Les dispositions sur la signature électronique existent depuis plus de 20 ans désormais. Néanmoins les documents signés électroniquement ou leur pratique, continuent à susciter des hésitations auprès des professionnels du secteur juridique. Une des raisons immédiatement invoquées est la crainte, ou la persistance, d’incertitudes quant à l’authentification du signataire, oubliant au passage le fait que la signature manuscrite n’offre-elle, aucune garantie supplémentaire par rapport à celle électronique. Ces craintes ainsi que l’absence de conventions internationales sur la signature électronique (au-delà de l’union européenne) semblent cependant avoir conduit à la situation de fait où seules les signatures effectuées au moyen des certificats qualifiés sont considérés juridiquement, comme des « véritables » signatures électroniques. Nous avons ainsi, en dépit des dispositions juridiques initiales, abouti à une situation d’inflation des dispositions juridiques au profit de la technologie spécifique des certificats qualifiés alors que nombre d’autres technologies sont à même d’offrir un degré d’authentification et d’intégrité suffisantes à des situations rencontrées en pratique.

Introduction: With the increase in life expectancy in Brazil (with an older population), the number of accidents, chronic and degenerative diseases, required the current health system to develop and offer assistance focused on holistic care. Responsible discharge is a process in which users leave a point in the health care network, in this case the hospital, and are received in primary care. Objective: Conceptualize highly qualified. Methodology: An integrative research methodology was used, in which articles were searched in online databases, in order to demonstrate the impact on care and knowledge on the topic addressed. Results: The high level of communication between the multiprofessional team and between the intra- and extra-hospital environment are the biggest obstacles to the realization of qualified discharge.

The Children's Services Regulation 2004 (NSW) makes it possible for children aged between birth and two years to be without a university qualified teacher in a centre-based long day care service. However, research demonstrates important links between caregivers' formal training and the quality of early childhood education. This case study, about a rural children‟s service which successfully employs a university qualified teacher in the infant-toddler room, highlights the role of strong pedagogical beliefs, sound management strategies and a commitment to rural community capacity building as important organisational contributions to the employment of a teacher. The research has implications for leadership in the provision of high quality infant-toddler education.

This study develops hypothetical scenarios for different types of individuals with varying ages and distribution periods, while using a historical outlook to determine the proper structure of a variable universal life insurance policy. This essay claims that one can consistently maintain a sanctity of human life principle that is explicitly grounded in theology, while making a kind of quality-of-life judgment regarding withholding or discontinuing life-sustaining treatments for those with advanced illnesses. For those who embrace them, resources that are specific to the Christian tradition delineate the parameters of responsibility for people dying with advanced illness and those who care for them. Those who embrace the sanctity of human life for the theological reasons provided in this essay are under no moral obligation to continue merely to sustain life at the end of life—that is, when, in view of our best available judgment, the human being (who remains inherently valuable nonetheless) will not ever be able to exemplify other human values that contribute to human flourishing, theologically understood.

AbstractWe analyse annuitization rates by policyholders with individual deferred annuities in Korea to assess the impact of different tax policies on payout decisions between 2008 and 2011. Under the Korean tax system, two types of individual deferred annuities were sold: qualified (taxed for lump sums) and non-qualified (tax free for lump sums). Our results show that policyholders with qualified contracts are more likely to select a life annuity option than a lump-sum distribution, compared to policyholders of non-qualified contracts. This suggests that policyholders are more likely to use non-qualified contracts as savings vehicles than as longevity insurance.

Currently, a significant part of highly qualified athletes are students of higher educational institutions at the same time, which manifests itself not only in an ultra-high level of physical activity, but also in significant psycho-emotional stress. Therefore, the search and introduction of modern technologies in the process of sports training, including pharmacological, hygienic, rehabilitation, etc. are continuing. An essential place among such technologies is occupied by a comprehensive methodology of nutrition-metabolic support of the training process, built on the principles of evidence-based medicine and using the latest achievements of laboratory and functional diagnostics, biochemistry and pharmacology. The purpose of the study is the formation of ideas about the necessity, validity and effectiveness of nutritive-metabolic support of the process of sports training of students of higher education institutions. Nutrition-metabolic support is part of a sporting nutritiology that possesses all the features of basic science – terms, definitions, and at the same time has great practical significance, helping to form relevant and well-grounded programs of nutrition-metabolic support of the training and competitive process of athletes, as well as to contribute to preservation the health and quality of life of athletes. This position is particularly important in student sports, where the body of an athlete is exposed to additional stressors due to the complexity of the need for a rational and effective combination of the educational and training process of highly qualified athletes. Conclusion. The applied nutritive-metabolic technologies such as methods of metabolic support of motor activity should take into account the specialization and qualifications of athletes, their gender-age characteristics and should be applied depending on the training period and the orientation of the loads. In connection with the improvement and tightening of doping control, it is extremely important that sports nutrition products and special nutritional supplements that are widely used to optimize the functional state of the athlete's body and maintain their health and quality of life do not contain substances related to the World Anti-Doping Agency Prohibited List, while ensuring a pronounced ergogenic effect

The juridical correspondent is represented in article 194: bodily harm - The new criminal code and the new criminal procedure code. A stable structure of life values is one of the components of success in sports. When defining the value of value as a category of psychology, based on data from many authors, we denote that it reveals value as a concept used in philosophy and sociology to designate objects and phenomena that are significant in the life of society, social groups and individuals. Athletes who have achieved high results are dominated by such life values as “spiritual satisfaction” (74%) and “achievements” (61%). Since “spiritual satisfaction” is a moral value, it becomes obvious that it is moral values that motivate athletes to achieve high results. According to the results of multiple regression of terminal values in the total sample of athletes (n = 118, p <0.05), we observe that the “achievement” of qualified athletes is most affected by “spiritual satisfaction”. In second place in terms of contribution to the formation of “achievement” value is “own prestige”, and in third place is “financial standing”. The value hierarchy of athletes also contains such a value as “self-development”, which indicates the athlete’s desire to work on himself, his character, the development of necessary abilities and other subjectively important characteristics of his personality.

This paper brings Lotman's semiotic space to bear on Pierce's categories of the universe's processes. Particular manifestations of cultural semiotic space within the semiosphere are qualified as inconsistent and/or incomplete, depending upon the cultural context. Inconsistency and incompleteness are of the nature of vagueness and generality respectively, that are themselves qualified in terms of overdetermination and underdetermination, the first being of the nature of the category of Firstness and the second of the nature of Thirdness. The role of Secondness is unfolded by acts of distinguishing the possibilities of Firstness into this and that, here and there, there and then, and all the distinctions that follow. Secondness, then, with respect to cultural semiotic space, gives ride to hegemony, to dominance and subservience, superordination and subordination. Commensurate with this interpretation of Secondness, the realms of overdetermination and underdetermination are labeled homogeny and heterogeny respectively. These theoretical assumptions will then be used as a modeling device providing an interpretation for various key aspects of Latin American cultures.

Capable, qualified, and working-age (18-65) autistic adults experienced an 83% unemployment rate in the United States in 2017 resulting in extreme poverty and severely decreased quality of life. Research dating from 1957 to 2016 inferred hiring agents’ beliefs were the cause. In this multiple regression study, the nature of the relationship between hiring agents’ beliefs and their selection of qualified autistic candidates was explored through Ajzen’s theory of planned behavior to determine what hiring agent’s beliefs, if any, influence the selection of qualified autistic candidates to fill open positions. I used the Hiring Agent Survey Regarding Selection of Qualified Autistic Candidates to anonymously gather data from hiring agents throughout the contiguous United States. Known values of the independent variable, the beliefs influencing hiring agents, were summed and clustered against the TPB-predicted, percentage-based, continuous-level dependent variable, which was hiring agents’ selection of qualified autistic candidates. This statistically significant regression analysis, F(45, 73) = 36.067, p < .001, adj. R2 = .930, predicted the degree to which each control, normative, and behavioral belief influenced hiring agents’ selection. Hiring agents’ desire for mandated comprehensive organizational diversity, along with their negative stereotypical associations and fear of embarrassment, signify a need for substantive policy and strategic interventions. Results of such aggressive diversity initiatives could considerably improve the nation’s socioeconomic health and substantively increase autistics’ quality of life.

The aim of this study was to analyze the health and wellness status perception in amateur half-marathon runners according to sex, age, being injured or not during the two months prior to the race, and having the support or not of qualified staff for race preparation. Six hundred and twenty-four amateur level half-marathon athletes (515 men and 107 women; 41.5 ± 10.1 years) participated in the study. One week before competing in a half-marathon, participants answered the Hooper Index and the SF-36 questionnaire. Women stated higher stress before competing in the race (p < 0.01) compared to men and the group of runners of <40 years stated greater fatigue (p < 0.05) compared to the group of >40 years. Women showed a better quality of life in physical and emotional role dimensions (p < 0.05), and the group of >40 years showed a better quality of life in the emotional role dimension (p < 0.05). The group that had suffered an injury (InjuryYes) declared greater muscle soreness (MusclSore; p < 0.01), and the group that had qualified staff (QualifStaffYes) declared a higher level of stress (p < 0.05) and fatigue (p < 0.01). The Injury No (InjuryNo) group showed a better quality of life in the physical function dimension (p < 0.01). The group that did not have qualified staff (QualifStaffNo) showed a better quality of life in the dimensions of body pain, general health, vitality, social function (p < 0.05), and mental health (p < 0.01), while the QualifStaffYes group showed better results in the dimensions of physical function and emotional role (p < 0.05). Sex, age, being injured or not during the two months prior to the race, and having the support or not of qualified staff for the race preparation can influence the health and wellness status perception.

Introduction/Objective. Assessment of the Quality-of-life questionnaires was filled out before and after surgery by patients with laryngeal cancer hospitalized in the Otolaryngology, Head and Neck Surgery Department, qualified for surgical treatment. Methods. Fifty-four patients with laryngeal cancer in T3 and T4 stages who were qualified for total laryngectomy were asked to fill out the EORTC QLQ-30 and H&N30 modules before and a few years after surgical treatment. Results. The quality of life of the hospitalized patients increased after surgery. The level of pain after surgery decreased and was statistically significant (p = 0.025). In the study group, 90.6% of patients survived five years after surgery. Conclusion. The quality of life in patients with laryngeal cancer improved in the domain of pain. Further research should be conducted on a larger group of patients. Future results could provide useful material for analysis regarding the benefits for the patient that may be relevant to a decision to consent to the proposed treatment and the choice of its type.

How does power manifest itself in everyday life? Using experience-sampling methodology, we investigated the prevalence, sources, and correlates of power in people’s natural environments. Participants experienced power-relevant situations regularly, though not frequently. High power was not restricted to a limited few: almost half of the sample reported experiencing high-power positions. Positional power and subjective feelings of power were strongly related but had unique relations with several individual difference measures and independent effects on participants’ affect, cognition, and interpersonal relations. Subjective feelings of power resulted more from within-participant situational fluctuation, such as the social roles participants held at different times, than from stable differences between people. Our data supported some theoretical predictions about power’s effects on affect, cognition, and interpersonal relations, but qualified others, particularly highlighting the role of responsibility in power’s effects. Although the power literature has focused on high power, we found stronger effects of low power than high power.

Objectives Overseas-qualified dentists constitute a significant proportion of the Australian dental workforce (approximately one in four). The aim of the present study was to provide a better understanding of the cultural adaptation process of overseas-qualified dentists in Australia, so as to facilitate their integration into the Australian way of life and improve their contribution to Australian healthcare, economy and society. Methods Life stories of 49 overseas-qualified dentists from 22 countries were analysed for significant themes and patterns. We focused on their settlement experience, which relates to their social and cultural experience in Australia. This analysis was consistent with a hermeneutic phenomenological approach to qualitative social scientific research. Results Many participants noted that encounters with ‘the Australian accent’ and ‘slang’ influenced their cultural experience in Australia. Most of the participants expressed ‘fascination’ with the people and lifestyle in Australia, primarily with regard to the relaxed way of life, cultural diversity and the freedom one usually experiences living in Australia. Few participants expressed ‘shock’ at not being able to find a community of similar religious faith in Australia, as they are used to in their home countries. These issues were analysed in two themes; (1) language and communication; and (2) people, religion and lifestyle. The cultural adaptation process of overseas-qualified dentists in Australia is described as a continuum or superordinate theme, which we have entitled the ‘newness–struggle–success’ continuum. This overarching theme supersedes and incorporates all subthemes. Conclusion Family, friends, community and organisational structures (universities and public sector) play a vital role in the cultural learning process, affecting overseas-qualified dentist’s ability to progress successfully through the cultural continuum. What is known about the topic? Australia is a popular host country for overseas-qualified dentists. Migrant dentists arrive from contrasting social and cultural backgrounds, and these contrasts can be somewhat more pronounced in dentists from developing countries. To date, there is no evidence available regarding the cultural adaptation process of overseas-qualified dentists in Australia or elsewhere. What does this paper add? This study provides evidence to support the argument that the cultural adaptation process of overseas-qualified dentists in Australia can be viewed as a continuum state, where the individual learns to adapt to the people, language and lifestyle in Australia. The ongoing role of family and friends is primary to a successful transition process. Our research also identifies the positive role played by community and organisational structures, such as universities and public sector employment schemes. What are the implications for practitioners? A potential implication for policy makers is to focus on the positive roles played by organisational structures, particularly universities and the public sector. This can inform more supportive migration policy, as well as strengthen the role these organisations play in providing support for overseas-qualified dentists, thus enabling them to integrate more successfully into Australia’s health care system, economy and society.

Abstract The Decree of the President of the Russian Federation “On national goals and strategic objectives of the development of the Russian Federation for the period up to 2024” deals with the priorities for the creation in the basic sectors of the economy, primarily in the manufacturing industry and the agro-industrial complex, a highly productive export-oriented sector, developing on the basis of modern technologies and provided with highly qualified specialists. The strategic goals are not only to increase the efficiency of the agro-industrial complex through the introduction of innovations, but also to increase the level of employment and the quality of life in the countryside. The current research also emphasized on stabilizing the number of highly qualified specialists, reducing their migration outflow. Indeed, the quality of the developed and adopted management decisions also depends on the qualitative representation of the management staff, and, consequently, the indicators of enterprises efficiency in agribusiness. The research provides analytical information on the resource and productive indicators of the development of agriculture in the Penza region, the recruitment of the qualified staff (managers and other specialists) by the agricultural organizations, their qualitative number and mobility. It is concluded that it is necessary to form a state program of personnel support for the agro-industrial complex, contributing to the integration of a systemic and integrated approaches in the reproduction of highly qualified specialists.

In many cases, minor heirs are damaged by obligations with the inherited estate. The Ministry of Justice announced an amendment to the Civil Code to protect minor heirs. The amendment can relieve some of the heirs, but it cannot protect minor heirs who become aware of their inheritance obligations when they are minors. In addition, legislation on the procedure for liquidation of Inherited Estate is necessary. If minor heirs passed the period for acceptance and renunciation, qualified acceptance should be regarded. And the provisions for bankruptcy of inherited property of the Debtor Rehabilitation And Bankruptcy Act should also be revised. The amendment to the Family Litigation Act should be amended that minors have non-litigation capacity in cases related to qualified acceptance. In the procedure of accepting the qualified acceptance report of minor heirs, the judge can appoint a procedure assistant to support minor heirs. In judicial procedures that affect the minor himself, the minor's own partici- pation must be guaranteed. A court may grant a litigation aid to participate in family litigation procedures that have an important impact on one’s life.

Описывается авторская модель подготовки квалифицированных специалистов по специальности «Механизация сельского хозяйства». Приводится спецификация стандарта World Skills по компетенции «Эксплуатация сельскохозяйственных машин». Описывается внедрение данной спецификации в образовательный процесс ОГБПОУ «Томский аграрный колледж». Рассматривается процесс организации учебных занятий. Связь преподавания с жизнью, сельскохозяйственным производством – это не только использование материалов об историческом пути сельскохозяйственной науки и практики, но и рассмотрение актуального вопроса как необходимость знания экономики, организации и планирования сельскохозяйственного производства. Задача преподавателя заключается в том, чтобы применять экономические знания на практике, например при изучении сельскохозяйственной техники, то есть машин и механизмов, уметь определять эффективность применения машин, удобрений, ядохимикатов и т. д. Таким образом, в деле профессиональной подготовки обучающихся важно, чтобы в содержание занятий включался конкретный материал, направленный на развитие у обучающихся интереса к избранной специальности. The article presents the author’s view on the training of qualified specialists for agricultural production. The economic and managerial training of qualified specialists for agricultural production is considered taking into account the World Skills Russia standard in the field of training “Agricultural mechanization” using the example of secondary vocational education. The author describes the model of training qualified specialists in the specialization «Agricultural Mechanization». The specification of the World Skills standard on the competence “Operation of agricultural machines” is given. The introduction of this specification in the educational process of OGBPOU «Tomsk Agrarian College» is described. The process of organizing training sessions is considered. The connection of teaching with life, with agricultural production is not only the use of materials about the historical path of agricultural science and practice, but the consideration of an urgent issue as the need for knowledge of the economy, organization and planning of agricultural production. The teacher’s task is to apply economic knowledge in practice, for example, in the study of agricultural machinery, that is, machines and mechanisms, to be able to determine the effectiveness of the use of machines, fertilizers, pesticides, etc. Thus, in the matter of training students, it is important that the content of classes include specific material aimed at developing students’ interest in their chosen specialty.

Introduction to the problem. The relevance of the analysis of the environment of a graduate student from the position of searching for a pedagogical means of managing his formation as a highly qualified specialist is due to the multidimensional goals and objectives of postgraduate training, which are based on the conditions of real life. The purpose of the article is to identify and justify the functional and predictive model of the environment of students in graduate school as a means of scientific and scientific-pedagogical training of highly qualified personnel. The methodology of the study. Theoretical bases of the description of a model of students in graduate school made presentation on environmental design, as part of a technology of the environmental approach in education, as well as theoretical and practical experience of understanding the way of life as a condition of personality during the educational process. An important role was played by the results of the study of the use of information and communication technologies as a system-forming factor in the training of highly qualified personnel in graduate school, conducted by the author since 2017. Results and conclusion. The environment of students in graduate school is presented as an integral tool that includes the parameters of the possibility, probability and reliability of achieving an educational goal in the environment and with the help of the environment. These parameters are revealed in the course of a sequential solution of nine tasks to describe the environment of students in graduate school, based on the rules of combining parts of the environmental approach in order to realize the educational potential inherent in it. The way of life of a graduate student is considered as a condition for becoming a highly qualified specialist with scientific and scientific-pedagogical training as a result of the interaction of the student with the environment.

Abstract Nursing homes face challenges caused by increasing numbers of older adults with frailty and multimorbidity, and complexity of care in combination with decades of under resourcing and severe workforce challenges. In most countries the vast majority of direct care in LTC homes is provided by a large unregulated workforce that is largely unregulated, female, racialized and poorly remunerated. The results are severe difficulties in recruiting and retaining staff at all levels and a tendency to substitute less qualified workers for more highly qualified and more highly remunerated. Less well reported are the significant pressures that critical LTC home managers face. However, they are equally under duress especially in the wake of a global pandemic. Developing a culture of continuous learning and integrating this into daily nursing practice is one promising way to attenuate these challenges, ensure a high quality of care and a better equipped nursing staff. However, insight into strategies and interventions that contribute to such a continuous work-based learning culture in nursing homes is still relatively limited. In this symposium we will focus on different approaches to increasing workplace learning in long term care.

Food is one of the principal ingredients in the framework of the growth and life of the nation and has an important role in national development. Control of factors premises, equipment, people and food enabling poor health disorders or food poisoning. The research method is descriptive with samples of food processing power as many as seven (7) people. The data collection conducted interviews using a questionnaire and checklist. Data analysis was performed manually and presented into a frequency distribution table. The results were obtained personal hygiene qualified only by 43,0%, processing methods eligible is still low (29,0%). Sanitation equipment is generally eligible (86,0%), and sanitary processing sites still little qualified (29,0%). Additionally, hygienic way of packaging is good is qualified by 86%. The conclusion shows that there are many circumstances in patent bakery bread factory production is still less qualified. Suggested to the factory owner in order to provide training to employees to further hone their knowledge in order to create quality bread eligible. Auditing has a very important role in the economic life and the auditor’s report is considered as the end of accounting information system in the enterprise, where it gives full and thorough summary of information content. So, this study aims to identify the existence level and form of financial market reaction on the auditor report by defining the change impact of the external auditor’s opinion on the stock prices of service companies listed in Amman Stock Exchange (ASE) in the period 2010–2017. The study population consists of all the 37 service companies listed in ASE, in which the audit report type has changed from unqualified to qualified and vice versa, where the number of observations was 48 – 32 from unqualified to qualified and 16 from qualified to unqualified. The results showed that there is statistically significant difference of stock prices after changing the report type from unqualified to qualified, where its prices declined as a result of this change, while there weren’t any statistical differences of stock prices as a result of changing the report type from qualified to unqualified. So, companies must pay more attention to the auditor report issued on its behalf, and work at its best to keep this report unqualified.
