This project is an examination of the Hong Kong film industry, focusing on the years leading up to the handover of Hong Kong to communist China. The influence of classical Chinese culture on gender representation in martial arts films is examined in order to formulate an understanding of how these films use gender issues to negotiate a sense of cultural identity in the face of unprecedented political change. In particular, the films of Hong Kong action stars Michelle Yeoh and Brigitte Lin are studied within a feminist and cultural studies framework for indications of identity formation through the highlighting of gender issues.

Film watching is a popular leisure activity in modern society. Films, as a medium, provide powerful tools to deliver social messages and to create images of particular social groups. The cinematic images portrayed by films toward a particular social group may consequently shape our social perceptions and expectations of that social group. The ways that cinematic images portray older persons are, therefore, a potentially major source for detecting social values and views about them. As some cinematic images tend to reflect social attitudes and behaviours, the present research aimed at investigating how popular films portray the images of older persons. Focus was on the examination of: 1) the representation of older persons in Hong Kong movies, 2) whether older persons are positively or negatively portrayed in movies, and 3) any changes in the cinematic images of older persons over the last two decades. The present research examined Hong Kong movies released between 1981 and 2001. The population of the present study is the most popular Hong Kong movies, based on the turnover of the Hong Kong ticket offices. The sampled films were derived from the three highest-turnover movies for each year from 1981 to 2001. Content analysis was employed in this study to determine the representation and images of older persons in the 63 sampled movies. Generally speaking, older persons were found to be under-represented in the sampled movies relative to their presence in the population. Older persons were portrayed as having white hair, wrinkle skin, and walk independently in terms of physical appearance. Older persons were also portrayed as having generally good health status. However, older persons were portrayed to have a decline in both family status and socio-economic status in the 1990s as compared to that of the 1980s. In terms of occupation, most older persons were portrayed as retired persons in the movies. Apart from these features, the present research also found that there was a gender differences in the portrayal of older persons. Many older persons were depicted in the movies in the home setting, perhaps reinforcing traditional Asian family values and stereotypes. However, this perhaps underplays older persons’ active roles and contributions in the light of such current concepts as productive and active aging. There is a temporal division in that older persons in many movies of the 1980s were portrayed as more home-based while, in the 1990s, they were becoming more actively involved in external activities.

This paper explores the way Hong Kong independent comics encapsulate the essence of the city. Independent comics are distinguished from mainstream comics by their specific mode of production. More significantly they demonstrate an emphasis on subjective personal creativity and craftsmanship, which stands out sharply in the pervasive objective culture in modern society. Adopting an anthropological approach in representing local ways of living, these comics attempt to map an identity of Hong Kong in a way that is free from confusing influences of her postcolonial history, her political subordination to China and the global capitalist forces. The artists of independent comics embrace the essence of local culture by focusing on space and cultural memory and thereby rediscovering the truth and characteristics of life in Hong Kong. As a form of popular cultural text, Hong Kong independent comics package the local identity and history into fashionable goods for cultural consumption. Together with this, the articulation of a shared past creates forces of cohesion that binds the community together and offers a way for the people to negotiate their identity.

The Basic Law of the Hong Kong Special Administrative Region established the legal and judicial systems of the Hong Kong Special Administrative Region (HKSAR) of the People’s Republic of China. The courts of the HKSAR are vested under the Basic Law with the independent judicial power of the HKSAR, and are authorized to interpret the Basic Law. The common law based legal system is maintained in the new order under the Basic Law. The HKSAR courts have interpreted the Basic Law as the constitution of the HKSAR, and, using the traction provided by the constitutionalization of the Basic Law, made and filled for themselves the role of a constitutional check on the executive and legislative branches of government to ensure that they act in accordance with the Basic Law, with the constitutional jurisdiction to invalidate executive decisions and legislations found to be inconsistent with the Basic Law. This Thesis considers the exercise of judicial power in the HKSAR along three trajectories. The first tackles the challenges to the legality and legitimacy of the constitutional jurisdiction of the courts of the HKSAR to review legislations of the HKSAR, principally propounded by Mainland Chinese scholarship. The arguments set out in the most representative of such scholarship are each examined and rebutted. Nevertheless, the courts of the HKSAR are vulnerable to the exercise of the power of interpretation by the Standing Committee of the National People’s Congress (NPCSC) of certain provisions of the Basic Law touching upon the review of legislation and the adjudication of cases. The second concerns the relationship between the HKSAR courts and the coordinate branches of government of the HKSAR, namely the executive authorities and the legislature. Through an examination of the methodologies and procedures in which the HKSAR courts review legislation, it is found that they have calibrated and tempered the process of review, including the countering of justification with deference and the innovation in remedies, to palliate the effect of judicial scrutiny. The third examines the incidents where the exercise of judicial power in the HKSAR impinges upon a national law element under the Basic Law, the chief of which is the Court of Final Appeal making a reference of provisions of the Basic Law to the NPCSC for interpretation before final adjudication. The Court adopted strategies to resist the making of a reference to the NPCSC, taking a ‘second-best’ approach in limiting the effect and influence of Mainland legislative measures and legal theory in the HKSAR. It is possible for the Court to act as a last bastion of the autonomy of the HKSAR. This Thesis concludes with a cautious look at the erosive risks to the duty of the HKSAR courts to exercise constitutional jurisdiction posed by the findings above and the trend of indigenization of jurisprudence. The jurisprudence of the HKSAR must, in its own interest, stay cosmopolitan.

Posthuman representations in selected Hollywood and Hong Kong science fiction films show new interconnections in “techno-globalization.” They also exhibit a waning relationship between the “center” and the “margin” of technoculture. This study discusses the relation of technology, humanity, affect, and aesthetics in selective science fiction films produced from 1984 to 2010. The science fiction features were made in the United States and in Hong Kong. They include: The Terminator (1984), Terminator2 (1991), Terminator Salvation (2009), A.I. Artificial Intelligence (2002), I Love Maria (1988), Kung Fu Cyborg (2009) and Future X-Cops (2010). In particular, Kung Fu Cyborg merges the popular genre conventions of martial arts and technoculture, and manifests a different imagination at work wherein Hong Kong’s martial arts cinema stands in the place of a scientific-based Western technoculture absent in Hong Kong science fiction films. This study presents several key critical frames elaborated by scholars of science fiction who have assessed the recurrent themes and figures of science fiction films. The discussion of films identifies the resemblances, the differences, and the competitive dynamic between American science fiction films and Hong Kong action features. The absence of utopian or dystopian figures in posthuman filmic representations in Hong Kong cinema is considered an important difference from Western science fiction films. This thesis examines the figure of the cyborg and argues for the important place of emotions and the power to emote and hope as having a complex relationship to technology, humans and humanness. The compassionate cyborg has temporal and moral dimensions relating to belief and religion in this important genre. Thus, this thesis examines the backdrop for science fiction affect, which is one of oppression and crisis that speaks to the conditions of capitalism and modernity. The affective cyborgs make an important figure in the science fiction films that concern the crisis conditions, the appeal of technology, and the conventions of science fiction genre in commercial cinema.

Following the growing emphasis on the monitoring role of independent directors in the board of directors in the stock exchanges of Western developed countries, companies listed on the Hong Kong Stock Exchange are required to appoint independent non-executive directors (INEDs) representing at least one-third of their boards under the Listing Rules. Unlike those Western developed capital markets where listed companies are widely held, most listed companies in Hong Kong are controlled and managed by families. This means realistically, INEDs of those family-controlled listed companies can only be appointed to the boards with the support from the controlling owners. Under such circumstances, the INEDs' ability to monitor the performance of the management of those companies independently is put in doubt. This thesis intends to conduct a qualitative study using phenomenological approach to explore and understand the role and effectiveness of INEDs in family-controlled listed companies in Hong Kong based on the INEDs' lived experiences. The study is the first of its kind in the Hong Kong corporate governance research arena, as research studies on corporate boards and directors have often adopted a quantitative approach, using only publicly available archival data without in-depth discussions with the subjects on their real experience and views on their jobs. Accordingly, issues related to directors in family-controlled listed companies that require in-depth discussions with these directors are impossible to be addressed by such research approach. Through semi-structured interviews with INEDs of companies listed in Hong Kong, this thesis has contributed to the existing knowledge and literature in the research on INEDs and corporate governance in family businesses and provide useful hints and ideas to practitioners, listed companies, investors, regulators and policy-makers.
