Pełny tekst źródłaOur study attempts to elucidate the approach of religious guarantees in canon law regarding humansecurity, by investing in epistemology of canon law since its 1983 codification. According to ourhermeneutical analysis, the religious guarantees of the security of the human being in canon law havespecific bases, scopes and canonical regimes. Those are, among others, soteriological, human, andlegal. Soteriological security means accounting, by positive canon law, for the teleology of the humanbeing according to Christic revelation and associated theology. Human security here is dependent onphilosophical-theological anthropology and on Christian (Roman Catholic, in particular) ethics ofobedience. The canonical regimes of legal security are positioned between the freedom and the legalstatus of the individual. Given the institutional dimension of the Roman Catholic Church, these regimesare present in particular in the critical approach of administrative procedure and the criminal justicesystem. Given those prisms, which are not exhaustive but overlap, one may then examine the legal andaxiological means of religious guarantees in the canon law of the immanent and transcendent security ofhumans. Following a heuristic approach in both the history of law and contemporary canon law, the thesisexplores paradigmatic categories and procedures for the hermeneutics that this religious right implies ormight imply. In principle, the efficiency of the normative channels of this right should contribute toguaranteeing the security of human beings, but under what conditions of adaptation ad normam iuris velin procedendo vel in decidendi ? And with what effective and concerted centrality of the dignity of thehuman person as imago Dei ?

Pełny tekst źródłaIn the exercise of his office, the judge is constantly struggling with the law and his conscience. This reality is not peculiar to our time. It is a constant in judicial history. According to the times in history, the judge's conscience has not always occupied the same place. This oscillation of the place of consciousness in the act of judging shows both a concern for justice and an ethical concern. Despite the attempts of positivist and law-centrist doctrines to mitigate or even dispel the question of the judge's consciousness of the judicial sphere; it remains intact, even more so today with the increasing complexity of certain cases. The ‘righteous’ and the ‘conscientious’ are a viscerally linked couple but unfortunately it is a couple in "difficulty", where the law does not always triumph and where the conscience does not always have good press with regard to the subjective dimension which characterizes it and to which it is very often reduced. If this question has so far been the subject of an abundant literature in both French and Canon law, I believe that it has been essentially approached either from the angle of secular law or exclusively Canon law. To our knowledge, no comparative study has been made on this subject. Hence the interest of our study. We therefore propose in this investigation a comparative study of the judge's conscience in both French criminal law and Canon law through respectively the concepts of ‘intimate conviction’ and ‘moral certainty’. In French criminal law, judges and jurors, in accordance with art. 353 CPP must judge by referring to their intimate conviction whereas in the Canon law the judge cannot; whatever the litigation pronounce in his sentence that after having acquired according to c. 1608, CIC/83 "moral certainty" about the truth of the facts. "Intimate conviction" in French law and "moral certainty" in Canon law are two forms of manifestation of the judge's conscience. We therefore wonder whether "moral certainty" is in canon law what the "conviction" is in French criminal law. Through this comparative study we wish to subtract the judgment according to the consciousness of the caricatures of which it is the object, and to highlight the complexity of the office of the judge. At the heart of the debate about the conscience of the judge is the entire office of the judge that is at stake. Judging is an art that mobilizes the whole person of the judge and highlights his authority through a ritualized perspicacity and prudence. The conscience of the judge - whose manifestation is expressed under the terms of intimate conviction and moral certainty respectively in the French and canonical legal systems and whose risk of arbitrariness is so commonly apprehended by the public - is a pledge of justice and truth as much as it is subject to the test of judicial ritual. If our contemporary society rebels to the idea of consciousness – seen as an outset to the exclusively moral and subjective sphere -, our investigation aims to demonstrate that the conscience of the judge as understood in the canonical and French legislation has a precise technical meaning, which cannot be locked in any normativity

Pełny tekst źródłaThe present work bears the title, «The Procedure before the Ecclesiastical (Church) Courts of the Church of Greece: A nomocanonical analysis of the state law 5383/1932» which aspires to constitute the first monograph devoted to Law 5383/1932, a law that concerns the Greek Ecclesiastical courts, or better yet, the law regarding ecclesiastical disciplinary law according to the case law of the Council of State. This law concerns 82 metropolises (cathedrals) and the archdiocese of Athens. The disciplinary procedure is a judicial procedure that entails a hearing during which all of the principles of a fair trial must be applied. These courts owe a duty to offer the guarantees of a fair trial. The criterion is to know whether they are vindicating a difference with the rules of law having jurisdiction over this difference in the context of an existing procedure. Law 5383/1932 is a legal text and, in order to analyze it, we have used the legal and Canon law methods otherwise known as legal rule analysis and interpretation

Pełny tekst źródłaA glance of the current events of this Church brings to light that the collaboration between magisterial authorities and theologians involved with the task of doctrinal and catechetical education of the Roman Catholic Church experiences some difficulties, especially in more diverse and secularized societies. Sometimes theological research contributes to put the endangerment of the ecclesial communion or its cohesiveness with regard to the faith and moral theology. The instruction of the Roman Curie Donum veritatis of May 24th, 1990 enters in doctrine and in the procedure of regulation of the exercise of the freedom and the responsibility of the catholic theologian and the ecclesiastic to be met to ensure full communion. They are the criteria of orthodoxy, orthopraxy, ecclesial membership and communion.The question of the canonical status of theologians is debated and the catholic authority is obliged to specify the doctrine and the status of the catholic theologian. Does the code of Latin canon law of 1983 foresee rules for the regulation of the mission of the theologian according to the requirement of full ecclesial communion? A thesis in canon law was necessary to provide an initial assessment of the vocation of the catholic theologian, the institution of catholic theology, and the status of catholic theologians under Canon law. How does canonicity assist a faithful who, by the acquisition of recognized skills, wants to become a catholic theologian? How does one evaluate the suitability of the applicant? How to grant a candidate the status of theologian under Canon law and, if necessary, withdraw such status for the good of the Church? How does one guarantee the consciousness and the freedom of the catholic theologian? In case of differences of opinion or disagreement, how does one qualify this situation? Thus, the theologian enjoys liberties recognized by his Church but within the limits of the duty of communion described in canon # 209 § 1 of the Latin Code of 1983 and canon # 12 § 2 of the Code of the Oriental Churches’ Canons
