This cross-cultural study used the "Attitudes Toward Rape Victims Survey" (ARVS), designed by Ward (1984), to examine the attitudes of college students in New Zealand and the United States. The instrument (ARVS) is the first of its kind to test for victim blame, and the first to be limited to the assessment of attitudes toward the rape victim specifically. Subjects were 205 students from the University of Otago, Dunedin, New Zealand, and 508 students from the University of Arizona, Tucson. The survey responses were analyzed to determine cultural differences in attitudes, according to gender and age. Findings would suggest that the United States students were more sympathetic toward the rape victim, less likely to believe traditional rape myths, and more ready to assign male responsibility for the assault than were New Zealand students. New Zealand women appeared less aware of the implications of sexual assault than both United States men and women, and New Zealand men. New Zealand men demonstrated greater awareness than United States men. Older students in both countries tended to be more conservative in their responses than were the younger students. Although there was a significant cultural difference according to age and gender, scores were consistently low for each sample, indicating a general acceptance of traditional rape myths and a continuing tendency to assign to women the responsibility for sexual assault. Several conclusions were drawn from the data analysis. There is a significant cultural difference in attitudes toward the female victim of rape, between New Zealand and United States college students, according to age and gender. However, both cultures retain a strong belief in traditional rape myths. Responses to the ARVS seem to support the views of current theorists: that attitudes toward rape and incidence of rape are culturally predisposed by factors such as domination and aggression in men, passivity and submission in women, fear of the "feminine," and stereotypic sex roles. It is recommended that more research be undertaken on cross-cultural attitudes toward rape victims.

This paper will explore how portrayals of male violence against female characters in film and television have affected the way in which women navigate through society. Images of exploitation, degradation, and violence towards females are constantly presented in television and film, creating an over saturation in the media market and fostering a sense of normalcy the extremely problematic issue of violence. Often, these images are internalized by women to the extent that their view the men around them becomes as distorted as the men who view them as nothing more than sex object. Men become their source of fear and what was carried out on television becomes an accepted possibility and expectation in reality, regardless of whether these men actually pose of threat. Through examining television shows and news broadcasts, the paper reveals how media serves to perpetuate traditional notions of gender, power, and assault created in American society and offers solutions to rework the traditional systems or thought.

The purpose of this study was to investigate the effects of NLP Reframing as a means of decreasing sexual response when aggression is aroused by a female with incarcerated rape offenders. The process of reframing involves a redirection of the positive intentions underlying rape behavior by associating new acceptable and nonviolent behaviors to the same intention. The paradoxical nature of this method allows for measurement of newly acquired behavior, a decrease in the maladaptive behavior (rape) or a decrease in some representation of the maladaptive behavior. In this study, a representation was created by arousing the aggression level of the participants toward a female followed by measurement of sexual response as measured by the Sexual Imagery Levels 1 and 3 of the Rorschach. A post-test only control group design was utilized. The sample for this study included 26 rape offenders incarcerated at the Arizona Correctional Training Center in Tucson. Participants ranged from 18 to 28 years of age and had a mean age of 23.33 years; had a mean I.Q. of 112.71 on the Culture Fair Intelligence Test and included 13 Anglos, 7 Mexican Americans, 4 Blacks, and 2 Native Americans. Data analysis for hypotheses testing involved ANCOVA with the total number of responses on the Rorschach being the covariate. Significant results beyond the .05 level of confidence were obtained on one of the two directional hypotheses (Sexual Imagery Level 3), suggesting that reframing rape behavior using the NLP method with incarcerated rape offenders may be effective in decreasing sexual response at a more symbolic level.

Domestic Minor Sex Trafficking (DMST) is a severe form of child sexual exploitation. Thus far, DMST studies have been qualitative or relied on secondary data. There has been no quantitative attempt to directly identify victims in a methodical way in order to determine the prevalence of DMST at a local level or the nature and strengths of its correlates. The present study used a three-tiered screening process to identify victims of DMST in a juvenile detention center. All youth taken into custody over a three and a half month period (N = 738) received a short assessment to identify those most at risk and in need of additional screening. During the study, six youth were identified as DMST victims and statistically significant differences were found between youth referred for additional screening (N = 47) and youth who were not. The results suggest that detention and probation staff identified the presence of DMST risk factors in youth screen interviews and were making referral decisions based on the presence of those risk factors. Practical implications of the findings are discussed along with suggestions for future research.

Sexual trauma within the military is a widespread issue, and rape myth acceptance has been shown to contribute to its prevalence. Given that the military culture has been shown to lend itself to hypermasculinity and traditional gender role adherence, both of which facilitate aggression toward women, this effect warrants investigation within a military sample. The present study replicated and expanded upon Aosved and Long's (2006) study examining 85 veteran and active duty military members' responses on the Illinois Rape Myth Acceptance Scale, Attitudes Toward Women Scale (short form), Neosexism Scale, Male Role Norms Inventory (short form), Modern and Old Fashioned Racism Scale, Modern Homophobia Scale, a modified version of the Economic Belief Scale, Fraboni Scale of Ageism, Religious Intolerance Scale, and the Marlowe–Crowne Social Desirability Scale (short form). Findings provide support for the co-occurrence of rape myth acceptance with intolerant attitudes, including sexism, hypermasculine gender role ideology, racism, sexual prejudice, classism, ageism, and religious intolerance, both individually and collectively. These results provide insight into the functioning of intolerant attitudes within a military sample, and provide important insight for future research addressing the association between rape myth acceptance and rape proclivity and the perpetration of military sexual assault.

Rape culture remains a major issue on college campuses today in the United States. Significant research has been conducted on rape on college campuses in the United States, examining factors such as alcohol, cost of a date, relationship between the victim and perpetrator, apparel of the victim, sexual history of the victim, etc. However, no studies have yet investigated factors that impact rape culture in France. This study will investigate factors that impact both blame attribution and perceptions of sexual assault in the United States and in France. Participants (N=249) were shown a short vignette involving a rape scenario, and then asked questions about who was at fault for the rape, as well as their perception of the situation. Results showed that alcohol use, the cost of a date, and participant country of residence all impacted how participants attributed blame, as well as impacted their overall perception of the scenario. More specifically, participants were less likely to classify a scenario as “rape” when alcohol was involved, when the cost of a date was high, and when the participant was French. These results indicate that we need to rethink the way society approaches issues of sexual assault, in the United States and in France.

Recent policies in England and Wales and the United States have recognised for the first time enforcement mechanisms for victims of crime under the Crime Victims’ Rights Act (CVRA) in the United States as well the Code of Practice for Victims of Crime in England and Wales (the Code). Although very different from one another, these policies ostensibly aimed to provide a stronger commitment to victims’ rights, by recognising an accessible, timely and impartial process that recognises accountability and provides individual remedies in cases of breaches. This thesis engages in a careful in-depth analysis of these mechanisms and their implementation based on elite qualitative interviews, case law analysis and a multidisciplinary examination of the relevant literature. It argues that on the whole, these mechanisms have presented a number of limitations, and thus in many respects cannot and have not delivered accessible, and timely means to respond to victims’ rights breaches. Most importantly, it demonstrates that for certain types of breaches and in certain contextual settings, these mechanisms have recognised only limited or no redress at all for breaches. This research takes the available victims’ literature further by arguing that many of these promises have been closer to rhetoric than reality and providing a more nuanced portrait of the substantial difficulties and limitations that relate to these enforcement mechanisms. In effect, these limitations can be understood in light of the nature and structural components of these selected mechanisms, as well as the ways they have been implemented by the main actors involved in these processes and the different contexts under which the different types of breaches take place. Finally, despite their limitations, when compared to one another, each mechanism can be considered a better option for access, timeliness and redress – depending on context and the type of breach. Following from this analysis, a complementary approach is developed which can facilitate and increase opportunity for redress for a wider range of situations. It is important to bear in mind however the limits of the complementary approach; namely, that it only includes elements inspired from the two mechanisms examined in this thesis and that there are several limitations that relate to transplants and policy transfers.

Abused women are frequent users of health care services. Yet, battered women often do not identify the health care delivery system as a resource. The present study surveyed 155 female associate and baccalaureate degree nursing students from three mid-Atlantic universities in order to examine how selected personal and relationship variables affected their attitudes toward battered women. It was hypothesized that those students who had an early exposure to family violence combined with high levels of egalitarianism and perceived control over life events would be more sympathetic toward battered women than those who did not. Instruments used to measure the chosen variables included the Sex-Role Egalitarianism Scale, the Conflict Tactics Scale, the Family Violence Scale, the Perceived Control Scale, and the Inventory of Beliefs about Wife-Beating. Data were collected via anonymous self-report questionnaires and analyzed through the use of correlation and hierarchical regression procedures. Nursing students with more egalitarian sex role beliefs and perception of control over their life events were more sympathetic to battered wives than those students with more traditional sex role attitudes and less perceived control over their life. Sex role egalitarianism was found to be the best predictor of attitudes toward victims of domestic violence. Contrary to expectations, there appeared to be little relationship between the level of violence experienced by students in their families of origin or in their current relationships and sympathy for battered wives. Findings from this study will add to the current nursing knowledge base regarding attitudes of one group of health care professionals toward victims of domestic violence by exploring those attitudes and by identifying which of the chosen variables was most predictive of those attitudes. Implications for nursing education include an examination of the impact of gender issues on personal and professional behavior as well as the importance of empowering nursing students through the use of a competency based practice model.

In 1987, statistics transformed rape from a rare and personal concern into an epidemic in popular consciousness. Mary Koss and colleagues conducted victimization surveys with thousands of college women, 1 in 4 of whom reported completed or attempted rape. This finding received tremendous attention in the 1980s, and continues to influence activists and state officials. Notwithstanding the importance of this and other scientific facts, scholars have rarely explored the role of scientists in shaping perceptions of and responses to sexual violence. This project addresses that gap in the literature, via the following questions: (1) how have scientists conceptualized sexual violence among adults; and (2) what social mechanisms enable, constrain, and otherwise influence scientific research on sexual violence? Drawing on insights from feminist science studies, I approach sexual violence as an intra-active phenomenon, and regard objects of study (sexual violence) as inseparable from agencies of observation (research instruments, researchers). Data came from three sources: content analysis of journal abstracts (N=1,313), in-depth assessment of texts in different subfields (N=84), and interviews with researchers (N=31). Ultimately, I argue that sexual violence research has been dominated by psychological inquiries, as well as gendered assumptions regarding who is most capable of perpetrating and experiencing rape. Scientists have produced a tremendous body of knowledge regarding the individual-level causes, individual-level outcomes, and prevalence of men’s sexual aggression toward women. Systemic forces and sexual violence that deviates from this particular gendered pattern remain underexamined. I further argue that scientific research on sexual violence is shaped by a range of social mechanisms that are particular to fields associated with questions of social morality and social movements including feminism(s).

This thesis is an ethnographic analysis of a Continuing Care Retirement Community (CCRC) in the American Midwest. I examine salient aspects of American culture, and how persons in the American Midwest understand relationships and themselves in the context of eldercare, and particularly, how issues of personhood and kinship are conceptualised in a long-term care facility. Rather than focusing exclusively on just the labour of caregivers, or how the residents in the CCRC receive care, my study is grounded in the interaction and relations that obtain during specific regimes of caregiving. Because the exigencies of ageing are met with certain exigencies of care, this study touches upon three dominant themes that make sense of the tensions that emerge when principles and practices do not square up. The first theme deals with how ageing and care are constituted, and made relational to one other. Secondly, I demonstrate that in the CCRC where I conducted fieldwork, ageing is constructed as a process and institutionalised, resulting in a distinctive way in which space and time are dealt with and unravelled from their inextricability. The resulting consequences affect not just the older residents and the CCRC staff, but also impacts how caregiving takes on specific forms and meanings. Thirdly, I investigate how formal (professional) caregivers and care receivers produce a type of social relation, which cannot be understood alone by conventional studies of kinship and economic relations. Ultimately, this thesis sets the frame for future debate on the ontological commitments involved in eldercare, and how the segregation of care and of the elderly in society relate to wider social norms regarding ageing and marginality.

This dissertation focuses on Latin American survivors of political violence and the staff members involved with one of the few torture treatment centers in the US. Relying primarily on life histories and semi-structured interviews, my research focuses on the social construction of suffering (Kleinman et al. 1997) created by the staff and participants over the course of three different eras of the center. While the clients of this center lead lives that are tremendously impacted by the violent histories of their home countries, they do so while living in a country where this history is almost completely invisible. As exiles, they are removed from the arena of collective memory reflected in debates in postwar transitional Latin American societies about the meaning of the past, the reasons for their suffering, and the need for historical truth. Consequently, I examine the torture treatment center as one arena where this history and the suffering of survivors is acknowledged. As such, I argue that the staff serves as a critical social network--indeed, perhaps the only one--that influences the individual interpretations, narratives, and actions of survivors about the meaning of trauma, the importance of the past, and how one best heals from violence. First, I illustrate how the biographies of staff shape their involvement with the center and the meaning the center has for them, which, in turn, leads to both the promise and predicaments of their work for social change. Second, this research illustrates the diverse forms that trauma can take and argues for a connection among structural, transitional, and political violence. Third, I explore how the meaning attributed to trauma and the past shapes notions held by the center's staff and participants regarding how one best heals from trauma. Throughout the exploration of these themes, my work identifies the presence of certain discourses and the absence of others--the frictions and fragments occurring in engagements between social service networks and those they serve (Tsing 2005)--that reflect the possibilities for and limitations of individual healing and collective change and that make this center a "fragile community."

During the antebellum period of U.S. slavery (1830-1861), many people claimed ownership of the enslaved woman's body, both legally and figuratively. The assumption that they were merely property, however, belies the unstable, shifting truths about bodily ownership. This thesis inquires into the gendered specifics and ambiguities of the law, the body, and women under slavery. By examining the particular bodily regulation and exploitation of enslaved women, especially around their reproductive labor, I suggest that new operations of oppression and also of resistance come into focus. The legal structure recognized enslaved women in the interest of owners, and this limitation was defining, meaning that justice flowed in one direction. If married white women were "civilly dead," as famously evoked by the Declaration of Sentiments (1848) then enslaved women were civilly non-existent. The law controlled, but did not protect slaves, and a number of opponents to slavery denounced this contradictory scenario during the antebellum era (and before). Literally, enslaved women were claimed by their masters, purchased and sold as chattel. Physically, they were claimed by those men (both white and black) who sought to have power over them. Symbolically, they were claimed by anti-slavers and pro-slavers alike when it suited their purposes, often in the domains of news and literature, for the sake of advancing their ideas, a rich record of which fills court cases, newsprint, and propaganda touching the slavery issue before the civil war. Due to the numerous ways that enslaved women's bodies have been claimed, owned, or circulated in markets, it may have been considered implicit to many that others owned their bodies. I believe that this is an oversimplified historical supposition that needs to be re-theorized. Indeed, enslaved women lived in a time when they were often led to believe that their bodies were not truly their own, and yet, many of them resisted their particular forms of oppression by claiming ownership of their bodies and those of their children; sometimes using rather extreme methods to keep from contributing to their oppression. In other words, slave owners' monopoly of the legal, economic, and logistical meanings of ownership of slaves had to be constantly reaffirmed and negotiated. This thesis asks: who owned the enslaved woman's body? Sarah Winnemucca, a Paiute Indian born around the year 1844, crossed cultural boundaries and became an influential voice within both white and Indian societies. This thesis employs a settler colonial framework that places the sexuality and rape of native women at the center of colonial relations in the settlement of the Americas. Viewed through this lens I perform an in-depth analysis of Winnemucca's gendered critique of colonialism that focused on sexual violence. Rather than the unstable, mixed messages of native resistance and assimilation emphasized by earlier scholars, I argue that Winnemucca purposefully employed a strategy of oppositional conformity to publicize an unwavering political message that championed Paiute sovereignty, exposed white cruelty, and re-wrote the dominant gendered, racial, political and cultural constructs that bound Native American women's identity. The introduction begins with a brief history of Winnemucca's life and accomplishments. In the introduction I also address the authenticity of Winnemucca's published narrative, Life Among the Piutes: Their Wrongs and Claims (1883) and identify the constraints of the settler colonial lens through which I view Winnemucca's public voice. In chapter one I argue that Winnemucca's narrative employs the gendered moral rhetoric of the colonizer to cultivate white audience receptiveness, while simultaneously criticizing whites for their brutality against Indians. In chapter two I assert that Winnemucca employed multiple political strategies to cut away at Euro-American settlers' moral justifications for colonialism, and that she articulated a unique vision of Paiute citizenship that rejected complete Indian assimilation. In chapter three I highlight the ways in which Winnemucca used her public voice to articulate rape and the sexuality of Indian women as a foundational part of colonialism hidden from view in the media coverage of the Indian wars of the late nineteenth century. Unlike her biographers, who mostly overlook Winnemucca's public challenge to the negative sexual stereotypes that plagued Indian women during Winnemucca's lifetime, I argue that Indian women's sexuality was a foundational theme in Winnemucca's public discourse. Winnemucca grasped and resisted the gendered dimensions of colonialism and her consistent focus on this theme echoed in her lived reality. Finally, I conclude that ultimately personal accusations as well as her inability to escape the heathen identity forced on Indians by Christian reformers thwarted the success of Winnemucca's political message.

A quantitative study that examines American Muslim women's level of exposure to domestic violence, resources available to them, and the effect of domestic violence on their psychological well-being. Data was collected from 128 Muslim women from the Islamic Center of Riverside in Southern California. The key finding of the study was a significant positive relationship between depression and the use of verbal aggression. In addition, a positive relationship was found to exist between anxiety, depression and the use of violence.

This study examined the distinct effects of partner violence and psychological abuse on women's mental health over time. Latent growth modeling was used to examine stability and change over time, evaluating the course and consequences of each form of abuse. The size of women's social support network was examined as a mediator. The sample consisted of 835 African American, Euro-American, and Mexican American low-income women. Participants who completed Waves 1, 2, 3, and 5 were included in the study (n = 585). In general, partner violence decreased over time for all groups, while psychological abuse decreased over time for only Euro-American women. Whereas initial and prolonged exposure to psychological abuse was related to and directly impacted women's mental health, partner violence was only related to initial levels of mental health. Surprisingly, social support was only related to initial violence and distress and had no impact on the rate of change over time. These results have important implications for researchers and health care professionals. First, differences in the pattern of results were found for each ethnic group, reaffirming the notion that counselors and researchers must be sensitive to multicultural concerns in both assessment and intervention. For example, psychological abuse had a greater impact on the mental health of African American and Mexican American women than it did for Euro-American women, suggesting a shift in focus depending on the ethnicity of the client may be warranted. Second, this longitudinal study highlights the importance of future research to considerer individual differences in treating and studying victimized women. Understanding factors that contribute to individual trajectories will help counselors gain insight into the problem and in devising plans to prevent or reduce the occurrence and negative health impact of partner abuse.

To illustrate the intersection of ethical language and ethical frameworks within technical communication, this dissertation analyzes the history and documentation of the human radiation experiments of the 1940s through the 1970s. Research propositions included clarifying the link between medical documentation and technical communication by reviewing the literature that links the two disciplines from the ancient period to the present; establishing an appropriate historiography for the human radiation experiments by providing a context of the military, political, medical, and rhetorical milieu of the 1940s to the 1970s; closely examining and analyzing actual human radiation experiment documentation, including proposals, letters, memos, and consent forms, looking for established rhetorical constructions that indicate a document adheres to or diverts from specific ethical frameworks; and suggesting the importance of the human radiation documents for studying ethics in technical communication. Close rhetorical analysis of the documents included with this project reveals consistent patterns of metadiscourse, passive and nominal writing styles, and other rhetorical constructions, including negative language, redundancies, hedges, and intensifiers, that could lead a reader to misunderstand the writer's original ethical purpose. Ultimately this project finds that technical communicators cannot classify language itself as ethical or unethical; the language is simply the framework with which the experimenters construct their arguments and communicate their work. Technical communicators can, however, consider the ethical nature of behavior according to specific ethical frameworks and determine whether language contributes to the behavior.

This dissertation analyzes a typically overlooked novel within the corpus of post-9/11 fiction studies, Jess Walter’s The Zero (2006), and puts forward some hypotheses for this under-examination. It suggests that the debates that arose in the United States in the wake of 9/11—regarding the status of fiction in the face of tragedy, the theses about the demise of irony and satire, the high expectations put on canonical authors to give meaning to the event, and standardized interpretations of what a “good 9/11 novel” should be—all contributed to construct readings of The Zero that fell within the somewhat prescriptive approaches established by the first wave of post-9/11 fiction studies, and thus overlooked the subversive potential of Walter's novel. While recent academic output is starting to explore The Zero in innovative ways, early reception of the novel failed to examine it conceptually and formally, favoring as it did a trauma studies approach that resulted in a bland analysis of the discursive exploration that the novel carries out. On the other hand, the novel’s use of satirical humor has been mostly ignored, and this is partly explained by the currency of outdated theoretical conceptions of what constitutes a satirical novel. Therefore, this dissertation carries out a revision of the theoretical corpus on narrative satire and proposes its renewal through the theories of carnivalization of Mikhail Bakhtin. Approaching the novel through the notions of satirical carnival, dialogism, and intertextuality reveals how satire is a very effective way of exploring and questioning the discursive apparatus that mobilized in the United States after the attacks. Such is the object of the novel, the interaction with, the representation and the eventual subversion of a nationalist discourse that was underpinned by its appeal to foundational myths and cultural themes and that was highly accepted by the general population, which allowed the Bush administration to respond to the attacks in military terms and to suspend certain rights and freedoms on the domestic front, under the premise of promoting security. This dissertation seeks to demonstrate how satire understood this way is especially suited for constructing a dialogical, polyphonic and inquisitive narrative that not only questions but also dialogues with the American nation after 9/11.
La presente tesis explora una novela poco estudiada del corpus de ficción post-11-S, The Zero (2006), de Jess Walter, y propone algunas hipótesis que puedan explicar esta falta de atención. The public focus on domestic violence has been one of the most successful campaigns of the modern women's movement. This success was achieved in part through the creation of strategic alliances among agencies and organizations responding to partner violence. One of the most contested of these alliances involved partnering with the criminal justice system. While representing an advance in holding police accountable in protecting all citizens (Coker, 2006), this alliance has had problematic consequences, particularly as it has extended state power into the lives of women of color (e.g. Richie, 2005). This problem is exacerbated by new collaborations between law enforcement and Immigration and Customs Enforcement (ICE). Federal mandates like the Secure Communities program bring together local law enforcement and ICE throughout the United States, to increase deportation rates (Immigration and Customs Enforcement, 2009). As a result, many recommendations by domestic violence advocates to survivors now potentially include the presence of ICE in that referral. This dissertation explores how domestic violence advocates within the tri-county area of Portland, Oregon are responding to law enforcement-ICE partnerships. Advocates remain understudied in the domestic violence literature, in spite of the complexity of their roles. This dissertation fills this research gap in examining the processes advocates employ in responding to dilemmas faced by marginalized survivors. A total of twenty-five advocates from three separate agencies participated in the study, which centered on focus groups carried out in the agency settings. The dissertation pursues three research questions: 1) How do advocates work through a key dilemma that has emerged in their practice? 2) What are the discursive strategies enlisted by advocates in addressing a dilemma at the border of domestic violence and immigration politics? 3) What is the relationship between each group's proximity to working with undocumented survivors and their decision-making process? A case study methodology was used to evaluate proximity to work with undocumented survivors and the organizations' general orientation to domestic violence work. Transcripts of the focus groups were analyzed using a discursive method centered on identifying how the groups worked through a set of dilemmas presented in the focus groups, which involved a crisis call scenario involving an undocumented woman and an agency practice common to many domestic violence service providers. In the analysis of discursive strategies of the groups, a key finding centered on the groups' use of a decision-tree heuristic to work through dilemmas of practice presented in the two scenarios. This discursive strategy facilitated the process of group decision-making at points where the actions required were clear and concrete. However, as more complexity, ambiguity or ambivalence were introduced, the limitations of the decision-tree strategy become more apparent. Findings related to the agency's proximity to undocumented workers suggest that this affinity was less important than was the agency's working relationship to the Criminal Justice System (CJS). Closeness to the CJS was associated with reliance on a discourse that places the police at the center of services for all survivors of domestic violence, regardless of documentation status, and a heightened focus on the risk of lethality to rationalize the risks associated with referrals involving law enforcement-ICE collaborations.

This thesis examines news representations of Canadian, American and Australian military personnel involved in military 'sex scandals'. I explore what the representations of military personnel involved in well-publicized sex scandals reveal about scripts of soldiering and militarized masculinities. Despite a history of systemic violence in the military, I ask how and why the systemic nature of militarized masculinities are able to remain invisible, driving representations to focus on the ‘bad’ behaviour of individuals? By engaging with feminist scholarship in International Relations, I present the longstanding culture of misogyny, racism, homophobia and ableism in the Canadian, American and Australian militaries, focusing on the ways in which militarized masculinities are guided by these violent structures, and fundamental to the military's creation of soldiers. My dissertation uses the tools of critical discourse analysis to unpack the ways blame is individualised in cases of sexual and racist violence involving military personnel, while the military’s ableism, rape culture and imperial militarized masculinities are commonly naturalized or celebrated without regard for how they are fundamentally violent. My thesis presents an intersectional feminist project that intervenes in emerging questions in the field of transnational disability studies, tracing how militarism, hegemonic militarized masculinities and imperial soldiering (re)produce categories of ability and disability.

The present study aimed to examine factors influencing attitudes towards rape victims among a sample of Latinos (N=312) and Latinas (N=427). The predictive role of gender role attitudes was the overarching factor of interest. The study utilized the constructs of machismo/caballerismo and marianismo in efforts to capture the most culturally-relevant understanding and manifestation of gender role attitudes for the population of interest. Machismo/caballerismo and marianismo are largely ignored in empirical research but quite prevalent in Latino theoretical literature. The study also aimed to investigate the applicability of acculturation, a variable commonly included in Latino research but overlooked in rape research. The primary hypotheses tested in the study were whether the gender role attitudes of men and women would predict negative attitudes towards rape victims. It was proposed that higher levels of traditional gender role attitudes (i.e., machismo for males and marianismo for females) would predict higher levels of negative attitudes towards rape victims. Conversely, higher levels of caballerismo (i.e., less traditional male gender role attitudes) would predict lower levels of negative attitudes towards rape victims. Analyses revealed that gender role attitudes did not predict attitudes towards rape victims for either females or males in the sample. Among the female sample, social desirability was the only variable that significantly predicted attitudes towards rape victims. Among the male sample, socioeconomic status was found to be the only significant predictor of attitudes towards rape victims. Secondary hypotheses posited that degree of acculturation would affect the strength of the relationship between gender role attitudes and attitudes towards rape victims. This proposed moderating relationship was not tested as there was no significant relationship between the gender role and attitudes towards rape victims variables.

During the second-wave feminist movement, anti-rape activists sought to heighten cultural awareness about the pervasiveness of rape and instigate legal reforms that would increase the number of prosecutions and convictions of rapists. Despite resulting legal reforms that expanded the definition of "rape" and that eliminated resistance requirements and marital exemptions, reform efforts have been a failure in terms of increased reporting and achieving heightened response from the criminal justice system. I attribute the ineffectiveness of rape law reforms partially to the way in which the concept of rape was framed during the anti-rape movement. In particular, I argue that broadening the concept, detaching it from its sexual features, and paralleling the phenomenon to other violations such as property and assault have the effect of obscuring the unique indignity of rape. This, in turn, has inhibited the full legal recognition of the victim and her injury. I explore possibilities for an alternative conceptualization of rape that instead acknowledges and accommodates the distinctive features of the phenomenon in terms of sexuality, embodied differences of gender and race, subjective states of submission, and the encompassing nature of the injury as a violation of the integrity of self in both bodily and psychological dimensions. In order to enhance the recognition of the victim and her injury, I suggest that: a) legal discourse should be opened up to better account for concrete circumstances and embodied differences (as opposed to the reliance on abstract rights and principles and the generalized subject); b) victims should be allowed to provide an uninterrupted narrative of their rape experience and its consequences; and, c) "consent" as the predominant guiding legal standard should be reevaluated and replaced with an assessment of how force was subjectively experienced.

The decriminalization of consensual sexual behavior between adolescents has been under discussion and debate for a long time, but the controversy still existed. Reviewing the literature on sexual behavior between adolescents ,we can find that researchers in specific fields are concerned about that topic with specialized aspects. For examples, legal researchers focus on the protective legal interest of Article 227 in the Criminal Code and its applications; Social workers and school teachers target on parent-child conflicts, sexual education and counseling for adolescents. However, few studies have been conducted to integrate research results from various fields or comparative analysis from the perspective of criminal policy. Reviewing the literature on law, sociology, psychology, and feminism to illustrate the image of children, adolescents, and young girls as the fundamental knowledge, this study introduced the protection network established by the existing legislation, and also showed the practical dilemmas faced by the education system, social administration, and juvenile justice. In order to find a sound solution, this study reflects Taiwan’s legal issues on adolescent sexual behavior from learning cases of the operational experience of statutory rape law in the United States.First of all, we must be alerted to the impact of chastity aspects on the law, avoiding the law becoming a tool of sexual ethics. Furthermore, we should recognize that criminal law has limitation and should not be over-reliant. Finally, taking the adolescents as the subjectivity and their benefits as major concerns are the core concepts of ideal criminal policy. This study suggests that Taiwan can refer to the age-gap provisions of the statutory rape law in the United States, decriminalizes the consensual sexual behavior between adolescents within a certain age gap. Besides, adolescent sexuality should not be labeled as a delinquent behavior. Adults need to hold positive attitudes towards the sexual development of adolescence, provide sound information and sex education for adolescents’ robust mental and physical development.

The history of the United States’ occupation in the Philippines requires an alternative archive that includes family stories, museums sites, and other memories to articulate the nearly inexplicable legacy of imperial trauma. My project foregrounds the intangible effects of American imperialism, traced in generational memories of Filipinos and Filipino Americans and their descendants. Addressing three key moments defining the Filipino and Filipino American experience: the Philippine-American War, World War II, and 21st century global capitalism, I look at how the under-the-surface, banal nature of imperial trauma’s legacy marks Filipino identity and creates blind spots in the Filipino imaginary. My dissertation examines sexual atrocities committed by American soldiers during the 1898-1902 Philippine-American War, revisits memories of World War II and the Japanese Occupation as represented in military museums in Fredericksburg, Texas and on Corregidor Island, Philippines, and concludes with the importance of the babaylan figure, from an ancient priestess tradition in the Philippines, for diasporic Filipinas to negotiate the contemporary challenges of everyday living. My dissertation examines the use of strategic storytelling to recover lost histories, heal from the past, and re-create the present.

This thesis examines how the EU legal order has adapted to the presence of the World Trade Organization. More specifically, it asks how the European Court of Justice has adapted its case-law on the application of international law within the EU legal order to the particular nature of the WTO system at the intersection of international law and international trade policy. Central to this question is the extent to which the Court has granted direct or indirect effect to provisions of the WTO Agreements and to decisions of the WTO Dispute Settlement Body. Despite almost 40 years of case-law, the effect of WTO law within the EU legal order remains highly relevant. This thesis argues that the ECJ‟s stance vis-à-vis WTO law increasingly inspires the ECJ‟s standard approach to deal with international law, that WTO law provides for a laboratory of more implicit techniques of dialogue between courts and that the EU‟s central focus on respect for the rule of law and fundamental rights urgently calls for a viable solution so as to reconcile the political interests of the EU in the global trading arena with the fundamental rights of private market players. Therefore, the thesis proposes four pathways in order to overcome the identified shortcomings. Particular attention is thereby devoted to the potential of certain developments introduced by the Lisbon Treaty to shed new light on sometimes completely frozen chapters in this long-standing debate.

abstract: This study uses the ontological lenses of discourse theory to conduct a critical mixed-methods analysis of state statutes related to prostitution and sex trafficking. The primary research question of the study was, "How do state laws communicate and reinforce discourses related to sex trafficking and prostitution and how do these discourses reinforce hegemony and define the role of the state?" A mixed methods approach was used to analyze prostitution and sex trafficking related annotated and Shepardized statutes from all fifty states. The analysis found that not all prostitution related discourses found in the literature were present in state statutes. Instead, statutes could be organized around five different themes: child abuse, exploitation, criminalization, place, and licensing and regulation. A deeper analysis of discourses present across and within each of these themes illustrated an inconsistent understanding of prostitution as a social problem and an inconsistent understanding of the legitimate role of the state in regulating or criminalizing prostitution. The inconsistencies in the law suggest concerns for equal protection under the law based upon a person's perceived deservingness, which often hinges on his or her race, class, gender identity, sexuality, age, ability, and nationality. Implications for the field include insights into a substantive policy area rarely studied by policy and administration scholars, a unique approach to mixed methods research, and the use of a new technique for analyzing vast quantities of unstructured data.

En Amérique du Nord, la lutte contre la traite d'êtres humains s'avère d'une grande complexité. Les États doivent développer les stratégies nécessaires pour faire face aux multiples manifestations qui accompagnent le phénomène et exigent une approche holistique, interdisciplinaire et à long terme. Les stratégies nord-américaines de prévention de la traite comportent plusieurs lacunes qui vulnérabilisent certains groupes. Tandis que les mesures déjà en place s'attaquent peu aux causes premières du phénomène, plusieurs réformes essentielles afin de diminuer la vulnérabilité de ces personnes, notamment l'assouplissement des politiques migratoires restrictives, tardent à être implantées. Parallèlement, les stratégies de protection présentent des lacunes qui augmentent les risques de revictimisation des victimes de traite d'êtres humains. D'une part, les autorités n'identifient pas adéquatement toutes les victimes. D'autre part, certaines victimes, bien qu'identifiées, se retrouvent sans protection, soit parce que celle-ci est accordée de façon conditionnelle, soit parce que les mécanismes d'assistance demeurent incomplets.
In North America, the fight against human trafficking is of the utmost complexity. In order to tackle the numerous aspects surrounding this phenomenon, States must develop strategies using a holistic, interdisciplinary and long term approach. North American trafficking prevention strategies comprise many deficiencies which cause certain groups of individuals to be more vulnerable. While the measures already in place fail to target the root causes of the phenomenon, many reforms essential to the diminution of those persons ' vulnerability, namely the alleviation of restrictive migration policies, have yet to take place. Similarly, deficiencies existing in protection strategies increase the risks of revictimisation of human trafficking victims. On the one hand, state authorities fail to adequately identify all the victims. On the other hand, some victims, although identified as such, remain without protection, either because it is granted on a conditional basis or because support mechanisms remain insufficient.

The focus of this thesis is on Advance Fee Fraud (419 scams) on how it is executed and more importantly, on how it can be prevented. The research addresses the origins of AFF, the nature and extent of this crime and how the perpetrators are able to defraud their victims. The research described, examined and analysed the crimes, the perpetrators, the victims, adjudication and the prevention strategies of this fraud. Information was gathered through literature and empirical research. A qualitative research method was used to gather information from AFF offenders who were incarcerated in South African prisons in 2005. The results of the empirical research were carefully examined, analyzed and integrated into the various chapters of this thesis. A theoretical framework was also developed in an attempt to explain this complex phenomenon. The findings and recommendations in terms of the crimes, the criminals, the victims, adjudication and prevention were also made and some suggestions for further research thereof were also cited.
