Firms often face significant challenges to stay competitive in the present economic environment, thus, dynamic capabilities are vital as it is a substantial factor in accomplishing better business performance. This study involved yearly data of 62 firms in the ACE market that engaged with dynamic capabilities, the data was collected from the year 2012-2021. The data was gathered from the firm's annual report and has been analyzed using two-step GMM. Generally, the ACE market is consistently associated with inferior performance and capital compared to the main market. Hence, the market has the possibility of being delisted and affecting capital market performance. Therefore, this study includes dynamic capabilities in the ACE market to study the market’s performance. The results obtained are consistent with the theory, whereby changes in dynamic capabilities contributed to a positive return on the firm’s performance. However, the small capital nature of the ACE Market limits the investment in the dynamic capabilities. This study concluded that more priority to be given to the awareness of dynamic capabilities in the current competitive era. The result proved that the investment in the dynamic capabilities improved the performance of the Ace market even though some of the firms in the ACE market ignored dynamic capabilities due to capital constraints. Thus, policymakers should play their role in providing grants for the firms in the ACE Market to improve the investment in dynamic capabilities.

With the urgent needs of improving spectrum’s efficiency, dynamic spectrum allocation based on auction has become a popular method, which makes unlicensed users to use the vacant spectrum released by primary users. However, the collusion behavior between unlicensed users harms system’s efficiency and profit. Although many kinds of mechanism have been proposed to solve this problem, resisting collusion is still a tough problem. In this paper, we study the nature of collusion behavior and revenue, and model a multi-stage auction for centralized spectrum allocation. In order to balance the collusion-resistance and revenue-optimization, we propose an algorithm with unit price priority and one step revenue optimization, which can combat collusion between unlicensed users and encourage them to compete with each other so that improve system’s total profit to some degree. With the simulation results, our algorithm shows a good performance on collusion-resistance and system’s revenue comparing with the other two algorithms.

Among the various challenges in spaceborne radar observation of the ocean, the following two issues are probably of a higher priority: inadequate dynamic resolution, and ineffective vertical penetration. Two highly anticipated breakthroughs in the coming decade are likely to be associated with radar interferometry and ocean lidar technology, which are expected to make a substantial contribution to a sub-mesoscale-resolving and depth-resolving observation of the ocean. The planned “Guanlan” science mission comprises a dual-frequency (Ku and Ka) interferometric altimetry (IA) and a near-nadir pointing ocean lidar (OL). The spaceborne active OL will ensure a deeper penetration depth and an all-time detection which leads to a layered characterization of the optical properties of the subsurface ocean. The simultaneous functioning of the OL and a dual-frequency (Ku and Ka) interferometric altimetry system will allow an enhanced understanding of contributions of the atmosphere and the air-sea interface which in turn considerably reduce the error budgets of the two sensors. The OL payload is expected to partially reveal the marine food chain and ecosystem with 10-m vertical interval in the euphotic layer, moving a significant step down to the oceanic mixed layer both dynamically and bio-optically.

Happiness levels often fluctuate from one day to the next, and an exogenous shock such as a pandemic can likely disrupt pre-existing happiness dynamics. This paper fits a Marko Switching Dynamic Regression Model (MSDR) to better understand the dynamic patterns of happiness levels before and during a pandemic. The estimated parameters from the MSDR model include each state’s mean and duration, volatility and transition probabilities. Once these parameters have been estimated, we use the one-step method to predict the unobserved states’ evolution over time. This gives us unique insights into the evolution of happiness. Furthermore, as maximising happiness is a policy priority, we determine the factors that can contribute to the probability of increasing happiness levels. We empirically test these models using New Zealand’s daily happiness data for May 2019 –November 2020. The results show that New Zealand seems to have two regimes, an unhappy and happy regime. In 2019 the happy regime dominated; thus, the probability of being unhappy in the next time period (day) occurred less frequently, whereas the opposite is true for 2020. The higher frequency of time periods with a probability of being unhappy in 2020 mostly correspond to pandemic events. Lastly, we find the factors positively and significantly related to the probability of being happy after lockdown to be jobseeker support payments and international travel. On the other hand, lack of mobility is significantly and negatively related to the probability of being happy.

Background. The abilitation of premature infants acquires importance due to the increased prevalence of delayed health disorders in these children. The article considers the issues of individualization of rehabilitation treatment for premature infants according to prediction of perinatal pathology outcomes, determining the individual levels of «abilitation windows» and developing personalized abilitation programs.Objective. The aim of the study was to determine individual timely sensitive ontogenesis stages («abilitation windows») for premature children with various perinatal pathology, as well as the most effective methods of rehabilitation treatment according to the maturity of the child and the type of neurosomatic deficiency.Methods. Two-stage cohort study of premature children with gestational age of 250–6–300–6 weeks was conducted. Stage 1 — retrospective analysis of «abilitation windows» in 115 premature children, development of prognostic scenarios. Stage 2 — prospective cohort study of 109 premature children, using abilitation methods in this cohort according to predicted events and estimation of abilitation efficacy. Medical interventions: familyoriented educational counseling, kinesiotherapy, physiotherapy, neuroprotectors, music therapy.Results. Information matrixes on filling ontogenetic abilitation periods have been developed, as well as age limits for «abilitation windows» have been defined on the 1st stage. Sensitive interval has been established for the use of stimulating effects in extremely immature children (postconceptional age of 34–37 weeks). The leading role of abilitation protective measures has been identified. Perinatal pathology outcomes have been analyzed in children from retrospective analysis group. Direct abilitation of premature children (from birth to 18 months) was carried out on the 2nd stage of the study according to probability forecasts. The priority of non-drug abilitation methods usage in immature children was confirmed. The need in step-by-step dynamic correction of abilitation programs was established.Conclusion. Prognostic significance of perinatal period events and individual postconceptional age in «abilitation windows» development for premature children was determined. The priority of non-drug abilitation for such patients (including family-oriented pedagogics) is established.

Zero-emission transportation is currently a public priority, especially in big cities. For this reason, the use of electric vehicles (EVs) is receiving much attention. To facilitate the adoption of EVs, a proper charging infrastructure together with energy management is essential. This article proposes a design guideline for a direct current (DC) charging station with bipolar properties. A bipolar system can convert a two-wire system into three wires in a microgrid system with a neutral line. The configuration of the bipolar system supports different loads; therefore, the unbalanced operation is inherent to the system. The proposed bipolar DC charging station (CS) has a three-level balancing converter that reduces the step-down effort chargers. Moreover, this paper proposes the continuous-control-set model predictive control (CCS-MPC)-based balancing strategy that allows the handling of different output loads while keeping the neutral-line voltage efficiently regulated with improved dynamic performance compared to a traditional controller. Stability and parameter robustness analyses are also performed for the control parameter selection. To ensure the performance of the proposed method, both simulation and experimental results are presented and compared with those obtained from the traditional methods.

As indicated by a worldwide common perspective about health and sustainable health systems, the health structure as a part of public health is a key theme of many societies. The future is shaped by probable future scenarios, for which dealing practically has many complications. This study is focused on the future scenarios for a comprehensive sustainable health financing model to support a superior structure for a decision and policy-making pilot for the society. This aim is followed based on multiple attribute decision making (MADM)-based scenarios using two MADM methods, step-wise weight assessment ratio analysis (SWARA) and weighted aggregated sum product assessment (WASPAS), as a hybrid model which is the first real case study of the approach. Four main probable future scenarios are identified and selected based on experts’ viewpoints about sustainable health financing models. These scenarios include membership in the World Trade Organization (WTO), dynamic basic insurance, international cooperation, and effective resources management. The process of evaluating based on the approach works as a wider picture, including all criteria and alternatives together. Sustainable medical services, empowering the private sector in both production and technology, and employing international managers took place as the top priority for considering the most applicable alternatives in the future. This structure is designed and developed in Iran’s context, and the Institute for Futures Studies in Health is the pilot of the research.

Offshore wind farms (OWFs) can influence marine stratifications, leading to fuel nutrition in the upper ocean and regulating ocean carbon fluxes. Evaluating this dynamic effect facilitates the planning of OWFs deployment for enlarging marine carbon sequestration, which is urgent in the pursuit of China’s carbon neutrality targets. However, it is impossible to observe the target influence in the planning stage of deployments, and it is impractical to build a high-resolution (100~101 m) model to cover the entire waters adjacent to China. The theoretical calculations, therefore, are the first step and top priority. The simplified theory presents two suggestions in the design of future OWF deployments in the study area. The first suggestion is made from the perspective of OWF positioning. To the east of the cities of Zhoushan, Putian, and Shantou, the oceans are dynamically sensitive to OWF deployments. The second suggestion is made from the perspective of the length scale of OWFs. A broader OWF results in a smaller vertical disturbance in the coastal waters, but the situation is opposite in the open seas. The OWF deployment strategy, proposed in the aim of ensuring idealized marine stratification responses, thus varies geographically. This study provides a panoramic view of the sensitivity of marine stratification to OWFs in the study regions. It can be seen as a steppingstone in detailed research of the target phenomenon.

Tourism and recreation play an increasingly important role in the economy of regions located in the European territory of Russia. Their importance in the arrangement of space is also constantly increasing. It is essential to include tourism and recreation in the territorial development programs, which, in turn, requires elaboration of concepts for their promotion at inter-regional, regional, and intra-regional levels. The concept of tourism and recreation development is based on a comprehensive assessment of the territory, taking into account its stable characteristics and dynamic indicators. The areal nature of recreational impacts determines the choice of spatial assessment methods. Structurally, the concept of tourism and recreation development contains three blocks: informational, analytical, and practical. The article discusses the concept formation methodology based on two geographical methods: tourist-recreational zoning and construction of a tourist-recreational frame of the region. The practical part of the study is based on the territory of the Ustyansky district of the Arkhangelsk region. The application of the developed methodology to a specific region made it possible to step by step follow the algorithm for using spatial assessment when working with two blocks of the concept: the informational block, which includes a description of the tourist and recreational potential and the current state of the tourism industry, and the analytical block, which defines priority areas for the development of tourism and recreation. The article also shows the formation of the practical block of the concept based on the data collected. It contains ideas concerning promotion of the region’s tourism potential and the main tools for implementing the concept. Spatial assessment makes it possible not only to outline the directions of tourism development in the region but also to give recommendations for organizing high-quality recreation for local residents. The materials of the article can be used to formulate methodological recommendations on the preparation of tourism and recreation development concepts at various regional levels.

In continuation of the article, the authors of the study devoted to the problems of scenario modeling and solving specific problems of management and development of the health care system of the Perm Territory, built the author’s dynamic multivariate model, which was based on an authoritative approach and consists of a set of five structural simultaneous equations. As a result, each equation of the system is a linear form of recursive regression, where the independent variable as a factor-factor taken into account in one equation becomes a depend- ent variable as an effective factor-factor. In order to eliminate the phenomenon of autocor- relation of residual values, the method of time lagging was used. To estimate the parameters of the reduced form of structural simultaneous equations, the two-step least squares method was used as a special case of the maximum likelihood method. The obtained parameter esti- mates on the whole turned out to be effective with moderate consistency and satisfactory bias. The constructed model made it possible to carry out a short-term forecast of the most important target socio-economic indicator of the success of healthcare development in the region until 2023. The authors considered the national goal as such a priority indicator — the expected (future) life expectancy of the population of the study area. At the end of the article, conclusions were drawn and the prospects for further scientific research of the authors were outlined.

Abstract Dynamic light conditions require continuous adjustments of stomatal aperture. The kinetics of stomatal conductance (gs) is hypothesized to be key to plant productivity and water use efficiency (WUE). Using step-changes in light intensity, we studied the diversity of light-induced gs kinetics in relation to stomatal anatomy in five banana genotypes (Musa spp.) and modeled the impact of both diffusional and biochemical limitations on photosynthesis (A). The dominant A limiting factor was the diffusional limitation associated with gs kinetics. All genotypes exhibited a strong limitation of A by gs, indicating a priority for water saving. Moreover, significant genotypic differences in gs kinetics and gs limitations of A were observed. For two contrasting genotypes, the impact of differential gs kinetics was further investigated under realistic diurnally fluctuating light conditions and at the whole-plant level. Genotype-specific stomatal kinetics observed at the leaf level was corroborated at whole-plant level by transpiration dynamics, validating that genotype-specific responses are still maintained despite differences in gs control at different locations in the leaf and across leaves. However, under diurnally fluctuating light conditions the impact of gs speediness on A and intrinsic (iWUE) depended on time of day. During the afternoon there was a setback in kinetics: absolute gs and gs responses to light were damped, strongly limiting A and impacting diurnal iWUE. We conclude the impact of differential gs kinetics depended on target light intensity, magnitude of change, gs prior to the change in light intensity, and particularly time of day.

Objectives: In 2012, Colombia experienced an important institutional transformation after the establishment of the Health Technology Assessment Institute (IETS), the disbandment of the Regulatory Commission for Health and the reassignment of reimbursement decision-making powers to the Ministry of Health and Social Protection (MoHSP). These dynamic changes provided the opportunity to test Multi-Criteria Decision Analysis (MCDA) for systematic and more transparent resource-allocation decision-making.Methods: During 2012 and 2013, the MCDA framework Evidence and Value: Impact on Decision Making (EVIDEM) was tested in Colombia. This consisted of a preparatory stage in which the investigators conducted literature searches and produced HTA reports for four interventions of interest, followed by a panel session with decision makers. This method was contrasted with a current approach used in Colombia for updating the publicly financed benefits package (POS), where narrative health technology assessment (HTA) reports are presented alongside comprehensive budget impact analyses (BIAs).Results: Disease severity, size of population, and efficacy ranked at the top among fifteen preselected relevant criteria. MCDA estimates of technologies of interest ranged between 71 to 90 percent of maximum value. The ranking of technologies was sensitive to the methods used. Participants considered that a two-step approach including an MCDA template, complemented by a detailed BIA would be the best approach to assist decision-making in this context. Participants agreed that systematic priority setting should take place in Colombia.Conclusions: This work may serve as the basis to the MoHSP on its interest of setting up a systematic and more transparent process for resource-allocation decision-making.

Today’s rising housing prices in most countries worldwide have caused increasable attention to the problem of affordable housing. It is a social or ethical issue and an essential economic direction. Thus, affordable housing has great potential, influencing economic growth, labor forces, innovation, sustainable development, and an inclusive economy. Systematization of informational sources, theoretical and practical approaches for providing affordable housing, and assessing social housing needs indicated many views on this problem among scholars and policymakers. That is why marketing, management, and financial providing of affordable housing are significant mainstreams. The research aims to investigate marketing and management fundamentals of providing affordable housing in connection with funding aspects based on cross-country analysis. For achieving this target, key trends of housing market segmentation were analyzed, considering the distribution of the population by tenure status and analytical house price indicators using the data of the statistical office of the EU, the World Bank, and the OECD. The ways to promote more affordable housing by public and local authorities, private investors in affordable housing, and specific social and affordable housing market organizations were described. Main organizational forms of providing affordable and social housing were also characterized. Particular attention was paid to strategic planning for affordable and social housing, especially housing business plans or affordable housing strategy development as a priority step in marketing, management, and financial providing affordable housing. A SWOT analysis for affordable housing developments was used to show strengths, weaknesses, opportunities, and threats to the affordable housing market. To empirically confirm some relevant strengths, the impact of indicators of financial providing of affordable housing was formalized based on correlation analysis (calculating Pearson or Spearman correlation coefficients with time lags based on results of Shapiro-Wilk testing) and construction of Arellano–Bond linear dynamic panel-data regression model with checking the Sargan test of overidentifying restrictions (the sample from 25 EU countries for 2011–2019) using the Excel 2010 and STATA 14.2 software. The dynamic model made it possible to consider the share of affordable housing owners with mortgage or loan or the share of tenants, rent affordable housing at a reduced price or free. The value of GDP of the previous period affects the current situation (due to introducing lag variables and using instrumental variables or the generalized method of moments (GMM) to obtain adequate estimates). The hypothesis that an increase of 1% of the share of affordable housing owners with mortgage or loan causes the rise in GDP per capita of an average of 0.44% with a two-year time lag was empirically confirmed. An increase of 1% of the share of tenants, rent-free housing or affordable housing at the reduced price, causes the decrease of GDP per capita of an average of 0.5% with a two-year time lag. It was substantiated that governments should continue and improve their policies for financing social and affordable housing. At the same time, they should prefer affordable mortgage lending programs over programs of reduced or free rental housing. The results of this research confirm the significant drivers of policies and practices devoted to affordable and social housing, such as marketing, management, and financial providing. The presented recommendations are useful for scholars interested in this scientific field of research, public and local authorities, investors in affordable housing, and specific affordable and social housing organizations.

We consider a minimax routing problem related to visiting megacities under precedence conditions and cost functions with task list dependence. It is supposed that some megacity system requiring visiting above all is selected. For solving, an approach with decomposition into a set of two minimax routing problems is proposed. A two-step widely understood dynamic programming procedure realizing an optimal composition solution is constructed. The above-mentioned optimality is established by theoretical methods. Application of the results obtained is possible under investigation of multi-stage processes connected with regular allocation of resources. Another variant of application concerns the particular case of one-element megacities (i.e., cities) and may be related to the issues of aviation logistics under organization of flights using one tool (airplane or helicopter) under system of tasks on the realization of passing cargo transportation with prioritization of visits realized above all.

In the modern world, the priority is the development of clean urban electric transport. The constructive solutions used in the construction of the tram wheel in the past years are outdated and do not meet modern requirements. One of these problems is the destruction of asphalt coating in the places of road coverage to tram rails, which worsens the operational characteristics of tram crossings. The reasons for this problem can be attributed to the following: Not enough asphalt concrete near the rails; low adhesion of asphalt and metal from which rails are made; dynamic loads and vibrations arising from trams and motor transport; bad base of tram train and others. One of the options for increasing reliability and durability is to use as a road covering of tram plates. This solution is used in Ukraine and the European Union. German company RailBeton developed solutions for railway crossings - BetoCross. This system is a modular construction of reinforced concrete slabs, which are pulled together by steel strips. With the help of a system of fastenings and bearings, the flooring is fastened to rails, which provides vertical and horizontal stability of their position and stabilization under the influence of loading. To reduce the dynamic influence, the plates are based on reinforced concrete sleepers through the intermediate layers of the elastostomer. The load from the automobile transport is transferred to the broken beam. In addition to the positive features, the BetoCross system, due to the large number of connections, ties and bearings, requires frequent maintenance and maintenance. The Ukrainian state enterprise "Starokostiantyniv plant ZBSH" developed a similar technology, reinforced concrete plates with the help of a screw fastening through rubber gasket fixed to a special bridge type wallpaper. At a step of wallpaper 0,6 m the plate is attached to each wallpaper from two sides, with the length of the plate itself is 2,7 m. that is, on one plate there are five points of fastening on each side. Loads from the automobile transport, similar to the German technology, are transferred to the rubble balast and the basis. These technological solutions have found their application on railway crossings, and need some improvement for use in urban electric transport. The article reviews the constructive decision on the organization of the mentioned site, which is proposed by RS ENGINEERING in Kharkov. In the proposed solution instead of the crushed balast used monolithic reinforced concrete slab with supporting elements. The arising loads from the rolling stock and transport are transferred through the supporting elements to the concrete slab, which redistributes them on the rubble basis. As a road cover are used reinforced concrete plates covering RS-Slab. The plates are divided into 3 types: Road, interroad and external, which in turn have several sizes. The plates are bound to the supporting elements by means of screws in four points. To reduce dynamic influence between the film and the reference element, a rubber elastomer is laid. Depending on the size of the plates have different number of cutting sites. Also because of the design features possible option when the slab simultaneously relies not on all the supporting sites, these options should be taken into account when calculating the scale and choosing a class of concrete. This solution allows to solve the problems of road surface destruction on the side of the rails, keeps more load from transport, compared to asphalt. At the same time, there are factors that need to be studied in detail when designing and before implementing the solution in mass production. These include: Investigation of the influence of violation of standard assembly plates on the stress-deformed state of the element; determination of thickness and acceptable physical characteristics of the gasket on the plate supports; detailed development of a node for fixing plates. The use of reinforced concrete plates as a road coating has a number of advantages before asphalt concrete: Resistance to destruction on the rails; installation regardless of weather and temperature conditions; resistance to loads from trucks. At the same time, this decision has certain peculiarities that require detailed study, which is a branch of further research.

Marine Protected Areas (MPAs) are a promising management tool for the conservation and recovery of marine ecosystems, as well as fisheries management. MPAs are generally established as permanent closures but marine systems are dynamic, which has generated debate in favour of more dynamic designs. As a consequence, the identification of priority areas should assess their persistence in space and time. Here, we develop a step-by-step approach to assess the spatiotemporal dynamics of fisheries management priority areas using standard fishery-independent survey data. To do so, we fit Bayesian hierarchical spatiotemporal SDM models to different commercially important demersal species and use the resulting maps to fit different spatial prioritisation configurations. We use these results to assess the spatiotemporal dynamics of fisheries priority areas. The proposed method is illustrated through a western Mediterranean case study using fishery-independent trawl survey data on six commercially important species collected over 17 years. We identified two fisheries priority area patterns in the study area, each predominant during a different time-period of the study, asserting the importance of regularly re-assessing MPA designs.

AbstractThe automotive industry is placing a high priority on the design and optimization of articulated vehicles to minimize the risk of potential accidents or failures. Before mass production, field testing is a crucial step in the development process, requiring extensive dynamic tests to provide a secure design. However, these tests can be both expensive and time-consuming. This study presents the design process of a small-scale low-bed semi-trailer chassis, manufactured to simulate the structural response of an actual semi-trailer. The aim was to identify weak points through analysis under bending conditions and then optimize the thickness and width of the various cross-sections to increase strength while minimizing costs. After manufacturing and welding based on the optimized design, the equivalent chassis was subjected to two load cases for experimental testing. The test results confirmed the accuracy of the finite element analysis, with a deviation of 7.75 to 10.24% in stress levels compared to the numerical results. Overall, this study demonstrates an effective approach to optimize the design of low-bed semi-trailers for improved safety and cost-effectiveness.

Abstract Background Achieving widespread adoption of innovations across health systems remains a challenge. Past efforts have focused on identifying and classifying strategies to actively support innovation spread (replicating an innovation across sites), but we lack an understanding about the mechanisms which such strategies draw on to deliver successful spread outcomes. There is also no established methodology to identify core strategies or mechanisms which could be replicated with fidelity in new contexts when spreading innovations. We aimed to understand which strategies and mechanisms are connected with successful spread using the case of a national medicines optimisation programme in England. Methods The study applied a comparative mixed-method case study approach. We compared spread activity in 15 Academic Health Science Networks (AHSN) in England, applied to one innovation case, Transfers of Care Around Medicines (TCAM). We followed two methodological steps: (1) qualitative thematic analysis of primary data collected from 18 interviews with AHSN staff members to identify the strategies and mechanisms and related contextual determinants and (2) Qualitative Comparative Analysis (QCA) combining secondary quantitative data on spread outcome and qualitative themes from step 1 to identify the core strategies and mechanisms. Results We identified six common spread strategy-mechanism constructs that AHSNs applied to spread the TCAM national spread programme: (1) the unique intermediary position of the AHSN as “honest broker” and local networking organisation, (2) the right capacity and position of the spread facilitator, (3) an intersectoral and integrated stakeholder engagement approach, (4) the dynamic marriage of the innovation with local health and care system needs and characteristics, (5) the generation of local evidence, and (6) the timing of TCAM. The QCA resulted in the core strategy/mechanism of a timely start into the national spread programme in combination with the employment of a local, senior pharmacist as an AHSN spread facilitator. Conclusions By qualitatively comparing experiences of spreading one innovation across different contexts, we identified common strategies, causal mechanisms, and contextual determinants. The QCA identified one core combination of two strategies/mechanisms. The identification of core strategies/mechanisms and common pre-conditional and mediating contextual determinants of a specific innovation offers spread facilitators and implementers a priority list for tailoring spread activities.

IntroductionIn 2011, Four Corners — the flagship current affairs program of the Australian national broadcaster, ABC (Australian Broadcasting Corporation) — aired an investigative report on the conditions in Indonesian slaughterhouses. Central to the report was a focus on how Australian cows were being killed for human consumption. Moral outrage ensued. The Federal Government responded with a temporary ban on the live export of cattle to Indonesia. In 2010 the Australian Government initiated legal action in the International Court of Justice (ICJ) opposing Japanese whaling in the Southern Ocean, following a sustained period of public opposition. This article pays close attention to expressions of public opposition to the killing of what have come to be referred to as our cows and our whales, and the response of the Federal Government.Australia’s recent history with the live export of farmed animals and its transformation into an anti-whaling nation provides us with a foundation to analyse these contemporary disputes. In contrast to a focus on “Australian cow making” (Fozdar and Spittles 76) during the live export controversy, this article investigates the processes through which the bodies of cows and whales became sites for the mapping of Australian identity and nationhood – in other words, a relational construction of Australianness that we can identify as a form of animal nationalism (Dalziell and Wadiwel). What is at stake are claims about desired national self-image. In what we might consider as part of a history of cows and whales is in many ways a ‘history of people with animals in it” (Davis 551). In other words, these disputes are not really about cows and whales.The Live Export IndustryAustralia is the largest exporter of live farmed animals, primarily sheep and cows, to the Middle East and Southeast Asia respectively (Phillips and Santurtun 309). The live export industry is promoted and supported by the Federal Government, with an explicit emphasis on the conditions experienced by these farmed animals. According to the Government, “Australia leads the world in animal welfare practices … [and] does not tolerate cruelty towards animals and will not compromise on animal welfare standards” (Department of Agriculture and Water Resources). These are strong and specific claims about Australia’s moral compass. What is being asserted is the level of care and concern about how Australia’s farmed animals are raised, transported and killed.There is an implicit relationality here. To be a ‘world leader’ or to claim world’s best practice, there must be some form of moral or ethical measure to judge these practices against. We can locate these more clearly and directly in the follow-up sentence on the above claim: “Our ongoing involvement in the livestock export trade provides an opportunity to influence animal welfare conditions in importing countries” (Department of Agriculture and Water Resources). The enthusiasm expressed in this statement manifests in explicitly seeking to position Australia as an exporter of moral progress (see Caulfield 76). These are cultural claims about us.In its current form the Australian live export industry dates back to the early 1960s, with concerns about the material conditions of farmed animals in destination countries raised from the outset (Caulfield 72; Villanueva Pain 100). In the early 1980s animal activists formed the Australian Federation of Animal Societies to put forward a national unified voice. Protests and political lobbying lead to the formation of a Senate Select Committee on Animal Welfare, reflecting what Gonzalo Villanueva has referred to as a social and political landscape that “appeared increasingly favourable to discussing animal welfare” (Transnational 89-91).The Select Committee’s first report focussed on live export and explicitly mentioned the treatment of Australian farmed animals in the abattoirs of destination countries. The conditions in these facilities were described as being of a lower “standard of animal welfare” to those in Australia (Senate Select Committee on Animal Welfare xiii). These findings directly mirror the expressions of concern in the wake of the 2011 controversy.“A Bloody Business”On 30 May 2011, Four Corners aired a report entitled ‘A Bloody Business’ on the conditions in Indonesian slaughterhouses. The investigation followed-up on footage provided by Animals Australia and Royal Society for the Prevention of Cruelty to Animals (RSPCA Australia). Members from these groups had travelled to Indonesia in order to document conditions in slaughterhouses and prepare briefing notes which were later shared with the ABC. Their aim was to increase public awareness of the conditions Australian farmed cattle faced in Indonesia, provide a broader indictment of the live export industry, and call for an end the practice. The nationwide broadcast which included graphic footage of our cows being killed, enabled broader Australia to participate from the comfort of their own homes (see Della Porta and Diani 177-8).The program generated significant media coverage and public moral outrage (Dalziell and Wadiwel 72). Dr Bidda Jones, Chief Scientist of RSPCA Australia, referred to “28,000 radio stories, 13,000 TV mentions and 3,000 press stories” making it one of the top five national issues in the media for five weeks. An online petition created by the activist organisation GetUp! collected more than 260,000 signatures over a period of three days and $300,000 was raised for campaign advertising (Jones 102). Together, these media reports and protest actions influenced the Federal Government to suspend live exports to Indonesia. A front-page story in The Age described the Federal Government as having “caved in to public and internal party pressure” (Willingham and Allard). In her first public statement about the controversy, Prime Minister Julia Gillard outlined the Government’s intent: “We will be working closely with Indonesia, and with the industry, to make sure we can bring about major change to the way cattle are handled in these slaughter houses” (Willingham and Allard).The Prime Minister’s statement directly echoed the claims made on the Department of Agriculture and Water Resources website introduced above. Implicit is these statements is a perceived ability to bring about “major change” and an assumption that we kill better. Both directly align with claims of leading the world in animal welfare practices and the findings of the 1985 Select Committee report. Further, the controversy itself was positioned as providing an “opportunity to influence animal welfare conditions in importing countries” (Department of Agriculture and Water Resources).Four Corners provided a nationwide platform to influence decision-makers (see Della Porta and Diani 168-9). White, Director of Strategy for Animals Australia, expressed this concisely:We should be killing the animals here under Australian conditions, under our control, and then they should only be shipped as meat products, not live animals. (Ferguson, Doyle, and Worthington)Jones provided more context, describing the suffering experienced by “Australian cattle” in Indonesia as “too much,” especially when “a clear, demonstrated and successful alternative to the live export of animals” was already available (“Broader”; Jones 188). Implicit in these calls for farmed cows to be killed in Australia was an inference to technical and moral progress, evoking Australia’s “national self-image” as “a modern, principled culture” (Dalziell and Wadiwel 84). The clean, efficient and modern processes undertaken in Australia were relationally positioned against the bloody practices conducted in the Indonesian facilities. In other words, we kill cows in a nicer, more humane and better way.Australia and WhalingAustralia has a long and dynamic history with whaling (Salter). A “fervently” pro-whaling nation, the “rapidly growing” local industry went through a modernisation process in the 1950s (Day 19; Kato 484). Operations became "clean and smooth,” and death became "instant, swift and painless”. As with the live export controversy, an inference of a nicer, more humane and better way of killing was central the Australian whaling industry (Kato 484-85). Enthusiastic support for an Australian whaling industry was superseded within three decades by what Charlotte Epstein describes as “a dramatic historical turnabout” (Power 150). In June 1977, the International Whaling Commission (IWC) came to Canberra, and protests were organised across Australia to coincide with the meeting.The IWJ meeting was seen as a political opportunity. An IWC meeting being held in the last English-as-first-language nation with a commercial whaling operation provided an ideal target for the growing anti-whaling movement (Epstein, Power 149). In parallel, the opportunity to make whaling an electoral issue was seen as a priority for locally based activists and organisations (Pash 31). The collective actions of those campaigning against the backdrop of the IWC meeting comprised an array of performances (Tarrow 29). Alongside lobbying delegates, protests were held outside the venue, including the first use of a full-sized replica inflatable sperm whale by anti-whaling activists. See Image 1. The symbol of the whale became a signifier synonymous for the environment movement for decades to follow (see Epstein, Power 110-11). The number of environmental organisations attending exceeded those of any prior IWC meeting, setting in place a practice that would continue for decades to follow (M’Gonigle 150; Pash 27-8).Image 1: Protest at Australia’s last whaling station August 28, 1977. Photo credit: Jonny Lewis Collection.Following the IWC meeting in Canberra, activists packed up their equipment and prepared for the long drive to Albany in Western Australia. Disruption was added to their repertoire (Tarrow 99). The target was the last commercial whaling operation in Australia. Two months later, on August 28, demonstrations were held at the gates of the Cheynes Beach Whaling Company. Two inflatable Zodiac boats were launched, with the aim of positioning themselves between the whales being hunted and the company’s harpoon vessels. Greenpeace was painted on the side — the first protest action in Australia under the organisation’s banner (Pash 93-94).In 1978, Prime Minister Fraser formally announced an Inquiry into the future of whaling in Australia, seeking to position Australia as being on the right side of history, “taking a decisive step forward in the human consciousness” (Epstein, World 313). Underpinning announcement was a (re)purposing of whales bodies as a site for the mapping of relational constructions of Australian identity and nationhood:Many thousands of Australians — and men, women and children throughout the world — have long felt deep concern about the activities of whalers… I abhor any such activity — particularly when it is directed against a species as special and intelligent as the whale.(Qtd. in Frost vii)The actions of those protesting against whaling and the language used by Fraser in announcing the Inquiry signalled Australia’s becoming as the first nation in which “ethical arguments about the intrinsic value of the whale” displaced “scientific considerations of levels of endangerment” (Epstein, Power 150). The idea of taking action for whales had become about more than just saving their lives, it was an ethical imperative for us.Standing Up for (Our) WhalesThe Inquiry into “whales and whaling” provided specific recommendations, which were adopted in full by Prime Minister Fraser:The Inquiry’s central conclusion is that Australian whaling should end, and that, internationally, Australia should pursue a policy of opposition whaling. (Frost 206)The inquiry found that the majority of Australians viewed whaling as “morally wrong” and as a nation we should stand up for whales internationally (Frost 183). There is a direct reference here to the moral values of a civilised community, what Arne Kalland describes as a claim to “social maturity” (130). By identifying itself as a nation on the right side of the issue, Australia was pursuing a position of moral leadership on the world stage. The Whale Protection Act (1980) replaced the Whaling Act (1960). Australia’s policy of opposition to whaling was “pursued both domestically and internationally though the IWC and other organizations” (Day 19).Public opposition to whaling increased with the commencement of Japan’s scientific research whaling program in the Southern Ocean, and the dramatic actions of Greenpeace and Sea Shepherd Conservation Society. The Daily Telegraph which ran a series of articles under the banner of “our whales” in June 2005 (see, for example, Hossack; Rehn). The conservative Federal Government embraced the idea, with the Department of the Environment and Heritage website including a “Save Our Whales” page. Six months out from the 2007 federal election, opposition leader Kevin Rudd stated “It's time that Australia got serious when it comes to the slaughter of our whales” (Walters). As a “naturally more compassionate, more properly developed” people, we [Australians] had a duty to protect them (Dalziell and Wadiwel 84).Alongside oft-repeated claims of Australia’s status as a “world leader” and the priority placed on the protection of whales nationally and internationally, saveourwhales.gov.au wristbands were available for order from the government website — at no charge. By wearing one of these wristbands, all Australians could “show [their] support for the protection of whales and dolphins” (Department of the Environment and Heritage). In other words, the wearer could join together with other Australians in making a clear moral and ethical statement about both how much whales mean to us and that we all should stand up for them. The wristbands provided a means to individually and collectively express this is what we do in unobtrusive everyday way.Dramatic actions in the Southern Ocean during the 2008/09 whaling season received a broader audience with the airing of the first season of the reality TV series Whale Wars, which became Animal Planets most viewed program (Robé 94). As with A Bloody Business, Whale Wars provided an opportunity for a manifestly larger number of people to eyewitness the plight of whales (see Epstein, Power 142). Alongside the dramatised representation of the risky and personally sacrificial actions taken by the crew, the attitudes expressed reflected those of Prime Minister Fraser in 1977: protecting special and intelligent whales was the right and civilised thing to do.These sentiments were framed by the footage of activists in the series. For example, in episode four of season two, Lockhart McClean, Captain of the MV Gojira referred to Japanese whalers and their vessels as “evil” and “barbaric”, and their practices outdated. The drama of the series revolved around Sea Shepherd patrolling the Southern Ocean, their attempts to intervene against the Japanese fleet and protect our whales. The clear undercurrent here is a claim of moral progress, situated alongside an enthusiasm to export it. Such sentiments were clearly echoed by Bob Brown, a respected former member of federal parliament and spokesperson for Sea Shepherd: “It’s just a gruesome, bloody, medieval, scene which has no place in this modern world” (Japanese Whaling).On 31 May 2010 the Federal Government initiated proceedings against Japan in the ICJ. Four years later, the Court found in their favour (Nagtzaam, Young and Sullivan).Conclusion, Claims of Moral LeadershipHow the 2011 live export controversy and opposition to Japanese whaling in the Southern Ocean have unfolded provide us with an opportunity to explore a number of common themes. As Dalziell and Wadiwell noted with regard to the 2011 live export controversy, our “national self-image” was central (84). Both disputes encompass claims about us about how we want to be perceived. Whereas our cows and whales appear as key players, both disputes are effectively a ‘history of people with animals in it” (Davis 551). In other words, these disputes were not really about the lives of our farmed cows or whales.The Federal Government sought to reposition the 2011 live export controversy as providing (another) opportunity "to influence animal welfare conditions in importing countries,” drawing from our own claimed worlds-best practices (Department of Agriculture and Water Resources). The “solution” put forward by White and Jones solution was for Australian farmed cows to be killed here. Underpinning both was an implicit claim that we kill cows in a nicer, more humane and better way: "Australians are naturally more compassionate, more properly developed; more human” (Dalziell and Wadiwel 84).Similarly, the Federal Government’s pursuit of a position of world-leadership in opposing whaling was rooted in claims of our moral progress as a nation. Having formally recognised the specialness of whales in the 1970s, it was our duty to pursue their protection internationally. We could individually and collectively express national identity on our wrists, through wearing a government-provided saveourwhales.gov.au wristband. Collectively, we would not stand by and let the "gruesome, bloody, medieval” practice of Japanese whaling continue in our waters (“Japanese”). IntroductionAs a visual artist it seems to me that the ideal relationship between government and cultural producers is a coalitional one; an “alliance for combined action of distinct parties, persons or states without permanent incorporation into one body” (Oxford English Dictionary). The word “coalition”, however, is entirely absent from the document that forms the basis of the analysis of this paper, Creating Value: An Arts and Culture Sector Policy Framework 2010-2014, from the Government of Western Australia’s Department of Culture and the Arts. Released in March 2010, Creating Value has been introduced by the DCA’s Deputy Director General Jacqui Allen as the “first arts policy in Australia to adopt a public value approach” (DCA, New Policy Framework) whereby "the Department of Culture and the Arts is charged with delivering public value to the Western Australian community through our partnership with the culture and arts sector." As indicated in Allen’s press release, this document achieves its aim of providing “clarity in [the DCA’s] relationships with the culture and arts sector”. As an artist, cultural worker, or someone generally interested in the cultural wellbeing of Australian communities it would seem timely to consider just how this new and influential policy framework envisages the specific working relationships that make up the “partnerships across the culture and arts sector, government, the public and private sector” (DCA, Creating Value 2).In this brief paper it is my intention to interrogate the idea of “coalition” in relation to the evidence provided in the DCA’s Policy Framework, Creating Value, in order to examine the extent to which this State’s involvement in culture and arts may indeed be considered coalitional. In approaching the notion of the coalitional I take the position that there are two key elements to this idea, the first being the notion of an “alliance for combined action” and the second being that the distinct parties involved are not incorporated into one body. What is difficult, at this intersection between the strategic advances of governance and the more organic development of culture, is to distinguish between levels at which the interests of both parties in a coalition or partnership are served by the alliance. As I will argue later in this paper, there is an important distinction to be made between working under temporary contract to specifications (in which one party’s design is realised through a primarily economic exchange with those providing the requisite goods and services) and the kind of negotiated relationship between means and ends that is required to support the genuine development of culture. The question is whether the artist (or other cultural producer), receiving funding to produce cultural work according to “public value” criteria, is able to develop culture or merely able to reproduce an understanding of culture given by the funding brief and assessment panel? It seems to me that significant cultural development is only possible where the public value of the outcomes of cultural production is subject to continuous negotiation and debate – surely it is in the coalitional outcomes (the alliance of distinct parties for combined action) of such discussion that a meaningful identification with culture occurs?In the following discussion around Creating Value my approach is to focus upon some aspects of the policy framework that provide particular evidence of the kind of “combined action” of government and the culture and arts sector that the DCA is proposing in this document. When seen against a more cultural understanding of the “action” of making art and the dynamic processes of producing and identifying with culture, it becomes clear why it may be considered that the DCA and many Western Australian cultural producers may not be engaged in the same project at all, let alone be in effective partnership or coalition.“Public Value” and the Specifications of Cultural ProductionEliseo Vivas observes that in the process of creatively applying symbolic order and understanding to the physical world, humanity acquires culture and an ability to better exploit the world. He also notes that in this process “of constituting the world, [human-kind’s] merely physiological needs are complicated by new needs” (129); new systems of cultural values that assume no less importance in human activity than our more basic bodily needs. Vivas pertinently states, however, that more often than not in human society within a complex and existing symbolic order these cultural needs simply become an aspect of our practical functioning (an extension of survival), and we tend to inhibit our capacity to constitute the world through creative and symbolic endeavours. This depiction of cultural production as an activity that is constitutive of the world is particularly significant in relation to the DCA’s Creating Value. Despite noting that “it is through creative people that we better understand our world” (DCA, Creating Value 8), which echoes with Vivas’s contention that “the poet is needed to give the practical man his stage” (Vivas 129) the policy framework seems rather to exemplify the inhibiting of culturally constitutive activities (production) in favour of “practical functioning” (reproduction).What can be observed particularly well in the DCA’s policy framework is how effectively ideas associated with creative and cultural production have been co-opted to the cause of “practical functioning”. Looking for instance at the notion of “creativity” within Creating Value we discover that “creativity is the driving force of the arts and culture sector” (DCA, Creating Value 5) and that “creativity” is one of the “priority public value principles” for the policy framework, along with “engagement”. Reading more closely one understands that creativity is seen as producing the “distinctive” and the “unique”, a brand that is recognised as Western Australian and which, through such “recognition” and “significance” and through its “enriching” and “transforming” capacities (7), is seen to “add to a sense of place and belonging” (11) for the WA community. This in turn makes WA a “better place to live, work and visit” and ultimately delivers “economic and social outcomes that encourage and support growth” (2). The DCA’s strategies appear to have little to do with a dynamic conception of culture in which new worlds and systems of values may be constituted, but is focussed upon the optimisation and rationalisation of economic outcomes under the guise of “public value”.My contention is that, as difficult as the notion may be to entertain, a department of culture and the arts ought to understand that creative and cultural production are part of a dynamic system that continually engages in a process of tentatively constituting the world. The arts and culture sector undeniably has an important role to play in the formation of and identification with a national cultural identity, which can manifest in international prestige, tourist dollars and other forms of economic growth (Abbing 246; Chaney 166-67). Western Australian culture is not, however, as the DCA seems to perceive, a static and monumental edifice that acts as a singular landmark for Western Australia in local, national and international contexts. The DCA’s arts and culture policy framework talks of its strategies “reflecting the DCA’s vision, values and strategic objectives” (DCA, Creating Value 13) and in a number of places suggests that it will “respond to changing needs” (2, 5, 8). Surely an approach that was interested in the specific value that creative and cultural production has to offer to the community would recognise that it is not in a singular vision but in the world creatively renegotiated and reconstituted by different people and groups of people that such a value and identification is to be found? Furthermore, if Vivas is right, then the support and promotion of culture ought to be as much about cultural needs not yet anticipated, for cultural products whose significance is not currently recognised, as it is about being responsive and catering to the demands of those whom the DCA identifies as the present consumers and stake-holders in WA arts and culture. What is missing from the partnership, as conceived by the DCA between itself and the culture and arts sector, is an adequate mechanism by which “public value” is recognised as a system of constantly changing values in which the culture and arts sector play an important role in developing, extending and negotiating through their creative and cultural production.As Jürgen Habermas suggests, to approach culture strategically in terms of outcomes and deployment is to compromise the internal development that actually provides arts and cultural work with its meaning and significance (Habermas 71). Culture becomes not a distinctive composite of differing and changing world views linked by the “living” process of their “nature-like” coexistence and development, but a monolithic identity or brand with representative products (no matter how diverse those products may be).This policy framework document would suggest not a coalitional “alliance for combined action” but more accurately a process of putting the various strategic goals and cultural aspirations (with “public value” specifications) of the DCA up for tender in much the same way that another Government department might seek tenders for the construction of a bridge or building. It is perhaps telling that Creating Value is described as a “road map to help the Department achieve its vision” (DCA, Creating Value 2).“Engagement” and the Use Value of FreedomCreating Value states that “there is a complex relationship between creativity and engagement, which are the principles driving the delivery of public value outcomes” (DCA, Creating Value 5). The policy framework goes on to suggest that the conception of “engagement” that informs the document is geared towards notions of participation, access and interaction in response to the demands of society for “more than passive enjoyment of cultural experiences” (5). Ultimately, as the “Framework Measurements” (15) in Creating Value suggest, the public values associated with engagement are about quantifying access and participation in arts and culture, and polling audiences and the public regarding “their satisfaction with their level of engagement” (15). I have been arguing that the public value of creative and cultural production is the result of engagement, but I do not think that it follows that the cultural value of such engagement can be assumed to be the correlative of high attendance numbers or measures that indicate a high level of consumer satisfaction. Nor can one assume that the “impact” or “reach” of a cultural or creative experience can be assessed adequately while the box office is open and the door counter is operational, let alone prior to a project being granted funding.Some of the genuine complexity in the relationship between creativity and engagement and its bearing upon public value can be seen in George Steiner’s writing on the nature of “creation”. Steiner suggests on the one hand that the act of creation is “irresponsible” (Steiner 43); that the work of artists occurs at one remove from world of material consequence. On the other hand Steiner notes that external resistance to artistic production has the effect of reinforcing the necessity and significance of artists’ work, freeing them from “justifying [art’s] vital functions and dignifying its motivations” (189). In this understanding of the value of creativity, it seems to me, there is a delicate balance to be struck between “freedom” and “consequence” in artistic and cultural production. The cultural producer is most able to constitute the world in new or innovative ways when he/she is able to work irresponsibly, however, such culturally constitutive actions are most significant and valuable when access to a freedom sought is denied or challenged and the motivations and mores of our cultural institutions are brought under question.Herbert Marcuse wrote in One Dimensional Man that the high culture of the past, “free from socially necessary labour,” was “the appearance of the realm of freedom: the refusal to behave” (Marcuse 71) but he also suggests that in advanced technological societies such as our own, the “good life” of administered society “reduces the use-value of freedom” (49). Marcuse claims that the achievements of rational society have transcended those of the “culture heroes and half-gods” (56) and, given that rational society appears to be steadily advancing towards the best of all possible worlds (or at least the best of the existing alternatives), the inclination to “hope” and to look beyond our own world and for other means of advance has been lost. Here again there is a sense in which the creative activities of culturally constituting the world have lost significant ground to the administrative concerns of “practical functioning”. What is interesting, however, is that it is possible to see the residual traces of the importance of the concept of “freedom”, however illusory, to the notion of the public value of creative and cultural production, even in Creating Value.In Creating Value, the valuable conception of “freedom” occurs obliquely in the insistence that the policy framework supports and encourages artistic risk taking (DCA, Creating Value 5, 8). A closer examination of Creating Value and the DCA’s Arts Grants Handbook 2010 reveals that “artistic risk” (DCA, Arts Grants 17) is understood as a strength in a proposal that is indicative of artistic merit and quality, and quality, understood in the public value terms of the policy framework, is measured by “the distinctive, innovative and significant elements of the creative experience” (DCA, Creating Value 15). The value of risk-taking in the pursuit of innovation is a recurring theme of some of the literature concerning the creative industries over the past decade. Concepts such as the “no-collar workplace” (Florida) and the “artscience lab” (Edwards) have the appearance of promoting a relatively unfettered space apart in which creativity is unhindered by practical obstacles and institutional barriers. However, the concept becomes problematic as soon as there is an expectation that such a space apart will be “productive” in an economic or any other existing sense. Steiner’s notion of “irresponsible” creation, importantly suggests a creativity that defines its own productivity, in which the consequences of artistic or cultural production are contained within the context of the creative space apart. The greatest risk in a creative project is at the point of engagement, where it is met by consequence, where the public value of the work becomes available for negotiation and debate. The process required in applying for a DCA grant is actually a process of modelling, anticipating and containing the risks associated with artistic or cultural production. The conspicuous absence of genuine consequence in this schema suggests that the DCA seeks to manage the “engagement” to produce its own series of desired outcomes. Yet active control of the relationship between funding organisation and the funded artists may inhibit the production of arts and culture. What is required instead is a coalition of interests and aspirations that has the potential to produce (rather than merely reproduce) culture. In such a circumstance the coalitional relationship will be one where meaning, significance and identification are established in a negotiation between diverse entities and interests. In a realm of cultural values the capacity for these “combined actions” to be meaningful and significant (to possess genuine public value) seems to be compromised by the dominance of the authoritative vision of the Department. ConclusionThe coalitional premise that underpins this paper is predicated on the notion that the “combined action” that is the motivation for the partnership between the Department of Culture and the Arts and the culture and arts sector is to enrich the Western Australian community through “unique and transforming culture and arts experiences” (DCA, Creating Value 1), as stated in the DCA’s strategic charter. What my brief engagement with the DCA’s 2010 policy framework, Creating Value, suggests, however, is that the DCA’s vision is not conceived in terms of the coalitional development of culture, in which culture is acknowledged as a collective work in progress, but rather as a strategic project with instrumental aims. The concept of “public value” that is at the core of Creating Value is not ultimately the product of, or productive of, an ongoing discourse or debate into which cultural producers contribute their various creative outputs. Instead it is presented as a static set of assessment criteria designed to channel creativity into economic growth and to contain the risks associated with cultural production. The ideal of the “coalitional” should inform the concept of public value, as the ongoing work of “combined action” in which creative and cultural producers (through their production), Government (through venues and funding) and the public (through attendance and participation) are engaged in a dialogue whose outcomes provide an indication of public value in a dynamic cultural sphere.George Walden writes:Democratic peoples must be more creative than non-democratic ones, if only because the idea that the opposite might be the case is intolerable. Whatever the merits of the contention that repressive or authoritarian regimes have produced the finest literature or most brilliant artistic movements, it would be a bold politician who took the next logical step in the argument… Like health care or education, art is a public good, a commodity whose provision must be officially guaranteed and overseen. (Walden qtd. in Timms 68)Artistic and cultural freedom, according to this observation, is not actually a freedom at all, but rather a political imperative for welfare states such as ours, which in turn makes the support for creative and cultural production a “socially necessary labour”, that performs instrumental and political functions (Timms 68; Abbing 239) that are at least as important as the cultural wellbeing that seems to be promoted. In contrast Pierre Bourdieu suggests that ultimately the state is the “official guarantor” of “everything that pertains to the universal – that is, to the general interest” (Bourdieu & Haacke 72). If culture is to maintain a critical perspective, he argues, “we should expect (and even demand) from the state the instruments of freedom from economic and political powers – that is from the state itself” (71). Somewhere between “socially necessary labour” and “critical distance”, Charles Esche posits the idea of an “engaged autonomy” for creative and cultural projects operating unavoidably within the economic hegemony of capitalism, whereby they work in “tolerated cultural enclosure called ‘art’, able to act according to different rules,” but “still totally inside the system” (Esche 11). Or perhaps, as Tony Moore suggests:A new cultural renaissance will not be built by bureaucrats subsidising elitism or “picking winners”… but by entrepreneurs and public institutions bold enough to harness the diverse creative energy in the community from suburban garages to inner city garrets. (Moore 122)Ultimately the issue of state interests, support and patronage for the arts is the same balancing act between creativity and engagement, or freedom and consequence, that I introduced referencing Steiner earlier in the paper. The point is, however, that creative irresponsibility brought into an effective engagement ought to lead to a negotiation that allows for the dynamic processes of culture to develop around a debate on public value. Creative and cultural producers should be amongst the coalitional co-creators of contemporary Western Australian culture rather than the contractors brought in to make the DCA’s vision of culture a reality.References Abbing, Hans. Introduction In 2017, 250 Indigenous delegates from across the country convened at the National Constitution Convention at Uluru to discuss a strategy towards the implementation of constitutional reform and recognition of Aboriginal and Torres Strait Islander peoples (Referendum Council). Informed by community consultations arising out of 12 regional dialogues conducted by the government appointed Referendum Council, the resulting Uluru Statement from the Heart was unlike any constitutional reform previously proposed (Appleby & Synot). Within the Statement, the delegation outlined that to build a more equitable and reconciled nation, an enshrined Voice to Parliament was needed. Such a voice would embed Indigenous participation in parliamentary dialogues and debates while facilitating further discussion pertaining to truth telling and negotiating a Treaty between Indigenous and non-Indigenous peoples. The reforms proposed are based on the collective input of Indigenous communities that were expressed in good faith during the consultation process. Arising out of a government appointed and funded initiative that directly sought Indigenous perspectives on constitutional reform, the trust and good faith invested by Indigenous people was quickly shut down when the Prime Minster, Malcolm Turnbull, rejected the reforms without parliamentary debate or taking them to the people via a referendum (Wahlquist Indigenous Voice Proposal; Appleby and McKinnon). In this article, we argue that through its dismissal the government treated the Uluru Statement from the Heart as a passing phase or mere “thought bubble” that was envisioned to disappear as quickly as it emerged. The Uluru Statement is a gift to the nation. One that genuinely offers new ways of envisioning and enacting reconciliation through equitable relationships between Indigenous and non-Indigenous populations. Indigenous voices lie at the heart of reconciliation but require constitutional enshrinement to ensure that Indigenous peoples and cultures are represented across all levels of government. Filter Bubbles of Distortion Constitutional change is often spoken of by politicians, its critics, and within the media as something unachievable. For example, in 2017, before even reading the accompanying report, MP Barnaby Joyce (in Fergus) publicly denounced the Uluru Statement as “unwinnable” and not “saleable”. He stated that “if you overreach in politics and ask for something that will not be supported by the Australian people such as another chamber in politics or something that sort of sits above or beside the Senate, that idea just won't fly”. Criticisms such as these are laced with paternalistic rhetoric that suggests its potential defeat at a referendum would be counterproductive and “self-defeating”, meaning that the proposed changes should be rejected for a more digestible version, ultimately saving the movement from itself. While efforts to communicate the necessity of the proposed reforms continues, presumptions that it does not have public support is simply unfounded. The Centre for Governance and Public Policy shows that 71 per cent of the public support constitutional recognition of Indigenous Australians. Furthermore, an online survey conducted by Cox Inall Ridgeway found that the majority of those surveyed supported constitutional reform to curb racism; remove section 25 and references to race; establish an Indigenous Voice to Parliament; and formally recognise Indigenous peoples through a statement of acknowledgment (Referendum Council). In fact, public support for constitutional reform is growing, with Reconciliation Australia’s reconciliation barometer survey showing an increase from 77 per cent in 2018 to 88 per cent in 2020 (Reconciliation Australia). Media – whether news, social, databases, or search engines – undoubtedly shape the lens through which people come to encounter and understand the world. The information a person receives can be the result of what Eli Pariser has described as “filter bubbles”, in which digital algorithms determine what perspectives, outlooks, and sources of information are considered important, and those that are readily accessible. Misinformation towards constitutional reform, such as that commonly circulated within mainstream and social media and propelled by high profile voices, further creates what neuroscientist Don Vaughn calls “reinforcement bubbles” (Rose Gould). This propagates particular views and stunts informed debate. Despite public support, the reforms proposed in the Uluru Statement continue to be distorted within public and political discourses, with the media used as a means to spread misinformation that equates an Indigenous Voice to Parliament to the establishment of a new “third chamber” (Wahlquist ‘Barnaby’; Karp). In a 2018 interview, PM Scott Morrison suggested that advocates and commentators in favour of constitutional reform were engaging in spin by claiming that a Voice did not function as a third chamber (Prime Minister of Australia). Morrison claimed, “people can dress it up any way they like but I think two chambers is enough”. After a decade of consultative work, eight government reports and inquiries, and countless publications and commentaries, the Uluru Statement continues to be played down as if it were a mere thought bubble, a convoluted work in progress that is in need of refinement. In the same interview, Morrison went on to say that the proposal as it stands now is “unworkable”. Throughout the ongoing movement towards constitutional reform, extensive effort has been invested into ensuring that the reforms proposed are achievable and practical. The Uluru Statement from the Heart represents the culmination of decades of work and proposes clear, concise, and relatively minimal constitutional changes that would translate to potentially significant outcomes for Indigenous Australians (Fredericks & Bradfield). International examples demonstrate how such reforms can translate into parliamentary and governing structures. The Treaty of Waitangi (Palmer) for example seeks to inform Māori and Pākehā (non-Maori) relationships in New Zealand/Aotearoa, whilst designated “Māori Seats” ensure Indigenous representation in parliament (Webster & Cheyne). More recently, 17 of 155 seats were reserved for Indigenous delegates as Chile re-writes its own constitution (Bartlett; Reuters). Indigenous communities and its leaders are more than aware of the necessity of working within the realms of possibility and the need to exhibit caution when presenting such reforms to the public. An expert panel on constitutional reform (Dodson 73), before the conception of the Uluru Statement, acknowledged this, stating “any proposal relating to constitutional recognition of the sovereign status of Aboriginal and Torres Strait Islander peoples would be highly contested by many Australians, and likely to jeopardise broad public support for the Panel’s recommendations”. As outlined in the Joint Select Committee’s final report on Constitutional Recognition relating to Aboriginal and Torres Strait Islander peoples (Referendum Council), the Voice to parliament would have no veto powers over parliamentary votes or decisions. It operates as a non-binding advisory body that remains external to parliamentary processes. Peak organisations such as the Law Council of Australia (Dolar) reiterate the fact that the proposed reforms are for a voice to Parliament rather than a voice in Parliament. Although not binding, the Voice should not be dismissed as symbolic or something that may be easily circumvented. Its effectiveness lies in its ability to place parliament in a position where they are forced to confront and address Indigenous questions, concerns, opinions, and suggestions within debates before decisions are made. Bursting the ‘Self-Referential Bubble’ Indigenous affairs continue to be one of the few areas where a rhetoric of bipartisan agreement is continuously referenced by both major parties. Disagreement, debate, and conflict is often avoided as governments seek to portray an image of unity, and in doing so, circumvent accusations of turning Indigenous peoples into the subjects of political point scoring. Within parliamentary debates, there is an understandable reservation and discomfort associated with discussions about what is often seen as an Indigenous “other” (Moreton-Robinson) and the policies that a predominantly white government enact over their lives. Yet, it is through rigorous, open, and informed debate that policies may be developed, challenged, and reformed. Although bipartisanship can portray an image of a united front in addressing a so-called “Indigenous problem”, it also stunts the conception of effective and culturally responsive policy. In other words, it often overlooks Indigenous voices. Whilst education and cultural competency plays a significant role within the reconciliation process, the most pressing obstacle is not necessarily non-Indigenous people’s inability to fully comprehend Indigenous lives and socio-cultural understandings. Even within an ideal world where non-Indigenous peoples attain a thorough understanding of Indigenous cultures, they will never truly comprehend what it means to be Indigenous (Fanon; de Sousa Santos). For non-Indigenous peoples, accepting one’s own limitations in fully comprehending Indigenous ontologies – and avoiding filling such gaps with one’s own interpretations and preconceptions – is a necessary component of decolonisation and the movement towards reconciliation (Grosfoguel; Mignolo). As parliament continues to be dominated by non-Indigenous representatives, structural changes are necessary to ensure that Indigenous voices are adequality represented. The structural reforms not only empower Indigenous voices through their inclusion within the parliamentary process but alleviates some of the pressures that arise out of non-Indigenous people having to make decisions in attempts to solve so-called Indigenous “problems”. Government response to constitutional reform, however, is ridden with symbolic piecemeal offerings that equate recognition to a form of acknowledgment without the structural changes necessary to protect and enshrine Indigenous Voices and parliamentary participation. Davis and her colleagues (Davis et al. “The Uluru Statement”) note how the Referendum Council’s recommendations were rejected by the then minister of Indigenous affairs Nigel Scullion on account that it privileged Aboriginal and Torres Strait Islander voices. They note that, until the Referendum Council's report, the nation had no real assessment of what communities wanted. Yet by all accounts, the government had spent too much time talking to elites who have regular access to them and purport to speak on the mob's behalf. If he [Scullion] got the sense constitutional symbolism and minimalism was going to fly, then it says a lot about the self-referential bubble in which the Canberra elites live. The Uluru Statement from the Heart stands as testament to Indigenous people’s refusal to be the passive recipients of the decisions of the non-Indigenous political elite. As suggested, “symbolism and minimalism was not going to fly”. Ken Wyatt, Scullion’s replacement, reiterated the importance of co-design, the limitations of government bureaucracy, and the necessity of moving beyond the “Canberra bubble”. Wyatt stated that the Voice is saying clearly that government and the bureaucracy does not know best. It can not be a Canberra-designed approach in the bubble of Canberra. We have to co-design with Aboriginal communities in the same way that we do with state and territory governments and the corporate sector. The Voice would be the mechanism through which Aboriginal and Torres Strait Islander interests and perspectives may be strategically placed within parliamentary dialogues. Despite accusations of it operating as a “third chamber”, Indigenous representatives have no interest in functioning in a similar manner to a political party. The language associated with our current parliamentary system demonstrates the constrictive nature of political debate. Ministers are expected to “toe the party line”, “crossing the floor” is presented as an act of defiance, and members must be granted permission to enter a “conscience vote”. An Indigenous Voice to Parliament would be an advisory body that works alongside, but remains external to political ideologies. Their priority is to seek and implement the best outcome for their communities. Negotiations would be fluid, with no floor to cross, whilst a conscience vote would be reflected in every perspective gifted to the parliament. In the 2020 Australia and the World Annual Lecture, Pat Turner described the Voice’s co-design process as convoluted and a continuing example of the government’s neglect to hear and respond to Indigenous peoples’ interests. In the address, Turner points to the Coalition of the Peaks as an exemplar of how co-design negotiations may be facilitated by and through organisations entirely formed and run by Indigenous peoples. The Coalition of the Peaks comprises of fifty Aboriginal and Torres Strait Islander community-controlled peak organisations and was established to address concerns relating to closing the gap targets. As Indigenous peak organisations are accountable to their membership and reliant on government funding, some have questioned whether they are appropriate representative bodies; cautioning that they could potentially compromise the Voice as a community-centric body free from political interference. While there is some debate over which Indigenous representatives should facilitate the co-design of a treaty and Makarrata (truth-telling), there remains a unanimous call for a constitutionally enshrined Voice to Parliament that may lead negotiations and secure its place within decision-making processes. Makarrata, Garma, and the Bubbling of New Possibilities An Indigenous Voice to Parliament can be seen as the bubbling spring that provides the source for greater growth and further reform. The Uluru Statement from the Heart calls for a three-staged approach comprising of establishing an Indigenous Voice, followed by Treaty, and then Truth-Telling. This sequence has been criticised by some who prioritise Truth and Treaty as the foundation for reform and reconciliation. Their argument is based on the notion that Indigenous Sovereignty must first be acknowledged in Parliament through an agreement-making process and signing of a Treaty. While the Uluru Statement has never lost sight of treaty, the agreement-making process must begin with the acknowledgment of Indigenous people’s inherent right to participate in the conversation. This very basic and foundational right is yet to be acknowledged within Australia’s constitution. The Uluru Statement sets the Voice as its first priority as the Voice establishes the structural foundation on which the conversation pertaining to treaty may take place. It is through the Voice that a Makarrata Commission can be formed and Indigenous and non-Indigenous peoples may “come together after a struggle” – the translation of the word’s Yolngu origins (Gaykamangu; Pearson). Only then may we engage in truth telling and forge new paths towards agreement-making and treaty. This however raises the question as to how a Voice to Parliament may look and what outcomes it aims to achieve. As discussed in the previous section, it is a question that is often distorted by disinformation and conjecture within public, political, and news-media discourses. In order to unpack what a Voice to Parliament may entail, we turn to another Yolngu word, Garma. Garma refers to an epistemic and ontological positioning in which knowledge is attained from a point where differences converge and new insights arise. For Yolngu people, Garma is the place where salt and fresh water intersect within the sea. Fresh and Salt water are the embodiments of two Yolngu clans, the Dhuwa and Yirritja, with Garma referring to the point where the knowledge and laws of each clan come into contact, seeking harmonious balance. When the ebb and flow of the tides are in balance, it causes the water to foam and bubble taking on new form and representing innovative ideas and possibilities. Yolngu embrace this phenomenon as an epistemology that teaches responsibility and obligations towards the care of Country. It acknowledges the autonomy of others and finds a space where all may mutually benefit. When the properties of either water type, or the knowledge belonging a single clan dominates, ecological, social, political, and cosmological balance is overthrown. Raymattja Marika-Munungguritj (5) describes Garma as a dynamic interaction of knowledge traditions. Fresh water from the land, bubbling up in fresh water springs to make waterholes, and salt water from the sea are interacting with each other with the energy of the tide and the energy of the bubbling spring. When the tide is high the water rises to its full. When the tide goes out the water reduces its capacity. In the same way Milngurr ebbs and flows. In this way the Dhuwa and Yirritja sides of Yolngu life work together. And in this way Balanda and Yolngu traditions can work together. There must be balance, if not either one will be stronger and will harm the other. The Ganma Theory is Yirritja, the Milngurr Theory is Dhuwa. Like the current push for constitutional change and its rejection of symbolic reforms, Indigenous peoples have demanded real-action and “not just talk” (Synott “The Uluru statement”). In doing so, they implored that Aboriginal and Torres Strait Islander peoples be involved in all decision-making processes, for they are most knowledgeable of their community’s needs and the most effective methods of service delivery and policy. Indigenous peoples have repeatedly expressed this mandate, which is also legislated under international law through the UN Declaration on the Rights of Indigenous Peoples. Coming together after a struggle does not mean that conflict and disagreement between and amongst Indigenous and non-Indigenous communities will cease. In fact, in alignment with political theories such as agonism and pluralism, coming together within a democratic system necessitates a constructive and responsive embrace of different, competing, and in some cases incommensurable views. A Voice to Parliament will operate in a manner where Indigenous perspectives and truths, as well as disagreements, may be included within negotiations and debates (Larkin & Galloway). Governments and non-Indigenous representatives will no longer speak for or on behalf of Indigenous peoples, for an Indigenous body will enact its own autonomous voice. Indigenous input therefore will not be reduced to reactionary responses and calls for reforms after the damage of mismanagement and policy failure has been caused. Indigenous voices will be permanently documented within parliamentary records and governments forced to respond to the agendas that Indigenous peoples set. Collectively, this amounts to greater participation within the democratic process and facilitates a space where “salt water” and the “bubbling springs” of fresh water may meet, mitigating the risk of harm, and bringing forth new possibilities. Conclusion When salt and fresh water combine during Garma, it begins to take on new form, eventually materialising as foam. Appearing as a singular solid object from afar, foam is but a cluster of interlocking bubbles that gain increased stability and equilibrium through sticking together. When a bubble stands alone, or a person remains within a figurative bubble that is isolated from its surroundings and other ways of knowing, doing, and being, its vulnerabilities and insecurities are exposed. Similarly, when one bubble bursts the collective cluster becomes weaker and unstable. The Uluru Statement from the Heart is a vision conceived and presented by Indigenous peoples in good faith. It offers a path forward for not only Indigenous peoples and their future generations but the entire nation (Synott “Constitutional Reform”). It is a gift and an invitation “to walk with us in a movement of the Australian people for a better future”. Through calling for the establishment of an Indigenous Voice to Parliament, a Makarrata Commission, and seeking Truth, Indigenous advocates for constitutional reform are looking to secure their own foothold and self-determination. The Uluru Statement from the Heart is more than a “thought bubble”, for it is the culmination of Indigenous people’s diverse lived experiences, outlooks, perspectives, and priorities. When the delegates met at Uluru in 2017, the thoughts, experiences, memories, and hopes of Indigenous peoples converged in a manner that created a unified front and collectively called for Voice, Treaty, and Truth. Indigenous people will never cease to pursue self-determination and the best outcomes for their peoples and all Australians. As an offering and gift, the Uluru Statement from the Heart provides the structural foundations needed to achieve this. It just requires governments and the wider public to move beyond their own bubbles and avail themselves of different outlooks and new possibilities.
