Purpose: The study is focused on the question of how principals in Swiss compulsory schools evaluate civic and parental participation in education governance. Public management reforms in Switzerland have led to the implementation of semiautonomous school administration and the encouragement of professional leadership. Thus, the traditional role of school boards has come under scrutiny. Research Methods/Approach: Using the theoretical framework of actor-centered institutionalism, the study compares patterns of education policies in Swiss cantons and analyzes data of a principals’ survey by structural equation modelling. Findings: The views of principals concerning lay participation in school governance reveal a multifaceted picture. Principals affirm lay participation on the levels of the right to be informed, the right to be heard, and the right to volunteer; they regard with skepticism the authority of lay participants to make decisions. Implications for Research and Practice: Principals tend to insist on professional discretion and opt against the blurring of boundaries between schools and their social environment. This implies the self-justification of professional leadership. That such self-justification does not derive from a neutral perspective, but is an expression of stakeholder interests, has to be taken into account.

Currently, many districts and states are pursuing reforms that focus on holding principals accountable for school performance. While effective schools research has established that strong principal leadership affects school academic achievement at least indirectly, this relationship is more complex than originally thought. Personnel decisions about principal effectiveness made by educational policymakers or lay-controlled school site councils should be made only after careful consideration of research on the relationship between principal instructional leadership and school outcomes. This article presents data from a study to determine whether principal instructional leadership is predictive of school outcomes and discusses the implications of the research for developing school improvement strategies.

PurposeThis article explores Jamaican secondary school principals' use of mindfulness meditation as a spiritual well-being strategy to manage their work-related stress and anxiety.Design/methodology/approachThe author used qualitative semi-structured interviews to collect the data from 12 Jamaican secondary school principals working in schools supporting rural, urban and inner-city school communities. Thematic coding of the analyzed data was used to understand how principals deal with their work-related stress and anxiety.FindingsThe findings indicate that Jamaican school principals are experiencing work-related stress and anxiety as a result of work intensification, and use mindfulness meditation/prayer as a spiritual coping strategy. The data indicate that principals' primary source of support is their spiritual belief – faith in God and mindfulness meditation/prayer – when dealing with issues related to well-being.Originality/valueThis article explores the use of mindfulness meditation as a non-secular coping strategy, and focuses on an understudied area of educational administration research: Jamaican school principals' well-being. The findings can help inform future education and health policy around occupational health and well-being for professionals, and lay the foundation for greater studies on principal well-being in Jamaican and the Caribbean more generally.

Purpose – The purpose of this paper is to use the Objective Knowledge Growth Framework (OKGF) in the development and maintenance of the Canadian Principal Learning Network (CPLN) to advance principals’ knowledge and skills in the area of decision making. First, the paper presents the inception of the CPLN, to assist principals in making decisions and resolving common problems. Second, the evolution of the CPLN web site is presented and recount the challenges faced and collaborative solved by principals. Finally, the paper describes the OKGF based on the critical rationalism of Karl Popper and how principals, engaging and interacting in an online learning community (CPLN) informed their decision-making process. Design/methodology/approach – The paper mindfully assembled an international team of researchers with administration experience, curriculum knowledge and pedagogy, and whose research interests lay in educational leadership, education administration, change theory, educational policy and professional learning. Also in addition, principals who were current graduate students, and new researchers also joined the research team. Findings – The CPLN web site using OKGF, is a step forward in providing principals with a structure and a venue to be reflective and collaborative. However, getting them to interact with each other in a collaborative, reflective online learning community was not an easy feat at the beginning (Lieberman and Miller, 2008; Louis and Kruse, 1995; Schmoker, 2006; Wagner and Kegan, 2006; Bryk et al., 2010; McLaughlin and Talbert, 2002; Stoll and Louis, 2007). The study shows principals find the need for a place to reflect, discuss, experiment, practice and learn and, for this group of principals, that place is the CPLN. Originality/value – This study provides a model for principals’ learning in an online learning community using the OKGF. As well, it shows that powerful leadership does not just take place during preparation programmes, but that principals need to continue to learn as they lead in their respective schools (Mitgang and Maeroff, 2008). Sharing of the challenges faced and the learning that occurred principals are capable of addressing not only the challenges posed in their schools but also, as numerous researchers note (Fry et al., 2006; Levine, 2005; Mitgang and Maeroff, 2008), of surviving the job themselves.

This paper reports on an investigation of the attitudes of 225 principals employed in Queensland state schools, toward inclusion of students with disabilities. The justification for the study lay in the important role of school principals in implementing social justice strategies, together with the need to focus on attitudes toward inclusion, as opposed to mainstreaming or integration. The approach to inclusion taken in this study was the placement of students with disabilities and special needs in classrooms with children who do not have such disabilities or needs, together with the provision of support for the included student. A 30‐item scale measuring attitudes toward inclusion was developed and administered. In an attempt to identify the influence of factors which might be seen to influence inclusion attitudes, the following demographic variables were used for analysis: principals’ age and gender; type and size of school; previous and present experience with students with disabilities; and special education qualifications. The results showed the large majority of school principals were positive about inclusion. It was found that the demographics age, gender, and school size had no impact on attitudes toward inclusion. Using a two‐factor solution and a clustering of types of disability, significant differences emerged on the basis of type of school (secondary vs primary), type of disability (a combination of sensory, learning, intellectual, speech) vs aggressive behaviour, and previous teaching experience with students with disabilities. In terms of the implementation of inclusion, all respondents were equally cautious, pointing to the need for further training of teachers, aides and principals, and additional resources to ensure effective inclusion.

Why do people work? Economic theory generally, and the principal–agent model specifically, emphasize the role of material incentives. But many academics, for example, work diligently year after year for a nearly fixed real salary, continuing to work hard as they approach retirement, although financial incentives are usually absent. We will argue that while economists have been right to focus on incentives, they have been wrong to focus so exclusively on material incentives. While workers appreciate monetary rewards, they also get utility from what (they believe that) others think about them. We lay out a body of evidence that, taken as a whole, makes a strong case that respect matters in the workplace, above and beyond material rewards. We discuss evidence that workers respond to attention, symbolic rewards, and trust—and even that material incentives in some cases lead to less effort. Finally, we argue that many of these observations can be captured in a standard principal–agent model, once the principals and the agents are assumed to care about respect or esteem as well as money.

AbstractThis study attempts to broaden the usual understanding of the Chinese and Japanese Pure Land traditions by delineating two orientations toward Pure Land devotionalism: A lay orientation which is usually considered the whole of Pure Land devotionalism, and a monastic orientation which is often excluded from the history of Pure Land piety. This distinction makes clear not only the greater breadth of the Pure Land movement, but the way in which its growth was influenced by cross-currents between its two wings. In part one of the paper, the two orientations are typologically differentiated by considerations of (1) their views of history and of the human condition, (2) the types of buddha-reflection (nienjolnembutsu) they taught, and (3) their soteriologies. In part two we then sketch the history of these two forms of Pure Land devotionalism in China and Japan down to the twelfth century. We propose four stages of development: (1) A stage of initial formulation of the principals and styles of the monastic and the lay oriented traditions by Lu-shan Hui-yuan [334-416] and T'an-luan [c. 488-554], respectively; (2) a stage of clear differentiation of the two traditions represented by Chih-i [538-97] on the one hand, and by Shan-tao [613-81] on the other; (3) a stage of integration of the two forms, in China by Tz'u-min hui-jih [680-748], and in Japan by Genshin [942-1017]; and (4) a stage of radical re-differentiation of these by Hônen [1133-1212] in Japan.

This article uses edvertising as a vehicle through which to examine autonomy and control for key agents in education when market-like reforms are combined with privately led management of schools. We begin by outlining the philosophical foundations of school choice from the perspective of autonomy and control, and then lay out the case of edvertising. Guided by Cribb and Gewirtz’s theoretical discussion of autonomy and control, we explore degrees and types of autonomy and control for various agents in schools. We then examine the differences between levels of autonomy for key agents—schools, principals, teachers, parents, and the State—as idealized in the philosophical underpinning of market-based policies with the actual autonomy exhibited with the introduction of edvertising.

This study's purpose was to establish teachers’ views towards their involvement in the choice and development of curriculum support materials and implementation of the secondary school curriculum in Kenya. The study involved 342 secondary school teachers and employed a descriptive survey research design. Data from principals and teachers was collected using an interview schedule and questionnaires, respectively. Analysis of the collected data was carried out using inferential and descriptive statistics. The study's findings showed that there existed a statically significant relationship between teachers’ views on their involvement in the choice and development of curriculum support materials for secondary school curriculum. However, teachers’ voice in the process of developing curriculum support materials was at the minimum: to a small extent (M=1.97). The study recommends that teachers who are key curriculum implementers should be engaged in planning and developing the curriculum in all stages for effective curriculum delivery in schools. KICD (Kenya Institute of Curriculum Development) should lay better strategies to involve teachers in the curriculum development process. The findings of this study will, hopefully, supplement government efforts directed towards the improvement of curriculum delivery in Kenyan secondary schools.

Abstract This paper reports an experiment designed to assess the influence of workplace arrangements on the reactions to (the absence of) control. We compare behavior in an Internet and a laboratory principal-agent game where the principal can control the agent by implementing a minimum effort requirement. Then the agent chooses an effort costly to her but beneficial to the principal. Our design captures meaningful differences between working from home and working at the office arrangements. Online subjects enjoy greater anonymity than lab subjects, they interact in a less constrained environment than the laboratory, and there is a larger physically-oriented social distance between them. Control is significantly more effective online than in the laboratory. Positive reactions to the principal’s choice not to control are observed in both treatments, but they are significantly weaker online than in the laboratory. Principals often choose the highest control level, which maximizes their earnings.

The role of a Catholic school principal is complex and includes promoting Catholic faith and spirituality throughout the school community. The additional job requirements of spiritual leadership are intentional formation for prospective and novice principals and efforts to sustain spirituality for experienced principals. This qualitative study explored the perceptions held by experienced lay elementary principals of their role as spiritual leader as well as how prepared they felt to serve in this role. Additionally, the study explored suggestions for sustaining principals in their role as spiritual leader. Participants were six lay Catholic elementary principals working in the Archdiocese of Los Angeles. Data were collected in the form of written reflections, interviews, and a focus group. There were three rounds of written reflections and interviews. A focus group was conducted after the three rounds of data collection. Initial analysis was conducted by identifying emerging themes for each research question. The Four Pillars of Jesuit Leadership Framework was used to discuss the findings. Findings indicated the need for formation and training programs for lay Catholic elementary school principals specifically focused on their role as spiritual leader. Additionally, principals need more supports and opportunities to renew themselves to continue serving as spiritual leaders. These findings support the need for the archdiocese to take responsibility for training and forming lay principals as this responsibility is beyond the scope of the Department of Catholic Schools.

The purpose of this research study was to consider the understanding and experience of a selected number of lay principals of diocesan secondary Catholic schools in Victoria as to the religious and spiritual dimensions of their leadership role and to identify what supported them in the discharge of their responsibilities in these domains of their leadership. Based on this purpose, I identified three research questions: 1. What is the understanding of lay Catholic secondary principals in Victoria, of their role as a ministry within the Catholic Church? 2. In what ways have principals experienced the spiritual and religious dimensions of their leadership role? 3. In what ways have principals sought and/or experienced formation beyond academic study which has enriched their practice of principalship? The theoretical perspective of the research is Interpretative Constructionism and the methodology adopted is Multiple Informant Case Study. The researcher has taken the stance of ‘interrogatory fellow traveller’ in relation to the research informants. The methods used to gather data are (a) focus group, (b) biographical written statements, (c) document analysis and (d) personal reflection in response to the previous three methods. In general, the findings of this research study suggest that lay principals of Catholic secondary schools who were informants in the study understand the role of principal of a diocesan secondary school as a ministry within the Catholic Church. While the informants did not use overtly theological terms to articulate this understanding, the accounts of their experience in principalship and the insights gained through reflection on their leadership behaviour have led them to believe that they are in fact exercising a legitimate ministry within the field of Catholic secondary education in Victoria. This research has brought to light a body of knowledge about the work of a group of principals which has not previously been subject to critical scrutiny. While the study is of intrinsic merit in recognising and describing the work of secondary lay principals, from an instrumental perspective these findings raise a number of issues relating to the preparation, induction and support available to newly appointed and continuing principals in diocesan Catholic secondary schools in Victoria. As a consequence the following propositions are offered: Further study using a wider informant group of principals is warranted to confirm the findings of this enquiry and to expand on the knowledge already gained. Such study might include parallel studies of lay principals in congregation-owned schools, in other states of Australia or in other countries where the Catholic Church has established schools as an agency of its evangelising mission in education. This study is of potential assistance to aspiring principals, principals and system authorities in the planning and development of appropriate professional learning and support, including formal academic study and formational opportunities. The findings confirm the importance for leaders and aspiring leaders in Catholic education of sound theological and spiritual education as a necessary part of their preparation for leadership, both pre-service and in-service. The findings confirm the significance of appropriate liturgical induction or commissioning for principals. It is suggested that one practical form of support for principals is the provision of access to regular professional supervision and spiritual direction. It is recommended that the process of appointment and induction of principals be undertaken more systematically, perhaps using the principles of project management, especially in relation to the identification of enhancing and inhibiting factors present within the staff community at the time of the appointment of a new principal. The findings indicate that schools have had varied experiences of developing a distinctive ethos and charism, based on a particular founder or group of founders. It is recommended that all diocesan secondary schools be encouraged to develop an appropriate charism and spirituality, based on the character of the local faith community and the history of the particular school. The findings point to the need for further development of an authentic spirituality of educational and faith leadership, based in the reality of principals’ lives as family and community members and educators in faith of their staff and wider community. Informants to the study indicated their awareness of the tension between occupying a leadership role in the Church and personal positions in conscience on matters of Church teaching. Some further study of this issue may be warranted.

Catholic schools in the United States have experienced daunting challenges since Vatican II (1962-1965) with a 45% decrease in number attributed to decisions made by Church leaders. Traditionally led by religious, the National Catholic Education Association (2010) reported 97% of Catholic schools are now staffed by lay people. This research details the importance of Catholic schools to the evangelizing mission of the Church, defines the role of laity, and acknowledges a lack of programs that support lay Catholic principals. Past studies provide a snapshot of trends, list expected competencies, and compare their positions to public school counterparts. The literature review indicates little attention has focused on lived experiences of lay Catholic principals. This study presents the stories of six female Catholic principals in an effort to provide a greater understanding of the responsibilities associated with their roles. Using narrative case study design, this research reveals aspects of their lives, careers, and families as it pertains to their experiences as Catholic principals. Six major themes emerged from the analysis of data: (1) the unwavering link between the Catholic Church and school; (2) the call for leadership that deepens the faith of their constituencies; (3) the importance of building community as a dimension of the principal’s role as faith leader; (4) the requisite for principals to model faith in action; (5) the need for spiritual and professional development to support principals as faith leaders; and, (6) the negotiation of tensions in their personal and professional lives. Results provide a richer understanding of the complexity associated with lay leadership and informs the reader of areas in need of further research to assure the future of Catholic education in the United States. Specifically, findings suggest Church leadership structure programs that adequately prepare lay Catholic principals for their roles, perform studies focused on the multifaceted roles associated with Catholic school leadership, and create opportunities for spiritual and professional development for those who currently serve in these positions. The study confirms priests as the link between the Catholic Church and school, and suggests their preparation, as well as desire to oversee a Catholic school, as critical.

Principle of self-determination of peoples is one of the issues of international law, which is complicated. International commentators agree that the content of the principle is unclear. The same should be said about the borders of implementation of the principle. There are a number of legal acts on the question, however the two problems remain. This master thesis was aimed to analyze and to reveal the purport of the principle of self-determination of peoples and the borders of implementation.
Laisvas tautų apsisprendimo principas tarptautinėje teisėje yra priskiriamas sudėtingesniems klausimams. Mokslininkai analizavę principą pabrėžia, kad sunku yra atskleisti principo esmę, nes ji yra labai neapibrėžta. Sunku apibrėžti ir aiškias principo taikymo ribas. Nors yra priimta daug teisinių dokumentų, kurie reglamentuoja laisvo tautų apsisprendimo principo taikymą, jie neatskleidžia principo esmės bei mažai prisideda prie ribų nustatymo. Rinkimų institutas yra labai svarbus elementas konstitucinėje demokratijoje. Demokratinėje visuomenėje suvereniteto šaltinis – Tauta, suteikia galią valstybės valdžios institucijoms. Formuojant politines atstovaujamąsias institucijas rinkimų būdu, reikia užtikrinti tam tikrų fundamentalių taisyklių laikymąsi. Pagrindiniai principai yra šie: visuotinė rinkimų teisė, lygūs rinkimai, laisvi rinkimai, slaptas balsavimas ir tiesioginiai rinkimai. Šių principų turinį sudaro smulkesni reikalavimai, kurių analizė yra svarbi siekiant suprasti principo esmę. Rinkimų principai suponuoja ne tik teises, bet ir tam tikras rinkėjo pareigas. Pagrindiniai rinkimų teisės principai yra dažnai vadinami Europos rinkimų arba konstitucinės teisės paveldu. Rinkimų teisės principai, kuriais vadovaujantis turi būti organizuojami ir vykdomi rinkimai, yra įtvirtinti įvairios juridinės galios nacionaliniuose teisės aktuose, taip pat tarptautinės teisės normomis. Tik įtvirtinimo nepakanka, turi būti sukurtas teisės normų aparatas, kuris padėtų užtikrinti šių principų įgyvendinimą ir apsaugą. Lietuvos Konstitucijoje ir rinkimų įstatymuose yra įtvirtinti visi šie principai. Stabilus apsaugos aparatas negali susiformuoti dėl dažnai keičiamų rinkimų įstatymų nuostatų. Election law is the main element of the constitutional democracy. In democratic society the Nation, as the holder of suverenity, grants power to the authority institutions. Fundamental rules must be implemented during the formation of political representative bodies. Fundamental principles are: universal election, equal election, free election, secret suffrage and direct suffrage. These principles consists of narrower regulations, which are important for the nature of the main principle. Electors’ rights and duties originate from principles of the election law. Main principles of the election law are sometimes called Europe’s electoral or constitutional law heritage. These principles are the main rules for organizing and administrating the process of election. Constitutional democracy requires that national authoritues should povide effective legal basis to implement and safeguard these rules. These principles are regulated in the Constitution of Lithuania and election statutes. Well-established safeguard apparatus can not be created, since statutes are often changed. This research is focused on the content of principles of the election: it discloses and gives broader understanding of the compaund elements of the principles; the research focuses on the problems deriving from the implementation and safeguard of the main principles.

Darbe keliama hipotezė – procesinė taisyklė, leidžianti apylinkių teismams nagrinėjant administracinių teisės pažeidimų bylas, savo iniciatyva neribotai rinkti įrodymus, pažeidžia proceso šalių lygiateisiškumo ir rungimosi principus. Siekiant patvirtinti hipotezę, yra pasirinkta trijų dalių darbo struktūra. Pirmojoje dalyje aptarta administracinių teisės pažeidimų bylų teisena, administracinės atsakomybės samprata ir organai (pareigūnai) įgalioti nagrinėti administracinių teisės pažeidimų bylas. Antroje dalyje analizuojama rungimosi ir lygiateisiškumo principų samprata, jų veikimas administracinių teisės pažeidimų teisenoje. Paskutinėje dalyje įvertinamas teisėjo vaidmuo administracinių teisės pažeidimų teisenoje, lyginama su užsienio šalių teisinėmis sistemomis Atlikus mokslinės teisinės literatūros, įstatymų analizę bei išanalizavus bendros kompetencijos teismo vaidmenį nagrinėjant administracinių teisės pažeidimų bylas, galima daryti išvadą, kad teisėjas rinkdamas įrodymus pažeidžia rungimosi ir proceso šalių lygiateisiškumo principus. Darbe keliama hipotezė pasitvirtino.
The paper proposes a hypothesis – the procedural rule that enables district courts to collect evidence while hearing the cases of administrative law offences at their own initiative without any limitations violates the principle of equal rights of the dispute parties and the adversarial principle. In order to support the hypothesis, a three-part structure of the paper has been chosen. The first part discusses administrative legal proceedings, the concept of administrative liability and the bodies (officers) authorized to hear the cases of administrative law offences. The second part analyzes the concept of the adversarial principle and the principle of equal rights, their application in administrative legal proceedings. The final part evaluates the role of a judge in administrative legal proceedings and provides a comparison with foreign legal systems. The analysis of scientific legal literature, laws, the role of the court of general competence and the case-law on administrative law offences permits to jump into conclusion that by collecting evidence in administrative cases without limitations, the judge violates the adversarial principle and the principle of equal rights of the parties in the proceedings. The proposed hypothesis has been supported.

Šiame straipsnyje pateikiami tik principų pavadinimai, o jų turinys atskleidžiamas per kitus Civilinio kodekso straipsnius ar teismų praktiką. Principų vaidmuo vis auga, nes jie yra tam tikros gairės, kuriomis turi sekti tiek įstatymų leidėjas, tiek teisėjas, spręsdamas bylą, tiek patys civilinių teisinių santykių subjektai. Todėl šiame darbe civilinės teisės principai atskleidžiami per teismų praktiką, tai yra kokį jų turinį ir supratimą savo priimamuose sprendimuose nustato teismai. Pirmoje darbo dalyje pateikiama bendra civilinės teisės principų interpretacija - kas yra teisės principas, kartu pateikiant civilinės teisės principo sąvoką. Taip pat analizuojamos civilinės teisės principų funkcijos, kurios yra svarbios aiškinant pačių principų turinį. Tame pačiame skyriuje aptariamas santykis tarp civilinės teisės santykių reglamentavimo ir įgyvendinimo principų, nuosekliai pereinant prie kelių Europos Sąjungos principų, kurie padarė didžiausią įtaką Lietuvos civilinei teisei, kadangi buvo perkelti harmonizuojant mūsų teisės normas. Antroje darbo dalyje kiekvienas civilinės teisės principas analizuojamas atskirai, jo analizė pateikiama remiantis mokslininkų nuomone bei teismų suformuluotomis taisyklėmis. The 1.2 article of the Lithuanian Civil Code establishes the principles of the regulation of legal civil relations. Only the bare names of these principles are being presented in this article, while their content is revealed through the other articles of the Civil Code or through the judicial practice. The importance of the principles keeps growing, since these seem to constitute certain basis which is equally to be relied upon as by legislation, so by judges (that deal with the case) or by the subjects of legal civil relations themselves. It follows that in the present work the principles of civil law are revealed through the judicial practice (i.m. what content and interpretation of the mentioned principles the court establishes in its litigations and judgments). In the first part of the present work, general interpretation of the principles of civil law is presented, and, at the same time, in respect of that, the definition of a principle is clarified. There are analyzed as well the functions of the principles of civil law, these are essential in future while explaining the content of the principles themselves. The correlation between the regulation principles of civil law and enforcement principles of civil law is analyzed in the same part of the work; afterwards the author consequently passes on to some principles of European Union that caused enormous impact on the Lithuanian civil law, as they have been extrapolated within the harmonization of our provisions. Apibendrinant pilietybę pirmiausiai yra pabrėžiamas priklausomumas valstybei, antra –asmens ir valstybės abipusis teisinis ryšys, šis ryšys turi būti nepertraukiamas ir nuolatinis. Vaikas yra asmuo, neturintis 18 metų. Teisėti vaiko atstovai yra tėvai, įtėviai, globėjai, rūpintojai ir kiti asmenys, kurie pagal įstatymą ar kitą teisės aktą privalo jam atstovauti, ginti jo teises ir teisėtus interesus. Yra du pilietybės įgijimo būdai: a) gimimo faktas ir b) natūralizacija. Valstybės suteikdamos vaikui pilietybę laikosi tam tikrų principų: nacionalinio ir teritorinio arba mišraus. Lietuvoje vaikas, kurio abu tėvai jo gimimo metu buvo LR piliečiai, yra LR pilietis, nesvarbu, ar jis gimė LR teritorijoje, ar už jos ribų. Šio straipsnio taikymo problema atsiranda tais atvejais,kai vaikas gimsta valstybėje, kuri taiko teritorinį pilietybės įgijimo principą. Daugelis problemų iškyla dėl vaikų pilietybės įgijimo kai tėvai yra skirtingų valstybių piliečiai. Pavyzdžiui, jeigu vaiko tėvai turi ne tą pačią pilietybę ir vaiko gimimo metu vienas iš jų buvo vienos šalies pilietis, tai vaiko gimusio už tos šalies ribų, tos šalies pilietybė gali būti įgyjama jeigu tėvai sutinka. Kita problema gali iškilti tuo atveju, kai abu vaiko tėvai turi skirtingą pilietybę, bet vaikas gimsta trečiojoj šalyje. Lietuvoje vaikas, kurio vienas iš tėvų vaiko gimimo metu buvo LR pilietis, o kitas buvo asmuo be pilietybės arba nežinomas, yra LR pilietis neatsižvelgiant į vaiko gimimo vietą. Describing the nationality firstly the dependence to the state is stressed, secondly – the legal connection between citizen and state, that should be mutual, constant and continuous. A child is a person under 18 years old. Legal representatives of the child are parents, adoptive parents, tutors, guardians and other persons who according to the law can represent the child, protect his/her rights and legal interests. There two ways to achieve the nationality: a) by birth and b) by naturalization. There are some principles that the states usually comply in the cases of the child birth: national, territorial or mixed. In Lithuania the child, who’s both parents are citizens of RoL on the time of the child birth, is citizen of RoL and it doesn’t matter if the child is born in the territory of RoL or outside. The problem arises when the child is born in the state where the land principle dominates. Lots of problems rise when the parents have different nationalities. For instance, if the parents of the child has the different nationalities and on the time of the child birth one of the parents was the citizen of that state, so the child, who was born outside the state, nationality of that state can be acquired if the parents agrees. Another problem can arise if the parents of the child have different nationality, and the child is born in the third country. This chapter provides an overview of three of the central structural principles of the German state and legal system that are found in Art. 20 of the Grundgesetz (GG): the republic principle, the democracy principle, and the federalism principle. Also included in this group of general principles is the rule of law principle, which is implicitly contained in Art. 20 para. 3 GG. The structural principles and state goals articulated in Art. 20 GG serve three primary functions: first, as foundational norms which serve as a catch-all standard for evaluating subjects not specifically regulated by GG; second, as interpretive guidelines for other provisions of GG and for the application of (statutory) laws; and third, as classification categories to which sub-principles are assigned, including the principle of proportionality. These structural principles and state goals are often in tension; a means of reconciling them is by using the concept of practical concordance.

To this end, the chapter considers in some detail how the courts might use the Constitution to provide a stronger normative justification for the principle, better fix the content of the rights it operates to protect, and inform how it is applied. The analysis undertaken is based on the view that much of the recent (and likely future) development of the principle in Australia—indeed the principles of statutory interpretation more generally—may well be constitutionally driven. To do so, the present status of the principle of legality is outlined in this chapter. Its evolution in Australian law and the key points of doctrinal controversy and methodological disagreement are also traced and identified.

This chapter evaluates Brazilian perspectives on the Hague Principles. Despite the proposition of several bills in the 1960s, no legislative initiative to modernize the Brazilian private international law has succeeded so far. The most recent legislative proposals have focused on modifying Article 9 of the Law of Introduction to the Norms of Brazilian Law (LINDB) rather than the whole system. One of these proposals, pending before the Senate, amends the Brazilian Code of Consumer Protection and updates and expands the contents of Article 9 LINDB. This bill incorporates several provisions of the Hague Principles; it states the basic principle of party autonomy and authorizes choice of law in respect of international contracts (B2B transactions). As Brazil still waits for law reform, the Hague Principles may be relevant as persuasive authority before the Brazilian courts. In this sense, the Hague Principles may be used in the interpretation, supplementation, and development of the applicable rules and principles of Brazilian private international law.

This chapter discusses the principle of party autonomy. The term ‘party autonomy’ as used in this book is a shorthand expression for the notion that parties to a multistate contract should be allowed, within certain parameters and limitations, to agree in advance on which law will govern the contract. This notion is now considered a universal principle of private international law (PIL) or conflicts law. In 2015, the year in which the Hague Conference on Private International Law adopted the Principles on Choice of Law in International Commercial Contracts, only eleven of the 161 countries surveyed did not adhere to this principle. It has been characterized as ‘perhaps the most widely accepted private international rule of our time’, a ‘fundamental right’, and an ‘irresistible’ principle that belongs to ‘the common core’ of nearly all legal systems. Naturally, there are significant variations from one legal system to the next about not only the exact scope, modalities, parameters, and limitations of this principle, but also about its theoretical source and justification. The chapter then traces the historical origins and subsequent evolution of the basic principle.

This chapter assesses Bahraini perspectives on the Hague Principles. In Bahrain, private international law rules are mainly found in domestic legislation. The main legislative text in this regard is the Act No 6/2015 on Conflict of Law in Civil and Commercial Matters involving a Foreign Element (the 2015 Act). The Act includes a number of rules of general application, among which is Article 4 on party autonomy in addition to some other rules relating to choice of law in contractual matters in general (Article 17) or applicable to special types of contracts and other juristic acts. It can be safely said that nothing in principle prevents the Bahraini courts from referring to the Hague Principles as a persuasive authority nor from using its solutions in the interpretation or the development of the applicable rules and principles of private international law in Bahrain. This is particularly true knowing that many of the solutions adopted by the 2015 Act are particularly consistent with the Hague Principles’ solutions.

This chapter provides an overview of the refugee in international law. The refugee in international law occupies a legal space characterized, on the one hand, by the principle of State sovereignty and the related principles of territorial supremacy and self-preservation and, on the other hand, by competing humanitarian principles deriving from general international law and from treaty. Refugee law nevertheless remains an incomplete legal regime of protection, imperfectly covering what ought to be a situation of exception. It goes some way to alleviate the plight of those affected by breaches of human rights standards or by the collapse of an existing social order in the wake of revolution, civil strife, aggression, or disaster; but it is incomplete so far as refugees and asylum seekers may still be denied even temporary protection, safe return to their homes, or compensation. The international legal status of the refugee necessarily imports certain legal consequences, the most important of which is the obligation of States to respect the principle of non-refoulement through time.

This chapter explains the general principles of international humanitarian law—i.e. the prohibition of unnecessary suffering; the prohibition of indiscriminate warfare; and the principle of humanity—in their application and interaction. The prohibition against maux superflus—that is, against weapons and materials causing excessive suffering—is an old principle. It is characterized by an intricate mixture of very definite prohibitions on certain specific categories of arms, on one hand, and a rather abstract prohibition on means of warfare which cause unnecessary suffering, on the other. The utmost protection of the civilian population is also an old concept. By the nineteenth century, legal practice had established the prohibition against indiscriminate warfare as a customary rule. The principle of humanity has not always played the definitive role in moderating belligerent conduct. Nevertheless, humanity was clearly a source of normative constraints on the waging of war.

This chapter deals with equal access to civil service which is guaranteed by Art. 33 of the Grundgesetz (GG). It first examines the Federal Constitutional Court's jurisprudence regarding the importance of the civil service to a democratic state founded on the rule of law before addressing the question of access to civil service, with emphasis on the performance principle and the procedures which safeguard it. It then analyses the Court's so-called ‘Radicals decision’, in which it ruled that the duty of political loyalty was one of the traditional principles of the professional civil service, and the scope of the functional reservation of Art. 33 para. 4 GG. It also explains the prohibition of strikes by civil servants, along with the traditional principles of the professional civil service. Finally, it describes the traditional principles of the civil service as individual rights comparable to fundamental rights.

El presente proyecto conlleva las prácticas en industria farmacéutica Tevapharma dentro de la asignatura Tecnología Farmacéutica I del 4º curso del Grado de Farmacia de la Universidad San Jorge. Los alumnos, divididos por grupos y tandas, realizarán una estancia en dicha empresa, y en lugar de trabajar durante las mismas con un cuadernillo de prácticas, diseñarán una web colaborativa tipo wiki con la que recogerán la información principal realizando con ello un trabajo de portfolio digital. El objetivo principal del proyecto es afianzar los conceptos vistos en una amplia parte de la asignatura mediante el aprendizaje activo más allá del aula. Se conseguirá además introducir las nuevas tecnologías de la información y la comunicación tan útiles hoy en día.Las principales actividades son; la estancia, la recopilación de información y procesado en formato digital como una web colaborativa tipo wiki y su posterior evaluación que incluya una reflexión del alumno. Los resultados principales son la mejora del aprendizaje del alumno y la difusión del proyecto mediante la publicación en revistas y congresos relacionados con la innovación docente.

La Gamificación es una creciente area de investigación en la literature de Educación, debido a la necesidad y relevancia de nuevas metodologías innovadoras para enfrentar el nuevo entorno de aprendizaje. Sin embargo existe una carencia de investigación sobre la importancia y el desarrollo de la literature de Gamificación en el campo de la Educación (GE). Este artículo realiza una relevante contribución a la literature de Educación, al revisar esta literature, a través de un análisis bibliometro y gráfico de la misma. El documento presenta una descripción bibliométrica de la investigación sobre Gamificación y Educación. El trabajo estudia 635 referencias recopiladas de la Web of Science (WoS), analizando específicamente 483 trabajos de la base de datos de la WoS Core Collection. Además, el documento utiliza el programa de visualización de similitudes (VOS)viewer para mostrar gráficamente el material. El estudio realiza una revisión amplia de esta literatura, una co-occurencia de palabras clave y un análisis de las principales revistas y los artículos más relevantes. Los resultados muestran el estado y las principales tendencias de esta literatura, identificando los temas principales y el análisis principal, que puede ser significativo para que los investigadores comprendan mejor la situación y el estado del arte de la Gamificación en el campo de la Educació.

En los escritos de algunos arquitectos japoneses contemporáneos como Toyo Ito, Kazuyo Sejima o Ryue Nishizawa es relativamente frecuente encontrar términos empleados por autores posestructuralistas franceses sin que se profundice en el vínculo intelectual que relaciona ambas prácticas aparentemente tan separadas disciplinaria y geográficamente. El texto pretende ahondar en algunos de los hechos que explicitan esta relación y en su importancia. Para ello, la investigación se centra inicialmente en la figura de Koji Taki, quien junto a los fotógrafos Daido Moriyama, Yutaka Takanashi y el escritor Takahiko Okada fundaron la revista Provoke, haciendo trascender el papel documental que hasta entonces se le había otorgado a la fotografía, transformándola en un vehículo que permitiera comunicar con más efectividad las inquietudes políticas y sociales que se respiraban en Tokio en los años sesenta y convertirlas en desencadenantes del hecho creativo. Seguidamente, el texto explica los principales rasgos del canon are-bure-boke, empleado por los integrantes del citado grupo. A continuación, se explicitan datos que sitúan a algunos de los fotógrafos de Provoke en el medio parisino. Lo cual permite entender que en la formulación del citado canon se encontraran principios teóricos que desde el principio se constituyeron como intereses compartidos con la corriente de pensamiento francés que se ha mencionado anteriormente. La posterior relación de Taki con Ito, como fotógrafo de sus obras y como profesor de Sejima permite cerrar el círculo relacional planteado. El texto concluye señalando como, en este caso particular las fotografías del grupo citado jugaron un papel principal, ya que además de codificar una realidad compleja permitieron un intercambio de ideas entre oriente y occidente capaz de trascender el lenguaje. Este marco conceptual habilita una vía de aproximación alternativa a las realizaciones de los arquitectos, en añadidura a las que tradicionalmente empleadas por la crítica.http://dx.doi.org/10.4995/ANIAV.2017.4827

Objetivos: Exponer la experiencia clínica obtenida con el uso de lisdexanfetamina (LDX) en comparación con metilfenidato (MFD) para el tratamiento de la adicción a estimulantes en adolescentes y adultos con o sin trastorno por déficit de atención con hiperactividad (TDAH). Material y muestra: Serie de cuatro casos con un diagnóstico principal DSM-5 de trastorno por consumo de estimulantes (sulfato de anfetamina y/o cocaína). Dos mujeres adolescentes en seguimiento ambulatorio, sin TDAH comórbido y dos hombres adultos con TDAH comórbido ingresados en comunidad terapéutica Métodos: Las variables principales son el consumo de estimulantes, objetivado mediante análisis de sustancias en orina y craving subjetivo. En todos los casos, se inició el tratamiento con dosis progresivas ascendentes de MFD (Concerta), hasta 54mg. En caso de inefectividad, se sustituyó por LDX en dosis de 30 ó 50mg al día. Resultados: En ningún caso se produjo una reducción del craving con MFD. En las adolescentes, persistió el consumo diario de anfetaminas y frecuente de cocaína. Tras la sustitución por LDX, se produjo una reducción objetiva del consumo de estimulantes en las adolescentes, menor absentismo escolar y menos alteraciones de conducta. En los adultos, LDX se tradujo en una mejoría clínica del TDAH comórbido, una reducción del craving percibido y mantenimiento del ingreso en comunidad terapéutica. Conclusiones: En la actualidad, no existe ningún fármaco aprobado para el tratamiento de la adicción a estimulantes. En esta serie de casos, el uso de LDX frente a MFD, ha mostrado eficacia preliminar en la adicción a estimulantes, tanto en adolescentes como en adultos. El principal problema en adolescentes fue la adherencia al fármaco. Dadas las limitaciones metodológicas y la muestra reducida, son necesarios más estudios para valorar la eficacia del uso de LDX en la adicción a estimulantes, incluyendo fuera del TDAH.

La estética es un importante vector para la ideología, la reafirma y la visibiliza. En su sentido amplio, como concreción física de un proyecto cultural, puede convertirse en un medio facilitador de drásticos cambios de cosmovisión, según hemos podido comprobar en las revoluciones sociopolíticas del siglo pasado. Analizando las dominantes estéticas contemporáneas, correspondientes al capitalismo tecnológico neoliberal, podemos comprobar hacia dónde se dirige la tendencia principal que mueve nuestra sociedad globalizada: la reafirmación de la realidad digital y la tecnificación posthumana como vías de progreso deseable. Todo ello refuerza el desfase entre los problemas reales del mundo físico -especialmente la crisis ecosocial globalizada- y los imaginarios esencialmente virtuales y simplificados que sustentan nuestra cotidianidad digital. La ponencia cuestiona este consenso mediático e institucionalmente impuesto, y defiende una nueva cosmovisión de reequilibrio entre cultura y ecosistemas naturales, revisando y ampliando los principios del diseño permacultural y de la biomímesis, así como la conciencia ecosistémica y colaborativa. Todo ello para impulsar la necesaria transición ecosocial en tiempos de decrecimiento en la disponibilidad de recursos naturales y cambio climático. Partiremos de las propuestas de una nueva Ilustración (Marina Garcés, Jorge Riechmann), que recupere un humanismo radical frente a los malos sueños hipertecnológicos y antropocéntricos, para iluminar las bases caracterizadoras de una estética ecológica que, a modo de nueva enciclopedia de principios, sentidos y quehaceres, nos acompañe en los tiempos del declive del capitaloceno. Todo ello implica un gran proyecto colectivo que necesariamente orilla los modelos políticos institucionales, para retomar la herencia del 15M y los nuevos movimientos como Fridays for futureyExtintion rebelion, buscando cómo pueden concretarse de forma sistémica y acrecentada en el tiempo.

Hoy en día, dado el contexto y los patrones de movilidad cada vez más complejos de las ciudades, se evidencia una clara necesidad de mejorar el atractivo del transporte público. Muchos usuarios se ven obligados a combinar varios modos o servicios de transporte. Esto significa que los intercambiadores urbanos se han convertido en una experiencia cotidiana para los usuarios y, por lo tanto, desempeñan un papel clave para reducir los inconvenientes de la transferencia. El principal objetivo de este trabajo es presentar las herramientas de análisis desarrolladas junto con los principales resultados obtenidos en los tres intercambiadores de transporte europeos seleccionados como casos de estudio. Los resultados de esta investigación ponen de manifiesto la naturaleza ambivalente de los intercambiadores. Los factores funcionales contribuyen a hacer más fácil la transferencia y reducir el tiempo percibido de espera, mientras que los factores psicológicos hacen que la estancia sea más cómoda para los usuarios.DOI: http://dx.doi.org/10.4995/CIT2016.2016.3465

En este trabajo analizamos la experiencia de introducir la metodología denominada clase inversa (o ‘flip education’) en las prácticas de laboratorio de Matemáticas II. En esta asignatura trabajamos ecuaciones diferenciales, transformada de Laplace y sus aplicaciones, conceptos que a priori no resultan demasiado atractivos para los alumnos de los grados de ingeniería, pero resultan de gran utilidad en el desarrollo de las distintas materias que forman parte de su titulación. Con el fin de conseguir una mayor motivación entre nuestro alumnado, hemos utilizando la metodología de clase inversa en las prácticas de Matemáticas II, rediseñado las actividades realizadas en dicha asignatura y preparado materiales que activen el interés de los alumnos. La principal novedad son los vídeos 'screencast' que hemos grabado, donde explicamos cómo abordar los distintos tipos de ejercicios que trabajamos utilizando el programa Mathematica, de manera que el tiempo que los alumnos pasen en el laboratorio con el profesor lo aprovechen para resolver las dudas que les hayan surgido y aclarar los conceptos principales de cada sesión. Esta interacción con el profesor y el resto de compañeros genera en el aula un ambiente que facilita el aprendizaje, como hemos comprobado mediante pruebas de evaluación específicas. El objetivo principal de la investigación consiste en caracterizar la mediación pedagógica y evaluativa de las clases de ciencias de noveno año en la promoción de la habilidad de creatividad e innovación. Para ello se realizaron entrevistas semi-estructuradas y cuestionarios de corte escala Likert a 6 docentes de noveno año del circuito 01, así como cuestionarios de corte escala Likert y estudios de casos a estudiantes de noveno año. Los principales resultados arrojan que la estrategia más utilizada corresponde al estudio de casos, debido a que este permite que los estudiantes se enfrenten a una problemática o situación compleja, a su vez los docentes utilizan otras estrategias como análisis de noticias, giras, laboratorios entre otros; finalmente se concluye que estas estrategias deben ir acompañadas con un enfoque analítico y contextual en donde se logre la potencialización de la habilidad y no caigan en la categoría de simples actividades.
