The idea that planners should work toward an equitable society has been part of the profession since the 1960s, largely based on the work of planning theorists like Paul Davidoff, Sherry Arnstein and Norman Krumholz. Transportation planning, however, has been slower than other sectors of the profession, such as housing, to embrace equity planning concepts. That has begun to change as concerns about income inequality, environmental justice and climate change have become more salient. This thesis makes the case that in order to improve social equity outcomes, transportation planners must make social equity an explicit goal and add social equity performance measures and targets to their plans. The study focuses on Hillsborough County, Florida as a case study and analyzes the extent that transportation planning agencies in the county consider social equity in their plans and processes. The data on plans and processes will be compared to data on social equity outcomes related to the distribution of transportation benefits and burdens, and next steps to improve social equity outcomes in the County will be identified in the form of policy recommendations.

The focus of this study was to explore and expand capabilities, sustainability and gender justice in Science, Mathematics and Technical subjects (SMTs) in teacher education curriculum practices as a process of Education for Sustainable Development in two case studies in Zimbabwe and South Africa. The study begins by discussing gender and science education discourse, locating it within Education for Sustainable Development discourse. Through this nexus, the study was able to explore gender and sustainability responsiveness of the curriculum practices of teacher educators in Science, Mathematics and Technical subjects; scrutinise underlying mechanisms that affect (promote or constrain) gender and sustainability responsive curriculum practices; and understand if and how teacher education curriculum practices consider the functionings and capabilities of females in relation to increased socio-ecological risk in a Southern African context. Influenced by a curriculum transformation commitment, an expansive learning phase was conducted to promote gender and sustainability responsive pedagogies in teacher education curriculum practices. As shown in the study, the expansive learning processes resulted in (re)conceptualising the curriculum practices (object), analysis of contradictions and developing new ways of doing work. Drawing from the sensitising concepts of dialectics, reflexivity and agency, the study worked with the three theoretical approaches of Cultural Historical Activity Theory (CHAT), feminist theory and capabilities theory. The capability and feminist lenses were used in the exploration of gender and sustainability responsiveness in science teacher education curriculum practices. CHAT, through its associated methodology of Developmental Work Research, offered the opportunity for researcher and participants in this study to come together to question and analyse curriculum practices and model new ways of doing work. Case study research was used in two case studies of teacher education curriculum practices in Science, Mathematics and Technical subjects, one in Zimbabwe and one in South Africa. Each case study is constituted with a networked activity system. The study used in-depth and focus group interviews and document analysis to explore gender and sustainability responsiveness in curriculum practices and to generate mirror data. Inductive and abductive modes of inference, and Critical Discourse Analysis were used to analyse data. This data was then used in Change Laboratory Workshops, where double stimulation and focus group discussions contributed to the expansive learning process. Findings from the exploration phase of the study revealed that most teacher educators in the two case studies had some basic levels of gender sensitivity, meaning that they had ability to perceive existing gender inequalities as it applies only to gender disaggregated data especially when it comes to enrolment and retention. However, there was no institutionalised pedagogic device in place in both case studies aimed at equipping future teachers with knowledge, skills, attitudes and values to promote aspects of capabilities (well-being achievement, wellbeing freedom, agency achievement and agency freedom) for girls in Science, Mathematics and Technical subjects. Science, Mathematics and Technical subjects teacher educators' curriculum practices were gender neutral, but in a gendered environment. This was a pedagogical tension that was visible in both case studies. On the other hand, socio-ecological issues, in cases where they were incorporated into the curriculum, were incorporated in a gender blind or gender neutral manner. Social ecological concerns such as climate change were treated as if they were not gendered both in their impact and in their mitigation and adaptation. It emerged that causal mechanisms shaping this situation were of a socio-political nature: there exist cultural differences between students and teacher educators; patriarchal ideology and hegemony; as well as other interfering binaries such as race and class. Other curriculum related constraints, though embedded in the socio-cultural-political nexus, include: rigid and content heavy curriculum, coupled with students who come into the system with inadequate content knowledge; and philosophy informing pedagogy namely scientism, with associated instrumentalist and functionalist tenets. All these led to contradictions between pedagogical practices with those expected by the Education for Sustainable Development framework. The study contributes in-depth insight into science teacher education curriculum development. By locating the study at the nexus of gender and Science, Mathematics and Technical subjects within the Education for Sustainable Development discourse, using the ontological lenses of feminist and capabilities, it was possible to interrogate aspects of quality and relevance of the science teacher education curriculum. The study also provides insight into participatory research and learning processes especially within the context of policy and curriculum development. It provides empirical evidence of mobilising reflexivity amongst both policy makers and policy implementers towards building human agency in policy translation for a curriculum transformation that is critical for responding to contemporary socio-ecological risks.

ENGLISH ABSTRACT: This study deals with crime prevention within the criminal justice system in response to the current crime situation in the Western Cape. It describes the structure and function of the criminal justice system and assesses crime prevention processes with specific reference to the role of social work within the criminal justice system. It further examines the criminal justice system as practised in the Western Cape, paying specific attention to the role of the police, criminal courts and prisons in the prevention of crime. In line with the nature of the study an exploratory approach was used. The data was collected from both primary and secondary sources. Interviews and observations were the main research techniques used for gathering primary data. Secondary data + was gathered by means of a study of the literature. Structured and unstructured interviews were conducted with social workers, magistrates, police officers, prosecutors, victims, offenders, community workers and other officials of the criminal justice system. These interviews were mainly conducted at Wynberg magistrates' court, Drakenstein Prison (formerly known as Victor Verster Prison) and organisations based in the metro areas and on the Cape Flats. The study was conducted over a period of three years with the interview schedule administered between May and August 2000. A sample of 21 respondents was selected on the basis of a purposive approach and procedure. The comprehensive interview schedule consisted of mainly open-ended and a few closed questions, generating information on the profiles of respondents, crime dynamics in the Western Cape, the sentencing process and prevention strategies, matters related to the criminal justice system and corrections, and the role of community justice in the prevention of crime. The generated qualitative data was analysed and interpreted. The findings suggested the necessity for social work to make a contribution to the prevention of crime in a sensitive and proactive way. The analysis has shown that criminal justice approaches can significantly enhance the process of crime prevention, but that the criminal justice system requires combined strategies and approaches for crime prevention to be effective. It is in this context that the contribution of social work can be much more effective. The recommendations of the study have demonstrated a need for social workers to promote approaches that are premised on a broader understanding of the role of the criminal justice system in the prevention of crime. It is important to state that the study's recommendations for the prevention of .crirne can also be implemented by other role-players, particularly within the criminal justice system.
AFRIKAANSE OPSOMMING: Hierdie ondersoek handeloor misdaadvoorkoming deur die strafregstelsel in reaksie tot die huidige misdaadsituasie in-die Wes-Kaap. Dit beskryf die struktuur en funksie van die stafregstelsel en beoordeel misdaadvoorkomingsprosesse met besondere verwysing na die rol van maatskaplike werk binne die strafregstelsel. Dit ondersoek verder die strafregstelsel soos beoefen in die Wes-Kaap deur veral aandag te gee aan die rol van die polisie, die howe en gevangenisse in die voorkoming van misdaad. Die aard van die ondersoek vereis dat 'n eksplorerende benadering gevolg is. Data is versamel uit primêre sowel as sekondêre bronne. Advocates of restorative and transitional justice practice have long drawn from practices of indigenous peoples to form the basis for more sustainable, relational, participatory, community-based approaches to conflict resolution. With the resurgence in Kazakh nationalism since the Republic of Kazakhstan independence, repatriated diasporic Kazakhs, who through cultural survival in diaspora retain more of their ethno-cultural characteristics, influence a revival of Kazakh language and culture. The purpose of this study was to understand the indigenous informal restorative conflict resolution practices of the Kazakh people. The questions that drove this study were: What indigenous informal forms of dispute resolution have been in use among Kazakhs, as reflected in their folklore and proverbs; which have continued in use among diasporic semi-nomadic Kazakh populations; and, which, if any, are restorative in nature? This ethnographic multi-case study incorporates participant observation and semi-structured interviews of participants selected through snowball sampling from among diasporic Kazakhs in, or repatriated from, China. Kazakh folklore and proverb collections were examined for conflict resolution practices and values at the family and kinship levels. Key theories used to explore the topic include Post-Colonial Theory of Sub-Altern Agency, Essentialism Theory, Soviet Ethnos Theory, and Restoration of Trust Theory. This study expands the knowledge base regarding indigenous systems of conflict resolution and contributes to the ethnography of the Kazakh people. The existence of indigenous informal restorative Kazakh systems of conflict resolution can inform reassessment and reform of public policy as to alternatives to punitive criminal justice practices.

In order to test whether South African public service fulfills democratic aims and objectives, this study establishes the limits to and extent of the Promotion of Administrative Justice Act 3 of 2000 (the PAJA) in promoting the right to administrative justice as a human right (the RAJAH) and thereby transforming public service delivery. To achieve above aim the background to the entrenched right to administrative justice is analysed through a study of principles underlying administrative justice. Both South African common law and Constitutional systems are analysed against the principles underlying administrative justice. Batho Pele principles contained in the White Paper on the Transformation of the Public Service (WPTPS) are also analysed to find out how the South African Public Administration interprets its constitutional duties and to establish the relevance of these principles to administrative justice principles ensconced in the PAJA. The PAJA is then analysed in order to measure the extent to which it affirms the transformation principles ensconced in the Constitution and coinciding with Batho Pele principles. As the public service is a reflection of democracy in action, the public expects it to be professional, representative and proficient. If it does not fulfil these expectations, this may be interpreted as a fundamental failure of democracy. South African democracy in particular is development oriented because it is based on the Constitution that entrenches among others the right to administrative justice. The right to administrative justice as a development tool urges the public sector to recognise and apply constitutionally recognised procedures and processes in every delivery so that the social status of citizens may be enhanced. Such steps, if effectively followed, signify that the public sector has transformed from bad governance practices of the pre constitutional era where there was no requirement for the observance of individual rights in public service delivery. Failures to the adoption of good governance principles by the public sector show the opposite of the expected standards and signify that the public sector is not yet transformed. In the light of the problems caused by the lack of protection of human rights from abuse by the executive under the common law system of parliamentary supremacy, the constitutional era was expected to have changed the position of South African administrative law drastically through its adoption of the principles underlying administrative justice. To develop insight into the extent of the transformation towards administrative justice that is expected to have occurred in South Africa since the advent of constitutionalism the implementation of the PAJA is evaluated through an examination of a selection of cases that deals with public administration decisions in the area of social assistance as a context in which members of the public are most dependent on effective state administration. As the scope of the study limits the number of cases that can be examined, only the most informative cases on social assistance that relates to the KwaZulu-Natal and the Eastern Cape provinces are analysed. The research finds that public service is not yet transformed and identifies the causal factors. It recommends steps to be followed so that the expected culture from the public sector is attained.

ENGLISH ABSTRACT: This thesis explores whether sustainable peace can be achieved in post-conflict societies using the transitional justice approach. In particular, the truth commission is investigated as a mechanism of transitional justice. The South African Truth and Reconciliation Commission (TRC) was selected as a case study to investigate the relationship between sustainable peace and transitional justice. This thesis analyses whether the TRC Commission followed its mandate, and whether there are any specific definitions, conclusions or recommendations that the TRC through its Final Report undertakes in order to fulfill a specific part of the mandate, namely “to ensure that there would be no repetition of the past” (TRC vol. 5, chap. 8, paragraph 14). This is done through a textual analysis of the Final Report of the South African TRC, where inherent weaknesses of the Final Report in its aim of achieving sustainable peace are read critically and deconstructively. It is further analysed through linking the issue of sustainable peace to the field of transitional justice and the study of political development on how future TRCs can deal with the issue of sustainable peace. This thesis comes to the conclusion that the South African TRC failed to contribute to a significant analysis of how to prevent the repetition of the past. It is argued that this is based on a lack of a coherent theoretical framework, as the Final Report mixes two different truth finding mechanisms: micro-truth finding and macro-truth finding, together with the just war theory. By analysing the TRC’s theoretical framework through textual analysis, it becomes clear that micro- and macro-truth finding is difficult to combine in one report, and that in the South African case the micro-truth finding part is prioritised. However, the macro-truth finding mechanism would have provided a more in depth analysis towards sustainable peace – which in this thesis is read as Galtung’s positive peace and Lederach’s structural peace – and is a necessary prerequisite in order to achieve sustainable peace. ENGLISH ABSTRACT: Violence against women is a serious offence. Emotional and physical abuse can happen to our daughters, sisters and wives. Rape is a form of violence against women. It violates a woman's privacy, dignity and it makes her feel as if she has lost control. The criminal justice system is there to protect the citizens of a country and this protection should extend to women when they have been violated. The criminal justice system has different structures, for example the courts, medical services and police services. The staff of the criminal justice process do not have an inherent duty to care about rape survivors but they can be trained to treat survivors with consideration and sympathy to counteract the effects of the rape and secondary victimization experienced by rape survivors. It is important that there are guidelines for the staff of the criminal justice system to assist them in rape cases. This thesis explores whether women experience secondary victimisation during court proceedings. To assess whether it occurs, court transcripts were analysed with a focus placed on the background of the court case and the verdicts of the judges. Findings indicate that secondary victimisation do occur during court cases. Rape survivors feel as if they are on trial and not the rapist. Survivors furthermore believe that they will have to live with the label that they had been raped and humiliated. The thesis recommends that officials of the criminal justice process should receive extensive training, and looks at the Sexual Offences Court in Wynberg as an example of an improved system for rape survivors. It is recommended that the procedures of the Sexual Offences Court should be evaluated on a regular basis to address secondary victimisation problems that may persist. Communication is very important during the rape trial. The rape survivor has to be informed about her case and about the location of the rapist at all times.
AFRIKAANSE OPSOMMING: Geweld teen vroue is 'n ernstige oortreding wat plaasvind in ons samelewing. Emosionele en fisiese geweld kan gebeur met ons dogters, vroue en susters. Hierdie vorm van geweld laat vroue voel asof hulle beheer verloor oor hulle lewens en dit het ook 'n impak op hul self respek en selfbeeld. Die Kriminele Sisteem van Suid Afrika is daar om die belange van sy inwoners te beskerm. Dit het verskillende afdelings byvoorbeeld, die mediese dienste, die polisie en die hof verrigtinge. Die lede van die Kriminele Sisteem werk met verskillende individue wat voel dat die hof die uitweg sal wees wat geregtigheid sal laat geskied. Die lede van die Kriminele Sisteem het nie 'n persoonlike verantwoordelikheid teenoor die verkragtings oorlewendes nie, maar hulle moet sensitiwiteit en empatie betoon teenoor die dames wat verkrag was. Die gedrag van die personeel speel 'n groot rol in terme van hoe die vrou wat verkrag was die aangeleentheid verwerk. Die fokus van die studie is om te kyk of vroue wel sekondêre viktimisering ervaar wanneer hulle besluit om voort te gaan met die hofsake. Hierdie gevoelens van self blamering vorm deel van sekondêre viktimisering wat veroorsaak dat vroue sommige kere voel om nie verder te gaan met die hof saak nie. Die verskillende lede van die Kriminele Sisteem moet gedurig opleiding verkry wat hulle in staat sal stel om die gevoelens van die slagoffers in ag te neem. Die howe wat spesiaal opgerig is om verkragting sake te verhoor moet geevalueer word sodat dit 'n sukses kan wees. Kommunikasie moet bevorder word tussen die verskillende departemente en nie -regerings organisasies wat 'n rol speel gedurende die hof sake.

This study was interested in exploring the perceptions and experiences of social workers about the nature and contents of conducting risk assessments with child offenders. Considering the high level of crime and reoffending in South Africa, effective assessment is imperative. The goal of the research was to develop an in-depth understanding of how risk assessments of child offenders are conducted in practice. This was done by applying a qualitative research methodology. The study was conducted in the Western Cape. Data were collected by means of semi-structured interviews. Purposive sampling was employed and data were analysed according to the framework provided by Tesch. The findings indicated that although prescribed instruments are used in the risk assessment of children in South Africa, they all have definite limitations. To enhance the quality of service rendered to child offenders, the development of a standardised risk assessment instrument is needed.

While intergenerational transmission of trauma has been widely studied, there is a paucity of literature on intergenerational humiliation. Furthermore, humiliation is regarded as a significant feature of transgenerational transmission of trauma and revenge production. Therefore, the present study aimed to contribute to addressing this paucity and to explore and understand intergenerational humiliation as experienced by 20 children and grandchildren of victims of apartheid-era gross human rights violations. Conceptually, historical trauma theory framed the study. A hermeneutic phenomenological methodology was used to achieve the aims. Through purposive-criterion sampling, data was collected and analysed using interpretive phenomenological analysis. Results show that the consequences of intergenerational humiliation are varied as feelings of hurt and loss perpetuate through the generations. Although positive influences counter these feelings within a generation, they remain alive in memories. This has implications on ethnic and racial inter-group relations as transitional societies such as South Africa seek social cohesion.

Increasing incidents of mob justice have left a trail of murders that remain unsolved in the rural areas of South Africa. As such, little attention has been given to the experiences of victims and perpetrators involved in mob justice related incidents in these areas in particular. The purpose of this study was to examine narrative accounts of the experiences of victims and perpetrators engaged in mob justice associated incidents in the Diphale village, Limpopo. Twenty participants, consisting of 14 perpetrators and 06 victims, were chosen through sampling techniques, like, convenience and snowball sampling. A qualitative approach was adopted using semi-structured interviews as the key research instrument. The semi-structured interviews were conducted with 09 perpetrators, and two focus groups involving 06 victims and 05 perpetrators. Data was analysed using thematic analysis to interpret data collected from the participants. The findings indicated that unsolved crime leads to persistent mob justice activities in the Diphale village. The findings in the study were further bolstered through the provision of recommendations aimed at preventing future mob justice activities. The recommendations highlight proper service delivery, including community development, and the reduction of corruption and bribery.

The purpose of this study was to contextually describe and explore the experiences and challenges of the juvenile offenders and pre-trial diversion officers (PTD) involved in the pre-trial diversion programme (PTD) in the Chitungwiza community. In this study, the qualitative research methodology was applied. Research designs used were explorative, descriptive and contextual of nature. Furthermore, the multi-case studies design within the qualitative approach applied. The non-probability purposive and snow-balling sampling methods were used to select the sample from juvenile offenders and PTD officers who have been involved in the PTD programme. Qualitative data was collected using semi-structured interviews with an open-ended interview guide. The eight steps of Tesch (Creswell, 2009:186) were employed to analyse the data. To demostrate the trustworthiness of the research findings, the researcher used Guba`s model (Krefting, 1991:214-222). The findings of the study established that most children commit criminal offences due to socio-economic reasons and that the pre-trial diversion programme is largely effective in the rehabilitation of juvenile offenders. Recommendations were made for the PTD programme to activate socio-economic interventions and improve resources allocation in order to enhance service delivery.

The purpose of this study was to retrospectively analyze a group of observation cases referred to a psychiatric institution through the criminal justice system by means of certain measuring instruments in order to determine on which grounds some of the cases were classified as criminals and others as state patients. The sample for the purposes of this investigation consisted of one hundred and forty-two cases referred to the Weskoppies hospital for psychiatric observation during 1988 to 1994. The measuring instruments were the South African Wechsler intelligence scale, the Rorschach projective technique and an information schedule which was used for the purpose of gathering biographical information and personal details of each particular case. The data collected through these instruments was statistically analyzed utilising frequencies and crosstabulations, chi-square tests, t-tests, correspondence analyses, factor analyses and regression analyses. The findings of this investigation revealed that crimes concerning personal relations and property crimes were more committed by criminals than state patients while crimes concerning communal life were encountered more amongst state patients than criminals. Non-person-directed crimes of violence were encountered proportionally more amongst state patients who had a history of substance abuse than in criminals with a similar history. State patients who had a history of substance abuse were proportionally more prosecuted on account of person-directed-crimes of violence than criminals with a similar history. The predictive measuring instrument developed by means of regression analysis indicated as important predictors three subtests of the South African Wechsler intelligence scale namely general information, digit-symbol substitution and picture arrangement as well as the variable "previous psychiatric treatment". The following recommendations were also made: The current endeavour to adapt the South African Wechsler intelligence scale for all population groups needs to be maintained and this adaptation should also be pursued in each country where the scale is used or was used in the past. It is advisable to draw up certain profiles of specific offenders by means of the Rorschach projective technique while the testing procedure should preferably be undertaken by the same researcher. Provision should be made that the accused be declared as state patients only on account of serious and violent crimes while the courts should have the right in appropriate cases to charge the accused with detention in accordance with chapter three of the Mental Health Act. The testimony of criminologists and psychologists should be added to the testimony of psychiatrists especially in cases of accountability or diminished accountability. The proposed predictive model may be further refined and adapted through the use of a larger, nation-wide sample resulting in the inclusion of a greater number of observation cases and variables. Due to the accelerating rate of revision associated with The DSM­ IV manual and the fact that its validity is questioned, ethically responsible psychiatrists, psychologists and criminologists are obligated to identify practices and procedures which threaten to misinform the legal system.
Die doel van hierdie studie was om aan die hand van bepaalde meetinstrumente retrospektief 'n groep observasiegevalle wat deur die regstelsel na 'n psigiatriese inrigting verwys is, te ontleed, sodat daar vasgestel kon word op watter gronde sekere van die gevalle as misdadigers en ander as staatspasiente geklassifiseer is. Die steekproef vir die doeleindes van hierdie ondersoek het bestaan uit honderd twee-en-veertig gevalle wat vanaf 1988 tot 1994 na Weskoppieshospitaal vir psigiatriese waarneming verwys is. Die meetinstrumente wat gebruik is, was die Suid-Afrikaanse Wechsler-intelligensieskaal, die Rorschach-projeksietegniek en 'n inligtingskedule wat biografiese inligting en persoonlike besonderhede van elke besondere geval ingewin het. Die gegewens wat uit hierdie meetinstrumente versamel is, is statisties verwerk met behulp van frekwensies en kruistabellerings, chi­ kwadraattoetse, t-toetse, korrespondensie-analises, faktoranalises en regressie-ontledings. Die voorspellingsmeetinstrument wat met behulp van die regressie ontledings ontwikkel is, het drie subtoetse van die Suid­ Afrikaanse Wechsler-intelligensieskaal naamlik algemene inligting, syfersimboolvervanging en prentrangskikking asook die veranderlike "vorige psigiatriese behandeling" as die belangrikste voorspellers uitgewys. Die volgende aanbevelings word ook hiermee gemaak: Daar moet volgehou word met die huidige poging om die Suid­ Afrikaanse Wechsler-intelligensieskaal vir alle bevolkingsgroepe in Suid-Afrika aan te pas asook met die aanpassing van die meetskaal vir elke land wat dit tans gebruik of in die verlede gebruik het. This study investigates the challenges and benefits of policy networks. It focuses specifically on the experiences of the Centre for Crimlnal Justice, examining the challenges and benefits it experiences in its networks. In spite of the widely applauded benefits of networks in this study and in other publications, findings from this study still highlight the challenges of networks in labour policy implementation. The study reveals that the element of diversity and the complicated nature of networks' management threaten networks' ability to realize their objectives. The lack of binding regulations and managerial structures in certain networks reveals the drawback in networks' management. Firstly, it raises questions about the legitimacy of any self-initiated coordination in networks since such might not be formally accepted by network members. Secondly, the thesis argues that the lack of binding regulations in some networks deepen the likelihood of uncooperative attitude among actors, especially when it suits them, given that there are no defined consequences for their actions. Other findings in this study draw attention to the operational conflict between the vertical and lateral-minded members of a network. This discusses the question of methodological disagreement between actors of contrasting view points in the execution of certain tasks. Finally, the thesis looks at the question of actors' autonomy in a network. It argues that threats to actors' autonomy or dignity could promote lack of commitment from network members, neglect of responsibility and the possible breakdown of the network if such issues are not properly addressed. In summary, though networks are ideal tools for policy implementation and service delivery in contemporary society, they nevertheless have their challenges. Hence the study concludes with an invitation for proper acknowledgement of the challenges in the process of networks and the need for further studies in this field to enhance the effectiveness of networks in implementation processes.

This study was intended to understand the experiences of individual detective trainees about poor academic performance in Hammanskraal academy. Detectives are the people who must ensure that perpetrators of crime face the full might of the law through investigating and proving before the courts the guilt on the part of the perpetrator, but also to prove the innocence in some instances. In this qualitative study, purposive sampling was used, and ten participants were selected to take part in the study. The participants include the six trainees who obtained below 50% mark in one of the summative assessments and could not qualify as detectives. Further, participants include the four trainers who had more than five years as trainers in the academy to give their perspective about the poor academic performance of trainees in Hammanskraal Academy. The unstructured interview was used to collect the data, and qualitative data analysis steps were applied to analyse the data. Some of the findings are the extent of damage that is caused by poor academic performance on the individual detective trainees, and that also affected their families. They also feel embarrassed that they did not qualify as detectives because of poor academic performance. In conclusion, there is a need to put measures that would deal with the poor academic performance of the detective trainees.

In this study the researcher’s focus was on the analysis of human rights training in SAPS, a case study in Gauteng. The whole study is covered by over seven chapters. In chapter one, the introduction to human rights is discussed and the reason that motivated the researcher to pursue the study under the topic. Most importantly the aim and objectives of the study are outlined. Chapter two main focuses is on the regulatory frameworks of human rights training and programmes. In chapter three the attention is on the international best practice for police training in human rights, as any police training is benched marked internationally. Chapter four the researcher explains the research methodology used in this study, as it is important for the reader to have an understanding. Chapter five discusses the data that is collected and the analysis thereof by using nine themes to analyze data. In chapter six the discussion is based on the finding of data analysis from chapter five. Finally the researcher in chapter seven gives the summary of the study, the recommendations and conclusion on how to improve the training of human rights in the SAPS.

This qualitative case study research endeavour is a direct result of limited research on female fraud research in South Africa. The research questions that guided this research are: What are the different pathways and lived experiences of the females incarcerated for fraud?; What are the causes, contributory factors and motives of the sample-specific female fraud offenders? and Can the criminal behaviour of each female offender be explained by means of criminological theories?. Seven adult female offenders voluntarily participated in this research project and their unique narratives, pathways and lived experiences were depicted and analysed to determine the causes, contributory factors and motives related to their offending behaviour. Criminological theories and the gendered theory of female offending were applied to explain their fraud-related behaviours. The findings suggest that overlapping causes (i.e. lack of self-control), contributory factors (i.e. rationalisation of behaviour) and motives (i.e. greed) played a prominent role in the female offenders’ fraud-related behaviours.

The researcher conducted an in-depth analysis of the criminality and criminal behaviour of selected sample-specific, African, adult male Mozambican and Zimbabwean foreign offenders, incarcerated at South Africa’s Losperfontein Correctional Centre. The causes, contributory factors and motives of their crimes were determined, and their criminogenic needs and risks identified. The needs and risks of foreign offenders were found to differ from those of South African offenders significantly. To address criminogenic needs and risks of foreign offenders, and to enhance their self-development and rehabilitation, recommendations for each individual case study are made.

Higher education institutions (HEIs) are now adopting the management styles that are being practised in profit-making organisations in the private sector. The top management in HEIs embark on monitoring performance of all categories of their employees, including academic staff. This has become necessary in order to encourage and enhance quality in teaching and also to achieve increased research productivity. This means that the same principles involved in managing the private sector, such as introducing performance management systems, are now applied in the public sector. Empirical evidence from previous studies suggests that the introduction and implementation of performance management systems in academic institutions often result in tension between academic employees and management, thereby heightening the age-long debate on the necessity for academic freedom in institutions of higher learning globally. The present study evaluated the perception of academic staff members regarding the implementation of a performance management system in an open distance learning institution in South Africa. The study adopted a survey research design, using a quantitative research approach. The total sample of the study comprised of 492 academic staff members of the institution. A structured self-administered web-based questionnaire that was tested for high reliability and validity content was used to collect primary data from the respondents. The data were analysed using both descriptive and inferential (one-way sample t-test) statistics. The research findings indicate that academic staff members at the institution are satisfied with the performance management system implemented by management. The study further found that academics do not consider the resultant performance bonus from the implementation of the performance management system sufficiently motivating and that it should therefore be reviewed by management. Overall, the outcome of the present study was to a large extent inconsistent with the empirical evidence presented by previous studies.

This study investigated issues of gender discrimination in the Cacadu district of the Eastern Cape and the possible role that Community Learning Centres could play in mitigating gender disparities in this particular district. The aim of the study was to recommend ways in which Community Learning Centres could assist people in mitigating gender disparities in the Cacadu district of the Eastern Cape. The study examined scholarly and professional publications, both theoretical and empirical, that support or challenge the proposed focal area. The study was underpinned by post-colonial feminism. Contrary to Western feminism, post-colonial feminism is primarily concerned with the representation of women in once colonized countries.The paradigm deemed to be the most appropriate in undergirding this study was a post-colonial indigenous paradigm which can be seen as context based and inclusive of all knowledge systems. The research approach was qualitative and the research design adopted for the study was phenomenological. Two Community Learning Centres (Xola and Zodwa) located in a rural and an urban area respectively in the Cacadu district of the Eastern Cape were selected by purposive sampling. Data gathering was conducted through semi-structured interviews and focus group discussions. Three adult educators volunteered to participate in individual interviews and twenty-four adult learners volunteered to participate in focus group discussions. Findings indicated that Community Learning Centres in their attempt to promote equity and redress do not help people mitigate gender disparities in their daily lives in the Cacadu district of the Eastern Cape. Based on the findings, it was found that gender disparities emanate not only in the home, but also in Community Learning Centres in the Cacadu district of the Eastern Cape. Finally, strategies were identified in the form of educational practices, processes and developments to assist people to mitigate gender disparities in their daily lives in the Cacadu district of the Eastern Cape. Such educational strategies should be characterised by fairness, equality and the values embedded in social justice with reference to the role of women in society.

The role of school management on the qualitative provision of inclusive education in designated full-service schools in North West Province is vital for optimum accommodation of learner diversity in ordinary mainstream primary schools. The school management of designated primary schools are assigned with the task of ensuring that inclusive education policy and practices are adopted and implemented by all stakeholders as prescribed by policy in their respective schools. This dissertation sought to investigate at a micro perspective the impact of school managers as individual employees and their response to the new inclusive education system in their schools. The study also identifies factors that facilitate or hinder their role. A qualitative approach and the case study design were applied in this study. Five schools were purposefully selected and total of 40 participants were involved. The participants include five principals, five deputy principals, ten heads of departments (HoDs) and 20 members of the SBST. Data were collected by conducting individual interviews for principals and deputy principals and focus group interviews for HoDs and members of SBST. The findings reveal that the school managers, SBST and stakeholders like parents do not yet understand the reasons behind expansion of inclusive education in their schools. The study reveals that the school management are still finding it difficult to fulfil their role and responsibility. This is owing to numerous challenges emanating from inadequate support from district based support teams or departmental officials, pedagogical barriers, systemic barriers, insufficient staffing, lack of human resource development through trainings, infrastructure challenges, resistance to policy such as SIAS and lack of knowledge of assistive devices. Subsequent to that, literature review reveals that studies on implementing inclusive education in schools focus largely on the plight and role of teachers and that little attention was paid to the role of school management on the provision of inclusive education. To enhance the impact of school management on provision of inclusive education and to address prohibiting factors noted form the findings, the study recommends to the department an intensive and structured capacity building programmes for departmental officials, school management, curriculum specialists, senior managers with specific reference to inclusive teaching strategies, admission within protocol of SIAS policy, and curriculum differentiation using assistive devices. A proposed model to improve the impact of school management on the provision of inclusive education with specific reference to administer admission within SIAS protocol is presented.

The transformation of the Department of Correctional Services into an institution of rehabilitation and the promotion of corrections as a societal responsibility brought a new dimension to the release policy of South Africa. A new Correctional Services Act 111 of 1998 came into effect and the Department of Correctional Services published a White Paper on Corrections during 2005. The idealistic correctional goal of protecting the community while rehabilitating the offender has served as a reason for conducting research into the parole process from a South African perspective. The qualitative aim of the study is to explore parole as a phenomenon and to describe the process involved in successfully reintegrating an offender into the community. The significant role that Correctional Supervision and Parole Boards play in the parole process and the emphasis they place on community safety, the interest of the victim and the rehabilitation and control of offenders as part of their mission statement are highlighted in the study.

Assessment is considered as integral to the teaching and learning process of Mathematics where various types of assessment are used to develop feedback for several purposes. Research has highlighted the challenge of the dominance of summative assessment in classroom assessment practices. In recent years, world countries have been acknowledging the use of assessment for learning (AfL) to enhance the learning process and thus improve learner performance. This research explored how Mathematics teachers applied AfL in their classrooms. A theoretical framework to support AfL was presented through an overview of constructivism theory, social justice theory, connectivism theory, TPACK theory and Bloom’s Revised Taxonomy. A qualitative approach and a case study design were applied involving nine Mathematics teachers from nine primary schools. Data, collected through semi-structured interviews, non-participant observation and document analysis, were thematically analysed. The findings show a positive understanding of what AfL is and its importance to the teaching and learning of Mathematics. However, the application of AfL was found to be inconsistent with its purpose of creating an environment conducive to develop feedback that supports the learning process. Challenges that inhibit its application were found to outweigh successes experienced by teachers. Lack of theoretical understanding of the use of AfL, overcrowding, the language of learning and teaching and lack of resources emerged as some of the major challenges. Teachers pleaded for more in-service training opportunities to assist them with managing assessment for learning practices in Mathematics.

Data is deur halfgestruktureerde onderhoude, waarneming sonder deelname en dokumentontledings versamel en tematies geanaliseer. Daar is bevind dat die onderwysers geweet het wat AvL is en die belang daarvan in die onderrig en leer van wiskunde besef het. Die toepassing het egter nie met die oogmerk van AvL gestrook nie. Die oogmerk is om ʼn omgewing tot stand te bring wat assessering bevorder om leer te ondersteun. Die toepassingsprobleme van AvL oorskadu die welslae wat daarmee behaal word. ʼn Gebrekkige teoretiese begrip van hoe AvL gebruik word, oorvol klaskamers, die taal van onderrig en leer, en ʼn gebrek aan hulpbronne is van die grootste uitdagings. Onderwysers bepleit indiensopleiding sodat hulle die assessering van leerpraktyke in wiskunde beter kan bestuur.
