The World Trade Center Attack or 9/11 tragedy has awakened the international community, particularly the United States (US) to sharpen its foreign policy in facing security threats coming from ‘weak states’. One of the most prominent weak states examples that pose a grave threat to other countries are the Northern Triangle Countries of Central America that referred to Guatemala, Honduras, and El Salvador. Hence, this paper will discuss the rationale behind US initiatives in dealing with security threats in El Salvador as one of the Northern Triangle Countries. In analyzing the case, the writers will use the weak state concept and national interest concept. The result of this paper finds that El Salvador corresponds to the elements of a weak state and further poses security threats by giving rise to transnational criminal organizations, drug trafficking, and migrant problems in which overcoming those security threats has become US vital national interest. However, we also find that although decreasing security threats and strengthening El Salvador government capacity is highly correlated, strengthening El Salvador governance through the providence of aid and assistance is actually classified as US important national interest. This case is the latest in a series of actions brought in the United States since 1984 that have resulted in court and administrative decisions on the claim of asylum by, and attempt at extradition of, the plaintiff, Joseph Patrick Doherty, a native of Northern Ireland and subject of the United Kingdom and its Colonies. He was admittedly a member of the Provisional Irish Republican Army and was convicted in absentia, in Northern Ireland, of murder of a British Army officer there in 1980. In the instant case, the plaintiff sought review by the United States Court of Appeals for the Second Circuit of two administrative decisions by successive Attorneys General of the United States (one by Edwin Meese in June 1988, and the other by Richard Thornburgh in July 1989).

In response to a request by Canadian tax authorities under the United States-Canada Double Taxation Convention (Convention), the U.S. Internal Revenue Service (IRS) issued summonses to obtain U.S. bank records concerning certain accounts of respondents, Canadian citizens whose Canadian tax liability was under investigation. Respondents sought to quash the summonses, arguing that because under 26 U.S.C. §7609(b) the IRS is prohibited by U.S. law from using its summons authority to obtain information about a U.S. taxpayer once a case is referred to the Justice Department for prosecution, and because the tax investigation of respondents was part of a Canadian criminal investigation, the IRS should be precluded from using its summons authority to honor the Canadian request under the Convention. Unsuccessful in the district court, respondents prevailed in the U.S. Court of Appeals for the Ninth Circuit, which held that under the “good faith” standard applicable to enforcement of domestic summonses, the IRS may issue a summons pursuant to a Convention request only if it first determines and makes an affirmative statement to the effect that the Canadian investigation has not reached a stage analogous to a Justice Department referral by the IRS. The U.S. Supreme Court (per Brennan, J.) reversed, and held: (1) that if the summons is issued in good faith, it is enforceable regardless of whether the Canadian request is directed toward criminal prosecution under Canadian law; and (2) neither United States law nor anything in the text or the ratification history of the Convention supports the imposition of additional requirements. Justice Kennedy (joined by O’Connor, J.), concurring in part and in the judgment, filed a brief opinion to state his view that it is unnecessary to decide whether Senate preratification materials are authoritative sources for treaty interpretation. Justice Scalia, concurring in the judgment, wrote separately to oppose the use of such materials in treaty construction.

In 2020, the Department of Justice (DOJ) filed an antitrust suit against Google alleging that Google has unlawfully monopolized the markets for general search services, search advertising, and general search text advertising. The complaint raises questions involving market definition, monopoly power, and monopolizing conduct. In this article, we examine these issues through the lens of microeconomic principles. Our analysis finds that there is a sound economic rationale for the DOJ’s complaint.

United States Attorney General Merrick Garland issued new Department of Justice guidance for charging, plea, and sentencing policies via two memos: one providing general policies for all criminal cases and a second providing additional policies for drug cases. These latest DOJ policies are generally consistent in many respects with past policies issued by Attorney General Garland’s predecessors, but they break new ground (or revive previously rescinded policies) in several areas: mandatory minimum statutes, statutory sentencing enhancements, the crack/cocaine sentencing disparity, and pretrial diversion. All of these new policies tack in the same direction: ameliorating the harshness of the modern-era federal sentencing regime. Most notably, Attorney General Garland’s Drug Memo seeks to all but do away with the disparity by calling for federal prosecutors to “promote the equivalent treatment of crack and powder cocaine offenses.” The Drug Memo directs prosecutors to charge crack offenses as if they were cocaine offenses by using the quantity for cocaine rather than crack.

Disciplinary practices utilized in public libraries in the United States carry echoes of the ways in which youth of color and/or LGBTQ and gender non- conforming youth are policed and incarcerated. This research includes interviews with librarians and staff engaging in relational disciplinary practices, namely restorative justice, to gain understanding of how altering approaches to discipline may create cultural shifts that lead to more culturally conscious services to youth made vulnerable by the state. Individual, open-ended interviews with librarians and staff at an urban library system in California addressed the implementation of restorative justice practices, individuals’ approaches and understandings of restorative justice, and the process of institutionalizing restorative justice throughout the library system. This research reveals that restorative justice offers one approach to creating social change through increased access to library services and resources.

This dissertation has examined to what extent six prestigious newspapers (The Guardian/The Observer, The Daily Telegraph/The Sunday Telegraph, The New York Times, The Washington Post, El País and La Vanguardia) complied with the fundamental principles of journalism ethics (truth, justice and responsibility) in their coverage of the London 2012 Olympics. The content analysis of 6,552 pieces, their correlation with the major codes of ethics, and the conduct of 41 interviews revealed that in many areas the coverage dispelled the long-held notion of sports journalism being the “toy department”. Significant strengths include the wide range of sources employed, the comprehensive examination of the larger framework of the Olympics, the recognition of errors and the fight against discrimination. Despite all of this, the research highlights that in other core aspects, the diversity of the sporting agenda, sensationalism, stereotyping and the use of warlike language, for example, there is much room for improvement.

Imagine a world where someone’s personal information is constantly compromised, where federal government entities AKA Big Brother always knows what anyone is Googling, who an individual is texting, and their emoticons on Twitter. Government entities have been doing this for years; they never cared if they were breaking the law or their moral compass of human dignity. Every day the Federal government blatantly siphons data with programs from the original ECHELON to the new series like PRISM and Xkeyscore so they can keep their tabs on issues that are none of their business; namely, the personal lives of millions. Our allies are taking note; some are learning our bad habits, from Government Communications Headquarters’ (GCHQ) mass shadowing sharing plan to America’s Russian inspiration, SORM. Some countries are following the United States’ poster child pose of a Brave New World like order of global events. Others like Germany are showing their resolve in their disdain for the rise of tyranny. Soon, these new found surveillance troubles will test the resolve of the American Constitution and its nation’s strong love and tradition of liberty. Courts are currently at work to resolve how current concepts of liberty and privacy apply to the current conditions facing the privacy of society. It remains to be determined how liberty will be affected as well; liberty for the United States of America, for the European Union, the Russian Federation and for the people of the World in regards to the extent of privacy in today’s blurred privacy expectations.

The purpose of this study is to analyze the possibility of political influence upon the Department of Justice merger decisions within the brewing industry. Political preference was measured by the congressional ratings of a liberal political action committee, The Americans for Democratic Action (ADA), thus giving a liberalness score. Regressions including the merger guideline variables and the political preference measurement were estimated with a logit model. After running numerous regressions, the addition of the political preference variable resulted in insignificance for otherwise significant 1968 and 1982 guidelines variables. These results may indicate an inability of the model to differentiate between political pressure on antitrust enforcement during the establishment of the 1968 and 1982 guidelines, or beyond the establishment of the guidelines. However, the Chair of the Senate Antitrust Subcommittee, the oversight committee for the Department of Justice, is found to be the most significant with liberalness having a positive impact upon the probability of DOJ merger litigation.

AbstractIn the summer of 1787, New Yorkers were about to ratify a constitution for the US. In a series of 85 essays written by Alexander Hamilton, John Jay, and James Madison between October 1787 and May 1788 urged New Yorkers to ratify the proposed United States Constitution, which was drafted in Philadelphia in the summer of 1787. The essays (commonly referred to as the Federalist Papers) were published anonymously, under the pen name “Publius,” in various New York state newspapers of the time. On May 28, 1788, Alexander Hamilton published Federalist 78, titled “The Judicial Department.” In this famous essay, he offered a powerful defense of judicial review. Hamilton argued that only a federal judge could guarantee constitutional rights and provide an effective check on state power. At the same time, Hamilton had to convince his political opponents that the unelected judiciary would never dominate the other branches of government. Drawing on the ideas of Montesquieu, he deliberately portrayed the judiciary as “the least dangerous branch of government”. A branch that is inherently weak because it can control neither the country’s financial resources nor the army.

The United States represents a “least likely” case for cyber persistence theory. Until 2018, the United States applied a deterrence strategy to cyberspace, practicing restraint that further emboldened adversaries. An assessment of US cyber strategy shows that the core logic of cyber persistence theory was applied by 2018, although unevenly across government agencies. The clearest pivot away from deterrence was the Department of Defense’s adoption of “defend forward” and “persistent engagement.” Department of State attribution diplomacy and efforts to establish norms, and Department of Justice public indictments, mostly focused on setting redlines, signaling, and imposing costs to deter, despite little evidence that such actions impact adversary cyber behavior. Uneven adoption of a new cyber paradigm is consistent with Thomas Kuhn’s observations about paradigm change. States best equipped to manage interconnectedness and constant contact will be those that align intergovernmental, private sector, and citizenry efforts with other States in a whole-of-nation-plus approach.

Abstract This chapter examines the Congressional controversy over the 1951 NATO Status of Forces Agreement (SOFA), which allows the European members of the alliance to hold criminal trials of U.S. troops. Opponents of the agreement in the Senate argued that the legal systems of Europe failed to meet American standards of due process. Supporting the agreement, the U.S. military, Department of Defense, Department of State, and Department of Justice saw little reason to fear the legal differences between the United States and its allies. The chapter concludes by demonstrating that, to this day, the United States shows reluctance to submit troops to foreign jurisdiction.

Abstract This uprising by Cuban nationals lasted 11 days, involved more than 100 hostages, and required protracted negotiations to resolve. It occurred concurrently with a nine-day disturbance, also by Cuban nationals, at the Federal Detention Center, Oakdale, Louisiana. The combined cost of the two riots to the federal government was over $100 million. (Both the Atlanta and Oakdale facilities are part of the Bureau of Prisons [BOP], U.S. Department of Justice.) Like the Attica riot of 15 years earlier, the Atlanta and Oakdale incidents became benchmarks against which to compare other prison disturbances and strategies to resolve them. The BOP itself undertook the task of redesigning its emergency response strategy based on what it learned from Atlanta and Oakdale. Those changes were put to the test in the summer of 1991 when Cuban detainees rioted at Talladega, Alabama (see chapter 3).

This chapter highlights food insecurity. One in six people in the United States experiences food insecurity. Food insecurity has dramatic effects on the health of children and the elderly in particular, influencing educational progress, family stress, and nutritional deficiencies. Yet, as millions of Americans remain food insecure, they throw away 40% of their food every day. The largest source of this waste is the food people buy and bring home; 70% of all food discarded in people’s homes is edible. Restaurants are second in waste generation. If people could recover and redistribute one third of the food they waste, they could end food insecurity. Other countries are already moving in this direction; people may be starting to take similar steps in the United States. The 2018 Farm Bill supports food waste reduction plans in 10 states, creates a new Food Loss and Waste Liaison position within the US Department of Agriculture, and, following the European example, promotes the expansion of liability protections for food donations. In the private sector, there has been a rush of money into food waste reduction start-ups. Ultimately, reducing food waste creates economic, environmental, and public health benefits, as well as jobs, climate change deceleration, and hunger relief.

Aim/Purpose . The quantitative comparative ex post facto research study covered in this paper aims to fill gaps in the literature by focusing on whether gender influences perceptions of leadership; diversity, equity, inclusion, and accessibility (DEIA); and job satisfaction among federal employees within the Department of Justice using empirical data. The study also explores whether there are relationships between the perception of leadership and job satisfaction and the perception of DEIA and job satisfaction. Background. Since 2002, the United States Office of Personnel Management (OPM) has administered the Federal Employee Viewpoint Survey (FEVS), which measures employee perceptions of whether and to what extent successful organizational conditions exist in their agencies. Areas currently assessed within the FEVS include training, job satisfaction, leadership effectiveness, management effectiveness, work-life balance, and diversity, equity, inclusion, and accessibility. The exploration of variations in perceptions of leadership, DEIA efforts, and job satisfaction among U.S. federal employees by gender and other criteria are crucial areas for research that are underrepresented in the literature. This is not only important for the United States federal government, which is grappling with high attrition rates, but also for public administrations around the world. Methodology. A quantitative ex post facto research design was used to analyze data from responses of U.S. federal employees working for the Department of Justice. Leadership, job satisfaction, and DEIA were all measured using aggregate scores from pre-determined question sets. Differences based on gender were analyzed using t-tests. Additionally, chi-squares and Spearman’s rank correlations were employed in order to explore whether there is a relationship between the perception of leadership and job satisfaction and the perception of DEIA efforts and job satisfaction among U.S. federal government workers. Contribution. The findings of this study aid in providing empirical data to support the need for federal government leadership to understand the impact of employees’ perceptions on their willingness to continue working in the federal government. The research study was grounded in Public Service Motivation Theory, which centers around factors that motivate individuals to pursue and maintain careers in the public service sector. More specifically, this study supported the public service motivation theory in that it looked at gender as a mitigating factor in public service motivation as well as explored the role of leadership and DEIA as a correlating factor to job satisfaction. The results of this research have practical implications for federal government leaders interested in increasing employee motivation and retention and who should be considering the range of sociocultural and demographic characteristics that have been found in the research to impact employee perceptions and experiences. Findings. The analyses found differences in perceptions of leadership, DEIA, and job satisfaction among United States Federal Government employees based on gender. Additionally, perceptions of leadership and DEIA were both found to influence job satisfaction. The first research question explored in this study used a t-test to consider whether the perception of leadership among U.S. federal employees differed based on participant gender with significance found. The second research question examined whether the perceived job satisfaction of U.S. federal employees differed based on gender, with statistical significance detected. The third research question focused on whether perception of DEIA differed when gender was explored and the results of the t-test indicated a significant difference in perceptions of DEIA when gender was considered. The fourth research question considered the relationship between the perception of leadership and job satisfaction. A Chi-square and a Spearman Rank Correlation were performed, and a relationship was found to exist. Research question five explored whether a relationship exists between the perception of diversity, equity, inclusion, and accessibility initiatives and job satisfaction, with significance found following a chi-square and a Spearman rank correlation. Recommendations for Practitioners. Leadership behaviors of managers and the existence of DEIA policies play a critical role in employees’ job satisfaction and commitment. The recommendations for organizational leadership in the public service sector include addressing gender inequality in work practices and environments and cultivating more inclusive organizational cultures. Recommendations for Researchers. The lack of inclusion of socio-cultural norms in the research on public service motivation is a gap that has yet to be sufficiently addressed and is an area of research that should be explored. Impact on Society. Research on public service motivation in local, state, national, and international government employment can aid organizations in developing strategies for improving recruitment, selection, and retention in public service organizations. This information can advance scientific knowledge on transforming management and leadership practices across sectors. Future Research. Future research can expound on what has been done here by examining in more detail how various identities, and more specifically intersecting identities, within the LGBTQIA+ community as well as other historically marginalized groups, impact such factors as perceptions of leadership, job satisfaction, employee motivation and retention, and work-life balance. Perceptions of specific DEIA initiatives should also be further explored.

Objectives. Opioid stewardship interventions promote the appropriate use of prescribed and ordered opioids to reduce the risk of opioid adverse events. Our main objectives were to determine the effectiveness of these interventions in healthcare settings on opioid prescribing and clinical outcomes (e.g., number of opioid prescriptions, opioid dosage, overdose, emergency department visits, and hospitalizations) including unintended consequences (e.g., changes in patient-reported pain intensity), and ways these interventions can be effectively implemented. Methods. We followed rapid review processes of the Agency for Healthcare Research and Quality Evidence-based Practice Center Program. We searched PubMed and the Cochrane Library to identify eligible systematic reviews from January 2019 to April 2023 and primary studies published from January 2016 to April 2023, supplemented by targeted gray literature searches. We included systematic reviews and studies that addressed opioid stewardship interventions implemented in healthcare settings in the United States and that reported on opioid prescribing and clinical outcomes. Findings. Our search retrieved 6,431 citations, of which 34 articles were eligible (including 1 overview of systematic reviews, 13 additional systematic reviews, 13 randomized controlled trials (RCTs) [reported in 14 articles] and 6 nonrandomized studies). Systematic reviews, mostly summarizing pre-post studies, included a wide variety of opioid stewardship practices that focused on patient and family engagement, healthcare organization policy, or clinician knowledge and behavior interventions, in inpatient, perioperative, emergency department, and ambulatory settings. RCTs addressed multicomponent interventions (typically a combination of prescriber education, care management and facilitated access to resources), and patient education and engagement, mainly in ambulatory chronic pain. Opioid stewardship practices involving clinical decision support or electronic health records, or multicomponent interventions (including for chronic pain) were associated with decreases in opioid prescribing or reduced doses and no increases in pain, emergency department visits, or hospitalizations (low strength of evidence for all outcomes). Patient engagement and education interventions had mixed results for opioid prescribing outcomes (insufficient strength of evidence) and no increases in pain, emergency department visits, or hospitalizations (low strength of evidence). The evidence was insufficient on other types of interventions and on outcomes of opioid refill requests and refills, patient satisfaction, or overdose. Barriers included lack of training, workload, gaps in communication, and inadequate access to nonpharmacological resources. Facilitators included clinician and patient acceptance of intervention components. Conclusions. Selected opioid stewardship interventions may be effective for reducing opioid prescribing and dosing without adversely affecting clinical outcomes overall, although strength of evidence was low. Unintended consequences were often not measured or not measured rigorously. Interventions to reduce opioid use should monitor unintended consequences and include access to nonpharmacological pain management resources with appropriate patient education and engagement.
