Despite a large number of studies with Western samples on neutralization among juvenile offenders, similar investigations on this phenomenon in Chinese society are lacking. This paper aims to fill this gap in the literature by constructing a scale to measure the use of neutralization during offenses by Chinese juvenile offenders. A scale consisting of 13 items falling under 3 subscales, with a Cronbach's alpha ranging from .48 to .73 was used in a survey interview of 200 Chinese juveniles (95 boys, 105 girls; M age = 13.6 yr., range = 10–17) who had been arrested by the police for commission of theft. The data highlight the importance of not only developing and validating a measurement of neutralization specific to the offense and the offender, but also discussing individual differences among respondents in terms of their application of neutralization.

Legal protection for children who are faced with the law is one of the important issues that must be considered by all parties to avoid the negative impact felt by children if their rights are violated. The purpose of this study is to analyze the legal protection of children as perpetrators of the crime of theft, and to examine criminal sanctions against children who commit the crime of theft. The method used is normative legal research. This research approach is a conceptual and literature approach, with the primary legal sources coming from legislation and decisions, while the secondary legal sources come from legal journals and law books. Data collection is done by collecting data and summarizing. The results of the study show that legal protection for children as perpetrators of criminal cases is based on Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, which is known as litigation, non-litigation through deversion, children who commit criminal cases are called with children in conflict with the law. Children in conflict with the law are children aged 12 (twelve) years, who are suspected of committing the crime of theft. This study shows that the sanctions are in accordance with the provisions of the juvenile criminal justice system, in which the child is punished for a maximum of seven years in prison or a fine of nine hundred thousand rupiahs

Delinquency problem is the actual problem, in almost all the countries in the world, including Indonesia . Attention to this issue has a lot of thought poured out, either in the form of discussions and seminars which have been held by organizations or government agencies that close relationship with this problem. In a legal perspective, the problem of theft is a criminal act (delict) plaguing the society , in Article 362 Code of Criminal Law of the theft said, " Whoever took the goods wholly or partially belongs to another person , with intent to have unlawful , punishable due to theft, with a maximum imprisonment of 5 ( five ) years or a fine of nine hundred dollars. However, the rules of Article 362 Book of the Law of Criminal Law of the theft and criminal application against minors regulated in Article 26 paragraph (1), 27 and 28, paragraph (1) of Act No. 3 of 1997 on Juvenile Justice , stipulates that the maximum legal threats meted out to convicted child is ½ of the maximum threat of criminal provisions will apply. This study uses a normative approach , in that the data from the literature and from the field as input and information in order to obtain an answer. The results of this research that the detention of offenders under the age of 3 was associated with the Law No. 1997 on the Juvenile Justice conducted an investigation into juvenile delinquents by the investigator children who have an interest, attention, dedication and understanding the problem child. Legal protection of the child as a criminal in the process of investigation has not been in accordance with Law No. 3 of 1997 on Juvenile Justice. Police to interrogate suspected child should distinguish processes and work systems of the investigation and adult actors. Status of child offenders under the custody process by investigators in Bogor City Police Detention by the investigator or prosecutor young child or children with the determination of the judge, in a case and in the manner provided for in the law No.11 of 2012 and the Criminal Procedure Code, determine that the suspect or the accused may be detained. Because there is the term "may" be detained, the detention of children is not always meant to do, so in this case the investigator expected to strongly consider if the detention of children. <p>The purpose of this research is to find out the legal protection of children as perpetrators of the crime of theft through the diversion system in the juvenile criminal justice system. The research method used in this research is normative juridical research derived from the literature and court decisions. The results of the study indicate that legal protection of children as perpetrators of the crime of theft through diversion in the juvenile criminal justice system is the transfer of settlement of children's cases from the criminal justice process to a process outside of a fair criminal justice with an emphasis on restoring back to its original state, and not retaliation. In addition, through diversion, children as perpetrators of the crime of theft are given punishment with an educational aspect in order to provide justice and legal protection to children without ignoring the child's criminal responsibility in a non-formal way. Based on this description, it can be said that diversion is not a peaceful effort between a child who commits a crime of theft and the victim or his family, but a form of punishment for children in conflict with the law.</p><p>Tujuan dari pnelitian ini yaitu untuk mengetahui perlidungan hukum terhadap anak sebagai pelaku tindak pidana pencurian melalui sistem diversi dalam sistem peradilan pidana anak. Metode penelitian yang digunakan dalam penelitian ini yaitu penelitian yuridis normatif yang berasal dari kepustakaan dan putusan pengadilan. Hasil penelitian menunjukkan bahwa perlidungan hukum terhadap anak sebagai pelaku tindak pidana pencurian melalui diversi dalam sistem peradilan pidana anak yaitu pengalihan penyelesaian perkara anak dari proses peradilan pidana ke proses diluar peradilan pidana yang adil dengan penekanan pada pemulihan kembali pada keadaan semula, dan bukan yang bersifat pembalasan. Selain itu melalui diversi, anak sebagai pelaku tindak pidana pencurian diberikan pemidanaan yang beraspek pendidikan guna memberikan keadilan dan perlindungan hukum kepada anak tanpa mengabaikan pertanggung jawaban pidana anak dengan cara nonformal. Berdasarkan uraian tersebut maka dapat dikatakan abahwa diversi bukanlah sebuah upaya damai antara anak yang melakukan tindak pidana pencurian dengan korban atau keluarganya akan tetapi sebuah bentuk pemidanaan terhadap anak yang berkonflik dengan hukum.</p>

Abstract: This study discusses juvenile delinquency studies in Pandeglang district and the role of counselors in resolving the juvenile delinquency phenomenon, the research method used is qualitative data collection techniques of interviews, observation, and documentation studies, researchers act as key instruments, observations carried out for 1 year, interviews were conducted with 3 respondents, and documentation studies were collected from various literature, the findings and discussion of the study illustrated that juvenile delinquency consisted of criminal theft of motorbikes, high speed motorbikes and modified exhausts, and did not care about the environmental conditions of the residence , the conclusion of the study is that the role of the counselor is very important in reducing the level of juvenile delinquency with the counselor's mental and psychological readiness, namely the ability of the counselor to lead, understand multiculturalism, provide reinforcement to students, and train themselves in order to have good personality competencies, the implications of this research are very important for school teachers and the community to measure the level of juvenile delinquency and how to prevent future levels of juvenile delinquency in the future. Abstrak: Penelitian ini membahas tentang studi kenakalan remaja di kabupaten Pandeglang dan peran konselor dalam menyelesaikan fenomena kenakalan remaja tersebut, metode penelitian yang digunakan adalah kualitatif dengan teknik pengumpulan data wawancara, observasi, dan studi dokumentasi, peneliti berperan sebagai instrumen kunci, observasi dilaksanakan selama 1 tahun, wawancara dilakukan bersama 3 orang responden, dan studi dokumentasi dikumpulkan dari berbagai literature, hasil temuan dan pembahasan penelitian menjabarkan bahwa kenakalan remaja terdiri dari tindakan kriminal pencurian sepeda motor, memacu sepeda motor dengan kecepatan tinggi dan knalpot modifikasi, serta tidak peduli terhadap kondisi lingkungan tempat tinggal, kesimpulan penelitian adalah bahwa peran konselor sangat penting dalam mereduksi tingkat kenakalan remaja dengan kesiapan mental dan psikis konselor, yaitu kemampuan konselor dalam memimpin, memahami multikulturalisme, memberikan penguatan kepada siswa, dan melatih diri agar memiliki kompetensi kepribadian yang baik, implikasi penelitian ini sangat penting bagi guru sekolah dan masyarakat untuk mengukur tingkat kenakalan remaja dan bagaimana strategi dalam mencegah tingkat kenakalan remaja di masa mendatang.

The subject matter of the study is the main aspects of the militia activity of Ukraine on combating crime in the mid-1930s. The novelty of the work is that this problem has not been researched in the historical and legal literature yet. The authors of the research have used historical, statistical, formal and logical methods. The facts about different directions of militia activities have been generalized. It has been noted that the criminal situation in Ukraine in the 1930s intensified, which became the consequence of the processes of industrialization, solid collectivization, mass dispossession of the kulaks and the Holodomor. Robberies, thefts, bodily harm and murders were widespread in the Republic. The main damage to the state was caused not by the gangs that carried out robberies and attacks on trains, warehouses and shops, but “offenses at the place of work” – large theft of money and goods carried out by the administration, and petty thefts by ordinary workers. Therefore, the fight against crime remained the most important direction of the activities of law enforcement agencies of Ukraine. The attitude towards juvenile delinquency and methods of combating it changed. Penalty policy has shifted from preventive and educational measures to repressive actions against juvenile offenders, who committed crimes. In order to improve the activities of militia, certain attention was paid to improving the work of investigators and district inspectors, covert intelligence and information work, public involvement into countering crime. As a result, it was possible to achieve a certain reduction in the overall level of crime. However, the number of cases of some types of crime (hooliganism) even increased, and new types of crimes (passport forgery) appeared. There was also a politicization of crime, which was a manifestation of the strengthening of the totalitarian regime in the Republic. The materials of the article can be used for teaching the discipline “History of the State and Law of Ukraine” and the special course “History of Law Enforcement Agencies of Ukraine”.

One of the crimes that has been formulated in the Criminal Code or a crime called "Theft with Aggravation" is regulated in Article 363 paragraph (1) 5th of the Criminal Code in conjunction with Article 25 in conjunction with Article 26 paragraph (1) of Law Number 3 of 1997 concerning Juvenile Justice , Aggravated theft committed by a child is a criminal offense. The specificity of this type of criminal act lies in the perpetrator/subject of the crime, namely children who are classified as minors who still have a long future as the nation's next generation. The aim of the criminal justice process is not punishment, but improving the condition, maintenance and protection of children as well as preventing and overcoming their actions through constructive court action. As related to the case of aggravated theft committed by a minor in case Number: 41/Pid.Sus-Anak/2020/PN.Plg. The method in this research is a normative juridical method or library research, namely research by analyzing applicable legal norms, both in the form of laws and court decisions. Research data was obtained from library materials and legal documentation in the form of primary, secondary and tertiary law. Then the data is collected by investing in statutory regulations, books and literature related to the research material. Finally, the existing data is then analyzed qualitatively, namely carrying out analysis without using numbers or formulas. The results of the research show that firstly, in the process of resolving criminal acts committed by immature children, in the examination process both at the investigation level and in the trial process, the children have been accompanied by community counselors (BISPA), parents, and Advocates/Legal Advisors. Second, the punishment of children who committed the crime of theft with aggravation in Case No. 41/Pid.Sus-Anak/2020/PN. Plg, it is regulated in Article 363 paragraph (1) 4th of the Criminal Code. This is based on legal facts that have been revealed in the trial, both from the testimony of the victim and witnesses as well as from the defendant's confession.

This study attempted to empirically investigate the moral filtering hypothesis as a major role of morality in situational action theory. More specifically, we examined whether people with high morality even in a criminogenic situation do not consider crime as an alternative using a specific hypothetical situation. The current study utilized the data from 「A study of juvenile felony crime」 conducted by the Korean Institute of Criminology(KIC) in 2013. This study estimated logistic regression. The results indicated that people with high morality were less likely to perceive crime as an action alternative in the first place, even in criminogenic settings that cause theft, robbery, and arson. The findings provide support for the moral filtering hypothesis in situational action theory and fill the gap in the existing literature. Lastly, the limitations of the study and suggestions for future research are discussed.

The issue of the responsibility of minors and their criminal sanctions is an interesting topic to discuss, considering that there is a lack of uniformity in both positive law and Islamic criminal law. The mindset of many law enforcement officials is currently centered on the understanding that all criminal cases must still be included in the realm of punishment (directly processed through litigation), even though these cases are crimes with relatively small losses or minor crimes. This is legal in the theory of positivism, provided that the act is clearly accommodated in the law (the principle of legality is met). However, not infrequently this process actually hurts the sense of justice in society. This article is a literature research with a descriptive analysis research method. Furthermore, the existing data is described and analyzed carefully in order to find the right conclusions. The results of this study are based on the positive law of the Child in view of Law no. 3 of 1997 concerning Juvenile Court is a person who has not been able to take responsibility for his actions, whether it is a criminal act or an act prohibited by the regulations in force in society. Children who are underage are considered as people who are unable to know the consequences of their actions because their thinking development has not yet reached the level of adults. So that children who can be punished are children whose age limit has been determined in the law. Meanwhile, according to Islamic law, if the perpetrator of the theft is a child or a madman, he cannot be sentenced to hadd cutting off his hands, based on hadith. Because cutting hands is a form of punishment, while punishment is carried out because of a crime. Meanwhile, the actions of a child who is a madman are not called a crime.

Abstract In the literature on crime, children and young people are far more likely to be viewed as offenders than victims. It is well known that juvenile offenders contribute significantly to the total volume of recorded crime, but only in the 1990s is it being recognized that young people, especially those of school age, figure disproportionately as victims. Children are prey to the whole range of crimes from petty theft to serious assault. Not only are children direct victims of most crimes; they may also be witnesses to crimes committed against their households, parents, or siblings, and have to live with the consequences of such offences. Over a third of the 400,000 households which experience burglary each year include children. Domestic violence and other serious personal assaults, including rape and even homicide, all too often take place in the presence of children or in circumstances of which the children are aware.1 In some cases children may be affected by other crimes which have occurred within their neighbourhood-an extreme example of which was the trauma suffered by many children in the wake of the massacre at Hungerford in 1987.
