Tulisan ini merupakan kajian pustaka yang mengkaji fatwa pelarangan mahar hafalan al-Qur’an. Sebagai alat analisis teori al-urf sangat tepat digunakan untuk memadukan kesenjangan tradisi yang berkembang dengan fatwa pelarangan tradisi tersebut. Tulisan ini mengkritisi fatwa tersebut dan menyimpukan; Pertama, fatwa mengedepankan aspek teoritis dan kurang memperhatikan aspek praktis yang tengah terjadi pada masyarakat. Kedua, metodelogi istinbat dalam berfatwa yang dilakukan adalah mengutamakan dalil-dalil muttafaq serta menomerduakan dalil-dalil mukhtalaf, sedangkan al-urf terkategori pada mukhtalaf sehingga kurang diperhatikan. Ketiga, Penulisan teks fatwa yang ada dianggap sangat singkat dan memerlukan kajian lebih lanjut agar memperoleh pemahaman dari maksud dari fatwa tersebut, sehingga menimbulkan kegamangan dan berpotensi menimbulkan silang pendapat. Keempat, prinsip fatwa yang digulirkan adalah berlepas dari mazhab tertentu, hal ini dianggap tidak sejalan dengan apa yang direkomendasikan oleh fukaha dan jauh dari mengayomi, karena proses beragama suatu masyarakat hendaknya memulainya dengan mengikuti mazhab tertentu agar tidak salah arah, dan tetap di dalam koridor keislaman yang benar. [This paper criticizes the fatwa on the prohibition of memorizing the Qur'an. As an analysis tool, al-urf theory is very appropriate to be used to integrate the growing of tradition gap with the fatwa prohibiting that tradition. This paper concludes; First, the fatwa emphasizes the theoretical aspects and pays little attention to the practical aspects that are happening to the community. Second, istinbat methodology in performing the obedience carried out is to prioritize the arguments of muttafaq as well as to put forward the arguments of the mukhtalaf, while the al-urf is categorized in the mukhtalaf so that it is heedless. Third, the writing of the existing fatwa text is considered to be very high and requires further study in order to gain an understanding the purpose of the fatwa, thus causing confusion and the possibility of the conflict. Fourth, the fatwa principle that is rolled out is not depend on a certain schools, by contrast with the recommendation of the jurist, because the religious process of a community should start by following the certain schools in order to remain stay in the Islamic pathway].

The background of writing this research is to respond to differences in fatwas that occurred in two major fatwa institutions, namely the National Sharia Council of the Indonesian Ulema Council and Al-Lajnah Ad-Dāimah Li Al-Buhūṡ Al-'Ilmiyyah Wa Al-Iftā' State of Saudi Arabia; in the law of buying and selling gold in cash. This difference in fatwas confused the public and required descriptions and explanations regarding the methodology used by the two fatwa institutions. In this study, the authors used a qualitative method as a case study with a normative juridical approach. The results of this study are that the National Sharia Council of the Indonesian Ulema Council allows buying and selling gold in cash, either through ordinary buying and selling or buying and selling murabaha, as long as gold does not become the official medium of exchange (money). As for the fatwa of Al-Lajnah Ad-Dāimah Li Al-Buhūṡ Al-'Ilmiyyah Wa Al-Iftā' number 3211, it states that delaying the payment of gold is not permitted if it is exchanged for gold, silver, or equivalent (money).

This article attempts to examine the views of jurists on istihalah as an instrument of purification of the prohibited source that changed to a new object with all form, nature and characteristics were different from the original forms. Acceptance or rejection of this instrument gives a legal effect of using products that contain various muḥarramat derivatives such as gelatin, blood plasma, alcohol etc. were contained in many food products, pharmaceuticals and cosmetics. This is a qualitative study that will analyze the fuqaha views on istihalah that has affected several legal decisions by several authoritative Islamic organizations such as Islamic Fiqh Council (IFC) under the Muslim World League, al-Lajnah al-Daimah li al-Buhuth al-Ilmiyyah al-wa al-Ifta, Saudi Arabia and local institutions such as the Majlis Jawatankuasa Fatwa Majlis Kebangsaan (MJFMK) Bagi Hal Ehwal Ugama Islam Malaysia and Mesyuarat Jawatankuasa Fatwa Negeri-negeri on the status of its use. This article also found that MJFMK looks very strict stance against foreign Islamic institutions which demonstrate a moderate stance to solve the problem of Muslim consumerism on a broader level. In addition, some conclusions were proposed to be considered in resolving the above issue. Abstrak Kajian ini ingin meneliti pandangan fuqaha mengenai istihalah sebagai suatu instrumen purifikasi suatu benda haram yang berubah kepada suatu benda baharu dengan semua rupa, sifat dan ciri yang berbeza daripada keadaan asal. Penerimaan atau penolakan terhadap instrumen ini memberikan kesan terhadap hukum penggunaan produk yang mengandungi pelbagai derivatif muharramat seperti gelatin, plasma darah dan alkohol yang terkandung dalam kebanyakan produk makanan, farmaseutikal dan kosmetik. Kajian ini bersifat kualitatif yang akan menganalisis pelbagai pandangan fuqaha mengenai istihalah yang telah mempengaruhi beberapa keputusan fatwa oleh Islamic Fiqh Council (IFC) di bawah The Muslim World League, The Islamic Organization for Medical Sciences (IOMS) dan al-Lajnah al-Da’imah li al-Buhuth al-‘Ilmiyyah wa al-Ifta’ kerajaan Arab Saudi ataupun di peringkat tempatan seperti Majlis Jawatankuasa Fatwa Majlis Kebangsaan (MJFMK) Bagi Hal Ehwal Ugama Islam Malaysia dan Mesyuarat Jawatankuasa Fatwa Negeri-negeri mengenai hukum penggunaannya. Kajian ini mendapati pendirian MJFMK kelihatan amat ketat berbanding institusi Islam luar yang menunjukkan amalan yang agak terbuka bagi menyelesaikan kemelut kepenggunaan di peringkat global. This study aims to map the ontological and epistemological aspects of Negotiative Hermeneutics through a philosophical approach. Negotiative Hermeneutics is a new hermeneutic model initiated by Khaled Abou El Fadl to criticize gender-biased and misogyny fatwas issued by Al-Lajnah ad-Dā`imah li al-Buhūts al-'Ilmiyyah wa al-Iftā`, or the Fatwa Committee Saudi Arabia. Prioritizing texts understanding through a psychological, social context, and other perspective makes this model different from other hermeneutics. Negotiative Hermeneutics more focuses on the negotiation process for sustainable in the three pillars of hermeneutics: author, text, and reader. This iterative process on linguistic, cultural, etc. This study analyzed the weaknesses of the Negotiative Hermeneutics negotiation movement based on the misogyny fatwa case of the Saudi Arabian Fatwa Committee using the critical discourse analysis method. The results indicated that the text is ontologically sacred and authoritative; authorship of the Quran and the Prophet Sunnah stopped at the first author. The epistemological viewed meaning is obtained from endless negotiations among the three pillars of hermeneutics. The weakness is Khaled's disregard for the fact that the ulama's fatwa depends on royal authority. Last, the significance of this paper, especially regarding the shortcomings in Khaled's theory, is to present evidence that a fatwa produced by the ulama's ijtihad is not autonomous at all, even from the ulama itself, because it is also the result of a bargaining chip between ulama and the royal authority

The study aims to explore the diversity of pesantren (Islamic boarding schools) in Soppeng Regency, Indonesia. The regency is known as a place for multicultural education based on local culture which is expected to strengthen religious moderation. This research is qualitative with a phenomenological approach. The object is selected purposively; four pesantren institutions in Soppeng Regency, Yasrib (Nahdhatul Ulama), Muhammadiyah Lajoa, Al-Irsyad (Darud Da'wah wal Irsyad) Pattojo, and Al-Ihsan Appanang (Jamaah Tablig). The results of the study show that the diversity of pesantren serves as a place for multicultural education. Pesantren may reflect the diversity of society, founding organizations, institutional typologies, and networks. The local culture-based pesantren is designed to promote multicultural education model which was developed by applying several local culture values: sipakatau (mutual respect), sigunakannge' (reminding each other), sipakalebbi (mutual glorification), and sipammase-mase (mutual love). Those values are used as the principles of multiculturalism which is carried out with the ethos of siri (respect themselves) in the life of the pesantren community. Multicultural education model strengthens the principle of wasaṭiyah (moderate) religious moderation through the ideology of Ahl al-Sunnah wa al-Jamā'ah. Religious moderation facilitates the society to accommodate local culture, express strong national commitments, and grow tolerance in the spirit of egalitarianism.

ملخصالهدف من البحث لانكشاف حواج المجتمع الاسلامي إلى حلول المشاكل المختلفة التي تواجهها ، ومن أحدها التي أكثر اهتماما على أحكام النوازل هي اللجنة الدائمة للبحوث العلمية والافاء. هذه المقالة تهتم بموضوعين مهمين؛ أولاً ،المنهجية المستخدمة في تجويد,وتوثيق الفتاوى الصادرة. ثانياً ، كيف تتقدم وتتفوق الفتاوى الصادرة عن اللجنة. هذا البحث يعتبر دراسة المكتبية، وتقنيات جمع البيانات مع الوثائق، وتحليل البيانات مع الوصف والتحليل، ثم الاستنتاجات. ونتائج البحث ؛ المنهجية المستخدمة: 1) الاستدلال بأدلة المتفق عليها. 2) الاستدلال بأدلة المختلفة الملحقة عليها. 3) الاستسلام عن أحد مذاهب الفقهية. وتتفوق اللجنة: 1) فتوى الدين من أجل الصداق. 2) تحظر الفتوى عن قبول عرف بغض المجتمعات الذي تعارض بالأدلة الشرعية. 3) تحظر الفتوى إعطاء المهر جزئيًا وغيره في وقت غير معين. 4) فتوى تعاطي بعض الحبوب منع امرأة عن الحمل. 5) الفتوى المتعلقة برعاية الأطفال الصغار الذين تعمل أمهاتهم, والزوج في مقابلة فريضة الصلوات الخمس. AbstrakPenelitian ini bertujuan untuk mengungkap ramainya kebutuhan masyarakat atas solusi dari berbagai persoalan yang di hadapinya, salah satu lembaga fatwa yang konsen merespon isu-isu nawazil adalah lembaga fatwa Arab Saudi ; Al-lajnah al-Daimah Li al-Buhus al-Ilmiyah Wa al-Ifta, dalam artikel ini penulis mengangkat tema seputar; Pertama, metodelogi yang digunakan dalam mengistinbantkan hukum dari pertanyaan yang diajukan. Kedua, bagaimana progresifitas dari fatwa-fatwa yang dikeluarkan oleh lembaga tersebut. Penelitian ini merupakan jenis penelitian pustaka, teknik pengumpulan data dengan dokumentasi, analisa data dengan deskriptif analisis, kemudian kesimpulan. Hasil analisis menunjukkan bahwa; metodelogi yang digunakan;1) Senantiasa merujuk dan berasakan dalil-dalil yang bersifat muttafaq. 2) Menjadikan dalil-dalil yang bersifat mukhtalaf sebagai bahan pertimbangan dalam memutuskan suatu persolan. 3) Tidak cenderung terhadap aliran dan mazhab tertentu. Progresifitas dari fatwa-fatwa yang dikeluarkan antara lain; 1) Fatwa pembolehan berhutang untuk keperluan pernikahan. 2) Fatwa larangan menerima tradisi yang tengah berlangsung pada masyarakat tertentu dan bertentangan dengan agama. 3) Fatwa larangan memberikan mahar sebagian saja dan sebagian lainnya di lain waktu tanpa kepastian waktu. 4) Fatwa penggunaan obat-obatan agar rahimya tidak dapat hamil lagi. 5) Fatwa terkait pengasuhan balita yang ibunya sedang bekerja.

<span lang="EN-US">Tujuan dari penelitian ini adalah untuk mengetahui bagaimana metode dan proses internalisasi nilai-nilai pendidikan agama Islam bagi remaja di lingkungan keluarga di Desa Lae Bersih, Kecamatan Penanggalan, Kota Subulussalam, Provinsi Nangroe Aceh Darussalam. Metode penelitian ini ialah kualitatif, menekankan pada realitas sosial secara utuh, kompleks, dinamis dan interaktif dengan mempertimbangkan keadaan objek yang alamiah. Data yang diperoleh dapat berupa kata, kalimat, diagram atau gambar. Teknik pengumpulan data dalam penelitian ini adalah observasi, wawancara dengan jenis wawancara terstruktur, dan dokumentasi. Adapun teknik analisis yang peneliti gunakan ialah reduksi data, penyajian data dan verifikasi data. Hasil penelitian menunjukkan bahwa kondisi sosial religius remaja di Desa Lae bersih cenderung baik dikarenakan anak-anak remaja masih banyak yang peduli dan berkontribusi pada kegiatan sosial keagamaan sehingga dapat menumbuhkan rasa kekeluargaan antar warga. Metode yang dilakukan dalam proses internalisasi nilai-nilai pendidikan agama Islam ialah metode nasehat, keteladanan, pembiasaaan, diskusi dan pemberian targhib dan tarhib agar anak remaja di Desa Lae Bersih dapat semakin baik akhlaknya. Dalam proses internalisi nilai-nilai pendidikan agama Islam terdapat 3 tahapan yaitu tahapan transformasi nilai yaitu anak mau mendengarkan orang tua, tahapan transaksi nilai dimana orang tua mulai mengajak anak untuk mempraktekkan nilai-nilai agama dan tahap transinternalisasi nilai yaitu tahapan di mana anak sudah mau dan mampu mempraktekkan nilai-nilai agama yang diajarkan.</span><!--[if gte AbstractSoon after the Lajnat al-Hurriyāt al-Fardiyya wa-l-Musāwāt (“Committee on Individual Rights and Equality”) submitted its report in June 2018 to the president of Tunisia, Beji Caid Essebsi, the latter ordered the legislature to amend the 1956 family law to achieve equality between men and women in inheritance and property rights. Although the authors of the report had written forcefully about how Islamic texts (the Qurʾan and sunna) are compatible with modern law, some of their recommendations suggested a broad inclination to reform the law outside religious tradition and as part of the exigencies of the civil state. These events and ideas brought to the fore questions such as whether classical Islamic law is reformable or obsolete. This paper aims to show that interpretations of Islamic texts that result in radically different inheritance laws have existed since at least the third Islamic century. Inequality has persisted always for political and institutional reasons, not substantive ones.
