Pełny tekst źródłaThe research on the legitimacy and effectiveness of the HRC stems from the observation that there is a deep lack of knowledge regarding the scope of its mission, which has a negative impact on it. This study shows that despite the limits imposed on this body by the ICCPR, its work has a very significant impact on the international human rights protection. To achieve this end, the HRC adopted interpretation methods that have earned it the attention of others bodies, strengthening by the way its legitimacy. Pursuing the same goal, in order to overcome the non-binding nature of its decisions, it endeavors to give its activity the impression of that of a formally court-like function with the purpose to facilitate States’ compliance by the degree of authority with which they are endowed. However, we propose that if States do not take a new step by setting up a single international court in human rights field, it is an urgent that the UN treaties bodies system, as it known today, be rationalized for the individual’s interests. As the effectiveness of human rights dependent on States willingness, the solution against the current pitfalls requires a large-scale political project supported by them

Both have opted for different methodes of designation of their presidents, each one being influenced in its choice by the requirements of its internal structure and the political role it is called upon to assume. The two presidents have exercised their functions mainly within the limits of the debates. Nevertheless, they have also intervenedin the accomplishment of their task by the two organs, either by facilitating the consultations between their respective members, or even sometimes, by contributing to the peaceful settlement of disputes

Pełny tekst źródłaThe legal system of the european community's participation in the main bodies of the united nations is determined by the scope of the community's external powers and by the rules of the un governing membership conditions. The community's participation in these bodies is a legal and practical necessity to achieve the goals of the treaty of rome. This requirement is reinforced by the treaty on the european union, which enhances and enlarges the external powers of the community and the european union. On the one hand, the community has exclusive or parallel competences in many fields of action of the un. And on the other hand, as an regional legal order, community law is subordinated to the un's universel legal order. Since the un reservers membership solely to nation states, the community has only been able to abtain observer status in the general assembly and the ecosoc. This status puts the community on the same level as other intergovernmental organizations, and does not reflect its exceptional situation in the international legal order, nor does it permit the community to exercise its external powers in conformity with community law. This position also deprives the community of the possibility to participate in proceedings before the international court of justice. However, progressively the community has been admitted to participate with a similar status to nation states, in conferences and treaties convened by the un. The obtaining of full membership in the fao constitutes an important precedent for the evolution and the future draft of the community's legal status within the un main bodies and specialized agencies. An enhancement of the community's status in those bodies, which is more and more pressing, can only be realized by an extensive reinterpretation or by revision of the un's charter

Pełny tekst źródłaA new dynamic has been introduced by the united nations in the negotiating process for disarmament which offers new possibilities for future negotiations : presentation of reforms introduced in the international negotiating mechanism for disarmament during the first united nations special session on disarmament. An observation of the negotiations between 1978 and 1986 on the two main subjects - nuclear tests and chemical armaments - show the failure of the United Nations negotiating process for disarmament. This failure results from defects of the mechanism itself and from the weakness of the political will which is absolutely necessary to every disarmament negotiation

Pełny tekst źródłaThe acts providing for objective regimes, particularly status treaties, the characteristic of which is their effect erga omnes, affect directly the fundamental principles of privity of agreements and the freedom of contract of the state. Though the rule of pacta tertiis nec nocent nec prosunt is absolute, the existence of acts which have created objective regimes to be opposed to all is a fact evidenced by the practice of states. The legal rule does not seem to be questioned, but to attempt to build a theory of objective situations on specific legal basis is a difficult task. The international law commission has not been able to overcome this difficulty, and has refused to codify the status treaties, while admitting that some legal situations are governed by such acts without providing for appropriate legal grounds. The use, in the past, of treaties creating obligations on states which are not parties to an agreement or which have not expressly consented to the provisions of an unilateral act has been an obstacle to their codification. Nonetheless, there remains a problem for, paradoxically, the notion which is not codified in the field of the law of treaties does not seem, considering the travaux preparatoires, to have been abandoned the custom being referred to solve such problems

Pełny tekst źródłaThe empirical construction of the United Nations human rights treaty system was based on a minimum consensus among states. Treaty bodies and monitoring procedures of treaty obligations are part of this consensus. Besides the reporting procedure, States parties have reached consensus on an individual complaints procedure. The procedure emerged after polarization and hesitation among States over the establishment of an international human rights court and the status of the individual in international law and was reproduced in without major modifications. So individual complaints procedures under United Nations human rights treaties have common procedural and institutional features. Furthermore, treaty bodies have engaged in a process of harmonization of their working methods giving us reason to be optimistic about the unity of United Nations human rights treaty system. Besides common institutional and procedural aspects, the latest treaties establishing individual complaints procedures codify the evolutionary practice of older treaty bodies, especially the Human Rights Committee. By affirming their determination to protect the object and purpose of human rights treaties and to guarantee the effectiveness of individual complaints procedures, treaty bodies strengthen implicitly the judicial aspects of the procedure. However, in the absence of judicial authority and other institutional tools for imposing on States parties’ treaty obligations, the treaty bodies are forced to seek the right balance between firmness and diplomacy without being able to ensure States parties’ cooperation. Nonetheless, observance of treaty obligations under the individual complaints procedure is a part of a long and continuous process in which treaty bodies due to their expertise and competences have a predominant role. The standardization of the individual communications procedure in the United Nations human rights treaty system strengthens the position of the individual in international law and foregrounds victims that have long remained in the shadows. By asserting their authority to interpret treaties and to ensure the effectiveness of the individual communications procedures, the treaty bodies contribute to the universalization of normative principles and their effective and coherent implementation

In 2017, an UNCITRAL working group confirmed its concerns about the "incorrect" and "inconsistent" interpretations of investment treaties in Investor-State Dispute Settlement (ISDS). This thesis firstly invites to reconsider the concept of "correct" interpretation in application of the rules of interpretation of the 1969 Vienna Convention. The second step is to identify possible vectors of coherence within ISDS (control of awards and use of precedent). The third and final part aims to analyze the effects of the procedural and substantial reforms which have already been announced

Pełny tekst źródłaHuman rights treaties have been adopted at the end of the first half of the XXth century, in a technological, social and economic context which has since then deeply evolved. To maintain the effectiveness and relevance of those treaties, specialised jurisdictions have therefore increasingly interpreted their provisions in light of current living conditions. This method, called evolutive interpretation of treaties, is still looked at with suspicion. Indeed, it is not recognised by the Vienna Convention on the law of treaties and it may lead the judge to depart from the parties intention as expressed in the text of the convention. The evolutive interpretation of treaties invites therefore to reconsider the international judge’s interpretative function, between its strict theoretical conception and the empirical needs of contemporary international law
