Increasing use of technologies in the last decades has created an unprecedented opportunity to systematically collect and use a wide variety of data (including personal data) for different purposes. Information and data collected and processed with the help of new technologies is used not only for the purposes of natural and legal persons but also for various other purposes. Intelligence services that ensure prevention of crime must perform their functions to ensure safety of public. When doing so, they use various means and methods of information collection, which help them to reach their goals. However, the means applied undermine and intensively restrict a person’s right to private life. Given that two legal interests compete during the application of criminal intelligence measures, i.e. the individual’s right to privacy and ensuring of public security, the Author seeks to analyse their points of contact – restrictions of application of criminal intelligence measures, which in theory are designed to ensure the person’s right to private life. In this article, the Author analyses the restrictions on the application of criminal intelligence measures, which are present in international, Lithuanian legislation and compares them with relevant requirements set forth in the practice of European Union Court of Justice. Pieaugošā tehnoloģiju izmantošana pēdējās desmitgadēs ir radījusi nepieredzētu iespēju sistemātiski ievākt un izmantot ļoti dažādus datus (ieskaitot personas datus) dažādiem mērķiem. Informācija un dati, kas ievākti un apstrādāti ar jauno tehnoloģiju palīdzību, tiek izmantoti ne tikai fizisko un juridisko personu vajadzībām, bet arī dažādiem citiem mērķiem. Izlūkošanas dienestiem, kas nodrošina noziedzības novēršanu, jāveic savas funkcijas, lai nodrošinātu sabiedrības drošību. To darot, viņi izmanto dažādus informācijas vākšanas līdzekļus un metodes, kas viņiem palīdz sasniegt savus mērķus. Tomēr izmantotie līdzekļi nereti grauj un intensīvi ierobežo personu tiesības uz privāto dzīvi. Tā kā kriminālizlūkošanas pasākumu piemērošanā sacenšas divas likumīgas intereses – personas tiesības uz privātumu un sabiedrības drošības nodrošināšana –, autore cenšas analizēt to saskares punktu – kriminālizlūkošanas pasākumu piemērošanas – ierobežojumus, kas teorētiski ir izstrādāti, lai nodrošinātu personas tiesības uz privāto dzīvi. Šajā rakstā autore ir izvēlējusies analizēt kriminālizlūkošanas pasākumu piemērošanas ierobežojumus: (1) obligāta iepriekšēja kontrole (sankcija) noteiktam kriminālizlūkošanas pasākumam, ko veic tiesa vai neatkarīga administratīva vienība; (2) kriminālizlūkošanas pasākumu ilguma ierobežošana; (3) kriminālizlūkošanas pasākumu samērīgums. Rakstā secināts, ka, kaut arī šie kriminālās izlūkošanas piemērošanas ierobežojumi likuma izpildes direktīvā parasti nepastāv, tie ir ietverti Lietuvas Republikas likumā par kriminālo izlūkošanu. Tomēr ar tiem var viegli manipulēt un tie nenodrošina tiesības uz privātās dzīves efektīvu aizsardzību.

John Finnis's powerfully and deservedly influential modern classic, Natural Law and Natural Rights, expounds a theory of law and morality that is based on a picture of “persons” using practical reason to pursue certain “basic goods.” While devoting much attention to practical reason and to the goods, however, Finnis says little about the nature of personhood. This relative inattention to what “persons” are creates a risk—one that Finnis himself notices—of assuming or importing an inadequate anthropology. This essay suggests that the “new natural law” developed by Finnis suffers in places from the inadvertent adoption of (or, more likely, acquiescence in) a flawed anthropology—an anthropology under the thrall of modern individualistic commitments. To explain this suspicion, this article discusses three difficulties (or so they seem to me) in his natural law theory: difficulties in accounting for the basic good of friendship, for obligations we owe to others, and for legal authority. These difficulties may seem disconnected, but this article suggests that they may all reflect an inadequate anthropology—one that Finnis does not exactly embrace (in fact, I suspect that he would reject it) but that is pervasive today and that in places may affect his theorizing.

The terms glava (head, caput, kephal?), or sometimes kapa (cap, hood) are used in Serbian legal sources to designate natural persons (individuals). In Serbian mediaeval law, it was mostly churches and monasteries that had the trait of legal persons (entities). Beside them, towns, villages, counties and districts, had some characteristics of legal persons.

The article is devoted to the analysis of law enforcement agencies’ activities to search for missing persons. The purpose of the study is to examine the peculiarities of the analytical work of law enforcement agencies on missing person’s search. The methodological bases are general scientific and special scientific methods and techniques of scientific knowledge (systemic, formal-logical, structural-functional, sociological, historical and axiological). It is concluded that the criteria for law enforcement agencies to search for missing persons are the general state of search work, search for certain categories of missing persons, trends and processes that cause missing persons, causes and conditions of missing persons, results of police operations and special operations conduct. It is determined that the consolidation and combination of efforts of different units and services during the search work helps to increase the number of facts of locating missing persons. Attention is paid to the identification of factors influencing the assessment of the search work. The state of the international search missing persons is analyzed. The necessity of using the positive experience of European countries in the outlined activities is substantiated.

The article is dedicated to revealing the efficiency of legal documents concerning provision of help to internally displaced persons on the example of work carried out by the Department of social protection of the population in Poltava area. The legal framework of Ukraine is viewed in terms of ensuring rights and freedoms of the internally displaced persons; it is accentuated on an internally displaced person’s obligation to fulfill the duties stipulated by the Constitution and laws of Ukraine; statistical data are supplied as to the number of internally displaced persons in Poltava area and the number of social protection workers whose work is linked with rendering quality social services to vulnerable categories of citizens including internally displaced persons (19 territorial social protection centers and 36 centers for rendering social services ensure servicing of 4.5 thousand internally displaced persons); it is proved that a characteristic feature of the social protection field in Poltava area is the systematic approach, owing to which the Complex program for social protection of the Poltava area population is implemented successfully. The quality implementation of laws and resolutions of the Cabinet of Ministers of Ukraine as to rendering assistance to internally displaced persons in the work of the Department of social protection of the population in Poltava area is highlighted.

The aim of the paper is to propose that special mental health laws be replaced by generic protection and prevention legislation. The arguments used for the detention and compulsory treatment of persons with mental illnesses are analysed, and found not to justify protection and prevention rules which apply only to persons with mental illnesses. Two separate systems of legal intervention should be established to deal with (1) all persons in need of compulsory care and (2) all persons who require to be detained for the prevention of harm to others.

Drawing from Roberto Esposito's recent work on persons and things, this Article studies recent attempts to rethink international legal personality. Esposito's work resurrects the claim that personhood operates like a mask, splitting the legal and philosophical world into persons and things. International law differs from domestic law in that international legal personality has traditionally been the prerogative of states, not of (rational) individuals. Yet, this has not completely dismantled the persons/things logic, because the exclusive legal personality of states has continuously threatened to reduce individuals into things in the eyes of international law. It is perhaps for this reason that international legal theorists have long sought to extend international legal personality to individuals and other non-state actors. This Article addresses the most recent attempt, namely an attempt to shift international law towards a law of humanity. Without taking a stance on whether this project is a good idea or not, this Article raises some doubts about whether the concept of international legal personality can help in fulfilling the project's aim, namely to help increase human freedom and wellbeing. This is especially relevant because, regardless of whether legal personality is attributed primarily to the state or the individual, we still remain—according to Esposito—within a theoretical framework in which the dispositif of person necessarily excludes some forms of life in protecting or empowering others.

The right on the same position on the law means that every citizens including disabilities persons have the same change to use their rights regulated by the institution. Indonesia government has signed Convention on the Rights of Persons with Disabilities in March 30, 2007 in New York. That even shows the strong intention of Indonesia country to respect, save, fulfill, and develop the disabilities persons’ right to fulfill the welfare of the disabilities persons. There is a case happened in Sukaharjo in the decision No. 18/Pid.B/PN.SKH/2013 about a crime defeated the disabilities person. This study employed library research design. The finding shows that the judges in the decision Nomor 28/Pid.B/PN.SKH state that the defendant convicted 8 years 6 months. The decision can be used as jurisprudence for other judges in examining the same case in order to avoid criminal disparity. In a further development, the criminal appeals to the High Court in Central Java, and in the High Court, Decision No. 244 / Pid 2013 / P.T.Smg actually strengthens the High Court Decision Sukoharjo with 10 years prison. Based on this decision it should increase the capacity of law enforcement agencies in the fulfillment of the right to a fair trial for persons with disabilities must be done. It aims to introduce the concept of disability to law enforcement officials, provide an understanding of human rights, especially the rights of persons with disabilities to law enforcement officials, as well as provide expertise (skills) to law enforcement authorities on the way and methods to fulfill the accessibility of persons with

This study examined predictors of attitudes of law students toward persons with disabilities. The proposed regression model, which included, frequency of interaction with persons with disabilities, familiarity with the Americans with Disabilities Act of 1990 (ADA), and level of comfort with establishing relationships with persons with disabilities was explored through a questionnaire, the administration of the Scale of Attitudes Toward Disabled Persons-Form R, and the Relationships with Disabled Persons Scale. Participants were 189 law students at a university in the Southeast. Usable responses were received from 164 students. Using multiple regression analysis, attitudes toward persons with disabilities were significantly explained by familiarity with the ADA (p < .05) and comfort with establishing intimate relationships with individuals having disabilities (p < .05).

Persons with dementia often prefer to participate in decisions about their health care, but may be prevented from doing so because healthcare decision-making law facilitates use of advance directives or surrogate decision makers for persons with decisional impairments such as dementia. Federal and state disability law provide alternative decision-making models that do not prevent persons with mild to moderate dementia from making their own healthcare decisions at the time the decision needs to be made. In order to better promote autonomy and wellbeing, persons with dementia should be accommodated and supported so they can make their own healthcare decisions.

There exists a strong synergy between the regulation at the international level of minority rights, asylum and criminal prosecutions of violations of human rights. The aspirations of minorities as a human right are recognised in the International Covenant on Civil and Political Rights while the violation of such a right can confer on a victim the status of refugee in a third country. As well, persons who are responsible for causing very serious disruptions to the rights of minorities and other groups can be brought to justice for the commission of genocide and crimes against humanity, particularly persecution. While in general there has been a clear distinction between the granting of asylum or refugee status to victims of persecution one hand and the prosecution of perpetrators of persecution on the other, these two notions have been brought together into the concept of exclusion in order to address the phenomenon of persons with a criminal background being part of the refugee stream arriving in a third country. Exclusion is an essential part of refugee law to ensure that persons who have committed criminal acts will not benefit from the benefits set out in the Refugee Convention. This article will discuss the parameters of exclusion as determined by the jurisprudence in six countries in North America and Europe where this issue has been at the forefront in the last decade.

The article reviews the issues of carrying out economic activities by juridical persons, their participation in civil-law transactions. The article touches upon the issues of carrying out business activities by non-profit organizations. The article investigates the problem of legal capacity of juridical persons, competencies of their bodies and the nature of juridical persons. The author considers the issues of performance of juridical persons’ civil obligations by their employees. The author concludes that the civil legislation regulates three groups of relations (activities): property and personal nonproperty relations, entrepreneurial activity and corporate relations. These separate legislative bodies represent accordingly the civil, entrepreneurial and corporate law. Thus, the Civil Code and the civil legislation embody three separate branches of law.

Abstract The article, adopting an innovative approach to the law of the sea, discusses the place and role reserved to persons in the United Nations Convention on the Law of the Sea (LOSC) and the legal regime of which it is a part. The LOSC and other law of the sea agreements are examined, focussing on provisions that mention persons, their rights and their duties. Shortcomings identified include: the difficulty to configure persons as the beneficiaries of rights and the recipient of duties and the ensuing uncertain subjectivity of persons under the law of the sea; the presence of numerous gaps and inconsistencies in the existing legal regulation; the unavailability of mechanisms to address violations of duties by states. The conclusions draw attention to the potential of the LOSC and other treaties to further develop the international legal regime applicable to persons at sea and to provide an adequate place for persons in the law of the sea.

AbstractI compare three sorts of case in which philosophers have argued that we cannot assert the Law of Excluded Middle for statements of identity. Adherents of Smooth Infinitesimal Analysis deny that Excluded Middle holds for statements saying that an infinitesimal is identical with zero. Derek Parfit contended that, in certain sci-fi scenarios, the Law does not hold for some statements of personal identity. He also claimed that it fails for the statement ‘England in 1065 was the same nation as England in 1067’. I argue that none of these cases poses a serious threat to Excluded Middle. My analysis of the last example casts doubt on the principle of the Determinacy of Distinctness. While David Wiggins's ‘conceptualist realism’ provides a metaphysics which can dispense with that principle, it leaves no house-room for infinitesimals.

The author in his article analyses person’s rights to finalization of criminal proceedings within a reasonable period of time in case of criminal proceedings against several persons. In analysis the author provides an overview of legislation, regarding finalization of criminal proceedings within a reasonable period of time, reflects conclusions made, regarding the initial and final point of criminal proceedings within a reasonable period of time, provides a description of judicature, regarding finalization of criminal proceedings against several persons and points to the problems related to finalization of criminal proceedings against several persons within a reasonable period of time. In the end author concludes that as soon as there are few persons involved in criminal proceeding, who have right to defense, the provisions of Law on Criminal Proceedings become ineffective and constitute a menace to person’s rights to finalization of criminal proceedings within a reasonable period of time.

AbstractThe systematic protection of persons at sea remains flawed. This problem has become even more acute during the Covid-19 pandemic when port closures have caused an unprecedented humanitarian crisis at sea. This article looks at the impact of port closures on the rights of persons at sea and considers how international law can protect those rights. While persons at sea are afforded significant rights protections in international law, the rights and duties of States often clash, with the result that persons at sea can find themselves in something of a legal vacuum. In order to address this problem, this article argues that the various rights and duties of States must be interpreted and applied in a way that fully recognises the rights of persons at sea.

Abstract Whenever one person’s conferral of a benefit on another is subject to a condition that the conferee not be married to a particular person or to a member of a specified class of persons, the question of whether the condition is enforceable is said to be a question of ‘public policy’. This ‘policy’ question is fundamentally a question of whether enforcing the condition contradicts or undermines any of the norms concerning the conduct of married persons to which the law is committed. It is not a question of whether enforcing or not enforcing the condition in the particular case would advance a more general social goal of encouraging marriage and discouraging divorce. A principle of preserving the coherence of the law—that the law ‘refuses to give by its right hand what it takes away by its left hand’—is the animating principle of both the marriage condition cases and the illegality cases.

The legal person, now a distinct institution in its own right, regulated as such in the Romanian Civil Code, is the result of a long process of modernisation of Romanian legislation, but also of its harmonisation with international regulations which unanimously recognise the legal person as a subject of law. The notion of legal person was born in private law and has been and is used in all branches of law. Legal persons are distinct subjects in civil law or commercial law legal relationships. The legal person is a subject of law with a wide scope in the legal circuit. Commercial companies, autonomous companies, companies, are participants as legal persons in private law relationships. Legal persons are the entities provided for by law, as well as any other legally-established organisations which, although not declared by law to be legal persons, fulfill all the conditions provided for by the Civil Code and the relevant legislation. The present article aims to present the specific rules for the establishment and functioning of a legal person, as well as issues related to classifications and constituent elements, and to their liability for legal acts or deeds performed.

AbstractEnvironmentally displaced persons can be included in several existing categories of protected persons under international law, but there may be a normative protection gap for many of those who cross an international border. This article looks at protection possibilities within the EU framework and national European legislations. Environmental displacement can arguably trigger temporary protection according to the EU Temporary Protection Directive. There may also be environmentally displaced persons who require longer-term or permanent protection. Drawing on the EU Qualification Directive and case-law from the European Court of Human Rights, one can argue that subsidiary protection should be granted in certain cases of extreme natural disaster or degradation. In less extreme cases, humanitarian asylum could be granted. Human rights principles such as non-refoulement could also be used to extend at least basic protection. In addition, legal labour migration could supply a work force, assist distressed countries and enhance protection of the individual. A strategy to meet the challenge of environmental displacement must also include climate change mitigation and external measures such as adaptation. Most of the displaced persons in the world today and in the near future do not arrive at the EU borders.

Article 44 paragraph (4) of Law No. 24 of 2013 it is not clear which judicial body has the authority to determine the unclear whereabouts of a person because of missing or dead but his body was not found. For this reason, this research focuses on 2 (two) problems. First, the practice of civil justice regarding applications for the determination of missing persons. Second, the meaning of the authority to adjudicate in the practice of civil justice regarding applications for the determination of missing persons. This research is included in the theoretical research using a statute approach, case approach, and conceptual approach. The results of this study answer 2 (two) problems. First, in examining and adjudicating cases of petition for the determination of missing persons, the general court uses rules regarding the state of absence (afwezig) according to Article 467 and Article 468 of the Civil Code, while religious courts use a legal basis relating to inheritance law. Second, to examine and adjudicate cases for the application of missing persons, the authority of the general court is based on Article 467 and Article 468 of the Civil Code, while the authority of the religious court body still requires interpretation of the judge's law on the subject matter, namely whether it has a connection with inheritance law or not. The case for appealing the missing person, as long as it is related to inheritance law, can reopen the option for Muslims to choose which judicial body to obtain legal certainty regarding the person's absence.

Mūsdienās tiesības uz privāto dzīvi nepieciešamas ikvienā demokrātiskā sabiedrībā, un šo tiesību iekļaušana konstitūcijā juridiski garantē fiziskas personas rīcības brīvību un vienlaikus arī citu – valsts pamatlikumā noteikto – cilvēka tiesību īstenošanu [5]. Personas datu aizsardzības institūts tika izveidots, izpratnes par tiesību uz personas privātās dzīves neaizskaramību saturu paplašinot 20. gadsimta 70. gados, kad vairāku Eiropas valstu valdības uzsāka informācijas apstrādes projektus, piemēram, tautas skaitīšanu u. c. Informācijas tehnoloģiju attīstība ļāva arvien vairāk informācijas par personām glabāt un apstrādāt elektroniski. Viena no tiesību problēmām bija informācijas vākšana par fizisku personu un tiesību uz privātās dzīves neaizskaramību ievērošana. Lai nodrošinātu privātās dzīves aizsardzību, atsevišķas Eiropas valstis pēc savas iniciatīvas pieņēma likumus par datu aizsardzību. Pirmie likumi par personas datu aizsardzību Eiropā tika pieņemti Vācijas Federatīvajā Republikā, tad Zviedrijā (1973), Norvēģijā (1978) un citur [8, 10]. Ne visas valstis pieņēma likumus par datu aizsardzību vienlaikus, tāpēc Eiropas Padome nolēma izstrādāt konvenciju, lai unificētu datu aizsardzības noteikumus un principus. Nowadays, the right to privacy is indispensable in every democratic society and inclusion of such rights in the constitution, guarantees legally freedom of action of a natural person and, simultaneously, implementation of other human rights established in the fundamental law of the state. The institute of personal data protection was established by expanding the understanding of the content of the right to privacy in the 70’s of the 19th century, when the government of several European countries initiated information processing projects, such as population census etc. For the development of information technology, more and more information on persons was kept and processed in electronic form. One of the legal problems was gathering of information on natural persons and the right to privacy. In order to ensure the protection of privacy, separate European countries, on their own initiative, established a law on data protection. The first laws on the protection of personal data in Europe were established in the Federal Republic of Germany, then in Sweden (1973), Norway (1978) and elsewhere. Not all countries adopted laws on data protection at the same time, so the Council of Europe decided to elaborate a convention to unify data protection rules and principles.

In the 10 years since Australia has ratified the United Nations Convention on the Rights of Persons with Disabilities (CRPD), the issue of the indefinite detention of persons with cognitive disabilities found unfit to stand trial has received considerable attention. Concerns have been raised by national media, law reform bodies and United Nations human rights agencies. Yet there remain few examples of formal change to unfitness to stand trial laws in Australia. This article focuses on the role of procedural accommodations in meeting CRPD requirements, and other accessibility measures to ensure accused persons with cognitive disabilities are able to take part in criminal proceedings on an equal basis with others. It examines support measures that appear in existing statute and case law within Australia and considers the need to develop new forms of support.

In the paper the author attempts to describe the issue of refugees as a very important problem in international law, a problem which generates profits e.g. a rise in human capital, as well as losses e.g. costs, for the countries involved. The balance depends on the policy of a given country, whether this country is able to capitalize on the human capital or whether it is only counting costs. Sometimes obligations resulting from international law are not sufficient to convince societies that accepting refugees is the right decision. The paper will focus on how, with appropriate legislative tools, the united world can help people who are in danger. The author will also pose a question whether enough is being done, or whether the scope and methods currently in use should be amended. The paper discusses the issue of refugees from the perspective of various organizations involved i.e. global institutions like UNHCR, European Union institutions, non-government organizations (NGOs) and contains a review of relevant legal acts such as the Treaty of Lisbon, the Geneva Convention etc. The author also touches upon the practical side of the refugee policy execution in various countries.

There is a link between a presumption of innocence and the right to a fair trial. The rights of a legal person, to be regarded as innocent, protection is ensured by the guarantees in law. The Court of Justice has recognized that the right to the presumption of innocence, the legal persons does not apply in the same way as natural persons. The Constitution reinforces the presumption of innocence is to be subject to the right to a fair trial arising from the principle of justice. The Constitution stipulates that the rights of the person may be limited to the benefit of the public, but not the right to the presumption of innocence. In the article the author expresses the conviction, nowadays, the development of such rights, – the environment, animal, unborn children, deceased persons and other types of law; it is obvious that, on the basis of an equity principle, human rights are extended translated and applied. Justice fully embraces the principles of equality law, which allows concluding on the physical and legal persons to equality before the law and the courts.

This article examines and analyzes law enforcement in criminal acts committed by children. Law enforcement has always been preoccupied with general and conventional crimes committed by adults. In fact, along with the development of society and technology, several criminal cases have been committed by children. Considering that children need protection to grow and develop optimally, children who commit crimes must be given special treatment in terms of procedural law, criminal threats, and fulfillment of childrens rights, which are different from adults. This research is normative and empirical juridical research with a socio-legal approach. Primary data collection was carried out by interviewing sources determined through the snowball technique, while secondary data collection was carried out by library research. The collected data is then processed through the stages of checking, tagging, compiling, and systematizing. The data that has been processed is then analyzed interactively, which consists of description activities and data reflection.Challenges to law enforcement against perpetrators of criminal acts in Indonesia include the high tendency to detain and imprison children, violations of childrens right to a fair trial, and the demands of prosecutors and judges decisions are still dominated by prison sentences.The strategy for law enforcement against child perpetrators of mass crimes is based on a humanist legal approach through issuing sentencing guidelines and adopting the concept of children hearing system, optimizing the role of the police in implementing diversion, and optimizing community participation in child protection.

Este estudio se sus-tenta en una jurisprudencia reciente –si bien consolidada– del TJUE en la que se garantiza no sólo el desplazamiento sino también el reconocimiento de situaciones privadas en el espacio europeo, y ello con independencia de la regulación material o conflictual del Estado miembro de acogida. This essay examines how EU criminal law, which regulates certain aspects of criminal procedural law of the twenty-seven EU member states, addresses the situation of persons with disabilities who come into contact with the criminal justice system. EU law on victims and on suspects and accused persons (partially) addresses disability through the prism of “vulnerability.” This essay argues that associating persons with disabilities with “vulnerability” can be stigmatizing. Moreover, the Convention on the Rights of Persons with Disabilities (CRPD), which requires that persons with disabilities have effective access to justice and receive appropriate accommodations, does not link these rights to a prior recognition of “vulnerability.” Even though the EU is a party to the CRPD, the 2013 Recommendation from the European Commission on Procedural Safeguards for Vulnerable Persons Suspected or Accused in Criminal Proceedings, frames disability in terms of “vulnerability.” In contrast, parts of the EU Victims’ Rights Directive address the situation of individuals with disabilities without using the language of vulnerability.

Access to Justice for people with disabilities is a term used to describe the legal protection given to persons with disabilities in their efforts to meet their needs from things that can endanger persons with disabilities themselves.The right to obtain employment including for workers with disabilities is regulated in the Indonesian state constitution. Therefore, these rights are protected and guaranteed by law, so companies that employ persons with disabilities in particular must protect the rights of persons with disabilities.The method used in this study is this research is a type of normative law research using normative legal case studies in the form of legal behavior products. Persons with disabilities must receive the support needed in the structure of education, health, employment and social services, so that the rights of persons with disabilities are in the perspective of human rights. Normatively, there are actually several legal instruments that have been born to protect the rights of persons with disabilities to work. Direct discrimination, indirect discrimination, harassment and instigation to discrimination have been identified as forms of discrimination at social level. At the level of international society, preventing and combating any form of discrimination by resorting to the most appropriate legal measures represent a concern even today. The right on non-discrimination prohibits those cases whereby persons or groups of persons in a similar situation are treated differently, and situations where persons or groups of persons in different situations are treated in the same way. The aim of the right on non-discrimination is to guarantee to all people equal and fair prospects of access to the opportunities granted by the society. The principles of anti-discrimination must be included in every product of legislation, including the employment regulation for persons with disabilities in Indonesia. Anti-discrimination in employment regulation for persons with disabilities have been included in the Indonesian constitution. In addition, it has also been adopted in various articles on legislation,regulating about employment for persons with disabilities, namely Law Number 3 of 2013, Law Number 19 of 2011 and LawNumber 8 of 2016. In substance, the law that guarantees the rights of persons with disabilities in a number of laws and regulations in Indonesia is sufficient. However, the regulation in Law Number 13 of 2003 on The Labor Law is not yet clear. Adjustments need to be made on Law Number 13 of 2003, Law Number 19 of 2011, and Law Number 8 of 2016. The need for the many provisions of labor laws that have not been implemented, thus it requires affirmative action to realize equal opportunities in all aspects of life and livelihood for persons with disabilities.</p>

In Indonesia, persons with disabilities have long been marginalised in mainstream development policies. The adoption of the United Nations Convention on the Rights of Persons with Disabilities (crpd), which was ratified by Indonesia in 2011, has opened new opportunities for persons with disabilities in the country to participate in the development process. In this regard, the first step toward the implementation of the convention domestically has been undertaken through the enactment of Law No. 8/2016 on Persons with Disabilities where the provisions of the convention are directly adopted. This article traces the development of the new law and how it differs from the previous legislation. We find that the new law is moving away from a long-standing paternalistic view toward disability in Indonesia by advancing a rights-based approach. Despite this substantial change, it remains to be seen how the new law would be able to change the challenging conditions of persons with disabilities in the country.
