This chapter illustrates how the counterstrategies of rope-a-dope and transnational legal process have played out since the start of the Trump Administration. The outside strategy of domestic litigation has been combined with other forms of external and internal pressure from many stakeholders in a wideranging effort to resist President Donald Trump’s draconian immigration policies, particularly the Travel Ban, or Muslim Ban. The chapter also describes the core strategy of internalized bureaucratic resistance to efforts to reimpose torture as an “enhanced interrogation tactic.” This counterstrategy, which gives meaning to the slogan “This is what democracy looks like,” will likely continue whether or not the Trump Administration successfully defends its immigration policies in the courts.

There is constant pressure on governments and policy makers to raise the standard of education, and to develop appropriate curriculum and pedagogies for students. It is no easy task. This book presents eight specific case studies of education reform implementation which capture how the design and implementation choices of policy makers are shaped by national and historical contexts. They offer real examples of the choices and constraints faced by policymakers and practitioners. The cases are a mix of nationally and locally mandated reforms with five examples from nations where the state initiated and guided reforms. The concluding synthesis chapter highlights commonalities and differences across the cases and disparate responses to shared concerns. Providing a breadth of real-world research, it will assist policy makers, practitioners and other stakeholders interested in system change.

Many citizens and decision-makers obtain information about science mainly, or even exclusively, from news and online media. Accordingly, social science has devoted considerable attention to the analysis of science news coverage. A review of this literature reveals a number of ongoing, substantial transformations: In line with the crisis of legacy media, the rise of online communication, and the extension of PR by many societal stakeholders, science communication is changing. Science journalism has come under pressure in publishing houses, and science journalists’ working conditions have worsened. The amount of science news coverage is stagnating, albeit after a rise that lasted several decades, and seems to navigate toward either a more controversial reporting about politicized issues such as gene editing or a less critical “churnalism” that is more strongly influenced by PR efforts than before. The implications of these changes for science communication and societal decisions regarding science communication are considered.

The transition towards a sustainable economy, i.e. towards business models that are able to reconcile the typical objectives of economic and financial management with environmental, social and governance (ESG) aspects and implications, is gaining increasing attention from all the main stakeholders, be they representatives of the political, scientific and social world, regulatory and supervisory authorities, market investors, workers and consumers. The companies, both industrial and financial, that will best respond to this market trend will be those that address ESG issues not as a pure response to public and regulatory pressure, but those that make it a lasting competitive advantage and longterm growth, taking an active leadership position in sustainability. For the banking sector, in particular, the implications will be considerable, given the fundamental role that banks play in financing the economy and businesses. In fact, being able to accurately identify the sectors, companies and business initiatives most exposed to these trends will be a fundamental factor in being able, on the one hand, to understand, identify, measure and effectively mitigate the new risks associated with them and, on the other, to promptly seize the new opportunities linked to the support and financing of the reconversion towards a more sustainable economy. In the current context, moreover, a great opportunity in this sense is represented by the possibility of channelling towards sustainable economy initiatives a substantial share of the public funds made available by Eurozone governments for the relaunch of the economy following the pandemic emergency. The objective of the position paper is to analyze the strategic priorities in addressing the risks and opportunities associated with the transition to a sustainable economy, to identify the initiatives with greater added value for the market and the respective enabling factors for their concrete implementation. The position paper is divided into four parts: 1. Market context and state of the art of Italian banks; 2. ESG in the banking sector; 3. ESG for non-financial institutions; 4. Key success factors and the role of risk management. Chapter 5 also includes the results of a questionnaire prepared by the Commission to which 31 banks responded, representing around 95% of the total assets of the Italian banking system.

As human resource management (HRM) has developed as a field of study, the attention paid to public sector employment relations has been relatively limited. The preoccupation with the link between HR practice and corporate performance has been less applicable to public service organizations that are answerable to a range of stakeholders and in which HR policy has been geared to ensuring political accountability. There has been a recognition that the public sector confronts fiscal and political pressures that are altering HR practice. However, this observation has rarely been backed up by a sustained focus on people management in the public sector. This limited attention arises from characteristics of the sector. Defining the public sector is not straightforward because there are differences between countries in terms of the size, scope, and role of the sector.

This article provides a comprehensive overview of one of the main areas where corporate social responsibility issues have impacted upon firms across the globe, namely the supply chain. Although the legal obligations for social and environmental issues are increasingly devolved to suppliers, the role of lead firms in the development of ethical supply chain management (ESCM) has been the subject of considerable debate. This article focuses on two questions which are central to the development of ESCM. First, it looks at stakeholder pressure for ESCM and its implications for the involvement of lead firms in ESCM. Second, it considers the conditions under which lead firms will be able to influence suppliers and implement ESCM. It then reviews the impact of ESCM on social and environmental performance. Finally, it outlines the implications for the development of effective ESCM.

Corporate social responsibility is a subject of growing importance in business and law. Today, no analysis of corporate governance systems would be complete without considering the pressures on companies to be seen as responsible corporate citizens. This chapter provides a descriptive overview of developments in the field, including increasing voluntary and required environmental, social, and governance (ESG) disclosure; and proliferating voluntary and multilateral standards for responsible corporate behavior. It reviews some of the more significant empirical evidence on the financial results of companies’ implementation of corporate responsibility initiatives, including the effects of such initiatives on innovation, trust, and social welfare. It concludes with an analysis relating these developments to arguments about the objectives of the corporation and the shareholder/stakeholder debate—with particular reference to the argument between Cornell Distinguished Professor of Corporate and Business Law, Lynn A. Stout, and Chief Justice of the Delaware Supreme Court, Leo E. Strine, Jr.

The conventional account of a European Union (EU) “democratic deficit” misses part of the story. This book argues that member-state regulatory processes operating under EU mandates may actually have become more democratically accountable, not less. EU law creates entry points for stakeholder participation in the operation of national regulatory authorities; these avenues for public participation were formerly either not open or not institutionalized to this degree. In these cases, we see not a democratic deficit but a democratic surplus generated by EU law in the member states. Moreover, the decentralized EU regulatory structure may promote experimentation, innovation, and policy exchange between the member states. The book discusses a series of case studies demonstrating how EU law influenced telecommunications regulation in France, Greece, and the United Kingdom. It assesses the operation of accountability processes by drawing on data from more than 1,000 public consultations and some 8,000 consultation responses. The analysis is supplemented by interviews with agency officials as well as industry and consumer group representatives in Paris, Athens, Brussels, and London. The study finds increased participation by actors other than the traditional powerful firms as well as significant transparency gains compared to the previous regime. Nonetheless, the three countries did not respond to EU pressures in an identical fashion. The book compares how the same EU mandates were translated into divergent institutional practices as a result of the different administrative traditions, bureaucratic culture, and public law history of these countries. It also documents roadblocks and difficulties along the way.
