The employer's liability in the event of the occurrence of an occupational hazard, or a simple failure to meet his preventive obligations, hinges on the essential notion of the safety obligation. Pełny tekst źródłaThe complexity of operating a vessel requires that crew members have in depth knowledge in a wide variety of areas. The International maritime training that has been standardized by the STCW convention is one of the elements that helps to guarantee their ability to make the maritime expedition a success. But it is not enough. The shipowner is the key actor in this area. His personal investment to maintain and develop technical knowledge, to supervise vessel operation and to implement an appropriate human factor strategy, is crucial for controlling the competencies of his crew to prevent potential damages that could result from human errors. It is very interesting to see that maritime law considers this investment in determining the civil liability regime to which shipowners will be subject for the damages caused by negligence of his crew. His involvement in implementing efficient human strategies will allow him to benefit from wide exemptions or limitation of liability. The very protective civil liability regime he enjoys will nevertheless be lifted, at least partially, for his own omissions that contribute to the damage. Maritime law therefore encourages, in a certain way, shipowners to get involved in vessel crewing. The reality is actually more nuanced because the difficulties to lift this specific regime are various. The protections that are granted to a shipowner will then appear to be a demobilizing factor in controlling the human element, which is essential for maritime safety

A worker injured will can request flate-rate compensation. This accident compensation will be established on the basis of income and professionally incidence. Personal damages are excluded except case of inforgivable fault employer's. State employee haven't same traitment than worker and he has got a best protection. At last, it is right to say road accident victim's, mugging victim's could ask indemnity on bodily injuri. They could request personal and economic damages. In view of inequality, we make changes to system in order to cancel these gap in compensation. This willingness to abolish inequality it's current political and human rights practices. From now on, it's imbelievable to think to deprive workers of personal damages while this accident are effects on the private life employee. That is why, hand work recommend solutions to restore equality between citizen

Pełny tekst źródłaThe study of the social welfare of the farmer victim of accidents reveals theexistence of disparities between the victims themselves and between the industrial accidentsand the common law. These disparities are inherent to farmer’s quality; whether he isemployed or not, the latter does not benefit from the same rights. In addition, the injuredfarmer in the course of his professional activity will have only a fixed compensation. Thelatter tends to compensate the loss of income and the professional incidence of the accident.Compensation for personal injury is excluded except in the hypothesis of unforgivablemisconduct of the employer. As for the victims of accidents of common law, their socialwelfare is only optimized if they possess a top up insurance plan that will completerepayments in cash and in kind of the agricultural system. Except the coverage of the basiclegal system, the compensation of accidents of common law tends to be complete. In order toensure that all accident victims are treated with equal manner by law and that compensationfor all their injuries can be achieved, we recommend solutions so that the disparities betweenthe farmers victims of accidents can disappear
