Critics of national injunctions are lining up. Attorney General Jeff Sessions labeled these injunctions “absurd” and “simply unsustainable.” Justice Clarence Thomas called them “legally and historically dubious,” while Justice Neil Gorsuch mockingly referred to them as “cosmic injunctions.” Scholars in leading law reviews have called for their demise. Critics argue that national injunctions encourage forum shopping, unfairly burden the federal government, and depart from the history of equity. They also claim that national injunctions contradict the Supreme Court’s decision in United States v. Mendoza to exempt the federal government from offensive nonmutual issue preclusion—a doctrine that permits nonparties to benefit from a prior finding against a party from an earlier case. Critics are right to identify the connection between national injunctions and nonmutual preclusion. Both of these doctrines describe when judgments can benefit nonparties. But critics are wrong to see Mendoza as an argument against national injunctions. For one thing, the rise of nonmutual preclusion that prompted Mendoza undercuts crucial arguments against national injunctions by offering an alternative explanation for the absence of analogous injunctions in the history of equity. For another, Mendoza was not preordained; instead, it was a highly policy-driven decision. And Mendoza’s policy arguments were dubious when it was decided and even more dubious today. Scrutinizing these arguments should make us less comfortable in extending Mendoza to a new context—as the Supreme Court may be poised to do. Indeed, this Article goes one step further. The Supreme Court or Congress should take advantage of the attention on nonparty relief to reconsider, and overrule, Mendoza. Federal-government litigants do not deserve special treatment with respect to preclusion in every case, and the existing rules of preclusion adequately protect the interests purportedly at stake in Mendoza. Moreover, rejecting Mendoza has feedback effects for the national-injunctions debate. Overruling Mendoza would not only reduce the need for national injunctions (because preclusion could do some of the work) but also provide a framework for limiting national injunctions without eliminating them completely. This is especially important given recent decisions that make relying on class actions a tenuous response. More generally, overruling Mendoza would create a system that is fairer to governmental and nongovernmental litigants alike while reaffirming each branch’s role in the making of national policy.

The rise of the major questions doctrine—the rule that says that in order to delegate to the executive branch the power to resolve a “question of ‘deep economic and political significance’ that is central to [a] statutory scheme,” Congress must do so expressly—threatens to unmake the modern executive’s authority over foreign affairs, especially in matters of national security and interstate conflict. In the twenty-first century, global conflicts increasingly involve economic warfare, rather than (or in addition to) the force of arms. In the United States, the executive power to levy economic sanctions and engage in other forms of economic warfare are generally based on extremely broad delegations of authority from Congress. The major questions doctrine (MQD) threatens the ability to fight modern conflicts for two reasons. First, classic national- security-related conflicts—wars of territorial conquest, terrorism, or nuclear proliferation—increasingly are met with economic measures. But the statutes that authorize economic warfare actions are incredibly broad and recent administrations have interpreted these statutes in ways that risk running afoul of an expansive and free-form MQD. Second, “foreign affairs exceptionalism,” in which the Court decides not to apply the MQD to statutes involving foreign affairs, is not likely to work well as a response because what is “foreign” and “domestic” cannot be easily distinguished and attempts to do so will have perverse consequences. The MQD raises serious problems for foreign affairs and national security. If the MQD is applied to domestic, but not foreign, delegations, then the executive branch will have an incentive to use broad foreign affairs delegations to accomplish domestic policy objectives in order to evade the safeguards and limits that attend domestic administrative action. At the same time, judges will have to police the porous boundary between “foreign” and “domestic,” with especially high error costs because wrong decisions will affect national security. If the MQD is applied to economic delegations that touch foreign commerce, the most likely consequence is that judges—particularly lower court judges—will be put in the position of second-guessing executive branch decisionmaking on precisely those questions—economic foreign policy questions of deep economic and political significance—on which the political branches enjoy both constitutional primacy and institutional expertise. This result is troubling; judges lack the knowledge and training to make effective decisions bearing on foreign policy, and putting them in the position to do so contravenes the norms of our legal system.

This chapter discusses urban developments in two major cities in Serbia, Belgrade and Novi Sad, influenced by the Balkan political crisis of the 1990s. Belgrade is the national capital of Serbia, with a dominantly Serbian population. Novi Sad is the capital of the Autonomous Province of Vojvodina, and home to a population of more than 20 different ethnicities. The seemingly bipolar relationship between these two cities started to emerge during the fall of Yugoslavia and has intensified during the subsequent shrinkage of the country into the current state of Serbia. The effects of war as well as migration have left their mark on the urban situation of both cities. Both cities are not old by European standards, Belgrade emerging before the rise of the Ottoman Empire and Novi Sad being a product of the eighteenth century and the rise of the Austro-Hungarian Empire. These two cities traditionally vary in size and ethnic make up from almost mono-ethnic Belgrade to multi-ethnic Novi Sad. This paper will explore the idea that national capitals such as Belgrade can give rise to “un-national capitals” such as Novi Sad. This will be viewed through a lens of the role of architecture and design in affecting the realities of both cities.

Even though corruption continues to mar economic progression, worker enthusiasm, and societies' moral constitution, most studies of corruption have been confined to the fields of economics and political science. However, psychological variables, such as personality and cultural values, are likely to be relevant to studying corruption. In the present study of 62 countries, we examined how national averages on the Big Three personality traits, a measure of social desirability, and Hofstede's cultural dimensions relate to perceptions of a nation's level of corruption. The Big Three personality traits showed modest relationships with corruption. However, national averages on a social desirability measure were strongly and positivel correlated with corruption, suggesting that national dishonesty in responding to personality items is related to national dishonesty in corruption. In addition, the discrete, combined, and unique effects of personality and culture on corruption were compared. The findings suggest that both cultural values and personality have relevance for understanding corruption. As globalization continues to promote the exchange of cultural values and the assimilation of both individuals and organizations into new cultures, these findings highlight the need for I/O psychologists to be attentive to both culture and personality in designing human resource systems.

The question of what kind of national theatre might be most appropriate to this country has worried cultural pundits for a century, and occupies most of the deliberations on theatre in the Massey Report, the seminal document presented to Parliament in 1951 that shaped the development of the arts in Canada over the subsequent four decades. The Massey Report didn’t invent that obsession. Since the 1890s theatre critics in Canada have wrestled with what appeared to be a simple problem: if we have a Canadian nation, then a Canadian drama must be one of its proofs; therefore we must have a national theatre to advance the national drama.

This thesis is an attempt to grasp the phenomenon of the national hero behind the facade of national identity. Three smaller nations from the northern quarters of Europe - Scotland, Norway and Lithuania - are examined separately and within a comparative framework. Thus, the study is built on three different layers representing differences rather than common features among the three case studies. The key question underlying the thesis is this: what is the relation if any between the heroic traditions and national identity? Since the latter has been widely seen by scholars as an entity caught up in a perpetual cycle of human evolution, whether monitoring or constructing the world we live in, it was deemed appropriate to investigate the most permanent feature of national identity, that is heroic traditions - the prevailing popular trends in situating the national hero in history. The thesis argues that heroic traditions came about in connection with the emergence of the nation state in early modern history. The common ground for selecting the three otherwise different countries for this study was found in the fact that all had been exposed to unionism for a greater part of their national history, hence national heroes were formulated in the language of separatism and longing for statehood. Yet, as the thesis attempts to demonstrate, both the heroic and the modern state had been conceived with a Neostoic mindset which envisioned a close relationship between the ethical values and political interests of the citizen. The confluence of political theory and Realpolitik gave birth to three types of national identity, namely civitas popularis (democracy), regnum (kingship), and optimatium (aristocracy) as found in Scotland, Norway and Lithuania respectively. The study has shown the persistence of these key models of state-formation in the development of national identity from patriotism to territorial and ethnic nationalism. The abundance of the heroic in the Scottish case is explained as a vestige of the legacy of civic humanism, the traditional emphasis on the king-lines in the Norwegian case is a result of absolutism, while the lack of both in Lithuania is interpreted within an aristocratic model of national identity.

By reading food television as a cultural text, through which the nation is narrated and envisioned, this dissertation examines the evolution of Korean food television and its articulation of Koreanness in contemporary globalization. Theoretically, I suggests understanding the nation as a discourse or a regime of truth from the Foucauldian perspective. In order to bring Foucault’s relativistic notion of truth into play, this dissertation employs Fairclough’s three-dimensional approach for critical discourse analysis (CDA). Through this multi-dimensional approach, I aimed to conduct a thick description of Korean food television’s discursive practice with regard to national cuisine and the Korean nation. My historical analysis of food television shows that an increased awareness of cultural others enhances a struggle for nation-ness. By unveiling the “Janus-faced” characteristic of the nation, which is constructed both against and through differences, this dissertation identifies the inextricable relationship between the nation and globalization, and the hierarchical integration processes inherent in cultural hybridization. Moreover, this research project reveals how the nation-state actively appropriates the banality of food and is involved in the production practices of the television industry in order to produce and disseminate hegemonic discourses on the nation, and to keep nationhood near the surface of everyday life. Through an investigation of the interplay between television texts and social conditions, my dissertation also explicates the socially-constructed and the socially-constitutive nature of media discourse, and enriches the discussion regarding the production cultures of the global television industries.

Three times in this century the US public has panicked with fear because of exaggerations of external threats to the nation. These panics peaked in 1950,1960, and 1980. Why did the U.S. markedly exaggerate the Soviet threat at these times? These periods of widespread public fear were "defining moments" when the US created confrontational and militarized containment policies. These panics ratcheted up the arms race tremendously between the US and the Soviet Union, and arguably these panics led to unnecessary confrontations and crises. In this study I test leading explanations of these cases--eight hypotheses drawn from three different perspectives. The Rational Perspective argues insufficient information and uncertainty about present and future capabilities and intentions causes overestimations. The Psychological Perspective argues cognitive errors could cause these overestimations (attribution theory and schema theory/analogical reasoning, tested here). The Domestic Politics Perspective argues oversell, logrolling, electoral politics and/or militarism causes public overestimations. Domestic Politics best explains the national misperceptions examined. In each case, the sources of the specific misperceptions examined were clearly rooted in domestic politics (1950: oversell and militarism; 1960 and 1980: electoral politics and militarism.) Uncertainty about the threat was found to be a significant contributing factor in 1950 (but not the source/elites did not unintentionally overestimate when the misperceptions first formed).

Uncertainty was found to be a significant "permissive condition" for the misperceptions of 1960-but uncertainty was highest just after Sputnik in 1957, and sharply decreased by 1960, yet public fear increased and peaked in 1960. There was no significant uncertainty in the 1980 panic--uncertainty is not a necessary condition for panic. Psychological hypotheses were not detected playing a role in causing these panics. Leaders private deliberations were examined and did not exhibit the patterns of reasoning predicted by these theories (e.g. leaders were aware of provoking the threat). National misperceptions guide policy and shape many leaders' beliefs through "blowback" and psychological post hoc rationaliztion. These large, important misperceptions are rooted in domestic politics, while international relations scholars focus on psychological and rational reasons for misperceptions. The study of misperceptions in international relations needs to be re-oriented.

In this thesis, I use the cities of Yamoussoukro, Cote d'Ivoire; Phnom Penh, Cambodia; and Montreal, Canada as case studies to analyze the connection between architecture, nationalism, and the influence of colonialism. Each of these cities was directly influenced by French urban development as these cities were reshaped in order to change the people, history, or culture of specific geographies. As these countries gained independence from France they used architecture as a way to express national identity to local populations in order to collectivize them, as well as a way to express this "unified" identity to the international community. This is rooted in the urban policies of the European colonizers which focused on teaching indigenous populations European morality, aesthetics, and rational use of space, but also in the creation of maps, drawings, and other material to express the colonial identity of these territories.

This research is a detailed analysis of the Conservative Party leadership's understanding of British nationhood and national identity and its use of those concepts as part of its strategy during the 1997-2001 parliament. The evolution of Hague's strategy will be examined and both the leadership's conception of British nationhood and national identity and its utilisation of those concepts as part of its strategy will be analysed. Why did Hague use those concepts and why did he believe an appeal to the electorate's sense of national identity was an important part of his overall strategy? Was the leadership united in its understanding of nationhood and national identity and in agreement as to the role that those concepts should play within the party's strategy? Did the strategic role played by those concepts change during the parliament? Why did those concepts fail to adapt the party to being in Opposition and enable it to maximise its electoral support? Amongst the most important findings is that when conceptualising national identity, the leadership can be split into two groups, modernisers and traditionalists and both believed they were appealing to the majority of British people. As the 2001 General Election approached, Hague abandoned a long-term modernising approach to party renewal and emphasised policies which he believed would shore up the party's core support base, whilst also broadening its support. The politics of nationhood were central to this traditionalist approach. The issues that Hague emphasised were not salient and succeeded only in deepening, not broadening, the party's support.

The National Park Service (NPS) manages the Nation’s most iconic destinations that attract millions of visitors from across the Nation and around the world. Trip-related spending by NPS visitors generates and supports economic activity within park gateway communities. This report summarizes the annual economic contribution analysis that measures how NPS visitor spending cycles through local economies, generating business sales and supporting jobs and income. In 2020, the National Park System received over 237 million recreation visits (down 28% from 2019). Visitors to national parks spent an estimated $14.5 billion in local gateway regions (down 31% from 2019). The estimated contribution of this spending to the national economy was 234,000 jobs, $9.7 billion in labor income, $16.7 billion in value added, and $28.6 billion in economic output. The lodging sector saw the highest direct effects, with $5 billion in economic output directly contributed to this sector nationally. The restaurants sector saw the next greatest effects, with $3 billion in economic output directly contributed to this sector nationally. Results from the Visitor Spending Effects report series are available online via an interactive tool. Users can view year-by-year trend data and explore current year visitor spending, jobs, labor income, value added, and economic output effects by sector for national, state, and local economies. The Ambulatory and Hospital Care Statistics Branch of the National Center for Health Statistics (NCHS) is pleased to release the most current nationally representative data on ambulatory care visits to physician offices in the United States. Statistics are presented on physician practices as well as patient and visit characteristics using data collected in the 2019 National Ambulatory Medical Care Survey (NAMCS). NAMCS is an annual nationally representative sample survey of visits to nonfederal office-based patient care physicians, excluding anesthesiologists, radiologists, and pathologists.
