A work of creative fiction in the form of a short novel, Asleep in the Arms of God is a limited-omniscient and omniscient narrative describing the experiences of a man named Wafer Roberts, born in Jack County, Texas, in 1900. The novel spans the years from 1900 to 1925, and moves from the Keechi Valley of North Texas, to Fort Worth and then France during World War One, and back again to the Keechi Valley. The dissertation opens with a preface, which examines the form of the novel, and regional and other aspects of this particular work, especially as they relate to the postmodern concern with fragmentation and conditional identity. Wafer confronts in the novel aspects of his own questionable history, which echo the larger concern with exploitative practices including racism, patriarchy, overplanting and overgrazing, and pollution, which contribute to and climax in the postmodern fragmentation. The novel attempts to make a critique of the exploitative rage of Western civilization.

In this thesis I argue that epistemic trust in religious authorities is different from epistemic trust in other kinds of authorities because God disturbs the two-party relationship between trustee and truster. I reach this conclusion by first examining the nature of epistemic trust in authorities and how it is justifiable to practice this kind of trust. I then compare these findings to the nature of epistemic trust in religious authorities and see that the general justification for epistemic trust in authorities is not sufficient, instead, God’s relationship with the trusting party, the layperson, needs to be taken into consideration in order to justify epistemic trust in religious authorities.

My dissertation argues that the study of antebellum American religious novels is hindered by the secularization narrative, the widely held conviction that modernity entails the decline of religion. Because this narrative has been refuted by the growing field of secularization theory and because the novel is associated with modernity, the novel form must be reexamined. Specifically, I challenge the common definition of the novel as a secular form. By investigating novels by Lydia Maria Child, Susan Warner, Harriet Beecher Stowe, and Hannah Bond, I show that religion and the novel form are not opposed. In fact, scholars' unexamined and unacknowledged definitions of religion and secularity cause imprecision. For example, the Marxist definition of religion as ideology causes misrepresentations of novels with evangelical purposes, such as Warner's The Wide, Wide World and Bond's The Bondwoman's Narrative. Both novels feature protagonists who submit--one to patriarchy and the other to slavery--a stance that appears masochistic to feminist scholars and critics of slave narratives, respectively. However, attending to the biblical allusions, divine interventions, and theological arguments that saturate these texts places them in another framework altogether and reveals that they are commenting not on one's relationship with other humans but with God. Likewise, unexamined definitions of the secular are problematic because critics often conflate two definitions: the etymological sense of "earthly" and the modern sense of "anti-religious." This slippage underlies the view that religious literature of the nineteenth century became less religious, when it simply became more grounded in daily life. Therefore, to label as "secular" an author like Stowe, who promoted an earthly, lived Christianity, is only accurate if one means "mundane." Finally, my dissertation demonstrates that literary criticism itself relies on the secularization narrative, perceiving itself as modern and progressive. This reliance obscures the role literature has played in constructing this narrative. For example, colonial novels like Hobomok and The Scarlet Letter rewrite American religious history to exclude Calvinism. Noting how our investment in secularity has delimited interpretive possibilities, this project opens the way for increased clarity in the study of religion in literature.

This is the first of three parts in the first of three planned novels, collectively called The Great Plains Trilogy, which takes place between 1841 and 1845. Set against such historical events as the Battle of Plum Creek and the Texas Council House Fight, Part One follows Lock (a.k.a. Aidan Plainfield) in 1841, whose wife and daughter were killed by Comanches during the Victoria raid of 1840. Since the raid, Lock has left his life behind, surviving alone in the Great Plains. One morning he discovers that Comanches have stolen his horse, and he sets off to recover it. Along the way, he meets Mr. Pendleton, an Englishman who has been injured by Comanches, and Raymond Wales, a thief who has been mysteriously left to hang in the middle of the woods. Mr. Pendleton and Raymond Wales, each of whom have their own mysterious motivations, join Lock on his journey.

Denna uppsats är en undersökning av civilreligionen i Barack Obamas tal. Uppsatsens syfte har varit att analysera vilken funktion civilreligionen har haft i talen, hur den har framställts, och vilka taltillfällen som har haft ett större civilreligiöst innehåll än andra. Med hjälp av Robert N. Bellahs teori om den amerikanska civilreligionen har jag fastställt vad civilreligion är. Talen har analyserats med hjälp av en retorikanalys, för att kunna finna civilreligionens retoriska funktion. I undersökningen har jag analyserat sju tal mellan åren 2009-2015, de år som Barack Obama har varit USA’s president. I min slutsats kom jag fram till att civilreligionen kommer till uttryck olika beroende på i vilken situation talet har framförts. Obamas minnestal visade att civilreligionen fungerade som ett verktyg att skapa en gemenskap för nationen, och i State Of the Union användes den för att legitimera diverse beslut rörande nationell och internationell politik. De tal som stämde med vad tidigare forskning har visat var installationstalen, där det gick att finna många likheter mellan talen, och civilreligionen kommer till uttryck för att det är vad som förväntas av en amerikansk president.

In both Outer Dark and Child of God, McCarthy does a masterful job of blending the elements of Appalachian Gothic to present a novel that is darkly suspenseful and grimly thought-provoking. Outer Dark focuses on the complex incestuous relationship between a brother and sister and their interaction with others. The novel follows the two on a journey through the wilderness where they must cope with the unknown qualities of that wilderness, as well as the guilt stemming from their own behaviors. In Child of God, McCarthy explores the grotesque nature of a life lived in isolation and poverty in the mountains. This novel focuses more on an individual descent into the gruesome depths that illustrate the main character’s depravity. In these two novels McCarthy examines the darker side of life in Appalachia, and forces readers to question the purpose and meaning for the characters’ lives and actions.

This thesis establishes parallel claims about how women’s autobiography as a genreintersects with fiction as a means to share an author’s opinions on issues of race, gender,class, and topics that the publishing industry deems ‘controversial’, using Zora Neale Hurston’s works Their Eyes Were Watching God and Dust Tracks on a Road as points of comparison. Throughout this thesis, I will show that Their Eyes Were Watching God is a novel that by virtue of its content is a political novel because of how it represents an overlooked demographic of people and the novel’s ripple effect on later black female writers as one of the first novels that celebrates black female joy. TEWWG does the work of literary representation that publishers did not allow DToaR to do because of the fear that the book would not sell as well if it included more of Hurston’s own political perspective. The second claim that I make is that TEWWG is first dismissed because of its lack of ‘seriousness’ in subject matter by Hurston’s peers, but its use of nature metaphors like the horizon and the tree and motifs like desire and dreams allow for issues of gender, race, class, and love to be discussed because they are shrouded in a literary image disguise.

In communities throughout the developing world, faith-based organizations (FBOs) focus on goals such as eradicating poverty, bolstering local economies, and fostering community development, while premising their activities and interaction with local communities on theological and religious understandings. Due to their pervasive interaction with participants, the religious ideologies of these FBOs impact the religious, economic, and social realities of communities. This study investigates the relationship between the international FBO, World Vision International (WVI), and changes to religious, economic, and social ideologies and practices in Andean indigenous communities in southern Peruvian. This study aims to contribute to the greater knowledge and understanding of 1) institutionalized development strategies, 2) faithbased development, and 3) how institutionalized development interacts with processes of socio-cultural change. Based on fifteen months of field research, this study involved qualitative and quantitative methods of participant-observation, interviews, surveys, and document analysis. Data were primarily collected from households from a sample of eight communities in the Pitumarca and Combapata districts, department of Canchis, province of Cusco, Peru where two WVI Area Development Programs were operating. Research findings reveal that there is a relationship between WVI’s intervention and some changes to religious, economic, and social structure (values, ideologies, and norms) and practices, demonstrating that structure and practices change when social systems are altered by new social actors. Findings also revealed that the impacts of WVI’s intervention greatly increased over the course of several years, demonstrating that changes in structure and practice occur gradually and need a period of time to take root. Finally, results showed that the impacts of WVI’s intervention were primarily limited to those most closely involved with the organization, revealing that the ability of one social actor to incite changes in the structure and practice of another actor is associated with the intensity of the relationship between the social actors. The findings of this study should be useful in ascertaining deductions and strengthening understandings of how faith-based development organizations impact aspects of religious, economic, and social life in the areas where they work.

Bakgrund: Cancer är en av världens vanligaste sjukdomar och den näst vanligaste dödsorsaken. Patienters rätt till delaktighet i vård och behandling är lagstadgad och ligger till grund för medicinsk behandling och omvårdnad. Att se människan bakom patienten är viktigt för att förstå patientens livsvärld. Sjuksköterskans grundläggande omvårdnadsroll är att stötta patienter med det som de inte själva klarar av. Syfte: Att beskriva patienters upplevelse av hur sjuksköterskan kan främja en god vårdrelation, i samband med vård på en onkologisk avdelning. Metod: Studien är en litteraturöversikt, där datamaterialet utgörs av tolv kvalitativa, tre kvantitativa, samt två vetenskapliga artiklar med mixad design. Resultat: Det analyserade resultatet redovisas i fyra olika huvudteman med tillhörande underrubriker. Dessa huvudteman är: Bemötande och information som grund för vårdrelationen, Tillgodose patientens behov, Emotionellt stöd, Skapandet av en nära vårdrelation. Diskussion: Diskussionen visar att patienter behöver individanpassad information och stöd. För att det ska ske behöver sjuksköterskan kunna identidfiera patientens behov. Om inte behoven tillgodoses kan det skapa ett vårdlidande för patienten. En god vårdrelation bygger alltså på att patienten känner sig trygg och sedd i vården.
Background: Cancer is one of the world's most common diseases and the second most common cause of death. Patients' right to participate in care and treatment is statutory and underpins medical treatment and care. Seeing the person behind the patient is important to understand their life world. Nursing's basic care role is to support patients with what they do not manage. Objective: To describe patients' experience of how the nurse can promote a good care relationship, at an oncology department. Method: The study is a literature review. The data material consisted of twelve qualitative, three quantitative and two mixed designed scientific articles. Results: The analyzed result is presented in four different main themes and associated subheadings. These main themes are: Treatment and information as a basis for the care relationship, Relieving patient needs, Emotional support, Creation of a close care relationship. Discussion: The discussion shows that patients need personalized information and support. In order for this to happen, the nurse must be able to identify the patient's needs. Unless the needs are met, it can create an unnecessary care suffering for the patient. A good care relationship is therefore based on the patient feeling safe and seen in the care.

This thesis analyzes the work of Vasily Shuksin, an actor, director and writer in the Soviet Union during the Khrushchev and early Brezhnev eras, roughly 1958-1974. Shukshin's short stories, in particular, are of great value to anyone interested in Soviet attitudes during this period. The research suggests that Shukshin's work represents a sort of underground history. While the writer's stories are fictional, the issues are very real. Much of Shukshin's work provided the means for discussion on important topics such as gender relationships, alcohol use, and religious worship.Under Communism, nearly all sources of information were unable to tell the truth about Soviet society, but Shukshin's depictions of Soviet life appear to present a truer picture of the Khrushchev and Brezhnev eras. The author portrays women as "second class citizens" and often equates them with evil, while Shukshin's depictions of drunken males indicate that alcoholism was a serious problem in the Soviet Union. Finally, the author's religious symbolism provides evidence that Russian Orthodoxy was alive and well, despite a Communist government that continued to wage war against religion.

En el presente artículo, los autores critican este carácter basado en la incertidumbre del control de fusiones. Exigen que estas agencias se basen más en los hechos y no pretendan corregir errores antes de que sucedan. Además, analizan los resultados del control de fusiones en el Derecho comparado. De este modo, llegan a la conclusión de que dicho control suele ser ineficiente, pues genera costos a las empresas y puede evitar fusiones que, a la larga, serían beneficiosas. En el Perú, la existencia de un Proyecto de Ley para regular las fusiones motiva la crítica de los autores, que ven en esta medida un control innecesario y negativo que traería más problemas que beneficios.

Barn i alla åldrar möter sjuksköterskor i vården i såväl planerade som oplanerade möten genom hela uppväxten. Grunden för ett lyckat vårdande möte med barn är tillit. Syftet med denna allmänna litteraturstudie var att beskriva barns och sjuksköterskors erfarenheter av att skapa tillitsfulla vårdande möten. Arbetet genomfördes med deduktiv ansats utifrån Randall, Brook och Stammers (2008) teori Att skapa en god sjuksköterska i omvårdnad av barn. 13 resultatartiklar valdes utifrån sökningar i sju databaser, och granskades för att sedan kategoriseras utifrån teorin Att skapa en god sjuksköterska i omvårdnad av barn. Resultatet mynnade ut i tre huvudteman utifrån teorin. Sjuksköterskor behöver framförallt ha ett lugn i mötet med barn, vara kul och rolig och kunna knyta band till barnen. Även miljön i vilken vården sker är essentiell för ett gott vårdande möte. Slutsatsen av denna litteraturstudie blev att teorin Att skapa en god sjuksköterska i omvårdnad av barn kan vara av stor nytta för sjuksköterskor för att kunna skapa goda vårdande möten med barn.
Children of all ages meet nurses in care, in both planned and unplanned encounters throughout their childhood. The foundation in a successful encounter with children is trust. The purpose of this general literature study was to describe children’s and nurse’s experiences of creating trustful encounters with children. The study was conducted with a deductive approach based on Randall, Brook and Stammers (2008) theory To make a good children’s nurse when caring for children. 13 results articles were selected from searches in seven databases and were reviewed to be categorized based on the theory of creating a good nurse for children. The result emerged in three main themes. Nurses primarily need calmness in the encounter with children, be fun and must connect with the children. The environment in which the care is conducted is also essential in creating a good caring encounter. The conclusion of this literature study is that the theory of creating a good nurse for children could be of great benefit for nurses in their work to create good caring encounter.

This thesis describes a case study online community: online amateur authors. Taking this case study community as a base, this thesis considers how the concept of community is applied within the Semantic Web domain. Considering the community structures that can be demonstrated through the case study, this thesis makes the case for the recognition of a specific type of social network structure, one that fulfils the traditional definitions of ‘community’. We argue that this sub-type occupies an important position within social networks and our understanding of them due to the structures required for them to be so defined and that there are assumptions and inferences which can be made about nodes within this type of community group but not others. Having detailed our case study community and the type of network it represents, this thesis goes on to consider how the community could be supported beyond the mailing lists and journalling sites upon which it currently relies. Through our investigation of the community’s issues and requirements, we focus on identity and explore this concept within the context of community membership. Further we analyse the community practice of metadata annotation, in comparison to other metadata systems such as tagging, and as it related to the development of the community. We propose a number of ontological models which we argue could assist the community and, finally, consider ways in which these models could be made available to the community in keeping with current practice and level of technical knowledge as evidenced by the community.

The position of the Catholic Church within American civic culture has been irreparably altered by the emergence of widespread allegations of sexual abuse by Church officials between 1960 and 2005. This thesis examines the role of the law in the development of this scandal: how the legal position of the Church contributed to its creation, how civil litigation produced its exposure and how the secular legal system answered its demand for legal reform. In doing so, it will argue that, contrary to traditional legal assumptions, private lawsuits were the defining influence on the public crisis that confronted the Church. The allegations of abuse and their expression through this litigation debunked the regulatory autonomy of the Church and thereby caused a powerful rupture in the historical relationship of Church and State.

Annihilation is the first novel in the trilogy named “The Southern Reach,” a ScienceFiction/Horror series of books written by Jeff VanderMeer. Annihilation focuses on a team of scientists on an expedition into an area where the very nature has been altered in mysterious ways. The scientists’ goal is to study this area to come to an understanding of what is happening, but like the eleven previous expeditions, they fail.   With the aid of narratology, I will argue that Jeff VanderMeer’s Annihilation is an unreliable narrative. To prove that, I will analyse and discuss specific passage’s unreliable narration used in the novel, as well as incorporating themes from the novel that directly correlate with the unreliability of the novel’s narrative.  Annihilation is filled with ambiguous language and events that are on almost every  level unexplainable using scientific methods. The way that the novel is written makes the narrator, the biologist, unreliable in her narration of the events that take place around her. She is tormented by both her past and by the beings that inhabit Area X, such as the Crawler. The results of this study exemplify the ambiguity of VanderMeer’s writing and how he uses this ambiguous language to further thrust the narrative into a void of chaotic unreliability. There is nothing in the novel that can be trusted as fact in the context of the world in which the characters inhabit, down to the characters own thoughts and memories. The presented themes of Annihilation are in direct correlation with the unreliability of the narrative and show how deep VanderMeer went into constructing the most unreliable narrative possible.

This thesis is an attempt to explicate the concept of the death of God as it arises within Thomas Altizer's theological writings and the fiction of A.S. Byatt, paying special attention to the idea of the negation of eternal return. The negation of eternal return not only informs Altizer's theology, but also provides a metaphor with which to critique not only the traditional theological idea of God, but also the self-sufficiency of the theological tradition. As Altizer's theology is informed by a literary tradition outside the circle of traditional theological reflection, so this thesis suggests that theology comes about necessarily through self-emptying fictions, and not through the closedness of scholasticism; therefore the fiction of Byatt becomes a point of entry into theological reflection. The negation of eternal return also provides a useful metaphor for the metaphysics of the Proper, and economies of the Same. An intertextual consideration of Altizer's influences and theological development alongside the works of Byatt (specifically Possession, The Virgin in the Garden and Still Life), the thesis is informed also by thinkers such as Mark C. Taylor, Jacques Derrida, and Julia Kristeva, disciplines such as modern physics and nineteenth century biology, and literary works such as "The Dream of the Rood" and Iris Murdoch's The Time of the Angels.

This thesis examines representations of trust in selected British sentimental novels of the eighteenth century. It focuses principally on the manner in which sentimental prose fiction reflects and participates in the shift from premodern to modern formations of trust. Commenting on the nature of modern trust, Anthony Giddens claims that, with the move to modernity, trust relations in the intimate sphere become increasingly dependent on emotional mutuality, while trust in institutions becomes increasingly impersonal and disengaged from assessments of moral character.
My work explores this dual shift in three sentimental novels. It first analyzes Samuel Richardson's Pamela (1740) and contends that Richardson denies the concept of honor its epistemological role in practical deliberations. The denial of the epistemology of honor uncouples the mechanism of personal trust from assessments of role and role performance and thus makes the trust in persons in the intimate sphere less dependent on institutional forms of trust. To replace honor's role in the formation of trust, Richardson proposes that the sentiments can provide reliable grounds for trust in the intimate sphere. However, he denies the sentiments a role in the formation of an encompassing social trust among strangers and mere acquaintances. The thesis proceeds to read Henry Fielding's Amelia (1751). In order to argue that Fielding envisioned divergent grounds for trust relations, it maintains that Fielding considers trust relations in the intimate sphere and trust relations in public life as based on the sentiments and fair distribution respectively. To conclude, the thesis investigates Oliver Goldsmith's The Vicar of Wakefield (1766) to uncover the manner in which Goldsmith distinguishes personal trust in the intimate sphere from general system trust, which Goldsmith ultimately envisions as an ontological trust in providence.

This thesis is concerned with engaging a critic who has been neglected by his peers in the field of Joyce studies for more than forty years. This critic, Joseph Campbell, is an American scholar more popularly known for his studies in myth. However, he began his intellectual career contributing to a subject that emerged in the early years of the critical reception of Finnegans Wake: that the dream depicted in Joyce???s final masterpiece is dependent on a Dreamer. The neglect Campbell???s work has endured is largely due, this thesis argues, to an inaccurate treatment of his reading of this dream figure. This inaccuracy largely stems from a critic, Clive Hart, who engages with the debate of the Dreamer as an introductory means to demonstrating the ???structural??? theories involved in the Wake. As a minor feature of Hart???s analysis, Campbell???s theory of the Dreamer is identified with another method, one belonging to a fellow American Joycean, Edmund Wilson, a method incongruent with Campbell theories of dream consciousness. Subsequently, Campbell remains an undeveloped scholar within Joyce criticism. To counter Hart???s inaccurate depiction of Campbell, this thesis argues that there is provision in early scholarship to re-evaluate Campbell???s theory of the Dreamer in more developed terms. In this respect, the thesis is divided up into three sections. The first section is a literary review of this early scholarship, demonstrating certain influential strains of thought equivalent to Campbell???s ???metaphoric??? concept of the Dreamer, one that contrasts with the rigid, ???literal??? ideas his work is predominantly identified. The second section examines Campbell???s account in detail and the specific criticism it drew from Hart. Finally, the third section argues that Campbell???s interpretation of the Dreamer is best engaged through an archetypal account of the Dreamer, one that regards the symbols encountered in the Wake through the ???guiding??? features of a mythological concept of the psyche sensitive to the reflexive tendencies of the dream portrayed, Campbell???s ???cosmogonic cycle???.

This research investigates the connection between ethics and aesthetics in the representation of violence in the novel Cidade de Deus by Paulo Lins. The intense presence of violence in Brazilian history is articulated not only with forms and themes, but also with the ways artists express themselves, including in literature. The so-called crime fiction literature, which Cidade de Deus stands out as an example of, shows violence in an urban context as the main theme. This research aims to contribute to the studies on representations of violence and their meanings in literature and how that advanced Brazilian literary criticism, by analyzing the formal features and thematic aspects of the novel Cidade de Deus. We attempt to analyze the description of violence in the book, especially regarding the limits and representation possibilities within the ethical sphere, considering how it s impossible to represent the catastrophe. Issues we address are: the author s point of view and how he represents it; the outlines for representing extreme situations, which cannot be compared to anything other situation; the fact that the representation of violence brings implications to realism and the insight built by Paulo Lins and the possible connections between the representation of violence in the novel and the concepts of trauma, testimony, and melancholy, the way they have current been used in critical literary. The results show that Cidade de Deus can t be considered a testimonio due to the fact that this genre is set in post-dictatorial Latin America, despite its POV-style (Point of View) content, among other reasons, because it does not present a hesitant and unreliable narrator. We have also demonstrated that the insight s effect, hailed by critics, consists of literary and non-literary aspects and procedures. Moreover, we conclude and try to prove that Lins's novel is irregular, since it occasionally brings the representation of violence in order to encompass multiple meanings; in other times, it brings joy through stereotypical representations of violence. The theoretical framework is grounded in the proposals of Karl Erik Schollhammer, Tania Pellegrini, Jaime Ginzburg, Márcio Seligmann-Silva, Antonio Candido, Beatriz Resende and Hal Foster
Esta pesquisa consiste em investigar imbricamentos éticos e estéticos da representação da violência no romance Cidade de Deus, de Paulo Lins. A intensa e contínua presença da violência na História do Brasil está articulada tanto com as formas e os temas das manifestações artísticas brasileiras contemporâneas, inclusive as literárias, como com seus modos de produção e recepção. A chamada literatura marginal, da qual Cidade de Deus é um dos principais representantes, traz a violência, via contexto urbano, como protagonista. Procuramos apreender a inscrição da violência nesta obra, especialmente no que se refere aos limites e possibilidades de representação dentro da esfera da ética, considerando a própria impossibilidade da representação da catástrofe. As questões-problemas que abordamos dizem respeito à contaminação do ponto de vista e às questões de representatividade do autor; aos contornos dados para situações-limite, que não admitem termos de comparação; às implicações que a representação da violência traz ao realismo e à visão interna construídos por Paulo Lins, e às possibilidades de relação da representação da violência no romance com os conceitos de trauma, testemunho e melancolia, da forma como eles têm sido trabalhados na crítica literária atualmente. Os resultados mostram que Cidade de Deus não pode ser considerado um testimonio da forma como este gênero se configurou na América Latina pós-ditatorial, entre outras razões, pelo fato de não constituir um narrador hesitante e não confiável , não obstante seu teor testemunhal. Demonstramos também que o efeito visão interna , festejado pela fortuna crítica do romance, é constituído por procedimentos e aspectos literários e extraliterários. Ademais, concluímos e procuramos demonstrar que a irregularidade marca o romance de Lins, uma vez que ele nos traz, em algumas passagens, a representação da violência de forma a engendrar múltiplos sentidos; em outras passagens, deixa-se levar pela fruição de um deleite causado pela representação estereotipada da violência. A fundamentação teórica assenta-se nas propostas de Karl Erik Schollhammer, Tânia Pellegrini, Jaime Ginzburg, Márcio Seligmann-Silva, Antonio Candido, Beatriz Resende e Hal Foster

The objective of this dissertation is to present an exegetic study of a biblical poem: Psalm 42 43. This undertaking is justified in the measure that the search for the original meaning of a text which is inspired by God and is the bearer of a universal message of salvation can favor reflection on one of the problems that most disturbs the human conscience: human suffering and faith in a God who is omnipotent and filled with benevolence. Due to the particular position of this poem [at the start of the section of the Psalter which proportionally speaks most of human suffering] and certain stylistic traces [the striking comparison at the beginning of the poem; the name of God mentioned 22 times; the tetragram in the middle of it to call attention to a particular attitude of the person praying] this research has as a hypothesis that these Psalms throw some light on the subject of God s presence in the lives of people who suffer. In the style of commentary, the research continues following the steps of synchronic analysis with some reference to diachronic analysis when necessary. It analyzing the literary beauty and certain cultural, historical and theological aspects of one of the sacred texts which was chosen as a model of prayer for Israel because it deals with one of the vital problems of the human being in a realistic and beautiful manner. As a result of this work five essential elements were discovered which appear to contribute towards reflection on the presence of God next to the suffering human person: 1) the importance of trust in God; 2) how the presence of God appears to be experienced as absence; 3) worship as a privileged manner of communication and communion with God; 4) the misunderstanding of God as one of the causes of the difficulty to deal with suffering; 5) confining the presence of God to only the Temple in Jerusalem as a theological limitation of this poem
A presente dissertação tem como objetivo apresentar um estudo exegético de um poema bíblico: Sl 42 43. Tal empreendimento se justifica na medida em que a busca pelo sentido original de um texto, que foi inspirado por Deus e é portador de uma mensagem universal de salvação, possa favorecer a reflexão sobre um dos problemas que mais perturba a consciência humana: o sofrimento humano e a crença em um Deus cheio de bondade e onipotente. Dada a singular posição deste poema encabeça a parte do Saltério que, proporcionalmente, mais fala de sofrimento humano e certos indícios estilísticos a impactante comparação no início do poema, o nome de Deus citado 22 vezes, o tetragrama no centro do poema para chamar a atenção a uma determinada atitude do orante esta pesquisa tem como hipótese que estes Salmos lançam alguma luz sobre a questão da presença de Deus junto ao ser humano sofredor. No estilo de comentário, a pesquisa avança seguindo os passos de uma análise sincrônica com acenos à diacronia, quando necessário, analisando a beleza literária e certos aspectos culturais, históricos e teológicos de um dos textos sagrados que foi escolhido como modelo de oração para Israel por ele tratar de um dos problemas vitais do ser humano de maneira realista e bela. Como resultado deste trabalho foram encontrados cinco elementos essenciais que parecem contribuir na reflexão sobre a presença de Deus junto ao ser humano que sofre, a saber: 1) a importância da confiança em Deus; 2) o modo da presença de Deus parece ser sua ausência sentida; 3) o culto como uma maneira privilegiada de comunicação e comunhão com Deus; 4) a incompreensão de Deus como uma das causas da dificuldade de se lidar com o sofrimento; 5) o confinamento da presença de Deus apenas ao Templo de Jerusalém como uma limitação teológica deste poema

This thesis argues that a prominent concern among contemporary writers of fiction is the recuperation of lost or occluded histories. Increasingly, contemporary writers, especially postcolonial writers, are using the medium of fiction to explore those areas of political and cultural history that have been written over or unwritten by the dominant narrative of “official” History. The act of excavating these past histories is simultaneously both traumatic and liberating – which is not to suggest that liberation itself is without pain and trauma. The retelling of traumatic pasts can lead, as is portrayed in The God of Small Things (1997), to further trauma and pain. Postcolonial writers (and much of the world today can be construed as postcolonial in one way or another) are seeking to bring to the fore stories of the past which break down the rigid binaries upon which colonialism built its various empires, literal and ideological. Such writing has in a sense been enabled by the collapse, in postcolonial and postmodernist discourse, of the Grand Narrative of History, and its fragmentation into a plurality of competing discourses and histories. The associated collapse of the boundary between history and fiction is recognized in the useful generic marker “historiographic metafiction,” coined by Linda Hutcheon. The texts examined in this study are all variants of this emerging contemporary genre. What they also have in common is a concern with the consequences of exile or diaspora. This study thus explores some of the representations of how the exilic experience impinges on the development of identity in the postcolonial world. The identities of “displaced” people must undergo constant change in order to adjust to the new spaces into which they move, both literal and metaphorical, and yet critical to this adjustment is the cultural continuity provided by psychologically satisfying stories about the past. The study shows that what the chosen texts share at bottom is their mutual need to retell the lost pasts of their characters, the trauma that such retelling evokes and the new histories to which they give birth. These texts generate new histories which subvert, enrich, and pre-empt formal closure for the narratives of history which determine the identities of nations.

Mirrors and Vanities is a multi-modal collection which showcases the diversity of working in long and short storytelling forms. Featured in this thesis are fiction, nonfiction, graphic narrative, and screenplay. Using unconventional approaches to storytelling in order to achieve emotional resonance with the audience while maintaining high standards for craft, these stories and essays explore the costs inherent to the subtle nuances of interpersonal relationships. The fiction focuses on the complications of characters keeping secrets. A husband discovers the truth behind his wife's miscarriage. A girl visits her fiance in purgatory. A boy crosses a line and loses his best friend. Meanwhile, the nonfiction centers on self-discovery and gender roles associated with power struggles. A schizophrenic threatens to ruin my mother's wedding. I rediscover my relationship with my father through food writing. Sword-work teaches me to fail and succeed at making martial art. The title work of the thesis is a collaged story highlighting the tribulations of a physicist fixated on recovering his lost love by manipulating the multiverse. The multi-modal format implicates the nebulosity of physics theories and how different aspects of the narrative can be presented in various formats to best suit the nature of the storytelling. Through the interactions of characters in mundane and extraordinary circumstances, the works in this thesis examine the consequences of choice, the contrast between reality and expectation, coming of age, and the Truth of narrative.

This PhD dissertation is about legal fictions in private law. A legal fiction, broadly, is a false assumption knowingly relied upon by the courts. The main aim of the dissertation is to formulate a test for which fictions should be accepted and which rejected. Subsidiary aims include a better understanding of the fiction as a device and of certain individual fictions, past and present. This research is undertaken, primarily, to establish a rigorous system for the treatment of fictions in English law - which is lacking. Secondarily, it is intended to settle some intractable disputes, which have plagued the scholarship. These theoretical debates have hindered progress on the practical matters which affect litigants in the real world. The dissertation is divided into four chapters. The first chapter is a historical study of common-law fictions. The conclusions drawn thereform are the foundation of the acceptance test for fictions. The second chapter deals with the theoretical problems surrounding the fiction. Chiefly, it seeks precisely to define 'legal fiction', a recurrent problem in the literature. A solution, in the form of a two-pronged definition, is proposed, adding an important element to the acceptance test. The third chapter analyses modern-day fictions and recommends retention or abolition for each fiction. In the fourth chapter, the findings hitherto are synthesised into a general acceptance test for fictions. This test, which is the thesis of this work, is presented as a flowchart. It is the author's hope that this project will raise awareness as to the merits and demerits of legal fictions, de-mystify the debate and bring about reform.

Incontestablement présent dans d’innombrables incriminations, le contrat fait toutefois l’objet de conceptions particulières que la doctrine relève ponctuellement comme autant de marques d’autonomie de la matière. Mais la présentation du contrat en droit pénal par le simple constat de solutions autonomes ne peut suffire, qui ne permet pas de déterminer, de manière positive et rationnelle, ce en quoi le contrat consiste en droit pénal.En refusant de lui transposer l’ensemble du régime contractuel, le droit positif semble pourtant formuler le principe d’une sélection que la finalité du droit pénal peut éclairer de manière décisive. Le contrat en droit pénal apparaît alors, qui résulte ainsi d’une sélection fonctionnelle des dispositions du régime contractuel : seules celles assurant la finalité du droit pénal doivent être caractérisées
As a « bedrock of the legal order », the contract is not ignored by criminal law. Unquestionably present in many offences, the contract is the object of specific conceptions that the doctrine find here and there as signs of the autonomy of criminal law.However, the presentation of the contract in criminal law through the statement of fact that autonomous solutions exist, is not sufficient. It doesn’t allow establishment in a positive and rational way, the real definition of the contract in criminal law.By refusing transposition of the entire contractual settlement, current law expresses the principle of a selection and that the purpose of criminal law may clarify it in a decisive way.Then, the contract in criminal law appears, resulting of a functional selection from the dispositions of contractual settlement: only the ones which maintain the aim of criminal law must be distinguished

Diese Arbeit bietet eine solide theoretische Grundlage zu Philanthropie und religiös motivierten Spendenaktivitäten und deren Einfluss auf Wohltätigkeitstrends, Entwicklungszusammenarbeit und einer auf dem Gedanken der sozialen Gerechtigkeit beruhenden Philanthropie. Untersucht werden dafür die Strukturen religiös motivierte Spenden, für die in der islamischen Tradition die Begriffe „zakat“, „Waqf“ oder im Plural auch „awqaf-“ oder „Sadaqa“ verwendet werden, der christliche Begriff dafür lautet „tithes“ oder „ushour“. Aufbauend auf diesem theoretischen Rahmenwerk analysiert die qualitative und quantitative Feldstudie auf nationaler Ebene, wie die ägyptische Öffentlichkeit Philanthropie, soziale Gerechtigkeit, Menschenrechte, Spenden, Freiwilligenarbeit und andere Konzepte des zivilgesellschaftlichen Engagements wahrnimmt. Um eine umfassende und repräsentative Datengrundlage zu erhalten, wurden 2000 Haushalte, 200 zivilgesellschaftliche Organisationen erfasst, sowie Spender, Empfänger, religiöse Wohltäter und andere Akteure interviewt. Die so gewonnen Erkenntnisse lassen aussagekräftige Aufschlüsse über philanthropische Trends zu. Erstmals wird so auch eine finanzielle Einschätzung und Bewertung der Aktivitäten im lokalen Wohltätigkeitsbereich möglich, die sich auf mehr als eine Billion US-Dollar beziffern lassen. Die Erhebung weist nach, dass gemessen an den Pro-Kopf-Aufwendungen die privaten Spendenaktivitäten weitaus wichtiger sind als auswärtige wirtschaftliche Hilfe für Ägypten. Das wiederum lässt Rückschlüsse zu, welche Bedeutung lokale Wohltätigkeit erlangen kann, wenn sie richtig gesteuert wird und nicht wie bislang oft im Teufelskreis von ad-hoc-Spenden oder Hilfen von Privatperson an Privatperson gefangen ist. Die Studie stellt außerdem eine Verbindung her zwischen lokalen Wohltätigkeits-Mechanismen, die meist auf religiösen und kulturellen Werten beruhen, und modernen Strukturen, wie etwa Gemeinde-Stiftungen oder Gemeinde-„waqf“, innerhalb derer die Spenden eine nachhaltige Veränderung bewirken können. Daher bietet diese Arbeit also eine umfassende wissenschaftliche Grundlage, die nicht nur ein besseres Verständnis, sondern auch den nachhaltiger Aus- und Aufbau lokaler Wohltätigkeitsstrukturen in Ägypten ermöglicht. Zentral ist dabei vor allem die Rolle lokaler, individueller Spenden, die beispielsweise für Stiftungen auf der Gemeindeebene eingesetzt, wesentlich zu einer nachhaltigen Entwicklung beitragen könnten – und das nicht nur in Ägypten, sondern in der gesamten arabischen Region. Als konkretes Ergebnis dieser Arbeit, wurde ein innovatives Modell entwickelt, dass neben den wissenschaftlichen Daten das Konzept der „waqf“ berücksichtigt. Der Wissenschaftlerin und einem engagierten Vorstand ist es auf dieser Grundlage gelungen, die Waqfeyat al Maadi Community Foundation (WMCF) zu gründen, die nicht nur ein Modell für eine Bürgerstiftung ist, sondern auch das tradierte Konzept der „waqf“ als praktikable und verbürgte Wohlstätigkeitsstruktur sinnvoll weiterentwickelt.
This work provides a solid theoretical base on philanthropy, religious giving (Islamic zakat, ‘ushour, Waqf -plural: awqaf-, Sadaqa and Christian tithes or ‘ushour), and their implications on giving trends, development work, social justice philanthropy. The field study (quantitative and qualitative) that supports the theoretical framework reflects at a national level the Egyptian public’s perceptions on philanthropy, social justice, human rights, giving and volunteering and other concepts that determine the peoples’ civic engagement. The statistics cover 2000 households, 200 Civil Society Organizations distributed all over Egypt and interviews donors, recipients, religious people and other stakeholders. The numbers reflect philanthropic trends and for the first time provide a monetary estimate of local philanthropy of over USD 1 Billion annually. The survey proves that the per capita share of philanthropy outweighs the per capita share of foreign economic assistance to Egypt, which implies the significance of local giving if properly channeled, and not as it is actually consumed in the vicious circle of ad-hoc, person to person charity. In addition, the study relates local giving mechanisms derived from religion and culture to modern actual structures, like community foundations or community waqf that could bring about sustainable change in the communities. In sum, the work provides a comprehensive scientific base to help understand- and build on local philanthropy in Egypt. It explores the role that local individual giving could play in achieving sustainable development and building a new wave of community foundations not only in Egypt but in the Arab region at large. As a tangible result of this thesis, an innovative model that revives the concept of waqf and builds on the study’s results was created by the researcher and a dedicated board of trustees who succeeded in establishing Waqfeyat al Maadi Community Foundation (WMCF) that not only introduces the community foundation model to Egypt, but revives and modernizes the waqf as a practical authentic philanthropic structure.
