AIM The purpose of this study is to assess the appropriateness of Justin Martyr‘s apologetical arguments as contained in his genuine works, namely First and Second Apologies and Dialogue with Trypho the Jew, in response to the so-called “five-fold attack” against Christianity in the second century AD. Methodologically, by ‘appropriate‘ in this study is meant ‘suitable‘ or ‘proper,‘ taking into account the rhetorical and literary conventions of second-century Graeco-Roman culture, the contemporary social situation, Justin‘s rhetorical and/or intended audience and his purpose. Would Justin‘s arguments from the point of view of second-century standards have been reasonable, possessing at least a potential for effectiveness, or would they have been either ignored, dismissed without serious consideration, or even worsened the plight for Christians? I believe this work fills a significant gap in our knowledge of Justin, being the first time a comprehensive analysis of the effectiveness, or otherwise, of Justin‘s arguments has been made in one single study. SCOPE This Thesis is divided into six major chapters, plus a Conclusion: (i) In Chapter One I provide a brief introduction discussing how and why the Apologists emerged during the second century AD to meet the challenges of the day, as well as outlining the aim and scope of this study. (ii) In Chapter Two I discuss the nature of Christian Apology, its relationship to petitions to the Roman emperors, and how it compares to other (non-Christian) apologetic, protreptic, educational and missionary discourses. I also examine the rhetorical and literary conventions of the second century Graeco-Roman world and outline how Justin employed rhetoric in his three known works. (iii) In Chapter Three I outline in detail the particular attacks experienced by the Christians in Justin‘s time. (iv) In Chapter Four I examine the questions of intended destination, structure and purposes of Justin‘s apologetical works. (v) In Chapter Five I analyse the appropriateness of Justin‘s apologetical arguments in 1 and 2 Apologies. (vi) In Chapter Six I analyse the appropriateness of Justin‘s apologetical arguments in Dialogue. In all, eight distinct arguments from the Apologies (Behaviour, Beliefs, Due Process, Threat, Similitude, Dependence/Source, Antiquity/Prophecy, Miracles) and four distinct arguments from Dialogue (Superiority, Fulfilled Prophecy, Miracles, True Israel) are outlined in detail and then analysed giving the reasons for and against their appropriateness. CONCLUSIONS In my Conclusion, I argue that all of Justin‘s arguments were appropriate for one or more reasons, with only the argument of Threat in the Apologies being largely inappropriate. At the same time, all his arguments contained notable weaknesses, except for the argument of Similitude. The following table is provided, listing each of Justin‘s apologetical arguments and the number of reasons I give for their respective appropriateness/inappropriateness, together with a yes/no/mixed conclusion in the final column: [Table not shown].This table is simplistic, nevertheless it does illustrate that the question of appropriateness is rarely a simple one, as more often than not there exist simultaneous reasons for and against the appropriateness of any particular argument. How has this study furthered our knowledge and understanding of Justin and his apologetical works? What can we conclude about Justin and his works based on the appropriateness or inappropriateness of his arguments? It is clear that for both the Apologies and Dialogue the strengths of Justin‘s arguments outweigh their weaknesses. The strengths generally pertain to philosophical, religious, or ethical aspects of the works that are presented logically and cogently while the weaknesses, by and large, result from Justin‘s tendency towards arrogance and abuse. Justin wrote very much the way he lived. As a philosopher and skilled debater Justin was not above offending and demeaning those with whom he did not agree if he thought this would increase the reception of his message. His brilliance and arrogance proved to be a lethal combination and led to his ultimate silencing. It perhaps also curtailed the effectiveness of his writings for no change of policy was ever effected during his lifetime, or at least universally implemented.

L'etude consiste en une edition critique avec traduction, notes, commentaires (introduction, appendices), et indices, du dialogue avec tryphon (nʿ 1076 de la clavis patrum graecorum de geerard), oeuvre de controverse ecrite en grec par saint justin, dit justin le martyr ou justin le philosophe (mort circa 165). Elle vise d'une part a faire progresser l'etablissement du texte, d'autre part a contribuer a la connaissance des rapports entre christianisme, judaisme, et hellenisme a date ancienne, dans leur dimension historique, philosophique, exegetique, et theologique. Les commentaires s'appuient, en particulier, sur des rapprochements avec d'autres oeuvres des traditions patristique et rabbinique. Cette etude montre que des deux seuls manuscrits dont nous disposons pour cette oeuvre, le second (1541) est une copie directe du premier (1363). En depit des nombreuses corrections suggerees dans certaines editions anterieures, il apparait que le texte qui nous est parvenu est relativement fiable: ii presente une lacune centrale (chap. 74) dont il est possible de reconstituer le contenu en adoptant le mode de pensee tres particulier qui preside a la composition de cette oeuvre. L'exegese qui y est pratiquee presente elle aussi des traits originaux constitutifs de cette composition. Bien qu'il ait, semble-t-il, ignore l'hebreu, justin est assez bien informe des exegeses juives contemporaines dont il rend compte dans sa demarche missionnaire. Le dialogue avec tryphon est un authentique ecrit de controverse, mais il se distingue des oeuvres analogues par les intentions plus conciliatrices que polemiques de son auteur, et l'etendue du public vise.

This research aims to identify the guidelines that are opposed to Judaism in the body of the work Dialogue with Trypho of Justin Martyr, using the methodology engendered by Norbert Elias and John L. Scotson in their work, The Established and the Outsiders. As a result, our research intends to contribute to unveil another aspect of Justin’s work, considered by many scholars as a proselytistic tool; by taking it as a document builder of the Christian identity trough its dissociation from Judaism. For this reason, this thesis investigates and reviews the socio-cultural and political environment that gave rise to Roman Christianity, taking into consideration Christian internal conflicts and the resulting dichotomies within the Roman Christian community, as a result of its departure from its Jewish matrix.

The intention of this study is to analyze the proposal of the making of Christian identity from the work entitled First Apology, by Justin Martyr. We believe that in the formation of Christianity, some authors such as Justin, promoted the project of creating a Christian identity, from the rules and practices that should equalize / standardize the fact of being a Christian in the first and second centuries A.D. Justin, in his First Apology, indicates what should be done and what should be avoided to be considered Christian, and such discourse allows the production of identity characteristics. To achieve this goal, we investigated the relationships of interculturality in the first and second centuries A.D, we researched and presented specific aspects of author and his work, such as: its dating, the extant manuscripts, the genre, the historical context, etc. Finally, in the last chapter, we presented closely at particular aspects of the First Apology: its internal structure, his idea about Jesus, the Jewish prophecies, the Christians as a race, those who were not Christians and the groups considered heretical, the relationship of the author with the stoicism and the Platonism, the author s intention in drawing up his speech and, finally, about the Christian identity proposed by him seen from the data above.
A intenção do presente trabalho é analisar a proposta de construção de uma identidade cristã a partir da obra intitulada I Apologia, de Justino Mártir. Acreditamos que na formação do cristianismo, alguns autores como Justino, promoveram o projeto de criação de uma identidade cristã, a partir de preceitos e práticas que deveriam igualar/homogeneizar o fato de se ser cristão nos séculos I e II d.C. Justino indica na I Apologia o que se deveria fazer e o que se deveria evitar para se ser considerado cristão e tal discurso possibilita a produção de características identitárias. A partir dessa ideia, investigamos as relações de interculturalidade nos séculos I e II d.C., pesquisamos e apresentamos o autor e aspectos específicos de sua produção, tais como: datação, manuscritos existentes, gênero, o contexto histórico, etc. Por fim, no último capítulo, apresentamos detidamente aspectos particulares da I Apologia: sua estrutura interna, sua ideia de Jesus, das profecias judaicas, dos cristãos enquanto uma raça, que os diferenciavam dos que não eram cristãos e dos grupos considerados heréticos, a relação do autor com o estoicismo e o platonismo, a intenção do autor na elaboração do discurso e, por último, a identidade cristã por ele proposta a vista disto tudo.

This thesis examines the citation of Ps 68(67).19 in Eph 4.8. Following an introduction that introduces the problem of the altered wording in the citation in Eph 4.8, chapter 2 comprises a History of Research that is organised around the possible sources for the author’s citation in Eph 4.8. One of several conclusions made is that the proclivity of NT scholars to attribute the source text to particular Jewish traditions has contributed to overlooking the import of Ps 68(67).19 within a normal pattern of christological reading of the Psalms in early Christianity. Following these opening chapters, the thesis is divided broadly into Part One and Part Two. The first is deconstructive in nature; the second is constructive. Part One examines textual traditions of Ps 68(67).19 within Justin Martyr, the Peshitta Psalter, and Targum Psalms. Each of these sources share the reading ‘give’ rather than ‘receive’, raising the question of the relationship between these traditions and Eph 4.8. Chapter 3 examines Justin’s Dialogue with Trypho, which contains two citations of Ps 68(67).19 that strongly resemble Ephesians. Nevertheless, as nearly all interpreters acknowledge, Justin never refers directly to ‘Paul’ or ‘Pauline’ letters in any of his writings. Is the parallel wording of Justin’s citations evidence for an early Christian tradition that was also available to Ephesians? I argue that although unmentioned by name, a reasonable case can be made that Justin is familiar with the Pauline corpus, including Eph 4.8. Chapter 4 considers the evidence of Peshitta Psalms, which agrees with the reading of Eph 4.8 in a strand of its copyist tradition. After examining scholarly construals of the Peshitta MS tradition, I consider direct evidence for the influence of Eph 4.8 upon some Peshitta MSS as intimated by Theodore of Mopsuestia. Chapter 5 examines Targum Psalms, focusing on translation techniques and the targumist’s tendency to add, alter, or modify his source in various ways. I argue that when the targumist’s techniques and tendencies are taken into consideration, the targum’s reading ‘give’ is better understood as a typical targumic insertion. The proclivity of many scholars to link Targum Psalms to Eph 4.8 is a classic example of ‘parallelomania’. Part Two turns to make a constructive case for the citation found in Eph 4.8. Chapter 6 is a close examination of the author of Ephesians’ approach to literary borrowing. I consider both his citations from the Jewish scriptures and his use of Colossians as evidence. Chapter 7 examines how early Christians read the biblical Psalms as prophecies. Following a survey of Jewish readings of the Psalms, this chapter surveys how early Christians read the Psalms in light of the death and resurrection- exaltation of Christ. Drawing insights from this, chapter 8 turns to consider the phrases ‘he ascended . . . he gave gifts’ in Eph 4.8. I argue that an ambiguity of the addressee in the text of Ps 68(67).19 allowed for the application of this text to Christ. Moreover, the ‘ascent’ language could easily be applied to the resurrection- exaltation and this association naturally led to the language of gift-giving in Eph 4.8. Chapter 9 considers how the citation of Ps 68(67).19 fits into the context of Ephesians 4, focusing on several important factors such as the language of descent in Eph 4.9–10. Part One and Part Two are followed by a short conclusion that summarises the thesis and draws out several conclusions and implications based upon this study.

Le présent mémoire propose d’examiner, d’une façon approfondie et innovatrice, le rapport entre les chrétiens et Marc-Aurèle à travers une analyse complète des sources à disposition, notamment celles historico-littéraires, épigraphiques, numismatiques et législatives. En particulier, l’on démontrera l’absence de fondement de l’image faite a posteriori de Marc-Aurèle en tant que protector christianorum dont le premier témoin, d'après nos connaissances, est Tertullien. L’on montrera, par le biais d’une analyse législative des sources à notre disposition qu’à l’époque de Marc-Aurèle il n’y avait aucune loi qui protégeait les chrétiens. Bien au contraire, les dispositions de Trajan étaient toujours valides. Par la suite, nous chercherons à trouver les véritables raisons de la politique de Marc-Aurèle envers les chrétiens à travers la comparaison entre la pensée médio-platonicienne de Justin et celle stoïcienne du princeps. L’interprétation philosophique de l’attitude à montrer face à la mort, nous donnera une clef de lecture pour pénétrer les raisons les plus profondes des violences et des procès que les chrétiens ont subis au cours de son principat
This work aims to provide an original and thorough exploration of the relationship between Marcus Aurelius and the Christians by means of an in-depth analysis of the available historical, literary, epigraphic, numismatic, and legal sources. Specifically, it will show that the a posteriori view of Marcus Aurelius as protector Christianorum, apparently introduced by Tertullian, is unfounded. In support of this argument, a legal analysis of the available sources will show that, far from enjoying legal protection during the Principality of Marcus Aurelius, Christians were still subject to Trajan’s laws. The true reasons underlying the policy of Marcus Aurelius towards the Christians will be investigated by comparing the Middle Platonism of Justin Martyr with the stoic meditations of the princeps. In particular, the philosophical interpretation of the attitude deemed suitable in the face of death will provide an insight into the reasons that led to the wave of violence and to the trials of Christians under Marcus Aurelius’ rule

Comment peut-on concilier le respect des droits à la liberté des membres des générations futures et présentes ? Agir en faveur des premiers ne doit pas se faire aux dépens des seconds. Selon nous, la garantie pour tous de pouvoir développer et concevoir une conception spécifique de la vie bonne suppose de privilégier l'objectif d'une justice sociale globale dans le temps présent pour ainsi transmettre à la postérité un monde plus juste. Nous indiquons en premier lieu en quoi les générations qui se succèdent sur Terre ont des devoirs envers celles qui les suivront dans le temps, mais également pourquoi nos actes ne reflètent pas la reconnaissance de tels devoirs. Nous nous interrogeons ensuite sur le contenu du monde à transmettre en conformité avec ces devoirs. Il incombe aux générations de préserver autant que possible l'environnement naturel et d'édifier un environnement politique et social suffisant. Cela requiert la constitution d'une épargne intergénérationnelle au cours d'une phase limitée, suivie d'une phase de croisière dans laquelle l'accumulation doit être stoppée. Mais les efforts pour cette épargne et les ressources générées par celle-ci sont à répartir équitablement au sein et entre les générations : ce point est l'objet de notre troisième partie. Nous montrons que les efforts demandés à chacun au sein de la phase d'accumulation devraient dépendre de l'environnement dont disposent les individus, tandis que les ressources produites sont à redistribuer en priorité aux contemporains les plus démunis. Une telle préférence sociale pour le présent ne va pas à l'encontre des droits des individus futurs : elle permet au contraire de limiter la perpétuation, de génération en génération, des inégalités intragénérationnelles et de favoriser le respect de leurs droits par les individus qui vivent dans le temps présent
How can we reconcile the respect to liberty rights of members of future and current generations? Act in favour of the former should not be at the expense of the latter. According to us, the guaranty for all to be able to develop and conceive a specific conception of the good life involves favouring the objective of global social justice in the present time, and so transmitting to posterity a fairer world. We show first how the succeeding generations on Earth have duties to those who follow in time, but also why our acts do not reflect the recognition of such duties. Then we wonder about the content of the World to transmit in compliance with these duties. Generations bear the responsibility to preserve as much as possible the natural environment and to edify a sufficient political and social environment. This requires the constitution of an intergenerational savings during a limited phase, followed by a steady-state phase in which the accumulation must be stopped. But efforts to the savings and resources generated by it have to be distributed fairly within and between generations: this is the subject of our third part. We show that efforts required to everyone during the accumulation phase should depend on the environment available to individuals, while produced resources have to be redistributed primarily to the most disadvantaged contemporaries. Such a social time preference does not run counter the rights of future individuals: it allows instead to limit the perpetuation of intra-generational inequalities from generation to generation and to promote the respect of their rights by individuals living at the present time

Sen and Nussbaum generate very different degrees of obligation for the affluent under their theories of justice, despite each of them deriving their theory of justice from capability as a metric for quality of life. On one hand, Sen’s account of obligation seems very weak, while Nussbaum’s seems overwhelmingly robust. I argue that the sufficient/decisivereasons framework as put forth by philosopher Derek Parfit captures the nuances of their extremely different accounts of obligation. Further, I argue that this framework convincingly demonstrates that the accounts of obligation that Sen and Nussbaum offer in each of their versions of the capability approach are unsatisfying, as each approach occupies such extremes that they are unreasonable. In spite of this, supplementing the capability approach with a different and perhaps more centrist account of obligation can make the capability approach a more consistent and appealing theory of justice. To this end, I appropriate Thomas Pogge’s account of obligation.

Cette recherche vise à analyser l\'interprétation de l\'Allégorie de la Caverne, u um extrait de l\'oeuvre La République, de Platon, réalisé par Martin Heidegger, philosophe allemand. La recherche vise à mettre en évidence l\'originalité de l\'interprétation que Heidegger fait de ce passage célèbre de l\'oeuvre de Platon et de ce qu\'elle a été dévoilée par le philosophe allemand: le changement dans la détermination de l\'essence de la vérité. Confronterons les interprétations actuelles de l\'Allégorie de la Caverne faite par divers interprètes de l\'oeuvre de Platon, y compris par Hans Kelsen, aux l oeuvre de laquelle nous trouvons l\'influence de la philosophie platonicienne. Pour l\'interprétation de Heidegger sur l\'Allégorie de la Caverne, nous rencontrons la notion de aletheia (dévoilement) comme l\'essence de la vérité, établi de cette manière par les penseurs grecs d\'origine
Esta pesquisa visa analisar a interpretação da Alegoria da Caverna, trecho da obra A república, de Platão, feita por Martin Heidegger, filósofo alemão. A pesquisa procura evidenciar a originalidade da interpretação que Heidegger fez deste famoso trecho da obra de Platão e o que nela foi desvendado pelo filósofo alemão: a mudança na determinação da essência da verdade. Confrontaremos as interpretações correntes da Alegoria da Caverna feita por diversos intérpretes da obra de Platão, inclusive por Hans Kelsen, em cuja obra encontramos a influência da filosofia platônica. Na interpretação de Heidegger sobre a Alegoria da Caverna deparamo-nos com a noção de aletheia (desvelamento) como a essência da verdade, elaborada dessa forma pelos pensadores gregos originários.

Social violence is a serious problem in Latin America, an assertion that is thoroughly supported by statistics that identify Latin America as one of the most violent regions in the world (?Searching for Solutions in Latin America and the Caribbean? 20). These violent statistics explored in the very first chapter set the stage for this proposal by establishing its dire purpose. Formative historical legacies are central to social development, and they can provide the root causes and resentments that spur such social violence. There are a few that are common to the area of Latin America as a whole, such as the colonial experience and the slave trade, and these are examined alongside legacies of key leaders and educators that have shaped the face of the region and produced both pillars of hope and some of the greatest obstacles to social change. Understanding the root causes of violence and the formidable obstacles against effecting social change are key elements in designing and instituting a solution to this problem. Within this solution, education is a universally valid channel that, if given the necessary resources and personnel, could affect the lives of the majority of citizens. Combining the ideas of Martin L. Hoffman on the effect of inductive discipline encounters on children through character education, education becomes a powerful tool for creating not only more intelligent and autonomous citizens, but more empathic ones more attuned to an ?ethic of care.? While such a proposal certainly offers no guarantees and its successful institution would need to co-exist with other much needed social, political and economic reforms, it is presented as an innovative and experimental solution to a pressing problem taking a toll on the social and economic capital of societies in the region; a toll that is not easily ignored, particularly those for whom violence is an every day reality.

The ability to establish and maintain trust is regarded as a critical modern leadership skill. However, different conceptualisations of trust saw to it that the empirical and theoretical sides of research did not merge. As a result, trust has been studied in a variety of different ways and resulted in a varied and fragmented knowledge base, which this study attempts to address. The objectives of this study were to investigate conceptualizations of trust as perceived by middle- and senior level managers in a military medical basis in order to provide recommendations to management on how to build trust. Research was conducted in two phases of investigation. In phase 1 a literature review of the concept was conducted by analyzing and categorizing definitions and frameworks currently in use. In the second phase an empirical investigation was conducted by means of a descriptive and explorative qualitative research design and the use of a non-probability purposive sampling technique. The results showed that three proposed factors of trustworthiness (ability, benevolence and integrity), effective communication as well as perceived justice and fairness are fundamental to the establishment of trust. It is evident that management should draft a strategic plan to ensure that trust is established and maintained on a sustainable basis. The findings will contribute to a better understanding of the essential nature of trust and assist management in an effective approach to master trust as an essential leadership skill in order to successfully enhance business reputation and outcomes.

While an estimated one-third of the United States population has a tattoo, tattoos are still seen as a sign of deviance. The appearance of the first tattoos in the United States were relegated to the bodies of the lower classes and outcasts of society. Over the past few decades tattoos have migrated on to the celebrity skin of today's pop culture icons. In the past twenty years, tattoos have moved from deviant subcultures to the mainstream, and yet are still considered to be a mark of the disfavored factions of society. The dominant culture continues to regard the bearers of tattoos as social deviants, while at the same time appropriating tattoos for use as fashion statements, beauty enhancements, and mechanisms for continued oppression. While tattoos make their way from the prison cell to the pop culture runway, how are they perceived by law enforcement? Are tattoos still seen as markers of deviance or has law enforcement adopted the mainstream culture's perception and view tattoos as self-expressive artwork? Do tattoos negatively influence law enforcement's judgment where individual discretion is exercised? The purpose of this study was to examine the arrest patterns of arrestees with visible tattoos using a critical theory perspective to determine if tattoos and arrest seriousness are related. This study also examines tattoo placement and type in affecting the severity of arrest charges. The data used in this study is a random sample of 2011 Pinellas County Florida arrestees (N=3,733). Numerous logistic regression models were utilized in this analysis and resulted in no consistently significant association between tattoos (visibility, placement, or type) and severity of offense charges. This provides evidence that the use of tattoos as a marker for deviance does not appear to influence police behavior any differently than other characteristics such as race.

Notre these se concentre sur les aspects varies et les etapes successives de la presence de nietzsche dans le projet de destruktion de la metaphysique de la subjectivite entreprise par heidegger dans les annees qui suivent le premier cours consacre a lui en 1936 et jusqu'a la lettre sur l'humanisme (1946). Afin de mesurer l'importance de cette presence, nous etudions l'enchevetrement de la confrontation heideggerienne avec la metaphysique avec le dispositif conceptuel de la "justice", tel qu'il se met en place tout au long de cette etape de la confrontation heideggerienne avec la metaphysique a partir et, d'une certaine facon, grace a son interpretation de nietzsche. Lors de sa premiere apparition, dans l'introduction a la metaphysique (1935), la justice est dike (sikn) au commencement-initial (anfang) de la philosophie : nous designons cette figure primordiale de justice en termes de justice aletheiologique. Par ailleurs, sa traduction comme "ajointement" (fug) est le premier indice de la nouvelle approche de l'historialite comme structure existentiale du dasein resultant de son traitement insuffisant dans etre et temps (1927). En effet, le terme cle de cette transmutation, celui de l'evenement appropriant (ereignis), peut etre place sous la configuration du dispositif de la "justice" (dike, fug). Dans notre seconde partie, nous abordons un autre aspect de justice, a savoir la justice (gerechtigkeit) comme figure ultime de la verite metaphysique - justice veritative - en incompatibilite absolue avec la dike presocratique : c'est la separation radicale entre ceux deux figures de justice qui aboutit a la reduction de la position fondamentale de nietzsche a une figure de la metaphysique de la subjectivite. Our thesis focuses on the various aspects of nietzsche's presence in the heideggerian project of destruktion of the metaphysics of subjectivity in the years following his first lecture course on "the will to power as art" (1936) and until the letter on humanism (1946). In order to make this explicit, we study the association of the questions of subjectivity and justice in heidegger's interpretation of nietzsche. In fact, the theme of justice appearing in all his ontological implications for the first time in introduction to metaphysics (1935) gives access to the different ways in which nietzsche intervenes in his confrontation with the question of the origin and history of metaphysics. In the first place, justice is dike in the presocratic beginning of philosophy. Its translation as "joining" (fug) permits a new approach to the status of dasein's historicality in fundamental ontology. Actually, its reformulation in the major work of 1936-1938 beitrage zur philosophie (vom ereignis) is the result of the insufficient treatment of being and time. In our second part, we examine another aspect of heidegger's interpretation of justice (gerechtigkeit) in nietzsche qualified as the ultimate moment of the metaphysics of truth. The radical separation of presocratic dike from gerechtigkeit results in his definition as the "metaphysician of subjectivity". In the horizon of the history of being, the justice of life is represented (vor-gestellt) by the will to power. In our third part, we study the ontological status of modern technology as the result of the metaphysics of subjectivity. This is possible insofar as nietzschean justice is identified with rectitude (richtigkeit) and calculative thought (rechnung). In our introduction and conclusion, we concentrate on the hermeneutical nature of justice as "justice of the thought" taking as starting point the term of "differend" (auseinandersetzung) which caracterises the heidegger-nietzsche encounter from its very beginning

This dissertation is dedicated to a critical analysis of the merits involved in the work done by Martha C. NUSSBAUM in her book “Frontiers of Justice”, in which a new theory of justice is proposed by means of the adoption of her theses of the Central Human Capabilities. The Author of “Frontiers of Justice” has the intention to present a theory of justice that uses some of the basic elements obtained from the contractualist doctrine of John RAWLS, but that doesn’t stay restricted to the formal structure of the pure procedimentalism suggested in the Rawlsian work. That is why NUSSBAUM proposes that Rawlsian contractualism should be complemented in those elements that are positive in it with the substantial elements that are present in the Aristotelian Ethics. With this the Author tries to elaborate some sort of “Aristotelian contractualism”, by means of which theoretical elements of three philosophical traditions (classical, modern and post-modern traditions) are mixed into one theory of justice. This being so, the present study has the specific objective of analyzing the viability of the project that intents to combine distinct philosophical traditions, each having their own basic concepts and fundamental elements that could even be interpreted as incompatible with each other. Following some of the lessons of Alasdair MACINTYRE concerning the incommensurability and untranslatability of the concepts that are elaborated by different philosophical traditions, this study will try to evaluate NUSSBAUM’s success in presenting a theory of justice that combines the Aristotelian realism with the Rawlsian constructivism. For this it will be necessary to demonstrate that there exists between those philosophical traditions sufficient elements that are common and compatible with each other, which allows the organization of a new model of thought that is superior to both of the traditions of the past and that presents a theoretical structure that is more complex and that explains with higher coherence the defects and partialities of the points of view that are being superseded.
Esta dissertação dedica-se a avaliar criticamente os méritos do empreendimento realizado por Martha C. NUSSBAUM na sua obra “Frontiers of Justice”, em que se propõe elaborar uma nova teoria da justiça escorada em sua tese das Capacidades Humanas Centrais. Pretende a Autora elaborar uma teoria da justiça que parta dos elementos básicos extraídos da doutrina contratualista desenvolvida por John RAWLS, mas que não se mantenha adstrita a estrutura formal do puro procedimentalismo sugerido na obra rawlsiana. Para tanto, sugere NUSSBAUM seja o contratualismo rawlsiano complementado naquilo que possui de positivo por meio de elementos substanciais que são extraídos da Ética aristotélica, produzindo, com isso, uma espécie de “contratualismo aristotélico”. Mescla a Autora, desse modo, dentro de uma única teoria de justiça elementos teóricos que são extraídos de três tradições filosóficas distintas e possivelmente rivais, quais sejam: a tradição clássica, a moderna e a pós-moderna. Nesses termos, o presente estudo assume como objetivo específico analisar a viabilidade do projeto que pretende conjugar tradições filosóficas distintas e que possuem conceitos básicos e elementos fundantes que poderiam ser interpretados, inclusive, como inconciliáveis entre si. Martha Nussbaum has produced a compelling account of how we might do justice to non-human animals, but in doing so she seems to have committed us to a project of ‘policing nature’, which appears to be at odds with many of the ethical commitments of the contemporary environmental movement. Intervening to make the circumstances of wild animals more conducive to their flourishing may be in accordance with the principles of Nussbaum’s capabilities approach, but it is at odds with the concerns of environmentalists who wish to ensure the functioning of ecosystems and the survival of species as an ethical imperative. Superficially, at least, it appears that one cannot endorse the capabilities approach and simultaneously be an environmentalist. In this thesis, I attempt to reconcile these two positions through appeal to the exercise of the virtues. While many of the premises of the capabilities approach and of the environmentalist accounts of ethics that I discuss are mutually exclusive, I suggest that an environmental virtue ethic, such as that described by Ronald Sandler, can justify many of the ethical stances that the environmentalist wishes us to adopt. In particular, characteristics of the virtue of humility can inform the agent as to why extending justice to wild animals is not a warranted course of action. I also apply virtue ethical considerations to the issues of species extinction and ecosystem destruction, areas in which the capabilities approach seems to offer little guidance. Thus, I propose augmenting our capabilities-based account of justice with an environmentally conscious appeal to the virtues in order to produce more consistent moral guidance with regard to the non-human world.

The aim of this study is to examine how female refugees in Sweden experience that their escape and arrival to Sweden have formed their lives and wellbeing. The study seeks to understand how several women live their lives in relation to equality, discrimination and justice within the Swedish territorial borders. This is done with the Capability Approach by Martha C Nussbaum where she uses a list of universal values that should be central to women in every country, as a method of comparing how fair women live. I chose to interview six women who have fled to Sweden as refugees during the past 10 years, in order to see if the Capability Approach applies to them. I have also used Nancy Frasers theory of the scales of justice in my thesis. Fraser mentions three-dimensional politics where the inclusion of redistribution, recognition and representation should be achieved to create justice for women. The result showed that the women lack central capabilities such as the right to not being discriminated based on their ethnicity or religion, and the right to experience emotional development that is not bothered by traumatic experiences or unhealthy relationships. Furthermore, these women do not have the right to participate in political decisions that affect and shape their lives. The result in relation to Fraser’s theory indicates that these women have a limited freedom in Sweden. According to Fraser, there has to be an integration of a redistribution of resources, recognition, and a representation in Swedish politics, which benefit female refugees.

The emergence of Human Rights NGOs continue to influence the practice of human rights domestically and internationally. In connection with this development, as scrutinizers of human rights and human rights violations, the Human Rights NGOs must in turn be scrutinized. Guided by a theoretical framework consisted of theories of justification by Rainer Forst, Martha Nussbaum and Michael Ignatieff, a critical analysis of how Amnesty International and Human Rights Watch reveal the state of human rights in the respective annual report of 2017 is carried out. The aim is to scrutinize how the Human Rights NGOs interpretation, prioritization and justification of human rights affect the validity of human rights. The validity of human rights in turn, argues the thesis, presupposes that we must assess whether these strategies are reasonable. The thesis finds that human rights are understood as universal claims for the respect and protection of the underpinning values of human rights: dignity, freedom and equality. Human rights, interpreted in this sense, must have an abiding effect and protect human rights, but also to hold human rights violations accountable through means of justice. Accordingly, justice has a double meaning for the purpose of human rights in the sense that it firstly set out conditions for when human rights are protected and secondly, make this task possible.
I ljuset av framväxten av icke-statliga människorättsorganisationer och deras betydande inflytande på de mänskliga rättigheterna, syftar denna uppsats till att studera deras förståelse och tolkning av dessa rättigheter. Med hjälp av ett teoretiskt ramverk bestående av teorier om rättfärdigande av mänskliga rättigheter av Rainer Forst, Martha Nussbaum och Michael Ignatieff, genomförs en kritisk analys av hur Amnesty International och Human Rights Watch årliga rapporter om de mänskliga rättigheternas status ser ut. Syftet med denna analys är att kritisk granska hur organisationernas tolkning, prioritering och rättfärdigande av mänskliga rättigheter påverkar rättigheternas validitet. Validiteten i sin tur, förutsätter att en kritisk analys av dessa strategier förhåller sig till huruvida dessa är förnuftiga och godtagbara. Uppsatsen kommer fram till att mänskliga rättigheter förstås som universella anspråk vars syfte är att respektera och skydda de underliggande normerna av mänsklig värdighet, frihet och jämlikhet. Mänskliga rättigheter måste således ha en varaktig effekt för att skydda människor, men även för att kunna ställa brott mot mänskliga rättigheter inför rättvisa. Följaktligen har rättvisa mer än ett syfte, nämligen att först staka ut de förutsättningar som krävs för att respektera och skydda mänskliga rättigheter, och för det andra att göra detta möjligt.

Syftet med denna uppsats har varit att granska påståenden om djurs rättigheter och tolkningen av rättvisa för ickemänskliga djur utifrån Martha C. Nussbaums förmågemodell, och undersöka om den är förenlig med en fortsatt djurhållning. För att besvara min frågeställning har jag studerat Nussbaums förslag om hur människan kan och bör främja förmågor när det kommer till andra arter, samt direkta liksom indirekta kommentarer inom ämnet från utilitaristen Peter Singer och abolitionisten Gary L. Francione. Nussbaum är trevande i sitt försvar av rättigheter för ickemänskliga djur och motsätter sig inte dödandet av dem – även om detta konstateras som en form av skada, görs viss skillnad mellan olika arter och dödandet av dem värderas olika både utifrån art och syfte. Denna tanke återfinns inom utilitarismen, där det främsta målet är att minska lidande men dödandet av andra arter kan rättfärdigas av ändamål såsom kulinarisk njutning och ekonomisk vinning. Inom det abolitionistiska synsättet krävs nolltolerans när det gäller nyttjandet och dödandet av ickemänskliga djur, grundat i att det saknas en moralisk grund för människan att döda kännande varelser när andra valmöjligheter finns. Min slutsats blev att oavsett vilken teori vi ansluter oss till har vi i egenskap av människor en maktposition i relationen till ickemänskliga djur, vilket medför en skyldighet att inte utsätta andra arter för lidande eller ta deras liv ifrån dem då det inte är en fråga om en absolut nödvändighet.

Esta disserta??o dedica-se a avaliar criticamente os m?ritos do empreendimento realizado por Martha C. NUSSBAUM na sua obra Frontiers of Justice, em que se prop?e elaborar uma nova teoria da justi?a escorada em sua tese das Capacidades Humanas Centrais. Pretende a Autora elaborar uma teoria da justi?a que parta dos elementos b?sicos extra?dos da doutrina contratualista desenvolvida por John RAWLS, mas que n?o se mantenha adstrita a estrutura formal do puro procedimentalismo sugerido na obra rawlsiana. Para tanto, sugere NUSSBAUM seja o contratualismo rawlsiano complementado naquilo que possui de positivo por meio de elementos substanciais que s?o extra?dos da ?tica aristot?lica, produzindo, com isso, uma esp?cie de contratualismo aristot?lico. Mescla a Autora, desse modo, dentro de uma ?nica teoria de justi?a elementos te?ricos que s?o extra?dos de tr?s tradi??es filos?ficas distintas e possivelmente rivais, quais sejam: a tradi??o cl?ssica, a moderna e a p?s-moderna. The Capability Approach was initially developed by Nobel laureate Amartya Sen, with the first basic articulation presented in his 1979 ‘Equality of What?’ Tanner Lecture. Since then, the approach has gained a huge amount of attention as a conceptual framework which offers a clear and insightful way to measure well-being and development. Most recently, the approach has been refined and extended by Martha Nussbaum to issues of disability, nationality, and species membership in political philosophy. This project is about the foundations of the capability approach. More specifically, this project asks whether we can, and whether there are good reasons to, strengthen those foundations. The conclusions drawn here are that we ought to think seriously about the way that the capability approach develops as a theory that responds to real world challenges and change. More importantly, this project contends – in light of the challenges of future people and indigenous peoples – that there is good reason to think of new ways to ground the approach. This project takes up this challenge and grounds the approach in a modified version of Tim Mulgan’s approach to well-being. This project demonstrates that this alternative enriches the capability approach by providing us with a way of making sense of important problems, and with options for moving forward. Overall, this project asks important questions about how the capability approach could evolve based on challenges that remain relatively under-explored in the current literature. This project contributes to this literature by demonstrating that we can and ought to strengthen the capability approach and its ability to understand, take on board, and resolve these challenges.

Many studies have been carried out throughout the world on how street-connected children relate to the streets, but not enough of these studies are seen through a gender perspective. Hence, the general conception of street-connected children is in some manner still mainstreamed, which casts an image claiming all children in the same category. This demonstrates that there is currently a missing gap of knowledge. This study covers whether the role of gender could affect the lives of the children that live and work on the streets, through a qualitative research in the field with 28 interviewees. These interviews were largely conducted in Brikama, Serekunda, Topkunda, Farafenni, Madina Salaam and Bakau in The Gambia, where the majority of the Gambian NGOs and street-connected children is located. The results from analysing these interviews pointed towards the same pattern: that there were a few similarities in the livelihoods of the street-connected boys and girls. However, the differences concerning their livelihoods on the streets were greater since the findings demonstrated that their challenges and opportunities of achieving the Ten Central Human Capabilities were different. Street-connected boys and street-connected girls were both exposed to child labour. The main difference was, street-connected boys, who lived in groups, worked in car garages, fish industries and for shop owners, while the few girls who permanently lived on the streets, were alone and sexual exploited. This research is thus not merely a contribution to the studies of street-connected children, but how gender is relating to the streets. Furthermore, a contribution to improve these vulnerable children’s livelihoods and also increase the awareness through the perspective of humanities, which might be crucial in future policy recommendations and research.

On January 27, 2014 the International Court of Justice, principal judicial organ of the United Nations ruled in the case of the maritime dispute (Peru v. Chile), being Peru the one that brought forth the case in January 2008. During the proceedings in Court, the parties presented fundamentally different positions on the existence of a maritime boundary between them and how the Court should proceed solving the dispute. The Court should have considered the multiple legal reasonings presented by the States parties over the years to arrive to its ruling. Particularly, some of the legal reasonings presented by Peru were accepted by the Court and considered in the ruling, beginning from the interpretation given to the proclamations of Peru and Chile in 1947, going through the reasonings Peru presented about the 1952 Santiago Declaration (It was the main topic presented by Chile, which was discarded by the Court) until the reasoning presented by Peru saying that the 1954 Special Maritime Frontier Zone Agreement didn’t create a zone of tolerance that extends to 200 nautical miles. However, the Court considered that in the 1954 agreement the parties accepted the existence of a tacit agreement, but this existence was not presented by them in the Court even though it has a legal support in the jurisprudence of the International Court of Justice. Then, the Court had to determine the extent of the tacit agreement, a very difficult duty because the parties hadn’t considered the existence of that situation and its extension. After establishing the implied legal agreement was for 80 nautical miles along a parallel of latitude, the Court proceeded to establish a maritime boundary applying thoroughly the rules and principles of maritime delimitation presented by Peru, which applied to the case determine the presence of an equidistant line. In relation to the starting-point of the maritime boundary, the Court didn’t use the point presented by Peru but, in a correct way, made it clear that the starting-point of the maritime boundary and the starting-point of the land boundary don’t have to match necessarily. Finally, the way how the Court established the maritime boundary recognizes, with no doubt, that the area previously named “outer triangle” belongs to Peru, as this country claimed and as Chile opposed repeatedly over the years. In summary, it is a decision based on International Law and adopted under the evidence presented in Court. The Court applied and confirmed various legal arguments presented by Peru during the process, in spite of the opposing position of Chile.
El 27 de enero de 2014, la Corte Internacional de Justicia (CIJ), órgano judicial principal de la organización de las Naciones Unidas, dio su sentencia en el caso de la controversia marítima (Perú c. Chile), el cual el Perú presentó ante ella en enero de 2008. Durante el proceso ante la Corte, las partes presentaron posiciones fundamentalmente distintas sobre la existencia de un límite marítimo entre ellas y sobre cómo la Corte debía proceder para resolver este caso. Para llegar a su fallo, la Corte debió evaluar esos múltiples argumentos legales planteados por ambos Estados a lo largo de años. En particular, varios de los argumentos legales planteados por el Perú fueron aceptados por la Corte y acogidos en el fallo, desde la interpretación que dio a las proclamaciones de Perú y Chile de 1947, pasando por los argumentos que planteó el Perú sobre la Declaración de Santiago de 1952 (que había sido el núcleo del caso argumentado por Chile, el cual fue descartado por la Corte), hasta el argumento peruano en el sentido de que el Convenio sobre Zona Especial Fronteriza Marítima de 1954 no creó una zona de tolerancia que se extienda por doscientas millas marinas. Sin embargo, la Corte consideró que en ese tratado de 1954 las partes reconocieron la existencia de un acuerdo tácito, figura que no argumentaron las partes ante la Corte, pero que tiene su fundamentación legal en jurisprudencia previa de la CIJ. La Corte luego tuvo que determinar la extensión de ese acuerdo legal tácito, labor sumamente difícil ya que las partes no habían contemplado la existencia de esa figura ni argumentado hasta dónde se habría extendido la misma. Luego de establecer que el acuerdo legal tácito se extendía por ochenta millas marinas a lo largo de un paralelo de latitud, la Corte procedió a establecer un límite marítimo siguiendo exactamente las normas y principios sobre delimitación marítima planteados por el Perú, los cuales aplicados al caso determinan el establecimiento de una línea equidistante. Con relación al punto de inicio del límite marítimo, la Corte no empleó el punto planteado por el Perú pero, correctamente, dejó en claro que el punto de inicio del límite marítimo y el punto de inicio del límite terrestre no tienen necesariamente que coincidir. Finalmente, la manera como la Corte estableció el límite marítimo reconoce sin lugar a duda que el área antes llamada «triángulo exterior» corresponde exclusivamente al Perú, como ese Estado argumentó y Chile se opuso repetidas veces a lo largo de los años. En resumen, se trata de una decisión ajustada al derecho internacional y tomada sobre la base de la evidencia a disposición de la Corte, en la que esta emplea y confirma diversos de los argumentos legales planteados por el Perú durante el proceso, a pesar de todo lo que Chile argumentó contrariamente.

Es contextualitzen aquestes relacions en el marc de les pautes de relació exterior de la Xina Ming i en el conjunt de la inserció asiática de les Filipines espanyoles del segle XVI. També es contextualitzen en el marc de les disputes entre ordes religioses i en el marc de l'entrada del jesuitas Mateo Ricci i Michele Ruggieri a Xina. S'hi destaca la importància de la relació Macau-Manila. La tesi edita i anota una sèrie de documents en xinès, castellà i portuguès que permeten verificar i concretar tot el procés de relació i els projectes espanyols de conquesta de Xina, que van arribar a presentar-se a la cort de Felip II.

Cette étude part de la conviction que les deux notions de politique et de langage, analysées en interprétation mutuelle, peuvent approfondir notre compréhension et critique de l'œuvre philosophique de Lévinas. Dans le premier chapitre, le profil de Lévinas lecteur de Husserl et de Heidegger est esquissé pour comprendre la manière dont Lévinas travaille en philosophie, ainsi que les premiers problèmes qu'il a formulés et dont la notion de totalité représente la conception générale. La philosophie du premier Heidegger est présentée afin d'être utilisée comme clef heuristique dans notre lecture de Lévinas. La pensée politique, que Lévinas a développée comme réponse au problème du totalitarisme, est reconstituée dans le deuxième chapitre en comparaison avec le libéralisme. Le troisième chapitre analyse le politique inscrit dans la métaphysique de Lévinas en explorant d'abord les manifestations de la totalité et ensuite l'altérité qui échappe à la totalité. L'aspect langagier de cette métaphysique est examiné dans le dernier chapitre. Progressivement, ce chapitre analyse le rapport entre le politique et le langage et débouche sur une critique centrée sur deux problèmes : l'impossibilité d'interpréter la signifiance de l'altérité et le danger inhérent à la conception d'une justice dépassant l'Etat
This study is driven by the conviction that our understanding and criticism of the work of Lévinas could be advanced by a mutual interpretation of the themes of politics and language. In the first chapter a profile of Lévinas as reader of Husserl and Heidegger is sketched in order to understand the way in which Lévinas philosophises and to get to grips with the first problems he formulated where the critique of totality is the central theme. The philosophy of the first Heidegger is presented in order to be used as a heuristic key to our reading of Lévinas. The political thought that Lévinas developed in response to the problem of totalitarianism is reconstructed and compared with liberalism in chapter two. The third chapter analyses the latent politics in the metaphysics of Lévinas, first by exploring the manifestations of totality, and then, the alterity that escapes from totality. The linguistic aspect of this metaphysics is examined in the last chapter, which analyses progressively the relation between politics and language. The study results in a criticism centred around two problems: the impossibility of interpreting the significance of alterity and the danger inherent in a conception of justice as exceeding the limits of the State

Today, some twelve million immigrants are unlawfully present in the United States. What response to this situation does Christian theology suggest for these immigrants and those who receive them? To this question about the status of immigrants before the law, the theological literature lacks an understanding of how federal U.S. immigration law developed, and it lacks a robust theological account of the governance of immigration. To fill this gap, the thesis presents three stages in the formation of the laws that designate some immigrants as aliens unlawfully present or illegal aliens, drawing out the moral argumentation in each phase and responding with moral theology. In the first stage, non-citizens were called aliens in U.S. law. In response to the argument that aliens exist as a consequence of natural law, Christian teaching indicates that immigrants are not alien either in creation or for the church. In the second stage, the authority of the federal government to exclude and expel aliens was established, leaving those who do not comply to be designated illegal aliens. To the claim that the federal government has unlimited sovereignty over immigration, interpretations of the Christian Scriptures respond that divine sovereignty limits and directs civil authority over immigration. In the third stage, legal reforms that were intended to end discrimination between countries allowed millions from countries neighboring the U.S. to become illegal aliens. These reforms turn out to be unjust on philosophical grounds and unneighborly on theological grounds. While federal law classes many as aliens unlawfully present in the United States, Christian political theology indicates that immigrants are not alien, the government of immigration is limited by divine judgment, and nationals of neighboring countries deserve special regard.
