This PhD thesis examines the factors that have shaped entrepreneurial cognition and practice in entrepreneurs from within the world’s oldest monotheistic religious community; the Zarathustrian community. Zarathustrianism is the religion that was founded by a Prophet named Zarathustra in approximately 1200 BCE. Marketing and Entrepreneurship have, until quite recently, remained two quite independent scholarly domains. In 2002, Morris et al., provided a definition of Entrepreneurial Marketing as, "an integrative construct for conceptualising marketing in an era of change, complexity, chaos, contradiction, and diminishing resources, and one that will manifest itself differently as companies age and grow. It fuses key aspects of recent developments in marketing thought and practice with those in the entrepreneurship area into one comprehensive construct". Since then, research in this field has grown in significance across the globe. A recent book by Sethna, Jones and Harrigan (2013) presents important theoretical developments with regard to research at the Marketing and Entrepreneurship Interface and which addresses critical issues for businesses, both small and large, from global perspectives, and covers topics such as new venture creation, marketing in Small-to-Medium-Sized Enterprises (SMEs) as well as large companies, renewal of existing businesses facing market challenges, internationalization, innovative cost-effective marketing strategies and practices, along with recent exploration of entrepreneurship theory and entrepreneurial behaviour of individuals and, in organisations. Zarathustrianism has not only been instrumental in shaping nascent civilisation of ancient Iran, but has also wielded a considerable influence on Biblical religions and Greaco-Roman philosophical thought. Zarathustra gave his followers a basic and comprehensive ethical rule to live by, namely that they should think Good Thoughts, speak Good Words and perform Good Deeds (Humata, Hukhta, Hvarshta in the ancient Persian language called Avestan). This PhD thesis explores the impact of these basic tenets – Good Words, Good Thoughts and Good Deeds - on Zarathustrian entrepreneurship. The researcher takes the stance that the realities of the Entrepreneur/Owner-Manager (EOM) are socially constructed, using ‘thoughts, words and deeds’, rather than objectively determined. In doing so, this research is interested in understanding why things are happening to those Zarathustrian EOMs (actors) and how their different experiences eventually shape, nurture and affect the actors’ entrepreneurial behaviour. Thus, throughout this research study, a qualitative research design based on the Carson et al. (2005) perspectives on an ‘integrative multiple mix of methodologies’ is used, but primarily all centred around ethnographic form. The use of narrative theory and life story techniques is further overlaid with the use of the EMICO framework, a qualitative research model developed by Jones and Rowley (2009) as the basis for exploring ‘entrepreneurial marketing and the Zarathustrian entrepreneur’. The findings reveal that whilst the dimensions of the EMICO framework are both usable and valid for Zarathustrian entrepreneurs, when applied to these firms in the context of ‘ethnic’ entrepreneurs, the framework is lacking in two particular areas; Family Support and Religio-Cultural Identity and Influences of business practice. The thesis makes a significant contribution to the EM and ethnic entrepreneurship literature by first of all re-developing and re-naming the framework, 2e(EMICO), and secondly by further extending the knowledge in respect to Zarathustrian entrepreneurship, about which nothing currently exists in the EM literature.

This study was designed to explore possible relations between moral maturity and moral action by evaluating groups of delinquent and non-delinquent youth, and examining their relative position on multiple measures of moral maturity and criminality. Subjects were 60 male adjudicated juvenile offenders between the ages of 14 and 17, and 20 non-delinquent controls. All youth participated in a series of structured interviews used as a way of assessing their abilities on Kohlberg's moral reasoning, Turiel's social convention understanding, and Selman's social perspective taking measures, and were administered Hogan's socialization, empathy, and autonomy scales. The delinquent youth were assigned immorality ratings and further classified according to legal categories. Ratings for Hare's Psychopathy Checklist were obtained from primary therapists for the delinquents and from school counsellors for the non-delinquent comparison group. The results revealed that as a group, delinquent subjects showed substantial developmental delays in their performances on measures of moral reasoning, social convention understanding, interpersonal awareness and indices of socialization and autonomy. Hogan's empathy measure also showed a trend in the same direction. The majority of the delinquent youth were found to score at a preconventional-concrete reasoning level and showed a general lack of social-moral character. Tests of communality among the six moral maturity measures produced distinct and internally consistent cognitive reasoning (i.e., moral reasoning, interpersonal awareness, and social convention understanding) and moral character (i.e., socialization, empathy, and autonomy) clusters which lend support to the claims of Brown, Harre, and Hogan regarding the multidimensionality of moral development. There was an expected inverse relationship between immorality and moral maturity for the low and moderate seriousness groups, and an inconsistent pattern for the high group. This later finding was interpreted as an artifact of the fact that those delinquents whose criminal acts were judged most immoral were particularly guilty of various sexual offenses. The psychometric properties of the Psychopathy Checklist confirm its usefulness with adolescent populations. Three internally consistent factor scales emerged (i.e., motivational deficit, lack of ego strength, and behavioral deviation). While psychopathy was found to significantly correlate with immorality ratings, an unexpected positive relationship was also found between psychopathy and moral reasoning for the sex offender group. Taken together, all of these results were interpreted in terms of Heider's theory of the psychology of action, which views behavior, in this case moral behavior, as a combination of "can" (i.e., moral reasoning competency) and "try" (i.e., moral character).

This thesis will argue that a significant part of our moral experience can be explained by an analogy with the phenomenon of aspect perception discussed by Wittgenstein in his Philosophical Investigations. I will argue that projectivism cannot give a satisfactory account of moral perception. This difficulty constitutes an argument against projectivism; namely that projectivism is hopeless as an account of the phenomenology of morality, because it is at variance with the way we actually think and talk morally. It will be shown how quasi-realism is an attempt to remove the most important range of objections to projectivism - namely that it cannot account for the phenomena of serious moral thought and talk. I argue that the project of quasi-realism ultimately fails, leaving realism as the theory most able to account for our moral experience. I shall reveal the untenable assumptions of the ‘Absolute’ viewpoint entailed by the non-realist arguments of J.L.Mackie, and reveal the perpectival outlook that lies behind an aspect-seeing account of moral perception, and also illuminate why the key issue for moral realism is the question of whether we can establish moral objectivity. I shall then go on to say how much objectivity is possible. Finally, I shall show how a Wittgensteinian analogy between moral values and aspects helps to explain our common moral experience. The ability to perceive moral values will be shown to be tied in with the concept-dependency of moral perception, relying on discriminations that can only be made through the use of language, and hence through a shared form of life. The account will be shown to be fully capable of giving an account of our common moral experience

Le harcèlement moral, notion protéiforme a été longtemps occultée par le Droit Français. Cette souffrance morale, issue de la relation de travail était avant la loi protégée par différentes branches du droit indirectement ( sociale, privé, sécurité sociale. . ) au niveau national mais également européen. Désormais, phénomène de société dont la gravité est reconnue, est appréhendé à travers la loi de modernisation sociale du 17/01/02, législation spécifique. Cette loi définit et instaure une protection des victimes de harcèlement moral par l'intermédiaire des notions de prévention, responsabilité et sanctions civiles et pénales. Les apports de la loi sont nombreux, pourtant des critiques et des vides apparaissent tant au niveau de l'appréciation du concept que de sa protection. Il appartient à la jurisprudence de préciser les contours de la loi, rôle qui incombe au juge à tous les stades du contrat ( exécution et rupture) par la reconnaissance ou non du délit. La jurisprudence semble orienter le débat entre pouvoir de direction et droits des salariés. La difficulté de la notion relève de l'aspect subjectif. Le rôle du juge étant d'objectiver cette sphère pour permettre aux victimes ( employeur, salarié, collègue) d'être indemnisé et rétablit dans leurs droits. La construction solide de ce concept résidera dans l'interprétation qu'en feront les juges sur le terrain !!!

I begin my discussion of the question 'Why should I be moral?' by drawing distinctions both between possible different senses of 'moral' and also between different conceptions of what morality requires. I then criticize the idea that one should be moral because it serves self-interest. Self-interest is served by one's having benevolent concern for only a fairly small number of others, but being moral involves more than this. Furthermore, having moral dispositions other than benevolence is in one's interest only if these dispositions are required by the moral code predominant in one's society. Moreover, even if we confine our attention to people who live in such a society, each person would probably be better off with moral dispositions that were not so strong that they would always get their way, but the completely moral person would presumably have overriding moral dispositions. Finally, having the correct moral beliefs may not be in one's interest. But whatever the gap between self-interest and morality, might one not have most reason to be moral? Derek Parfit has recently argued that the view that one has most reason to do whatever best achieves one's present aims (and these may sometimes be moral aims) is at least as good as the view that one has most reason to do what best promotes one's own long-term good. I attack some of his arguments. But I then go on to argue that moral requirements as such—i.e., independently of whether they are reflected in present desires—do generate reasons for action. But are these moral reasons always stronger than reasons of other kinds? On the basis of an example I describe in the closing pages, I reluctantly conclude that they are not.

The last fifty years have seen a turn in the Catholic Church's public attitude toward capital punishment. From openly defending the right of the state to kill malefactors, the Church has become an outspoken opponent. What accounts for this? How can it be reconciled with Catholic tradition? Should the current teaching be called a 'development of doctrine'? Can we expect further change? These questions shape this thesis. The work is divided into three parts comprising a total of eight chapters. Part I undertakes a detailed exegesis of the death penalty teaching of the Catechism of the Catholic Church (1997). I conclude that the text, while not explicitly stating that the death penalty is in itself wrong, lays down premises which when carried to their logical conclusions, yield just such a conclusion. This conclusion is checked and confirmed by the fundamental moral reasoning found in the papal encyclicals Evangelium Vitae and Veritatis Splendor. In light of this conclusion (what I call the new position), Part II asks the question: may the Church, constrained by sound biblical interpretation and dogmatic tradition, legitimately teach in a definitive way that capital punishment is per se wrong? This is a question which concerns the development of doctrine. Before it can be answered the Church's traditional teaching needs to be precisely formulated so that it can be placed in juxtaposition to the new teaching. An analysis of statements throughout ecclesiastical history is therefore undertaken and what we might call the cumulative consensus of ecclesiastical writers on capital punishment is formulated. The authoritative nature of this teaching is analyzed to determine what kinds of developments it admits and excludes. Judging its nature admits of a development like the one described in Part I, models are proposed to explain modes by which it might be understood to be developing. Finally, a systematic and philosophically consistent account of the new position is proposed and its implications for other teachings in the Church's tradition of 'justifiable violence' is examined.

La question qui est à l'origine de ce travail est la suivante : quelle est l'influence de la mathématisation de l'incertitude des connaissances médicales sur la relation médecin-malade ? Le cadre de notre travail est la médecine de soins. Le phénomène dont nous partons est celui de la mathématisation des connaissances médicales dans le cadre de l'épidémiologie. Nous nous intéressons à l'influence de cette transformation de nos connaissances sur la pratique médicale en nous demandant quels sont les effets de cette transformation théorique sur l'éthique qui encadre la relation médecin-malade. Nous recherchons comment une telle influence peut exister. Nous nous sommes donc demandé comment le praticien pouvait tirer parti des informations épidémiologiques. Un premier problème se pose : l'unité étudiée par l'épidémiologiste est un groupe de patients, celle qui est étudiée par le praticien est un patient individuel. Un second problème a pour origine la nécessite fréquente ou se trouve le praticien d'évaluer subjectivement les risques. Ces deux difficultés trouvent une solution élégante dans le cadre de la théorie bayésienne de la décision qui énonce à partir d'une base axiomatique réduite, les règles du comportement rationnel en situation d'incertitude. En tant que théorie normative, la théorie de la décision (ou théorie de l'utilité) prescrit de prendre telle ou telle décision. Or en médecine, toute décision est susceptible de poser des problèmes éthiques. Notre thèse est que l'interprétation par l'épidémiologie de la réalité médicale conduit à une réinterprétation des problèmes médicaux en termes de décision dans l’incertitude, ce qui conduit à une réinterprétation des fondements de l’éthique médicale dans un cadre utilitariste qui entre en conflit avec l’éthique médicale traditionnelle
The problem which is at the origin of this work is the following : what is the influence of the mathematisation of medical uncertainty on the doctor-patient relationship ? The frame of analysis is clinical medicine. The thesis stars with the mathematisation of medical uncertainty within the field of epidemiology. I then examine the impact of this new knowledge on medical practice, especially from the perspective of medical ethics ; and i try to figure out how such a modification is possible. When one try to understand how the practitioner can make use of epidemiologic data, two problems arise. The first one originates in the discrepancy that exists between the object of clinical medicine (the individual patient) and that of epidemiology (groups of patients). The second problem is related to the frequent lack of meaningful information and the correlative necessity for the physician to guess subjectively what are the olds that apply to his / her patient. These two problems find an elegant solution within the bayesian framework (bayesian or utility decision theory). As a normative theory, this theory prescribes that a specific behavior should be adopted. The problem is that, in medicine, every decision has some ethical consequences. This thesis attempts to answer the following question: Should it ever be legally permissible to buy a kidney from a living donor in Israel?
Existing legislation and government policy prohibit payment out of fear that the poor, minorities, and other vulnerable people will be coerced to exchange organs for money, i.e. it focuses on the potential harm to the donor. This thesis will address the issue of whether this prohibition is justified and how much risk a paid donor should be allowed to assume.
This essay will present a detailed investigation of an existing kidney trade in Israel, as well as a review of the nature and medical risks associated with kidney donation from a healthy kidney donor. It will also provide an overview of the legal provisions and case-law, pertaining to kidney transplant in Israeli law and Jewish law, and will seek answers to the silence of the legislator in different sources of law. This thesis will conclude with suggestions and recommendations for a statutory authorization of a market system of kidney transfer and will present a model of a health-transplant agency, in an effort to answer the growing demand for kidneys.

This thesis is concerned with two different aspects of human embryonic stem cell research: legal and moral. These are not two distinct areas the law cannot regulate this controversial area of science without the input of morality. There is not one moral viewpoint on the use of human embryos in scientific research and as such this thesis discusses several different moral viewpoints before moving on to consider how the law takes into account these wide ranging and diverse stances. The science of human embryonic stem cell research is discussed briefly so as to ensure that the reader comprehends the science that the law is seeking to regulate and over which there is so much ethical debate. The majority of this thesis then considers the legal aspects of human embryonic stem cell research. The focus is upon the human embryo and human embryonic stem cell interface how the legislation which governs human embryo research has been used to subsequently regulate human embryonic stem cell research. The examination of the legal aspects of human embryonic stem cell research starts with a historical chapter on how the legislation came into force. This is necessary so as to understand how and why we regulate human embryonic stem cell research as we do and what the legislation does, before moving onto the finer detail. The role of research ethics committees, the HFEA and the UK Stem Cell Bank in human embryonic stem cell research are all analysed in depth, problem areas highlighted and solutions suggested. An analytical discussion of the reform process which led to the Human Fertilisation and Embryology Act 2008 is the last step in the examination of the regulation of human embryonic stem cell research. Finally comparisons are made to the State of California, USA which was the first US state to permissively fund stem cell research. The law stated is correct as of the 13th November 2008 when the Human Fertilisation and Embryology Act 2008 received Royal Assent.

ENGLISH ABSTRACT: Moral theories on abortion are often regarded as mutually exclusive. On the one hand, pro-life advocates maintain that abortion is always morally wrong, for life is sacred from its very beginning. On the other hand, the extreme liberal view advocated by the absolute pro-ehoieers claims that the unborn is not a person and has no moral standing. On this view there is no conflict of rights; women have the right to dispose of their body as they wish. Therefore, killing a non-person is always permissible. In between the two extreme views, some moral philosophers argue that a 'pre-sentient' embryo or fetus cannot be harmed because it lacks the ability to feel pain or pleasure, for it is 'sentience' that endows a living entity (human and non-human) with moral considerability. Therefore, abortion of a pre-sentient embryo or fetus is permissible. Neurophilosophy rests a philosophical conclusion on neurological premises. In other words, to be tenable sentientism - the claim that sentience endows an entity with moral standing - needs robust neurobiological evidence. The question is, then: What is the basic neuroanatomical and neurophysiological apparatus required to be sentient? The answer to that question requires a fair understanding of the evolution, anatomy and function of the brain. The exploration thereof shows quite convincingly that the advocates of sentientism do not provide convincing arguments to root their theory in neurobiological facts. Their claims rest rather on emotions and on behaviours that look like a reaction to pain. The other shortcoming of sentientism is that it fails to distinguish pain from suffering, and that as a utilitarian moral theory it considers only the alleged pain of the aborted sentient fetus and disregards the pregnant woman's pain and suffering. And, finally, sentientism leaves out of our moral consideration living and non-living entities that deserve moral respect. The main thrust of the dissertation is that the argument of sentience as its advocates present it has no neurophilosophical grounds. Therefore, the argument from sentience is not a convincing argument in favour or against abortion.
AFRIKAANSE OPSOMMING: Morele teorieë wat handeloor aborsie word dikwels as wedersyds uitsluitend beskou. Rares sont les recherches qui ont analysé le contenu des justifications réalisées à l'issue d'un choix fait à un dilemme moral, choix aux conséquences toujours graves pour autrui. Plusieurs recherches ont montré que le jugement moral était largement intuitif et, de ce fait, était difficilement explicités par les individus. Pourtant, étudier le contenu de ces rationalisations après coup devrait permettre d'apporter des éléments nouveaux sur les relations entre les aspects cognitifs et émotionnels à l’œuvre lors d'une prise de décision moralement difficile. Aussi, le design expérimental de cette étude a consisté à demander à des adultes de fournir un jugement à la suite d'un dilemme personnel (Pont) ou impersonnel (Aiguillage) en expliquant les raisons de l'orientation de leur choix soit par oral, soit par écrit. Plusieurs observables, concernant la nature des arguments (déontologiques et utilitaristes) ainsi que le lexique (émotionnel et cognitif) utilisés, ont été mis au point. Few studies have analyzed the content of justifications made at the end of a choice facing a moral dilemma, although this choice causes serious consequence for others. Several studies have shown that moral judgments were largely intuitive and, therefore, were hardly explained by individuals. However, studying the content of these rationalizations afterthought is expected to provide new information on the relationships between cognitive and emotional aspects at work in a morally difficult decision. The experimental design of this study was to ask adults to provide a judgment on a personal (Bridge) or impersonal (Switch) dilemma explaining the reasons of the direction of their choice either by oral or in writing. Several observables were developed on the nature of the deontological and utilitarian arguments and the emotional and cognitive lexicon used. The main expectation of this thesis is to show that what adults say about their choice is highly dependent on the nature of the dilemma they were submitted to, on their judgment and on the constraints making their mode of expression more or less easier. In other words, the content of their post hoc rationalization would greatly depend on the conditions under which they were produced. More precisely, the content of justifications produced by 331 participants was analyzed with an analytical grid of the deontological and utilitarian arguments and with Tropes software, enabling two scenarios of automatic counting of the emotional lexicon (EMOTAIX) and cognitive lexicon (COGNITAIX). South Africa currently has one of the highest levels of crime in the world. The high prevalence of violence in South African culture has led to the increased exposure to violence of individuals of all ages. The South African Police Service annual report for 2008/2009 reported 48 732 crimes ranging from murder, attempted murder to sexual offences and common assault against children under the age of 18 years. In addition, young people between the ages from 12 to 22 are generally victimized at twice the adult rate and even higher for violent crimes. It is the belief of various theorists that exposure to violence can alter one’s cognitive, affective, and behavioral processes- the three core components that are essential to moral development. The role that exposure to violence has on the development of aggressive behavior has been thoroughly researched; however the implications that this exposure has on the moral development of adolescents remains vague. This study explored and described the relationship between exposure to violence and moral development amongst adolescent learners. A quantitative exploratory descriptive research design was employed and the participants were selected by means of non-probability, convenience sampling. The sample consisted of 53 participants at a coeducational high school in the Nelson Mandela Metropole. The demographic data of the participants was gathered through the administration of a biographical questionnaire. The participants’ exposure to violence was explored by using the Harvard Trauma Questionnaire- South African Adaptation (HTQ-SAA), while their moral development was assessed by means of the Moral Judgment Test (MJT). The data was analysed using descriptive statistics and both the Pearson’s correlation coefficient and Chi square test was computed to draw inferences regarding the relationship between exposure to violence and moral development. The results of the study revealed that all of the participants were exposed to violence directly or indirectly on one or more occasion; however the frequency with which the participants were exposed to violence was lower than expected. The results of the MJT further indicated very low to low moral judgement competence scores for the majority of the sample. No significant correlation or association was found between the two constructs.

The purpose of this study to investigate the morality of persons in organisations and especially the effect of organisations on the moral autonomy of persons. In addition to reviewing the literature of moral autonomy in philosophy, psychology, sociology and organisation studies and management, the thesis also examines the ontology of organisations, moral agency and the organisation as a context. Based on this knowledge, a model is developed that addresses the relations of the organisation to society and the person to the organisation in ethical decision making. From this model the thesis develops three moral decision making categories. These are: moral autonomy. Where persons are allowed to use their moral values, moral heteronomy, where the organisation provides such values and moral anomy, where there is a lack of moral deliberation and moral values. Four research propositions are developed from this model. The propositions are that people are more likely to make morally autonomous decisions in personal life dilemmas than in organisational life dilemmas. In organisational dilemmas it is proposed that the organisation will affect the morality of its members. In bureaucratic organisations, people are expected to make more anomous organisational decisions when faced with an easy and simple dilemma and more heteronomous decisions when faced with complex and difficult dilemmas. In clan organisations, people are expected to make more autonomous organisational decisions. In a market organisation, people are expected to make more anomous organisational decisions. An exploratory primary research project is undertaken to test the model and the propositions developed. People from three Australian organisations that approximate Ouchi's (1980) typology of bureaucracy, clan and market organisations participated in the research. Managers and supervisors from each organisation were asked to assess the ethical climate of their organisation using Victor and Cullen's (1987, 1988) Ethical Climate Questionnaire. They also responded to Forsyth's (1980) Ethics Position Questionnaire and resolved and justified their resolutions six organisational and six personal ethical dilemmas. These dilemmas had been assessed by two groups of MBA students for relevancy, complexity and difficulty. The analysis of the primary data reveals that the three organisations have different ethical climates. It also reveals that the respondents from the three organisations do not differ insofar as they share similarly idealistic end relativistic ethical ideologies. They do however differ in the reasoning they use to resolve organisational and in some cases personal ethical dilemmas. People In organisation Alpha, the bureaucratic organisation, are more likely to make heteronomous decisions. People from organisation Beta, the clan organisation, are more likely to make autonomous moral decisions, and people from organisation Gamma, the market organisation, are more likely to make anomous moral decisions. These findings support the research propositions developed. More importantly, some people in organisations Alpha and Gamma did not perceive some organisational dilemmas as ethical issues but only as business issues that are void of ethics. In addition, people from organisation Alpha in particular were more likely to try to avoid making a decision and suggest that someone else in the organisation should make the decision not the person facing the dilemma. The findings suggest that organisations that rely on rules and regulations are more likely to remove the responsibility from ethical decision-making, and lead to avoidance of such decisions. The implications of these findings are discussed and opportunities for further research are identified.

The high school to college transition may be especially influential in creating feelings of social loneliness in adolescents. Failure to establish social structures may lead to feelings of loneliness and an increased need for social approval from their peers in the new environment. It was therefore predicted that the more lonely a student is, the more likely he/she would look for approval from others and the more likely he/she would acquiesce to a decision to participate in unethical actions proposed by peers. This prediction was tested in a sample of 158 female and 133 male college students. The evidence suggests that participants who were the most lonely were most likely to report a willingness to engage in unethical behaviors when encouraged by others. However, contrary to expectations, the need for approval did not mediate the relationship between loneliness and unethical behavior. Gender differences were found in the endorsement of unethical behaviors. Male participants were more likely to report a willingness to engage in unethical acts than were female participants.

The concept of causation is essential to ascribing moral and legal responsibility since the only way an agent can make a difference in the world is through her acts causing things to happen. Yet the extent and manner in which the complex features of causation bear on responsibility ascriptions remain unclear. I present an analysis of four aspects of causation which yields new insights into different properties of responsibility and offers increased plausibility to certain moral views. Chapter I examines the realist assumption that causation is an objective and mind-independent relation between space-time located relata – a postulate meant to provide moral assessment with a naturalistic basis and make moral properties continuous with a scientific view of the world. I argue that such a realist stance is problematic, and by extension so are the views seeking to tie responsibility attributions to an objective relation. Chapter II combines the context sensitivity of causal claims with the plausible idea that responsibility ascriptions rest on the assessment of causal sequences relating agents and consequences. I argue that taking context sensitivity seriously compels us to face a choice between moral contrastivism and a mild version of scepticism, viz. responsibility is not impossible, but ultimately difficult to identify with confidence. I show why the latter view is preferable. Chapter III explores the concern that group agents would causally (and morally) overdetermine the effects already caused by their constituent individuals. I argue that non-reductive views of agency and responsibility lack a coherent causal story about how group agents impact the world as relatively independent entities. I explain the practical importance of higher-order entities and suggest a fictionalist stance towards group agency talk. Chapter IV analyses the puzzle of effect selection – if causes have infinitely many effects, but only one or a few are mentioned in causal claims, what determines their selection from the complete set of consequents? I argue that the criteria governing the difference between effects and by-products lack clarity and stability. I use the concerns about appropriate effect selection to formulate an epistemic argument against consequentialism.

Through such an experience, adolescent students may intuit insights about what befits persons as moral persons in all their complexity and wonder. The plays chosen for concentration in this thesis are not to be considered exhaustive but only as sound examples of the treatment of the evolution of transcendent values within the adolescent phenomenon.

ENGLISH ABSTRACT: We live in a time of unprecedented wealth and ease, taking airplanes to exotic locales and enjoying a variety of foods from across the globe. Significant improvements in healthcare have increased life expectancy to three times that of Ancient Egypt, once considered the most advanced civilization of its time. Yet despite these advances, millions of children continue to suffer. Ninety-nine percent of the millions of child deaths before the age of five each year are preventable through low cost treatments. Poor children who live past age five usually experience a lifetime of intellectual, physical, and emotional setbacks because of their disadvantaged circumstances. What, if anything, is to be done? This dissertation argues we have strong moral obligations to help children by providing a substantive equality of opportunity so that any differences in socioeconomic or life circumstance result from individual choice, not poor moral luck. These obligations are grounded in the common morality, arise from cosmopolitan applications of beneficence, and include the provision of nutritious food, safe drinking water, adequate sanitation, shelter, certain levels of healthcare and education, and love and guidance. Although the task before us is large, it is not impossible and thus incumbent upon us to fulfill it.
AFRIKAANSE OPSOMMING: Ons lewe in ‘n tyd van ongekende rykdom en gemak, waar ons vlieg na eksotiese bestemmings en ‘n verskeidenheid van kos en ontspanning van regoor die wêreld geniet. What are the consequences of such practices for scientific research and health care? One of the fundamental philosophical questions behind this issue is the following: are we justified in patenting human genetic material? An examination of the traditional philosophical justification of intellectual property will allow us to critically explore whether or not this practice is ethically justifiable. It will be argued that the consequentialist justification of intellectual property requires, in this present case, that we modify the patent regimes in order to maximise social benefits and minimize public burdens.

Although auditors engage in considerable social interaction (Gibbins & Mason, 1988; Solomon, 1987), little is known about how social interaction influences an auditor's moral reasoning process. In order to address this gap, this study used an experiment to examine the effect of social influence on 288 auditors' moral reasoning on realistic moral dilemmas. The results of this study indicate that social interaction influences the moral reasoning of auditors. Auditors' level of prescriptive reasoning appears to increase after engaging in discussion of a realistic moral dilemma, particularly for those which discuss dilemmas with others at high levels of moral development, while auditors' level of deliberative reasoning appears to decrease after engaging in discussion of a realistic moral dilemma. At a practical level, these findings suggest that auditors should be encouraged to prescriptively discuss moral dilemmas with others of high levels of moral development as this tends to result in the use of more principled moral reasoning. In contrast, auditors should avoid deliberative discussion of moral dilemmas, as this tends to result in the use of less principled moral reasoning than would be used in the absence of discussion.

One feature that varies within competing conceptions of medical shared decision-making is how a patient's values are to be engaged by a physician. One detail that can be overlooked under "shared" decision-making is whether or not a physician ought (or be allowed) to attempt to persuade the patient to adopt particular health-related values. Some argue that it is incumbent on a physician to share her privileged understanding of medicine so as to help her patient embrace "better" values. This thesis argues that it is dangerous to patient autonomy for a physician to exert moral suasion on her patient to attempt to influence or change those values; the danger lies in the power imbalance between patients and physicians that seems inherent in medical encounters, and is exacerbated by the sick role. Thus, while a physician ought to help her patient articulate his health-related values, she ought not try to change them.

This study examined the hypothesis that the moral personality is one in which moral knowledge structures are chronically accessible. A spontaneous trait inference cued-recall paradigm was employed. It was expected that those with chronically accessible moral knowledge structures (N = 61) would spontaneously encode virtue-content information differently than those with less chronically accessible moral knowledge structures (N = 77). High and low moral chronic accessibility participants were instructed to memorize sentences that contained virtue-content implications. Sentence recall was then cued by either virtuous dispositional terms or by words that were linked semantically to the sentences. Within the spontaneous processing condition, dispositional cues prompted twice as much recall as semantic cues among participants with high moral chronic accessibility whereas semantic cues prompted twice as much recall as dispositional cues among participants with low moral chronic accessibility. As predicted, within the deliberate processing conditions, there were no high/low moral chronic accessibility differences. These findings support the claim that the moral personality is usefully conceptualized in terms of the chronic accessibility of moral knowledge structures.

The ideology of weight control as evidenced in the discourse of American adolescent girls is explored via a cognitive approach to discourse analysis, and focuses on the teasing out of cultural models through evidence in natural language. It is hypothesized that a cultural model exists which equates weight control with a moral code reflective of the Protestant ethic. The research examines how the cultural model frames experience by supplying interpretations of that experience, and how it influences behavior by supplying goals for action. The cognitive salience of the model within the belief system of the individual regulates the degree of influence the model has on behavior. Four levels of influence are proposed, ranging from cultural cliche to motivation of disordered eating. The predominant influence is found to be as an occasional guide to weight controlling action or discourse about such action.

This thesis moves beyond the traditional approaches of how we ought to treat animals, and instead concentrates on the best strategy for preventing animal suffering in the farming industry. Chapter 1 considers the question of how we can know that animals feel pain, and concludes not only that it is rational to believe that they can, but also that this is a significant fact. Chapter 2 then analyses one possible strategy for helping to prevent animal suffering, namely demi-vegetarianism. For a number of reasons, however, this strategy is found to be flawed, therefore Chapter 3 analyses a second possible strategy, namely vegetarianism, and concludes that this is, in fact, the best strategy for helping to prevent animal suffering in the farming industry.

The dramatic improvement of neonatal intensive care has produced vexing ethical and legal questions. One of the most striking issues is to determine whether the most defective neonates should be provided with intensive care and to what extent they should be treated. This thesis demonstrates that an attempt to answer this question and an analysis of the demands and limitations of a duty to treat defective neonates cannot properly occur without first considering the legal concerns and ethical issues surrounding the notion of "person". The author examines germane ethical theories and North-American jurisprudence to see what approaches and standards commentators and courts have adopted in this respect. This thesis demonstrates that in the context of the cessation or non-initiation of intensive care, the legal and moral status of very defective neonates remain ambiguous. In particular, the author suggests that a legal best interests analysis that includes quality of life considerations may actually involve the use of criteria similar to those supported by the authors of the controversial moral theories that negate the personhood of seriously handicapped newborns. The author ultimately concludes that a clear divide between the legal definition of the "person" and the moral and social perceptions of that term is misleading.

This study examines the ethical reality of medical students, and ethical curricular aspects of medical school. The 'received curriculum' is analysed using a combined interdisciplinary theoretical framework of 'Ethics' and 'Curriculum'. Defined in terms of students' experience of the curriculum, and the participants' perceived moral reality, the study was framed within a phenomenological-interpretive research paradigm. Content analysis of the 'narrative corpus' obtained by 38 open questionnaires addressed to sixth-year medical students, and by 21 interviews with medical students and senior faculty members, was conducted. Based on students' interviews, holistic 'ethical profiles' were produced, and proved to be significantly informative. The study shows that during their clinical training years, medical students cope with daily contextual moral dilemmas that relate to their culture and status and involve subtle, elaborately-calculated decisions. The student's authentic, reflective and analytical accounts of their ethical dilemmas, lead to the novel concept of students' 'moral awareness'. This increasing awareness of ethical dilemmas complexity sheds light on an adult ethical-cognitive stage, characterised by pragmatic thinking focused on content, and by internalisation of relativism and contradictions. The study further demonstrates the significance of students' experience for viewing and evaluating curriculum: the students, who perceived their ethics 'received curriculum' in its totality, consequently offered important insights concerning ethical processes, thus enriching the 'traditional' medical school curricular thought.

The main objective of this mini–dissertation is to investigate the basic form and content of moral education as it manifests itself in the mamtiseni and nkciyo female initiation rituals of the Mount Frere region of the Eastern Cape Province of the Republic of South Africa. The main theoretical position taken is the reemergent African Renaissance coupled with African indigenous knowledge systems, first revived by (former) President Thabo Mbeki. Accordingly the main purpose of this study is to address the transmission of moral aspects of female Bhaca initiation inherent in behavioural/cultural educational enculturation. The main findings of the mini–dissertation constitute the following: 1. Mamtiseni and nkciyo rituals play a major role in the enculturation of young Bhaca girls. 2. The song texts carry strong messages of how to go about achieving a healthy and surviving society. There are further opportunities for research in the following aspects: 1. Nkciyo initiation schools are very exclusive, involving many secret codes. The fact that I am a male put me at a disadvantage. 2. There are many more points of difference between the two rituals than meets the eye.

The use and abuse of drugs among adolescents and adults has prompted a renewed national concern about drug abuse. Educational programs have attempted to provided factual information and create negative attitudes about drug use so that students will decide not to use drugs. Studies have revealed, however, that the drug programs have not been effective in reducing drug use. The present research addresses two primary questions: 1) Are there developmental differences in young persons' perceptions of social and moral dilemmas associated with drug use? and 2) Are gender and race associated with social and moral reasoning about drug use? Semi-structured interviewers were conducted with 32 fourth and 32 eleventh grade students. The interview posed two vignettes about drug-related behavior, including helping behavior. In addition, the interview probed respondents' conceptions of the problems associated with drug use and of the treatment that users and dealers should receive. Content analysis produced 40 codes which reached the reliability criterion of 60 percent agreement. The Kappas ranged from .57 to .91 (m = .66). Chi square tests were conducted, using the variables of race, sex and the thematic categories associated with each question. Of the 26 tests of significance conducted on the variables, two were significant for grade, two were significant for gender and one was significant for race. Eleventh grade students were more likely to specifically reject some category of help than the fourth grade students (x2 = 4.48,p < .05, df = 1). Fourth grade students were more likely to consider teachers as a source of help (x2 = 3.48,p < .06, df= 1). Female students were more likely to acknowledge risk to themselves due to helping (x2 = 4.27,p < .04, df= I). Caucasian students were more likely to acknowledge that there may be risks to the helpee due to helping (x2 = 3.52,p < .06, df= 1). Male students were more likely to want punishment and control of drug dealers (x2 = 5.32,p < .05, df= 1). In general, the :findings indicate that there are fewer developmental, gender and race differences in children's perception of drug use and associated dilemmas than might be expected. Students' descriptions did reveal that they are thinking and reasoning about the information given to them.

This study examined the ethical decision-making process as it transpired in the everyday context of the therapeutic space. In-depth interviews explored the subjective experiences of six South African psychologists, practicing as psychoanalytic psychotherapists, and their efforts to resolve real-life ethical dilemmas. The theoretical framework used to interpret the data subsumed professional literature in psychology on principle-based ethical decision-making as well as contemporary psychoanalytic debates on the phenomenon of countertransference enactments. A review of ethics codes, survey research and seminal decision-making frameworks suggests that ethical dilemmas have traditionally been resolved by recourse to an objective and impartial “principle ethics” perspective. Empirical evidence shows, however, that logical thinking and the rational application of codes, principles and standards are often insufficient to secure ethical action. The establishment of reflective space and the core theoretical notion of “ethical decision-making enactments” were proposed in order to address the subjective, irrational and unconscious dimension of professional decision-making. This study used a broadly hermeneutic research method which transformed participants‟ descriptions of engagement with real-life dilemmas into a psychoanalytically informed interpretive account of ethical decision-making. Twelve aspirational ethical principles were found to guide participants‟ daily analytic work. Beneficence was the principle most strongly identified with and nonmaleficence was the most neglected ethical principle. Unprocessed countertransference responses were shown to drive earlier prereflective phases of the ethical decision-making process. Mature ethical judgment was predicated upon the retrospective analysis of enactment phenomena. Dissatisfaction was expressed by all participants with regard to the role of professional resources in aiding the resolution of stressful ethical dilemmas. Risk factors for compromised professional decision-making included the paucity and perceived irrelevance of postgraduate ethics training, supervisory failure to confront the ethical and countertransference dimensions of common dilemmas and professional isolation. Rather than eliciting the hope of emotional support and greater insight, professional resources on the contrary mostly appeared to induce anxiety, mistrust and fearfulness. Based on the data and the literature, a pragmatic psychoanalytically informed ethical decision-making model was finally generated. The model, which considers both principle ethics as well as countertransference phenomena, offers a preliminary contribution to professional dialogue on the development and evaluation of empirically based decision-making frameworks. Practical recommendations are made for both the revision of the current South African ethics code and for improving the postqualifying ethics education of psychoanalytic practitioners and supervisors. The limitations of the data are discussed and directions for future research initiatives are proposed.

In acknowledging past abuses of humans in research contexts, and recognising the potential for malpractices in Human Movement Studies (HMS), this study evaluated the extent to which ethical issues are addressed in the discipline. The primary method consisted of the standard techniques of philosophic analysis, with empirical data complementing the conclusions. In general, the study contends that insufficient attention is paid to ethical issues in HMS research. In response to a set of specifically constructed, ethically problematic research proposals, only 1.8% of comments from senior researchers advocated rejection of the proposals on ethical grounds. Also, a journal search indicated that consideration of ethical issues in published research may largely be absent. Questionnaire responses revealed that South African HMS departments may be deficient in terms of accountability towards ethical guidelines. Whilst noting the existence of utilitarian ethics in HMS research, it is advocated that deontologic principles should take precedence. Further, only a sound educative effort will produce improvements. In conclusion, this study advocates a deontology-based approach to research ethics. This is consistent with the contention that the use of humans in research is a privilege, and that the rights of participants ought to outweigh the desire of researchers to conduct research.

Digital piracy, the illegal copying or downloading of copyrighted digital products without approval from the copyright holders, has brought great economic loss to the software and digital media industries. Previous studies using moral developmental theory have not found consistent relationships between moral judgment and attitudes towards digital piracy. While some researchers have developed individual test items to assess relationships between moral judgment and attitudes toward digital piracy, others have relied on the Defining Issues Test (DIT). However, in that the DIT represents a general measure of moral judgment based on broad social issues, it, too, may not adequately assess an individual’s reasoning specific to issues regarding digital piracy. The purpose of this study was to create a reliable instrument (i.e., DP-DIT) modeled after the DIT designed to assess moral judgment regarding digital piracy as well as to examine and compare the ability of both DP-DIT and DIT2-short to predict attitudes, intentions and behaviors regarding digital piracy of college students. Results indicated the reliability of both the DIT2-short and the DP-DIT were discounted, quite likely due to the small number of stories contained in each. DP-DIT appeared to have greater predictive ability due to its advantage in predicting attitudes toward digital piracy, especially using DP-DIT MNS. However, even though here DP-DIT MNS was the strongest predictor of attitudes toward digital piracy, it explained a limited amount of variance. Further research to improve reliability and validity of DP-DIT is warranted.

This research deals with socially responsible investing (SRI) in its broadest context in South Africa and includes an analysis of the risk-adjusted performance of local SRI funds. SRI refers to an investment strategy whereby investors integrate moral as well as environmental, social and governance (ESG) considerations alongside conventional financial criteria in evaluating investment opportunities. Typical SRI strategies include screening, shareholder activism and cause-based (targeted) investing. The primary objective of this research was to obtain a deeper understanding of SRI in South Africa as it represents a powerful means whereby private sector capital can be channelled into areas of national priority. Data and methodological triangulation strategies were adopted to investigate the research problem, respond to the research questions and test the research hypotheses of this study. The phenomenological component of the research consisted of an extensive literature review as well as in-depth, face-to-face interviews conducted with twelve SRI fund managers and industry experts. The positivistic dimension of this research centred on the construction of the first complete database of SRI funds in South Africa, the sourcing of quantitative primary data and the testing of eight pairs of null and alternative hypotheses. Risk-adjusted performance was evaluated by means of the Sharpe, Sortino and Upside-potential ratios during three sub-periods, namely 1 June 1992 to 31 August 1998, 1 September 1998 to 31 March 2002 and 1 April 2002 to 31 March 2006. Forty-three SRI funds have been launched in South Africa since June 1992 and it is estimated that SRIs constitute approximately 0.7 percent of the total investment capacity in the country. It was found that most local SRI funds combine a cause-based investment strategy with a positive or best-of-sector screening approach. ESG screens were found to focus on the promotion of broad-based Black Economic Empowerment and the development of social infrastructure in South Africa. The FTSE/JSE SRI Index and the Financial Sector Charter were identified as the most prominent drivers of SRI in South Africa, whereas a lack of skills and a shortage of new SRI opportunities, asset classes and funds were seen as impediments to the growth of the local SRI sector. The empirical evidence shows that: - local SRI funds underperformed relative to their respective benchmark indices during the first two sub-periods but significantly outperformed them during sub-period three (the resurgence period of SRI in South Africa); - local SRI fund performance is not significantly different from that of a matched sample of conventional (non-SRI) funds; and - local SRI funds significantly underperformed relative to the general equity market in South Africa during sub-period two (the decline period of SRI in South Africa) but performed on a par with the FTSE/JSE All Share Index during sub-periods one and two. The findings of this research therefore suggest that investors can consider SRI funds as part of a well-diversified investment strategy. It is strongly recommended that a Social Investment Forum be established in South Africa to address the educational needs of stakeholders in the local SRI sector. It is also recommended that local asset managers adopt a focused differentiation strategy to take advantage of the growing SRI sector in South Africa.

Ethics is not a new or modern discipline. It was developed thousands of years ago and still remains relevant today. Ethics is applied in all spheres of modern life from philosophy to business and religious environments and even around dinner table conversations. It is applicable to all areas of life. This research is aimed at investigating whether ethical conduct among new entry level emerging contractors can contribute to and ensure their sustainable competitiveness within the South African construction industry. This research is also aimed at determining whether education and knowledge of entrepreneurship, business, project and construction management and building contracts can contribute to new entry level emerging contractors’ ethical conduct and sustainable competitiveness. The literature reviewed and results of quantitative and qualitative research amongst professional consultants in South Africa formed the basis of the study. Ethics is a sensitive topic within the industry and therefor it is difficult to gather data directly from contractors, as they are reluctant to participate in fear of revealing their identities and having it negatively influencing their personal and business credentials. Therefor unbiased respondents who were not directly linked to emerging contractors and who were unafraid to give objective opinions were questioned. These unbiased respondents included consultants within the industry. The study revealed that ethics is an important factor in any business environment and that the correct application thereof can partially contribute to the sustainable competitiveness of new entry level emerging contractors and this in turn can promote the long term survival of a business. Furthermore, knowledge of good management practices and building contracts can contribute to a successfully run business. However, the average new entry level emerging contractor has insufficient experience and knowledge of the management of construction projects, as well as building contracts.

This research falls within the field of normative business ethics. Its aim is to examine the moral nature of the employment relationship in western democracies by examining the liberal, democratic justifications that are normally advanced for its probity. Its concern is to challenge the notion that the employment relationship is in conformity with these liberal democratic values. Thus, the research is an exercise in the examination of the application of the liberal, democratic tradition to the social institution of employment. Thus research examines areas of dissonance between the political relationship of employee � employer and the dominant values of the liberal tradition found elsewhere in western democracies. The research firstly identifies the key moral characteristics of the employment relationship in private, capitalist organisations. This is derived from a consideration of the development historically, of the employment relationship, with acknowledgement of the combined influences of statute, common law, contract law and custom in forming the current employee relationship. Secondly, the research identifies the justificatory arguments from the liberal tradition that are normally advanced in support of the employment relationship�s moral probity. These include notions of rights deriving from private property, the separation of social life into public and private spheres and the application of contract law to employment. Thirdly, the research examines these arguments for their moral probity. Specifically, this involves an examination of the arguments regarding the private property status of employing organisations, the application of contract law to employment, the moral characteristics of the master and servant relationship as a basis for employment and the relevance of democratic values within employment. As an additional perspective, the literature on human needs is reviewed as a source, outside of the liberal tradition, for a basis upon which to outline the moral requirements of human relationships to work.

This thesis attempts to answer the following question: Is it ever morally permissible to use a minor child as a tissue or organ donor for the benefit of a family member? Those sceptical of using minors as tissue or organ donors for the benefit of a sick family member will highlight two points: the donor will be subject to risks that are not counterbalanced by possible medical benefits, and the minor cannot consent to the procedure herself.
This thesis will present a review of the medical risks associated with bone marrow and kidney donations, as well as a review of the common law dealing with donations by minors and incompetent persons. The final chapter then makes a case for the permissibility of minor donation based on the interests of the family.

The growth of the managed investment industry brings with it the potential for institutional investors to exert their influence on boards of listed companies to deliver strong and sustainable growth. The concepts of socially responsible investment (SRI), responsible investment (RI) or ethical investment (EI) have become part of mainstream investment practices in many financial markets. While SRI is largely a qualitative concept, its survival and adoption by the mainstream investment community may, in part, be due to the formalising of its concepts into language that investors, asset managers and analysts can more readily understand: the benchmark index. SRI indices may hold the key to attracting attention to ESG issues in listed corporates and to help bring about positive outcomes in sustainable development. Figures show SRI investments in emerging markets are minimal when compared to those in developed markets but emerging markets hold great potential for growth and development of these tools. This research develops a tool for bringing together social construction theory and stakeholder theory in understanding the construction of SRI Indices and in development of new indices. The core of this research is an analysis of SRI indices in three major emerging markets of Hong Kong, India and China, together with an analysis of different perspectives of SRI in Asia. The purpose is to identify opportunities to building SRI indices through a stakeholder engagement approach. The research was conducted over several phases between October 2008 and August 2010 and can be defined by three different studies: 1. a comparative study on SRI indices and their ESG criteria; 2. a comparative study on SRI indices and their stakeholder engagement approach; and 3. an analysis on the feasibility of building SRI indices in Asian markets. The findings from the three studies indicate three main arguments. First, ESG assessment and criteria of SRI indices does have an impact on the creditability and value of the SRI indices. Due to the lack of transparency on the ESG assessment and criteria, SRI investors and other stakeholder groups are deterred from adopting SRI indices as SRI tool. Second, stakeholder engagement is essential for SRI indices. And lastly, SRI indices in emerging markets, especially in the three studied markets, are attractive to both global and local SRI investors; however, these SRI indices need to include local ESG contexts to reflect the actual ESG concerns of the societies and avoid blindly following developed markets’ SRI index model, which in the end become unrealistic and unpopular to investors and stakeholder groups. We recommend that stakeholder engagement in index criteria and corporate assessment be widened and deepened; that governments and stock exchanges can play a pivotal role in SRI development and should take the lead. We also recommend that SRI indices strengthen the institution of corporate research to rely less on secondary data when making their corporate assessments.
