Objective - This paper examines Dusun Tindal's instrumental music practice within the context of modernity of the society in Tenghilan, a town that is located on northwest Sabah. The study looks into the driving modish musical styles and forms in the root of the ancient traditions especially in the aspects of musical natures, music compositions, musical functions, and philosophies. Methodology/Technique - The contemporary musical ensemble is a newly developed tradition combining a mixture of traditional and western musical instruments and styles. Due to the new mindsets and tastes of their young people, as well as to open up opportunities to venture into the exotic blooms of globalized musical festivals and tourism, their music is manifold and endeavoring in captive of the hearts of the global audience. Findings - The contemporary musical ensemble is a newly developed tradition combining a mixture of traditional and western musical instruments and styles. The majority of Dusun Tindal tribe learners in Sabah failed to achieve competency as native Malay speakers due to the fossilization mechanism which is performance-related. Hence, this research aims to examine the fossilization mechanism in the interlanguage of the young generation from the Dusun Tindal tribe. The case study was conducted at Tenghilan Secondary School, Tuaran, Sabah which involved 69 students. Besides the students, 12 language teachers were interviewed to get detailed information on target language learning strategies that allowed students to cross the interlanguage. Two informants from the Dusun Tindal community have provided a missing link to the Dusun Tindal tribe in Sabah. The first important finding involved trends in existing native language domains within Dusun Tindal communities that show multilingual equivalence. Secondly, most essay writing scores in the Malay language itself was still having interlanguage. Thirdly, the highest factor of fossilization causation was cognitive. The mapping of lexical and syntax elements into the target language domain was affecting students' thoughts. It was obvious sentences accommodate the overgeneralization form in the student interlanguage depicts a temporary plateau and they most often use message omission strategy. Fifthly, the continuum of interlanguage was based on the knowledge of native and the Malay language of the students most at acrolect level, namely one level lower than the native speaker competency. Language teachers suggested a number of strategies to dissolve the fossilization in interlanguage, specifically taking the right attitude towards student language errors.

Dusun Tindal tergolong dalam kumpulan etnikterbesar di Sabah iaitu Kadazandusun. Sejak 1990-an, Dusun Tindal di Tenghilan telah mula kehilangansebahagian besar daripada budaya tradisional muzik mereka. Walau bagaimanapun, kumpulan etnikini masih terus memegang beberapa tradisi kuno mereka, sungguhpun kini terdapat perkembanganmuzik baru yang bertujuan untuk meneroka ke dalam industri muzik tempatan dan demi mengekalkankepentingan anak-anak mereka dalam mempelajari alat muzik tradisional. In his Christianity as Old as the Creation Matthew Tindal has reduced Christian religion to the natural religion. His reduction was the last stage of purification of Protestant religion from its supernatural elements. This whole process was taking place in England between 1534 and 1730. The main conclusion of this English deist sounded: the revealed religion was the only repetition of the eternal natural religion, based on the law of nature and human reason. Simultaneously he claimed that any Christian proprium (specific Christian content) did not exist in relation to any other non Christian religion. In this article I put this problem through critical assesment, making analysis of Tindal’s argumentation and confronting it with (to some degree) Thomas Becconsall views, expressed in his The Grounds and Foundation of Natural Religion. In contrast to Becconsall Tindal understands the nature of man in another way. This latter rejects the opinion that human nature was burdened with certain moral ineffectuality. According to it human being is more prone to misdeeds than to good deeds. In Christian religion it was possible to explain by the original sin and its hereditary effects in the history of mankind. Matthew Tindal rejects this Christian dogma. In reality he understands man’s existence in the state of pure nature and with reason acting without limitations. It corresponds to the situation of man before the Fall into the original sin. But Tindal is not any atheist. He is convinced of God’s existence as the Creator of the world and people. The reason of human beings participates in the light of Divine Wisdom. Thus cognition of God and human moral duties are possible (in practice) by intellectual effort directed to the sensible creatures only. This kind of rational investigation is characteristic for methaphysical cognition. In fact, there is small step from deism to atheism. English Enlightenment, based on the enlightened reason, was initially deistic character, afterwards on the Continent (especially in France) it quickly assumed atheistic form. In considerable degree it was possible owing to English deists like Matthew Tindal. They draw the ultimate conclusion from the plurality of Protestant denominations.

Etnik Dusun Tindal menghasilkan tembikar kuron melalui kearifan tradisi yang dimanipulasikan untuk mencipta barang keperluan harian daripada medium tanah liat. Kearifan tradisi ini telah diwarisi diwarisi sejak turun-temurun secara tradisi lisan dari segi proses penghasilan, teknik, motif, bahan dan teknik pembakaran kuron. Tembikar kuron yang dihasilkan mempunyai fungsi yang sinonim dengan aktiviti harian etnik Dusun Tindal, sebagai alat memasak, peralatan mengangkut dan menyimpan barangan harian. Oleh itu, penghasilan tembikar kuron dipercayai kerana tuntutan keperluan hidup dan kearifan mereka sejak turun-temurun. Kajian ini akan memfokuskan kearifan tradisi penghasilan tembikar kuron oleh adiguru Puan Kantiam binti Setan yang merupakan anak kepada mendiang Adiguru Somotoi binti Lugu, iaitu seorang tokoh kraf etnik tembikar tradisional kuron. Kuron pottery is made by the Kadazandusun people in Sabah, however it is currently only actively made by the Dusun Tindal ethnic group, who dwell in Kampung Malangkap Kapa, Kota Belud. The Dusun Tindal ethnic group crafts kuron pottery using traditional knowledge that is utilised to manufacture daily necessities out of clay. The wisdom of this heritage has been passed down orally from generation to generation in terms of manufacturing procedures, techniques, motives, materials, and kuron burning techniques. Kuron pottery is connected with the Dusun Tindal ethnic group’s daily activities, serving as cooking tools, equipment for transporting and storing daily things. As a result, the manufacture of kuron pottery is thought to be a result of the demands of their living necessities and wisdom passed down from generation to generation. The knowledge of the heritage of manufacturing kuron pottery by adiguru Puan Kantiam binti Setan, the daughter of the late Adiguru Somotoi binti Lugu, a traditional kuron ceramic ethnic craft figure, will be the emphasis of this study.

The sinipak traditional costumery is a centuriesold heritage inherited by the Dusun Tindal ethnic community located mainly in the flatlands of Kampung Bangkahak, Kampung Tempasuk and Kampung Piasau in the Kota Belud district of Sabah, Malaysia. The designs and accessories exhibited in the sinipak costume of the Dusun Tindal womenfolk are representative of natural materials and elements integrated with human creativity, and are traditionally perceived as symbols of wealth and social status within the community. Findings of this study were derived from fieldwork data and analysis of the design concepts of the sinipak female costumery.

Arts and cultural heritage is a potent reflection of the identity of a community. The art of traditional handicraft weaving in any society is dependent on the resources available in his environment and the needs of the particular community. The Dusun Tindal of Kota Belud is rich in weaving craft traditions with kinulung as one of its distinctive products. Kinulung is unique with its own specific purpose and simple design, and has been able to withstand modernisation and change. However the factors of adaptation, environmental change, and modern technological transformation could pose as threats to the traditional and heritage elements in the production of the kinulung. This study is important as a platform for the promotion of continuity and resilience of the Dusun Tindal heritage. Kinulung documentaton will clarify various aspects of the design and purpose elements of this traditional craft. The study focuses on the design and meaning presented in the kinulung weaving tradition as an object of culture in the community. Material for this study was derived from field work through observations, interviews and notations. The findings of the study indicate that the design and motif of the kinulung reflect the cultural values and local knowledge of the Dusun Tindal.

ABSTRACTMatthew Tindal's Rights of the Christian church (1706), which elicited more than thirty contemporary replies, was a major interjection in the ongoing debates about the relationship between church and state in late seventeenth- and early eighteenth-century England. Historians have usually seen Tindal's work as an exemplar of the ‘republican civil religion’ that had its roots in Hobbes and Harrington, and putatively formed the essence of radical whig thought in the wake of the Glorious Revolution. But this is to misunderstand theRights. To comprehend what Tindal perceived himself as doing we need to move away from the history of putatively ‘political’ issues to the histories of ecclesiastical jurisprudence, patristic scholarship, and biblical exegesis. The contemporary significance of Tindal's work was twofold: methodologically, it challenged Anglican patristic scholarship as a means of reaching consensus on modern ecclesiological issues; positively, it offered a powerful argument for ecclesiastical supremacy lying in crown-in-parliament, drawing on a legal tradition stretching back to Christopher St Germain (1460–1540) and on Tindal's own legal background. Tindal's text provides a case study for the tentative proposition that ‘republicanism’, whether as a programme or a ‘language’, had far less impact on English anticlericalism and contemporary debates over the church–state relationship than the current historiography suggests.

This research looked into the use of artefact tajau as one of the Dusun Tindal counting traditions. In addition, this report will clarify how this native used the term tajau a century ago. This research also employs a qualitative approach fieldwork method with sources being interviewed to gather evidence. The researcherwas taken to the study site by an informant who is an expert and a traditional chief in the village. This approach is employed so that the researcher can analyze and comprehend the study’s use of the tajau in greater detail. Futhermore, this research demonstrates that tajau has been used since the first war until thepresent century.

Tulisan ini membahas tiga hal penting terkait dengan deisme, terutama deisme yang berkembang di Inggris. Pertama, munculnya deisme yang dimulai dengan gagasan Edward Herbert di tahun 1624, sebagai konsekuensi dan pengaruh situasi dan kondisi saat itu. Kedua, tumbuh suburnya deisme setelah pergantian abad ke-17, terutama karena pengaruh filsafat yang dikembangkan John Locke. Ketiga, merosotnya deisme dengan cepat pada pertengahan tahun 1700-an yang disebabkan oleh pemikiran skeptisisme David Humes. Eighteenth-century whig historians of the Union (1707) reacted to Lockhart’s tory-jacobite Memoirs in different ways. While John Oldmixon (1672-1742) incorporated passages from them into his account of the Union for the sake of confuting them, Abel Boyer (1667-1729) and Nicholas Tindal (1687-1774) endorsed them to a large degree, borrowing from them extensively. Then, several historians writing in the mid- to late eighteenth century such as Thomas Somerville (1740-1830) or Malcolm Laing (1762-1818) approached them with an open mind, but also some critical distance, revealing an evolution in British historiography towards a more scholarly approach to historical sources. Except for Oldmixon’s accounts, all those historians’s expositions of the Union were to some extent impacted by Lockhart’s Memoirs. Far from using the latter only as a storehouse of information on the Union, they were all in some mesure influenced by Lockhart’s vision of that event and, as a result, ideologically hybrid.

The paper presents a brief overview of the thin-layer thermal insulation paints used now and their characteristics. A new composition of thin-layer heat-insulation coating is proposed. The introduction of solid phases of non-autoclaved foam concrete with the average density D150 with high values of the standard entropy of formation in it is scientifically substantiated from the point of view of increasing the thermal protection properties. It is shown that such phases have an advantage in comparison with the solid phases of the glass and ceramic microspheres used now. It is also proved that the presence of thin-layer thermal insulation coating of nanoscale particles in the form of silica in the composition favours the reflection of the incident heat flux due to the Tindal effect and provides an increase in the polydispersity of the composition. The calculation of the resulting composition by the Van Vleсk formula used in the classical science is given.

<p class="abstrak">This article aimed to describe Said Agil Siradj's (SAS’s) communication strategy at the anniversary of Fatayat NU in 2019. Radicalism and terrorism have become a real threat to world peace and human values. In Indonesia, it has been categorised as an extraordinary crime, particularly since the Bali bombings in 2002. The act of anticipation has been issued by forming anti-terrorism regulation to prevent and crackdown of its action. Nevertheless, this effort is not sufficient to eradicate terrorism action. Collaboration with religious institutions is needed to deal with the questions of the religious doctrines. Therefore, the participation of religious leaders from the Islamic organisations such as Nahdlatul Ulama (NU) is essential.. The study employs a descriptive qualitative approach of critical discourse analysis, focusing on the illocutionary acts of speech acts theory. The data of the research was transcribed from the video of SAS’s speech on YouTube channel. The result shows that the speaker used types of illocutionary acts; representatives, directives, commisives, expressives, and declarations. These expressions are used to command, persuade, and warn the listeners. <p class="abstrak">This article aimed to describe Said Agil Siradj's (SAS’s) communication strategy at the anniversary of Fatayat NU in 2019. Radicalism and terrorism have become a real threat to world peace and human values. In Indonesia, it has been categorised as an extraordinary crime, particularly since the Bali bombings in 2002. The act of anticipation has been issued by forming anti-terrorism regulation to prevent and crackdown of its action. Nevertheless, this effort is not sufficient to eradicate terrorism action. Collaboration with religious institutions is needed to deal with the questions of the religious doctrines. Therefore, the participation of religious leaders from the Islamic organisations such as Nahdlatul Ulama (NU) is essential.. The study employs a descriptive qualitative approach of critical discourse analysis, focusing on the illocutionary acts of speech acts theory. The data of the research was transcribed from the video of SAS’s speech on YouTube channel. The result shows that the speaker used types of illocutionary acts; representatives, directives, commisives, expressives, and declarations. These expressions are used to command, persuade, and warn the listeners. The controversies in the title of this paper are related to an attempt of answering the following questions: who was a deist and what does deism express, as well how is it related to atheism, agnosticism, pantheism and theism? The article by professor Antoni Szwed included in this very volume of “Humaniora” makes a voice in the debate on the issue of deism of Matthew Tindal and several other contemporary deists. I do not intend to argue with the views of that author. It is however necessary to say clearly that in the issue of those deists, as well many others opinions and views may vary in often even radically different. It is to be stressed out that the author of this article had presented his opinion on the issue in the title, but also that he presented in it only a fraction of this very comples problem which was and still is deism. For a better understanding of this problem we may recall several other deists and present the controversies surrounding them.

This article provides a brief history of publications of the treatise of Herbert of Cherbury (1583-1648) &ldquo;On Truth&rdquo; (written in 1624); critical response of his contemporaries; as well as comparative analysis of the &ldquo;symbols of faith&rdquo; of the English thinker, his contemporary Hugo Grotius (1583-1645), Henry Bolingbroke (1678-1751), Thomas Chubb (1679-1747), and the author of the &ldquo;Bible of Deism&rdquo; &ndash; &ldquo;Christianity as Old as the Creation&rdquo; Matthew Tindal (1657-1733). One may often come across a well-established in the research opinion about the role of Herbert as the &ldquo;father of Deism&rdquo;. However, in recent years, this topic remains undisclosed, bringing obscurity whether Herbert of Cherbury should be considered the founder of deistic philosophy. The article also conducts detailed analysis of the criticism of the religious philosophy of deism of the English thinker, and reveals which elements of this doctrine caused a controversial response among his contemporaries. The goal of this work lies in highlighting the most substantial part of the heritage of Herbert of Cherbury, which was subsequently reflected in the religious philosophy of the adherents of deism. The article is of particularly relevance for the Russian audience, as this topic was not sufficiently covered in the Russian language.

The aim of the study is to develop theoretical and practical recommendations for improving the management of rural areas based on the logistics concept. The article uses interdisciplinary and economic- statistical types of analysis, applied private methods of economic research. In the work, the rural area is considered as a logistics system with the main subsystems: natural resource environment; population; economy and institutional environment. Attention is focused on the balanced development of all subsystems of the rural territory as a guarantee of its sustainable development. The article analyzes the historical experience of managing one of the ethnic groups of Mountainous Dagestan – the Tindal free Society in the 18th and 19th centuries, which is relevant today in the conditions of a systemic crisis of the rural community caused by market transformations. As the analysis shows, the rural community has developed systematically precisely due to the use in practice of essentially logistical principles of managing all flow processes. The rural population rationally used natural resources, the forms of management corresponded to the level of development of productive forces, institutional norms regulated the functioning of the entire community. Sustainable development of rural areas in the future is possible only on the basis of a logistics concept – a systematic approach to managing all the flow processes of the territorial system of rural entities.

Узагальнити відомості про особливості рослин гуара й маш, їхні генетичні ресурси, що зберігаються у світових колекціях, господарську цінність продукції і про перспективи вирощування цих нетрадиційних для України культур у південних регіонах. Матеріали та методика досліджень. Матеріалами досліджень слугували наукові праці з питань особливостей росту і розвитку, вирощування, поточних та перспективних ресурсних можливостей селекції гуара й маша в Україні та світі. Методи: кількісне та якісне порівняння, абстрактнологічний, аналітичний. Результати. У 2020–2021 рр. в Інституті зрошуваного землеробства НААН вивчались зразки колекції нової нішевої культури – гуар, надісланої з Національного центру генетичних ресурсів рослин України. Унаслідок дослідження впродовж двох років тривалості періоду вегетації отриманих зразків встановлено, що найкоротшим, 124,5–125,0 діб, характеризувались IU074659 Maharandi, IU074660 Sheetal, IU074657 Ankur. Не дозріли всі сформовані на рослині боби у зразків IU07466 Haldi bhati з тривалістю періоду вегетації 133 доби та у IU074658 Pusa Naubahar, 129,5 діб, проте вони сформували максимальну врожайність. Найбільше насінини на рослині нараховувалось у IU074661 Haldi bhati – 329 штук та у IU07465 Pusa Naubahar – 262,5 штук. Ці ж зразки сформували найкращу врожайність: IU07465 Pusa Naubahar, 315 г/м2 та IU074661 Haldi bhati, 334 г/м2. Висота рослин у досліджуваних зразків знаходилась у межах 43,2 – 69,5 см (IU074661 Haldi bhati, IU074663 Tindal – IU074659 Maharandi, відповідно), а висота прикріплення бобу коливалась від 3,0 до 4,2 см (IU074657 Ankur – IU074658 Pusa Naubahar, відповідно), що відповідає градації «дуже мала». Висновки. Селекційна робота, створення та вирощування вітчизняних сортів гуару та машу є необхідною для Україні для використання цих культури в харчовій, косметичній, нафтовидобувній промисловості, що дозволить зменшити імпорт та заощадити значні валютні ресурси.

It was not very glorious at first, at least to many English people of the late seventeenth century. With a king of undoubted legitimacy squeezed out and a new, albeit related monarch installed and recognized by Parliament, the transaction shook government, nation and church alike. It left Jacobite and non-juring splinters all round. The Revolution, happening in fulfillment of ideals of exclusionist Whigs, did not entirely satisfy those partisans, who soon learned that they could not control their masterful king, William III. As for the Tories, their consciences ached due to their resistance to a divinely-appointed sovereign. Few highly-placed Englishmen were comfortable with their need to call in a foreigner to help them solve their domestic squabbles. Indeed, one writer, reflecting on the letter inviting the Prince of Orange to invade England, thought it would have been “more glorious … to assist our undoubted Soveraign [sic], then to suffer him to be dethroned, solely because he is a Roman Catholic.”Twentieth-century historians called the Revolution other names than “glorious.” It has been dubbed a “sensible,” a “model,” a “moral,” a “respectable,” a “palace,” and simply the English Revolution. All agreed that it was indeed a Revolution, and they themselves were in agreement with some early writers who were contemporary with the event. The Orange Gazette, at the very end of the year 1688, reported on “the Revolutions that had occurred.” The historian Nicholas Tindal wrote that William of Orange himself, in a speech before the House of Lords, spoke of “this late Revolution.” Considerable discussion ensued in Parliament and in pamphlets as to whether William conquered James, or whether the king had abdicated, or had deserted his kingdom. But little question with contemporaries: there was a Revolution.

Penelitian ini menggunakan penelitian yuridis normatif. Dualisme terjadi dikarenakan Qanun Jinayat dan Undang-undang Perlindungan Anak (UUPA) mengatur pencabulan terhadap anak. The article presents a brief biography of the little-studied British deist Thomas Chubb (1679-1747) and a reconstruction of his ideas about capabilities of human mind. The goal of this article is to study the religious philosophy of T. Chubb that Russian studies does not distinguish from ideas of other deists. That is why the idea of the phenomenon of deism is still less clear in relation to foreign studies. The article analyzes and presents Chubbs concepts about the independence of religious truths from human perception, that are presented in «Discourse concerning Reason, with Regard to Religion and Divine Revelation» (1733) and «An Enquiry into the Ground and Foundation of Religion». The article documents that the English philosopher formulated three "author's" truths of natural religion: there is an initial difference between objects, independent of human perception; this distinction is the basis for human behavior; God made these foundations a moral rule for all people and for himself. The work identifies and analyzes the definition of the phenomenon of "deism" in Chubb's treatises, as well as an assessment of his philosophy in the context of this definition – the natural religion of reason or belief and just and sense of a Deity impressed upon the mind, and is the governing principle of a man’s-affections and actions. The correlation of the ideas of Thomas Chubb and Matthew Tindal is analyzed. At the end of the article, a brief conclusion is made about the place of T. Chubbs philosophy to deism in general. The author of this work believes that despite the absence of references to other deists by the English philosopher, the ideas of this thinker fit into their religious and philosophical system, specifically about the issue of understanding natural religion. The sources of this article are treaties «The Sufficiency of Reason in Matters of Religion, Farther Considered» (1732), «Discourse concerning Reason, with Regard to Religion and Divine Revelation» (1733), «Some reflections upon the comparative excellency and usefulness of moral and positive duties» (1733), «The true Gospel of Jesus Christ Asserted»(1741) and several other treatises.

The act of corruption is a violation of every person’s life as stipulated in Article 28A of the 1945 Constitution. As a result of corruption that has been detrimental to the country’s finance or the country’s economy, it also impedes the growth and sustainability of demanding national development high efficiency. For this corruption case, a court for corruption case has been established. Meanwhile, Money Laundering as stipulated in Law No. 8 of 2010 concerning Prevention and Eradication of Money Laundering Crimes, does not have a special court but is often put together with a court of corruption. A court of corruption is the only court that has the authority to examine, hear, and decide the cases of corruption and money laundering crimes whose original crime is a criminal act of corruption; and/or criminal acts which are explicitly stated in other laws as criminal acts of corruption. The problem is how the litigation of corruption and criminal acts of money laundering are incorporated in an indictment of corruption and money laundering. This study used the descriptive method with a normative juridical approach. Data collection was carried out through library studies by collecting data in the form of legal materials; primary, secondary and tertiary legal materials. The analysis technique of this study was descriptive analysis that analyze the process and institutions based on legislation. The results of this study showed that the Corruption Eradication Act regulates materially and formally, so there are exceptions to the principles that are generally regulated in the Criminal Code (KUHP), Criminal Procedure Code (KUHAP) (Lex Specialist Derogate lex Generalis). The modes of money laundering are carried out in various ways. Judging from TPPU modes, it seemed true that TPPU is a stand-alone crime when using cumulative charges is more appropriate. The legal policy of the Corruption Crime Act and Money Laundering Lay (TPPU) related to the rule of law which is the basis of legality for Beneficial Ownership Criminal Liability (BO) as well as its position in Deelneming theory is a topic that must be formulated n the Action Bill Criminal Crime and Money Laundering Crime Bill (TPPU), whether effective evidence for Beneficial Owners (BO), doctrinal or the teaching snares. In the future politics of law enforcement in eradicating corruption and TPPU leads to Beneficial Ownerds (BO) is not enough as long as only the physical actors or stop at the actors revealed in the investigation. Besides the beneficial owner, it is also necessary to regulate criminal liability for legal entities that are used to save the proceeds of money laundering

Nowadays, in Indonesia, there are so many laws appear after KUHP which regulate about criminal laws, beside providing the rules of material criminal law againts to KUHP, also providing the formal rules which againts to KUHAP (formal criminal laws). In criminal laws that related to financial government, has common law which is regulated by laws itself. And corruption criminal laws which has the regime of law itself, but it is still unclear where could be qualificated as crimnal laws in financial government and which could be qualificated as corruption criminal laws. It is still in the “grey area”

The narcotics crime is one of the extraordinary crimes so that it is specifically regulated in act of Law Number 35 Year 2009 concerning Narcotics. The perpetrators and other parties involved in narcotics crime certainly understand the severe consequences of what they do. In connection with the above problem, there is one interesting decision to be reviewed and analyzed, which has been decided by the panel of judges is the decision number: 124 / Pid.Sus / 2016 / PN.TJK in which the perpetrator commits two offenses at once so that the sentence could be sentenced whether it has been be fair. This study will focus on legal issues, namely knowing the responsibility of the perpetrators of narcotics and money laundering crimes. analyze the court's decision Number: 124 / Pid.Sus / 2016 / PN.TJK whether it has fulfilled a sense of justice that is beneficial. This study uses a Normative Juridical approach by analyzing a court decision. As for the results of the study found that: According to the analysis of researchers seen from the criminal responsibility has fulfilled the elements of error, the ability to be responsible, evil inner attitude, and there is no reason to forgive. Court Decision Number: 124 / Pid.Sus / 2016 / PN.TJK has fulfilled a useful sense of justice. Based on research shows that the verdict given is considered fair because the defendant's actions have damaged the nation's generation and remembering that the defendant's actions committed two offenses namely violating Article 131 of Law Number 35 Year 2009 concerning Narcotics and Article 5 paragraph (1) letter c of the Act Law Number 8 of 2010 concerning Prevention and Eradication of Money Laundering Crimes. As for the suggestions that can be submitted in this study, it is better for the police in an effort to prevent the circulation of narcotics and money laundering so that they coordinate well with the financial transaction analysis tracking center and also the national land agency so that the assets of drug dealers or traffickers can be properly tracked.

ABSTRAKDalam surat dakwaan Putusan Nomor 57/PID.SUS/2014/PN.SLR, penuntut umum mendakwa dengan pasal tindak pidana pencucian uang tanpa bersamaan dengan pasal tindak pidana asal, sebagaimana diatur secara limitatif dalam Pasal 2 Undang-Undang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang. Hal yang demikian berdampak kepada hakim dalam membuktikan unsur tindak pidana pencucian uang yang diketahui atau patut diduga hasil dari tindak pidana asal. Permasalahan yang menarik untuk dianalisis adalah 1) mengapa penentuan bentuk dakwaan menjadi penting dalam tindak pidana pencucian uang?; dan 2) bagaimanakah hakim membuktikan unsur tindak pidana pencucian uang jika tindak pidana asal tidak didakwakan? Untuk menganalisis permasalahan tersebut digunakanlah metode penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Penentuan bentuk dakwaan dalam tindak pidana pencucian uang menjadi dasar bagi hakim untuk menentukan sistem pembuktian dalam membuktikan unsur. Dengan pembuktian yang tepat hakim dapat membuktikan unsur tindak pidana pencucian uang. Oleh karena itu, penyusunan surat dakwaan yang tepat dalam tindak pidana pencucian uang menjadi hal yang sangat penting.Kata kunci: pencucian uang, dakwaan, pembuktian. ABSTRACTIn the accusation of Court Decision Number 57/PID.SUS/2014/PN.SLR, the prosecutor filed the accusation with the article of money laundering crime without referring to the article on the predicate crime, as regulated in Article 2 of Law on Money Laundering Crime. Such matters affect the judges in proving the elements of money laundering crime known or reasonably suspected to be the result of a predicate crime. Issues of interest to review in the analysis are: 1) why does determining the form of the accusation play important role in the money laundering crime? and 2) how does the judge prove the element of money laundering crime if the predicate crime is not accused? To analyse these problems, the juridical-normative method with legislative and conceptual approaches was used in this analysis. The accusation form determination in money laundering crime becomes the basis for the judge to determine the proof system in proving the element. With the precise proof the judge can prove the element of money laundering crime. It is therefore vey important to precisely write the accusation letter in the money laundering crime. However in proving the money laundering crime the predicate crime should be proved first. Keywords: money laundering, accusation, proof.

Perkembangan ilmu pengetahuan dan teknologi serta arus globalisasi yang sudah tidak terbendung dewasa ini, tidak hanya menimbulkan dampak positif tetapi juga seringkali menimbulkan dampak negatif misalnya dengan adanya “globalisasi kejahatan” dan berkembangnya kualitas (modus operandi) dan kuantitas tindak pidana oleh korporasi. Permasalahan dalam artikel ini adalah bagaimana pertanggungjawaban hukum pidana korporasi dalam upaya penanggulangan tindak pidana korporasi pada saat ini dan bagaimana pertanggungjawaban hukum pidana korporasi dalam upaya penanggulangan tindak pidana korupsi pada masa yang akan datang. Metode penelitian yang digunakan dalam artikel ini adalah yuridis normatif. Hasil penelitian menyimpulkan bahwa dalam kebijakan pertanggungjawaban pidana korporasi dalam upaya penanggulangan tindak pidana korporasi dalam upaya penanggulangan tindak pidana korupsi pada saat ini terdapat beberapa kelemahan mengenai kapan korporasi melakukan tindak pidana korupsi dan masalah sanksi pidana. Penelitian ini bertujuan mengkaji tindak tutur imperatif guru dalam proses belajar mengajar SMA Muhammadiyah Kupang, SMA Negeri 5 Kupang, SMA Kristen Citra Bangsa, SMK Muhammadiyah Kupang, dan SMK Negeri 1 Kupang. Jenis penelitian ini adalah deskriptif kualitatif. Data dalam penelitian ini berupa tuturan yang menunjukkan bentuk dan makna tindak tutur imperatif. Teknik pengumpulan data yang dilakukan melalui teknik simak bebas libat cakap, teknik rekam, dan teknik catat. Hasil penelitian menunjukkan bahwa: ada empat bentuk tindak tutur imperatif guru yaitu (1)Tindak tutur imperatif langsung literal, (2)Tindak tutur imperatif langsung tidak literal, (3)Tindak tutur imperatif tidak langsung literal, (4)Tindak tutur imperatif tidak langsung tidak literal. Sepuluh makna tindak tutur imperatif (1)Tindak tutur yang mengandung makna imperatif perintah, (2)Tindak tutur yang mengandung makna imperatif suruhan, (3)Tindak tutur yang mengandung makna imperatif permintaan. (4)Tindak tutur yang mengandung makna imperatif persilaan, (5)Tindak tutur yang mengandung makna imperatif ajakan, (6)Tindak tutur yang mengandung makna imperatif imbauan, (7)Tindak tutur yang mengandung makna imperatif larangan, (8)Tindak tutur yang mengandung makna imperatif permohonan, (9)Tindak tutur yang mengandung makna imperatif desakan, dan (10)Tindak tutur yang mengandung makna imperatif.
