For Thomas Hobbes, nothing illustrated the “inconstant use of words” better than the confusion between “Counsels and Commands,” for the words “Doe this,” he said, “are the words not only of him that Commandeth; but also of him that giveth Counsell.” This confusion remains with us today. We still do not have a sound grasp of the distinctive place that counsel or advice plays within our constitutional system. How is ministerial advice to the sovereign concerning how a power ought to be exercised different from the exercise of the power itself? Does ministerial advice exist within a domain of political action beyond the reach of law? These are persistent questions in Canada.

This article reviews the creation, structure and output of the Central Policy Review Staff (CPRS) and compares the intentions of its founders with the practical achievements of its members. While the Staff produced reports of a high standard, ministerial interest was disappointingly half-hearted, which forced the Staff to rely on Prime Ministerial support more than it would have liked; in contrast, relations with the civil service in time proved more productive than anticipated. The article also examines the many changes in the Staff's activities made necessary by the changing requirements of successive governments—particularly since 1979—and finally suggests a form that a revived central analytical capability might take and the lessons that it should learn from the CPRS.

This article examines the duality of ministerial regulations in Indonesian regulation system based on their making authority sources according to Law No. 12 Year 2011 concerning Regulation Making Rules (UU P3). The approach methods used in this research are conceptual approach and statute approach. This article concludes there are two ministerial regulations which recognized as regulations by UU P3 that should be distinguished. Ministerial regulation which was made by higher regulations order (delegated legislation) could be categorized as an implementing rule (verordnung). Whereas, ministerial regulation which was made based on ministery position authority (inherent aat het bestuur) could be categorized as a beleidsregel, standing as policy rules. Though, the two of them were recognized as regulations, however, they have different design, background and character, thus, their substance, binding power, hierarchy position and review mechanism, were not the same. Therefore, ministerial regulation which was beleidsregel could not be applied as the same as implementing regulation (verordnung).

In January 2000 the Victorian government established a 'Ministerial Review of Postcompulsory Education Pathways in Victoria'. This explores the work of this Ministerial Review using an organisational discourse approach to the policy-making process. The study examines how the initial problem was represented that required policy intervention. I ask what the Brack's Victorian State Government defined, understood and represented the 'problem' to be regarding young people's participation in post-compulsory education. The research then focuses on establishing how the Ministerial Review set out to validate the initial representation of the problem. The research then concentrates on how the Ministerial Review came to develop its policy recommendations to address the policy problems it had identified. This involves establishing what solutions to the 'problem' were proposed by the Ministerial Review panel and why they were recommended as policies. Finally this study evaluates the value of the Ministerial Review process.

This paper is organized as follows. The introduction determines what Foreign Economic Policy is. Then, it builds a theoretical framework about Foreign Economic Policy formulation in developing countries, with a focus in Lain America. This discusses three different approaches: system-centered, society-centered and state-centered. Then, it explores literature about epistemic communities in Latin America in order to determine to what extent this has focus on Foreign Economic Policy formulation. Finally, it explores the importance of studying the role of epistemic communities in public agencies in charge of foreign economic relations in the region.
Este escrito está organizado de la siguiente manera. En la introducción se discutirá en quéconsiste la política económica exterior (en adelante PEE). Luego, en primer lugar, se construye un marco teórico en torno de la formación de la PEE en los países en vías de desarrollo y, en particular, en América Latina. Ello a través de tres enfoques diferentes: centrado en el sistema, en la sociedad y en el Estado. En segundo lugar, se busca mostrar de qué manera este marco teórico podría informarse del constructivismo. Asimismo, se aborda la literatura sobre las comunidades de conocimiento latinoamericanas para determinar hasta qué punto ha sido tratada la formación de PEE. Finalmente, se arriba a una conclusión sobre la necesidad de explicar el papel de las comunidades de conocimiento en los organismos o agencias públicas encargadas de las relacioneseconómicas exteriores latinoamericanas.

Abstract Digital transformation will impact the European Higher Education Area (EHEA) and could contribute to developing a new vision for the Bologna Process and for higher education in Europe and beyond. In recent years, research on European and national levels has shown increasing attention being paid to digitalisation and digital transformation by higher education leadership. The 2015 and 2018 Ministerial Communiqués also clearly emphasised the importance of the topic for the EHEA. Yet, a strategic integration of digitalisation into higher education policy and practice remains hard to find. This is for two main reasons: (1) because although digitalisation is often seen as a technical innovation, it must, in fact, be a social innovation for it to have any impact and (2) because higher education as a field of practice, especially in Europe, is a multi-layered system where strategic impact is only possible if all layers are broadly following the same objectives. With reference to policy theory, the authors conjectured that reducing goal conflict and practice ambiguity would help to facilitate a more integrative digital policy and practice. With this aim, the authors launched a White Paper in 2019 to facilitate broad agreement on the potential of digitalisation within the Bologna framework. This contribution provides an interim evaluation of the initiative and its next steps. In this, it provides a reflexive review of how practitioners and researchers in the field might hope to influence policymaking and practice in the area of digitalisation.

AbstractCircular economy (CE) is a new development strategy adopted by the European Union (EU) authorities in 2014, aiming to boost global competitiveness, foster sustainable economic growth, and generate new jobs. The CE approach maintains the added value in products for as long as possible and eliminates waste; moreover, it implies totally systemic change and innovation not only in technologies, but also in organization, society, finance methods, and policies. Such an approach leads to a new model of production and consumption and a new relationship between stakeholders at the local, regional, national, and EU levels. The first consideration of CE priorities in Poland started in 2016 when the Inter-ministerial Committee for Circular Economy was established. Representatives from nine ministries became committee members, and the chief document they prepared was the Roadmap for Circular Economy Transition. The document proposed an action plan for CE implementation and focused on increasing resource efficiency and waste reduction in Poland. Prepared with the active involvement of all possible stakeholders—businesses, NGOs, the academic and research community, and local and regional authorities—the Roadmap can be seen as a quick and effective guide. In addition to national government initiatives, there were numerous attempts to implement CE principles at the local and regional levels. The main goal of the current research was to examine the effectiveness of such national, regional, local, and business CE projects for influencing Poland’s CE transition during the past three years. This study reviews the main policy documents, reports, and expertise of national, international, regional, and local organizations and NGOs involved with CE in Poland. The research is also supported by a review of the relevant academic literature. As a result, it was possible to estimate the current level of achievement, as well as future prospects for CE in Poland. Moreover, this research identifies potential opportunities for updating existing planning policies and tools related to CE-based development in Poland.

The 2018 Act introduces a strictly controlled ministerial review mechanism. The Act prevents designated persons from immediately challenging section 1 regulations before the courts, by way of judicial review. Rather, they must first request either variation or revocation of the designation from the appropriate Minister (at the Treasury or Secretary of State level). Only after that initial stage may a designated person seek judicial review of a sanctions-related decision; see Chapter 9 of this Guide. Thus, those who are subject to financial sanctions can challenge their listing, but financial sanctions will remain in place while the challenge or request is being considered.

Herfkens and Short left their cabinet positions in 2002–3, the former because of a government change, the latter over disagreement with the government’s policy in the Iraq War. But Johnson stayed in office until 2005 and Wieczorek-Zeul until 2009, pushing for implementation of the U4 agenda in different contexts and with different partners. They continued to collaborate with each other, the UK, and the Nordics, on specific issues. Thus, while a systemic and fully fledged U4 cooperation never re-emerged at the political and ministerial level, there was a transition over time. The U4 did not disappear from the international scene as much as they faded away as a ministerial group. This chapter reviews this transition roughly over the period 2003–8, discussing key aspects of international cooperation for development: the Rome–Paris–Accra accords on Aid Effectiveness, the UN 2005 Millennium Development Goals Review, the Doha Round of Multilateral Trade Negotiations; changes in HIPC, the Doha Review Conference on Financing for Development, and other aspects of international cooperation over this period.

Chapter Two looks at Ministerial use of, and attitude towards, intelligence after Labour’s 1945 Election victory, drawing on the papers of the Joint Intelligence Committee (JIC). While it has been argued that Attlee, a committed internationalist, was opposed to any hostility towards the Soviet Union, the chapter shows that he was kept fully aware of Soviet interests and intentions despite his commitment to renewed Anglo-Soviet relations. In addition to highlighting the role of intelligence in early Cold War crises, particularly the Berlin Blockade, it also looks at Ministerial doubts about the intelligence community, particularly those of Attlee himself. By 1949, he had grown increasingly critical of the intelligence services and, a year later, ordered a review of the intelligence community by the Cabinet Secretary, Sir Norman Brook, which is explored here for the first time.

Chapter Five studies Ministerial reactions to the spy scandals that threatened Anglo-American nuclear exchanges. Considering the cases of Alan Nunn May, Klaus Fuchs, Bruno Pontecorvo, Guy Burgess and Donald Maclean, it argues that Ministers were sensitive to claims from the United States that Britain was weak in the field of security. After the Fuchs and Pontecorvo scandals, Ministers reacted quickly to repair any damage to transatlantic relations by introducing new security procedures known as ‘Positive Vetting’. The chapter also uses newly released archival material to shed light on Ministerial reactions to the disapperance of the Foreign Office diplomats, Guy Burgess and Donald Maclean, in the spring of 1951. Their defection provoked widespread outrage and, once again, prompted a review of security in government, on this occasion the Foreign Office, on the instructions of the Foreign Secretary, Herbert Morrison, now Foreign Secretary, which is explored here for the first time.

Canada contrasts distinctly with the prominence of intelligence oversight in the United States, insofar as Canada stands out for a predominately ex post facto approach to reviewing intelligence. Recent changes, however, bolstered the role of oversight in Canada’s accountability system. Previously, only three of 16 agencies that make up Canada’s intelligence and security community were reviewed by independent expert review bodies. Critics, however, argued that review should be more encompassing, lamented constraints by the Canadian intelligence accountability system that made it difficult for review bodies to cooperate and the negligible role of Parliament in holding ISAs accountable. Recent legislation created a security-cleared committee of parliamentarians to review Canada’s security and intelligence community, an agency to review activity related to national security and intelligence as well as an independent commissioner to oversee certain ministerial intelligence authorizations. The chapter reviews member organizations of the Canada’s intelligence community, the strategic environment that has informed intelligence and accountability in Canada; national security threats to Canada; as well as internal and external dynamics that culminated in changes to Canada’s intelligence accountability architecture: the Civilian Review and Complains Commission of the Royal Canadian Mounted Police, the National Security and Intelligence Committee of Parliamentarians, the National Security and Intelligence Review Agency, and the Intelligence Commissioner. The prospect of the NSICOP, NSIRA, and the IC strengthening compliance and general operations of Canada’s intelligence and security community will be realized by how each fulfils its broad mandate in practice and the degree of cooperation among NSIRA, NSICOP, and CRCC.

This chapter focuses on presenting the main research questions and answers provided in the literature on the different stages of the coalition life cycle. For example, focusing on the first stage—the formation stage—several researchers have tried to explain why specific types of governments form. Other scholars have asked why it takes longer to form governments in some contexts, or have tried to explain how parties distribute ministerial and policy payoffs when forming a cabinet. Focusing on the second stage of the coalition life cycle, we review the growing literature on coalition governance, concentrating on three coalition governance models; the ministerial autonomy model, the coalition compromise model, and the PM-dominated model—each of which make different assumptions about the actors that dominate the governance process in coalition governments. Focusing on the last phase of the coalition life cycle, the termination of governments, scholars have long aimed to explain the duration of cabinets, asking why some cabinets last longer than others. At the end of this chapter, we present some expectations about changes to the coalition life cycle which we are likely to observe considering the party system change we have seen in many Western European countries.

The system is an m-health application targeted at maternal health patients in South Africa. Execution of the project was carried out by a consortium headed by the National Department of Health. Project execution began in 2012, and the launch was two years later in 2014. In this research, a health systems framework for evaluation of implementations of m-health systems in developing countries was used to review the system. The sources of data for the study were face-to-face interviews of the Momconnect Task Team, Ministerial Advisory Committee on e-Health, and a sample of health care providers and consumers from the health facility level in Johannesburg Metro City. These interviews were supplemented by a document review. The findings of the study are reported according to the four headings of the study framework.

The intent of this publication is to provide an overview of the development of the VINCI® engine over the period 2014–2015. The VINCI® engine is an upper stage, cryogenic expander cycle engine. It combines the required features of this cycle, i. e., high performance chamber cooling and high performance hydrogen turbopump, with proven design concepts based on the accumulated experience from previous European cryogenic engines such as the HM7 and the VULCAIN®. In addition, its high performance and reliability, its restart and throttle capability offer potential applications on various future launcher upper stages as well as orbital spacecraft. At the end of 2014, the VINCI® successfully passed the Critical Design Review that was held after the major subsystem (combustion chamber, fuel and oxygen turbopump) had passed their own Critical Design Review all along the second half of 2014. In December, a Ministerial Conference at government level gave priority to the Ariane 6 program as Europe future launcher. In the framework of this decision, VINCI® was confirmed as the engine to equip Ariane 6 cryogenic upper stage engine. This publication shows how the VINCI development is progressing toward qualification, and also how the requirements of the new Ariane 6 configuration taken into account, i. e., offering new opportunities to the launch system and managing the new constraints. Moreover, the authors capitalize on the development already achieved for the evolution of Ariane 5. In parallel to completing the engine development and qualification, the configuration and the equipment of the propulsive system for Ariane 6 such as the components of the pressurization and helium command systems, board to ground coupling equipment, are being defined.

The Japan Society of Mechanical Engineers (JSME) issued the latest edition of Rules on Thermal Power Generation Facilities (JSME S TA1, TA2-2008) and the Mandatory Rules (JSME S TA0-2008) to satisfy the Japanese Electric Utility Industry Law and the Ministerial Ordinance (MO) No.51 of Ministry of Economy, Trade and Industry (METI). This Mandatory Rules were developed and described in form corresponding to the text of the regulatory Interpretations of MO No.51. Japan Electric Standards Committee (JESC) reviewed and evaluated these JSME Rules and proposed METI to accept the JSME Mandatory Rules as the harmonized code in MO No.51 of METI. These JSME Rules are basically equivalent to the ASME B & PV and Piping codes. In this paper, differences between JSME Rules and the ASME Rules were described to be helpful for the ASME Code users.

The last generation of PWR, the European Pressurizer Reactor, is being built both in Finland at Olkiluoto and in France at Flamanville where it will be the second unit in operation in two years. The conception of the reactor has no fundamental differences compared with the last French and German generations (i.e. N4 1450 MW and KONVOI 1300 MW). In fact the EPR is a synthesis of the best knowledge from both parts of Rhin river. Nevertheless, for what concerns the primary and secondary systems, few new issues have been implemented and they have important consequences for the pre-service inspection programme. First of it, main coolant lines and main components are declared break preclusion that means another approach for the in-service inspection and the requirements for pre-service inspection. A second one, is that the 1999 ministerial order will apply for the first time on a new unit. The inspection programme has to take it into account particularly in terms of NDE performance demonstration. In terms of structural integrity, the most important areas have been reviewed with fast fracture and fatigue criteria to determine the levels of NDE qualifications. This paper describes the important steps to reach the PSI and what is being developed in terms of NDE in relation to the structural integrity. Several examples are given to illustrate how EDF prepares the PSI of the EPR.

AbstractThe urgency for developing a circular economy is growing, and more and more companies and organisations are concerned with the importance of adapting their business to fit a changing economy. However, many analyses on the circular economy are still rather abstract and there is a lack of understanding about what circularity would mean for specific industries. This insufficient insight especially seems to be apparent in the building and construction sector. Besides, the building and construction sector is responsible for a major part of energy use and emissions. To tackle the issue of insufficient insight into the business consequences of circular devlopments, further research is necessary. Therefore, we propose to collaborate on a research project that aims to provide a more detailed level of analysis. The goal is to identify drivers and barriers to make better use of materials in the building and construction sector. This further research would benefit from an international collaboration between universities of applied sciences and industry from different European countries.
