Pełny tekst źródłaThis work is based on field observations showing that employees will or will not move to a work stoppage following the same type of work accident of minor gravity. In addition, national statistics describe a downward trend for work-related accidents, but absenteeism is on the rise (CNAM, 2016; Ayming-Kantar TNS, 2016). These data therefore pose the question of the nature of the relationship between the accident and the work stoppage. The aim of this thesis was to explore to what extent the work stoppage would be explained by stress states and coping strategies of injured employees. Referring to the Self-Regulatory Executive Function Model - S-REF (Wells & Matthews, 1994), one goal of this thesis work is to explore the extent to which metacognitive beliefs are factors that may explain stress states, and their management, after a period of work stoppage. In reference to this model, we postulated that employees who were off work would develop a Cognitive Attentional Syndrome - CAS (Wells, 1995). We conducted three studies testing three main hypotheses: 1) Employees who are absent following an occupational accident have a particular metacognitive profile implying positive and negative metacognitive beliefs about anxiety, and preferentially activate emotional coping or avoidance strategies (study 1); 2) Employees who were absent due to a work accident built a more threatening occupational accident representation than employees who did not miss (study 2); 3) The probability of stopping work in the days following the accident would be predicted by the affective state of the employees after the accident (i.e., worry, peritraumatic dissociation and distress) as well as by their coping strategies (study 3). Our results show that employees who have had an accident at work do not have a different metacognitive profile, depending on whether they have had a work stoppage or not (study 1). Coping strategies are predicted by metacognitive beliefs about worry; coping strategies centered on the problem are less used by employees who have had a work stoppage following their work accident (study 1). The representation of the industrial accident does not present a higher threat character for employees who have had a work stoppage (study 2). Finally, the results of study 3 show that the probability of being off work due to an accident at work is only predicted by a low propensity to use coping strategies centered on the problem. Our main findings indicate that the stress experienced by accident victims is influenced by positive and negative metacognitive beliefs about worry (studies 1 and 2). Our work shows no difference in the metacognitive profile between absent and absent employees after an accident at work. The use of coping strategies centered on the problem would be the main correlate (study 1) and predictor (study 3) of absenteeism of injured employees. All these results argue in favor of a work stoppage approach based on transactional stress model, in order to better understand this phenomenon and propose innovative methods of care for employees who have suffered an occupational accident

Pełny tekst źródłaFor some years now, there has been by degrees a significant development in the legislative and statutory context within which the whole field of accidents at work / professional sickness operates. The "asbestos legislation" of 28th February 2002 highlighted this movement by redefining the inexcusable fault of employer and by linking this legislation with safety obligations at the employer's cost. These legal decisions have undetermined the "historic compromise" of 1898 and have thrown into question the idea of its retention. They form part of an evolution towards better compensation for victims of occupational hazards, aiming to bring it closer to an "integral repair". This type of compensation has become commonplace in the field of physical damage, is being more and more sought after. It goes without saying that such a reform, were it to be passed, would have wide-ranging financial implications. Such a development cannot be envisaged without tackling the question of risk prevention, essential for the establishment of a genuine policy of health and safety at work. The maintenance of workers' health is today understood in the broad sense of the term : "it is a complete state of well-being physical, psychological and social". It follows that the emergence of fresh risks and the multiple illness which result from them offers new challenges to those who work in the field of prevention

Yet, the precise identification of the way the regime operates seems necessary to properly discuss the relevance of its rules, and contemplate its future. Striving to contribute to the debate, this study endeavors to situate the AT-MP regime within the broader framework of compensation law. The regime cannot, as has tradicionnally been the case, be conceptualized opposite civil liability -nor can it be assimilated to this system. Rather, it provides an original compromise bringing together liability and the need for social guarantees. Based on this analysis, one may assess the hurdles facing the incorporation of the AT-MP regime within compensation law, and appraise the relevance of the varions political proposals that have been put foward to this end

Pełny tekst źródłaAt the end of the 19th century, modem social welfare was created in France with the Act of April 9th 1898, introducing an inclusive payment system for accidents at work: this system entitled wage earners victims of accidents that had occurred during working hours and on their work location to an automatic compensation. A fierce ideological controversy flared up about the implementation of this act in the agricultural sector, especially among the agrarian, who defended the agricultural worid against industry. From the end of the 19th century to the interwar period, the agrarian strongly opposed the implementation of the principle of professional risk to the agricultural sector as a whole; yet, they opposition took a rather « dynamic » aspect, as they created their own network of social welfare. Indeed, the agricultural benefit system enabled them to vindicate their opposition, since, according to them, agricultural professional risks were already covered by an inability benefit. Eventually, thanks to the Act of December 15th 1922, agricultural wage earners could benefit from the measures of the Act of April 9th 1898. However, as far as this extension was concerned, the autonomy and specificities of the agricultural worid were taken into account and reinforced as the years went by. At the Liberation, despite the creation of the Social Security, the agricultural system was not questioned. Agricultural workers kept on benefiting from their own organisations and social measures. Yet, the various acts related to agricultural professional risks written after the Liberation tended to bring the agricultural system closer the general system

The methodology we adopted consisted in a pre-survey and a survey through questionnaires that were given out to five hundred workers: only four hundred and twenty questionnaires were given back and exploited. Improving the safety and health of employees at work should be a constant concern. The stakes are significant because nowadays, the idea that a person could be injured or even lose their life during work is widely frowned upon. Even if the likelihood is low, this possibility is intolerable to most contemporary sociologists, as they question how one can accept a person losing their life while simply trying to earn a living. According to statistics from the ILO, "every 15 seconds, a worker dies from a work-related accident or illness. Every day, 6,300 people die from a work-related accident or illness, amounting to 2.3 million deaths per year." The human cost of this daily threat is substantial. From an economic perspective, these situations are also worrisome. Firstly, for the victimized employee or their beneficiaries, who face significant financial distress despite the benefits provided by the social protection system. Secondly, for the company itself, it leads to the absence of employees due to accidents, protests and strikes against identified safety failures, and an increase in contributions owed by the company under the "workplace accidents" regime. Lastly, for the national community, the consequences are not negligible either: loss of production, organization and maintenance of medical structures, financial burden borne by social security funds, which is one of the causes of the French state's overindebtedness

Their topic shall sound familiar to policy makers, and to all empirical economists working on microenterprises, as they quesion the common mottos to deal with the informal sector: “formalize them”, “protect them”, and “train them”. Little of these recommendations rely on actual evidence, in particular regarding their effects for the firms themselves. Chapter one starts by questioning the relevance of formalization: what exactly do these production units have to gain from registration? The second chapter investigates the vulnerability of microenterprises to health problems: how much do they suffer from the consequences of health shocks within the household? The third chapter deals with the complementary question of the protection mechanisms, and questions the mitigating potential of health insurance. The fourth chapter finally deals with their managerial capital: do the business skills that are considered standard among larger firms have any meaning for informal micro enterprises?

Pełny tekst źródłaWith accidents in the workplace, compensation is generally set at a fixed rate. The present study therefore investigates cases where accident victims are able to obtain full compensation. In such cases, full compensation is awarded either on the basis of fault (inexcusable fault, intentional fault, or third party fault), or with regard to risk (traffic accidents or work-related traffic accidents). Full compensation is only obtained by recourse to the common law notion of civil responsibility. However, the instances where full compensation is possible appear insufficient in the light of the evolution of the law relative to civil responsibility, often supported by insurance systems, which allow accident victims automatic access to full compensation. Opportunities for full compensation in france also appear weak in terms of comparative law, especially when measured against the netherlands, where the notion of specific compensation has been completely abandoned to allow identical compensation for all physical injuries sustained by victims, irrespective of the cause of the accident. For these reasons, it seems appropriate to suggest improvements to the current french system of compensation. One possibility involves the fine-tuning of existing legislation which can be allowed to continue to develop as it has over the past century and thus adapt to the new requirements for full compensation. In this context, it is often claimed that inexcusable fault, particularly with regard to safety measures in companies, should constitute the key to removing employers' immunity. This type of fault ought to be accorded greater recognition than is at present the case and should lead to awards of maximum compensation. The recent example of asbestos suggests that jurisprudence is moving in this direction. A second potential improvement to the system would require important modifications to the present law. The dutch model might be considered, entailing a straightforward abrogation of article l. 451-1 of the css. Another possibility is the creation of a compulsory insurance system through private companies or by attributing the role of insurer to the social security system which would fully compensate accident victims

These figures show limitations which have been identified over 20 years ago. A longitudinal survey was carried out among 32 injured workers and our research suggests an alternative approach to occupational accidents which focuses on the point where work organisation hinges onto the individual and collective history of those injured. The issue is to question social relations within the work environment, first from the point of view of the accident itself and its impact on the body and on their life; then it focuses on how the accident is acknowledged and expenses paid for. From a public health angle, this work puts forward a critical analysis of institutional devices responsible for the visibility – or invisibility – of occupational accidents and of those injured

Pełny tekst źródłaThis study aims to build a model for the management of safety in the workplace assessing the accident phenomenon, the faults in safety management and the importance of people's representation within the organisation. First accidents have been studied theoretically as well as practically. This had led to theoretical propositions that accident theories have to take into account. It has also highlighted the widening gap between theories. Leading to accident models of increasing complexity, and people, managers, investigators or employees who consider accidents in a straight forward way. Second, the different aspects of safety management have been studied. This has brought to light the apparent inefficacy of safety management procedures, which has in turn stressed the importance of the representations of those in charge of safety. Third, a model of accidents and safety management procedures have been suggested, taking into account the complexity of the phenomenon and the central importance of agent's representations. The model for apprehending accidents as proposed here rests on three elements : regulations, representations ans behaviours. Accidents can then be interpreted as an infra or inter element malfunction. This model has led us to propose a "postural" analysis of accidental situations taking into consideration the agents' representations and to specify what might be the role played by the safety manager within such a theoretical framework

Pełny tekst źródłaIt is generally admitted that work is of central importance for the social individual. Independent work and wage-earning co-exist as the two possible forms of labour relations. Wage-earning, however, presents some deficiencies that call upon the social question and the individual's identity in relation to work. Independent labour and the starting up of companies were rediscovered and promoted since the last thirty years. Nonetheless, independent labour remains a default category in face of the employment paradigm. As its starting point this thesis has social work and social engineering undertaken within associations acting for independent workers, mainly Alsacian. This practice reveals some dynamics which shed light on labour and independent workers. Beyond sociocultural, professional and economic differences which characterise independent labour subjects and institutions, some common points are revealed in terms of human and psychological as well as economic and social expectations. Some intermediary bodies and some institutional sectors seem to overshadow the expression of diversified demands and needs of independent workers and enterprise owners. This thesis attempts to understand the peculiarity of independent work and workers. It decodes also what is at work in the relationship between social work and independent work. Furthermore, it covers the dimensions of labour, employment, the social question, social work and social intervention. Finally, it analyses not only the reality of a social work in face of independent labour, but also their interaction and the place of a socio-educative intervention

In a decade, the prevention of these risks asserted itself as the major stake in all the health policies in the work. A new dynamics was organized, consolidated by the European law, aiming on one hand at taking into account better the emergent risks and on the other hand, at conjugating prevention and repair to care about of an efficient approach of the treatment of the risks. The cursor so moved of an almost curative and repair logic, in order to assure the compensation of the risks, towards a logic of prevention the legal regime of which gradually grew rich of numerous specific tools. We can quote this way the considerable development of the obligation of safety of result, the redefining of the unforgivable fault and its probationary elements, the standards which allow to identify the psychosocial risks and their impact, their location to act then to reduce them without forgetting, in a more classic approach, the civil and penal penalties of the negligence with all these obligations pressing henceforth on the employers. After all, the prevention of professional risks mobilizes a whole series of actors, in and except company, making of this politics one of the big national causes. It is at this price that the work will preserve all its sense

Pełny tekst źródłaIn France as well as in many other industrialized countries, Workers’ Compensation Systems integrate an experience-rating system as a pricing mechanism to encourage firms’ investment in workplace hazard prevention measures. Are incentives implemented by this system sufficiently strong to encourage firms’ prevention efforts? However a second question has to be examined: does this system induce negative side effects? Especially, the literature highlights that experience-rated premiums may induce injuries under-reporting, negative impacts on employment and wages… Furthermore, the under-reporting phenomenon may reduce substantially the efficiency of this system. Our research provides new results on those questions. According to our results, the system contributes to increase firms’ prevention efforts and to reduce work-related injuries and illnesses, ceteris paribus. Besides, they highlight a strong phenomenon of under-reported work-related health expenditure, concerning mainly blue-collar workers and clerical workers

Pełny tekst źródłaOur research is aimed at the prevention of accidents in air transport operations. Over the past two decades, the level of safety has shown little improvement. This leads us to question the current paradigms for the analysis of accidents. Our work continues this trend and aims to contribute to the theoretical framework foi the study of the work situation, with the objective of safety management. Our main question concerns the contribution of observation to the prevention of accidents in air transport. Our work is based on two researches. The first one deals with the prevention of in-flight collision. Observations were conducted during simulator scenarios using a collision avoidance system. The systemic approach of CREAM ensured to produce safety recommendations following the identification of latent failures that were not revealed by the analysis of events. The second research aims at preventing tail strikes at take-off. Observations were made during the preparation phase of the takeoff in the cockpit. The functional approach of FRAM ensured to analyze these observations in the light of data from tail-strikes incidents and to propose recommendations to manage performance variability. These two studies highlight the complementary nature of incident data and activity observations. The functional approach to the work proposed by FRAM is particularly suited to the complexity and dynamics of air transport. The results are discussed in the context of the contribution of this method to the analysis of observations of normal activity with a safety objective

Pełny tekst źródłaPositive psychology is “ the study of the conditions and processes that contribute to the flourishing or optimal functioning of people, groups, and institutions” (Gable and Haidt, 2005, p.104). Happiness is a central concept in positive psychology but curiously little studied at work. Eight hundred and forty-seven employees participated in this research which breaks down into two objectives : The first objective was to build a Francophone Scale of Happiness at Work (EBT) and then validate it through five studies. Study 1 created a work happiness tool consisting of 9 items. In studies 2 and 3, factor analysis (exploratory and confirmatory) of data collected from two samples of French employees revealed the one-dimensional factor structure of EBT and a good internal consistency (.89 Conbach’s alpha). The fitting indices of the measurement model are also quite correct. Study 4 reinforced the structure of the EBT showing positive and significant correlations with two dimensions of Kern's (2014) tool, The Workplace PERMA Profiler. The first dimension, Accomplishment at Work, the second, Work Relationships. Study 5 examined the cultural validity of EBT by comparing two samples, one collected in Canada and the other in France. The results suggest that EBT applies to French-speaking cultures.The second objective is to identify the links between happiness at work and "positive" variables such as personality traits and comfort at work. The results indicate that the participants are relatively happy in their work, that they have a rather enthusiastic, altruistic, quite conscientious, emotionally stable and open-minded personality. Nevertheless, they have a relatively weak attachment to their workplace, a moderate control over the management of their privacy in the workplace, even if they consider their workspace to be quite comfortable and functional. The three concepts from positive psychology (happiness at work, comfort at work and personality in its positive dimension) are correlated. Partial mediation effects from Happiness at Work are found between the Opening dimension of the BFI-Fr and the Control / Privacy dimension of the Workplace Satisfaction Scale and between the BFI-Fr Neuroticism dimension and the Comfort / Functionality dimension of the satisfaction scale towards the workspace.EBT has satisfactory psychometric characteristics and can therefore be a valuable tool for occupational psychologists and human resource managers concerned with the happiness of workers in the workplace

At last, it is right to say road accident victim's, mugging victim's could ask indemnity on bodily injuri. They could request personal and economic damages. In view of inequality, we make changes to system in order to cancel these gap in compensation. This willingness to abolish inequality it's current political and human rights practices. From now on, it's imbelievable to think to deprive workers of personal damages while this accident are effects on the private life employee. That is why, hand work recommend solutions to restore equality between citizen

The transplanting of these diverse texts from an industrialised country to a country whose economy was based ont the economy of small artisans and agriculture did not facilitate a large coverage of the working population in cote d'ivoire. The current laws are not only insuitable for the cote d'ivoire but have also, to a large extent been poorly applied. It is not only necessary to reform the current laws, but also to write new legislation that is more suitable to the actual situation in the country. The government and the public service must rapidly intervene to create a body of laws that are truely adapted to the cote d'ivoire. This would require new and original texts which take into account an integration of the law the agricultural and small sector of the economy in cote d'ivoire

Decreasing accidents while adopting an approach based on accident analysis is difficult; therefore we look at what aspects of operators' activities contribute to the occurrence and absence of such occupational accidents. Indeed, for the majority of the time, operators are exposed to AOL risk factors but do not have an accident. We learn the safety practices operators take when walking about at their workplace by studying systems of resources, values and constraints that have influence on their practices, depending on the situations classes met. We propose that effective preventative measures are not only linked to systematic suppression of risk factors but also to the designs of facilitating environments planned around safety
