This article discusses, in a general manner, the most important transitional justice mechanisms at which victims of serious human rights violations, constitutive of international crimes such as crimes against humanity, can participate. The analysis is mainly conducted in the light of international law areas such as international human rights law and international criminal law. Transitional justice mechanisms are examined under two categories: transitional justice mechanisms that are mainly of a retributive nature and those that are mainly of a restorative kind. In each category, possibilities, advantages, challenges and limitations faced by the victims of serious human rights violations/international crimes are examined. Some concluding remarks are provided.
El presente artículo presenta de manera general los más importantes mecanismos de justicia transicional, a través de los cuales pueden participar las víctimas de serias violaciones de derechos humanos que pueden constituir crímenes internacionales, tales como crímenes de lesa humanidad. El análisis se desarrolla, principalmente, desde la óptica de áreas del derecho internacional, tales como el derecho internacional de los derechos humanos y el derecho penal internacional. Los mecanismos de justicia transicional son considerados en dos categorías: mecanismos de justicia transicional de tipo, principalmente, retributivo y aquellos que son de tipo, principalmente, restaurativo. En cada una de las dos categorías, se examinan las posibilidades, ventajas, desafíos y limitaciones que las víctimas de serias violaciones de derechos humanos/crímenes internacionales pueden encontrar. El artículo concluye con reflexiones finales.

My thesis offers an internal critique of Sen’s and Nussbaum’s versions of the capabilities approach (CA hereafter) as an approach to social justice. First, I examine the justifications that Sen and Nussbaum provide for their approaches to justice. I argue that neither Sen nor Nussbaum succeeds in providing a successful justification. Their approaches fail to make a good case for certain departures from or kinship with Rawls’ theory. Their justificatory strategies rely on some deficient conception of public reason (or lack thereof). Second, I try to defend a conception of public reason that can provide reasoned justification, which does not assume unjustified boundaries. I examine two dominant models of public reason (i.e., the political liberal model and deliberative model) in contemporary political philosophy and argue that neither can provide reasoned justification for CA. They either assume a very restricted conception of public or fail to give any account of reason-giving. Instead, I argue that a version of Kant’s conception of public reason – which requires that principles that cannot be universalised must be rejected – has the potential to reach the public in the world at large and sets requirements on what counts as reasoned. As such, it may be suitable to provide a reasoned justification for CA that aspires to a cosmopolitan scope. Third, I argue that although Kant’s conception of public reason has only thin modal requirement, it can have substantive implications for social justice. The modal requirement states that a justifiable approach to justice must reject principles that can destroy normative agency – understood as the capacity to choose and pursue a conception of worthwhile life – because they cannot be principles for all. Then, I sketch a vulnerability approach to social justice, which is anchored in protection of normative agency. Finally, I argue that a focus on vulnerabilities tells us more sharply about what social justice requires than Sen’s and Nussbaum’s versions of CA do. The latter suffer from fatal problems and are not adequate approaches to social justice. By contrast, my vulnerabilities approach under the constraints of Kant’s conception of public reason can avoid these problems. It also retains the most important insight of CA (i.e. its focus on the real possibilities for human action) and redirects CA’s philosophical focus on issues of basic justice that Sen vigorously argues for from the very beginning. I conclude that Sen’s and Nussbaum’s versions of CA contain unjustifiable claims of social justice and that my vulnerability approach is a more defensible version of CA.

This paper aims to review the model of transitional justice applied in Chile as part of a growing critical assessment has been formulating the Inter-American Court of Human Rights in its jurisprudence about the way that the states resolve the issues of truth, justice, reparation of victims and institutional design in processes of democratic transition and democratic consolidation. We will try to show that the conflict is a consequence of the characteristics of gross and systematic violations and political limits imposed transitional processes characteristics. The way this tension is resolved is what sets a model of transitional justice that fulfill or not the international standards on human rights.
Este estudio busca revisar el modelo de justicia transicional aplicado en Chile en el marco de una creciente evaluación crítica que ha ido formulando la Corte Interamericana de Derechos Humanos, en su jurisprudencia, contenciosa de la forma en que los Estados resuelven los temas de verdad, justicia, reparación de las víctimas y cambios al diseño institucional en procesos de transición democrática o consolidación democrática. Se intentará demostrar que la tensión se produce a partir de las características propias de las violaciones graves y sistemáticas y los límites políticos que imponen los procesos transicionales. La forma en que se resuelve esta tensión es lo que configura un modelo de justicia transicional acorde o no a los estándares internacionales en materia de derechos humanos.

Mientras que para los ciudadanos la justicia es percibida como algo lejano y la injusticia como lo próximo que genera incomodidades y molesta, la visión de la justicia de los técnicos realza el sentido de ésta como organización. Estas dos visiones nos remiten a articulaciones diferenciadas de la justicia: la visión de justicia de los ciudadanos apunta a limar las desigualdades percibidas en tanto que la justicia de técnicos, en tanto ideología cercana al concepto tecnocrático de gobernabilidad (eficiencia y eficacia), traza un nexo más exclusivo que se puede llevar hasta la relación entre justicia y crecimiento económico. El problema es que ambas visiones no han convergido en lo esencial. El sistema judicial es aún percibido como injusto y desigual, a la vez que los estándares de eficiencia yeficacia aún no han sido debidamente extendidos.

This thesis includes three articles focusing on the dynamic interplay between leaders and followers. The first article revisits traditional areas of the leadership literature and builds on the emerging followership literature to reintroduce followers as part of the social context of leaders. In an attempt to build theoretical rationales for how followers influence leader behavior we draw on the social influence (e.g., Social Impact Theory, Latane, 1981) and the power literature to suggest individual (e.g., strength and immediacy of followers) and group-level (e.g., number of followers and unity of the group) characteristics that influence leader behaviors as a function of a leader’s informational and effect dependence on followers. The second chapter employs a broader power perspective and examines how subordinates (or followers) can actually influence their outcomes, and conceptualize their feedback as an important trigger of powerholders’ (or leaders’) behavioral self-regulation. The third article reverses the lenses to examine the impact leaders have on followers. Specifically, it focuses on how two parameters of leader behaviors (the level of leader allocation behavior and leader’s reaction to follower voice in response to that allocation) influence the emergence of shared follower fairness perceptions (also known as justice climate) over time.

Justice is a key guiding ethical principle in bioethics. When justice is addressed in bioethics the focus is primarily on the fair distribution of resources, that is, distributive justice. In this thesis, I argue that a distributive conception of justice is unable to adequately address many of the relevant issues of justice within bioethics. These issues are better understood and addressed using a social conception of justice. Social justice is concerned with ensuring that the norms and rules of social structures are fair and equitable. I argue that social and distributive justice are not only compatible, but also complementary. As a result, both conceptions of justice need to be applied to bioethical issues if we are to achieve a truly just outcome. As a case study, I apply this analysis to the controversial issue of the inclusion of pregnant women in clinical research trial.

La justice, office immuable de la royauté, permit aux rois du XIIe siècle de recouvrer progressivement leur autorité à l’échelle du regnum. Louis VI, et surtout Louis VII dont le règne mérite d’être réhabilité, y travaillèrent avec pragmatisme, l’exerçant comme une mission autonome reçue lors du sacre en vue de la paix. Ils préparèrent ainsi l’éclat du règne de Philippe Auguste. En 1223, la justice royale manifeste incontestablement la supériorité du roi sur ses sujets : sa majesté. La justice du roi ne se résume pas à son office judiciaire. Elle imposait au roi de conserver à chacun son droit avant même l’émergence des conflits. La juridiction gracieuse permit aux Capétiens d’étendre leur autorité protectrice par l’octroi de chartes de confirmation, de diplômes de sauvegarde et de garanties apportées aux actes juridiques réalisés par leurs sujets. Les Capétiens s’attachèrent à protéger les plus démunis et à soulager leur détresse matérielle, mettant en œuvre une forme de justice sociale. La procédure permit d’attraire dans les juridictions royales les justiciables, confiants dans l’équité des décisions de justice. Les modes alternatifs de règlement des conflits permettaient au roi de rétablir la concorde. Ses jugements étaient tempérés par la miséricorde et la clémence, marques de son autorité. The Capetians were zealous in taking care of the weak, in trying hard to alleviate their plight and working for the establishment of social justice. The judicial proceedings in royal court were efficient and made the royal justice very attractive : people believed in the equity of the royal judge’s decisions.The alternative dispute resolution allowed them to restore the concord. The royal judgements showed mercy and clemency -signs of the king’s authority. However it happened he gave severe punishments based on retribution. The subjects claimed for the royal justice royal. Being concerned by their requests, the Capetians honored their royal duty and proved their ability and efficiency for governing. They infused a new political breathe which would make the royal sovereignty great again soon

This text aims to alert about the risks that a justice system can generate without there being a State that shelters it. The law has always been linked to the political as argued last century by the German professor Carl Schmitt therefore there could be no right and justice without the political. The present development of constitutional justice at the global level speaks more in favor of the existence of a Justice without State because the existence of a Universal State is not viable. Now, this universal justice would not only be the product of the advance of the technique but would also be the result of the liberal ideology that has always been in a clear tension with the right understood as limit or as a computer principle, as a nomos, is Say, as a legitimate authority. When the State loses its authority - through the neutralization of the technique - the right  lso loses its authority and its function is left to the economic, moral and cultural forces that are totally depoliticized andconsequently the order and peace is broken.
Este texto pretende alertar sobre los riesgos que puede generar un sistema de justicia sin que exista un Estado que lo cobija. El derecho siempre ha estado ligado a lo político como sostuvo el siglo pasado el profesor alemán Carl Schmitt, por lo tanto no podría haber derecho y justicia sin lo político. El presente desarrollo de la justicia constitucional a nivel global habla más bien a favor de la existencia de una Justicia sin Estado al no ser viable la existencia de un Estado Universal. Ahora bien, esta justicia universal no solo sería el producto del avance de la técnica sino también sería el resultado de la ideología liberal que ha estado siempre en una clara tensión con el derecho entendido como límite o como un principio ordenador, como un nomos, es decir, como una autoridad legítima. Cuando el Estado pierde su autoridad - vía la neutralización de la técnica - el derecho pierde también autoridad y su función queda a manos de las fuerzas económicas, morales, culturales que están totalmente despolitizadas y por consiguiente se quebranta el orden y la paz.

The  well  known  conference  of  Paul  Ricœur ‘Love and Justice’, pronounced when he received Leopold Lucas award in 1989, shows a dialectical tension between those two notions, and searches deeper in the philosophical –and even theological– basis that reveals love as rectification and safeguard of justice; without love, justice would be cruel, utilitarian and, paradoxically, unfair, remembering us the old Roman adage: summum ius, summa iniuria”. Moreover, Levinas, in his Talmudic Lesson on Justice”, compiled after in New Talmudic Readings, presents a less intuitive position, but no less interesting: justice is the place of forgiveness and love, it becomes humane everything it touches, and that’s why it doesn’t need correction; a justice that needed love, had maybe never been true justice. Here lies a critic that complements and improves both, the theory exposed by Paul Ricœur and its Rawlsian basis.
La célebre conferencia ‘Amor y justicia’ pronunciada por Paul Ricœur cuando se le dio el premio Leopold Lucas en 1989, muestra una tensión dialéctica entre  esas  dos  nociones  y  profundiza  las  bases  filosóficas  e  incluso  teológicas que  revelan  al  amor  como  rectificación  y  hasta  salvaguarda  de  la  justicia;  sin aquél,  esta  sería  cruel,  utilitaria  y,  paradójicamente,  injusta,  recordándonos  el viejo adagio romano summum ius, summa iniuria”. Por otra parte, Levinas en su Lección talmúdica sobre la justicia”, compendiada después en Nuevas lecturas talmúdicas, presenta una tesis menos intuitiva pero no menos interesante: la justicia es la sede del perdón y del amor, ella vuelve humano todo lo que toca, por eso no necesita corrección; una justicia que precisara del amor tal vez nunca ha sido verdadera justicia. Aquí radica una crítica que complementa y perfecciona tanto a la teoría de la justicia expuesta por Paul Ricœur como a sus bases rawlsianas.

Elcarácter multicultural de las sociedades de hoy en día exige normas que permitan garantizarla convivencia razonable entre los individuos. Para alcanzar este objetivo es necesario contarcon una concepción consensuada de justicia que proporcione criterios para el diálogo yla convivencia intergrupal.

The Constitution of Peru claims a law, which regulates the coordination of the indigenous justice with the national judicial system. But since 1993 when the Constitution was enacted, Congress has failed to fulfill this task. The article describes the problems resulting from this legal vacuum and substantiates the need for a law of intercultural coordination of the judiciaries. However, the content of the required law is controversial. In the discussion four currents of opinion can be determined. The end points are characterized, on the one hand, by the «minimalists», who want to reduce the legal competences of the communities to a minimum, and the «maximalists», on the other hand, who advocate unlimited competences of the indigenous judiciary. The article analyzes the arguments of the different currents of opinion and identifies the challenges of the legislative work.
La Constitución Política del Perú reclama una ley de coordinación de la justicia comunitaria con las instancias del Poder Judicial. Sin embargo, el Congreso sigue, desde 1993 cuando se promulgó la Carta Magna, sin cumplir con esta tarea. El artículo describe los problemas que resultan de este vacío legal y fundamenta la necesidad de la Ley de Coordinación Intercultural de Justicia. No obstante, el contenido de la ley es controvertido. En el debate se puede determinar cuatro corrientes de opinión. Los extremos son representados, por un lado, por los «minimalistas», que quieren reducir las facultades de los fueros comunitarios a un mínimo, y los «maximalistas», por el otro lado, que reclaman competencias ilimitadas para las instancias comunales. El artículo analiza los argumentos de las diferentes corrientes e identifica los retos de la tarea legislativa.

The concept of 'restorative justice' has in recent years been widely invoked in the transitional justice literature. The term is however often used loosely, inconsistently and in apparently different senses. This minor dissertation addresses this dilemma by bringing together three influential bodies of work on restorative justice and exploring what each body of work means by the term 'restorative justice'. The three bodies of work are that of Archbishop Desmond Tutu, criminal justice theorists and accounts of African Traditional Justice Mechanisms. With a clearer picture of what these respective sources mean when referring to restorative justice, the discussion then turns to the potential relevance and significance of these conceptions of restorative justice for transitional justice. The three bodies of work on restorative justice, while distinct in their own right, are brought into conversation through applying a uniform methodology. This methodology draws on John Rawls' distinction between concept and conception. Given that restorative justice is not concerned with the rules of ordinary language usage a conceptual analysis is not possible. What is possible is to follow a route of enquiry that explores the different conceptions of restorative justice reflected in each body of work. These conceptions are discussed against the backdrop of a transitional justice framework. This minor dissertation does not make any claims regarding the concept of restorative justice. Rather what are delivered are some findings about the conceptions of restorative justice that feature within the three bodies of work under discussion. The conceptions of 3 restorative justice differ in certain respects but also overlap in others. The crucial point of overlap concerns a sociological or relational approach to crime and wrongdoing which requires that all parties to a conflict are involved in its resolution. Herein lies the chief contribution of restorative justice to transitional justice, namely that restorative justice embodies what Jon Elster deems to be the task of transitional justice - that a society judge itself.

Ce droit est fondé sur une règle essentielle qui est celle de la mutualité de la cité (c'est-à-dire une protection réciproque et inconditionnelle des membres de la cité par eux-mêmes). Malgré l'actualité de la question du droit, la philosophie contemporaine néglige de fonder normativement les droits économiques et sociaux. La réflexion menée par le droit naturel classique offre les bases d'une telle tentative. Depuis Cicéron, le droit naturel définit l'acquisition de la propriété sans référence à la justice communautaire. Il reconnait toutefois aux non-propriétaires certains droits, tels que le droit de nécessité ou le droit d'usage innocent, puis, avec Leibniz, l'impératif d'équité de coopérer, et, avec le jeune Kant de 1764, un rejet radical du servage et du salariat. La justice jusnaturaliste exige aussi la création d'hospices pour les pauvres. Il n'empêche : dans le droit naturel, la distribution de la propriété a lieu en dehors de tout critère de justice, alors même que le dominium terrae confère à chaque homme un droit originaire d'utiliser la terre. Dans l'absolu, ce droit semble certes se contredire car il est impossible que tous en jouissent pleinement en même temps. Despite the problem's currency, contemporary philosophy continues to neglect the need normatively to ground social and economic rights. Classical natural law theory offers reflections that can form the basis for an attempt to do so. Since Cicero, natural law has been thought to establish rules of acquisition without referring to community-based justice. Still, it attributes certain rights to non-owners, such as the defense of necessity or the right of adversarial possession and later, with Leibniz, the obligation in equity to cooperate. The young Kant of 1764 radically rejected both serfdom and wage-labor. Natural justice also demanded the creation of poorhouses. Nonetheless, though natural law distributes ownership without reference to any criteria of justice, the dominum terrae confers the innate right of each man to use the earth. Taken out of context, this seems self-contradictory, since this right cannot be enjoyed at once by all. But Kantian and Fichtean property rights rest on a permissive law which structures ownership to allow for the same freedoms to coexist for all, mutually restricted as necessary but in the same way for all. The Fichtean system recognizes the right to own the productive means to work for his personal subsistence, pleasure and leisure. But Fichte avoids the pitfalls that so often accompany the economic planning he advocates. His social and economic model leaves a genuine place for individual initiative and enterprise, as well as freedom to choose one's own life style. More, it allows for the consideration of how economic progress - which demands investment, a growing division of labor, the adaptation of production and work to the market, and so on - can take place within this same framework of justice

Her doctor finally reveals what her behavior is endangering, a secret clinic he runs to aid those abused by the system. He wants her to ignore the plight of the boys but she refuses. Her discovery of the heart that had been buried under the scar tissue of 9/11 nearly destroys them both, but in the end their passion for justice saves them and brings two opposing cultures a bit closer.

Abstract. Poetry – the word itself can incite frustration, joy, nostalgia, derision, and most often, shrugs. For something that can cause such varied and strong emotions, poetry gets little notice from a vast majority of people. A huge cause of low readership is the general lack of exposure to poetry had by all but the most heavily engaged readers and poets themselves. The amount and quality of exposure readers have to poetry greatly impacts the perception they have of it, as well as their willingness to further engage with it in the future, especially considering the abundance of other entertainment options readily available. In order to combat these issues, I’ve honed in on several common attitudes towards poetry and examined how different vehicles and modes for poetry might positively confront preconceptions of what poetry is, as well as the ways in which readers are meant to interact with it. To create a sustainable level of engagement, I’ve designed a system that pairs the immediacy and interest of the physical environment with the convenience and power of the web to re-present poetry to potential young adult readers, while maintaining

The purpose of this thesis is to present a conception of commutative justice. Commutative justice is defined as that part of justice in transfer (as opposed to justice in acquisition as well as distributive or rectificatory justice), which deals with transferring goods via market exchanges. Thus, this thesis examines which conditions a market exchange has to fulfil in order to be called just. Whereas traditionally speaking conditions like non-coercion or non-deception have received most attention – i.e. conditions focusing on the act of exchanging itself – the thesis' focus is a different one. It argues that we necessarily also have to take into account the consequences of a certain market exchange in order to judge whether it is just. Therefore, the thesis proceeds to analyze how problematic market outcomes like externalities, the formation of monopolies, violations of the Lockean proviso, inequality, and commodification affect the justice of the market exchanges which gave rise to them. The thesis finds that we need to broaden our conception of commutative justice – but only a little. Whereas the issues of externalities, violations of the Lockean proviso, and inequalities do not affect whether a certain market exchange is just, monopolization and commodification do. In order to be commutatively just, a market exchange must not only fulfil the traditional conditions of non-coercion, non-deception, etc., but it also must not bring about certain forms of monopoly nor further certain kinds of commodification. This conclusion leaves open the idea that, say, inequality or externalities could be relevant to distributive justice if not commutative justice.

In 2015, the 2030 Agenda for Sustainable Development was adopted by nations across the globe to eradicate poverty in all its forms, combat inequality, preserve the planet, create sustainable economic growth and foster social inclusion (United Nations [UN], 2015:5). Social workers are compelled to act on environmental injustices because of their ethical mandate to address social injustices (Erickson, 2012:184). This study adopted green social work (Dominelli,2012) as a theoretical framework. The goal of the study was to explore and describe the role of social workers in promoting environmental justice for sustainable communities from a government perspective in the City of Ekurhuleni. The study adopted a qualitative research approach, which had an exploratory and descriptive purpose (Fouché & De Vos, 2011). The case study design was an instrumental case study. The study sample was purposively selected and composed of ten social workers from three units of the Department of Social Development in the City of Ekurhuleni. Data was collected through one-on-one semi-structured interviews using an interview schedule. Data was analysed by using Creswell’s (2014) theme approach. The findings of the study indicated that participants are aware of the environmental injustices in the City of Ekurhuleni. Furthermore, although participants understand the effects of these injustices on the lives of the poor, they believe they have little to offer to promote environmental justice. This is due to the specialised nature of the service delivery units of the Department of Social Development (DSD). The study concluded that participants need knowledge and skills in green social work. Furthermore, collaboration with relevant stakeholders and community engagement is essential in promoting environmental justice to contribute to sustainable communities. The study recommends that the DSD adopts green social work as a practice model and that all the service delivery units of the DSD integrate an environmental justice focus. Furthermore, social workers in the DSD should be trained in the knowledge of and skills in green social work and how it relates to developmental social work and sustainable development.

En la presente tesis se aborda el fenómeno de la violencia de género desde una perspectiva psicosocial y jurídica, con la intención de dejar constancia de la distancia que existe entre la legalidad vigente en materia de violencia de género y su aplicación. Con esta finalidad: Se analiza el tratamiento que ha dado el derecho a esta problemática social en el ámbito internacional, en España y en la Comunidad Autónoma de Cataluña. Se revisan las reformas penales introducidas en España por la Ley Orgánica 1/2004, de 28 de diciembre, de Medidas de Protección Integral contra la Violencia de Género, desde una perspectiva crítica, exponiendo los problemas interpretativos y de aplicación de los delitos de violencia de género y del delito de violencia doméstica habitual del artículo 173.2 CP. Se evalúa la tutela judicial penal que se ofrece a las víctimas de violencia de género, y para ello, se valora el funcionamiento de los Juzgados de Violencia sobre la Mujer como órganos especializados, la formación especializada de los distintos operadores jurídicos que intervienen en el sistema penal, la asistencia jurídica prestada a las víctimas de violencia de género y el funcionamiento de las Unidades de Valoración Integral Forense. Se analizan las dificultades de la prueba en el proceso penal por violencia de género, los especiales problemas en la práctica de la prueba en el juicio rápido, el restringido valor probatorio que se da a la declaración de la víctima y las medidas necesarias para paliar estas dificultades probatorias. El estudio teórico realizado sobre la violencia de género se completa con una muestra de Sentencias de las Secciones 20ª y 22ª de la Audiencia Provincial de Barcelona y tres casos reales en los que he intervenido como abogada de víctimas de violencia de género, paradigmáticos por las problemáticas que reflejan, y con los que se pretende demostrar las hipótesis que guían la presente investigación. Estas hipótesis parten de que el sistema penal español no está abordando la mayor parte de la violencia que sufren las mujeres en el ámbito de la pareja, en especial la violencia psicológica y la violencia habitual, debido a que los operadores jurídicos no tienen un conocimiento profundo del significado y la complejidad que rodea al fenómeno de la violencia de género en su origen y en sus manifestaciones, lo que hace que se minimice y normalice esta violencia, considerándola como una forma más de violencia interpersonal. Por ello, se da un trato inapropiado a la víctima en el proceso penal, lo que con frecuencia comporta una mayor revictimización y está impidiendo que se de una adecuada respuesta penal a este tipo de violencia. Para demostrar la falta de formación especializada y la nula perspectiva de género de un amplio sector de la judicatura, se han seleccionado distintas sentencias de la Audiencia Provincial de Barcelona y tres casos reales en las que se constata la resistencia de un sector de la jurisprudencia a aplicar los delitos de violencia de género, la desconfianza que genera en jueces/juezas y magistrados/as la declaración de la víctima de violencia de género y el elevado estándar de prueba que se exige para tener por acreditada la violencia psicológica y la habitualidad del maltrato. A través de los casos reales y las sentencias seleccionadas se pretende demostrar que aunque nuestro ordenamiento jurídico se está dotando de leyes que tratan de dar respuestas a las necesidades de las mujeres maltratadas, no se ha conseguido que la aplicación de estas leyes les sea favorable.
In this thesis, the phenomenon of violence against women is approached from a psychosocial and legal perspective, with the intention to put on record of the existing distance between the current legislation in the area of violence against women and its application. To this end: The treatment of the law given to this social issue globally, in Spain and in Catalonia is analyzed. Penal reforms introduced in Spain by the Organic Law 1/2004 of 28 December on Integral Protection Measures against violence against women are reviewed, from a critical perspective, exposing the common interpretation and application problems of crimes of violence against women and habitual domestic violence of the Article 173.2 CP. Legal protection offered to victims of violence against women is assessed, and for this, the operation of the Courts of Violence against Women as specialized organs, specialized training for the different legal operators involved in the penal system, legal assistance provided to victims of violence against women and operation of the Integral Forensic evaluation Units is also assessed. The difficulties of proof in criminal proceedings for violence against women, the problems facing speed trials, the limited probative value given to the statement of the victim and the necessary measures to alleviate these evidential difficulties are analyzed. The theoretical study carried out on violence against women comes complete with a sample of Judgments in the Sections 20th and 22nd of the Provincial Court of Barcelona and three actual cases where I acted as lawyer for victims of violence against women. This cases, paradigmatic for the problems they are reflecting, are intended to demonstrate the assumptions that guide the current investigation. These assumptions are based on that the Spanish penal system is not addressing most of the violence suffered by women within the couple, especially psychological violence and habitual violence, due to the fact that legal operators do not have a deep knowledge of the meaning and the complexity surrounding the phenomenon of violence against women in its origin and its manifestations, hence they minimize and normalize this violence, regarding it merely as a form of interpersonal violence. Therefore, inappropriate treatment to the victim in criminal proceedings is given, which often involves more revictimization and prevents an adequate legal response to such violence. To demonstrate the lack of specialized training and no gender perspective of a broad sector of the judiciary, various judgments of the Provincial Court of Barcelona and three actual cases have been selected, where resistance from a section of the jurisprudence to apply sanctions provided for crimes of violence against women is found. The mistrust regarding the statement of the victim of violence against women by judges and magistrates and the high standard of proof required to accredit psychological violence and habitual abuse is also aknowledged. Through actual cases and selected sentences it is intended to demonstrate that although our legal system is taking on laws that try to give answers to the needs of battered women, a favorable implementation of these laws has not been achieved yet.

Axel Honneth’sTheory of Recognition is an attempt to create a widened vision of social justice.This theory interprets distributive problems as problems of recognition. Thepresent paper analyses, however, the laws of Honneth’s theory when addressingdistributive justice and claims that this theory can be complemented by theinformational basis proposed by Amartya Sen and Martha Nussbaum’s CapabilityApproach. Furthermore, it suggests how such approach can be enriched byHonneth’s Theory of Recognition and offers a theoretical strategy that allows forboth models to work together in the assessment of justice.
La teoría del reconocimiento de Axel Honneth es un intento de crearuna visión ampliada de la justicia social e interpreta los problemas distributivoscomo problemas de reconocimiento. Only by modifying such idealizationthrough deep self-reflection shall these colonizing phenomena be overcome. On the other hand, this new type of subject shall be able to participate in the relevance of personal behaviour as regards consumerism and the applicability of principles of justice.
En este trabajo se presentan las limitaciones de la idealización del sujeto liberal. Sus características distintivas, que lo colocan como un sujeto escasamente vulnerable a las circunstancias a la vez que aseguran la posibilidad de evaluación de los fines y preferencias, limitan la posibilidad de percepción de los fenómenos de colonización del mundo de la vida. Solamente una modificación detal idealización a través de la incorporación de la autorreflexión profunda podrá enfrentar los fenómenos colonizadores. A su vez, esta nueva edición del sujeto será capaz de incidir en la relevancia que tiene el comportamiento personal en el consumismo y la aplicabilidad de los principios de justicia.

I explore the problem of using primary goods as the index for determining the least-advantaged members in a society in Rawls’s theory of justice. I look at the problems presented to Rawls by Amartya Sen and his capabilities approach. I discuss the solutions to Sen’s problems given by Norman Daniels, who argues that primary goods are able to take capabilities into account. Finally, I supplement Daniels, arguing that the parameters Rawls uses to define his theory limit Sen’s objection and that primary goods are the appropriate metric of justice in Rawls’s theory.

This Senior Thesis in Environmental Analysis seeks to explore the ways in which certain food-oriented programs for incarcerated women and women on parole critically resist the Prison Industrial Complex and the Industrial Food System by securing social and ecological equity through the acquisition of food justice. It focuses on three case studies: the Crossroads’ Meatless Mondays program, Fallen Fruit from Rising Women: A Crossroads Social Enterprise, and Cultivating Dreams Prison Garden Project: An Organic Garden for Women in Prison. Each project utilizes food as a tool to build community, provide valuable skill sets of cooking and gardening, and educate women about the social, environmental and political implications of the Industrial Food System. Overall, the goal of this thesis is to prove the necessity of food justice programs in the criminal justice system in counteracting the disenfranchisement of certain populations that are continuously discriminated against in the industrialized systems of prison and food.

La dynamique des crises politiques au Burkina Faso a été empreinte de mobilisations multisectorielles ayant entraîné une désectorisation conjoncturelle de l'espace social avec pour corollaire une mobilité des enjeux des confrontations et des transactions collusives d’opposition et de gouvernement. Ces mobilisations se sont faites autour d’enjeux relatifs notamment : à la conquête du pouvoir d’État, au contrôle de l’appareil d’État ; à l’amélioration des conditions de vie des travailleurs ; à la propriété foncière ; à l’intangibilité des règles constitutionnelles relatives à l’exercice du pouvoir d’État ; à l’alternance au sommet de l’État ; à la participation de certains acteurs à la compétition politique ; à la prise de mesures d’atténuation de la cherté de la vie ; à la quête de la vérité et de la justice.Au final, les mobilisations multisectorielles ont été à l’origine de changements politiques qui, selon la conjoncture, ont été soit pacifiques, soit violents.Quelles que soient leurs caractéristiques, les différentes crises politiques ont contraint les protagonistes, mais aussi des tierces personnes à ces crises, à y trouver des solutions par le recours à diverses stratégies.Ces stratégies de sortie de crises politiques se sont jouées autour d’enjeux liés à : la conservation du pouvoir politique, la préservation de la paix sociale, le redressement économique et financier de l’État, le rétablissement de l’ordre public, la quête de la vérité et de la justice, l’obtention du pardon et de la réconciliation nationale.Elles ont donné lieu à une diversité d’initiatives avec pour corollaire une variété des moyens, coercitifs et pacifiques, utilisés pour sortir des situations de crise. En outre, les initiatives de sortie de crises politiques ont débouché sur des dynamiques de transitions constitutionnelles et de justice transitionnelle. Si elles ont constitué des processus distincts, elles n’en ont pas moins eu des finalités communes : la garantie des droits et la reconstruction de l’État de droit. Ces finalités communes peuvent coïncider de sorte que la dynamique de justice transitionnelle intègre le texte constitutionnel consacrant ainsi sa constitutionnalisation. Finalement, ces dynamiques transitionnelles ont constitué des fenêtres d’opportunités pour procéder à des réformes constitutionnelles et de politiques publiques
The dynamics of the political crises in Burkina Faso have been marked by multisectoral mobilizations having led to a cyclical desectorization of the social space, with the consequence of a mobility of the stakes of confrontations and collusive opposition and government transactions.These mobilizations were made around relative issues including: the conquest of state power, the control of the state apparatus; to the improvement of the living conditions of the workers; land ownership; the inviolability of constitutional rules relating to the exercise of State power; alternation at the top of the state; the participation of certain actors in the political competition; taking measures to mitigate the high cost of living and the quest for truth and justice.In the end, the multisectoral mobilizations have been at the origin of political changes which, according to the conjuncture, were either peaceful or violent.The different political strategies have forced the protagonists, but also third parties to these crises, to find solutions by the use of various strategies.These strategies out of political crises were played around issues related to: the preservation of political power, the preservation of social peace, the economic and financial recovery of the state, the restoration of public order, the quest truth and justice, obtaining forgiveness and national reconciliation.They have given rise to a variety of initiatives, resulting in a variety of means, coercive and peaceful, used to emerge from crisis situations. In addition, the initiatives to end political crises have resulted in constitutional transitions and transitional justice. Although they constituted distinct processes, they nevertheless had common goals: the guarantee of rights and the reconstruction of the rule of law. These common goals can coincide so that the dynamics of transitional justice integrate the constitutional text thus consecrating its constitutionalisation. Finally, these transitional dynamics constituted windows of opportunity to carry out constitutional and public policy reforms

International criminal law is at a crucial juncture in its history and progression. The year 2019 marks 26 years since the creation of the International Criminal Tribunal for the former Yugoslavia (‘ICTY’) and the commencement of the modern international criminal law project. In surveying the expanse of international criminal law at this time, it is clear that this project is at a crossroads, marked by a sense of transition and crisis. This stands in stark contrast to the jubilation and optimism that accompanied the creation of the ICTY. This thesis seeks to examine, analyse, and ultimately account for the forces that have driven international criminal law to this point. It does so using a unique methodological framework, which centres around an understanding of justice as a process. This process involves taking abstract beliefs about what is just (which we might term ‘justice beliefs’), focusing these into concrete aims for a particular international criminal tribunal (‘justice aims’), and embodying those aims in particular models and techniques to deliver justice (‘justice models’ and ‘justice techniques’), in order to deliver practical outcomes that ensure lasting legacies of justice (‘justice legacies’). Analysing the purposes and practices of the international criminal tribunals (‘ICTs’) through the lens of this ‘justice progression’, by examining the operation of the ICTs at each stage of this process, offers new insights into the operation of the ICTs, and reveals some of the hidden causes of the systemic problems they face. In particular, it reveals that at each stage of this ‘justice progression’ the ICTs fail to live up to the standards (beliefs, aims, models, techniques and legacies) that they set for themselves. This is due both to practical difficulties in implementation and, perhaps more significantly, flaws and assumptions implicit in those standards themselves, which skew the operation of the ICTs in particular, often problematic, ways.

This thesis examines local transitional justice programmes and processes in Sierra Leone. I will examine both recognised mechanisms – official institutions with preconceived goals and processes that are already recognised as part of the transitional justice ‘toolkit’ and unrecognised mechanisms – processes outside the institutional transitional justice scope and discourse. Much research and analysis of these processes often prioritise organisations and their programmes as the starting point of investigation and fail to recognise the various individual actors involved, both within the organisational structures and the groups for whom these programmes are designed. Moving beyond discussions of impact and effectiveness, this thesis examines the actual activity of Sierra Leonean individuals in both recognised and unrecognised processes. Fambul Tok is an example of a recognised local transitional justice programme, which seeks to facilitate justice and reconciliation through bonfire ceremonies to make the programmes more contextually relevant for rural communities. I will look at the various individuals involved in constructing and shaping how Fambul Tok operates and is represented to different audiences to better understand dynamics amongst different Sierra Leoneans with attachments to different places, all of whom theoretically constitute the local. My thesis will demonstrate how transitional justice processes are not only institutional, but also individual. I move away from discussions about ‘societies,’ normative questions of institutional effectiveness, the underlying assumptions that propel transitional justice programmes and mechanisms and look more specifically at the activities and appropriation of individual actors within these transitional justice processes to better illustrate the diverse means through which individuals construct as well as engage with local transitional justice programmes and the unique unrecognised ways individuals move past their war-related experiences.

This thesis explores the construction, implementation and experience of transitional justice at both the state-level in Uganda, and within the Acholi sub-region, the epicenter of the twenty-year war between the Government of Uganda and the Lord’s Resistance Army. It takes 2006 as its starting point, when peace talks began between both sides in Juba, southern Sudan. Conducted against the background of the ICC’s first ever arrest warrants for leading members of the LRA, these talks provided the empirical context for the major theoretical debates that dominated the nascent field of transitional justice. These included normative disagreements about the relationship between peace and justice and the relative merits of international versus indigenous approaches to justice. At Juba, an Agreement on Accountability and Reconciliation was signed and purported to address and resolve these dilemmas. To date however, we know remarkably little about the political and socio-legal dynamics and trajectory of transitional justice in Uganda since Juba. This thesis aims to bridge that gap, providing an in-depth, empirical study based on extensive fieldwork involving 106 semi-structured interviews, 25 focus group discussions and participant observation. Two major dissonances are identified in the promotion, practice and experience of transitional justice in Uganda since 2006. The first highlights the dilemmas surrounding contemporary donor approaches to transitional justice in the absence of a substantive domestic political transition. The interaction of a technocratic and apolitical donor approach with a reactive, procrastinatory and occasionally opportunistic GoU approach, created a stasis which prevented the emergence of a transitional justice policy for Uganda. The second area of dissonance identified was between the ‘local’ as imagined in transitional justice narratives and the local as lived experience in post-conflict Acholiland. Rhetoric around particular ‘Acholi’ approaches to transitional justice, focusing on values of forgiveness and reconciliation, has obscured both the complexity of post-conflict local justice practices and the extent to which these processes and their outcomes were highly contingent on the wider, post-conflict socio-economic context, including poverty, physical and spiritual insecurity, and other quotidian strains. Finally, in its treatment of the northern Ugandan case, this thesis contributes to broader theoretical debates about how transitional justice is constructed and practiced, particularly in contexts where there has been no substantial political transition.
