Although it is an ancient and much-discussed problem, political obligation continues to pose challenges to political and legal philosophers. Some of these challenges are conceptual, for they require explanations of what a political obligation is and how it differs from other obligations, duties, or responsibilities. Other challenges concern the practical matters of whether and to what extent political obligations are truly binding on us. In this respect, the foremost challenge is that of anarchism, including the “philosophical anarchism” that has become increasingly influential in recent decades. This chapter aims to meet these challenges by setting out a coherent account of political obligation and providing reason to believe that neither political nor philosophical anarchists have made a satisfactory a priori case against the possibility of a compelling theory of political obligation.

This chapter provides concluding thoughts on the subject, stressing that this book is supportive of the idea of religious arbitration, and secular society benefits in many ways from allowing religious communities and their members to contractually resolve their commercial and family law disputes. Secular society must regulate arbitration by making sure that (1) people are truly voluntarily agreeing to such arbitration in a way that shows a true consent to religious arbitration; (2) such arbitrations are limited to monetary matters and not treading on the unique police powers of the general society; and (3) procedural due process is followed in arbitration hearings. Related to that is that religious arbitrators, to be successful, must integrate well the norms of the secular society that intermingles with their own religious community. Our law should be increasingly open to the idea that people can structure their relationships around a contract, rather than around sacrament.

How Constitutional Rights Matter explores whether constitutionalizing rights improves respect for those rights in practice. Drawing on global statistical analyses, case studies in Colombia, Myanmar, Poland, Russia, and Tunisia, and survey experiments in Turkey and the United States, this book advances three claims. First, enshrining rights in constitutions does not automatically ensure that those rights will be respected in practice. For rights to matter, rights violations need to be politically costly, which can happen when citizens mobilize against governments that encroach upon their rights. Successfully resisting the government, however, is no small feat for unconnected groups of citizens, and governments can often get away with constitutional rights violations. Second, some rights are more likely to be enforced than others. The reason is that some rights come with natural constituencies that are able to mobilize for their enforcement. This is the case for rights that are practiced by and within organizations, or “organizational rights,” such as the rights to religious freedom, unionize, and form political parties. Because religious groups, trade unions, and political parties are highly organized, they are well equipped to use the constitution to resist rights violations. Indeed, we find that these organizational rights are systematically associated with better practices. By contrast, rights that are practiced on an individual basis, such as free speech or the prohibition of torture, usually lack constituencies to enforce them, which makes it easier for governments to violate them. Third, even highly organized groups armed with the constitution face an uphill battle. Although such groups may be able to successfully resist repressive practices, they often can only delay governments that are truly dedicated to rights repression.

It describes what Cavendish thinks a truly well-ordered and perfectly regular universe would be like. According to Cavendish’s mature natural philosophy, Nature has “but One Law,” which is “to keep Infinite matter in order, and to keep so much Peace, as not to disturb the Foundation of her Government”; when the “foundation” of Nature is not disturbed, matter moves in orderly, peaceful ways. This suggests that, for Cavendish, Nature’s goal is for matter to be orderly and for its “regular” motions not to be disturbed. For the natural world to be peaceful is for it to be orderly, and that means the motions of matter must be regular, not irregular.

Treatment with monoclonal antibodies that deplete B lymphocytes has proven that B cells are critical to relapse development in multiple sclerosis. While immunopathophysiology is clearly important in MS, whether multiple sclerosis is truly an autoimmune disorder and the target or targets of the autoimmunity remain unknown.

In Learning from My Daughter, the author claims that living with a daughter who has multiple and significant disabilities, including cognitive disabilities, has been utterly transformative for thinking about her training, career and research as a philosopher. Interweaving the personal voice with the philosophical, the book argues that cognitive disability should reorient us to what truly matters; raises the question of whether normalcy is necessary for a good life; considers the ethical questions regarding prenatal testing and what it implies for understanding disability, the family, and ethically informed bioethics; and discusses the importance of care and an ethic built on an adequate understanding of care as it ought to be—not simply in how it is—practiced. The end of the book takes on the controversial case of Ashley X and the ethics of growth attenuation. In Learning from My Daughter, the disabled person takes center stage, but so does the ethic that needs to guide care. An ethic of care—if properly understood, the author claims—can be an ethical theory that is most useful for fully integrating disabled people and allowing them to live lives that are joyful and fulfilling.

This chapter examines the strategy being adopted in England and Wales to enable the arbitration of trust disputes to be introduced, and the steps that have already been taken in that direction. One particular obstacle to progress in Britain is Article 6.1 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, which requires that everyone’s civil rights and obligations be determined by way of a public hearing, whereas arbitrations are traditionally confidential and heard in private. This concluding chapter looks at the legacy of the contest of 1989 and 1990. The legacy of 1989–90 shows the power of chance and contingency. At many points, all state leaders, superpower and otherwise, were simply reacting to change. They had to propose models of order for the future precisely because they were overwhelmed by disorder. Often they were not so much designing events as simply surviving them. The challenge was to make the best use of events, no matter how unexpected they might be. The most unexpected was the opening of the Berlin wall on November 9, 1989, which shocked everyone, and might easily not have happened at all. Indeed, the collapse of the Berlin wall and the subsequent struggle to co-create order in post-Cold War Europe represent truly major turning points in modern history.

This chapter offers a limited defense of a controversial argument put forward by Ted Kaczynski, the “Unabomber,” namely that technological society threatens humanity’s survival. It draws on direct correspondence and prison interviews with Kaczynski and applies his broader views to the robotization of humanity; and it argues that the technological system is so complex that users are forced into choosing between jailed technology controlled by those within existing oppressive power structures, dedicating their lives to building knowledge and understanding of the software and robotics that facilitate participation in the technological system, or otherwise revolting against said system. That is, contra Peter Ludlow, it is not simply a matter of putting technology back in the hands of the people through “hacktivisim” or open-source design and programming. We must either accept revolt as permissible or recover a philosophy of technology truly geared toward human ends—parts set against the dehumanizing whole.

When one thinks truly, what one thinks is what is the case. In this truistic but influential thought lies the germ of the identity theory of truth. For, in the broadest terms, the identity theory holds that truth is a matter of identity between how things are and how one takes them to be. Giving such a theory substantive content, however, requires the specification of a pair of candidate entities for identification. The early sections of this chapter consider identity theories based on the most frequently proposed pair of entities, namely facts and propositions, focusing in particular on whether such theories can steer between the Scylla of mere truism and the Charybdis of absurdity (such as making falsehood impossible). The final sections briefly examine the connections between the identity theory of truth and quietism, on the one hand, and monistic idealism on the other.

If an experience is distressful enough to be called suffering, does it truly end, or does residue of the experience continue to assault the person’s wholeness? In this chapter, we offer three themes that that emerged as means to resolve suffering or to protect themselves from experiencing suffering despite distress. They are: (1) having goals, (2) sharing the power of the family story and (3) maintaining friendships with other African-American men. The three themes were often interrelated in men’s accounts. Men interviewed for this research revealed the importance of looking toward the future with hope and plans in hand, keeping previous generations alive through reminiscence and, seeking friendship with other men, particularly during caregiving (Black, 2015; Mattis et al., 2001) and showed older African-American male caregivers to be involved in reciprocal friendships with other men, which one man described as “what keeps me going.”

Philosophical/epistemic theories of rationality differ over the role of judgment in rational argumentation. According to the “classical model” of rationality, rational justification is a matter of conformity with explicit rules or principles. Critics of the classical model, such as Harold Brown and Trudy Govier, argue that the model is subject to insuperable difficulties. They propose, instead, that rationality be understood, ultimately, in terms of judgment rather than rules. In this paper I respond to Brown’s and Govier’s criticisms of the classical model, and to the “judgment model” they propose in its place. I argue that that model is unable both to distinguish between rational and irrational judgment and to avoid recourse to rules, and is therefore inadequate as an account of rationality, critical thinking, or argument appraisal. More positively, I argue that an adequate account of rationality must include a place for both rules and judgment.

The volume summarises the contributions to the fourth conference of the Working Group "Law and Politics in the European Union", which was jointly organised with the Friedrich-Ebert-Stiftung in Berlin in April 2017. We started by investigating how narratives develop and what functions they have in the integration process. Does the "Europe of the Fatherlands" lead us into a European Union that is more strongly shaped by the national identity of the member states than before? What remains of the legal community? Is "peace" an outdated narrative? Why is it so difficult to reform the "Europe of welfare states" into a truly European social space? A number of arguments militate in favour of a more differentiated, flexible and pluralistic European legal area. It is far from clear, however, how such a structure could live up to democratic standards and on which normatively convincing narrative it could be established. With contributions by Armin v. Living things are truly strange objects. They stand squarely within the material world, but at the same time flaunt capacities that far exceed those of inanimate matter. Life is in some sense a singular phenomenon: astonishingly, all creatures from bacteria to elephants, redwoods and humans belong to a single enormous family. What life is, how living things work, how they mesh with the realm of physics and chemistry, and how they came to be as we find them—these are the questions that define the science of biology. A rational sense of the world requires finding in it a place for life. Many of the answers are known, but as knowledge expands relentlessly it becomes ever harder to grasp the phenomenon of life whole. This book aims to make the phenomenon of life intelligible to serious readers who are not professional biologists by giving them a sense of the biological landscape: presenting the principles as currently understood and the major issues that remain unresolved, as simply and concisely as may be. What emerges is a biology that is internally consistent and buttressed by a wealth of factual knowledge, but also inescapably historical and complex. The hallmark of life is organization, order that has purpose; and that sets biology apart from the physical sciences. Despite a century of spectacular progress the phenomenon of life remains tantalizingly beyond our grasp, bracketed by two stubborn mysteries: the origin of life at one end, the nature of mind at the other.
