sugiere que el objetivo de este tipo de asambleas no es persuadir ni llegar a un consenso, no porque estos objetivos no sean alcanzables, sino porque los discursos que participan en estas interacciones están estructuralmente orientados hacia la (des)estabilización de potencias discursivas

Texto completo da fonteThe orders issued by the general assemblies of Parisian sections are politic and juridical acts used by the citizens of Paris to express themselves and take decisions. These acts can be local bylaws (applied in the area of the section), as well as petitions addressed to deputies or other authorities. They dealt with various affairs: subsistence, education, the military, public assistance, etc.The first year of French republic, especially from 21st September 1792, to 5th September 1793, see the extension of the electoral body (end of the ownership vote) and the drafting of a new constitution by the Assembly in order to consecrate these rights. New institutional devices are also designed to tackle situations of emergency in a time of war and civil unrest, and they become the foundation of the revolutionary government and the Terror.The study of the production and the diffusion of the decrees of the Parisian sections reveals how the general assemblies are organized and what type of citizenship they shape. Following the course of the decrees after their redaction in the sections, especially in the elected assemblies of the General council of the Paris Commune and the National Convention, one can see how the popular voice is taken into account in the drafting of laws and resulte in political decisions. In other words, it reveals to what extent the voice of the people influence the construction of a new government, the first democratic and representative republic

Texto completo da fonteBy means of significant examples, the present study highlights the uneven achievement of the invocation of the Constitution of 1791 based on the Declaration of the Human Rights and of the Citizen had been implemented within the Parliament debates. This analysis emphasizes the significant effects as for the invocation of these constitutional measures in the normative creation. This invocation showed its limitations in times of crisis. The Declaration of 1789 and the Constitution have repeatedly been used. The main domains in which they have been referred to, are the principle of the separation of powers, the rights and liberties (the liberties, equality and the right of possession). The members of the Assembly have initiated a new civil legislation based on this Constitution. The disappearing of the traditional paternal will, the secularisation of the Civil State, the distinction between religious and civil marriage, all are measures that show this novelty. The modernity of the very text of the Constitution and its application is noticeable in many respects: raising the Declaration to the rank of positive legal rules, planning the new legal system as a hierarchical system at the top of which is the Declaration of the Human Rights and the Constitution. The work of the members of the “Legislative” marks a turning point in the way to lay down the law

Texto completo da fonteWe try to highlight the prevalence and new electoral system established in the first three decades of the nineteenth century, to show that the election, one of the rituals of democracy, has been implemented since 1811 and evolving since, as indicated by processes such as secularization, the pacification of the elections, the introduction of political societies in the electoral competition, openness and acceptance of the political factions in the political issue. We seek to prove that the election was the essence of the republican system implemented by the publicists of the first republics. In fact, the study of elections shows that electoral systems are subject to particular historical moments that determine rituals, techniques and practices of the company, which does not necessarily follow a dynamic shift towards "the improvement.
