Prostitution comes from the word prostitutio which means things to place, confront, offer. There are also other articles selling, peddling, but generally interpreted as surrender to many people by getting a reward for fulfilling that section of the person. Prostitution or prostitution is a serious problem and needs improvements that need to improve society, this disease develops very rapidly in the community. In addition to the social forms of social norms, prostitution is also a form of immorality in any religion that is not permitted and rejected. Although prostitution is issued in religion or law, many of these prostitution practices occur in Indonesia. Prostitution is a lucrative and promising business place for so many people to believe in their pride. It is necessary to establish a new criminal law legislation to provide legal attention to the imposition of sanctions aimed at commercial sex workers and users of services. Because the criminal law currently in force in Indonesia is considered not in accordance with the current state of Indonesia.

The article presents a socio-historical analysis of the formation of prostitution as a social institution. The considered concepts about the origin of prostitution, regardless of the root causes — a relic of archaic-primitive instincts, building a social structure through exchange, where a woman was a medium of exchange or the decline of orgiastic cults, allowed the author to conclude that there was a regulation of sexual relations and the construction of gender discriminatory structure of society. Based on the works of various authors, the main stages of the process of institutionalization of prostitution are identified — “state-regional”, “socio-regional”, transnational-global”. The article analyzes the interaction with other social institutions. The state of the system of prostitutional relations at the present “transnational-global” stage is described, where prostitution has become one of the elements of the sex industry. The intensification of criminalization and discrimination in the field of prostitution relations is noted.

Prostitution’s phenomenon is one of criminality forms that is very difficult to overcome and this criminality type is widely supported by economic factors in the environment, until now, prostitution cannot be stopped, as well as a treatment to sexual morality, domestic life, health, women’s welfare. One of the problems is because the number of tourists from the Middle East came and went to Kampung Arab, the area of Puncak, Bogor regency particularly. The practical sexual transaction not only experiencing by the prostitutes from Bogor and Cianjur (PSK Domestic) but also between Arabic tourists and Moroccos, what we called Maghribi. Therefore, the government should be more active in seeking solutions to this problem, such as eradicating prostitution bravely in brothels. As the time goes by, Indonesian culture will be eroded from that area and the most worrying is the case of prostitution will multiply as social issues related to moral ethics nationally.Keywords: Prostitution, Moral Ethics and Prevention of Prostitution.

Prostitution is an act that is contrary to the norms that exist in society because this act can cause unrest in the community and disrupt the order of life in the surrounding community. Prostitution deviates from the norms of decency where a woman or a man sells himself to get satisfaction from lust. Prostitution is spreading rapidly in Indonesia. Many prostitutions are committed under the guise of, among others, Reflexy Massage Parlors, Beauty Salons, and SPA. This study is motivated by the problem of the practice of hidden prostitution under the guise of these business premises in Indonesia, especially the Sleman Regency area, which are almost entirely unexposed and untouched by law enforcement officials but have the potential for negative impacts on society both socially, psychologically, religiously and culturally. This article aims to find out how law enforcement is against the hidden practice of prostitution under the guise of massage parlors, salons, and spas in Indonesia, especially in the district of Sleman. This study combined field and library research, using an empirical juridical approach with a descriptive-analytic method to explain the data. It also used legal system theory to analyze. This study showed no clear and specific regulations that regulate or prohibit prostitution firmly. So far, the Police and Civil Service Police Unit (Satpol PP) have enforced the law based on Regional Regulation No. 15 2012 concerning Tourism Business Registration in Sleman. However, the participation of every stakeholder in society with local wisdom that has existed so far is expected to create legal awareness about hidden prostitution.

The phenomenon of human trafficking for commercial sexual exploitation has long been developed in various countries, including Southeast Asia, such as Indonesia. Prostitution prevention and handling efforts can be carried out by the government through the formulation of policies or regulations and implemented with a collaboration of various government actors and non-government actors, both national, regional, and local stakeholders. This research aims to study the collaboration model of stakeholders in the perspective of implementation of prostitutional prevention and to handle policy in Surabaya as the closure of Dolly, the largest prostitution area in Southeast Asia. In conclusion, state collaboration with the community in handling prostitution will be a strong root because here will create a synergy together to always supervise and seek mutual solutions in preventing and handling the problem of prostitution, so that can be an example for other local governments in making prevention and handling policies of prostitution in their region. The method used in this research is the experimental method. The first step is a survey to get research subjects. The survey was conducted using the snowball method. Researchers also evaluated several potential groups. Then the process is continued by using a SWOT analysis to determine the best pilot location. Participatory Focus Group Discussion and interviews to deepen the diagnosis. The diagnostic results are developed and compiled manually. This study found that the main causes of prostitution were mostly related to family problems, personal problems, the trauma of sexual harassment, and unemployment. The existence of teenagers who fall into prostitution is a social problem in society. The negative impact is moral degradation. Implications of research to strengthen the Social work profession to prevent prostitution and provide clear and factual information about the reasons why young people may fall into prostitution. This solution should involve both formal and informal institutions.

ABSTRACTProstitution has been linked by many historians and social commentators to the industrial development and capitalism of the modern age, and there is no better example of this than the prostitution that developed in mining regions from the mid-nineteenth century. Using research on mining-related prostitution, and other social histories of mining communities where prostitution inevitably forms a part, large or small, of the historian's analysis of the mining region, this article will review, contrast, and compare prostitution in various mining contexts, in different national and colonial settings. From the American and Canadian gold rushes in the mid- and late nineteenth century, to the more established mining frontiers of the later North American West, to the corporate mining towns of Chile in the interwar years, to the copper and gold mines of southern Africa and Kenya in the first half of the twentieth century, commercial sex was present and prominent as the mining industry and mining communities developed.1 Challenging the simplistic images and stereotypes of prostitution that are popularly associated with the American mining frontier, historians have shown that prostitution's place in mining communities, and its connection to industrial development, was as complex as it was pervasive and enduring.

Les romanciers en parlent ouvertement en mettant en exergue les transformations sociales, politiques et économiques, car elles sont véritablement les vecteurs de cette crise morale. La banalisation de la tradition, les libertés individuelle et collective, ont largement contribué à l’expansion de la prostitution. Même les villages, terreau de la culture africaine, sont quelquefois profondément affectés comme les villes, symboles de la perdition. Les nouveaux concepts (droits et démocratie) appliqués à toutes les catégories sans aucune distinction ont donné l’occasion à certaines femmes de se livrer à plusieurs formes de prostitutions pour des raisons purement financières.

The debate on the morality of prostitution has been a trending contemporary ethical issue. Some have argued for and some against prostitution. Prostitution, as I have defined it in the study, is the conscious act of any gender exchanging sex for financial or material gain. The study looked at the historical antecedents of prostitution, concepts and types of prostitution, and also brought forth various views or conceptions of prostitution. The views looked at include the feminist position for and against prostitution, the contractarian position for prostitution, and the liberalist and conservative positions on prostitution. The study adopted the qualitative method, and thus only secondary sources were used to carry out this research. The secondary sources used are from texts and journal articles. The study concludes that prostitution is neither coercive nor immoral if valid consent is obtained. Any sex act that takes place between two freely consenting adults is morally acceptable. Prostitution combines consenting sex with a contractual exchange. Hence, this dual aspect of the act serves as the foundation for any governing set of rules or morals that govern prostitution.

This study aims to obtain similarities and differences regarding legal formulation in online prostitution. Hitherto, prostitution has remained to exist in Indonesian society. In context, the existing perpetrators of prostitution do not peddle conventionally but also virtually, in which online prostitution that gradually increases is a common term that refers to this phenomenon. The current law enforcement against perpetrators of online prostitution performs as the consequence of the national law in which national laws have yet remained to accommodate in criminalizing perpetrators of online prostitution. The criminalization of perpetrators in online prostitution may contrast with the principle of legality so that national laws should accommodate perpetrators of online prostitution regarding their criminal liability. In particular, these national laws should address whether to prohibit the attitude that proliferates online prostitution so that perpetrators of online prostitution should be accountable for their crimes. Henceforth, this measure intends to avoid the overlap of the principle of legality in criminal law. Keywords: Online Prostitution, Criminal Liabilities, Principle of Legality.

This paper focuses on women who have left the industry of prostitution and is based on ethnographic field studies conducted in several cities in Lithuania. Four women have agreed to share their stories of entering and leaving the industry of prostitution and in all their narratives the core accent was the experience of shame. During the interviews, each of these women had an urge to express the importance of moral virtues in their lives and, as all of them claimed, they felt ashamed because “they have lost their femininity.” It was very important for these women to emphasize that they are not “easy going” or “loose women,” but women who have high moral standards and that entering the industry of prostitution was never the idea of their own, it was rather the consequence of several different factors varying from manipulations of their pimps to their poor social and financial circumstances. It is evident that these 4 women understand femininity as opposed to the work which women in prostitution do (providing sexual service). According to their narratives, women in prostitution, due to the aspect of providing sexual service to many male clients, lose the virtue of femininity, and that is the main factor generating the experience of shame. Due to experience of shame, all these women could not share their traumatic experiences with their families or even close friends. The construction of femininity in Lithuania is heavily influenced by the cult of Mother Mary and the doctrine of innocence. Therefore, the division of women into the categories of the Madonna and the Whore is still very much prominent in the Lithuanian society today. According to the Code of Administrative Offenses, prostitution in Lithuania is categorised as a crime against morality, and both the client and the sexual service provider must be fined. Nevertheless, the data shows that disproportionately very few clients get punished compared to the sexual service providers, mainly women. While non-governmental organisations are putting their efforts to focus the attention of society and the law institutions onto the client and in that way to put an end to the stigmatisation of women in the industry of prostitution, since both the client and the provider of sexual services are needed for the act of prostitution, in reality no social rehabilitation programs in social politics exist for these women in Lithuania today, apart from the help they receive from non-governmental organisations. Therefore, they are left to cope with the traumatic experience on their own, while the stigmatisation of women in prostitutions persists. Empirical material confirms the hypothesis that the experience of shame, which is based on the construction of femininity and the system of moral virtues in the society, reflected in the law defining prostitution in Lithuania, creates certain psychological and social configuration. Due to this configuration, these particular women experience social isolation. Therefore, their rehabilitation from the trauma period is prolonged and new obstacles in achieving well-being in their lives emerge.

Prostitution has been linked with drug/alcohol misuse for ages. A mathematical model to explore the relationship between prostitution and drug/alcohol misuse is proposed and analyzed. The epidemic thresholds known as the reproduction numbers and equilibria for the model are determined and stabilities analyzed. Analysis of the reproduction numbers suggest that prostitution enhances drug/alcohol misuse and vice-versa. Numerical simulations further show high levels of prostitution (drug/alcohol misuse) control in the absence of drug/alcohol misuse (prostitution). Results from this study suggests to effectively control prostitution (drug/alcohol misuse) require strategies that address both prostitution and drug/alcohol misuse. Addressing only one social issue like prostitution through poverty eradication may not be enough to stem prostitution as some would be turning to prostitution to support drug/alcohol addiction. The same scenario happens to drug/alcohol misuse.

Prostitution is considered the oldest profession in the world. Although the culture and date of its inception is not clear, there are various myths. It has different meanings and reflections in every culture and civilization. This situation causes it to take on different places. The beginning of prostitution is thought to derive from phenomenon of war; therefore, it relates to the settlement of the occupation forces in the cities. Economic reasons accompany the phenomenon of war. According to the type of prostitution, the phenomenon of religion also shapes prostitution. Social and cultural meanings attributed to prostitution, types of prostitution and sex workers, accessibility, urban politics and technology can be counted among the dynamics in the selection of spaces of prostitution. All these factors transform and diversify the places of prostitution. We will examine the changing places of prostitution from the past to the present including what these types of places are, both chronologically and thematically on the basis of countries. It is possible to collect types of spaces of protitution under eight different headings from design (planned and organic), settlement (urban and rural), religion (holy and non-religious), law (legal and illegal), and location in urban space (centre and periphery – scattered or combined), to access (virtual and real – mobile or fixed), continuity (legal and illegal) and front spaces (night club, pavilion, residence, hotel, massage parlor, Turkish bath and tourism). In this study, it is aimed to discuss the dynamics of choosing a place for prostitution, its concentration in the region where prostitution occurs, and the formation of prostitution in a region with activities of no prostitution. For this purpose, spaces of prostitution will be categorized. For the classification of spaces of prostitution, the phenomenon of prostitution in different countries will be analyzed. Online prostitution was uncovered after it was discovered that several social media accounts provided sex services that were easily accessible and at varying prices. The emergence of online prostitution has been reported as a form of resistance by some prostitutes in getting customers due to the closure of many localized places as centers of sexual transactions. Far from that, online prostitution has a troubling impact on the local community, especially for young people who are still at puberty, many of whom have fallen into the form of prostitution. This paper highlights the functional changes of prostitution that are offered with internet access and social media as functional changes in prostitution relations so that efforts are made to find the root of the problem in online prostitution. The method used in this writing is descriptive qualitative, namely by reading the supporting literature and by following the news about the development of online prostitution. The results obtained are that online prostitution is not pure prostitution for economic reasons, but rather refers to the concept of trends and lifestyles, so that the changes seen in online prostitution are structural changes in prostitution as well as irregularities in prostitution behavior that can be said as deviant behavior or pathological behavior.

Many see prostitution as controversial, as it has few, if not many things to do with morality and public safety. For Indonesia in particular, such practice is also contradictory with the religious teachings upheld by the society. Realizing that the majority of people stand against prostitution practice, government authorities are competing to entirely wipe out prostitution by disbanding prostitution localizations. Total of 160 prostitution localizations had been disbanded in the span of 2016-2019. However, such attempt did not evaluate safety concerns for therein female sex workers (FSW). Prostitution will flourish, localized or not. Thus, FSW were relocating to scattered areas (increasing safety risk) or soliciting online (violating more laws). The disappearance of monitored zones for sex business will address new problems, resulted from negative effects of uncontrolled prostitution. This research is a preliminary analysis in criticizing the Indonesian government policy for disbanding prostitution localizations. Indonesia’s government promoted eradication of prostitution to conform with norms while in national level, prostitution is not entirely illegal. Sex work is not a crime and in the history, regional governments had been accommodating area for prostitution. That, in a way, provided safety for FSW from criminalization. However, a full recognition, let alone legalization, of prostitution is still far from achieved. The authors concluded that the recent prostitution localizations dissolution is a hostile attempt to eliminate the rights of FSW as women, including rights for welfare and a safe work environment. Thus, strict control for prostitution through localizations for sex work is actually the answer for a safe, monitored prostitution industry and should have not been disbanded.

In the United States, prostitution is considered illegal in all but one state; Nevada allows some legal activities in exchange for substantial guidelines. In 2010, approximately 43,600 females were arrested for prostitution. Numerous intervention programs were established in order to obstruct the lifestyle of a prostitute (PRP, Project ROSE, etc.). There are many documentations and programs that share their forethought on prostitution; however, few target prostitution directly. To determine the dynamics of prostitution, this paper constructs a four-class compartmental model that focuses on the effectiveness of government intervention and rehabilitation of prostitutes mathematically. The basic reproductive number, [Formula: see text], helps to discover the threshold values for the dynamics of prostitution to become both prevalent or absent in society. This paper predominately observes government intervention to curtail a prostitution prevalent society. Various parameters and variables help to define and indicate the dynamics of prostitution to construct viable simulations. Successful prostitution interaction prevention deemed essential in prostitution prevention; however, government intervention corresponding with successful rehabilitation competitively challenges prostitution interaction prevention in reducing basic reproductive values.

This article is an attempt to bring together knowledge about the Norwegian prostitution market, public debates on prostitution and prostitution laws and regulation in order to explore the processes whereby the prostitution setting is constituted. Norway has been the site of changes in the ways female prostitution takes place, changes that are being experienced by the women involved due to a growth in indoor prostitution. These changes seem to have been produced by, and to take part in, the production of new images of prostitutes and new means of prostitution control.

Prostitution complex has so far been labeled as a risky place for the child's growth process, as well as in the aspect of forming religious behavior. This article intends to answer the question of how the process of forming religious behavior of the child in the prostitution complex at Weru, Kediri. This study uses a qualitative approach by observing and doing in-depth interviews with children, parents who work as prostitutes, pimps, mosque administrators and the head of POKJA at the prostitutions site, as data collection techniques. Concerning theoretical perspective, this research employs the Social Construction theory of Peter L. Berger. The results revealed that the children at the prostitution complex of Weru could not carry out religious activities properly because their family and surrounding environment was not supportive. The social construction that is formed the prostitution complex does not show religious values that should become the main focus of life.Lokalisasi selama ini dilabelkan sebagai tempat yang riskan untuk proses tumbuh kembang anak, demikian pula dalam aspek pembentukan perilaku religius. Artikel ini bermaksud untuk menjawab pertanyaan bagaimana proses pembentukan perilaku keagamaan anak-anak di lokalisasi Weru Kediri dengan menggunakan teori Konstruksi Sosial dari Peter L. Berger. Penelitian ini menggunakan pendekatan kualitatif dengan teknik pengumpulan data melalui observasi dan wawancara mendalam terhadap anak-anak di lokalisasi, para orangtua yang bekerja sebagai PSK, mucikari, pengurus masjid, dan ketua POKJA di lokalisasi. Hasil penelitian mengungkapkan bahwa anak-anak di lokalisasi Weru ini tidak dapat menjalankan kegiatan keagamaan dengan baik karena faktor keluarga dan lingkungan yang kurang mendukung. Konstruksi sosial yang terbentuk dalam lokalisasi ini tidak menunjukkan nilai-nilai religius yang seharusnya menjadi tumpuan utama kehidupan.

If in the past, promotion of sexual services was done face to face – on the streets or brothels – but now it has turned to social media. Data shows that online prostitution continues to increase because it can be accessed easily on social media. Social media, with its more open communication, is considered adequate for the promotion of commercial sex services. The purpose of this study is to get an overview of the interaction and communication with regards to online promotion of prostitutions on social media. Netnography is the research method chosen. The results of the study concluded that in the interaction regarding prostitution on social media and communication between fellow perpetrators is very open and vulgar. Commercial sex workers and pimps are the main promoters of the services offered. The message conveyed includes the services offered, ways of payment, and rules of the game accompanied by terms and conditions that are commonly used among actors. The use of the hashtag (#) by service providers helps facilitate the promotion and search for customers. In addition to the timelines used by actors, social media commentary, and the direct message (DM) feature are also used for communication purposes. Furthermore, if there has been an agreement between the actors, an extension of the private communication is continued through instant messaging such as talking about time, location of the service, payment and sharing of testimonials from previous customers. The information developments and communication technology also has a negative side. This study is aimed to determine the online prostitution communication network on Twitter and understanding of online prostitution on Twitter. This study uses SNA (Social Network Analysis). SNA views social relations as a theory of networks consisting of nodes and relationships (also called edges, links, or connections). Nodes are individual actors in the network and the relationships are between actors. The data set used in this study is tweet data from Twitter, with the keyword samples being “openBO”. The hashtags were chosen because they are the most widely used the hashtags for online prostitution. The data is taken with a period between January 2020 to December 2020. The data is taken and processed using NodeXL Basic, one of the plugins for Microsoft Excel that can be used to process data from social networks. This research found there are 3,673 nodes and 54,969 edges. The hashtags utilization is usually utilized by online whores to advance their administrations. A few prostitutes are independent, it is implying that they don’t connect with others in advancing business sex administrations. It is not reliant upon pimps since pimps mean to lessen their business chain.

Nowadays prostitution tends to be regarded as a moral problem. This claim, in fact, oppresses women in prostitution. Women in prostitution then are regarded as sinners, dirty, and damned. This stigmatization in fact cannot solve the real problem of prostitution, and has made it difficult for women in prostitution to return to society. Based on historical, social and cultural research on prostitution, it can be found that prostitution is a structural problem. Structurally, women in prostitution are victims of poverty, discrimination against women, and domination by patriarchal culture. Stigmatizing women in prostitution nowadays cannot be separated from religion as source of morality. The false interpretation of religion often happens because theology is constructed from a dogmatic-textual orientation. Based on this theology, women in prostitution, of course, are blamed and claimed to be sinners. This perception makes women in prostitution who are oppressed become more oppressed. Based on this problem, then, theology needs to be reconstructed. By considering social and cultural analysis, theology need not become in the future so alienated from actual problems. To support the literary data, field research will be conducted, that is in Pasarkembang, a centre of prostitution in Jogjakarta. To collect data from this field, I will use convenience samples for interviews of women in prostitution. The interview questionnaire is included in the appendix. The interview questions will be based on existing research with the intention of connecting the local situation to theory in liberation theology. Interview questions will be quoted in text to illustrate structural aspects of prostitution. This field study proposes to learn about the presence of structural aspects of prostitution in Islamic society in Indonesia. In investigating Islamic theology, some points can be addressed. The main point is that the situation of many women in prostitution nowadays is analogous with slavery in Muhammad’s day. If we look at al-Qur’an wholly, we will understand that Islam actually wanted to eradicate slavery gradually. Some verses even explicitly forbid people to enslave women. The last step of liberation theology is praxis. In considering the steps within praxis, the insights of Islamic theology, can do best praxis for liberating women in prostitution. But, women in prostitution have also to be included in this praxis. The role of women in prostitution as subjects is very important if they are to liberate themselves.

Prostitution activities that occur in society are not only caused by pimps and sex peddlers, but are also closely related to users of prostitution services. The absence of regulations that can ensnare perpetrators of prostitution practices, especially users of prostitution services, shows the government's inconsistency in combating prostitution practices. There are two problems in this study, namely, first, how is the regulation of punishment for perpetrators of criminal acts of prostitution in Indonesian positive law and second, how is the imposition of criminal sanctions against perpetrators of criminal acts of prostitution, especially users of prostitution services through complaint offenses in the Criminal Code. This study uses normative research conducted through an assessment of the legislation and legal concepts. The approach in this study uses a legal concept approach, and a statutory approach. Based on various explanations of articles in Indonesian positive law, it is not at all clear and implicit that there are articles that regulate criminal sanctions against users of prostitution services. With the absence of legal norms related to criminal sanctions for users of prostitution services, other legal remedies can be taken to ensnare users of prostitution services through the application of a complaint offense with the alleged crime of adultery as regulated in Article 284 of the Criminal Code.

Abstract: This article discusses about advocacy against child prostitution in Dolly-Surabaya. Child prostitution is an act that violates the fundamental rights of the children from any kind of exploitation activities. The people who cause prostitution are to be punished in accordance with the applied regulations. Advocacy on child prostitution in Dolly is where the act of prostitution is not getting any penalties or sanctions because the child only has an obligatory capability and not an act capability. The parties that led to the child victims of prostitution should be punished by the assumption that they have done fraud and coercion. Moreover, child prostitution is a form of human trafficking. The advocacy dedicated to child as the victim of prostitution is: first, litigation advocacy with the target of those children’s fundamental rights which have been violated by others can be restored; second, budgetary advocacy with the goal of keeping the budget managed by the government can be allocated appropriately to children who become the victim of prostitution; and third, policy advocacy with the aim of protecting the fundamental rights and improving the welfare of the children who become the victim of prostitution, both of morally and materially.Keywords: Advocacy, child prostitution, Dolly localization

The paper presents the results of a qualitative analysis of prostitution in Croatia according to the prostitution categorisation into low, medium and high-level prostitution. The goal of the conducted study and this paper is to provide an in-depth insight into prostitution phenomenology, and based on that, on influencing factors, as well as about the possible directions of prevention regarding the etiology of prostitution. For the purpose of transparency and systematic presentation, semi-structured interviews with persons engaged in prostitution and police officers engaged in the prevention of prostitution were divided into mentioned prostitution categorisation and thematic division of the questionnaire was carried out according to the questionnaire presented in the introduction and presented in a table for the sake of transparency, after which the analysis strives to bring out conclusions about the possible patterns of the phenomenon itself. In addition, at the end of the research, the table shows the general police officers’ knowledge of the phenomenon of prostitution, their attitudes regarding the phenomenon itself and the current legislative framework. The results of research and analysis show that street prostitution has almost disappeared in Croatia, while medium-level prostitution is dominant because it offers a significantly higher level of protection and safety (both physical and from stigmatization, as well as police detection). High-level prostitution is more in the focus of new communication channels and media full of "successful" beauties who live "on the high side", and most often it is about women who have a certain legal "occupation/profession", while they engage in prostitution occasionally in order to improve their financial situation, while most of them grew up in average families without detected trauma or victimization.

According to Korea's current law, both sex sellers and sex buyers, who are parties to prostitution, are punished, but those forced to sell sex due to hierarchy and power are excluded from the punishment, and the burden of proof of the damage is placed on women in prostitution. Although prostitution is currently illegal, the market size of prostitution is estimated to be more than 30 trillion won, and it is becoming more organized and intelligent. At the same time, the problem of human rights violations such as exploitation and violence against sex-selling women is accelerating. This shows that the current method of regulating prostitution has limitations in eradicating prostitution, blocking demand, and protecting the human rights of prostitution women. Above all, the current punishment clause for both parties of prostitution is abused as a means of threatening women even if they are victims of various crimes such as sexual violence and abuse. In addition, if prostitution women fail to prove the damage that they were forced to trade sex by others, they will eventually be punished, which makes them hesitate to report. In this situation, practical solutions are needed to effectively block the growing demand for prostitution and to protect prostitution women, and as part of this, it is essential to consider the Nordic model of punishing sex buyers and brokers without punishing sex sellers.

This paper identified the problem of prostitution from the viewpoint of positive law and empirical reality in society. By combining normative and empirical studies, the article aims to provide an overview of the problem of prostitution more clearly. From the library resarch, it is found various types of prostitution occur. In addition, the motivation to commit prostitution was not solely caused by economic motives, but there were other motives such as drug abuse, for instance. To keep prostitution is not rampant, it is not solely relying on legal instruments, but the role and function of the family is important. Therefore, the problem of prostitution is not simply seen from one point of view, there are other factors as its cause.

The disclosure of several cases of online prostitution using the MiChat application in major cities of Indonesia shows that the phenomenon of prostitution is increasing. Prostitution practices are prohibited in Indonesia as it included in human trafficking. Furthermore, prostitution using virtual networks is part of cyber-crime regulated in the Electronic Information and Transactions Law. Despite the existing regulations, online prostitution activity continues. One of the reasons is the use of social media and online applications that facilitate the distribution of sexual services. This study aims to obtain an overview of online prostitution activity through the MiChat application and its solutions. This study used a content analysis method equipped with interviews with informants who are competent in handling prostitution. The results of the study concluded that the 'people nearby' feature in the MiChat application was dominated by accounts aimed at online prostitution, including the promotion of sexual services through profile information, timelines, and uploading photos/ videos related to service offerings, payment execution, also customer testimonials. Various efforts have been made by the government by blocking negative content regarding prostitution, but unfortunately, the platform itself has not been closed. In addition, all parties have taken preventive measures in terms of the prevention and handling of online prostitution.

Prostitution cases have emerged as a phenomenon having continuously loaded with law enforcement actions in Indonesia; the modus operandi is getting developed over time. The case that is currently trending is the case of online prostitution. Although prostitution cases have been set forth in the Criminal Code and online transaction-related legal provisions can be found in the Electronic Information and Transaction Law (ITE Law), however, online prostitution cases are in fact difficult to eradicate. This is due to the condition that only the procurers or procuresses can be held liable for the acts, while sex workers (commercial sex workers) and the online prostitution service users cannot. This indicates that the prostitution-related legal arrangement needs to be reconstructed, and for that, the present study has an urgent force to be carried out to review the online prostitution regulations as well as the legal politics to eradicate prostitution, particularly regarding the criminalization of sex workers (commercial sex workers) and the online prostitution service users. This study applies a normative law research method design. The results of the study show that the Criminal Code does not regulate the conviction of commercial sex workers and online prostitution service users, so they cannot be held criminally liable for the act. If the online prostitution-related regulations outside those in the Criminal Code are examined further, sex workers and their service users can be charged with the ITE Law, but the rule is still general in nature - regulating prohibitions that violate decency. Regulations on prostitution can also be found in Regional Regulations (Perda), but not all regions have or issue the regulations on Prostitution, so their enforcement is limited to the territory. The political law that can be learned from this fact is the reform of criminal law through the synergy of the draft of Criminal Code concept through criminalization and the provision of criminal threats against commercial sex workers and the online prostitution service users so that they can be held criminally liable for (penalization).
