The purpose of the research reported in this thesis is to investigate the occurrence and recognition of “limit experience” among some Catholic High School students in their final year at selected secondary colleges in Brisbane. “Limit” experience was defined as an experience that reveals a reality of life beyond the self, beyond the here and now. It may be recognition of our own fragility and vulnerability as much as a joyous awareness of a reality beyond our normal encounter with life.” The research work of the Alistair Hardy Research Centre and of Hay (1987) in particular has centred on the question, asked in various ways: Have you ever been aware of, or influenced by, a presence or power, whether you call it God or not, which is different from your everyday life? The survey instrument for this research was designed to divorce questions on such experiences from the direct reference to the term “religious”, although individuals might indeed interpret them as “religious”. To approach the issue, an extensive open-ended survey was administered to senior high school students. It was designed first to determine the extent of recognition of such experiences among the students and second to examine whether factors such as home background, regular religious practice, type of school, subject choice or co-curricula activities may make a difference in enhancing the awareness of such experience. This research has also been designed to enable comparison with similar studies. Major research in Australia by Flynn (1975, 1985, 1993) highlighted the factors above as influencing student achievement. Flynn also made connections to religious practice and attitudes to church but not to religious experience as such. Robinson and Jackson (1987) had undertaken extensive research on religious experience in Great Britain that also has important parallels to this research. Some of the techniques of both studies and in some cases actual questions have formed part of this research instrument. This research has gone further than both studies by incorporating the Hay (1987) categorisation of types of religious experience to form the basis for direct questions on student experience. The data gathering, treatment and analysis focused on four catholic secondary schools in the Brisbane Archdiocese. While the research focus was by definition limited, and while the results have of necessity to be treated with some caution before wider generalisation, the outcomes of the research do illuminate some of the important issues identified in the literature. The results of the survey showed that over 90% of the respondents could affirm some association with a “limit” experience along the lines of the Hay (1987) framework. With significant strengthening of criteria to allow for meaningful statistical analysis, this reduced to 76% of respondents. Results for this smaller group were shown to be essentially independent of home background, type of school attended, co-curricula programs and level of religious practice. With the significant exception of religious education, their recognition of “limit” experience was also independent of subject choice. This last is in contrast to the earlier work of Robinson and Jackson (1987). Exploratory analyses of the data enabled comparisons to be made with a suggested framework for “spiritual sensitivity” and the context of “relational consciousness”, both of which were first proposed by Hay and Nye (1998). This suggests some possible directions for further research into adolescent spirituality. The exploratory analyses also highlight some of the conflict between the reality of these experiences for students and their experience of dissonance with institutional religion.

Digital video games are an immensely popular form of entertainment. The meaningful positive experiences that games facilitate are fundamental to the activity; players are known to invest a lot of time playing games in search of those experiences. Digital games research is polarized. Some studies find games to be a healthy hobby with positive effects; games promote well-being through regular experience of positive psychological experiences such as flow and positive emotions. Others have identified rare problematic use in those players who devote excessive amounts of time to gaming, associating them with social dysfunction, addiction, and maladaptive aggression. While it remains unclear if games cause these effects, or merely coincide with play, the negative effects historically receive more attention in both popular media and academia. Some authorities attempt to reduce the harms associated with games to such an extent that their methods have become national policy affecting all players including those who exhibit no negative outcomes. In South Korea and Taiwan, policing authorities employ a behaviour policy that sets strict daily limits on session length, thereby controlling the amount of time people spend playing games each day. In China, the General Administration of Press and Publication employ a design policy requiring that games service-providers fatigue their games’ mechanics after a period to coax them to take a break sooner than they ordinarily would. Both policy types alter player interaction with games in any given session and it is unclear how these policies affect players in general. This research aims to compare sessions affected by the behaviour policy, design policy, and policy-free sessions in terms of session length, measurable subjective user-experience, the player's intention to return to the game, and their reasons for choosing to stop playing in a particular session. For use in a repeated-measures experiment, we modified the action RPG Torchlight II to simulate both policies. Participants had one session at the same time each week for three consecutive weeks. In varied sequences, participants played a control session unaffected by policy, a one-hour shutdown session representing behaviour policy, and a fatigue session representing design policy. After each session, we recorded their session's length, their user-experience in terms of flow and affect, their intention to return to the game, and their reason for ending the current session. We found that our shutdown condition successfully decreases session length, when compared to the other conditions. The condition facilitates strong flow, moderate positive-affect, and weak negative-affect. The shutdown event does not appear to degrade positive experiences and makes participants slightly more upset (statistically significant) than they would be after choosing to stop playing. This is because players do not get to make that decision, and because players are unable to complete the goals they have set for themselves. Most players intended to play the game again immediately or sometime later in that same day, much sooner (statistically significant) than they would after choosing to stop. This also may be due to satisfaction associated with choosing to stop, or being unable to complete their self-set goals. We found that our fatigue condition increases session length when compared to the other conditions. This result contradicts the intentions associated with design policies: shorter sessions. The fatigue mechanics make the game more difficult, which increases the time required for players to complete the goals they have set for themselves, whether it is to complete a level, quest, or narrative sequence. The condition facilitates high levels of flow, moderate positive-affect and low negative-affect; the condition does not appear to degrade these positive experiences, nor increase negative experience. Most players intended to take the longest breaks between sessions of at least one day, and although we observed that these were longer than the control condition, the differences is not statistically significant. We found that most participants chose to stop playing when the game stopped providing them with positive experiences, or begins to generate discomfort. A large group of participants chose to stop because another activity took priority. Few participants chose to stop because they were satisfied with their session. Less than one third of players explicitly referenced the fatigue mechanics in their decision to stop. Neither policy is holistically better than the other. Both provide strong positive experiences, and have different effects on session length. Whereas it appears that the fatigue condition fails to reduce session length, it also appears that players intend taking longer breaks between sessions, which may reduce total play-time across all sessions. Similarly, the shutdown condition may increase total play time, or at least bring it closer to normal amounts of play-time while also making players more upset. Our operational definition of user-experience is bi-dimensional, and does not include many experiential constructs commonly associated with digital games. During this research, several reliable and valid, and more representative experience measures became available. Any future work on this topic should make use of one of these. Our experiment tested the effects of player experience associated with a single game, genre, and context. Future research should reduce the variation of player factors by focusing on single personalities, typologies, or risk-factors rather than generalizing to all players. We tested out participants only as they played in the early stages of Torchlight II. It is possible that the game's narrative elements, rather than the gameplay mechanics fatigued by the design policy, motivated continued play. We suggest a longitudinal study of the individual policies to explore their effects over many sessions.

This thesis develops a model for the net present value to the firm of a strategy of increasing an SBU's market share as a function of four quantitative variables: the firm's initial market share, the current position in the product life cycle, as viewed by the firm, the competitor's relative experience curve slope and the competitor's view of the shape and size of the product life cycle. The net present value is calculated using traditional definitions, but includes a limit pricing strategy by the firm and assumes the existence of the experience curve. The prime reason for the development of this model is to test quantitatively the capital budgeting implications of the portfolio matrices proposed by the Boston Consulting Group and McKinsey and Company. And, to suggest a format that better integrates corporate strategy and finance. The most important finding of this research is that the inclusion of experience curve effects causes relative market share to assume dominance over market growth rate in the BCG matrix and causes business strength to assume dominance over industry attractiveness in the McKinsey matrix, at least within the limitations and assumptions of the model. Put into laymen's terms, that means that corporate planners should abandon attempts to convert low share but high growth businesses (what BCG calls "Problem Children") into "Stars", if such conversion can only be accomplished .through price, or price equivalent competition, as long as both participants are equally competent. A second important finding is that other variables, beyond growth and share, can be successfully and quantitatively incorporated into the model. This means that the two-dimensional approach of the Boston Consulting Group can be improved upon by adding additional variables or that businessmen can make better use of the McKinsey approach to strategy and its investment implications, by logically quantifying their variables.

Cette thèse interroge les relations entre l’architecture et l’horizon et montre qu’elles engagent la notion philosophique d’habiter. Au travers du prisme de l’horizon, l’objectif est de repenser les limites des pratiques des architectes, de saisir leur sens et de mesurer la responsabilité des professionnels qui participent à la transformation des milieux habitables. Au tournant de la modernité, l’étude de l’horizon chez Le Corbusier, Claude Parent, Henri Gaudin, Álvaro Siza, Pierre-Louis Faloci et Marc Barani, éclaire des évolutions dans les modes de voir et de penser le monde, de la première moitié du 20e siècle à nos jours. Des récits d’expériences vécues au sein d’architectures construites sont confrontés à des entretiens menés avec les architectes ainsi qu’à l’analyse de leurs écrits, dessins, plans et/ou archives. Tour à tour, l’horizon, l’architecture et l’habiter sont mis à l’épreuve. Au premier abord, l’horizon évoque la limite visuelle lointaine du paysage. Mis à l’épreuve de l’architecture, il se révèle aussi comme limite spatio-temporelle et corporelle, qui concerne la relation sensible et existentielle entre l’homme, l’architecture et le paysage. À l’épreuve de l’horizon, l’analyse des pratiques et des expériences des architectes démontre une pluralité de modes de dire et de faire. Comme prisme de lecture, l’horizon traduit le sens des actions et des pensées de ces professionnels. Au travers de leurs invitations à « habiter l’horizon », les architectes témoignent d’un changement de paradigme à l’œuvre depuis Le Corbusier. L’ouverture et le rythme entre l’architecture, l’homme et l’horizon s’imposent finalement comme les conditions d’un habiter possible
This thesis examines the relationships between architecture and horizon, and show that they are committed with the philosophical notion of dwelling. Through the lens of horizon, the purpose is to grasp architect’s practices, to rethink their limits and to measure the responsibility of the professionals who are involved in the transformation of places where people can live. At the turn of modernity, the study of horizon by Le Corbusier, Claude Parent, Henri Gaudin, Álvaro Siza, Pierre-Louis Faloci et Marc Barani, sheds light on changes of ways of seeing and thinking the world, from the first half of the 20th century to the present day. Accounts of experiences within built architectures face interviews conducted with architects and the analysis of their written materials, drawings, blueprints and, or, records. Horizon, architecture and the place we live in, in turn, are tested. At first sight, the horizon calls to mind the far visual boundary of the landscape. Put to the test of architecture, it also proves to be a physical spatial and temporal boundary which concerns the sensitive and existential relationship between humans, architecture and landscape. Put to the test of horizon, the analysis of the architects’ practices and experiences show a plurality of ways of saying and doing. As a reading prism, the horizon expresses the sense of the actions and the thought of these professionals. Through their propositions to “dwelling the horizon”, architects reveal a paradigm shift operating since Le Corbusier. The openness and the rhythm between architecture, human and horizon turn out to be the conditions of a dwelling possibility

When scuba diving under a physical overhead such as a cave, a mine, a shipwreck, or under a virtual overhead due to decompression requirements, it makes it impossible to safely access the surface in the event of an emergency. Therefore, diving with overhead is often described as technical diving. In this research, I address how technical divers in Outaouais, Quebec, practice this risky sport with unforgiving consequences. Based on fieldwork in Outaouais, I focus on divers, including myself, who perform trimix dives deeper than 200 feet. I argue that the process of becoming a deep diver is a lifelong journey where a diver learns to adapt to a milieu hostile to human life. The basic skills are acquired during classes to ensure that a novice diver will survive in this limit-environment. As divers bend the rules and take more risks to go deeper for longer lengths of time, they will go through a series of limit-experiences and near misses that are essential to their development and found to be regenerative. In turn, those limit-experiences and near-miss events shared with teammates create mutual trust. It is this trust that becomes the foundation of the team and allows the team to improve upon existing techniques and increase the depth and difficulty of their dives.

Le concept d’indicible, aussi complexe soit-il, peut se fonder sur une expérience du sensible, et trouver un contexte commun dans les évènements transgressant la limite et pointant un certain chaos. Ceux de la Guerre d’Espagne ont constitué, par de nombreux aspects, des exemples de ces excès impensables. L’impact de l’environnement sur les créateurs s’est entendu dans les traces thématiques qui s’imposent dans les œuvres composées sur les thèmes de la mort, de la violence ou de la guerre : en partant des phénomènes sonores, ont été relevées des figures qui rendent sensible le dépassement de la limite et la connotation chaotique et font écho à ce qui dépasse l’entendement, comme la destruction de l’homme ou l’inintelligibilité de la mort. Ces figures, relevées grâce à des outils de sémiotique (icônes, indices et symboles peirciens, disjoncteurs d’après Rinn, être et faire inspirés de Greimas, sémiose interne que l'analyse structurelle viendra alimenter), s’inscriront dans des champs sémantiques que nous avons relevés comme étant liés au concept d’indicible contextualisé (démesure ; altérité absolue ; irréel ; mort ; abjection…), non seulement en musique, mais aussi dans les autres arts. Nous explorerons la parenté de ces figures relevant parfois d’un niveau pré-sémique. Nous dégagerons des figures de l’indicible partagées par différents compositeurs espagnols dans des œuvres composées sur ce thème et soulignerons des réminiscences chez certains auteurs, tandis que les spécificités compositionnelles et sémantiques manifestant l’indicible évènement seront explicitées, y compris au sein d’une proto-intrigue dont nous observeront les particularités symptomatiques
The concept of unspeakable, as complex as it may be, can base itself on an experience of the sensitive, and find a common context in the events exceeding the limit and pointing a certain chaos. Those of the Spanish Civil War have constituted, by numerous aspects, examples of these unthinkable excesses. The impact of the environment on the creators has been heard in the thematic traces which are imperative in the works composed on the themes of death, violence or war: from the sound phenomena, some figures making sensitive the exceeding of the limit and chaotic connotation have been highlighted and echo what is beyond belief, as the destruction of man or the inaudibility of death. These figures rose thanks to semiotics’ tools (icons, indications and peircian symbols, breakers (“disjoncteurs ”) according to Rinn , being and doing inspired by Greimas, introversive semiosis that the traditional structural analysis will come to feed), will join semantic fields which we found as being connected to the contextualized concept of unspeakable (immoderation; absolute otherness; unreal; death; abjection …), not only in music, but also in other arts. We shall explore the kinship of these figures being sometimes of a pre-semic level. We will bring out figures of the unspeakable shared by various Spanish composers in works written on this theme and will underline some recollections at certain authors, whereas compositional and semantic specificities showing the unspeakable event will be clarified, including within a “proto-intrigue” whose we will observe the symptomatic peculiarities

A pesquisa Corpolimite parte do discurso de onde a fisicalidade e experiência informe do corpo que atravessa camadas, dos rituais de passagem às políticas urbanas, cria complexidades e zonas desestabilizantes que revelam saberes via percepção e sentidos através da experiência poética em carne-viva. Partindo da perspectiva das modificações corporais no contexto das transformações extremas (como tatuagens, piercings, escarificação, implantes e suspensão corporal) o trabalho traça um percurso errático acerca das práticas de corpo que borram fronteiras, abrem fissuras e desviam, criando novos caminhos poéticos, novos jogos de significação. Baseando-se numa escrita poética e biográfica, o texto mistura imagem e palavra de forma a elaborar uma trama das complexidades envolvidas nos processos descritos. Trabalhando no campo da Performance Art e da Body Art o discurso arte-vida é permanente, trazendo à tona traços da vida cotidiana. Bodylimit is a study based on a discourse in which both the physicality and the amorphous experiences of the body as it crosses through layers of situations ranging from rites of passage to urban policies create complexities and zones of destabilization that reveal different forms of knowledge through sense perception and through a poetic experience felt in living flesh. Viewing body modification within the context of extreme transformations (such as tattoos, piercings, scarification, implants, and suspension), the research traces an erratic path through physical practices that blur borders and open fissures and detours to create new poetic paths and new games of signification. Utilizing a poetic and autobiographical writing style, the text mixes images and words to elaborate a web based on the complexities involved in the physical processes it describes. The study situates itself in the fields of Performance Studies and Body Art, in which the discourse of art-life is a permanent phenomenon that brings traces of quotidian life to the forefront of the text. These traces spill and overflow throughout the flesh-text, which is the living material in this body of paper

This thesis takes the position that current analyses of digitally mediated interactive experiences that include narrative elements often lack adequate consideration of the technical and historical contexts of their production.From this position, this thesis asks the question: how is the reader/player/user's participation in interactive narrative experiences (such as hypertext fiction, interactive fiction, computer games, and electronic art) influenced by the technical and historical limitations of the interface?In order to investigate this question, this thesis develops a single methodology from relevant media and narrative theory, in order to facilitate a comparative analysis of well known exemplars from distinct categories of digitally mediated experiences. These exemplars are the interactive fiction Adventure, the interactive art work Osmose, the hypertext fiction Afternoon, a story, and the computer/video games Myst, Doom, Half Life and Everquest.The main argument of this thesis is that the technical limits of new media experiences cause significant ‘gaps’ in the reader’s experience of them, and that the cause of these gaps is the lack of a dedicated technology for new media, which instead ‘borrows’ technology from other fields. These gaps are overcome by a greater dependence upon the reader’s cognitive abilities than other media forms. This greater dependence can be described as a ‘performance’ by the reader/player/user, utilising Eco’s definition of an ‘open’ work (Eco 21).This thesis further argues that the ‘mimetic’ and ‘immersive’ ambitions of current new media practice can increases these gaps, rather than overcoming them. The thesis also presents the case that these ‘gaps’ are often not caused by technical limits in the present, but are oversights by the author/designers that have arisen as the product of a craft culture that has been subject to significant technical limitations in the past. Compromises that originally existed to overcome technical limits have become conventions of the reader/player/user’s interactive literacy, even though these conventions impinge on the experience, and are no longer necessary because of subsequent technical advances. As a result, current new media users and designers now think of these limitations as natural.This thesis concludes the argument by redefining ‘immersion’ as the investment the reader makes to overcome the gaps in an experience, and suggests that this investment is an important aspect of their performance of the work.

L'objectif de ce travail a ete d'etudier a partir des mesures experimentales aeroportees, realisees pendant l'experience semaphore, les caracteristiques de la couche limite atmospherique marine (clam) au dessus du front oceanique des acores marque par un gradient de temperature de surface (sst). Cette etude a porte sur 10 situations ou les avions ont realise des mesures couplees avec le bateau suroit. Ce travail a tout d'abord necessite un travail de comparaison entre les mesures realisees par les differents moyens aeroportes et le bateau. Les donnees experimentales ont ete confrontees avec le modele arpege developpe au centre national de recherche meteorologique (cnrm) qui sera utilise pour l'interpretation phenomenologique. Le forcage oceanique est caracterise par un gradient de sst relativement faible (environ 1c/100 km) separant les eaux chaudes des eaux froides. Les flux de surface augmentent systematiquement de la zone froide vers la zone chaude quelle que soit l'orientation du flux incident. L'epaisseur de la couche limite sous l'influence des flux de flottabilite augmente dans la zone chaude le gradient de temperature potentielle dans la clam est legerement plus faible que le gradient de sst. Globalement, les gradients de temperature potentielle dans la clam est legerement plus faible que le gradient de sst. Globalement, les gradients de sst induisent un chauffage differentiel en surface de la clam qui rend la couche limite melangee barocline. Les parametres turbulents de la couche limite augmentent de la zone froide vers la zone chaude. Adimensionnes, ils ont des comportements analogues au dessus de la transition frontale. Ceci signifierait que dans semaphore, sans doute a cause de la faiblesse des gradients, la turbulence est en equilibre local et peu influencee par les termes de transport horizontaux. Le bilan d'energie cinetique turbulente montre que la production turbulente est essentiellement thermique. Le vent, en situation anticyclonique, augmente des zones froides vers les zones chaudes montrant qu'une circulation secondaire se cree en relation avec le gradient de sst. Cette circulation est fortement ageostrophique comme le montre l'analyse des bilans de quantite de mouvement et les simulations arpege qui ont permis de mettre en evidence la relation existant entre les champs de sst et des flux de flottabilite avec l'orientation du vent moyen dirigee vers les zones chaudes.

General education teachers are critical contributors to the successful inclusion of students labeled with learning disabilities in general education classrooms. Similarly, teacher beliefs about disability labels significantly influence how teachers include or exclude students labeled with a learning disability in their classrooms. This qualitative study investigated eight secondary general education teachers’ attitudes towards inclusion and their experiences teaching students labeled with a learning disability from a Critical Disabilities Studies perspective. Data were collected using an innovative qualitative method, Q methodology, in order to surface distinct perspectives within the group about inclusion and the experience of teaching students labeled with a learning disability in their classes. The data bore that while teachers agree with the aspirations of inclusive education, they insist they are not capable of teaching students labeled with a learning disability. These findings support the need for systemic change within teacher preparation programs and schools that can disrupt deficit notions of disability.

Cette étude porte sur les données de la campagne de mesure ESCOMPTE. Son but est d'analyser la structure verticale de la basse troposphère en liaison avec le transport et la diffusion des polluants. Cette analyse montre en particulier la difficulté à définir une couche limite comme on le fait classiquement. Elle permet de mettre en évidence la superposition complexe de couches limites internes, surtout près des côtes. L'étude de l'épaisseur de la couche dans laquelle la pollution est soit diluée, soit accumulée, montre que le mélange reste bloqué près de la surface, près des côtes par régime de brise de mer, alors qu'il est advecté et réparti sur une épaisseur plus conséquente sur les montagnes. Paradoxalement, la concentration en ozone sera, en régime de brise, plus faible en bordure de mer, près des sources (titration) alors que sur les montagnes, les forts développements de couche limite vont contribuer à intégrer de l'ozone de la basse troposphère, issu de couches limites lointaines, ce qui augmentera les concentrations locales.

Il s'agit de ce que Wittgenstein approche en termes du « paradoxe » dans sa Conférence sur l' éthique[1] ainsi que de ce que Cora Diamond appelle « la difficulté de la réalité » dans son article « La difficulté de la réalité et la difficulté de la philosophie »[2]. Lacan appellerait cette expérience une « expérience du réel ». Ce que je soutiens est qu’une telle expérience est une expérience de ce que Wittgenstein appelle la valeur absolue (dans sa « conférence sur l 'Ethique ») qui ne peut pas être exprimée sans que cela conduise nécessairement à l' engendrement du non-sens; Si (comme je le propose) quand on reste exposé à une telle expérience et à l’engendrement de non-sens qui l'accompagne, l’on se trouve contraint de faire face à un problème concernant le niveau du sens (meaning), ma question est quelle approche du sens (meaning) peut s' accorder avec une position qui exclut une attitude d'esquive tout en restant exposée à cette expérience. The thesis focuses on what is called an experience of limitation. This could be also called a “running up against the limit experience” in Wittgensteinian terms, or “an experience of the real” in Lacanian terms. In any of those cases, it is of course a paradoxical kind of experience. The description of this experience is also articulated in relation to Diamond's notion of “difficulty of reality”. Such experiences necessarily generate nonsense and therefore pose a question on meaning. What such experiences concern and what cannot be put into words without the generation of nonsense is according to the thesis the ethical or aesthetical dimension of language. For the thesis, the task which arises in staying exposed at such experiences is the task of accepting that meaning cannot be grounded in some metaphysical anchorage but it emerges as recoverable possibilities attached to our use of language in the different contexts of our forms of life. The aim of the thesis is to explore a different notion of meaning (which involves this ethical dimension of language) and to show how an experience of limitation can make us attentive to it. What I try to argue is that both Wittgenstein and Lacan can offer us a third way of treating such experiences, a way which allows us to see language as a locus of value (through meaning) without seeking to ground meaning on metaphysics (or on a realm beyond language)

Esta tese pretende contribuir para a melhor compreensão e aplicação do denominado direito ao esquecimento na sociedade contemporânea, notadamente caracterizada pela intensa circulação de informações viabilizada pela permanente evolução tecnológica. Para o desenvolvimento do estudo foi necessário tecer considerações críticas à expressão utilizada no Brasil para identificar o direito em exame, conceituá-lo como uma forma de restrição à ilimitada divulgação de informações individuais pretéritas e desprovidas de interesse público, além de definir sua configuração jurídica de direito fundamental da personalidade decorrente da cláusula geral de tutela da dignidade humana. A partir do reconhecimento de evidentes limites para a aplicação do direito ao esquecimento e considerada a tutela da vida privada em seu viés atual, de controle sobre a circulação de informações relativas aos indivíduos, entende-se não apenas possível como também fundamental a plena tutela do direito tratado na tese. Dada a magnitude do papel atualmente desempenhado pela Internet na comunicação social, defende-se, entre outras possibilidades de aplicação do direito ao esquecimento, o direito de o indivíduo requerer a exclusão de resultados das listas de links apresentadas após uma pesquisa, em provedores de busca, utilizando-se determinadas palavras ou expressões, ainda que tal exclusão não atinja também a fonte onde a informação foi originalmente divulgada. Ademais, o exame da legislação correlata ao tema, a análise de projetos de lei sobre a matéria, bem como a pesquisa da recente jurisprudência brasileira na aplicação do direito ao esquecimento foram métodos utilizados para se chegar à sugestão de critérios que possam ser adotados na ponderação entre os interesses eventualmente conflitantes à liberdade de expressão e à tutela dos direitos da personalidade. Em síntese, informações desatualizadas e irrelevantes sob a perspectiva do interesse público, cuja disseminação possa causar comprovados e injustos danos aos direitos da personalidade, não devem ser irrestritamente divulgadas, sob pena de configuração de notória violação à dignidade humana e, acrescente-se, sem que esta defendida limitação informativa possa ser considerada como prática análoga à tão condenável censura.
This thesis intends to contribute for a better understanding and application of the so-called right to be forgotten in the contemporary society, notably characterized by the intense circulation of information made possible by the ongoing technological progress. In order to develop the study, it was necessary to weave critical considerations to the term used in Brazil to identify the right under review, conceptualize it as a way to restrict the unlimited disclosure of past individual information lacking public interest, as well as define its legal configuration of fundamental right of the personality resulting from the general clause of human dignity protection. From the recognition of clear limits for the application of the right to be forgotten and considering the protection of the private life in its current bias of control over the circulation of information regarding individuals, it is noticeable that it is not only possible but also fundamental to provide for the full protection of the right addressed in the thesis. Due to the magnitude of the role that is currently performed by the Internet in social communication, the right of an individual to require the exclusion of results from the lists of links presented after a search in search providers using certain words or terms, even if such exclusion fails to also reach the source where the information was originally disclosed, is defended, among other possibilities to apply the right to be forgotten. In addition to that, the analysis of the legislation related to the subject, the assessment of draft bills on the subject, as well as the survey of the recent Brazilian jurisprudence in the application of the right to be forgotten were methods used to get to the suggestion of criteria that may be adopted when pondering the possibly conflicting interests with freedom of expression and protection of personality rights. In short, outdated and irrelevant information under the perspective of public interest, whose dissemination may cause proven and unfair damages to the rights of personality, shall not beunrestrictedly disclosed, under the penalty of configuring notorious violation to human dignity and, moreover, not allowing that defended informative limitation to be considered a practice that is similar to the so condemnable censorship.

Husserlian phenomenology of time, as it is developed on theLectures on the Phenomenology of Inner Time Consciousness, shows some  difficulties  to  explain  certain  temporal  experiences.  This  is  the  case  of the incompatibility between the rigidity of the retentional modification and the effective approach that a subject may have with his memories. On the one hand, according to the Lectures’ explanation, the darkening of the past occurs in an homogeneous way: The more distant an experience is, the lower the clarity of the associated retention. However, our relation with the past is not so direct. Complementing the studies of the Lectureswith those of the Analysis concerning passive synthesiscould allow to explain this kind of temporal phenomena.
La fenomenología del tiempo husserliana, tal como es desarrollada en las Lecciones de fenomenología de la conciencia interna del tiempo, presenta dificultades a la hora de explicar ciertas experiencias relativas a la temporalidad. Es el caso de la incompatibilidad entre la rigidez de la modificación retencional y la aproximación efectiva que tiene un sujeto con sus recuerdos. Por una parte, según  la  explicación  de  las Lecciones, el oscurecimiento del pasado opera de manera homogénea: cuanto más lejana es una experiencia, menor claridad se atribuye a la retención asociada. Por otra parte, en los hechos, la relación con el pasado no es tan directa. Complementar los estudios de las Leccionescon los de los Análisis sobre las síntesis pasivas permitiría dar cuenta de este tipo de fenómenos temporales.

This thesis uses Narrative Theory and Technology Acceptance Model to uncover the experiences, perceptions, and challenges that five experienced teachers face when using and integrating technology in their classroom. It gives narrative consideration of the value of unique experience by focusing on the stories of each participant, and it analyzes narrative themes. This study found that there were numerous impacts on teachers’ perceptions on the usefulness and ease of use of technology: this included (a) Limits: technology limits, teacher limits, student limits, and practical limits; (b) Support: school board, resources, equipment, parents; and (c) Dynamic environment (teacher-student feedback loop) which influence strategies for integrating technology: attitude, teaching orientation, classroom management, technology management, technology tools, and participant-observer strategies. Study limitations and recommendations are discussed.

Psychological services in Australia are frequently provided in the context of third party payers who impose time limits based on reasons other than particular client (or therapist) characteristics. Time limits may function as a useful clinical factor in the provision of therapy, for example through accelerating treatment. Less is known about the third party imposition of time limits and the impact they may have on psychotherapy from the perspective of psychologists. The present study investigates the impact of time limits imposed in this manner from the viewpoint of practising psychologists. Practising psychologists took part in a mixed methods study. Twenty seven participated in a semi-structured interview, and eighty-five completed a mailed questionnaire. Interviews were analysed thematically, while both qualitative content analysis and statistical analyses were applied to questionnaires. The interview and questionnaire findings were congruent, both showing that a time limit makes a difference to psychologists. Psychologists are less satisfied with treatment that can be provided in the time limited as opposed to time unlimited context. However, they also perceived benefit in terms of improved client access to psychologists and improvements in the efficiency of therapy. Participants reported that the system of third party referrals had an impact on them that was over and above the impact that a time limit itself had, for example, the fact they were externally managed. The broader context therefore reportedly brought with it the need for psychologists to adapt their treatment to the context of the service. Psychologists reported that, in response to time limits, they often changed their treatment type, for example, from a psychodynamic to cognitive behavioural approach. They also made more general changes, such as moving quicker through the process of therapy and becoming more directive and less client-centred. Perceived outcomes were also affected by the time-limited context. How psychologists conceive of, report, and achieve outcomes is different in this context, and overall outcomes were perceived as weaker. In conclusion, this study has demonstrated that time limits impact upon psychologists in important ways with regard to the process and outcomes of psychotherapy. The broader system of third party referrals has implications for the delivery of psychological services in Australia, which clinical understandings of time limitation have not accounted for. Previous research has shown that the number of sessions available makes a difference, but the present research shows that a time limit cannot be separated from the system under which it is imposed, because once it is imposed, it has implications throughout the whole process.

Background Indigenous peoples with traditional lifestyles worldwide are considered particularly vulnerable to climate change effects. Large climate change impacts on the spread of infectious vector-borne diseases are expected as a health outcome. The most rapid climate changes are occurring in the Arctic regions, and as a part of this region northernmost Sweden might experience early effects. In this thesis, climate change effects on the lives of Sami reindeer herders are described and 30 years of weather changes are quantified. Epidemiology of the climate sensitive human infection tularemia is assessed, baseline serologic prevalence of tularemia is investigated and the disease burden is quantified across inhabitants in the region. Methods Perceptions and experiences of climate change effects among the indigenous Sami reindeer herders of northern Sweden were investigated through qualitative analyses of fourteen interviews. The results were then combined with instrumental weather data from ten meteorological stations in a mixed-methods design to further illustrate climate change effects in this region. In two following studies, tularemia ecology and epidemiology were investigated. A total of 4,792 reported cases of tularemia between 1984 and 2012 were analysed and correlated to ecological regions and presence of inland water using geographical mapping. The status of tularemia in the Swedish Arctic region was further investigated through risk factor analyses of a 2012 regional outbreak and a cross-sectional serological survey to estimate the burden of disease including unreported cases. Results The reindeer herders described how the winters of northern Sweden have changed since the 1970s – warmer winters with shorter snow season and cold periods, and earlier spring. The adverse effects on the reindeer herders through the obstruction of their work, the stress induced and the threat to their lifestyle was demonstrated, forcing the reindeer herders towards the limit of resilience. Weather data supported the observations of winter changes; some stations displayed a more than two full months shorter snow cover season and winter temperatures increased significantly, most pronounced in the lowest temperatures. During the same time period a near tenfold increase in national incidence of tularemia was observed in Sweden (from 0.26 to 2.47/100,000 p<0.001) with a clear overrepresentation of cases in the north versus the south (4.52 vs. 0.56/100,000 p<0.001). The incidence was positively correlated with the presence of inland water (p<0.001) and higher than expected in the alpine and boreal ecologic regions (p<0.001). In the outbreak investigation a dose-response relationship to water was identified; distance from residence to water – less than 100 m, mOR 2.86 (95% CI 1.79–4.57) and 100 to 500 m, mOR 1.63 (95% CI 1.08–2.46). The prevalence of tularemia antibodies in the two northernmost counties was 2.9% corresponding to a 16 times higher number of cases than reported indicating that the reported numbers represent only a minute fraction of the true tularemia. Conclusions The extensive winter changes pose a threat to reindeer herding in this region. Tularemia is increasing in Sweden, it has a strong correlation to water and northern ecoregions, and unreported tularemia cases are quite common.

This dissertation draws on qualitative research conducted in 2012 with foster mothers and young people living and having lived in three household-style ‘safety homes’ in the township of Khayelitsha, Cape Town. Unlike large formalised residential care facilities, with high staff turnover and high ratios of children to caregivers, these settings are intimate long-term spaces of care that provide stable parenting. This finding of stable parenting and of proper care of young people in the safety homes forms the crux of this thesis and challenges the dominant view that care other than within the biological family is inferior and ‘out of home’ and ‘out of family’ care. The research highlighted that the social (non-biological) family has both strengths and limitations.

This study attempts to understand how distance education practices influence the learning of calculus. Understanding student learning in a distance education environment is an important factor to consider in improving the learning experiences of those students who for one reason or the other opt not to study in conventional institutions of higher education. On one hand, understanding student learning may illuminate the influences that the learning environment has on student learning and on the other hand, it may inform on how learning experiences can be improved. The aim of this study is to acquire a deeper understanding of the diverse manner in which distance students learn calculus. Specific focus is also placed on how the distance education context of the Zimbabwe Open University (ZOU) influences student learning. The study describes a group of students' experiences of learning calculus in the ZOU distance education environment. The study also describes the students' learning styles and relates these to their mathematical understanding of certain calculus concepts. The specific content topics of "limit of function" and "derivative of function" are used to view achievement and performance, thereby indicating the distance students' mathematical understanding. The information processing learning theory is used as the theoretical framework for this study. The constructs of learning styles and mathematical understanding are used to illuminate the student's learning processes. The study used the Felder-Silverman learning styles model and Hiebert and Carpenter's notion of mathematical understanding to expound these constructs. The distance education environment of the B.Sc. Mathematics and Statistics (BSMS) programme at the ZOU provided the context of the study and an interpretive case study approach was adopted. A group of students registered in a first year first semester calculus course were studied. Data were collected from students based in four ZOU regional centres; namely Harare, Mashonaland Central, Mashonaland West, and Masvingo. These regional centres were conveniently selected for the study on the basis of proximity and accessibility. A total sample of twenty six students was involved and data for the in-depth part of the study emanated from five students who were purposively selected to participate in interviews. The interviewees were selected on the basis of their performance in a written calculus test. Data for this study were collected through use of learning journals, learning styles preference questionnaires, calculus tests and interviews. The data on students' learning experiences were predominantly qualitative in nature though supported by some quantitative data. The data on learning styles and mathematical understanding were also qualitatively analysed and presented case by case for the five interviewees. The study established that in a distance education system, the type of learning environment has the potential to influence students' learning, both positively and negatively, of which the main contributing factor is the learning support system. The study found that the learning support system provided by the institution and distance educators can have an impact on student learning. With reference to the calculus course in the BSMS programme, the study identified specific aspects where the environment facilitated or deterred learning. The study also revealed that students have varied learning style preferences, and that the learning environment has the potential to impact on students' learning styles. Since learning styles occupy a central place when it comes to improving distance learning materials, the study further explored the relationship between the constructs of learning styles and mathematical understanding. The study revealed that students' learning styles can influence the students' mathematical understanding. Improving students' learning in a distance education environment rests mainly on improving the learning materials and the support systems. A carefully designed and well supported instructional distance learning package can facilitate learning. Implications of the findings point towards the improvement of the distance teaching processes through the improvement of learning materials and the learning support systems for the BSMS distance education programme.

A poesia de Paulo Leminski (1944/1989), escrita no Brasil entre os anos 60 e 80 do século XX, revela uma constante atitude de experimentação que abre caminhos para o questionamento da relação entre pensamento, mundo e linguagem. Ao refazer a trajetória do autor e analisar o modo de criação de seus jogos de linguagem, pretendo revelar a lógica de sua poética, voltada para a materialidade do signo lingüístico. Como poeta e ficcionista, redator publicitário, letrista de música, crítico e tradutor, a matériaprima e o objeto de Leminski é sempre a linguagem verbal em suas mais variadas dimensões. Nesse período, entre os anos 60 e 80, em que as teorias sobre os signos e sobre o discurso começam a dominar os estudos literários, a poética metalingüística e reflexiva de Leminski surge como um campo de experiência de limites ainda não testados ou pouco testados por outros poetas. O conceito da poesia como texto literário, como expressão de uma linguagem escrita, veiculada em livros e destinada a um público erudito, passa a ser também por ele questionado. Para Leminski, a poesia faz parte da semiótica, do mundo dos signos que engloba todas as outras formas de manifestações artísticas, de informação e de comunicação. Poesia é também linguagem gráfica, sonora e verbal, que busca uma lógica própria para expressar pensamentos e formas de vida. Esta pesquisa vai focalizar alguns aspectos da teoria da linguagem e da teoria literária evidenciados, em diversos níveis, na prática poética leminskiana. São questões pertinentes ao contexto de diferentes correntes contemporâneas de pensamento que apontam a linguagem como o lugar privilegiado em que se dá a atuação do sujeito e a criação dos sentidos.
The poetry of Paulo Leminski (1944-89), written in Brazil between the 1960s and the 1980s, displays a constant attitude of experimentation that opens up possibilities for questioning the relationships between thought, world and language. By retracing the development of his career as a writer and analyzing the ways in which he created his language games, I set out to discover the logic of his poetics and its links to the materiality of the linguistic sign. As a poet and author of fiction, but also as a producer of advertising copy, song lyrics, literary criticism and translations, Leminski always took verbal language in its many different dimensions as his object and raw material. In the period discussed (1960s, 70s and 80s), when theories of signs and discourse predominated in literary studies, Leminski developed his metalinguistic and reflexive poetics as a field for experiencing and experimenting with limits that other poets had not yet tested at all or only very marginally. He also questioned the concept of poetry as literary text, as the expression of a written language conveyed in books to a learned audience. For Leminski poetry was part of semiotics, of the world of signs that encompasses all other forms of art as well as information and communication. Poetry is visual language and sound as well as verbal language, pursuing its own logic to express thoughts and life forms. My research focuses on some aspects of the theory of language and of the literary theory evinced at various levels by Leminskis poetic practice. The questions raised are pertinent in the context of different contemporary currents of thought which consider language a privileged field for the operation of the subject and the creation of meaning.

« Quand le seuil fait œuvre » est une recherche qui se déploie dans le champ des arts visuels. Par une approche poïétique, elle repose sur la conception d’œuvres inédites et sur un développement théorique rigoureux. Elle tend à expliciter le seuil pour comprendre quand celui-ci fait réellement œuvre. Cette quête du seuil se construit au travers d’Espace-Jeu, une performance dans laquelle les corps déambulent et tracent dans et hors de l’exposition. Si la performance autorise tous les débordements, les actions font apparaitre des limites insoupçonnées et indépassables qui réintroduisent paradoxalement le seuil à l’intérieur de ses frontières originelles. Si le corps humain pose problème, il est opportun de l’écarter pour que le seuil puisse se déployer pleinement. Vient alors une phase d’expérimentation sur des organismes vivants non-humains. Placés dans des dispositifs presque scientifiques, ceux-ci donnent littéralement (leurs) corps au seuil, révélant au plus profond de leur chair l’interstice vital. Leurs corps deviennent alors des moules permettant au seuil d’émerger ; ils protègent alors le seuil au péril de leur vie. Malgré ces expérimentations chirurgicales, le seuil découlant des corps organiques répond toujours à des stimulus prévisibles. Et pour cause : notre modèle de pensée actuel est basé sur des seuils qui vont jusqu’à influencer la création artistique même. Vient alors le moment d’élever des machines pour déconstruire ce seuil en le réduisant à des données inintelligibles. "When the threshold becomes art" is a research project developed in the field of visual arts. Through a poiesis approach, it is based on the conception of visual production and on a rigorous theoretical development. It tends to make the threshold explicit in order to understand when it actually become art. This quest for the threshold is built through Espace-Jeu, a performance in which bodies wander and trace in and out of the exhibition. If performance allows all overruns, actions reveal unsuspected and impassable limits that paradoxically reintroduce the threshold within its original boundaries. If the human body is a problem, it is appropriate to exclude it so that the threshold can be fully deployed. Then comes a phase of experimentation on non-human living organisms. Placed in almost scientific devices, they literally give (their) bodies to the threshold, revealing the vital interstice in the depths of their flesh. Their bodies then become molds allowing the threshold to emerge; they then protect the threshold at the risk of their lives. Despite these surgical experiments, the threshold resulting from organic bodies always responds to predictable stimuli. And for good reason: our current thinking model is based on thresholds that go so far as to influence artistic creation itself. Then comes the time to raise machines to deconstruct this threshold by reducing it to unintelligible data. Thus questioned and emptied of its substance, the threshold can essentially become art

In contemporary society, work and home represent the two most significant domains in the life of a working individual. In order to help an individual live optimally, the work and personal life domains must no longer be regarded as separate domains, but as highly interrelated. The work and personal life domains must influence each other in a positive way to assist the individual in his daily responsibilities at work and in his personal life. A high proportion of employed workers, however, have serious difficulties in combining obligations in their work and personal lives. Educators are one of the occupations that may find it difficult to integrate their work and personal life. The objectives of this research were to determine how Afrikaans-speaking educators experienced Work-Personal Life Interaction (WPLI), to determine the domains in Afrikaans-speaking educators' lives that could interact with one another, to determine the main antecedents and consequences of WPLI for Afrikaans-speaking educators and to investigate which strategies Afrikaans-speaking educators used to deal with WPLI issues. A non-probability purposive voluntary sample (N = I I) of Afrikaans-speaking secondary school educators was used from the North West Province (in the Potchefstroom and Promosa areas). A qualitative design from a phenomenological approach was used to determine educators' experience of WPLI. Content analysis was used to analyse, quantify and interpret the research data. The results indicated that educators experienced certain aspects in their work environment and personal lives as demanding. Certain dimensions were identified in both their work and personal lives. As a result of a demanding work environment, they experienced time and strain-based conflict between their work and personal lives. However, it was found that educators possessed various factors that facilitated their WPLI and strategies they used to deal with WPLI issues. Recommendations were made for the organisation and for future research.

В диссертации определяется сущность и раскрываются особенности административно-правовых основ осуществления контроля и надзора за предпринимательской деятельностью, а также обобщаются направления совершенствования организационных и правовых основ осуществления контрольно-надзорной деятельности в соответствующей сфере. Определяются понятие и особенности предпринимательской деятельности как объекта контроля и надзора. Аргументировано, что предпринимательская деятельность, как объект контроля и надзора, представляет собой зарегистрированную в установленном законодательством порядке самостоятельную, инициативную, систематическую, осуществляемую на свой риск хозяйственную деятельность субъектов хозяйствования – предпринимателей, направленную на получение прибыли. Отмечается, что контроль и надзор за предпринимательской деятельностью направлены на проверку того, насколько поведение подконтрольных объектов соответствует установленным законодательством требованиям, правилам, стандартам и тому подобное. К особенностям предпринимательской деятельности, как объекта контроля и надзора, отнесены следующие: во-первых, субъекты осуществления такой деятельности должны быть зарегистрированы в установленном законом порядке, ими являются субъекты хозяйствования – предприниматели, в том числе юридические лица и физические лица- предприниматели, внесенные в Единый государственный реестр юридических лиц, физических лиц-предпринимателей и общественных формирований; во-вторых, предпринимательская деятельность должна соответствовать установленным законом признакам и принципам; в- третьих, предпринимательская деятельность должна быть такой, которая не запрещена законом, осуществляться в формах, способах и условиях, которые разрешены действующим законодательством; в-четвертых, в случае если осуществление определенного вида предпринимательской деятельности требует получения дополнительного разрешительного документа от уполномоченных государством субъектов, а именно лицензирования, сертификации и так далее, необходимо внедрение такой деятельности исключительно после получения соответствующих разрешительных документов. Осуществляется классификация видов контроля и надзора за предпринимательской деятельностью. Дается характеристика правовых основ контроля и надзора за предпринимательской деятельностью и выясняется место среди них административно-правового регулирования. Доказано, что правовые основы контроля и надзора за предпринимательской деятельностью определены, прежде всего, Конституцией Украины, международными нормативно-правовыми актами, согласие на обязательность которых предоставлено Верховной Радой, законами и значительным количеством подзаконных нормативно- правовых актов. Отмечено, что ключевое место в системе соответствующих нормативно-правовых актов принадлежит нормам административного права, ведь именно с их помощью определяется круг и правовой статус субъектов контроля и надзора за предпринимательской деятельностью, в частности их полномочия и гарантии функционирования, а также предмет и пределы такой деятельности. Устанавливаются предмет, пределы и система субъектов контроля и надзора за предпринимательской деятельностью. Выясняются административные формы и методы контроля и надзора за предпринимательской деятельностью. Исследуются административные процедуры контроля и надзора за предпринимательской деятельностью. Определяются направления совершенствования административно- правовых основ осуществления контроля и надзора за предпринимательской деятельностью.

В диссертации приводится теоретическое обобщение и новое решение научной задачи, которая заключается в определении сущности и особенностей административно-правовых основ осуществления ведомственного контроля за деятельностью судов (судей) в Украине и определении путей совершенствования административного законодательства, нормы которого регулируют осуществление контрольной деятельности в исследуемой сфере общественных отношений. Выясняются сущность и особенности ведомственного контроля как одного из средств обеспечения законности в сфере судопроизводства. Установлено, что ведомственный контроль, как одно из средств обеспечения законности в сфере судопроизводства, представляет собой систематическую, упорядоченную и регламентированную законодательством деятельность уполномоченных органов государственной власти, направленную на: во-первых, проверку, анализ и изучение судебных решений на предмет их законности и справедливости; во-вторых, повышение правового сознания самих судей, ведь наличие контроля является важной превентивной мерой для предупреждения совершения ими проступков при осуществлении судопроизводства. Отмечено, что ключевыми особенностями осуществления ведомственного контроля в сфере судопроизводства являются: специфический состав субъектов, уполномоченных осуществлять контрольную деятельность в очерченной сфере общественных отношений; особый объект и предмет контроля; невозможность вмешательства контролирующих субъектов непосредственно в процесс осуществления судопроизводства; пределы ведомственного контроля за деятельностью судов (судей) определяются на законодательном уровне и обусловлены спецификой правового статуса последних, наличие четко определенных и детально прописанных административных процедур осуществления ведомственного контроля; контроль должен осуществляться таким образом, чтобы закрепленные Конституцией и другими законами гарантии деятельности судей ни коим образом не были нарушены. Определяются особенности деятельности судов (судей) как объектов ведомственного контроля. Определяется система принципов ведомственного контроля за деятельностью судов (судей) в Украине. Предоставляется характеристика правовых основ ведомственного контроля за деятельностью судов (судей) в Украине и устанавливается место среди них административно-правовых норм. Диссертация посвящена анализу административно-правовых основ осуществления контроля за качеством высшего образования в Украине. В работе определено понятие и особенности высшего образования как объекта контроля. Аргументировано, что высшее образование, как объект контроля целесообразно рассматривать в широком и узком смысле. Согласно первому — это особая, стандартизированная, регулируемая государством и основаная на положениях законодательства сфера общественной деятельности, связанная с обеспечением получения людьми специальных знаний, умений и навыков в соответствии с нормативно установленных степеней и уровней. В узком смысле, высшее образование — это совокупность специальных знаний, умений, навыков, духовных и нравственных ценностей, предоставляемых человеку в определенном нормативно-правовыми актами и регулируемой государством порядке. Выяснена сущность и содержание контроля как способа обеспечения законности в деятельности высших учебных заведений. Доказано, что контроль как способ обеспечения законности деятельности высших учебных заведений — это особое направление работы уполномоченных субъектов, которое направлено на наблюдение, анализ и проверку текущего состояния функционирования соответствующих учреждений и ее соответствия определенным законодательством стандартам и требованиям. Сущность указанного контроля выражается в следующем: во-первых, существовании многоуровневой структуры управления высшим образованием и реализации государственной политики в этой сфере; во-вторых, законодательно установленных жестких и исключительных лицензионных требованиях и стандартах деятельности высших учебных заведений Украины; в-третьих, наличие аккредитационной процедуры проверки статуса (уровня) высших учебных заведений; в-четвертых, системности контроля, который включает в себя контроль за качеством высшего образования и поддержки данного качества высших учебных заведений. Определена система принципов контроля качества высшего образования в Украине. Охарактеризованы правовые основы контроля качества высшего образования в Украине и установлено место среди них административно-правового регулирования. Доказано, что нормы административного права занимают ключевое место среди правовых основ контроля за качеством образования в Украине, поскольку именно с их помощью: регламентирован порядок работы субъектов контроля, их структура и подчиненность; особенности реализации отдельных административных процедур (например, лицензионных и / или аттестационных) перечень функций и задач в области контроля за качеством высшего образования и так далее. Важным является тот факт, что именно нормы административной области права закрепляют правовые и организационные особенности взаимодействия субъектов контроля в исследуемой сфере. Обобщены задачи и функции контроля за качеством высшего образования в Украине. Установлен предмет и пределы контроля качества высшего образования в Украине. Раскрыта система субъектов контроля качества высшего образования в Украине. Систематизированы административные формы и методы контроля за качеством высшего образования в Украине. Обозначены проблемы классификации контроля качества высшего образования в Украине. Определено понятие и виды государственного контроля за качеством высшего образования в Украине. Выяснены особенности самоуправляющегося и общественного контроля за качеством высшего образования в Украине. Встановлено місце та значення судово-експертних установ в системі правоохоронної діяльності України; з’ясовано поняття та особливості контролю як способу забезпечення законності за діяльністю судово-експертних установ України; охарактеризовано правові засади здійснення контролю за діяльністю судово-експертних установ України та встановлено місце серед них адміністративно-правового регулювання; визначено систему та межі контролю за діяльністю судово-експертних установ; окреслено мету, завдання та принципи контролю за діяльністю судово-експертних установ; розглянуто систему суб’єктів контролю за діяльністю судово-експертних установ та встановлено особливості їх адміністративно-правового статусу; з’ясовано об’єкт та предмет контролю за діяльністю судово-експертних установ; встановлено адміністративні форми та методи здійснення контролю за діяльністю судово-експертних установ; узагальнено зарубіжний досвід здійснення контролю за діяльністю судово-експертних установ та опрацьовано можливості його використання в Україні; переглянуто критерії оцінювання ефективності контролю за діяльністю судово-експертних установ; запропоновано напрямки оптимізації системи суб’єктів контролю за діяльністю судово-експертних установ та удосконалення їх взаємодії.
В диссертации приведено теоретическое обобщение и новое решение научной проблемы – выяснение сущности и особенностей административно-правовых основ осуществления контроля за деятельностью судебно-экспертных учреждений Украины, что легло в основу выработки соответствующей концепции, а также предложений и рекомендаций по совершенствованию законодательства в этой сфере. По результатам работы наработан ряд научно-практических выводов и рекомендаций. Установлено место и значение судебно-экспертных учреждений в системе правоохранительной деятельности Украины; раскрыто историческое развитие системы контроля за деятельностью судебно-экспертных учреждений Украины; выяснено понятие и особенности контроля как способа обеспечения законности в деятельности судебно-экспертных учреждений Украины; охарактеризованы правовые основы осуществления контроля за деятельностью судебно-экспертных учреждений Украины и установлено место среди них административно-правового регулирования; определена система и пределы контроля за деятельностью судебно-экспертных учреждений; обозначены цели, задачи и принципы контроля за деятельностью судебно-экспертных учреждений; рассмотрена система субъектов контроля за деятельностью судебно-экспертных учреждений и установлены особенности их административно-правового статуса; выяснен объект и предмет контроля за деятельностью судебно-экспертных учреждений; установлены административные формы и методы осуществления контроля за деятельностью судебно-экспертных учреждений; предоставлено определение понятия и обозначены виды государственного контроля за деятельностью судебно-экспертных учреждений; раскрыты особенности ведомственного контроля за деятельностью судебно-экспертных учреждений; охарактеризован самоуправляемый контроль за деятельностью судебно-экспертных учреждений; выяснена сущность общественного контроля за деятельностью судебно-экспертных учреждений; систематизированы проблемы участия международных организаций и других субъектов международного права в процессе контроля за деятельностью судебно-экспертных учреждений; обобщен зарубежный опыт осуществления контроля за деятельностью судебно- экспертных учреждений и обработаны возможности его использования в Украине; пересмотрены критерии оценки эффективности контроля за деятельностью судебно-экспертных учреждений; предложены направления оптимизации системы субъектов контроля за деятельностью судебно-экспертных учреждений и совершенствование их взаимодействия.
The place and significance of forensic institutions in the system of law enforcement activities of Ukraine have been established; the concept and specific features of control as a method to ensure the rule of law over the activities of forensic institutions of Ukraine have been found out; the legal principles of exercising control over the activities of forensic institutions of Ukraine have been characterized and the place of administrative and legal regulation among them has been established; the system and limits of control over the activities of forensic institutions have been determined; the purpose, objectives and principles of control over the activities of forensic institutions have been outlined; the system of control entities over the activities of forensic institutions has been studied and the peculiarities of their administrative and legal status have been established; the object and subject matter of control over the activities of forensic institutions have been clarified; administrative forms and methods of control over the activities of forensic institutions have been established; international experience of exercising control over the activities of forensic institutions has been generalized and the possibilities of its application in Ukraine have been worked out; the criteria for assessing the effectiveness of control over the activities of forensic institutions have been revised; the author has suggested directions for the optimization of the system of entities of control over the activity of forensic institutions and improvement of theirinteraction.

The study aimed to explore the limit-setting experience of participants in the filial therapy, to understand the process of how parents learned to set limits in parent-child play, and to discover influential factors of using limit-setting and the subsequent impacts. A total of four parents were recruited as research participants, and the Landreth 10-week model filial therapy was adopted. After group activities and semi-structured in-depth interviews, the qualitative research method was used to conduct thematic analysis. The following conclusions were made according to the findings of the analysis. 1. Learning skills were influenced by parenting habits and application ability in learning: Parents were insensitive to emotions or unfamiliar with emotional wordings; old parenting habits influenced the way to set limits; parents could not react or provide options in time. 2. Ensure safety and consistency of play through limit-setting so parent-child interaction could be adjusted peacefully during the process: Limit behaviors so as to maintain safety and authenticity of the therapy; parents could implement limit-setting and children could in turn adjust their emotions and behaviors; both parties could have more flexible interactions and discipline. 3. Internalize limit-setting principles and steps, implement them and change parenting methods in daily life: not knowing what to do during role-plays; try to use limit-setting skills outside play time; parents could observe and adjust their parenting behaviors and attitudes. Lastly, suggestions for future research and practices were proposed according to the aforementioned conclusions and discussions.

Human sexuality has been overrun with narratives that limit the possibilities of pleasure. Sex-positive workers have the potential to challenge the ways in which these limitations become embodied. In this research I explore narratives of sex education and youth, pleasure as prevention, and the medicalization of sexuality. I engage in collective biography as a way to identify how these narratives shape the way bodies and pleasure get taken up in specific places. Drawing from poststructural feminist theory I propose three ways of reconceptualizing bodies and pleasure as emergent sites of change and potential. Through an analysis of the experiences of sex-positive service workers in Canada, I consider what else, and for whom, bodies, pleasure, and sex education might look like.

The thesis "Influence of experience with infidelity on setting the bottom limit of infidelity tolerance in a partner relationship" deals with the issue of determining the bottom limit of partner exclusivity and its possible association with a previous infidelity experience. The main thesis of this work is that setting the limits of infidelity tolerance between partners in a relationship is quite individual and each person may perceive these limits very differently. This work is divided in two parts. The theoretical part focuses on analyzing selected findings about infidelity that have been so far collected in research studies or therapeutic sessions, and methodological shortcomings that arise from these findings. The practical part is a description of the research itself, and its goal to find out if infidelity experience affects the setting of tolerance limit in a relationship. It was examined whether it was an experience with the person"s own infidelity or infidelity if its partner, if it was an experience from a former relationship or a current one and if there is a difference between men and women in being influenced by the experience. Estimulada por um entendimento inato à idoneidade do limiar arquitetónico, a presente dissertação aponta para a problematização do que é, ou pode ser, um espaço limiar. Na medida em que o domínio exterior e o domínio interior se comportam, procura-se perceber as competências físicas do limite que os medeia; numa dialética narrada por um espaço dual, um lugar de transições, oposições e encontros. Considerando uma postura histórica da arquitetura, o conceito de limiar é analisado sob a forma como se estabelece na mesma – isto é feito através de um mapeamento de situações espaciais que alteram as fronteiras entre o dentro e fora. Posteriormente amplia-se a discussão para o seu potencial enquanto espaço de urbanidade e vitalidade; atende-se a edifícios que espelhem um diálogo cordial e permeável entre a sua arquitetura e o exterior. Este trabalho abordará três casos de estudo – de temperamento público – apoiados numa experiência no sítio que permite averiguar inúmeras contingências. Desdobra-se assim uma narrativa baseada na experiência e reminiscência dos espaços, de modo a compreender o momento da entrada na sua capacidade de intermediação; ademais, atenta-se à expressão espacial e ao seu papel tácito na interação social e coesão entre pessoas. Como conclusão, ambiciona-se a verificação da essencialidade de um espaço liminar – das particularidades espaciais que acentuam o seu caráter coletivo e, ainda, a forma como o cenário que o envolve pode influenciar este processo.
Stimulated by an intrinsic understanding of the competencies of the architectural threshold, this dissertation points to the problematization of defining the concept of threshold space. Through the behavior of the outer domain and inner domain, one tries to perceive the physical competence of the limit that mediates them; in a dialectic narrated by a dual space, a place of transitions, oppositions, and encounters. Considering a historical approach to architecture, the threshold and its establishment through time are analyzed, by identifying spatial situations that change the boundaries between inside and outside. Consequently, the discussion is broadened to its potential as a space of urbanity and vitality; resorting to buildings that reflect a cordial and permeable dialogue between its architecture and the exterior. This work will address three case studies of public nature, supported by an on-site experience that allows us to investigate numerous contingencies.Thus, a narrative based on the experience and reminiscence of spaces unfolds to understand the moment of entrance in its ability to intermediate; moreover, it pays attention to spatial expression and its implicit role in social interaction and cohesion between people. Concluding, the aim is to verify the essentiality of liminal space – the spatial particularities that accentuate its collective character and also, the way that the scenario surrounding it can influence this process.

Abstract The study investigates a teacher's experiences in applying New Age Seth Materials to life education, including her inspiration and experiences from Seth Materials, how she applied Seth Materials to her classes, and the effects of life education on her students. By using purposive sampling, the researcher interviewed Ms. S, an experienced Chinese teacher who teaches in a senior high school. To achieve the purpose of qualitative research, the researcher employed semi-structured interview to acquire the data needed. The data were analyzed and concluded as follows. I. Ms. S's process and experiences in learning the Seth Material A. Learn the knowledge step by step and take action immediately. B. Understand the true meaning of the Seth Material and internalize the knowledge. C. Put the ideas of the Seth Material into practice in the daily life. In the process of helping the students, the teacher also benefits herself a lot. II. The major characteristics of the use of the Seth Material in life education A. The teacher's internalization of the Seth Material enables her to help the students through life education. B. The teacher can design her class activities freely, and there are no limitations in the operation of the life education curriculum. III. The procedure of applying the Seth Material in life education A. Help the students find tranquility of mind through meditation. B. Help the students achieve value completion through assignments. C. Heal the students by letting them describe their stories in different ways, including writing, acting, and story-telling. IV. The effects of life education on students A. The teacher made students enjoy doing their assignments by asking them to share their experiences in accomplishing the homework assigned. B. The students became automatic learners when they found out that they themselves are unique. C. The students learned that they have the ability to love themselves as well as others after finding out their own values. D. By teaching the students to look on the bright side of things, to appreciate what they have now and seize the moment, and to pursue their dreams, the teacher makes every student "become a person". In conclusion, the suggestions based on the results were provided. The researcher hopes that the research will be helpful to educators, professional helping workers, researchers and all the people.
