This thesis presents the findings of three empirical studies which together examine relationships between religiosity and sexual misconduct. In the first study archival data from 111 incarcerated adult male sexual offenders were analysed for associations between self-reported religious affiliations and official offence histories. Four categories of religiosity were devised according to self-reported continuities and discontinuities in life-course religious affiliations: non-religious, dropouts, converts, and stayers. ANCOVAs indicated that "stayers" (those who maintained religious involvement from childhood to adulthood) had more sexual offence convictions, more victims, and younger victims, than the other groups. In contrast to the population of study one, all of whom had been convicted of sexual offences, the second study aimed to clarify whether there is also a link between religiosity and sexual misconduct within a population that has not been convicted of sexual offences. It also aimed to identify which aspects of religiosity relate to sexual misconduct. Extending the findings of the first study, study two examined associations between one aspect of religiosity, religious orientation, in conjunction with self-control, moral beliefs and self reported misconduct (including sexual misconduct) in 163 adult male university students. Participants were assigned to one of four religious orientation groups: extrinsic (n = 39); intrinsic (n = 25); indiscriminate (n = 36); and non-religious (n = 63). Participants with an intrinsic religious orientation reported higher self-control and stronger moral beliefs, and were less likely to engage in nonsexual, non-violent misconduct (illicit drug use, wilful damage and theft). Participants with an extrinsic religious orientation were found to have lower self-control and weaker moral beliefs, and were more likely to engage in sexual misconduct. This thesis explores male sexual assault and sexual harassment perpetration. The theoretical orientations were constituted of a theoretical synthesis of primarily Max Weber's theory of action, motivation and subjective meaning, and theoretical aspects of sensemaking. Four research questions were divided into two qualitative studies. Study 1 conducted a systematic review of a diverse field of the research literature on sexual harassment and sexual assault perpetration. The two objectives of study 1 were to explore what kinds of factors are associated with sexual harassment and sexual assault perpetration and what kinds of meanings the research literature attributes to perpetrators actions. The first objective of study 2 was constituted of a qualitative investigation of what kinds of subjective meanings selfidentified perpetrators attribute to their actions. Analysis relied on a hermeneutical interpretation of meaning. Empirical materials were obtained via asynchronous online inquiries and collection of confessional online posts authored by self-identified perpetrators. The second objective of study 2 was to explore in what ways factors associated with male sexual harassment and/or sexual assault perpetration against women affect the subjective meanings perpetrators' attribute to their actions. Findings from study 1 (research review) suggest that sexual misconduct is associated with factors stemming from individual (e.g. psychological characteristics), social (e.g. norms, attitudes and beliefs of how to act as a man), situational (e.g. alcohol intoxication's distortion of meaning and detrimental effect on judgement), communicative (e.g. misperception and misinterpretation of cues from women) and power-related (e.g. sexually harassing or assaulting as a means to obtain or to exert power) factors. Findings further suggest that the research literature attributes obtainment of sexual/physical gratification, exertion of power, will to power and obtainment of a perceived sense of control as primary meanings of perpetrators sexually coercive or harassing actions. Primary findings of study 2 highlight the complex nature of power and its central relation to sexual misconduct, where perpetrators attribute will to power, obtainment of sexual gratification, obtaining enjoyment from exerting power, and ideological subordination as the subjective meaning of their actions. Suggested further is that selfidentified perpetrators attribution of subjective meanings to their actions is characterized by a sensemaking practice of moral disengagement, where distortion of the meaning of sexually oriented actions through euphemistic labeling and perceiving sexually coercive behaviors as a form of game or play are central aspects. Lastly, analysis of the empirical materials in this study suggests that the subjective meanings these men attribute to their actions are associated with individual, socioculturally embedded, situational, communicative and power-related factors.

This thesis was an exploratory study into clerical sexual misconduct within the Roman Catholic Church. It sought to describe the experiences of women and men who, as adults, had experienced this form of professional misconduct. The findings were that clerical sexual misconduct involving adults is an unacknowledged, misinterpreted and harmful event, one involving the abuse of power and which leaves lifelong scars. Contrary to common thinking, these events were not affairs between equals, but violations of professional and religious duty. Survivors are seeking transparent and genuine acknowledgment of this reality in order for their lives to fully heal.

Incidents of sexual misconduct by educators continue to become more prevalent in the United States, resulting in negative social, emotional, and psychological effects on many students. School social workers are professionals with backgrounds in prevention, intervention, and advocacy; however, very little literature has examined the roles of school social workers in preventing and addressing teacher-student sexual misconduct. This case study explored school social workers' roles and their perceptions thereof in relation to incidents that involved teacher-student sexual misconduct and exploitation. General systems theory provided the framework for understanding the roles of social workers and their approaches to working with the different systems associated and connected with the entire education system, including teachers and students. Nine school social workers participated in 30-45-minute audiotaped, in-depth, face-to-face interviews and provided data for this study related to their roles and responsibilities in addressing sexual misconduct in schools. Transcribed interviews were coded, first using emergent open coding and then using focused/axial coding, to form 2 main themes. School social workers in this district were identified as having no well-defined primary or secondary roles related to prevention of and response to teacher-student sexual misconduct, which was reported to result from a number of barriers to school social workers' ability to deliver effective services. A reevaluation of school social workers' roles to include addressing crises such as sexual misconduct has the potential to promote positive social change by improving the educational system and the school's ability to provide a healthier educational environment for students.

There is an unwarranted number of men and women that experience an unwanted sexual contact occurrence while on active duty, that is not reported through the military's sexual harassment or sexual assault system channels. A reporting system that is cumbersome and ineffective may hinder a leader's perception in implementing effective sexual harassment and sexual assault policies and procedures. The purpose of this descriptive multiple case study was to explore the ways a reporting system influenced the decision making processes of leaders and the importance of a fluent information flow through communication channels regarding the reporting system for sexual misconduct within an organization. The conceptual framework for the study was comprised of Freire's dialogical pedagogy theory, leadership decision making, and Bandura's social cognitive theory in cultural context. The research questions addressed the perceptions of 10 retired, senior military leaders, regarding how a leaders' decision making processes may be influenced by a reporting system. The data sources included interviews, observations, journaling, and historical documents. The results suggested that leaders' decision making processes were motivated by the following factors: (a) reporting process, (b) leader decision making processes, (c) gender in the workplace setting, (d) reporting deterrent factors, (e) hostile work environments, (f) leader contributions, and (g) social comparisons. The results of this study contribute to positive social change through their potential to be used to deter or eliminate sexual misconduct at the individual, organizational, and societal levels.

The present research seeks to identify the risks, rewards and challenges associated with hypothetical restorative justice based responses to sexual misconduct at the University of Oregon. Prior to this project here was limited research directly applicable to identifying these risks, rewards and challenges because no university-based restorative justice programs designed to respond to sexual misconduct existed to be studied. The present research uses a literature review to investigate the nature of restorative justice, sexual misconduct, and the laws and statutes that govern both at the University of Oregon. The literature review is supplemented by qualitative data gathered from a series of personal interviews with specialists on the subject. The research shows that restorative justice offers a potentially valuable supplement to existing university responses to sexual misconduct, albeit one that has a variety of limitations and barriers that would need to be surmounted in order for it to be beneficial.

This qualitative study sought to explore and describe the self-reporting experiences of victims/survivors of clergy sexual misconduct against adults (CSMAA) within the Australian Roman Catholic Church (RCC). These under-researched experiences were then compared with Anson Shupe’s theory of clergy malfeasance and its modes and tactics of neutralisation used against those who expose institutional deviance and corruption. The findings were that while, superficially, victims/survivors were positively responded to in some way, for the most part, these adult victims are actually viewed with suspicion, mainly because of their age. Accordingly, victims/survivors experienced further traumatisation, often more impactful than the initial abuse.

Sexual assault has been an issue facing institutions of higher education for many years (Office of Civil Rights, 2011). Alcohol plays a role in both who have been victims of sexual assault and who have perpetrated the crime of sexual assault (Crawford, Wright, & Birchmeier, 2008). The purpose of this study was to look at sexual misconduct at institutions of higher education and to determine if substance use, such as alcohol or drugs, is a factor in the incidence of sexual misconduct happening to students on college campuses. The quantitative data section of the study reviewed three years of data from the Survey of College Health and Behavior. Baseline data were reviewed to show the rate of individuals experiencing nonconsensual sexual contact. Almost 6% of students reported they were taken advantage of sexually due to alcohol use. Over 16% reported they had engaged in risky sexual behavior due to alcohol use, and over 3% had been taken advantage of sexually due to alcohol use by others. Over 1% of students reported they had taken advantage of someone due to their alcohol use. More than 18% of students reported using alcohol or drugs to feel more comfortable with a sexual partner. Half of the 12 survey questions asked had an average of over 70% of respondents who had utilized protective factors. For the qualitative portion of the study, seven interviews were conducted with Title IX Coordinators at higher education institutions in the Midwest with experience ranging from one year to 15 years of working with sexual misconduct in the collegiate setting. Four themes emerged from the interviews: consent, communication, programming, and promotion. Based on the findings from this study, students need to be aware of the connection between substance use and sexual misconduct.

The purpose of this study on university handling of Campus Sexual Assault (CSA) was to understand the experiences of Title IX Coordinators as key administrators in this work. CSA continues to be a pervasive problem, and the dialogue on campuses and externally is highly contentious. Guidance from the federal government, combined with a recent surge in lawsuits against universities, have created a precarious legal context for CSA that is exceedingly difficult for universities to manage. How institutions handle the array of moving parts with CSA is largely absent from the current literature. This study interviewed university Title IX Coordinators, who are responsible for overseeing the institutional response to CSA and therefore are uniquely positioned to offer insight into how universities are handling the problem and the internal and external factors that are playing a role. Sixteen interviews were conducted of Title IX Coordinators responsible for overseeing student CSA matters at NCAA Division I institutions. The research questions guiding this study included: (a) how do Title IX Coordinators handle and carry out their responsibilities related to CSA; what shapes the ways in which Title IX Coordinators handle their responsibilities related to CSA, and (b) how does university culture influence Title IX Coordinators’ work related to CSA? The theory that emerged from the data indicates that Title IX Coordinators have an array of complexities to navigate in their CSA work, stemming from an interplay of both internal and external pressures and factors, that can lead to a range of outcomes that are most often negative. Using grounded theory methodological procedures, a theory and visual model were generated to explain the interactions among the following components: Title IX Coordinator values and priorities; processes involved in CSA work; university culture and structure; collaboration with and management of university partners; the legal landscape and external context; and case outcomes and Title IX Coordinator impact. The theory has implications for policy, for Title IX Coordinators and universities, and for future research

The purpose of this study was to investigate high school policies and procedures that address educator sexual misconduct. High school principals completed an online questionnaire which addressed administrator knowledge of state and federal laws and regulations; knowledge of district policies and procedures; experience with educator sexual misconduct; training and communication available in their schools and school districts for staff, parents, and students; the policies and procedures in place in secondary schools to prevent educator sexual misconduct; and related problems that are reported to school administrators. Responses were compared by school size, community type, and Title I eligibility. The findings of the study revealed that principals feel they have knowledge of the federal and state laws and regulations, as well as the district policies and procedures. However, principals reported a lack of specific policies addressing sexual harassment and discrimination of gay, lesbian, bi-sexual, and transgender students; training for students and teachers in recognizing and responding to sexual misconduct; and sexual misconduct related to students with disabilities. In addition, most principals stated that their schools have not surveyed students to determine the extent of sexual harassment on the campus. Principals of the largest schools and the urban and suburban schools were more actively involved in educator-to-student sexual misconduct investigations.

The Management of children, younger than twelve years of age, who pose a risk to other children, remains complex and confusing. When their behaviour includes sexual aggression towards other children, ignorance about how to manage them becomes even more challenging. Society has an expectation that any sexual aggressor should be punished, however, when the aggressor is younger than ten years old, different responses are necessary. The aim of this current study was to explore the management of learners with sexual behaviour problems, within the primary school setting. The main question underpinning this study was: How are children, aged five-to-nine-years, with sexual behaviour problems, managed by social workers and educators? A qualitative methodology, with focus group discussions and semi-structured interviews were used to conduct this study. Educators from primary schools, as well as social workers from the Western Cape Education Department, were purposively selected to form the sample for this study. Focus group discussions were conducted with the educators, while semi-structured interviews were conducted with the social workers.

UN peace mission personnel sexual misconduct against women violates international norms and law, and persists despite the multitude of interventions aimed at combatting it. South African personnel have repeatedly been identified as perpetrators which calls into question whether the norms that prohibit such conduct have been internalised. Insufficient research has been conducted to interpret the relationships between the political dynamics of UN peace missions and the international norms that govern appropriate conduct towards women. By using a Constructivist lens to examine the mechanisms behind Norm Internalisation, and by analysing how this applies to South African personnel, this research identifies some of the reasons why South Africa’s apparent commitment to international norms about women does not always result in appropriate behaviour. The research examines the UN’s zero-tolerance policy and South Africa’s compliance therewith, demonstrating the challenges that the political dynamics between these two actors has in achieving Norm Internalisation. This research provides a foundation for future research on the topic of peacekeeper sexual misconduct by highlighting the role that norms can play in determining appropriate behaviour.

This study's purpose was to discover commonalities and differences among female predators and Florida female teachers who are perceived and reported to harass students sexually. When perceived and reported female sexual harasser and student safety was researched, a breath of studies did not occur. When current studies were reviewed, teacher sexual harassment continued to occur. In this qualitative study, ten Florida public school female teachers who were perceived and reported to sexually harass students were randomly selected. Findings indicted that further research is still needed on female teachers who are perceived and reported to sexually harass students. When researching the female teacher as a sexual predator, implications such as student safety in the public school system, school districts not reporting sexual harassment, and the need for additional research due to the minimal amount of completed research on the topic. When the differences and commonalities between female teachers who are perceived and reported to harass students sexually and female predators was studied, the results were not conclusive. The data displayed minimal commonalities and differences leaving no definitive answer but created numerous questions for future research. In addition, recommendations were made for school leaders and for future research.

This study describes and analyzes the institutional response of the Unitarian Universalist Association (UUA) to clergy sexual misconduct between 1991 to 2005. Through the analysis of organizational proceedings, interviews, archival documents and historical references, qualitative case study methodology is used to investigate two research questions: 1. What has been the response of the UUA to clergy sexual misconduct?; 2. What theology/ideology guide(s) the UUA's institutional response to clergy sexual misconduct? The research findings indicate that increased inclusion of female clergy, influenced by the women's movement, Unitarian Universalist women's advocacy, and the sexual revolution were some of the factors that influenced the UUAs institutional response to clergy sexual misconduct. The research identifies obstacles that have impeded more aggressive support of victim/survivors' leadership and opens a space for the emergent identities of victim/survivors. Data gathered suggests there is a critical need for more rigorous theological reflections to foster transformational dialogues. By providing examples of how the UUA is working to eradicate clergy sexual misconduct, this dissertation demonstrates how faith communities can achieve safe congregations, and empower victim/survivors, while moving toward a new restorative justice paradigm. New arid fresh voices, perspectives and analyses are introduced to develop a richer understanding of clergy sexual misconduct and one faith community's response to this growing problem.

This study was conducted in the context of the regulation of professional nursing and midwifery practice in the Australian health care system. In this environment, professional regulatory authorities established by State and Territory legislation in all jurisdictions, regulate and control the work of health professionals. In Queensland, registered nurses, enrolled nurses and midwives are regulated by the Queensland Nursing Council, the statutory body created by the Nursing Act 1992 (Qld). Part of the regulatory role of this and other authorities is to discipline professionals whose conduct or behaviour falls short of appropriate and acceptable standards of practice. All regulated health professionals, including nurses and midwives, are potentially subject to professional disciplinary action if a complaint is lodged in relation to their conduct. This being an important issue in the management and delivery of health care, and an increased trend among health care consumers, the dearth of existing research into the disciplinary process is a major concern. This exploratory study examined the disciplinary role of the Queensland Nursing Council in adhering to its legislative mandate to ensure safe and competent nursing practice. The study focused on the extent to which structural (legislation and policy), professional, and process factors impacted on the outcomes of disciplinary Tribunals and Committees in cases of incompetent or unsafe practice and sexual misconduct. The study was situated within the interpretive paradigm using a case study approach. Specifically, it investigated cases of sexual misconduct by nurses and unsafe or incompetent practice by midwives. The study was guided by Donabedian's conceptual framework of structure-process-outcome. This framework was seen to be most suited to the aims of the study and provided a template for in-depth analysis of the data emerging from the two cases. The findings of this study provided insight into the factors underpinning the decisions of the disciplinary bodies in making determinations and formulating outcomes. There was found to be a lack of consistency and predictability in both the legislative frameworks and the interpretation of terms and concepts used to identify conduct warranting a disciplinary response from regulatory authorities. Although the processes of disciplinary proceedings are prescribed by both legislation and policy, their practical application was characterised by considerable challenges, which resulted in varying outcomes. The thesis reports this information so that it can be used as an initial basis to build a body of knowledge from practical experience with disciplinary proceedings that will inform future processes. Subsequent case studies in other contexts and systems will increase the level of knowledge available to nurses, other health care providers, health care institutions and regulatory authorities. The initial base of evidence suggests implications for practice, education and further research which are outlined in the final chapter of the thesis.

This thesis examines sexual abuse and violence against women by priests. Using public complaints made in Brazil between 1994 and 2000 as an empirical base, it details 203 articles related to 21 cases of sexual misconduct by clergymen, including sexual abuse, rape, and the violation of vows of celibacy. These articles were grouped to create a dossier on each of the cases and numbered sequentially. Brazil´s most important media sources were consulted, including online news sites and non-governmental organizations (NGOs) across the country. Two representative cases were chosen and studied in depth. Interviews were conducted with plaintiffs, witnesses, members of the Church hierarchy, and attorneys involved in the cases, preserving the anonymity of all interviewees. Utilizing a sociological perspective, the analysis explores the mechanisms by which the Catholic Church attempts to cover up such cases. Showing the specificities of the violence perpetrated against women by priests, the study points toward the existence of structural causes of this violence and their different manifestations, examining them through the lens of feminist theory. The study suggests that a specific analytic category should be developed in order to better comprehend this particular type of violence against women. The term clerical violence is proposed for describing this type of violence, whose structural aspects include gender asymmetries, the separation between clergy and lay members, patriarchal discourse, the sexualization of ministerial relations and the force of symbolic violence. The work of Pierre Bourdieu is useful in understanding religion as a symbolic system that endows the priest with sacred power. Given that the causes of clerical violence are mainly structural, likewise, structural solutions are needed in addressing the issue
Esta tese tem por objeto, relações de abuso e violência sexual de padres contra mulheres. O campo empírico delimita-se às denúncias públicas feitas no Brasil entre os anos 1994 e 2002. Foram mapeadas 203 matérias sobre 21 casos de má conduta sexual de religiosos, abuso sexual, estupro e infração dos votos de celibato. Essas matérias foram agrupadas de modo a compor um dossiê de cada um dos casos noticiados, numerados sequencialmente. Para realizar esta pesquisa foram consultados os veículos de mídia mais significativos do país, sítios de agências de notícias e ongs atuantes em todo o território nacional. Dois casos paradigmáticos foram selecionados e estudados em profundidade. Realizou-se entrevistas com denunciantes, testemunhas, membros da hierarquia, e advogados/as envolvidos/as no caso. Preservou-se o anonimato de todos/as os/as entrevistados/as. A análise feita, desde uma perspectiva sociológica, evidencia os mecanismos existentes na Igreja Católica para o ocultamento dos casos denunciados, estuda as especificidades da violência perpetrada por padres contra mulheres e aponta as causas estruturais dessa violência. Recorrendo às teorias feministas, são abordados os fatores causais da violência contra as mulheres e suas diferentes manifestações. O contato com essa bibliografia e o tratamento dos dados sugere a necessidade da elaboração de uma categoria específica que ofereça elementos para a análise da violência praticada por autoridades eclesiásticas contra mulheres. Trabalha-se os aspectos estruturais que constituem essa categoria, denominando-a violência clerical. Tais aspectos referem-se às assimetrias de gênero, à separação entre clero e laicato, ao discurso religioso patriarcal, à sexualização das relações ministeriais e à força da violência simbólica. O pensamento de Bourdieu ajuda na compreensão da religião enquanto sistema simbólico que reveste a figura do padre de um poder sagrado. Uma vez que as causas da violência clerical são principalmente de origem estrutural, entende-se a necessidade de buscar soluções estruturais no enfrentamento da questão

Questa tesi di dottorato ha l’obiettivo di analizzare i processi attraverso cui individui ed organizzazioni costruiscono la loro posizione e la loro valutazione nel contesto di field istituzionali culturali e creativi. La tesi contiene tre capitoli che rappresentano tre distinti lavori di ricerca. Le analisi empiriche svolte sono incentrate sui settori del cinema (primo capitolo), della quality television (televisione ‘di qualità’, serie televisive) e della musica indipendente negli Stati Uniti. In tutti i lavori di ricerca sono stati utilizzati database longitudinali e metodi quantitativi e qualitativi. Nel primo capitolo, si analizza come gli scandali personali (di natura sessuale e non sessuale) influenzino la costruzione della peer recognition. Si prendono anche in considerazione gli effetti degli stereotipi legati al genere e dei comportamenti orientati alla valorizzazione delle diversità (solidarietà femminile), per comprendere come questi influiscano sulla peer recognition, insieme agli scandali, nell’ambito della valutazione degli attori di Hollywood (candidatura all’Oscar), nel lasso temporale 2003-2018. Nel secondo capitolo, viene teorizzato il processo di nascita e di consolidamento di un field interstiziale (interstitial issue field), attraverso l’analisi del caso del field nato tra la musica indipendente e la quality television negli Stati Uniti, dal 2003 al 2018. Si delineano le caratteristiche della infrastruttura istituzionale del field emerso, si definisce il ruolo lavoro degli attori istituzionali (institutional work) e degli spazi interstiziali (interstitial spaces). Nel terzo capitolo, i field istituzionali della musica indipendente e della quality television sono ulteriormente esaminati, tra il 2013 e il 2018, attraverso una indagine della collaborazione tra i due field, nell’ utilizzo di un album indipendente nella soundtrack di episodi di una serie televisiva. La ricerca mira a comprendere gli effetti della collaborazione sulla valutazione di un prodotto del field della musica indipendente (album indipendenti) che collabora con un field più ‘commerciale’ (quality television).
This doctoral thesis aims at shedding light on the processes by which individuals and organizations negotiate their structure, position, and evaluation, within the context of creative and cultural fields. It contains three chapters that represent three research studies. The empirical analyses undertaken throughout the research pieces are focused on the fields of cinema (first chapter), quality television, and independent music (second and third chapter) in the United States. For all of them, longitudinal databases are employed, and both quantitative and qualitative methodologies are utilized. In the first chapter, the role of personal (sexual and non-sexual) scandals for peer recognition is investigated. The research focuses on how scandals, gender stereotypes, and engagement in diversity-valuing behaviors (female solidarity) affect peer recognition for Hollywood actors (nomination of actors for an Oscar), in the time frame 2003-2018. In the second chapter, the process of emergence and consolidation of an interstitial issue field is theorized, by exploring the case of the field that emerged between indie music and the quality television in the United States from 2003 to 2018. In the analysis, the features of the institutional infrastructure of the emerged field, with the role of institutional actors and of interstitial spaces, are taken into consideration. In the third chapter, the fields of independent music and quality television in the US are further examined, between 2013 and 2018, by focusing on the patterns of evaluation of one field’s products (independent music, independent albums) when this field interacts with the other (quality television) – that is, when independent albums are featured in quality television episodes.

The interpretation of Art. 228 of the criminal code rules a person who takes advantage of his authority over another who is subject to his supervision because of family, guardian, tutor, benefactor,official, or occupational relationship and who has carnal relations with or commits an indecent.   However, ever since the amendment to our national Criminal Code in 1999, the differentiation between Article 221 in the Criminal Code and Article 228 in the Criminal Code are unapparent.
