Pełny tekst źródłaInternet of Things (IoT) generates, connects and shares collected data from smart devices with various independent parties. With the increasing number of connected devices, its wide deployment is revolutionizing the modern world by covering almost every aspect of an individual's life. In this context, it is in the best interest of the community to successfully motivate users to share their IoT data with the rest of the environment, to allow the emergence of new services in different fields such as healthcare, education, or industrial manufacturing. However, requesting data to be able to extract valuable information from it can be a sensitive matter to approach. Therefore, framing requests and providing clarity on how this information will be used is necessary for building trust and credibility in connected environments. More precisely, when data providers decide to share their data with the community, they have little control over how their information are being used and in which context. In parallel, data consumers don't have the ability to trace back the different nodes by which the available data went through and its processing history to determine, for example, if it meets the technical and legal requirements of a given activity.Our research focus on three main challenges: (i) the definition of a semantic layer that handles the security requirements in the context of IoT data sharing, (ii) the enforcement of a context-aware security policy that matches both the data provider's preferences and the data consumer's usage, and (iii) the establishment of an end-to-end security solution that manage the sharing of IoT data in a decentralized architecture while eliminating the need to trust any involved IoT parties.To address these issues, we first present a context-aware IoT data Sharing Management ontology called IdSM-O, to establish a shared security vocabulary and handle the interoperability of IoT environments. Following that, we introduce a three-layer automatic semantic rule manager, that collects data provider's security policies requirements and automatically translate them to semantic rules ready for reasoning. Those contributions are the basement of IdSM, an end-to-end security framework for data sharing management during the phases of collection, transmission, and processing. Using this framework, we aim at addressing user's control enforcement over the owned smart devices, information security requirements, and obligation compliance between various parties in the IoT environment. Finally, we design, implement, and develop a prototype of the the proposal in order to prove its feasibility and analyze its performances

If the parliamentary logic exists, it still remains uncompleted on the european scale and lies in the only control of the commission, neglecting the real deciding institution, that is the council. So, the political control power does'nt correspond with the reality of the institutions. The whole procedure of the parliament, from a democratic point of view, consists on the "reconstruction" of it's ability. If it has been able to give itself the largest means for questionning the two executives, the sanction, limited to the only commission, still shows a democratical deficiency

Pełny tekst źródłaInformation technology offers a flexible support on which new organisational and collaboration structures, called Virtual Organisation (VO), can be built. Contrary to a classical organisation, the VO doesn't have a physical presence where its boundaries are flexible and even fuzzy, defined by its constituent members. These boundaries are defined within each organisation according to its strategy on how its services should be supplied. The deployment of the “Virtual Organisation” requires the definition of a security policy that indicates “who can do what” at the user-resource level as well as the administration level. This research work treats access control issues within the VO mainly addressing how to define a trans-organisational access control policy, how to specify a collaboration access control policy where entities (users and resources) are managed by independent partner organisations, and how to dissociate the partner internal structure from the VO structure to support multiple VOs simultaneously. For an unambiguous specification of access control policy, formal security models are of particular interest where formal tools may serve to reason about and verify the policy coherence. We argue that OrBAC (Organisation Based Access Control model) is an appropriate model for the VO environment. The major contribution of this thesis constitutes a new access control and administration model for virtual organisations on the top of OrBAC. A prototype is implemented to validate the proposal. The prototype integrates “Identity Federation” notion (using Shibboleth) and authorization infrastructure (using modified PERMIS) for enforcing access control within a Virtual Organisation

From now on, marine areas must be shared between the traditional users (fishing, marine cultures, sea traffic) and the new users of the sea (industrial activities, leisure), to whom is added an environmental use. Conflicts which arise from this competition in the use of these fragile environments require an intervention which needs to be increased and renewed by public authorities. Arbitration between these activities involves research by the authorities of a balance between the exploitation and the environmental protection of the sea. Despite recent reforms, the study of different administrations in charge of the sea has pointed out that the dispersed skills lead to the inefficient management of conflicts of use. Solutions are possible to optimize the organization and coordination in the State's policies on maritime affairs. These conflicts are then considered in connection with the regulation of the different activities. Preventing these conflicts of use requires that planned marine activities may be integrated into a management approach of the sea and the coast and improved by more effective tools and better coordination. However, after consultation, the development of European and national integrated maritime policies, applied at relevant scales, provide a better overall shared management of the sea. Finally, the resolution of these conflicts implies that civil society and the courts are more involved in the process and have to specialize

Also bound by the main objective of sustainability, the EC promotes stability and democratic governance by objectives through its global and pregnant juridical order. The EC can use the law of the sea in the areas it encompasses to strengthen European identity by integrating any object concerned by the sea and its law. Through a cybernetic frame, the integrated management of coastal zones (water, environment, fishery, navigation) may contribute to a coherent control of decentralised public policies. Control theory methods can be used to provide informations on properties of stabilization of an economic system as well as to determine measures of optimal economic policy. The first part of this work deal with problems of stabilization in economy by insisting on properties of the system studied. Among the set of concepts developed by systems theory,the controllability conditions of a dynamic system look as the fundamental link between the control theory and the theory of economic policy. The second part uses the economic system considered for the effective decision-making. The decision rule provided by the control theory is then optimal to the look of a criterion of choice represented by a given objective function. The objective function,that corresponds itself to a specific decision process,is studied. In particular,the research of information on the policy-maker's objective function(great economic policy orientations)can be apprehended by the inverse optimal control techniques. Linear models and quadratic objective functions must be used to formally describe the preceding methods

It promotes integration, by the subjects of an order of social practices, and organizes the traceability of human activities. But technology is not the only dimension of social control, whose effectiveness depends on the internalization of the symbolic order of dominant social relationships by the subjects. In organizations, managerial power seeking compliance behavior of employees working their representations, so that they become its relay on themselves, their colleagues and clients. Managerial devices are in the context of an economy of power based on the articulation of control and self¬ control. Think social control must lead to articulate three areas: the symbolic dimension of social relationships (order of discourse and ideology), the instrumental and technological dimension of social relationships (where the symbolic order materializes) and finally the question psychic without which we can not understand how cooperation in processes that they sometimes perceive themselves as alienating is born. Nowadays, most democracies have enacted laws to regulate their national system of political finances. The first part of the thesis presents the comparison of the legal frameworks between several foreign countries : the united states, germany, italy, canada, belgium, etc. Due to a call for openness in the financing of political parties and politicians, these recent legislations are based on similar principles. Control of political finances seems rather deceptive. The second part deals with french legislation. Several laws have been passed so as to establish a control of political finances. Due to this, french lawmakers have devoted considerable attention to this area : funds used by parties and politicians are theoritically scrutinized; jurisdictions can impose sanctions on guilty candidates. The third part studies the effectivness ot the new laws enacted in france since 1988. Despite some improvements, several aspects of the system of legal control are still questionable. Pełny tekst źródłaThe contractualisation's policy can be defined as a way of running an administration through which the objectives and results are agreed upon by those in charge of day to day operations and the directing body. This policy first appeared in the french administration towards the late 1960's but it has, only recently, made great progress in the health service. This Ph. D. Thus proposes to describe and give a legal analysis of this new policy. It will especially focus on two main aspects : first the multiyear contracts of financial means linked to precise goals that are passed between the hospitals and the local health authorites (agences régionales de l'hospitalisation) ; secondly, the contracts signed, within the hospital, between the directing body on one side and its different units on the other. These two new possibilities (art. L. 614-1 to L. 614-3 and L. 6145-16 in the new public health code) were created by the special law nʿ96-346 of April 24th 1996. The first part of the present study focuses on the history, the motivation and structure of these two contracts while the second part is devoted to a review of their method in different hospitals, six years later. It intends to discuss what problems have been encountered, specially on a legal level, as far as the definition of contracts, the actual extent of the devolution of powers, the possibility of the outcome of conflicts are concerned. Eventually, several recommandations are offered to hospital directors in order to make the most of this new policy

No study deals with the coherence and the rationality of the political decisions made in that respect. At the moment when the government sets up a legal strategy to estimate public policies, the analysis of the public policy of tax-control does not lack interest. The argument aims at knowing whether public authorities have devised a scheme of action setting to work the speciifc means in the field at stake. Respecting the declarative system and detecting tax fraud seem to be the targets. The analysis strives to discover the nonexplicit objectives and the unexpected results. Tax control exerts important effects on the social and economic environment, noticeably, more or less violent reactions, engendered tax injustices, the rise in tax rates because of the losses in benefits linked with the substractions from the tax. The political decisions result form contradictory pressures and from multiple choices. .

Different from what has been established by western legal systems, the private ownership has never been considered as a subjective natural right , not an absolute right. In addition, there exists a contradiction between the market economy and the socialism. The land use right was created under the circumstances aiming to encourage economic development without breaking with the socialist ideology. Therefore, the land use right and the public ownership interact with each other in a very original way. The land use right develops along with the economic demands. In order to extend the protection to private ownership, the Chinese Constitution is amended in 2004. Accordingly, the Property Law of 2007 explicitly recognizes the very nature of the land use right, and offers equal protection to both private ownership and public ownership. It is important to keep in mind that the recognition of such new element in Chinese Property Law raises many legal questions as well as political ones. What are the consequences of governmental land finance? Is there a need to address the issue of ineffectiveness in the protection of land use right against the State? How to respond to the dissatisfaction of the private person whose property is expropriated? All these questions lead us to the conclusion that the land use right is still far from a sac red right. It requests a further extensive reform. In our view, a comprehensive political reform is both necessary and unavoidable

Indeed, that control has not a lot of influence as much on the intervention's agents, because of their variety and their status, as in the intervention's method they use, because of their diversity and the often officious character. All the more, that control traditionnally faced to the separation's power principle for, number of the intervention's decisions are political. However judges have the means to exerce their functions in that spheare. At first, in public right, they can have a great influence on the balance between charges and advantages, on the general interest, and on the civil servant's personal responsability. In a second time, in private right, judges can control the state by the way of two ideas : real directing and explicit responsability. At last, in european right, a growth of the helps seems to be possible. Nevertheless, judges won't have the opportunity to adapt fastly themself to the state's interventions and particulary to sanction the state's attitude towards the wage earnings and the creditors. So, we must lay down the basis of a real control of economic right even if we are aware of the fact that it also will have for necessary limit the principle of "separation power"

Pełny tekst źródłaDans un tel contexte, l'instrument économique peut-il, avec d'autres outils, apporter un éclairage sur les motivations des acteurs et sur leur comportement ? En prenant pour exemple le Mont-Saint-Michel et le projet de rétablissement de son insularité, la thèse observe les visiteurs et met en lumière leur réaction face à un programme sur lequel ils n'ont encore ni une véritable information ni le moindre débat. La méthode appliquée ici a vu des expérimentations régulières aux Etats-Unis. Appelée évaluation contingente, cette méthode permet aux visiteurs d'exprimer leur acceptation d'un projet sous la forme d'une contribution monétaire fictive.
Les résultats obtenus appellent plusieurs discussions. La première porte sur les règles méthodologiques utilisées. Derrière les questions techniques, il y a la question de la validité d'une technique qui crée un marché fictif pour mesurer des impacts non marchands. La deuxième discussion considère davantage l'apport qualitatif fait au pouvoir public pour l'éclairer dans ses choix. Enfin, le dernier thème de débat s'engage sur la place des instruments économiques pour améliorer la prise en compte du public dans les décisions publiques. Avec un peu de provocation, il s'agit de poser si l'instrument économique a les mêmes aptitudes qu'un instrument démocratique.
L'ensemble de ces interrogations aboutit à un constat : en aucune manière l'instrument économique n'est en mesure de supplanter l'instrument démocratique. Le vote et la sanction du marché, même quand celui-ci est fictif, ont des dimensions trop éloignées. En même temps, il faut observer que l'instrument économique offre l'opportunité d'une meilleure information du public, dans un premier temps, et du décideur public ensuite.

Pełny tekst źródłaFrom 1937 to 1974 the prices of the products of the french iron and steel industry were controlled by the authorities, which is what the industrialists have considered as the major cause of the crisis the industry went through in the seventies and of its particular feature, that is, massive debts and, because of the worsening economic crisis, a growing insolvency of the firms. However, the detailed analysis of the different periods when price control was enforced leads to more qualified conclusions. The effects of the price control, limited during the front populaire period and even world war ii, are more traceable from 1944 to 1953 but cannot be held fully responsible for the increasing debts the firms got into. Similarly, however anachronistic the price control may seem after the opening of the common market, it won't appear fully inadequate until the 1960's when its inadequacies and contradictions added up. As for its being reinforced from 1969 to 1974 it is nothing more than an epiphenomenon. These changing trends thus strongly question the idea that the iron and steel industry lost money because of price control

The empirical part of this work is developed following two axes. The first one addresses the question of the institutionalisation of management control within the public sphere and in particular within local authority units. Therefore, a set of clues was sought for evidencing this feature. The second axis consists in a case study of local unit in which management control systems were developed for more than fifteen years. This research is based on the concepts of the analysis of public policy for providing a reading of the formal management control systems. One of the stakes of the analysis of management control practices would lay in the ability to analyse the required tools and their effects as well. Moreover, the conditions of success should be searched in the setting-up of the different steps and their implementation. The present study sheds some additional lights on studies carried-out previously in this field and allows to go beyond traditional approaches. Indeed, it is of interest for all types of local authority units and not only for municipalities. Moreover, the present study is of interest for a global system set up by a French ‘Départment’. Finally, a processual approach is therefore required

If exercise government control is equated with censorship, it certainly appears that this control is ineffective.The constitutional reform of 23 July 2008 aiming displayed to upgrade the parliament, dedicated his article to control function 24 of the constitution which now reads: "parliament votes the law. It controls the action of the Government. It evaluates public policies” To revitalize the exercise of parliamentary control, all instruments and exercise of control arrangements have been consolidated.In practice, appears a "new" type of control, modern control government action focuses on the performance of public policies, it is the program evaluation. Vis-a-vis with a requirement of increasing adaptation their traditional functions were deeply renovated. After being durably held with the variation of the Community businesses the Parliaments gradually asserted a major role on the matter. This request however durably " remained died letter ", and the attempts implemented in order to found an efficient control ran up against many obstacles, as well structural as of the economic situation. It is only after having carried out successive adaptations of the parliamentary instruments that a true control of the Community policy of the governments gradually could emerge. The current solutions remain nevertheless lacunar and of new projections are currently being studied

Pełny tekst źródłaThis thesis studies the changes in French and Swedish arms export policies since the end of the Cold War. It seeks to explain why we first observe a converging trend between the two states (1990-2005) and then a diverging trend (2005-2015). The thesis shows that the explanations for policy change do not stem only from international (economic and diplomatic transformations) or domestic factors (defence industry evolutions, arms trade scandals, government political shifts), but from the power struggles between “pro-support” and “pro-control” arms export coalitions. The intervention and succession of causal mechanism requiring actors’ political work is necessary to link the international and domestic factors of change to the observed reforms in arms export policies

Pełny tekst źródłaThis work is devoted to the study of the evolution of management accounting practices in Russian firms after the brake-up of 1992. We provide a review of academic literature published before 1992 and pertaining to management accounting practices that were implemented by firms in the former Soviet Union. However, this information has to be confirmed because of the censure at that time. In this respect, we carry out a research in the field with a sample of 16 firms which witnessed the transition period. We find different firms’ profiles according to the degree of change they experienced. We provide a detailed longitudinal study for the evolution of the firm Nizpham. Finally, we identify the factors that influenced change in management accounting practices following the brake-up in 1992

Pełny tekst źródłaDevelopment of management control is in the heart of the method of modernization of the public utilities. It influences at the same moment the good decision of allowance of more limited public resources and the recognition of the merits of staffs, key of their implication. The repeated failures are due to the application strictly speaking of methods of management stemming from private sector and in the incapacity of consideration of the human aspects. This thesis tries to show that the consideration of the specificities of local governments and the explicit integration of behaviour is the two keys of success of its emergence in local governments. The bibliographical review of the variable, models and concepts susceptible to be used a priori, allowed us to notice: method is little diffused (frequency of the use and range of the used tools), the weakness of the literature as for the implemented. In front of this theoretical deficiency, we made a notably sociological bend by authors not treating management control, but innovation and change. We retained two essential educations of it: the consideration of the complexity and the necessity of enlisting gradually all the actors. This work allowed us to reach a first model of method. Then we made a qualitative search on several detailed case studies, concerning projects led in past in city hall, and based on theories selected in the literature. We ended in an improved model and tested it in priori in ground " unknown. We were able to confirm again our model enriched in the previous stage. Our thesis also allowed to put in motto of specificities appropriate for the municipalities, notably political dimension, characterizing every actor, whom has to take into account the bearer of change. The issue off the research is that of the means used to control over the public attitude by the royal government, and during the periods of royal reaction of the means of the political reaction adopted. Developing the example of the Loire Inférieure department allows us to study the local political background while analysing the measures of political control and reaction, as they have been set in Nantes. The analysis of the political control and reaction is made on various grounds : on a theoretical ground first, thanks to a research of the spirit in which the means of control and reaction were set, but also thanks to a research of the judicial means used, whether legislative or solely administrative, whether led by the administrative, judicial or secret police. On a practical ground, a local approach of the issue allows to study the implementation of these measures in the departments, the instructions given by the various ministers, their receipt by the local civil agents in charge of the enforcement, and their impact on local life. What the history of the Bourbon restoration tells us is the necessity for the political power to be well up on the evolutions of public life, and above all to measure the consequences of a brutal political repression. Finally, the Bourbon restoration is above all exemplary of the evolution of the representative regime settled by the Charter of 1814 to parliamentarianism. Now, it is because the royal power ignored this evolution, and because an obsolete system of political control was maintained, that the legitimate monarchy fell

Pełny tekst źródłaThe dissertation gives an overview of exchange control in Poland for the period 1918-1989. The first subject discussed is the alternationg inter-war periods of a system of exchange control inherited from the first wold war, the introduction of convertibility (1922-1924) and the reintroduction of exchange conrol in the years World War II (1936-1939). There follows a description of exchange control which was maintained for the post-war period during the years 1944-1980, with an account the unification of the Polish monetary system in 1944-1945 and the return to exchange control legislation which reached its peak in 1952. This was followed by a period of easing-off during the years 1954-1980. The damage caused by maintaining an artificial rate for the Polish zloty, and the search of pragmatic arrangements with partial remedies for its non-convertibility along with the isolation of Poland from the world market are brought out. The effects of the Polish economic reform of 1982 on exchange control are presented in the next part, together with the partial abolition of the foreign trade monopoly and the introduction of more flexible echange control for companies (through the retention quotas for earmarket hard currency)- these along with the introduction of partial convertibility for private individuals. The future of the introduction of convertibility is studied in the last part, taking into account the disequilibrium in the balance of payments and the possible effects of adopted economic reforms. The external and internal equilibrium of the Polish economy can, however, come about only after the introduction of market mechanisms and, int the short term, after a major reduction of Polish hard currency debt

Meanwhile, the state maintains a large number of people in its dependence. The national integration between the urbanised coastline areas and the rural areas of the interior therefore exerts itself through the development of migrations, but also through a severe control originating from the state. The study of these policies in Kroumiria enabled us to disclose the historical role of colonial forestry in shaping a national state which thanks to this inheritance, was able to adopt the international recommendations about sustainability. While in the past the colonial state personified the forest, the authoritarian state of to-day personifies the environment. This thesis describes the manner in which environmental problems are dealt with and the manner in which they justify a social policy aimed at the countryside

Pełny tekst źródłaBeyond the enduring fantasies surrnunding the Napoleonic police and its Minister Fouché, no overall study had yet been devoted to the "high police" between 1799 and 1814. The period of the Consulate and the Empire is crucial, with the birth of a "high police", which did not consist in a specific police entity, but a mission: to ensure the survival of the State and its leader by removing individuals seen a dangerous. "High police measures" took three forms: preventive surveillance, detention without trial, and placing under "special surveillance" (house arrest). The authorities' speeches justified the existence of these extrajudicial and extra-legal measures by staging a threat - presented as exception. - and by introducing the need to reassure, stabilize and unify people. The "high police" then took a central place in the process of controlling the public mind and strengthening the power. Napoleon thus occupied an increasing role in the control and orientation of a police action entirely aiming at protecting his own person.The police development of partially new criteria on dangerousness, intertwining both political and social control, made it possible to build a surveillance with a panoptic purpose. This research combines history of representations and history "from below", studied at ground level. It challenges the vertical interpretation of a police regime, since preventive surveillance is also based on popular involvement, and its effectiveness can be qualified, on the scale of the Empire

In order to manage these difficulties, (horizontal and vertical) environmental regulations have gradually been created. The problem is that the actual situation of “waste” regulation cannot be strictly applied. The increasing number of legal rules favoured creation of a nexus which is difficult to understand. Solutions in waste treatment already exist and can offer numerous opportunities of management. Unfortunately, deep disagreements appear between actors, each trying to minimise the cost of treatment, putting the blame on the other. This situation is the consequence of a weakness in the waste definition: according to the considered approach, the definition seems to favour such actor or such factor. Finally, the recurrent element to theses disagreements lies on the conception of waste. In appearance, these definitions have nothing to share. Nevertheless, a deep analysis shows the need for a common denominator: this is the social demand. The former has reached to shape each approach of waste(historic, economic, environmental and legal)
