Many analysts of Brazilian industrial relations share a determinist vision of the country’s trade unionism, according to which the unions maintain a paradoxical yet atavistic relationship with the heavy body of laws that provide them with advantages while limiting their freedom. We tested this vision by conducting field enquiries into the daily activities of two Brazilian unions: the ABC Metalworkers Union and the Seamstress Union for the Sao Paulo and Osasco Region. In this article, we present the results of our case studies and what they reveal about Brazilian trade unionism’s relationship with the labour legislation. We also briefly discuss former trade union leader and current President Lula’s recent attempts to reform the country’s labour relations system.

The article deals with the trade unions as a grant to protect the rights and interests of civil servants, reveals the main tasks of trade unions. The activity of trade union organizations in the structure of the state body in Ukraine is analyzed. The legal mechanisms of asserting the violated rights of a civil servant by a trade union organization of a public body and the role of trade unions in protecting the rights of civil servants in developed countries are emphasized. The state at certain times gave the trade unions great powers to protect the rights and interests of workers, and then deprived the trade unions of these powers. In connection with this, various problems arose in regulating the activities of trade unions in the protection of individual and collective rights and interests in the protection of public servants. All this affected the legal status of trade unions. However, it should be noted that trade unions are in constant flux and this leads to improvements in the regulations governing their activities. However, it should be noted that today there are many problems in Ukraine regarding the exercise by the trade union organizations of their powers in the civil service. In particular, the legal status of trade unions in the civil service is not regulated enough, which, in turn, does not allow them to fully protect the legal rights and interests of civil servants. Considering the importance of trade unions in protecting labor rights and the socio-economic interests of workers, in developing democratic forms of citizen participation in managing economic and political processes, a democratic, legal, and social state, which is Ukraine, should support trade unions and take care of legislative consolidation. their authority. Trade unions at all levels should once again return to the consideration of their core functions and pay attention to those that will now be more conducive to the achievement of the main objective of the creation and activity of trade unions – the protection of social-labor rights and interests of trade union members. Today’s Ukraine needs strong unions. A strong union is a union that effectively protects the interests of its members, enjoys their trust and support, is able to organize, if necessary, collective action to protect the socio-economic rights and interests of employees, has sufficient organizational, financial, and human resources to fulfill its statutory tasks. The context for this work is the learning and skills system in England, not for the United Kingdom as a whole. It presents a case study of the way in which we in unionlearn, the learning and skills organisation established by the Trades Union Congress (TUC), have developed a model and strategy for supporting learners in unions. Unions in other European Union (EU) countries may wish to consider how this model could be contextualised in their own industrial relations systems when developing the role of their union representatives and officers in learning and skills.

Since the Webbs published Industrial Democracy at the end of the nineteenth century, the principle that workers have a legitimate voice in decision-making in the world of work – in some versions through trade unions, in others at least formally through separate representative structures – has become widely accepted in most West European countries. There is now a vast literature on the strengths and weaknesses of such mechanisms, and we review briefly some of the key interpretations of the rise (and fall) of policies and structures for workplace and board-level representation. We also discuss the mainly failed attempts to establish broader processes of economic democracy, which the eclipse of nationally specific mechanisms of class compromise makes again a salient demand. Economic globalization also highlights the need for transnational mechanisms to achieve worker voice (or more radically, control) in the dynamics of capital–labour relations. We therefore examine the role of trade unions in coordinating pressure for a countervailing force at European and global levels, and in the construction of (emergent?) supranational industrial relations. However, many would argue that unions cannot win legitimacy as a democratizing force unless manifestly democratic internally. Therefore we revisit debates on and dilemmas of democracy within trade unions, and examine recent initiatives to enhance democratization.

At the present stage of development of the trade union movement in Ukraine, the issues of determining the place and role of trade unions in the system of public administration as a subject of public administration and the institution of civil society are relevant. The lack of legal recognition of social partnership, and its replacement by social dialogue has led to a decrease in the influence of trade unions on social protection and the lack of trade union control. The latter has been replaced by public control exercised in Ukraine by various public associations. The aim of the article: As a result, trade unions began to participate as advisory bodies rather than as defenders of workers' labor rights. Accordingly, the relations with the subjects of public administration have changed. The aims of the article: to demonstrate that not only in the Ukrainian practice of public administration, but also in the science of public administration, no attention is paid to the problem of trade union control and the relationship between trade unions and public administration entities. Object of research: trade unions as a subject of public administration. Research methodology: a review of Ukrainian literature sources on trade union control and its impact on the relationship of public administration. The results obtained: in the Ukrainian science of public administration there are no publications on trade union activities and trade union control; the mechanisms for building relationships between trade unions and public administration entities are not defined; there is a constant perception that trade unions are public associations and their main role is to conduct a dialogue between employers, authorities and employees; there is no clear conceptual view of the trade union control process, which causes many legal conflicts. Practical significance: scientific substantiation of the use of the concept of "trade union control" in legal practice and in the activities of public administration, its clear definition makes it possible to influence the rights of workers and influence the development of social policy by public administration.

This thesis explores three closely related questions in order to further the understanding of contemporary United Kingdom trade unionism and make an original contribution to knowledge. The first relates to understanding the distinct identities which trade unions project in the public domain. The second relates to those trade unions that display what will be called a niche union identity in order to organise a sector of the labour market, and which are therefore axiomatically not general in character. The third relates to what will be called niche unionism, which is a broader concept incorporating those unions that seek to organise niches through sectionalised structures. The work both acknowledges extant literature and advances knowledge in the field of industrial relations, and draws upon contributions from other disciplines where these inform the intellectual discussion. It is argued that existing theoretical approaches are inadequate for understanding the identities projected by contemporary UK Certified trade unions, and that the concept of niche in relation to trade unions has received minimal consideration in industrial relations literature. Therefore it is argued that a new conceptual framework is required. The methodological approach adopted was empirical pragmatism, with data being collected using mixed methods. The work was limited to certified unions operating within the United Kingdom and to data collected between October 2008 and August 2015. The work makes an original contribution to knowledge by introducing a multidimensional framework for the analysis of trade union identities based upon a limited number of ‘primary’ and ‘secondary’ sources that determine the territories within which unions organise, together with certain ‘additional’ sources. This framework then facilitates the recognition of both niche union identity and the practice of niche unionism.

Trade unions are juristic entities and volitional associations that have, historically and ideologically, represented the aggregate strength of labour to maximise their effectiveness in their endeavour to fulfil their core responsibilities and principal functions. However, Ceronie (2007) postulates that, in South Africa, there has been a loss of ideological support for unions since the dawn of democracy. The establishment of the democracy had the effect that a huge driving gear to belong to a union was lost. The mandate of trade unions is to, inter alia, protect, maintain, and improve the working conditions of their members. They fulfil this mandate by ensuring that they offer services that meet, if not exceed, members' satisfaction levels. Trade unions ultimately exist to protect both the work- and non-work-related interest of their members, whether these be economic, social, political, or environmental (Venter, 2003). Nel et al. (2005) asseverate that trade unions are membership organisations: They exist because of their members, they are made up of members, they serve their members' interest, and they are governed by their members. That is, they derive their authority and mandate from the members. Therefore, trade union are service providers. They must give employees enough reason to become attracted to them as members and to remain members. Simply put, trade unions, as the embodiment of workers' aspirations, owe a duty of care to their members, and thus should at all times, act in their best interests. Thus, the kind and quality of services offered by trade unions should be perceived by members as sufficient and satisfactory. Highly satisfied and committed union members are more likely to support and participate in trade union activities. Trade unions, like any other organisation that provides services, are faced with challenges of membership decline due to perceived poor services or the lack thereof, and are therefore required to devise remedial measures to mitigate the membership decline. Against the backdrop of the foregoing, the aim of the study was to examine if there is a relationship between the quality of services and benefits offered by unions to their members and member satisfaction. The sample comprised members of the three major unions within the public service of South Africa. Using the quantitative paradigm, primary empirical data were collected by distributing 500 questionnaires, which yielded a 48.9% response rate. Data were analysed using the SPSS Statistics 23 software program. The questionnaire was valid and reliable, with an overall scale reliability coefficient of α = .975. The findings revealed moderate levels of member satisfaction (56%) with low dissatisfaction (16%), and a significantly high participation rate in union activities (61%), and union effectiveness (80%). That is, the findings revealed that members were generally satisfied with their unions' performance. The findings affirm union instrumentality, union effectiveness, and member participation as antecedents of union commitment, and also confirm unions' performance and effectiveness as significant determinants of members' satisfaction with a union. Therefore, in a quest to maintain and/or increase their relevance, trade unions must examine their current services and benefits, in order to determine whether they still meet their members' preferences, and, if not, to develop and provide a new service mix that will not only appeal to unionised members, but will also attract non-unionised workers.

ENGLISH ABSTRACT: The assignment examines the policy positions of the Congress of South African Trade Unions (COSATU) on restructuring and privatisation. The assignment's theoretical point of departure is found in the work of Levitsky and Way (1998). Levitsky and Way (1998) examines the alliance between a political party and its labour ally in the context of neo-liberal economic reform. The context is usually a political party that has come to power with the aid of a powerful trade union federation. The authors are interested in establishing if the party-union alliance would be sustained if the political party embarks on drastic economic reforms that have the potential to undermine trade union federations. The two cases that are investigated are Poland and Argentina, because in both these cases, a political party has been swept into power with the aid of a powerful trade union federation. Against the background of neo-liberal economic reforms, both trade union federations initially supported the economic reforms. In the medium and long term however, labour defected from the alliance in Poland, whereas the alliance was sustained in Argentina despite the enormous costs to workers. Levitsky and Way (1998) then posit a number of material and institutional factors that explain both the initial convergence and the later divergence between the two test cases. The factors that are included in this framework are social linkages, party strength, leadership overlap, union competition and the degree of autonomy from either party leadership or the rank-and-file. These factors are hypothesised to explain the policy positions and behaviour of the trade union federation. It is this theoretical framework, which will be tested to establish if the framework permits enough conceptual leverage to explain the past and present policy positions of COSATU on privatisation. These factors have been given prominence because of its actual bearing on the status of the alliance relationship. The present study will therefore be using these factors of the framework, and barring one exception, it will be conceptualised in the same way. The second component of the study is to use the South African National Opinion Leader Survey of 1997/98 to study the actual attitudes and opinions of COSATU leaders on a range of privatisation issues. The survey is going to be used to determine if there is any degree of continuity between formal congress resolutions and the attitudes of COSATU leaders in the survey. This is also an indirect way of verifying the ideological loyalty of leaders to the official positions of the trade union federation. The second question returns to the alliance relationship by examining differences, if any between COSATU and ANC leaders on privatisation related issues. Factor analysis is used to build two indexes, namely a "privatisation index" and a "gear index." An interesting finding from the data is the relatively greater policy cohesion amongst COSATU leaders. These results permit speculations that do not necessarily indicate an imminent breaking up of the alliance, but rather continued discussions with possibly various policy compromises by COSATU and the ANC.
AFRIKAANSE OPSOMMING: Die werkstuk ondersoek die beleidsposisie van die Congress of South African Trade Unions (COSATU) oor herstrukturering en privatisering in Suid Afrika. Die werkstuk se teoretiese uitgangspunt word in die werk van Levitsky en Way gevind (1998). Hierdie skrywers ondersoek die alliansie tussen 'n politieke party en sy arbeidsvennoot in die konteks van neo-liberale ekonomiese hervorming. Die konteks is 'n politieke party wat aan bewind gekom het met die steun van 'n kragtige vakbondfederasie. Die skrywers wil vas stel of die party-vakbond-alliansie sal voortgaan wanneer die politieke party drastiese ekonomiese hervorming aanpak wat die potensiaal het om vakbond federasies te ondermyn. Twee gevalle, naamlik Pole en Argentinië word ondersoek. In albei gevalle het die regerende politieke party aan bewind gekom met die hulp van die vakbond federasie. Teen hierdie agtergrond van neo-liberale hervorming het albei vakbond federasies in Pole en Argentinië aanvanklik die proses gesteun. The aim of this thesis is to explore the ways in which class aspects of trade unions are formed in relation to their organisational properties. To achieve this aim, various assertions on the fundamental role of trade unions are first discussed, and criticised for treating trade unions as organisations that typically react to external stimuli and not as organisations that also generate goals and strategies on their own initiative. Then the focus moves to class consciousness as an effective measure of class capacity of both trade unions and their members, and in doing so, the concept of class consciousness is reformulated to embrace collective and action-oriented aspects of it. Having tested this reformulated concept initially by analysing the comparative characters and capacities of three national unions at different points in time in Korea, a class consciousness scale is developed to measure not only diverse aspects of class consciousness but also qualitatively different levels of it, and such research methods as text analysis and interviews are also employed for the main empirical survey of this thesis. The chief findings include the uneven development of class consciousness within as well as between the individuals, and the conspicuousness of the leadership effect/alliance factor, the less-then impressive effects of gender, size, union age, strike experience, and nationality of ownership on the overall level of class consciousness. Simultaneously, the potentially intriguing implications of the specific influences of those factors on certain aspects of class consciousness are discussed. The thesis is concluded with a recapitulation of the significance of the organisational factors investigated, suggestions on possible directions for further studies, and an urge to study trade unions as class organisations, with the emphasis on both words.

South African trade unions affiliated to Congress of South African Trade Unions (COSATU) have taken advantage of the arrival of democracy and newly found opportunities available through Black Economic Empowerment to venture into the world of business by setting up their own investment companies. The declared desire behind these ventures was to break the stranglehold of white capital on the economy and to extend participation in the economic activities of the country to previously disadvantaged communities. Using the National Union of Mineworkers and the Mineworkers’ Investment Company as case studies, this dissertation seeks to determine whether unions affiliated to the Congress of South African Trade Unions (COSATU) are advancing the struggle for socialism through their investment schemes. Secondly, the dissertation determines whether, in the activities of the schemes, internal democracy is preserved and strengthened. The theoretical framework of this dissertation emerges from arguments advanced by Lenin and Gramsci on the limitations of trade unions in terms of their role in the struggle against capitalism. In addition, the argument draws on the assertions by Michels regarding the proneness of trade union leadership to adopt oligarchic tendencies in their approach to leadership. Of interest is how, according to Gramsci, trade unions are prone to accepting concessions from the capitalist system that renders them ameliorative rather than transformative. Drawing from Michels’ ‘iron law of oligarchy’, the thesis examines whether there is space for ordinary members of the unions to express views on the working of the union investment companies. By looking at the extent to which the investment initiatives of the companies mirror the preferences of the ordinary members of the unions, one can determine the level of disjuncture between the two. The study relies on data collected through interviews and documentary material. Interviews provide first-hand knowledge of how respondents experience the impact of the investment schemes. This provides a balanced analysis given that documents reflect policy stances whereas interviews provide data on whether these have the stated impact. What the study shows is a clear absence of space for ordinary members to directly influence the workings of union investment companies. It is also established that, in their current form, the schemes operate more as a perpetuation of the capitalist logic than offering an alternative system.

This thesis focuses on the collective responses of union members and unions to redundancy. It adopts a theory of trade union action based on the idea that workers react to violations of what they perceive to be "rights" in the employment context. "Rights" are to a degree inculcated into the minds of workers by "union cultures", which condition moral and ethical judgements of behaviour. Connections are drawn between "cultures", "ideologies" and "world views". Workers' responses to redundancy it is suggested should show evidence of the influence of union cultures in a sequence of events over long periods of time. This is borne out in the empirical chapters; Chapter 4 (which describes the historical background to the 1965 Redundancy Payments Act) quotes developments in union responses to redundancy since the 1930s. In a further section, Chapter 5, a case study of a series of redundancy events in the computer company, ICL, is provided, covering union responses to redundancy in the period 1969 to 1979. The evidence also calls into question the view expressed in some academic and policy work on redundancy, that the 1965 Redundancy Payments Act has defused union opposition to redundancy. The period before 1965, the evidence suggests, could not be characterised as a period of strong union opposition, and the years since the passing of the Act have not seen a predominance of union acquiescence. On this basis, too, Hardy's argument that managements have managed redundancy and closure by a process of legitimisation, is called in to question. Also, the work of neo-classical labour economists, who see workers and union attitudes towards redundancy in terms of the decisions of "economic man", is refuted by the evidence and the argument in the thesis, which emphasises the moral influence of unions and the practice of unionism.

The theme of leadership, as much as it has been studied, remains so inexhaustible, the general need to identify those people and styles that lead to good results and that ensure a pleasant working climate. In this context, we considered useful an approach to authentic leadership but applied to trade unions. It may seem like a paradox at first glance, and maybe, for this reason, the topic of union leadership has not been explored much. In the present study, we want to highlight, in general, the perception of teachers about the need for authentic leadership in trade unions in pre-university education in Romania. The need for knowledge of leadership styles, values on which each of them is based, and dangers and the possibility of the emergence of flawed forms, determined this first exploration. The conclusions show that union members appreciate the need for authentic leadership in trade unions in the education system, which can have a positive influence on the educational process.

Uncompetitive remuneration for teachers has been a problem for many decades in Latvia. Government together with social partners –education trade unions, have tried to solve this problem by asking to allocate additional financial resources to public education budget, by developing teacher salary raise schedules and various educational reforms in all three Baltic countries. The aim of the study is to research general principles of teachers’ remuneration and workload in Latvia, Lithuania and Estonia, for comparison and social dialogue argumentation on the part of education trade unions. Research approach is analysis of information on teachers’ salary calculation and workload presented by education trade unions as semi-structured interviews. Reflection on the topic in relation to theoretical sources, including international organizations representing education and social dialogue issues, is enclosed. The results of the research show that there are differences in all three countries regarding general education teachers’ remuneration. The main challenge is the implementation of effective and decision –making oriented social dialogue between trade unions and education policy makers regarding teachers’ weekly contact hours and paid additional hours per full workload, minimal and average monthly salary rate for teachers. The conclusion of the paper indicates that, based on Lithuania and Estonia experience, immediate reforms in Latvia are necessary to increase public funding for education, to increase teachers’ remuneration, harmonize and balance workload and ensure that teachers are paid for all duties performed.

Additional to the three main trends influencing social dialogue at the organizational level - de-centralization, up-scaling, de-institutionalization and representation – the COVID-19 pandemic rules brought a new influence that impacts the Unions, forcing it to adapt its internal communication. This paper is centred upon the way the Unions members in Romania get access to information in the new labour landscape, characterized by the work from home and physical distancing. The research focuses on a collective case-study of three strong Union Federations that developed internal communication with unions’ members that fits the pandemic context. The research focuses on the internal communication repertoire elements used by the Unions. The research method assesses the qualitative information gathered by interviewing key Unions representatives. The main areas of interest are the key topics addressed in the communication with the members, the tools and media mix used, the frequency of the formal communication with the trade unions members, the accountable and the responsible persons with the internal communication, and the management of the feedback from the members, all in the context of what is different vs. 2019. The conclusions are enriched with some recommendations for future development of communication with union members, supporting the social dialog.

This paper considers the effects of trade unions on the education sector in Argentina and the channels of union influence on the performance of this crucial sector. The authors find that those provinces where teacher unionism is fragmented, where union density is higher and where political relations with the governor are more conflictual, have more strikes (fewer class days). Based on estimates of education production functions both in this paper and elsewhere, we expect this to translate into lower student performance. The authors then find a number of weak conclusions related to the impact that unions have on several variables that affect students' performance (i.e., teachers' tenure, job satisfaction, class size, education budget and teachers' salaries). Reviewing these results, we conclude that the impact of unions on students' performance depends on the channel and kind of political market where unions operate, but not on the existence of unions per se.

This paper examines the implications of a North-South trade accord where investments in the Southern partner nation exhibit country risk. Our analysis demonstrates that North-South trade accords can serve as credibility-enhancing mechanisms that induce additional foreign capital inflows into Southern partner nations. The presence of sovereign risk changes the tradeoffs between trade creation and diversion, enhancing the potential for regional trade accords to increase the welfare of accord members.

This paper studies the impact of trade liberalization on labor and capital gross flows and productivity in the Uruguayan manufacturing sector. Uruguay opened its economy in the presence of -at least initially- strong unions and structurally different industry concentration levels. Higher international exposure implied slightly higher job creation and an important increase in job and capital destruction. Unions were able to dampen this effect. Although not associated with higher creation rates, unions were effective in reducing job and capital destruction. Industry concentration also was found to mitigate the destruction of jobs but had no effect on job creation or capital dynamics. The changes in the use of labor and capital were accompanied by an increase in total factor productivity, especially in sectors where tariff reductions were larger and unions were not present. The authors found no evidence of varying productivity dynamics across different industry concentration levels.

The EU has indicated that after 2008 its trade relationships with developing countries will be dominated by the development of preferential trade agreements. Although not a consequence of the Cotonou Agreement, the free trade agreement between the EU and the Republic of South Africa (EU RSA FTA) is clearly one of the first fruits of this approach to trade relationships. However, there is no evidence that the design of the EU RSA FTA incorporated a comprehensive general equilibrium evaluation of the agreement for either the signatories or the other southern African nations. The analyses reported here indicate that while the EU RSA FTA may substantially benefit the signatories, there are appreciable negative impacts for other states, especially the RSA’s immediate neighbours. Moreover, the reluctance of the EU to fully liberalise trade in food and agriculture commodities results in a major reduction in the benefits for the RSA without ameliorating substantively the adverse implications for other nations.
